Debt recovery — suppliers and service providers
Debt recovery lawyer Paris: secure a title and get paid.
A claim must be certain, liquid and due before any procedure, and the debtor's solvency must be checked too. Payment order (injonction de payer), urgent application for an interim payment or writ of summons: as a debt recovery lawyer in Paris, the firm chooses the route and steers enforcement through to collection.
Starting proceedings against a debtor who is emptying out their assets means paying for nothing: protective attachment freezes the assets before any title is obtained, where the claim appears well founded in principle.

What a commercial debt recovery lawyer in Paris does

- Firm in Paris 17th
Lawyer at the Paris Bar — commercial debt recovery and enforcement measures.
Evidence between traders is unrestricted (Article L. 110-3 of the French Commercial Code, Code de commerce) and the limitation period is five years (Article L. 110-4). A formal notice (mise en demeure), recommended though not always mandatory, proves the delay and starts interest running. A payment order is served and enforced after one month without objection; an urgent application for an interim payment succeeds within a few weeks; a garnishment order (saisie-attribution) on a bank account immediately assigns the sum seized. Where the debtor is in collective insolvency proceedings, filing the claim within two months saves it.

Three routes, one choice
Payment order (Articles 1405 et seq. of the French Code of Civil Procedure, Code de procédure civile) for a determined contractual claim, urgent application for an interim payment for an obligation not seriously contestable, writ of summons on the merits as soon as there is a genuine dispute.
Ancillary amounts due as of right
Interest at no less than three times the statutory rate and a fixed indemnity of forty euros per late invoice: both should be claimed as a matter of course (Article L. 441-10 of the Commercial Code).
Solvency first
Filed accounts, BODACC, security held by other creditors, identifiable assets: checks come before the application, and protective attachment gives protection during the proceedings.
The routes
Payment order, urgent application, merits: choosing according to the claim
Four rules shape commercial debt recovery.
- The claim is verified: certain in principle, liquid in amount, due in its term — service performed, deadline passed, limitation period not expired.
- The payment order (Articles 1405 et seq. of the Code of Civil Procedure): non-adversarial application, order served, objection possible for one month (Article 1416).
- An urgent application for an interim payment requires an obligation that is not seriously contestable: a serious dispute stands in the way and requires proceedings on the merits (decision linked on this page).
- Ancillary amounts are claimed as of right: interest at no less than three times the statutory rate and forty euros of fixed indemnity per invoice (Article L. 441-10).
Against a fragile debtor: protective attachment with the authorisation of the enforcement judge where the claim appears well founded in principle and circumstances threaten recovery — served on the debtor within eight days, converted into a garnishment order once the title is obtained. If insolvency proceedings open, filing the claim within two months of the BODACC publication is vital.
Your documents
What you need to send to get started
A debt recovery file is put together in days, not months.
Position A
The claim
- Contract, general terms of sale (CGV), quotation or accepted purchase order
- Invoices and delivery notes or proof of performance
- Updated statement of account: principal, interest, fixed indemnity
- Reminders and formal notices already sent
Position B
The debtor
- Registration extract and filed accounts
- BODACC notices concerning the debtor
- Known bank details
- Identifiable assets: funds, equipment, claims against third parties, real estate
Frequent mistakes: issuing proceedings without checking solvency; forgetting the fixed indemnity and interest; letting the two-month deadline for filing a claim in insolvency proceedings pass.
The firm also uses:
- Protective attachment
- Garnishment order
- Filing of the claim
- Retention of title clause
The method
How the firm supports you
Skipping steps risks a rejection, or a title that is useless for lack of assets.
Step 1
Checks
Claim certain, liquid and due; the debtor's real solvency: accounts, BODACC, security, assets.
Step 2
Formal notice
Itemised statement of account, legal basis, time allowed, registered letter — the amicable route often saves six months.
Step 3
The right procedure
Protective attachment if there is a risk, payment order, urgent application for an interim payment or writ of summons on the merits depending on the dispute.
Step 4
Enforcement
Service, garnishment order or other measures depending on the assets, and handling of challenges before the enforcement judge.
Benchmarks: objection to a payment order within one month; B2B payment terms capped at sixty days; five-year limitation period.
The timetable
The timeline of a successful recovery
From verification to collection.
Checks
Days 1-5. Claim and solvency: documents, accounts, BODACC, security, signs of default.
Formal notice
Weeks 1-2. Itemised statement of account, legal basis, time allowed, notification by registered letter.
Protective measures
If there is a risk. Application to the enforcement judge, authorisation, service within eight days.
Title
Weeks 3-8. Payment order or urgent application for an interim payment; writ of summons on the merits if there is a serious dispute.
Enforcement
After the title. Garnishment order on a bank account, seizure and sale of movable assets, seizure of company shares, depending on the assets.
Insolvency
If the debtor defaults. Filing of the claim within two months of the BODACC publication, followed by monitoring of its admission.
The checks
What the firm checks before the application
No proceedings until these points have been validated.
- Characteristics of the claim: certain, liquid, due.
- Proof that the service was performed or the goods delivered.
- Limitation period: five years, running from the date the claim fell due.
- The debtor's solvency and identified attachable assets.
- Itemised ancillary amounts: interest, fixed indemnity, penalty clause where applicable.
- Route suited to the level of dispute, with the objection anticipated.

