The builder has retired, the developer’s company has been wound up, or the seller who renovated the house before selling it to you shrugs and points at the acte de vente (deed of sale). Under French law, none of that ends the story. Every new building — and every major renovation treated as construction work — carries a strict ten-year warranty, the garantie décennale (ten-year builder warranty), which runs with the property itself and binds builders, sellers and their insurers whether or not any contract links them to you. This guide explains what that warranty covers, whom it binds, and how a foreign owner enforces it from abroad, with the statutes and the Cour de cassation (France’s supreme court for civil matters) decisions that actually govern each step.

Two ideas organise everything that follows. First, the warranty protects the building, not the person who ordered the works: it passes automatically to each successive buyer, and the ten-year clock starts on a single event, the réception (formal acceptance of the works), not on the date you bought. Second, France separates emergency money from final liability. A special insurance, the assurance dommages-ouvrage (damage-to-works insurance, often called DO insurance), must pay for repairs quickly without waiting to decide who is at fault, while the search for the liable builder follows its own longer path. Understanding that split is what lets a non-resident owner get a house repaired before arguing about who pays.

I. What the ten-year warranty covers and who it binds

A. A strict liability triggered only by serious disorders

The foundation is a single sentence of the Civil Code. Article 1792 provides that every builder of a works is strictly liable, towards the client or the buyer of the works, for damage, even resulting from a defect of the soil, which compromises the solidity of the works or which, affecting it in one of its constituent elements or one of its items of equipment, renders it unfit for its purpose. Three features matter for a foreign buyer. Liability is de plein droit (automatic, without proof of fault): once the disorder meets the gravity test, the builder is liable unless it proves an external cause. Soil defects are expressly included, which is why subsidence and clay shrinkage cases dominate the case law. And the claimant can be the acquéreur (buyer) — you do not need to be the person who commissioned the works.

Gravity is everything, and the courts police it strictly. The Third Civil Chamber held on 25 September 2025, appeal no. 24-10.517, published on the Court’s official website, that harm qualifies only if it has compromised solidity or fitness for purpose with certainty within the ten years following acceptance. In that case a villa accepted on 25 August 2008 showed structural, worsening cracks on two facades, yet the court-appointed expert, whose work ran until September 2019, had stated that the house faced no immediate risk of collapse and was not currently unfit to live in. The Cour de cassation recalled the governing principle: « Selon ce texte, tout constructeur d’un ouvrage est responsable de plein droit, envers le maître ou l’acquéreur de l’ouvrage, des dommages, même résultant d’un vice du sol, qui compromettent la solidité de l’ouvrage ou qui, l’affectant dans l’un de ses éléments constitutifs ou l’un de ses éléments d’équipement, le rendent impropre à sa destination », then quashed the appeal court’s decision because that court had itself recorded acceptance on 25 August 2008 alongside the expert’s statement that the villa faced no immediate risk of collapse and was not currently unfit to live in — findings that did not establish the required gravity with certainty within the ten years following acceptance. Evolving cracks, without such a dated finding of gravity, cannot support the ten-year warranty. For a buyer, the lesson is practical: aesthetic cracks and anxieties about the future are not enough, and an expert report must say plainly, with measurements, that solidity is compromised or the house is unfit for its purpose — or that this outcome is certain — before the ten years expire.

The same decision confirms what the warranty does pay for when gravity is established. On 3 April 2025, appeal no. 23-16.055, published on the Court’s official website, the Third Civil Chamber held that all harm flowing from the disorder must be repaired by the liable builder. The court stated: « Il s’ensuit que tous dommages, matériels et immatériels, consécutifs aux désordres de l’ouvrage, doivent être réparés par le constructeur tenu à garantie en application de ce texte », which means that material and consequential non-material losses alike — in that case the owners’ rehousing, furniture storage and removal costs during re-tiling works — fall on every builder held under the warranty. A foreign owner forced to rent elsewhere while a Dordogne roof is redone can therefore claim those costs within the same action, provided the underlying disorder itself meets the gravity test.

