HLM allocation, DALO appeals — applicants and tenants in social housing

Social housing lawyer in Paris: asserting your rights, defending your lease.

A refused allocation, an unanswered transfer request, a DALO appeal (enforceable right to housing) that never led to rehousing or a threatened lease each call for different steps. The firm acts as a social housing lawyer in Paris: it examines your situation, the decisions you have received and the evidence available to determine against whom to act and before which court.

A favourable DALO decision does not, on its own, resolve eviction proceedings brought by the social landlord: each procedure must be examined separately.

What a social housing lawyer does in Paris

  • Paris Bar
  • Social housing law
  • Leases and DALO appeals

Reda Kohen, avocat at the Paris Bar, receives clients at 11 rue Margueritte, 75017 Paris, to examine your social housing case.

A social housing lawyer distinguishes between an allocation or transfer application, a DALO appeal and the defence of the lease. A failure to rehouse attributed to the State is not handled in the same way as an accusation of subletting made by a social housing body (HLM).

The firm checks the conditions for access to housing, the decisions of the mediation commission (commission de médiation) and the obligations arising from the contract. For a transfer of the lease after a death or abandonment of the home, the rules for social housing supplement those of the Law of 6 July 1989.

Send what you have, even if incomplete: the firm will prioritise and complete the file with you. In an emergency, call +33 6 46 60 58 22.

HLM allocation and transfer

Income, household composition, disability, current housing and the decisions received: the documents must explain the situation and the housing requested in concrete terms.

DALO lawyer

The mediation commission, an application for an injunction before the administrative court and a claim for compensation against the State serve distinct purposes, to be examined according to your case.

Defending the social lease

Transfer of the lease, personal occupation, alleged subletting or disturbance of quiet enjoyment: the defence rests on the established facts and the rules governing the housing.

The rules

Social housing and DALO: the rules that guide the remedy

Identify the claim, the party bound by the obligation and the conditions specific to social housing.

  1. A DALO appeal requires showing that the conditions set by Article L. 441-2-3 of the French Construction and Housing Code (Code de la construction et de l'habitation) are met. Once priority status has been recognised, the absence of a suitable offer may open the right to apply for an injunction provided for by Article L. 441-2-3-1 of the same code. A claim for compensation for the harm actually suffered is a separate step against the State, supported by precise evidence.
  2. Transfer after a death or abandonment of the home is governed by Article 14 of the Law of 6 July 1989. In social housing, Article 40 adds conditions of eligibility and suitability of the housing, with exceptions. The Court of Cassation quashed a decision for failing to respond to the argument “relating to the fact that she had a disability” (Cass. 3e civ., 4 July 2024, No. 23-13.757, our translation). That ruling requires the court to examine the argument raised in the submissions; it does not itself grant the transfer of the lease.
  3. Subletting of the housing concerned is prohibited by Article L. 442-8 of the French Construction and Housing Code, subject to statutory exceptions. In that case, the landlord established non-occupation and subletting through several consistent items of evidence. The court concluded: “Judicial termination of the contract will be ordered.” (TJ Bobigny, chambre 28 / Proxi fond, 19 May 2025, No. 24/08831, our translation).
  4. The social landlord must ensure peaceful enjoyment of the housing and carry out the necessary repairs, in accordance with Article 6 of the Law of 6 July 1989. A request for works or compensation requires proof of the defect, the steps taken and the consequences actually suffered.

Termination requires proof of the breach and “justification of its sufficient seriousness” (TJ Versailles, TPX VER JCP FOND, 15 May 2025, No. 24/00167, our translation). An accusation by the landlord therefore calls for a documented response, setting each complaint against the documents actually produced in the file.

Your documents

The documents to gather according to your situation

A precise chronology makes it possible to distinguish the steps already taken from the remedies still to be examined.

Situation A

Applicant or transfer applicant

  • Social housing application, renewal certificates and registration number
  • Income, household composition and documents establishing particular needs
  • Transfer requests, offers received and reasons for refusal
  • DALO file, acknowledgement of receipt and decision of the mediation commission

Situation B

Tenant or beneficiary of a transfer

  • Lease, addenda, rent receipts and letters from the social landlord
  • Writ of summons, judgment, formal demand or formal notice received
  • Proof of occupation, of living together and documents relating to the death or departure
  • Photos, reports, inspection records and correspondence concerning the disturbance of quiet enjoyment

Common mistakes: confusing an HLM transfer with a DALO appeal, assuming that a family link is enough for the transfer of the lease, or leaving an accusation of non-occupation unanswered. Keep the notifications and their envelopes so that the deadlines applying to the steps and proceedings under way can be checked.

