Social security lawyer in Paris: defending employers and the self-employed against the funds.
URSSAF inspection, letter of observations, reclassification of a contractor, contribution base, enforcement order, recognition of an occupational accident or daily allowances for a self-employed person: a social security lawyer in Paris first reads the rules applicable to the period concerned, then the procedure followed by the agency.
Time limits are short: thirty days to reply to the letter of observations, two months to refer the matter to the amicable appeals board (commission de recours amiable), fifteen days to lodge an opposition to an enforcement order (contrainte). Keep every notification and its date of receipt.

What a social security lawyer in Paris does
- Paris Bar
- Social security contributions
- Employers and the self-employed
Reda Kohen, lawyer at the Paris Bar, can act for employers, company officers and self-employed workers in their disputes with the URSSAF (social security contributions agency), the primary health insurance fund (caisse primaire) and the pension and occupational health insurance fund (caisse d'assurance retraite et de la santé au travail).
For a business, social security law is first a matter of contributions: who must be affiliated, on which sums, for what period and under what inspection procedure. Article L. 242-1 of the Social Security Code (Code de la sécurité sociale) sets the contribution base, and Article L. 243-7 entrusts the inspection of employers and the self-employed to the collection bodies.
It is also a matter of the benefits whose cost the employer bears, such as occupational accidents and diseases charged to its account, and, for the self-employed, of daily allowances calculated from the contributions actually paid.

Inspection and reassessment
The inspection notice, the letter of observations, the adversarial period and the inspector's reasoned reply frame every later challenge.
Status of individuals
Employee, officer treated as an employee, self-employed or micro-entrepreneur: affiliation depends on the actual working conditions, not on the title of the contract.
Occupational risks
The investigation of an accident or illness and its allocation to the employer's account determine the final cost borne by the business.
The rules
Contributions, inspection, benefits: the rules that apply
Four sets of rules govern the analysis of an employer's or a self-employed person's case.
- All persons employed, or working in any capacity for an employer, are affiliated to the general scheme, whatever the form of their contract (Article L. 311-2 of the Social Security Code). The Court of Cassation (Cour de cassation) recalls that “Work within an organised service may constitute an indication of a relationship of subordination where the employer unilaterally determines the conditions in which the work is performed” (our translation) (Cass. 2e civ., 19 March 2026, No. 24-10.948).
- Contributions are assessed on earned income, subject to exhaustively listed exclusions, including certain termination payments up to two annual ceilings (Article L. 242-1 of the Social Security Code). A settlement sum that compensates for a loss remains outside this regime and the contribution base (Cass. 2e civ., 30 January 2025, No. 22-18.333).
- Except for inspections targeting undeclared work, every inspection is preceded by a notice sent at least thirty days before the first visit; the letter of observations opens an adversarial period of thirty days, which may be extended to sixty on a request received before the period expires, unless illegal work is found (Article L. 243-7-1 A), and the inspector gives a reasoned reply to detailed observations (Article R. 243-59). An item already inspected without comment cannot be reassessed if the circumstances are unchanged (Article R. 243-59-7), but an assessment notified since then deprives this tacit approval of effect (Cass. 2e civ., 27 June 2024, No. 22-18.178).
- The formal notice must be specific and reasoned (Article L. 244-2), and contributions are subject to a three-year limitation period running from the end of the calendar year for which they are due, or from the following 30 June for the self-employed, extended to five years where illegal work is recorded in an official report (Article L. 244-3 and Article L. 244-11). If no opposition is lodged within fifteen days (Article R. 133-3), the enforcement order has all the effects of a judgment (Article L. 244-9).
A challenge is prepared from the letter of observations onwards: a decision of the amicable appeals board that was not challenged in time then closes off the discussion before the judge.
Your documents
What to send, depending on your situation
The documents received and their notification dates set the time limits; the business's own documents determine the merits.
