Banking disputes — individuals, guarantors and company directors
Banking law lawyer in Paris: securing your rights against the bank.
A director's personal guarantee, a home loan, a fraudulent payment, a closed account or a debt that keeps growing: a banking law lawyer in Paris starts from a precise reading of the contract and of the chronology, because a banking dispute is won there first.
An unauthorised payment transaction must be reported without delay: Article L. 133-18 of the French Monetary and Financial Code (Code monétaire et financier) provides for reimbursement, subject to the conditions of Article L. 133-19.

Banking law lawyer in Paris: the rule that governs your challenge

What a banking law lawyer in Paris does
- Paris Bar
- Banking and financial law
- Individuals and company directors
A lawyer at the Paris Bar, the firm handles banking law matters for individuals, guarantors and company directors.
The bank often holds the contract, the statements and the transaction history. The firm begins by gathering these documents and by distinguishing the debt that is actually due, the security given and the possible grounds of challenge.
The legal characterisation depends on the date and nature of the instrument: Article 2300 of the French Civil Code (Code civil) governs guarantees concluded since 1 January 2022; former Article L. 332-1 of the Consumer Code (Code de la consommation) remains the reference for earlier commitments. For a non-professional borrower, the duty to warn is measured against the risk of over-indebtedness on the day of the loan; for fraud, the evidence concerns whether the transaction was authorised and how the payer reacted.
Send what you have, even if incomplete: the firm will prioritise and complete the file with you. In an emergency, call +33 6 46 60 58 22.

Director's guarantee
Proportionality is assessed at the time of the commitment, in light of the assets, income and debts declared; a director who is an individual benefits from this protection.
Credit and the duty to warn
The offer, its acceptance and the suitability of the loan to the borrower's means are read together with the documents supplied by the bank and the instalments actually borne.
Banking lawyer and fraud
An unauthorised transaction, a refusal to reimburse or a contested account closure require each report and each response from the institution to be dated.
The rules
Guarantee, credit, fraud: the applicable rules
The date of the contract and the nature of the transaction determine the basis of the challenge.
- For a guarantee concluded since 1 January 2022, Article 2300 of the Civil Code provides that a commitment manifestly disproportionate to the guarantor's income and assets is reduced to the amount the guarantor could undertake (Article 2300 of the Civil Code). For earlier commitments, former Article L. 332-1 of the Consumer Code provided that a professional creditor could not rely on a guarantee that was manifestly disproportionate, unless the guarantor's assets allowed them to meet the obligation when called upon (former Article L. 332-1).
- The Reims Court of Appeal recalls, in its reasoning of 4 November 2025, that "Under Article L.332-1 of the Consumer Code, applicable to the dispute by reason of the date on which the contracts between the parties were concluded, a professional creditor may not rely on a guarantee contract entered into by an individual whose commitment was, at the time of its conclusion, manifestly disproportionate to their assets and income, unless the guarantor's assets, at the time when they are called upon, enable them to meet their obligation." (our translation) (CA Reims, Chambre-1 civile et com., 4 November 2025, No. 24/01020).
- A guarantor who runs the company is not excluded from this protection: the Paris Court of Appeal states that "No provision excludes from this protection the guarantor who is a director of a company whose debts they guarantee" (our translation) (CA Paris, pôle 5, chambre 6, 23 November 2022, No. 20/13541).
- For a non-professional borrower, the bank must give a warning where the loan creates a risk of excessive indebtedness. The Court of Cassation states that "a bank's failure to warn a non-professional borrower of the risk of excessive indebtedness arising from the grant of a loan deprives that borrower of a chance to avoid the risk that materialised" (our translation) (Cass. com., chambre commerciale financière et économique, 13 February 2019, No. 17-14.785).
For unauthorised payments, Article L. 133-18 of the Monetary and Financial Code provides for immediate reimbursement and, at the latest, by the end of the first business day following notification to the provider, unless there are written grounds for suspecting fraud by the user; Article L. 133-19 specifies the share, if any, left to the payer.
Your documents
The documents that fix your position
The contract and the exchanges with the bank make it possible to date the commitment, the incident and the response given.
Position A
Customer or borrower
- Loan offer, account agreement and tariff conditions
- Statements showing the contested transactions or direct debits
- Letters of complaint, fraud reports and the bank's replies
- Repayment schedule, formal notices and acceleration of the loan
Position B
Guarantor or director being pursued
- Guarantee deed and the asset statement given to the bank
- Tax assessment notices, proof of income, assets and debts at the date of the deed
- Formal notice, statement of account and recovery documents received
- Guaranteed loan agreements and exchanges with the account manager
Do not delete any statement and do not answer a formal notice by telephone alone: the date of the report, the content of the request and the bank's reply must remain provable.
The firm also handles:
- Account closure
- Over-indebtedness
- Account attachment
- Business credit
The method
How the firm analyses the dispute
Reconstruct the transactions, characterise the contract, then choose the useful response.
Step 1
Gathering the documents and the chronology
Contracts, statements, emails and deeds are sorted by date in order to isolate the commitment, the incident and the bank's successive positions.
Step 2
Identifying the applicable rule
The date of the guarantee, whether the borrower is professional or non-professional and whether the transaction was authorised point to the legal basis.
Step 3
Challenging or responding
The firm prepares a reasoned complaint, a formal notice, a reply to the bank or the defence before the court seised.
Step 4
Quantifying and securing the next steps
The sums claimed, the contested instalments and the recovery risks are checked before any negotiation or court application.
A single banking relationship may combine several grounds: disproportion of the guarantee, breach of the duty to warn and an unauthorised transaction are not proved with the same documents.
The timetable
The chronology of a banking case
Each stage leaves a document that can confirm or weaken the bank's position.
Commitment
Signing the contract. Keep the offer, the guarantee deed, the annexes and the financial information provided.
First difficulties
Sort the payment incidents, the bank's calls, the charges and the proposals for rescheduling.
Contested transaction
Report the unauthorised transaction by a means that preserves the date and request the reimbursement provided for by the Monetary and Financial Code.
Formal notice
Check the statement of account, the amount due and the security relied on before replying to the bank or its lawyer.
Formal complaint
Present the documents and the chosen legal basis; the bank's written reply often fixes the disagreement.
Settlement or litigation
Negotiate where the documents allow it, or bring the matter before the competent court with a quantified claim.
The checks
What the firm checks before any action
An effective challenge rests on dates, contracts and preserved evidence.
- Date the guarantee was concluded and the applicable text: Article 2300 of the Civil Code since 1 January 2022, former Article L. 332-1 before that.
- Declared financial capacity, assets, debts and any apparent anomalies in the asset statement given to the bank.
- Status of the borrower and the risk of indebtedness on the day the loan was granted, with the income and expenses then known.
- Whether or not each transaction was authorised, the date of the report, the authentication used and the provider's response.
- Whether the balance is due, the acceleration clause, the statement of account, charges and recovery documents sent.

