Home, vacant property, tourist rental — occupants without right or title

Squatter lawyer in Paris: assess the occupation, start eviction.

An occupied home, an empty house taken over, an Airbnb guest who stays on after the booking ends: the procedure depends on how the occupant entered and on the title relied upon. The firm, acting as a squatter lawyer in Paris, checks the evidence, examines the prefectural route and, where necessary, prepares a court application for eviction and an occupation indemnity.

The forty-eight hours in Article 38 relate to the prefect's decision once the request has been received, and do not guarantee evacuation within that period.

What a squatter lawyer in Paris does

  • Paris Bar
  • Real estate law
  • Eviction and unlawful occupation

Reda Kohen, lawyer at the Paris Bar, sees clients at 11 rue Margueritte, 75017 Paris, to review the documents and the steps already taken.

The word squat covers legally distinct situations: forced entry, staying on after a tourist rental, accommodation provided without charge that has been withdrawn, or a marital separation. The firm reconstructs how the occupant entered the premises and looks for any contract, authorisation or family decision allowing the occupation.

Article 38 of the Law of 5 March 2007 provides for administrative evacuation subject to conditions, in the version applicable on 25 October 2026. In parallel, an urgent application for eviction (référé) allows the judge to be asked to bring a manifestly unlawful occupation to an end, in accordance with Article 835 of the Code of Civil Procedure (Code de procédure civile). The choice takes account of the evidence, the applicable enforcement time limits and any claim for an occupation indemnity.

Entry into the premises

Occupation without title does not, on its own, prove entry by an act of force: the material circumstances must be documented.

The prefectural procedure

The file brings together the criminal complaint, proof of the home or of ownership, and a record of the unlawful occupation made by an authorised authority.

Enforcement of the eviction

The period following the formal demand and the winter eviction moratorium are governed by separate rules, whose exceptions must be examined separately.

The rules

Squatter law: the conditions for evacuation and eviction

How the occupation is characterised determines the choice of procedure and the conditions for implementing it.

  1. The administrative route requires the conditions of Article 38 of Law No. 2007-290 of 5 March 2007: a criminal complaint, proof of the home or of ownership, and a record made by an authorised authority. The text covers in particular entry by manoeuvres, threats, acts of force or coercion, as well as staying on after a furnished tourist rental has expired.
  2. Article 835 of the Code of Civil Procedure allows the urgent applications judge to put an end to a manifestly unlawful disturbance. The Court of Cassation reiterates that "any occupation of another person's property without right or title constitutes a manifestly unlawful disturbance" (our translation) (Cass. 3e civ., 4 July 2019, No. 18-17.119).
  3. Article L. 412-1 of the Code of Civil Enforcement Procedures (Code des procédures civiles d'exécution) provides for two months after the formal demand before eviction from an occupied dwelling. That period does not apply if the judge finds bad faith or entry by the unlawful means set out in the text. However, "the existence of an act of force cannot result from the mere occupation of premises without right or title" (our translation) (TJ Toulouse, JCP REFERES, 28 January 2025, No. 24/03270).
  4. Article L. 412-6 of the same code governs the winter eviction moratorium and its exceptions, which are distinct from those applying to the period after the formal demand. The Paris judicial court refused to set aside the protections invoked: "the claimant does not prove that they entered by means of manoeuvres, threats, acts of force or coercion" (our translation) (TJ Paris, PCP JCP référé, 25 November 2025, No. 25/07738).

Bad faith may rule out the two-month period without automatically removing the winter eviction moratorium: each exception requires its own demonstration.

Your documents

Squatter in a house: the documents to gather

The documents must establish your right, how the occupant entered, and the absence of any current title on the occupant's part.

Position A

Home or property occupied unlawfully

  • Title deed and proof of residence, depending on the situation
  • Criminal complaint filed and record of the unlawful occupation
  • Dated photographs of access points and of any signs of forced entry
  • Timeline of discovery and exchanges with the authorities or the occupant

Position B

Entry initially authorised

  • Airbnb booking, seasonal contract or accommodation agreement
  • Agreed departure date and any extension agreements
  • Letters ending the authorisation and proof they were received
  • Lease, title deed and family decisions in the event of a separation

Avoid any private eviction by threats, violence or coercion: Article 226-4-2 of the Criminal Code (Code pénal) penalises forcing an occupant to leave in this way. Preserve the evidence and put the conditions for recovering the premises to the firm.

