Bank accounts and enforcement procedures — debtors, creditors
Bank account seizure lawyer in Paris: challenge it or secure recovery.
Your bank reports a seizure on your bank account, or your debtor fails to pay a judgment: the enforcement title and the documents served determine what happens next. As a bank account seizure lawyer in Paris, the firm checks whether the measure is regular, the sums claimed and the time limits for challenging it or pursuing recovery.
A challenge to a garnishment order (saisie-attribution) must be brought within one month of its notification to the debtor, failing which it is inadmissible (Article R. 211-11 of the French Code of Civil Enforcement Procedures).

Bank account seizure: the title, the documents and the remedies

What a bank account seizure lawyer in Paris does
- Paris Bar
- Enforcement procedures
- Debtors and creditors
Reda Kohen, a lawyer (avocat) at the Paris Bar, sees clients at the firm, 11 rue Margueritte, 75017 Paris, to examine garnishment orders.
A blocked account does not, on its own, tell you whether a seizure is regular or which remedies remain open. The firm compares the enforcement title, the seizure report, the notification and the payments made to determine what can be challenged.
For the debtor, the analysis covers release of the seizure (mainlevée), the protected sums and whether a challenge before the enforcement judge (juge de l'exécution) is admissible. For the creditor, it checks the title, whether the debt is due and the steps needed for recovery, in coordination with the court enforcement officer (commissaire de justice).
Send what you have, even if incomplete: the firm will prioritise and complete the file with you. In an emergency, call +33 6 46 60 58 22.

A title before the seizure
A garnishment order requires an enforcement title recording a certain, liquidated and due debt, in accordance with Article L. 211-1 of the Code of Civil Enforcement Procedures.
Eight days to give notice
The seizure must be notified to the debtor within eight days, failing which it lapses (Article R. 211-3 of the same Code).
One month to challenge
The time limit runs from notification to the debtor; a complaint sent only to the bank is not the writ of summons required.
The rules
Bank account seizure without warning: what the law allows
The absence of prior warning is not enough to make the measure irregular: the title and the notification remain decisive.
- The creditor must hold an enforcement title falling within the categories of Article L. 111-3 of the Code of Civil Enforcement Procedures. The enforcement judge in Amiens recalls that a garnishment order may be made “without prior formal notice or demand to pay” (our translation). The judge nevertheless orders release of the seizure in a case where the title relied on in support of the seizure had lapsed (TJ Amiens, JEX, 4 June 2026, No. 26/00078).
- The debtor must be notified within eight days, failing which the seizure lapses (Article R. 211-3 of the same Code). In Rouen, where no notification had been given, the court held: “It is therefore appropriate to find that the garnishment order has lapsed.” (our translation) (TJ Rouen, PAC - JEX, 3 December 2025, No. 25/02899).
- A challenge must be brought within one month of notification (Article R. 211-11 of the same Code). Where the deadline falls on a Saturday, Sunday or public or non-working holiday, “it is extended until the next working day” (our translation) (Cass. 2e civ., 4 June 2020, No. 19-12.260).
- The judge may order release of a measure that is unnecessary or abusive and award compensation for abusive seizure (Article L. 121-2 of the same Code). Compensation requires separate proof: in Évry, the applicant “demonstrates neither the abuse of seizure nor the harm suffered” (our translation), despite having obtained release (TJ Évry, enforcement judge, 15 April 2025, No. 25/00761).
Two checks must remain distinct: the validity of the seizure and the existence of an abuse justifying damages. The lifting of the measure is not enough to establish the harm relied on in support of a claim for compensation.
Your documents
Documents to gather after a garnishment order freezes your account
The firm reconstructs the chronology from the documents served and the bank movements, depending on your position in the case.
Position A
Seized debtor
- Seizure report and notification, with their dates
- Judgment or other title relied on and any available notification documents
- Bank statements, notice of the freeze and the balance left available
- Proof of payments, exchanges with the creditor and evidence of the harm suffered
Position B
Enforcing creditor
- Complete enforcement title and proof of its notification where required
- Updated statement of account distinguishing sums due from payments received
- Documents from the court enforcement officer and information provided by the bank
- Challenges received, any agreements and correspondence with the debtor
Common mistakes: waiting for the bank's reply before looking at the time limit for challenging, sending only a notice of the freeze, forgetting payments already made.
The firm also handles:
- Debt recovery
- Enforcement of judgments
- Challenges to the statement of account
- Release of a seizure
The method
How the firm prepares the challenge or the recovery
Check the measure, determine the claims, then organise the necessary steps without losing sight of the time limits.
Step 1
Reading the documents and fixing the deadlines
The firm examines the title and the dates of seizure and notification, then identifies any missing documents and the deadline for challenging.
Step 2
Checking the title and the statement of account
The debt claimed is compared with the title and the documented payments; the irregularities alleged are distinguished from financial difficulties.
Step 3
Preparing the documents or seeking an agreement
Depending on your position, the firm prepares the challenge before the enforcement judge or the creditor's response, with the necessary formalities.
Step 4
Presenting the claims and following the decision
Release, limitation of the seizure, upholding of the measure or compensation: each claim rests on the documents served and the evidence produced.
An amicable discussion may be considered, but opening one does not replace the writ of summons and the challenge formalities prescribed by Article R. 211-11.
The timetable
The timeline of a garnishment order challenge
The time limits for notification and for challenging have different starting points: each must be checked against the documents.
Seizure at the bank
The document carries immediate assignment of the available debt to the seizing creditor, up to the sums concerned (Article L. 211-2 of the Code of Civil Enforcement Procedures).
Notification to the debtor
Within eight days of the seizure. The document informs the debtor and contains the mandatory particulars; failure to notify within this period exposes the seizure to lapse.
Challenge before the enforcement judge
Within one month of notification. The challenge is brought by writ of summons before the competent judge, with the relevant grounds and documents (Article R. 211-11).
Notification of the challenge
The same day or, at the latest, the next working day. The writ of summons is notified to the seizing court enforcement officer by registered letter with acknowledgement of receipt, failing which it is inadmissible (Article R. 211-11).
Informing the bank and lodging with the court registry
The bank is informed by ordinary letter of the challenge brought by the debtor before the enforcement judge. A copy of the writ of summons is lodged with the court registry no later than the day of the hearing, failing which it lapses.
Decision on the challenge
Where a challenge is brought, payment is deferred, unless the judge authorises it for the sum he or she determines (Article L. 211-5 of the same Code).
The checks
Checks before applying for release of the seizure
The documents must make it possible to support a specific ground and to comply with the formalities that go with the application.
- Title relied on: nature, enforceability and notification of the judgment where necessary, without confusing an unpaid invoice with an enforcement title.
- Statement of account: match with the title, payments received and justification of the sums still claimed on the day of the seizure.
- Notification: date, copy of the seizure report, details of the available remedies and indication of the sums left available in the case of a bank seizure.
- Protected sums: the protected bank balance (solde bancaire insaisissable) is made available without prior request by the debtor where the debtor is an individual (Article R. 162-2 of the Code of Civil Enforcement Procedures).
- Admissibility and evidence: one-month time limit, notification to the court enforcement officer, informing the bank, lodging with the court registry and evidence of the harm.