The firm also handles:

  • Transfer of the lease
  • Eviction of a tenant
  • Unfit housing
  • Disturbance of quiet enjoyment

The method

Your social housing lawyer: an approach based on documents

Characterise the difficulty, then take the step that matches your situation.

Step 1

Examining the decisions and the lease

The firm reconstructs the chronology, identifies the applications already made and picks out the notifications or documents that call for a response.

Step 2

Checking the conditions for the remedy

DALO priority, conditions for the transfer, personal occupation or the landlord's obligations: each ground is tested against the available documents and the rules governing the housing.

Step 3

Presenting a supported claim

Depending on the case, the firm prepares a transfer application, an appeal to the mediation commission or a claim to the landlord.

Step 4

Bringing the matter before the competent court

A DALO appeal may lead to the administrative court; a dispute concerning the social lease falls within the jurisdiction of the ordinary courts. The firm then tailors the claims to the evidence gathered, the decisions already received and the conditions specific to each procedure.

A DALO injunction seeks housing or rehousing; a claim for compensation seeks redress for a proven loss. The defence against termination of the lease must also be prepared when proceedings concerning the tenancy have been brought.

The timetable

The stages of a social housing case

The order of the steps depends on the difficulty encountered; several procedures may have to be followed together.

  1. Identify the difficulty

From the first reading. Distinguish between allocation, transfer, DALO decision, transfer of the lease or eviction proceedings, then gather the corresponding documents and decisions.

  2. Check the deadlines

Examine the notification dates, the remedies indicated and the court documents, before determining the applicable timetable.

  3. Complete the evidence

Document the current housing, the household's needs, the shared life or personal occupation, depending on the conditions to be established.

  4. Present the appropriate application

Send the supporting documents to the competent party or refer the matter to the mediation commission when the conditions for a DALO appeal are met.

  5. Prepare the litigation

If the dispute persists, consider the DALO injunction, the claim for compensation against the State or the defence before the court hearing the lease dispute.

  6. Follow up on the decision

Check the offers received, the works announced or the obligations set by the judgment, then assess the steps still needed.

The checks

What the firm checks before going to court

How the case is characterised determines the claim and the evidence needed.

  • Type of housing and landlord: the lease regime, the landlord's agreement with the State (conventionnement) and the rules specific to social housing.
  • Allocation or transfer: application registered, household situation, justified needs and decisions actually received.
  • DALO: conditions for referral, the commission's grounds, notification, offers made and the State's follow-up.
  • Transfer: status of the beneficiary, shared life, allocation conditions, suitability of the housing and exceptions raised.
  • Tenancy litigation: proof of occupation, breaches alleged, disturbances reported and deadlines arising from the documents received.

Summary

Your situation, the evidence, the useful step

Each difficulty calls for a precise claim and a coherent set of documents.

Situation

HLM allocation or transfer going nowhere

Decisive evidence: Application registered, income, household composition, current housing and replies received.

Time limit: To be assessed from the decision challenged and its notification.

Useful action: Complete the supporting documents, identify the reason for the refusal and examine the available remedy.

Situation

DALO priority not followed by a suitable offer

Decisive evidence: Commission decision, notification, household composition and any offers received.

Time limit: To be checked according to the DALO decision and the rules of the remedy contemplated.

Useful action: Examine the application for an injunction before the administrative court and, separately, the claim for compensation.

Situation

Transfer of the lease after a death or departure

Decisive evidence: Lease, death certificate or evidence of the departure, relationship with the tenant and proof of shared life.

Time limit: From the death or departure, in order to examine the conditions for remaining in the home.

Useful action: Check Articles 14 and 40 of the Law of 6 July 1989, then submit the supporting documents to the landlord.

Situation

Subletting or non-occupation alleged

Decisive evidence: Landlord's reports, proof of residence, witness statements and evidence explaining the payments in dispute.