Frequently asked questions
Your questions: bank fraud lawyer
When can a banking law lawyer challenge a director's personal guarantee?
The first question is the date of the deed. For a guarantee concluded since 1 January 2022, Article 2300 of the Civil Code provides that a commitment manifestly disproportionate to the guarantor's income and assets is reduced to the amount the guarantor could undertake. For an earlier deed, former Article L. 332-1 of the Consumer Code provided that a professional creditor could not rely on it, unless the guarantor's assets later allowed the debt to be met. The Reims Court of Appeal recalls that the guarantor must demonstrate the disproportion at the time of signing, while the bank must establish the guarantor's return to better financial circumstances where it relies on it (CA Reims, 4 November 2025, No. 24/01020). The deed, the asset statement, the income, the assets and the debts at the relevant date must therefore be gathered.
Does the protection against a disproportionate guarantee apply to a company director?
Yes, where the director committed as an individual to a professional creditor. Being a director is not enough to rule out the proportionality review. In a judgment of 23 November 2022, the Paris Court of Appeal states precisely that "No provision excludes from this protection the guarantor who is a director of a company whose debts they guarantee" (our translation) (No. 20/13541). The analysis remains concrete: the deed, the other commitments, the income available, the assets actually held and the debts must be set against the amount guaranteed. The bank may dispute the information presented, but the challenge is not limited to the nominal amount of the guarantee. The documents supplied at the time of signing and the contemporaneous supporting evidence are therefore essential to assess the situation without artificially reconstructing the guarantor's assets from later data.
What does the bank's duty to warn a non-professional borrower cover?
The duty to warn concerns the risk of excessive indebtedness arising from the grant of the loan where the borrower is non-professional. The Court of Cassation recalls that the failure deprives the borrower of a chance to avoid the risk that materialised, which assumes that the borrower cannot meet the sums due (Cass. com., 13 February 2019, No. 17-14.785). On 13 August 2026 the Dijon Court of Appeal stated that "A banking institution is bound by a duty to warn a non-professional borrower where, on the day of its commitment, that commitment is not suited to the borrower's financial capacity or where a risk of indebtedness arises from the grant of the loan" (our translation) (CA Dijon, 2e chambre civile, 13 August 2026, No. 21/01598). The file must therefore document the situation known on the day of the contract, the expenses, the other loans, the information provided and the progression of the arrears. The discussion is not limited to the difficulty that appeared several years afterwards.
What should I do after an unauthorised bank payment or transfer?
Report the transaction to the bank by a means that preserves the date, describe the contested entries precisely and request reimbursement. Article L. 133-18 of the Monetary and Financial Code provides that the provider must reimburse immediately after becoming aware of the transaction and, at the latest, by the end of the first business day following, unless it has written grounds for suspecting fraud by the user. Article L. 133-19 specifies the cases in which the payer may bear a loss, notably before the report in the event of loss or theft, and those in which the payer is not liable. Keep the statement, the police report receipt if there is one, the exchanges and the authentication data. A general reply from the bank does not replace a transaction-by-transaction review.
Can the bank refuse reimbursement by alleging fraud?
It may dispute reimbursement if it has grounds for suspecting fraud by the user or if it alleges fraud or gross negligence under the conditions of Article L. 133-19 of the Monetary and Financial Code. This position must be examined on the basis of the specific transaction, the method of authentication, the safekeeping of the security data and the chronology of the report. The customer should ask for a written reply, the identification of the transactions concerned and the grounds on which the bank bases its refusal. The ceiling of 50 euros provided for by the text concerns certain losses before notification following the loss or theft of the instrument; it does not govern every case of remote fraud. The firm therefore compares the statements, the alerts, the devices used and the exchanges, without inferring gross negligence from the mere fact that a payment was authenticated.
What time limits apply to a home loan offer?