Frequently asked questions
Your questions: commercial debt recovery
What is the difference between a payment order, an urgent application for an interim payment and a writ of summons on the merits?
A payment order (Articles 1405 et seq. of the Code of Civil Procedure) is a fast procedure, non-adversarial at the initial stage, suited to contractual claims that are certain, liquid and due. An urgent application for an interim payment (Article 873 of the Code of Civil Procedure for the commercial court, Article 835 for the judicial court) requires that the claim not be seriously contestable and allows an interim payment within a few weeks. A writ of summons on the merits is needed as soon as there is a serious dispute: the case is investigated and argued, the time needed to obtain judgment is longer, but the decision settles the dispute definitively.
What is the limitation period for a commercial debt?
Obligations arising between traders, or between traders and non-traders, are subject to a five-year limitation period (Article L. 110-4 of the Commercial Code), save for shorter special limitation periods. The period runs from the date the claim falls due. A formal notice does not suspend the limitation period; only bringing the matter before a judge or the debtor's acknowledgement of the debt interrupts it. After five years, the claim is in principle extinguished unless a ground of interruption or suspension is validly established.
Is a formal notice mandatory before starting debt recovery action?
A formal notice is not required to refer the matter to the urgent applications judge or to apply for a payment order, but it remains strongly recommended. It is proof of the delay, starts default interest running if the contract says nothing on the point, and often settles the dispute without court proceedings. For claims between professionals, Article L. 441-10 of the Commercial Code gives rise as of right, on the due date, to interest at no less than three times the statutory rate and to a fixed indemnity of forty euros.
What is a due claim for debt recovery purposes?
A claim is due when the payment term has expired and the creditor can therefore demand payment immediately. The claim must also be certain in principle (proof of the triggering event) and liquid in amount (a sum that is determined or determinable from the terms of the contract). An invoice issued without a contractual due date is due on receipt. A claim subject to a condition precedent only becomes due once the condition is met.
What is the time limit to object to a payment order?
The objection is lodged within one month of service of the order (Article 1416 of the Code of Civil Procedure). If service was not made on the debtor in person, the period runs from the first document served in person or from the first enforcement measure making the debtor's assets unavailable. After that period, the order becomes enforceable and may be enforced by any legal means. The objection reopens the case on the merits before the court that made the order (Article 1417 of the Code of Civil Procedure).
What are the conditions for an urgent application for an interim payment in commercial matters?
Before the president of the commercial court, an urgent application for an interim payment is available where the existence of the obligation is not seriously contestable (Article 873, paragraph 2, of the Code of Civil Procedure). The Commercial Chamber recalls that the urgent applications judge must refuse the interim payment as soon as a serious dispute appears, for example a defence of non-performance supported by the documents (Cass. com., 13 June 2018, No. 17-15.492). The creditor must therefore present a solid file: invoices, delivery notes, acknowledgements of receipt, no formal reservation by the debtor.
Can a debtor's assets be seized before a title has been obtained?
Yes, by protective attachment (Article L. 511-1 of the Code of Civil Enforcement Procedures). Anyone whose claim appears well founded in principle may ask the enforcement judge for authorisation to take a protective measure if they show circumstances likely to threaten recovery. The attachment freezes the assets (bank account, claim, company shares) without transferring ownership. The creditor must then bring proceedings on the merits and obtain a title, failing which the attachment is lifted.
How is the money actually recovered once an enforceable title has been obtained?
The fastest route is a garnishment order on a bank account (Article L. 211-1 of the Code of Civil Enforcement Procedures). It immediately assigns to the creditor the sum seized, up to the amount of the debt owed, from service on the third party holding the funds. Other routes exist depending on the assets: attachment of a claim held by a third party, seizure of company shares and securities, seizure and sale of movable property, seizure of real estate. Enforcement is entrusted to a commissaire de justice, who acts on the basis of the title and the description of the assets to be seized.
How much does a debt recovery procedure cost?