Situation A
You are an employer or a principal
- Inspection notice, letter of observations, reply sent and the inspector's response
- Formal notice, decision of the amicable appeals board, enforcement order and proof of receipt
- Contracts for services, invoices, vigilance certificates and exchanges with subcontractors
- Accident or illness reports, the fund's questionnaires and notifications of occupational accident and disease (AT/MP) contribution rates
Situation B
You are self-employed
- Contribution demands, payment schedules granted and annual adjustments
- Professional income returns and proof of payment
- Contracts and invoices with your clients, evidence of your own organisation
- Sick leave certificates, notifications of daily allowances and the fund's statements
Date every receipt: most time limits run from notification, and a mislaid envelope or acknowledgement of receipt makes proof harder.

- URSSAF inspections
- Companies in difficulty

The method
How the firm supports you
Place the case within the procedure, then challenge form and substance, head by head.
Step 1
Chronology and time limits running
The firm reconstructs the sequence of documents received, from the inspection notice to the enforcement order, and identifies the next time limit at risk of being missed.
Step 2
Head-by-head review
Each head of assessment or each decision to recognise a claim is checked against the rule applicable to the period inspected and the documents actually consulted.
Step 3
Written reply and amicable appeal
The firm drafts the reply to the letter of observations, then the complaint to the amicable appeals board, addressing each point in dispute.
Step 4
Court and enforcement
If the disagreement persists, the firm brings the matter before the social division (pôle social) of the judicial court or lodges an opposition to the enforcement order, and examines any enforcement measures taken. Disputes over AT/MP contribution rates fall instead to the Amiens court of appeal.
A procedural irregularity does not dispense with arguing the merits: the case must stand on both grounds at once.
The timetable
The timeline of a contributions dispute
From the inspection notice to the court's decision.
Inspection notice
At least thirty days before the visit. Except for inspections targeting undeclared work, the notice is mandatory; it refers to the charter of the inspected contributor and the right to be assisted by the adviser of one's choice.
Letter of observations
It sets out the documents consulted, the period checked and the heads of assessment; the reply is due within thirty days, which may be extended to sixty on a request received before the period expires, unless illegal work is found.
Inspector's reply
Where the contributor replies within the time limit, the inspector gives a reasoned reply to each detailed observation.
Formal notice
Specific and reasoned, it starts a one-month period before the agency may issue an enforcement order.
Amicable appeal
The amicable appeals board must be seized within two months of notification of the decision challenged (Article R. 142-1).
Enforcement order and court
Opposition is lodged within fifteen days before the competent court; failing that, the enforcement order has the effect of a judgment.
The checks
What the firm checks before acting
No challenge rests on a general impression that the assessment is excessive.
- Status of the people paid: employee, company officer, self-employed or micro-entrepreneur, in light of the actual conditions of work.
- Regularity of the inspection: prior notice, content of the letter of observations, the inspector's reasoned reply and the length of the adversarial period.
- Period claimed: years covered by the formal notice, start of the limitation period and its suspension during the adversarial period.
- Contribution base used: nature of each sum, business expenses, benefits in kind, termination payments and the calculation method applied.
- Route and time limit for challenge: amicable appeals board, opposition to an enforcement order, challenge to the AT/MP rate or to the allocation to the employer's account.

Frequently asked questions
Your questions: social security law
When does a business need a social security lawyer?
A social security lawyer can step in as soon as the inspection notice arrives, and not only at the stage of the court. Article R. 243-59 of the Social Security Code allows the person inspected to be assisted by the adviser of their choice during the inspection, and the letter of observations must recall this possibility. The outcome often takes shape at this point, because the written reply sets the points in dispute and the documents placed on the file. Involvement is also justified when a formal notice, an enforcement order or a notification of an occupational accident contribution rate arrives, because each document opens its own time limit, often a short one. For an employer, the issues concern the contribution base, the status of the people paid, joint liability with a subcontractor or the recognition of a claim. For a self-employed person, they concern provisional contributions, their adjustment and the calculation of daily allowances during sick leave. The firm examines the procedure followed by the agency, then the merits of each sum claimed. It finally checks whether a prior request for a ruling (rescrit), provided for by Article L. 243-6-3, would have made it possible, or would still make it possible, to secure a practice for the future.