Article L. 313-34 of the Consumer Code requires the lender to keep the terms of the offer open for at least thirty days from its receipt. The borrower and any guarantors who are individuals may accept it only ten days after receiving it. The offer, its acceptance, any withdrawal relied on and the documents supplied must therefore be dated and kept. The reflection period for the offer is not the same as a withdrawal, which must rest on the applicable text. In a dispute, the signed version, the specific conditions, any amendments and the date of each dispatch must be checked. These formation rules are not enough to resolve a challenge to an acceleration of the loan: the clause of the contract, the unpaid instalments, the formal notices and the statement of the balance must also be read. A bank that declares the whole loan due must be able to link its decision to the contractual terms and to the events actually established.
Can a bank close my account without explanation?
The answer depends on the account agreement, the type of account and the notification sent. A closure is checked against the letter, the notice announced, the transactions in progress and any reasons given. The customer should save the statements, ask for the return of the funds and arrange for the direct debits or transfers that can no longer go through. A closure that follows a disagreement over a transaction, a credit application or a fraud report calls for a complete chronology, without automatically concluding that there was an abuse. For a business account, the effects on salaries, suppliers and receipts must also be measured. The firm examines the contractual terms, the exchanges and the loss that can actually be demonstrated before choosing between a complaint, a transfer request or an action.
Can over-indebtedness be raised in a banking dispute?
Yes, but the overall handling of debts must be distinguished from the challenge to a bank claim. An over-indebtedness application does not, by itself, decide the validity of a guarantee, a statement of account or an unauthorised transaction. The file must list the income, expenses, loans, debts due and recovery documents, then check whether a claim should be challenged in parallel. For a director, the personal situation and that of the company are not the same; the nature of the debt and of the debtor must be clarified. The firm can briefly present the banking elements useful for choosing the route, without promising a measure or a result. The letters received and the time limits mentioned must be sent over before any reply, so that a recovery procedure does not advance without review.
What documents should I send to a banking law lawyer in Paris?
First send the contract concerned: loan offer, guarantee deed, account agreement, tariff conditions or credit-related insurance. Add the statements showing the transactions, the amortisation schedule, the formal notices, the acceleration of the loan, the closure letters and any complaints already sent. For a guarantor, include proof of income, assets, debts and commitments at the time of signing. For fraud, keep the date of the report, the alerts, the exchanges with the bank and any elements of a police complaint or challenge. Sort the documents by date and state what you are asking of the bank. An incomplete file can be reviewed, but the missing documents will be identified before choosing between negotiation, a formal complaint and proceedings.

What our clients say
Best real estate law and business law lawyer in Paris. A humane and attentive lawyer, with a wonderful team. Thank you, Maître KOHEN
Translated from French
Thank you to Maître KOHEN for his analyses of recent case law on fraudulent non-disclosure in property sales. It reassures me about an action for annulment that I am considering after buying a house affected by serious defects intentionally concealed by the seller and not reported by the estate agent; also defects (rising damp) characterised by spreading through-cracks and damp stains, not reported by the estate agent… Worse, defects concealed by the latter or at his instigation, under a coat of paint and by polystyrene tiles glued to the ceiling of a bedroom. And the said estate agent drafted the preliminary contract, which of course contains no information about any of these defects. Just to add that, being 77 years old and suffering from cognitive impairment, I am certain that the estate agent thought I would not be able to discover the deception and above all to establish the fraudulent intent, still less to bring legal proceedings given the complexity and length of the procedure... That is why I am opting for the criminal route, insofar as the intentional concealment of the defects by the seller and then by the estate agent amounts to the fraudulent manoeuvres of art. 313-1 of