Costs vary according to the procedure chosen. A payment order involves limited fiscal stamp and service costs. An urgent application and a writ of summons on the merits involve higher court registry and bailiff costs. Lawyer's fees are set either as a fixed fee (from around €1,200 incl. VAT for a simple payment order) or by time spent (hourly rate for complex cases). Part of the costs may be recovered from the debtor ordered to pay (Article 700 of the Code of Civil Procedure and Article L. 441-10 of the Commercial Code).
Which court has jurisdiction over a commercial debt recovery?
Where the creditor and the debtor are both traders, the commercial court has jurisdiction. For a payment order, the application is brought before the president of the commercial court for the place where the debtor lives (Article 1406 of the Code of Civil Procedure). A valid jurisdiction clause may designate another commercial court, provided it was agreed between traders and set out in a very prominent way (Article 48 of the Code of Civil Procedure, Cass. com., 2 October 1985, No. 84-10.156, Bulletin).
What if the debtor enters reorganisation or liquidation during the proceedings?
The opening of insolvency proceedings stops individual enforcement actions. The creditor must file its claim in the debtor's liabilities within the legal time limit (two months from publication in the BODACC, extended for creditors domiciled abroad). Failing that, the claim cannot be enforced against the proceedings and recovery is compromised. The firm systematically checks the debtor's situation before starting proceedings and files the claim as soon as proceedings open if this happens during the case.
What evidence should be gathered to make debt recovery easier?
The strongest combination of evidence brings together the contract or the accepted general terms of sale, the invoices issued and proof of performance (signed delivery notes, acceptance report, certificate of service rendered). To this are added dated written reminders (registered letter, email with acknowledgement), any part payments (which amount to an acknowledgement of the debt) and exchanges showing that no objection was raised at the time of delivery. Between traders, evidence is unrestricted (Article L. 110-3 of the Commercial Code).
What happens if the debtor disputes the claim?
If the debtor raises a serious dispute, an urgent application for an interim payment is ruled out and a payment order is exposed to a successful objection. It is then necessary to switch to a writ of summons on the merits, where the court examines the facts and the law in detail. The creditor must produce a complete file: proof of the claim, proof of performance, and a reasoned rebuttal of the objections. Protective attachment remains possible in parallel to freeze the assets during the proceedings, provided a threat to recovery is shown.
Is a penalty clause or fixed indemnity provided for in the contract automatically payable?
A penalty clause agreed in the contract or the general terms of sale is in principle applicable, but the judge may reduce it if it is manifestly excessive. The fixed indemnity of forty euros for recovery costs, provided for by Article L. 441-10 of the Commercial Code, is due as of right and without a reminder for any late payment between professionals. Additional compensation may be claimed on proof where the actual costs exceed this fixed sum (notably lawyer's fees and procedural costs).
How long does it take to actually recover the sums owed?
For a payment order that is not opposed, the title is obtained in four to eight weeks, then enforcement takes a further two to four weeks in the case of a garnishment order on a known account. An urgent application for an interim payment succeeds in five to eight weeks, hearing included. A writ of summons on the merits takes nine to eighteen months depending on the court's calendar. A protective attachment can be authorised within a few days. The firm builds the timetable from the review of the file.

What our clients say
Best real estate law and business law lawyer in Paris. A humane and attentive lawyer, with a wonderful team. Thank you, Maître KOHEN
Translated from French
Thank you to Maître KOHEN for his analyses of recent case law on fraudulent non-disclosure in property sales. It reassures me about an action for annulment that I am considering after buying a house affected by serious defects intentionally concealed by the seller and not reported by the estate agent; also defects (rising damp) characterised by spreading through-cracks and damp stains, not reported by the estate agent… Worse, defects concealed by the latter or at his instigation, under a coat of paint and by polystyrene tiles glued to the ceiling of a bedroom. And the said estate agent drafted the preliminary contract, which of course contains no information about any of these defects. Just to add that, being 77 years old and suffering from cognitive impairment, I am certain that the estate agent thought I would not be able to discover the deception and above all to establish the fraudulent intent, still less to bring legal proceedings given the complexity and length of the procedure... That is why I am opting for the criminal route, insofar as the intentional concealment of the defects by the seller and then by the estate agent amounts to the fraudulent manoeuvres of art. 313-1 of