How should you respond to a URSSAF letter of observations?
The letter of observations opens the adversarial period. Under Article R. 243-59 of the Social Security Code, the person inspected has thirty days to reply. This period may be extended to sixty days at their request, provided the agency receives it before the initial period expires, the extension being deemed accepted if there is no reply. Article L. 243-7-1 A rules out this extension where illegal work is found, as referred to in points 1° to 4° of Article L. 8211-1 of the Labour Code (Code du travail). The reply may provide any clarification, propose additions to the list of documents consulted and justify corrections already made during the inspection. Where it arrives within the time limit, the inspector must reply, and each detailed observation calls for a reasoned response that sets out, ground by ground, the amounts dropped and those maintained. The content of the letter itself can also be challenged, but with restraint. The Court of Cassation holds that “Only the documents that were actually used to establish the merits of the assessment or to calculate its amount must appear in the letter of observations” (our translation) (Cass. 2e civ., 4 December 2025, No. 23-16.341). In that case, decided under an earlier version of the text, the inspected bank's appeal to the Court of Cassation was dismissed and the assessments upheld. A purely formal criticism therefore carries little weight unless it identifies a decisive document that was omitted. The firm drafts a point-by-point reply, with figures, supported by the business's own documents.
Does an earlier inspection without observations protect the business?
Only sometimes. Article R. 243-59-7 of the Social Security Code prohibits an assessment concerning items that did not give rise to observations during a previous inspection of the same company or the same establishment. Two conditions apply in addition: the agency was able to rule in full knowledge of the facts on the basis of the documents consulted, and the legal and factual circumstances have remained unchanged. The Court of Cassation applies these conditions strictly. Under the earlier version of the text, it held that the absence of observations amounts to tacit approval for the practices checked, “provided that the collection body had the means to rule in full knowledge of the facts” (our translation) (Cass. 2e civ., 20 December 2018, No. 17-26.952), and it quashed the judgment that had protected the company even though the new profit-sharing agreement no longer used the same criterion. It also holds that notification of an assessment ends the tacit approval for the future, even where that assessment was later annulled by a court, and it dismissed the contributing bank's appeal to the Court of Cassation (Cass. 2e civ., 27 June 2024, No. 22-18.178). Both decisions went against the contributors. The firm therefore compares the two inspected periods, document by document, before relying on this argument in the reply to the letter of observations.
Can you ask the URSSAF before applying a pay practice?
Yes, through the social ruling procedure (rescrit social) provided for by Article L. 243-6-3 of the Social Security Code. A contributor or prospective contributor may raise a new question, not devoid of serious substance, on how the rules on affiliation to the general scheme or on contributions checked by the URSSAF apply to their specific situation. The agency must then give an explicit ruling. The request is no longer possible once an inspection has begun or where a dispute on the same question is pending. The decision obtained is binding on the agencies for the future for as long as the situation described and the applicable legislation have not changed. Where the agency does not reply within the time limit set by decree, no assessment based on the legislation concerned may be made for the period between the expiry of that time limit and the explicit reply. The accuracy of the statement of facts therefore determines the extent of the protection: an incomplete description of the situation does not cover the business's actual practice. The firm can draft the request, gather the relevant documents and then check that the practice followed remains consistent with the situation presented. For a group, the request may specify that the reply will apply to companies in an identical situation.
Can the URSSAF reclassify an independent contractor as an employee?
