You are British, you have a university place in France, and you assume that student life will sort out the paperwork by itself. Since 1 January 2021 it will not. British students are third-country nationals, which means a long-stay visa before departure, a validated permit on arrival, yearly proof of money and results, and a prefect who can refuse renewal and order you to leave if your studies stall. The good news is that the route is well marked: a single online procedure covers the United Kingdom, the first visa converts smoothly into a residence card, serious students can work part-time and stay on after a master’s degree, and courts regularly annul refusals built on lazy reasoning. This guide explains, step by step, how a British student lawfully arrives and stays in France, how to renew and upgrade the student card, what part-time work is allowed, and exactly how to challenge a refusal or an order to leave.
I. How does a British student lawfully arrive and stay in France?
A. From a British classroom to a French lecture hall: the visa route
Unlike the pre-Brexit years, no British student can simply arrive and enrol. The official service-public.fr guidance, verified on 1 August 2026, sets a three-stage sequence: first a long-stay visa valid as a residence permit with student status, lasting four months to one year; after one year, a temporary one-year student card or a multi-year student card lasting two to four years; with resource conditions to meet throughout. British applicants go through the single national online channel. Treat the platform as the start of your legal record, not as a mere application form: inconsistent dates, changing study plans or uploaded documents that contradict your interview answers resurface at renewal time, when the prefect re-reads the whole history. Choose a coherent project, a degree that follows from your A-levels, Scottish Highers or prior degree, at an institution genuinely equipped to receive you, and keep every admission letter, receipt and email.
The statute sets the entry ticket in one sentence. Article L. 422-1 of the Code on the Entry and Residence of Foreigners and Asylum provides: « L’étranger qui établit qu’il suit un enseignement en France ou qu’il y fait des études et qui justifie disposer de moyens d’existence suffisants se voit délivrer une carte de séjour temporaire portant la mention ” étudiant ” d’une durée inférieure ou égale à un an. » A foreigner who shows enrolment in France and sufficient means receives a temporary student card of up to one year. Two conditions, nothing more and nothing less: real studies and real money. Everything the consulate asks for, admission proof, accommodation evidence, bank statements, parental guarantees, school certificates, maps onto those two words. A narrow fast lane exists for competitive entry: article L. 422-2 of the same Code states that « La carte de séjour prévue à l’article L. 422-1 est également délivrée lors de sa première admission au séjour, sans avoir à justifier de ses conditions d’existence et sans que soit exigée la condition prévue à l’article L. 412-1, à l’étranger ayant satisfait aux épreuves du concours d’entrée dans un établissement d’enseignement supérieur ayant signé une convention avec l’Etat. » A student admitted through the entrance examination of a partner elite institution is excused from proving resources and from the usual visa condition at first admission. Few British undergraduates qualify, but classes préparatoires candidates and concours entrants should know the lane exists.
On arrival, validate the VLS-TS online within three months and complete the medical and civic formalities the system assigns. Enrol administratively at the university, pay the student life contribution, called the contribution vie étudiante et de campus, register for student social security alongside enrolment, and open a French bank account quickly: prefects later read bank statements as the diary of your means, and a student with no French account and only cash claims starts renewal on the back foot. Keep the validation certificate with your passport; it is your residence title for year one.
B. Renewing, upgrading and working: the multi-year student card and the 60 per cent rule
After year one, the system rewards steady students with longer cards. The same official guidance confirms the upgrade: after one year you may seek a temporary one-year card or a multi-year card valid for two to four years. Renewal is not automatic; it is a fresh examination of the same two conditions. Article R. 433-2 of the same Code requires that « L’étranger déjà admis à résider en France qui sollicite le renouvellement d’une carte de séjour pluriannuelle présente à l’appui de sa demande les pièces prévues pour une première délivrance de la carte de séjour temporaire correspondant au motif de séjour de la carte de séjour pluriannuelle dont il est détenteur et justifiant qu’il continue de satisfaire aux conditions requises pour celle-ci ainsi, le cas échéant, que les pièces particulières requises à l’occasion du renouvellement du titre conformément à la liste fixée par arrêté annexé au présent code. » You re-prove enrolment and means, plus any renewal-specific items on the official list. File on the ANEF online portal, the administration’s digital front desk, two to four months before expiry: late filing surrenders the receipt, called the récépissé, that protects your right to stay and work while the file is examined, and a gap in documented status poisons later applications for other cards.
Student status includes a genuine right to work. Article L. 422-1 of the same Code adds: « Cette carte donne droit à l’exercice, à titre accessoire, d’une activité professionnelle salariée dans la limite de 60 % de la durée de travail annuelle. » The card allows employed work on the side up to 60 per cent of the annual working year, roughly 964 hours, with no prior work permit. Exceed the ceiling and the sanction is severe: article R. 422-7 of the same Code warns that « La carte de séjour temporaire portant la mention ” étudiant ” prévue aux articles L. 422-1 ou L. 422-2 peut être retirée si l’étranger qui en est titulaire ne respecte pas la limite de 60 % de la durée de travail annuelle mentionnée à l’article L. 422-1. » The card may be withdrawn for breach of the limit. Count every payslip across all employers, keep the running annual total, and refuse extra shifts that push you over: the prefect cross-checks social-security declarations, and students who funded their studies with undeclared full-time work lose both the card and credibility. Note the boundary: salaried work is covered, but self-employment is not, so a British student running a real freelance business needs different advice before invoicing.