Time limit: From the formal notice and before the hearing date stated in the writ of summons.

Useful action: Respond to the facts alleged and challenge the evidence and the seriousness of the breach relied on.

Situation

Termination and eviction sought by the social landlord

Decisive evidence: Writ of summons, lease, rent statement, letters exchanged and proof of the current situation.

Time limit: Depending on the documents received, the hearing dates and the enforcement deadlines to be checked.

Useful action: Examine the regularity of the procedure, the basis for the termination and the relevant defence arguments.

Situation

Disturbance of quiet enjoyment in HLM housing

Decisive evidence: Dated photos, written reports, inspection records, the landlord's replies and documented consequences.

Time limit: From the moment the defect is reported, keeping a chronology of the steps taken.

Useful action: Request the necessary work and examine a claim for compensation for the loss established.

Frequently asked questions

Your questions: social housing and DALO appeals

When should you consult a lawyer specialising in social housing about an HLM allocation or transfer?

The firm first examines the application on file, the household's needs and the decisions actually received from the body concerned. A transfer request must explain why the current housing no longer meets the family, professional or personal situation. Income, household composition, disability or current housing conditions must be established by consistent documents. The firm can then identify a problem in the processing of the application, a refusal to be examined or a step that is insufficiently documented in the file presented. A DALO appeal is subject to its own conditions: it is not the same as an ordinary transfer request to a social landlord. The first analysis therefore serves to determine the useful application, its addressee and the supporting documents still needed, without presuming that housing will be allocated.

In what situations can a DALO lawyer prepare an appeal to the commission?

Article L. 441-2-3 of the French Construction and Housing Code sets out several situations in which the mediation commission may be approached. The appeal may in particular concern a person who has received no suitable offer after the applicable period, subject to the regulatory conditions of access to social housing. Some situations allow a referral without that wait, notably having no housing, facing eviction without rehousing or living in premises unfit for habitation. For overcrowding and certain situations of unfit housing, the text sets particular conditions relating in particular to the household or to disability. The file must therefore set out precisely the situation relied on, the steps taken and the housing needs actually established. The firm compares these elements with the statutory conditions in order to prepare a reasoned application, accompanied by the documents useful for its examination.

Having been recognised as a DALO priority in Paris, can I apply to the administrative court for an injunction?

A favourable decision of the mediation commission must be read together with its notification, the characteristics of the housing taken into account and the follow-up given. Article L. 441-2-3-1 of the French Construction and Housing Code provides for an action where the priority applicant has not received a suitable offer within the regulatory period. The administrative court may then order the State to provide housing or rehousing, possibly with a daily penalty payment (astreinte), under the statutory conditions. The firm checks the admissibility of the application, any offers made and the household's current needs before framing the application. This procedure seeks performance of the obligation to provide housing; in itself, it is not a claim for damages. Tenancy proceedings brought by the social landlord must also be followed according to their own documents and deadlines.

Does the failure to rehouse after a DALO decision entitle you to compensation from the State?

A culpable failure by the State to implement the priority decision may engage its liability for disruption to living conditions. The examination concerns in particular whether the situation that led to the decision persists, the housing conditions, the length of the failure and the household. Compensation therefore does not follow from a flat amount applicable to all applicants: the consequences suffered must be set out and justified. A prior claim for compensation must be addressed to the administration, and the conditions for bringing proceedings before the administrative court must then be examined. The Council of State (Conseil d'État) holds that this failure engages the liability of the State “even where the person concerned has not used the application for an injunction against the State provided for by Article L. 441-2-3-1 of the Construction and Housing Code” (CE, 5e ch., 21 February 2018, No. 405766, our translation). Finally, the daily penalty payment provided for by Article L. 441-2-3-1 is paid to the fund designated by law; it is not the applicant's personal compensation.

Can you keep a social housing flat after the death or departure of the leaseholder?