Yes, where the actual working conditions reveal a relationship of subordination. Article L. 311-2 of the Social Security Code affiliates to the general scheme any person working for an employer, whatever the form or nature of their contract, and Article L. 242-1 then makes the sums paid subject to contributions. Subordination must nevertheless be demonstrated precisely. On 19 March 2026, the Court of Cassation quashed a judgment that had upheld an assessment on the basis of the absence of invoices, a fixed fee and an office made available, holding that these were “insufficient grounds to establish the existence of a relationship of subordination” (our translation) (Cass. 2e civ., 19 March 2026, No. 24-10.948). The court must examine whether the person worked under the authority of an employer who gives orders, monitors their performance and penalises breaches. The case was sent back to the Caen court of appeal and the URSSAF was ordered to pay the costs. For a business, the defence consists in establishing the contractor's real autonomy: freedom of organisation, own clientele, absence of instructions and invoicing of the services. The firm gathers this evidence from the reply to the letter of observations onwards: produced early, it weighs on the position of the inspector and then of the board, even though it can still be supplemented before the court.
Does micro-entrepreneur status rule out employee status?
No. Article L. 8221-6 of the Labour Code presumes that persons registered, in particular with the national register of businesses or with the URSSAF, are not bound to the principal by an employment contract. This presumption can be rebutted. In a case concerning a heavy goods vehicle driver registered as a micro-entrepreneur, the Court of Cassation held that this presumption, which benefits persons under that status, “may be rebutted where it is established that they provide services to the principal, directly or through an intermediary, in conditions that place them in a relationship of permanent legal subordination to the principal” (our translation) (Cass. 2e civ., 28 November 2019, No. 18-15.333). The driver drove the company's lorries, used its licence and presented himself on sites as a member of the company; the company's appeal to the Court of Cassation was dismissed and the sums paid were reintegrated into the contribution base. This unfavourable decision shows what tips a case: equipment supplied, integration into the team, imposed dates of work. Conversely, a diversified clientele, one's own work tools and an autonomous way of organising the work support independence. The firm examines the relationship as it is carried out day to day, and not only the contract signed between the parties.
Are settlement payments made to an employee subject to social security contributions?
It all depends on its purpose. Article L. 242-1 of the Social Security Code excludes from the contribution base, up to twice the annual social security ceiling, termination payments that are not taxable, and makes those exceeding ten times that ceiling fully subject to contributions. This regime covers sums that genuinely have the character of a termination payment. The Court of Cassation holds that it does not cover “sums which, although awarded on the occasion of the termination of the employment contract, are intended to compensate for a loss” (our translation) (Cass. 2e civ., 30 January 2025, No. 22-18.333). In that case, the settlement agreement compensated the moral and professional losses arising from the conditions of performance and termination of the contract; the appeal to the Court of Cassation was dismissed and the payment remained outside the contribution base for its full amount. The drafting of the agreement is therefore decisive: it must describe the losses compensated, their origin and their link with the employee's grievances. A settlement that merely increases a dismissal payment exposes the employer to reintegration in an inspection. The firm reviews the agreement, the exchanges that preceded it and the chronology of the dispute in order to defend the characterisation adopted before the URSSAF and then before the court.
How many years can the URSSAF claim contributions for?
Under Article L. 244-3 of the Social Security Code, social security contributions are subject to a three-year limitation period running from the end of the calendar year for which they are due. For the self-employed, this period runs from 30 June of the following year. It is extended to five years where an illegal work offence has been recorded in an official report (Article L. 244-11), which bears directly on reclassifications and subcontracting. In the event of an inspection, the limitation period is suspended during the adversarial period opened by the letter of observations. The calculation must therefore start from each year claimed, then take account of the steps taken since. The Court of Cassation recalled, under the wording resulting from the Law of 21 December 2011, that “the warning or formal notice may relate only to contributions falling due during the three calendar years preceding the year of its dispatch and contributions falling due during the year of its dispatch” (our translation) (Cass. 2e civ., 19 February 2026, No. 23-20.461). It quashed the judgment that had declared the URSSAF's claim time-barred, the formal notice having been sent within the period: the decision went against the contributor, who was ordered to pay the costs. A limitation period is therefore not to be presumed from the age of the debt alone. The firm reconstructs, year by year, the due dates, the date the formal notice was sent and the date the court was seized, before raising this argument.
What should you do after being served with a URSSAF enforcement order?