The firm also handles:

  • Eviction of tenants
  • Residential leases
  • Seasonal rentals
  • Occupation indemnities

The method

How the firm prepares the recovery of the premises

Checking the right relied upon and the evidence available makes it possible to choose a course of action suited to the situation found.

Step 1

Reconstructing the occupation

The firm examines the title deed, the circumstances of entry, any contract and the notices already sent to the occupant.

Step 2

Choosing the procedure

It checks the conditions of Article 38 and, depending on the file, prepares a referral to the prefect or a summons for an urgent eviction application (référé).

Step 3

Presenting the claims

The argument distinguishes between recovery of the premises, the exceptions to enforcement time limits and the interim payment claimed as an occupation indemnity.

Step 4

Following the enforcement

The firm coordinates the steps with the enforcement officer (commissaire de justice) and checks the formalities, the applicable time limits and the actual return of the premises.

An eviction order does not dispense with enforcement formalities: Article L. 411-1 requires, unless a special provision applies, an enforceable title and a formal demand to vacate the premises.

The timetable

Evicting a squatter: the verifiable steps and time limits

The administrative route and the judicial route follow separate timetables, with no guaranteed overall time for recovering the property.

  1. Building the evidence

Gather the title, document the occupation and the conditions of entry; file a criminal complaint and obtain the record required for the prefectural route.

  2. Refer the matter to the prefect if the conditions are met

Formal notice decision within forty-eight hours of receipt of the request. Article 38 requires the personal and family situation to be examined; a refusal must rest on the statutory conditions or an overriding reason of general interest.

  3. Complying with the administrative formal notice

At least twenty-four hours; seven days if the premises are not the applicant's home. Where the premises are not that home, Article 38 also provides for enforcement to be suspended if the urgent application provided for in the text is brought.

  4. Obtaining a court decision where that route is chosen

The judge examines occupation without title, the manifestly unlawful disturbance and the claims for indemnity, on the basis of documents produced in adversarial proceedings.

  5. Checking the conditions of judicial enforcement

Two months after the formal demand for an occupied dwelling, unless an applicable exception applies. The firm checks this period, the winter eviction moratorium and the terms set by the decision separately, before any eviction operation.

  6. Recording the departure and closing the accounts

The return of the keys or the eviction report establishes that the premises have been vacated; financial claims are closed off according to the title obtained.

The checks

What the firm checks before seeking eviction

The analysis covers the right to occupy as much as the conditions for actually recovering the premises.

  • Capacity of the applicant: owner, person whose home is occupied, or person acting in that person's interest and on their behalf.
  • Nature of the premises and of the occupation: home, vacant property, furnished tourist rental, accommodation, or property involved in a separation.
  • Conditions of entry and end of title: documented forced entry, established manoeuvres, contractual expiry or revocation of an authorisation duly notified.
  • Enforcement regime: prefectural formal notice, court-ordered formal demand, two-month period and winter eviction moratorium, with their respective exceptions.
  • Justification of the indemnity claimed: period of occupation, characteristics of the property, rental value and documents establishing any separate losses relied upon.

Summary

Situation, evidence, time limit, action

The term squatter is not enough to identify the procedure: the circumstances of entry and the current rights remain decisive.

Situation

Home occupied after unlawful entry

Decisive evidence: Proof of the home, criminal complaint, record made by an authorised authority and material establishing the conditions of entry.

Time limit: Administrative formal notice: enforcement period of at least twenty-four hours.

Useful action: Request to the prefect based on Article 38, if its conditions are met.

Situation

House or flat left vacant and occupied unlawfully

Decisive evidence: Title deed, record of the occupation and proof of the methods used to enter.

Time limit: Seven days for the administrative formal notice if the premises are not the applicant's home.

Useful action: Examine the prefectural route; prepare the urgent eviction application where the judicial route is chosen.

Situation

Airbnb guest staying on after the end of the stay

Decisive evidence: Furnished tourist rental contract, booking, end date of the stay and absence of any agreed extension.

Time limit: Administrative period determined by whether or not the premises are the applicant's home.

Useful action: Check how Article 38 applies in its current wording, then choose the suitable course of action.