A family link is not enough: Article 14 of the Law of 6 July 1989 designates the beneficiaries and the conditions for continuation or transfer. For descendants, it requires in particular shared life with the tenant for at least one year at the date of the death or abandonment. A departure must not automatically be equated with the abandonment of the home referred to in the text: its characterisation must be examined. Article 40 adds the conditions specific to social housing, concerning allocation and the suitability of the housing, subject to the exceptions it provides for. In that case, the descendant lived alone in housing unsuited to the descendant's household, according to the findings accepted by the judges. The Court holds that “he could not claim the transfer of the lease in his favour” (Cass. 3e civ., 20 December 2018, No. 18-10.124, our translation). The firm therefore checks the status of the beneficiary, the proof of shared life and any exceptions that may apply.

How should you respond to an accusation of subletting made by a social landlord?

You need to obtain the specific evidence relied on by the landlord: inspection records, statements, financial transfers or documents relating to occupation of the premises. Article L. 442-8 of the French Construction and Housing Code lays down a prohibition on subletting, subject to the exceptions provided for by law. The defence must therefore examine whether the premises were actually made available, the conditions of occupation and the nature of any sums paid. Presenting a situation as mere accommodation is not enough where the documents describe an occupation paid for by a third party. In the Bobigny judgment cited on this page, the court set the tenant's explanations against several consistent items of evidence. The firm prepares a documented response on each element in dispute and on the consequences sought by the landlord, in particular termination or the return of sub-rent.

Is an absence from HLM housing enough to justify termination of the lease?

The file must distinguish between an explained absence, actual occupation and a situation in which the leaseholder has ceased to live in the premises personally. The firm examines the lease, the reasons for the absence and the documents that make it possible to reconstruct where the tenant actually resided. Inspection records, consumption data, witness statements or letters must be read together, taking account of their date and their respective weight. A general reply is no substitute for documents capable of explaining the specific facts relied on by the landlord in support of its claim. The Versailles judgment cited on this page recalls the requirement to prove the breach and its sufficient seriousness in order to obtain termination. The defence may therefore concern whether the failure to occupy is real, the documented explanations and the sanction sought before the court.

What should you do when a social landlord seeks termination of the lease and eviction?

You need to provide the writ of summons and its annexes, the lease, the letters exchanged and the documents relevant to the facts alleged against the tenant. The defence varies according to whether the claim rests on unpaid rent, alleged subletting, failure to occupy or other breaches relied on by the landlord. The firm examines the procedure, whether the complaints are well founded and the claims that can be put to the court in light of the documents. Hearing dates, notifications and enforcement documents must be noted in order to determine the responses needed at each stage of the procedure. Recognition of DALO priority must not lead to these proceedings being left undefended: the two steps serve distinct purposes. The possibilities of remaining in the home, of regularisation or of applying for time to pay or leave must be assessed according to the basis of the action and the situation shown.

Can the tenant of a social housing flat ask for works and compensation for disturbance of quiet enjoyment?

The social landlord remains bound by the obligations set out in Article 6 of the Law of 6 July 1989, notably as regards maintenance and peaceful enjoyment. The request must identify the defects, the work expected and the reports already sent to the landlord, with proof of receipt. Dated photos, inspection records, available reports and written exchanges make it possible to document the condition of the housing and how the situation has developed over time. A claim for compensation also requires setting out the consequences actually suffered, their duration and the elements linking them to the landlord's obligations. The existence of a defect does not dispense with examining its origin and who is responsible for the work requested in the situation concerned. The firm thus distinguishes between the request for works, the discussion of responsibilities and the assessment of the loss that the documents can support.

Thank you to Maître KOHEN for his analyses of recent case law on fraudulent non-disclosure in property sales. It reassures me about an action for annulment that I am considering after buying a house affected by serious defects intentionally concealed by the seller and not reported by the estate agent; also defects (rising damp) characterised by spreading through-cracks and damp stains, not reported by the estate agent… Worse, defects concealed by the latter or at his instigation, under a coat of paint and by polystyrene tiles glued to the ceiling of a bedroom. And the said estate agent drafted the preliminary contract, which of course contains no information about any of these defects. Just to add that, being 77 years old and suffering from cognitive impairment, I am certain that the estate agent thought I would not be able to discover the deception and above all to establish the fraudulent intent, still less to bring legal proceedings given the complexity and length of the procedure... That is why I am opting for the criminal route, insofar as the intentional concealment of the defects by the seller and then by the estate agent amounts to the fraudulent manoeuvres of art. 313-1 of