Act without delay. Under Article R. 133-3 of the Social Security Code, the enforcement order may be issued where the formal notice remains without effect one month after its notification. The debtor has fifteen days from notification or service to lodge an opposition before the competent court; the opposition must be reasoned and accompanied by a copy of the enforcement order. Failing that, Article L. 244-9 gives the enforcement order all the effects of a judgment, including a judicial mortgage. The scope of the debate depends on what was done beforehand. Departing from a 2019 ruling, the Court of Cassation holds that “a contributor who did not challenge the formal notice before the amicable appeals board may, in support of an opposition to the enforcement order issued on the basis of that notice, challenge the regularity of the procedure and the merits of the grounds of the enforcement order” (our translation) (Cass. 2e civ., 22 September 2022, No. 21-10.105, published in the Bulletin), and it quashed the judgment that had validated the enforcement order. The position is different where the board was seized and its decision, notified with the routes and time limits for challenge, was not challenged in time. The firm therefore first checks what was submitted to the board, then the mandatory particulars of the notification and the amount claimed. Where the enforcement order arises from a finding of illegal work, it becomes provisionally enforceable two calendar days after its notification, for the sums assessed on that basis; the president of the court seized of the opposition may stay its enforcement where there is a serious ground of invalidity and a risk of manifestly excessive consequences.
Can a principal be liable for its subcontractor's contributions?
Yes, where it has not carried out its checks. Article L. 8222-1 of the Labour Code requires a principal to verify, when concluding a contract above a minimum amount and then periodically until it ends, that the other party is meeting its filing obligations. Article D. 8222-5 deems these checks to have been made if the principal obtains, at signature and then every six months, a certificate less than six months old whose authenticity it checks, accompanied, where registration of the other party is mandatory or it practises a regulated profession, by a registration extract or equivalent document. The certificate is issued under Article L. 243-15 of the Social Security Code. Failing that, Article L. 8222-2 of the Labour Code, whose wording applicable from 26 December 2026 maintains this rule, makes the principal jointly and severally liable for the contributions owed by a subcontractor reported for undeclared work. Handing over the documents is not always enough. The Court of Cassation holds that the presumption of verification “does not apply where there is a discrepancy between the declarations stated on those documents and the volume of working hours needed to perform the service” (our translation) (Cass. 2e civ., 30 January 2025, No. 22-19.808). It quashed the judgment that had set aside the assessment without examining, as it had been asked to, whether the vigilance certificate, which stated two employees for a payroll of €691, was inconsistent with the information available to the principal. This decision went against principals. The firm therefore compares the certificates received with the real volume of the site or service, and documents the checks made at each six-month deadline.
How can an employer challenge the recognition of an occupational disease?
Through the investigation procedure. Article R. 461-9 of the Social Security Code gives the fund one hundred and twenty clear days to decide or to refer the matter to the regional committee for the recognition of occupational diseases. It sends a questionnaire to the employer, who has thirty clear days to return it. At the end of the investigations, the file is made available: the employer has ten clear days to consult it and submit observations, and may then still consult it without submitting observations until the decision. The fund must tell the employer the dates of these periods at least ten clear days before they begin. For an occupational accident, where the fund opens an investigation, Article R. 441-8 provides a comparable mechanism within ninety clear days of receipt of the accident report and the initial medical certificate. Formal compliance with these steps is often enough for the fund. The Court of Cassation quashed a judgment that had held the recognition not enforceable against the employer for lack of an effective day of consultation after the observation period, finding that “the fund had satisfied the obligations placed on it by the text referred to above” (our translation) (Cass. 2e civ., 4 September 2025, No. 23-18.826). This decision went against employers. The firm checks the dates of dispatch and receipt and the content of the file consulted, then the occupational nature of the condition itself.
Can an employer challenge the allocation of a claim to its AT/MP rate?