Frequently asked questions
Your questions: garnishment orders and bank accounts
Is a bank account seizure without warning legal?
Yes, a garnishment order may be made without prior notice of the measure to the debtor, if the creditor meets the legal conditions. Article L. 211-1 requires an enforcement title recording a certain, liquidated and due debt: an unpaid invoice is therefore not enough on its own. The enforcement judge in Amiens recalls that it is possible to act without prior formal notice or demand to pay, while ordering release of the seizure where the title has lapsed (TJ Amiens, JEX, 4 June 2026, No. 26/00078). The absence of warning does not remove the need to notify a judgment beforehand where that formality is legally required. Article 503 of the Code of Civil Procedure provides for this notification, subject to the exceptions it sets out. After the seizure, the creditor must also notify the debtor of it within eight days. The firm checks each of these requirements separately from the documents served and the documents provided.
How can I get a garnishment order freeze lifted?
First identify the document that caused the freeze, the title relied on and the date of notification, rather than relying on the bank's message. Release of the seizure (mainlevée) may be sought from the creditor or applied for before the judge where the measure suffers from a legally established irregularity. Payment already made, the absence of a valid title or a failure to notify must be examined on the documents, without presuming their effect. The bank's role is not to decide a dispute over the title or the debt. A challenge properly brought defers payment to the creditor, unless the judge authorises it, but does not automatically release the seized funds (Article L. 211-5). The firm therefore distinguishes between discussion with the creditor, protection of the sums available and the court application for release.
How do I challenge a garnishment order before the enforcement judge?
Article R. 211-11 requires the challenge to be brought within one month of the seizure being notified to the debtor. The step is taken by writ of summons and is not limited to a complaint to the creditor or the bank. On pain of the same inadmissibility, the writ of summons must be notified to the seizing court enforcement officer by registered letter with acknowledgement of receipt. This notification is made on the day of the writ of summons or, at the latest, the next working day. The garnishee (the bank) is also informed by ordinary letter of the challenge brought before the enforcement judge. A copy of the writ of summons must also be lodged with the court registry no later than the day of the hearing, failing which it lapses. Articles 641 and 642 of the Code of Civil Procedure govern the calculation of the deadline; a month does not always equal thirty days.
Does a missing or irregular notification always void the seizure?
Failure to notify within eight days exposes the seizure to lapse, in accordance with Article R. 211-3. The judicial court of Rouen found this in a case where the seizure had never been notified to the debtor (TJ Rouen, PAC - JEX, 3 December 2025, No. 25/02899). A notification that was served but suffers from a formal defect calls for a different analysis, depending on the irregularity alleged and its consequences. The Court of Cassation recalls: “it is for the party relying on it to show the existence of a prejudice, which is assessed by the lower courts at their sole discretion.” (our translation) (Cass. 2e civ., 9 September 2021, No. 20-13.850). A distinction must therefore be drawn between the absence of any document, the overrunning of the time limit and the irregular content of a notification that was in fact served. The firm examines the steps taken and the concrete harm to the debtor's rights before putting the ground forward.
How does the protected bank balance work after a seizure?
The protected bank balance (solde bancaire insaisissable) shields a sum of a maintenance nature for the debtor, where an individual, within the limit of the credit balances concerned. Article L. 162-2 of the Code of Civil Enforcement Procedures refers to the statutory flat-rate amount applicable to a single benefit recipient. This protection therefore does not create additional credit where the available bank balance proves insufficient to reach that amount. Article R. 162-2 specifies that no request from the debtor is necessary and that the bank notifies the debtor of the availability. Where there are several accounts, availability is assessed across all the credit balances; it is not automatically multiplied per account. The text also provides for coordination between garnishees where accounts held at several institutions are concerned. The firm examines the statements and bank information to verify the sum actually left available, without confusing this protection with a general release of the seizure.
Is an invoice or a reminder letter enough to seize a bank account?