Situation

Person housed without charge who refuses to leave

Decisive evidence: Initial agreement, terms of the accommodation, notification that it has ended and continued presence in the premises.

Time limit: Notice period suited to the initial title; examination of the judicial time limits after the formal demand.

Useful action: Establish that the authorisation has ended, then seek eviction if the absence of title is established.

Situation

Ex-spouse or former partner who has stayed in the home

Decisive evidence: Lease, title deed, separation judgment and decisions concerning occupation of the home.

Time limit: Depends on the rights established, the family decisions and the enforcement regime that applies.

Useful action: Check the occupant's personal rights before determining the court and the claims to make.

Situation

Occupation without title causing financial loss

Decisive evidence: Dates of occupation, characteristics of the home, rental references and supporting documents for the losses claimed.

Time limit: Period accepted by the judge in light of the documents and the actual departure of the occupant.

Useful action: Quantify the occupation indemnity; seek an interim payment in urgent proceedings if the obligation is not seriously contestable.

Frequently asked questions

Your questions: squatting, eviction and occupants without title

A squatter is occupying my house: what should I do first?

Begin by gathering the documents establishing your right to the property and the material describing the circumstances in which the occupant entered. For the prefectural route, Article 38 requires a criminal complaint, proof of the home or of ownership, and a record of the unlawful occupation. According to the text, that record must come from a judicial police officer (OPJ), the mayor or an enforcement officer (commissaire de justice). Photographs of the access points and written exchanges complete the file, but do not replace that record or necessarily show who is responsible for any forced entry. The firm then examines the administrative procedure and the possibility of an urgent eviction application, depending on the evidence and any title relied upon. Avoid forcing the occupant to leave yourself by threats or coercion: this private eviction is penalised by Article 226-4-2 of the Criminal Code.

The 48-hour squatting rule: must squatters be discovered within forty-eight hours?

Article 38 does not set a forty-eight-hour period after entry into the premises within which the right to request evacuation must be exercised. That period concerns the prefect's formal notice decision, counted from receipt of the request, after examination of the personal and family situation. It is therefore neither a limitation period on your request nor a promise that the home will physically be recovered. The formal notice then carries an enforcement period of at least twenty-four hours where the premises are the applicant's home. Where they are not the applicant's home, that period is extended to seven days, with a suspension mechanism if the urgent application provided for in the text is brought. The firm distinguishes between these stages in order to present a well-supported request and assess what follows if the occupant does not leave.

Does the squatter law also protect a vacant property?

The administrative procedure under Article 38 is not limited to a main residence: it also covers premises used as housing. For a vacant property, it is necessary in particular to establish ownership and the required unlawful means of entry, and then to attach the criminal complaint and the record made by an authorised authority. An empty house therefore does not remove the need to document the manoeuvres, threats, acts of force or coercion relied upon in support of the request. If the premises are not the applicant's home, the administrative formal notice carries the seven-day period provided for in the text. The judicial route remains to be examined where the situation or the evidence justifies an eviction application before the competent judge. The exceptions to the judicial winter eviction moratorium are then assessed separately, because another person's home and other premises are not governed by exactly the same regime.

An Airbnb occupant refuses to leave: is the prefectural procedure available?

Article 38, in the wording in force since 20 August 2026, expressly covers staying on after the expiry of a furnished tourist rental contract. It would therefore be wrong to rule out this procedure solely because the initial entry was authorised for a tourist stay. It must nevertheless be verified that the contract does concern a furnished tourist rental within the meaning of Article L. 324-1-1 of the Tourism Code (Code du tourisme), and that its end date is established. The mere presence of a booking on a platform does not replace analysis of the contract, its extensions and the documents available. Send the booking, the agreed dates, the exchanges and the documents establishing your ownership, so that the criminal complaint and the required record can be prepared. The firm examines referral to the prefect and, depending on the objections raised, the judicial route for seeking eviction and an occupation indemnity.

How can I get a person housed without charge to leave when they refuse?