Yes. Article L. 242-5 of the Social Security Code provides that the occupational accident and disease contribution rate is set each year by the pension and occupational health insurance fund, under rules laid down by decree that pool certain costs. This rate depends in particular on the claims entered on the employer's account. Challenging the allocation of an occupational disease does not require having challenged the rate for the year concerned. The Court of Cassation holds that “the employer is entitled to challenge the allocation of the consequences of an occupational disease to its employer account without being met by the time bar on challenging the last contribution rate notified and without having to wait for the notification of future rates” (our translation) (Cass. 2e civ., 7 April 2022, No. 20-18.310). It quashed the judgment that had declared the claim inadmissible, while leaving final the rate for the year that was not challenged. This litigation over contribution rates, referred to in point 7° of Article L. 142-1, falls to the Amiens court of appeal (Article D. 311-12 of the Code of Judicial Organisation) and is exempt from the mandatory prior appeal under Article L. 142-4. The firm examines the statement of the employer account, the origin of each claim allocated and the possibility of requesting that certain costs be entered on the special account.
How are the contributions and daily allowances of a self-employed person calculated?
The contributions of non-agricultural self-employed persons, other than micro-entrepreneurs, are due annually. Article L. 131-6-2 of the Social Security Code provides that they are first calculated on a provisional basis on the income of the year before last, then recalculated and adjusted once the final income is known; the contributor may ask for a calculation on their estimated income for the current year. The contribution base itself is defined by Article L. 131-6. These contributions then determine the benefits. Under Article D. 622-7, the daily allowance equals 1/730th of the average of the income used for sickness contributions over the three preceding calendar years, up to the annual social security ceiling, or three times that ceiling for the liberal professions covered by Article L. 640-1. During the first three calendar years of affiliation, a specific calculation applies, based on the income taken into account until the incapacity is recorded. If contributions have not been paid in full, the income is multiplied by a coefficient equal to the ratio of contributions paid to contributions due, unless a payment period that was granted has been respected. Under the earlier version of the text, the Court of Cassation had recalled that “the amount of the daily allowance equals 1/730th of the average annual professional income of the last three calendar years taken into account for calculating the contribution” (our translation) (Cass. 2e civ., 21 June 2018, No. 16-26.894), and quashed, with costs against the insured person, the judgment that had confused entitlement with the calculation of the amount. The firm checks the declared income, payments and payment schedules before any challenge.

What our clients say
Best real estate law and business law lawyer in Paris. A humane and attentive lawyer, with a wonderful team. Thank you, Maître KOHEN
Translated from French
Thank you to Maître KOHEN for his analyses of recent case law on fraudulent non-disclosure in property sales. It reassures me about an action for annulment that I am considering after buying a house affected by serious defects intentionally concealed by the seller and not reported by the estate agent; also defects (rising damp) characterised by spreading through-cracks and damp stains, not reported by the estate agent… Worse, defects concealed by the latter or at his instigation, under a coat of paint and by polystyrene tiles glued to the ceiling of a bedroom. And the said estate agent drafted the preliminary contract, which of course contains no information about any of these defects. Just to add that, being 77 years old and suffering from cognitive impairment, I am certain that the estate agent thought I would not be able to discover the deception and above all to establish the fraudulent intent, still less to bring legal proceedings given the complexity and length of the procedure... That is why I am opting for the criminal route, insofar as the intentional concealment of the defects by the seller and then by the estate agent amounts to the fraudulent manoeuvres of art. 313-1 of

His work gave us clarity, whereas the usual administrative procedures were long and ambiguous. I appreciated his efficiency and professionalism, and I recommend his services.

I was pleasantly surprised by the responsiveness of Mr Reda Cohen, who took the time to answer my questions about my case instantly. It has become so rare these days to find a lawyer who is so available, responsive and attentive, even when it is simply a matter of answering questions. His answers are clear, precise and reassuring. You can tell that he takes the time to understand the situation and to provide relevant answers. Beyond his excellent ratings on Google, it is above all this availability and this seriousness that make the difference. Many thanks to Mr Reda Cohen for his professionalism and his responsiveness. I highly recommend!