No, these documents are not, on their own, the enforcement title required to carry out a garnishment order on a bank account. Article L. 111-3 lists the titles concerned, including enforceable court decisions and notarial deeds bearing the enforcement formula. The firm checks the document relied on, whether it is enforceable and the formalities needed to use it against the debtor. Where a judgment is concerned, Article 503 of the Code of Civil Procedure requires it to be notified before enforcement, subject to the exceptions provided for. In Évry, the judge ordered release of a seizure for lack of proof that the title had been served beforehand (TJ Évry, enforcement judge, 15 April 2025, No. 25/00761). A debt may therefore exist without all the legal conditions for this enforcement measure being met. For the creditor, this check comes before the seizure instructions and covers the documents handed to the court enforcement officer.
As a creditor, how do I prepare a garnishment order against a debtor?
The starting point is an enforcement title recording a certain, liquidated and due debt, together with the documents needed to enforce it. The firm compares the amount claimed with the title and the payments received, then prepares the file with the court enforcement officer. After the seizure, notification to the debtor within eight days must be followed with the same care as the initial document. A challenge then requires justifying the title, the sums due and the regularity of the documents before the enforcement judge. The immediate assignment provided for by Article L. 211-2 must be distinguished from the bank's actual payment of the sums. That payment is deferred in the event of a challenge, unless the court authorises it under the conditions of Article L. 211-5. The firm also examines the debtor's observations and the possibilities of an agreement, without promising full recovery.
Can I obtain damages for an abusive seizure?
Article L. 121-2 allows the enforcement judge to order release of a measure that is unnecessary or abusive and to award compensation for abusive seizure. This claim must, however, be distinguished from a challenge concerning only the regularity or amount of the measure. The judicial court of Évry thus ordered release while rejecting the compensation claim, for lack of proof of abuse and harm (TJ Évry, enforcement judge, 15 April 2025, No. 25/00761). In Amiens, by contrast, the judge found fault in the absence of a valid enforcement title and harm linked to the measure (TJ Amiens, JEX, 4 June 2026, No. 26/00078). These decisions rest on their respective documents and do not support any inference of an automatic right to compensation. The firm gathers the exchanges, bank evidence and other material capable of establishing the harm alleged and its link with the seizure.
Why consult a garnishment order lawyer in Paris?
A lawyer handling garnishment orders examines the useful grounds and the steps to take before the time limit for challenging expires, depending on your position. The enforcement judge has jurisdiction over difficulties relating to titles and challenges to enforcement under the conditions of Article L. 213-6 of the Code of Judicial Organisation. For this seizure, Article R. 211-10 of the Code of Civil Enforcement Procedures designates the judge of the place where the debtor lives. The firm's location in Paris therefore does not, on its own, determine the competent court. The firm sees debtors and creditors alike to examine their case at 11 rue Margueritte, 75017 Paris. The preliminary review is offered at €80 incl. VAT; send the documents you have or call +33 6 46 60 58 22 to present the documents received.

What our clients say
Best real estate law and business law lawyer in Paris. A humane and attentive lawyer, with a wonderful team. Thank you, Maître KOHEN
Translated from French
Thank you to Maître KOHEN for his analyses of recent case law on fraudulent non-disclosure in property sales. It reassures me about an action for annulment that I am considering after buying a house affected by serious defects intentionally concealed by the seller and not reported by the estate agent; also defects (rising damp) characterised by spreading through-cracks and damp stains, not reported by the estate agent… Worse, defects concealed by the latter or at his instigation, under a coat of paint and by polystyrene tiles glued to the ceiling of a bedroom. And the said estate agent drafted the preliminary contract, which of course contains no information about any of these defects. Just to add that, being 77 years old and suffering from cognitive impairment, I am certain that the estate agent thought I would not be able to discover the deception and above all to establish the fraudulent intent, still less to bring legal proceedings given the complexity and length of the procedure... That is why I am opting for the criminal route, insofar as the intentional concealment of the defects by the seller and then by the estate agent amounts to the fraudulent manoeuvres of art. 313-1 of