First, the terms of the initial authorisation, its end date if any, and the way its termination was notified to the occupant must be determined. Accommodation provided without charge should not be presented as forced entry where you personally authorised the occupant to move into your home. In a case of accommodation with no fixed end date, the Grenoble judicial court examined the revocation of the authorisation and compliance with a reasonable notice period. It then held: "Remaining in the premises beyond that period thus amounts to a manifestly unlawful disturbance" (our translation) (TJ Grenoble, Ch4.3 JCP, 8 October 2026, No. 26/00134). That decision sets no universal notice period applicable to all accommodation arrangements, whose circumstances and agreements may differ. The firm examines the documents available before preparing the appropriate notification, and then the eviction application if remaining in the premises becomes unlawful.

My ex-spouse is still in the home: can I have them evicted as a squatter?

Separation does not, on its own, make a former spouse an occupant of the home without right or title. The firm checks the lease, ownership of the property and the family decisions that may authorise or organise use of the home. Article 1751 of the Civil Code (Code civil) provides in particular for joint holding of the lease of the home actually used as the spouses' residence, even where the lease predates the marriage. It also provides that the right to the lease may be allocated to one of the spouses on divorce or judicial separation. A personal title or an allocation decision must therefore be examined before seeking eviction for occupation without right or title. Send the deeds and judgments available: they determine each party's current rights, the court to approach and the claims that can be considered.

Can a squatter be evicted during the winter eviction moratorium?

Article L. 412-6 provides for a stay of judicial evictions from 1 November to 31 March, except in particular where rehousing meeting the statutory conditions is available. That stay does not apply to an eviction based on entry without title into another person's home by the unlawful means referred to in the text. For entry by those means into other premises, the judge may remove or reduce the benefit of the moratorium. Proof of these circumstances remains necessary: simply describing the occupant as a squatter is not enough to obtain application of a statutory exception. The Paris judicial court noted this in its decision of 25 November 2025 cited above, refusing to set aside the protections for lack of proof of the means of entry alleged. Finally, the bad faith referred to in Article L. 412-1 concerns the period following the formal demand and does not automatically remove the moratorium.

Can an occupation indemnity be claimed from a squatter?

A claim for an occupation indemnity must be quantified and justified, specifying the period concerned and the material establishing the rental value of the property. In urgent proceedings, Article 835 allows an interim payment to be awarded where the existence of the obligation is not seriously contestable, within the limits of what is established. The Toulouse judicial court accordingly rejected an insufficiently documented claim: "The claim for a monthly occupation indemnity will therefore be dismissed as unjustified." (our translation) In the reasons for its decision of 28 January 2025 cited above, it notes in particular the absence of material making it possible to verify the rental value. The firm gathers the characteristics of the home, the rental references and the documents establishing the dates of occupation and of actual return of the premises. Damage or other separate losses that may be relied upon must be documented separately, and not confused with mere loss of enjoyment.

How does a squatter lawyer in Paris prepare an urgent eviction application?

The firm begins by establishing your standing to act, the actual occupation of the property and the absence of any title allowing the occupant to remain. The documents must also make it possible to answer an accommodation authorisation, a contract or a family decision invoked in defence. The summons then sets out the manifestly unlawful disturbance, the claims concerning enforcement time limits and, where justified, an interim payment on the occupation indemnity. Article 835 allows that disturbance to be brought to an end even where there is a serious dispute, provided its manifestly unlawful nature is established. The hearing timetable and enforcement depend on the file; no overall time for recovering the home can be inferred from the mere fact of using urgent proceedings. The preliminary review is offered at €80 incl. VAT; it provides a first analysis of the documents sent before the appropriate steps are determined.

Thank you to Maître KOHEN for his analyses of recent case law on fraudulent non-disclosure in property sales. It reassures me about an action for annulment that I am considering after buying a house affected by serious defects intentionally concealed by the seller and not reported by the estate agent; also defects (rising damp) characterised by spreading through-cracks and damp stains, not reported by the estate agent… Worse, defects concealed by the latter or at his instigation, under a coat of paint and by polystyrene tiles glued to the ceiling of a bedroom. And the said estate agent drafted the preliminary contract, which of course contains no information about any of these defects. Just to add that, being 77 years old and suffering from cognitive impairment, I am certain that the estate agent thought I would not be able to discover the deception and above all to establish the fraudulent intent, still less to bring legal proceedings given the complexity and length of the procedure... That is why I am opting for the criminal route, insofar as the intentional concealment of the defects by the seller and then by the estate agent amounts to the fraudulent manoeuvres of art. 313-1 of
