Scope of the service
Kohen Avocat offers, through the contact form on this website, a preliminary case review. The service comprises examination of the documents submitted and delivery of a first written analysis of the situation, sent by email to the address given when the request is made.
Fees
The preliminary review is charged at €80 incl. VAT, that is €66.67 excl. VAT and €13.33 of VAT at 20%.
Payment is made online by bank card before the file is passed to the firm. Payment is processed by Stripe; the firm retains no banking data. An invoice from the firm is sent to the email address provided.
Fee agreement
This document constitutes a fee agreement within the meaning of Article 10 of Law No. 71-1130 of 31 December 1971. The fee is fixed and final. It pays for the review and analysis, and remains due whatever the content of the response delivered, including where it concludes that no useful action is available or advises against starting proceedings.
Timescale
The first analysis is sent within twenty-four business hours of receipt of payment and documents. This period may be extended where the volume or complexity of the file requires it; the client is then informed.
What the service does not include
The following are not included: drafting and sending of deeds or letters, representation in court, assistance at an interview, hearing or court session, negotiation with a third party, dealings with a public authority or social security body, analysis of further documents provided after the analysis has been delivered, and any subsequent follow-up. Any later work is the subject of a separate fee proposal, subject to the client’s prior agreement.
Right of withdrawal
In accordance with Articles L. 221-18 et seq. of the French Consumer Code (Code de la consommation), a client who contracts for purposes outside their professional activity has fourteen days in which to withdraw.
As the service is performed within a short time, a client who wishes to have it start immediately expressly requests its performance before that period expires and waives the right of withdrawal, in accordance with Article L. 221-25 of the same Code. That request and waiver result from the online payment, preceded by the corresponding notice displayed beneath the payment button.
Conflict of interest
If the firm is prevented from acting because of a conflict of interest, an incompatibility under professional ethics or any other reason relating to professional rules, the fee is refunded in full and the documents submitted are deleted.
Confidentiality
The documents and information submitted are covered by lawyer-client professional privilege (secret professionnel). They are held securely for fourteen days and then automatically deleted from the transmission servers. The processing of personal data is described in the privacy policy.
Complaints and mediation
Any complaint may be sent to the firm by email. In the event of a dispute over fees, the client may refer the matter to the President of the Paris Bar (bâtonnier de l’Ordre des avocats de Paris).
In accordance with Article L. 616-1 of the Consumer Code, a consumer client may also have recourse, at no charge, to the consumer mediator for the legal profession: Madame Sandra WEREY, 180 boulevard Haussmann, 75008 Paris — mediateur-consommation-avocat.fr.