Graduation opens a bridge to professional life. Article L. 422-10 of the same Code provides that « L’étranger titulaire d’une assurance maladie qui justifie soit avoir été titulaire d’une carte de séjour temporaire ou pluriannuelle portant la mention ” étudiant ” délivrée sur le fondement des articles L. 422-1, L. 422-2 ou L. 422-6 et avoir obtenu dans un établissement d’enseignement supérieur habilité au plan national un diplôme au moins équivalent au grade de master ou figurant sur une liste fixée par décret, soit avoir été titulaire d’une carte de séjour pluriannuelle portant la mention ” talent-chercheur ” délivrée sur le fondement de l’article L. 421-14 et avoir achevé ses travaux de recherche, se voit délivrer une carte de séjour temporaire portant la mention ” recherche d’emploi ou création d’entreprise ” d’une durée d’un an dans les cas suivants : 1° Il entend compléter sa formation par une première expérience professionnelle, sans limitation à un seul emploi ou à un seul employeur ; 2° Il justifie d’un projet de création d’entreprise dans un domaine correspondant à sa formation ou à ses recherches. » A master’s-level graduate with health cover receives a one-year job-search or business-creation card, for a first professional experience with any employer or for a start-up project in the field of study. Plan the final year around this card: line up the diploma, keep health cover continuous, and prepare either job applications or a credible business file before the student card expires.
A Paris and Île-de-France note matters because most British students land there. In Paris, renewals go to the préfecture de police, the Paris police prefecture that handles foreigners’ files for the capital, whose queues and processing times differ from provincial prefectures. File early on ANEF, keep the filing confirmation, and collect the receipt in person where required. Large universities run dedicated welcome desks, called guichets uniques, each September that resolve enrolment certificates and housing attestations in days rather than weeks: use them before they close.
II. Why do prefects refuse student renewals, and how do you fight back?
A. The two tests every renewal must pass: serious studies and sufficient means
Almost every student refusal rests on the same two findings: the studies are said not to be real and serious, or the money is said to be insufficient. Courts control both findings closely, and two recent appeal rulings, one annulling a refusal and one upholding it, draw the exact boundary British students must respect.
The controlling test was restated by the Paris Administrative Court of Appeal on 7 March 2025 in judgment no. 24PA02311. A Chinese master’s student had her renewal refused by the Paris police prefect for alleged lack of progress: no diploma since her 2021 licence, two repeated years, a change of programme. The court annulled the refusal and the accompanying order to leave. Its statement of the law deserves quotation: « Pour l’application de ces dispositions, il appartient à l’administration, saisie d’une demande de renouvellement d’une carte de séjour en qualité d’étudiant, d’apprécier, sous le contrôle du juge, la réalité et le sérieux des études poursuivies. » The administration must assess, under judicial control, the reality and seriousness of the studies. Applying that control, the court found the prefect had committed an error of assessment, noting the student’s earlier degree with distinction, her demanding placement described by her tutor as exceptional, and her subsequent master’s record with irreproachable attendance and satisfactory marks. The judgment concludes: « Il résulte de ce qui a été dit aux points 5 et 6 que le préfet de police, en refusant de renouveler le titre de séjour de Mme A… au motif du défaut de caractère réel et sérieux de ses études, a commis une erreur d’appréciation. L’arrêté attaqué est, par suite, entaché d’illégalité dans toutes ses dispositions. » The refusal was unlawful in all its provisions, taking the removal order down with it. For British students, the method is the lesson: one difficult year does not equal unserious studies where the overall file shows attendance, genuine effort and progression, and a prefect who counts repeated years without reading tutor evidence loses in court.
The mirror image came from Nancy a month earlier. On 6 February 2025 the Nancy Administrative Court of Appeal gave judgment no. 23NC03011, rejecting a student who had accumulated twelve years of enrolments without coherent progression. The court restated the full renewal test: « Pour l’application de ces dispositions, il appartient à l’administration, saisie d’une demande de renouvellement d’une carte de séjour présentée par un étranger en qualité d’étudiant, de rechercher, sous le contrôle du juge de l’excès de pouvoir, à partir de l’ensemble du dossier, si les études poursuivies par l’intéressé revêtent un caractère réel et sérieux et s’il dispose, à la date à laquelle elle statue, des moyens d’existence suffisants lui permettant de vivre et d’étudier en France compte tenu de tous les avantages, et notamment un logement gratuit, dont l’étudiant peut bénéficier par ailleurs. A cet égard, le caractère réel et sérieux de ces études est subordonné à une progression régulière de l’étudiant et à la cohérence de son parcours. » Two points in that passage decide cases. First, resources are judged at the decision date across the whole file, counting every advantage including free accommodation: a British student housed free by family in France needs less cash than one renting in Paris, but must prove the arrangement. Second, seriousness means steady progression and a coherent path: endless restarts across unrelated fields signal residence-seeking, not studying. The same ruling fixes the money floor: « En application du point 25 de l’annexe 10 au code de l’entrée et du séjour des étrangers et du droit d’asile, le montant de ressources considéré comme suffisant s’élève à 615 euros mensuels. » Six hundred and fifteen euros a month is the benchmark, adjusted upward in practice for Paris rents, and shown through bank statements, scholarship letters, or parental transfers that are regular, documented and credible.
Three refusal patterns follow from these rulings. First, academic drift: repeated failures, silent semesters, programme-hopping, or enrolment in a school chosen for its lax attendance rather than its teaching. Second, financial fog: lump sums deposited days before the appointment then withdrawn, sponsors whose income cannot support the promise, or means that evaporate mid-year. Third, the public-order bar, which needs no academic pretext: article L. 432-1 of the same Code allows that « La délivrance d’une carte de séjour temporaire ou pluriannuelle ou d’une carte de résident peut, par une décision motivée, être refusée à tout étranger dont la présence en France constitue une menace pour l’ordre public. » Any card may be refused by reasoned decision where presence threatens public order. Criminal convictions, fraud, or document forgery end student residence faster than any failed exam, and forgery poisons every later application for any status.
Build the renewal file as if the prefect were already sceptical. Enrolment certificate for the coming year, transcripts for every past year, attendance records where available, a short personal statement explaining any gap or change with dates and reasons, tutor letters describing assiduity and results, bank statements for six to twelve months, scholarship or parental support letters with the sponsor’s own income proof, housing evidence, and health cover. Where a year went badly, explain it once, honestly, with evidence of recovery: the Paris ruling rewards documented recovery, while silence invites the Nancy outcome.
B. Challenging a refusal or an order to leave: deadlines, judges and the winning file
A refusal rarely travels alone: it usually comes with an order to leave French territory, called an obligation de quitter le territoire français, commonly shortened to OQTF, giving thirty days to depart and fixing the destination country. The two decisions stand or fall together, as the Paris ruling shows: kill the refusal for error of assessment and the removal order collapses with it. Read the notification letter the day it arrives and calendar immediately, because student cases move fast and some appeal windows against removal measures are counted in days.
Start with the free informal appeal. A recours gracieux, the reasoned request asking the prefect to reconsider, costs nothing and sometimes works where the refusal stemmed from a missing or misread document: a transcript the office overlooked, a scholarship letter filed under the wrong name, a bank error since corrected. Send it by registered post with acknowledgment, called lettre recommandée avec accusé de réception, enclose the missing proof, and keep the slip. But never let the informal appeal eat the court deadline. Article R. 421-1 of the Code of Administrative Justice states: « La juridiction ne peut être saisie que par voie de recours formé contre une décision, et ce, dans les deux mois à partir de la notification ou de la publication de la décision attaquée. » The court must be seized within two months of notification. File the administrative appeal, called recours contentieux, before the tribunal administratif within that window even while the informal request is pending, and ask the court to annul the refusal and, as in the Paris case, to order the prefect to issue the card or re-examine, if needed under daily penalty, called astreinte.
Plead like the winners pleaded. Attack motivation first: a refusal that recites formulas without engaging your transcripts, tutor letters or bank statements suffers from defective reasoning. Attack factual accuracy next: semesters the prefect claims you skipped but you attended, diplomas it says you lack but you hold, funds it ignores but your statements show. Then invite the judge to do what the Paris court did: weigh the whole file, attendance, marks, distinction, placement reports, recovery, and find an error of assessment. Where money is the ground, reconstruct the monthly average across the year, add proven free housing, and show the total against the 615-euro benchmark. Where progression is the ground, chart the path visually: entry level, each year, each result, each step forward, with the weak year explained and the rebound documented. Judges decide student cases on files, not speeches, and the file that reads like the Paris student’s wins over the file that reads like the Nancy student’s.
While the case runs, protect interim status. A timely renewal application normally yields a receipt that authorises stay and, for students, accessory work until the decision: never let it lapse, renew it before expiry, and carry it with identity documents. If an OQTF with a short departure deadline is notified, ask the court for interim relief immediately: some removal orders can be executed once deadlines expire, and a student who misses the suspension request litigates from abroad. Keep studying, keep attending, keep every new transcript: post-refusal progress proves the very seriousness under dispute, and several courts have treated fresh results as lighting up a previously doubtful file.
Conclusion
For a British student, France after Brexit is open but exacting: the Etudes en France channel and a long-stay visa for year one, a one-year then multi-year card for steady students, part-time work capped at 60 per cent of the annual year, and a one-year job-search or start-up card after a master’s degree. Prefects refuse where studies drift or money dissolves, and courts draw the line with precision: documented attendance, coherent progression and proven means defeat an error of assessment, as the Paris court showed in March 2025, while scattered years and foggy finances confirm it, as the Nancy court showed a month earlier. File early, prove everything twice, count every payslip, and challenge every adverse decision within its deadline: two months for the court, days where removal looms.