Below that summit sits a ladder of shorter guarantees that foreign buyers constantly confuse with the ten-year one. Equipment that forms an inseparable part of the structure — foundations, framework, enclosure, roofing — falls under the extended rule of article 1792-2, which provides that the presumption of liability also covers damage affecting the solidity of items of equipment, but only where they form an inseparable body with the structural, foundation, framework, enclosure or roofing works. Other items of equipment carry a two-year proper-functioning warranty: article 1792-3 states that the other items of equipment of the works are covered by a minimum two-year guarantee of proper functioning from acceptance. And every contractor owes a one-year perfect-completion warranty from acceptance, defined by article 1792-6, which provides that acceptance is the act by which the client declares that it accepts the works, with or without reservations and that the one-year warranty covers repair of all disorders flagged in reservations or notified in writing afterwards. When a Paris flat’s newly fitted boiler fails in month eight, that is a one- or two-year claim, not a ten-year one; reserving the disorder in the acceptance report or notifying it in writing within the year is what preserves it. Owners who invoke the wrong warranty lose time, and time is the one thing the ten-year clock does not give back.

B. Builders, deemed builders, sellers — and the insurers behind them

French law defines the circle of liable persons generously. Article 1792-1 provides that a builder includes any architect, contractor, technician or other person bound to the client by a works contract, any person who sells, after completion, a works it has built or had built, and any person acting as the owner’s agent on a mission equivalent to a works contract. The second category is the one that matters most to buyers of renovated houses: the vendor who built the extension, commissioned the refurbishment and then sold is treated as a builder towards you, even though your only contract is the sale. Background on how French purchase transactions allocate these risks is available through our English-language real estate practice in Paris, which regularly advises foreign buyers on claims against sellers and builders.

That deemed-builder status has a precise consequence confirmed on 30 January 2025, appeal no. 23-16.347, published on the Court’s official website. The Third Civil Chamber held that a person who sells after completion a works it built or had built is liable, during the ten years following acceptance, under proven fault for so-called intermediate damage — disorders too slight for the automatic ten-year warranty but still wrongful. The court recalled: « Selon le premier de ces textes, est réputé constructeur la personne qui vend, après achèvement, un ouvrage qu’elle a construit ou fait construire », and held that such a seller answers, during the ten years following acceptance, under proven fault for so-called intermediate damage — which means that even when cracks or defects never reach ten-year gravity, the renovating seller remains liable for ten years if you prove fault, such as a breach of building standards. This is the safety net beneath the strict warranty, and it is why identifying the seller as a deemed builder transforms many seemingly hopeless files.

Two transmission rules complete the picture, both settled on 12 November 2020, appeal no. 19-22.376, published on the Court’s official website. First, the ten-year action passes with ownership to successive buyers, while the original client keeps the right to sue where it retains a direct and certain interest, for example after being ordered to compensate its own buyer. The court stated: « si l’action en garantie décennale se transmet en principe avec la propriété de l’immeuble aux acquéreurs, le maître de l’ouvrage ne perd pas la faculté de l’exercer quand elle présente pour lui un intérêt direct et certain », which means that buying a house with cracks gives you the warranty claim automatically, with no assignment clause needed in the deed. Second, disorders covered by a statutory warranty cannot be pursued through ordinary contractual liability against persons bound by that warranty. The court stated: « les dommages qui relèvent d’une garantie légale ne peuvent donner lieu, contre les personnes tenues à cette garantie, à une action en réparation sur le fondement de la responsabilité contractuelle de droit commun », which means your claim must be framed inside the warranty system, with its gravity test and its deadlines, rather than as a generic breach-of-contract complaint.

Behind the builders stand two compulsory insurers, and checking their existence is the first diligence of any buyer. Every person whose ten-year liability may be engaged must be insured: article L.241-1 of the Insurance Code provides that any natural or legal person whose ten-year liability may be engaged must be covered by insurance, and must prove at the opening of any site that it has taken out such a contract. Symmetrically, anyone having construction works carried out — owner, seller or agent — must take out damage-to-works insurance before the site opens, for itself and successive owners: article L.242-1 of the Insurance Code provides that any person having construction works carried out must subscribe, before the opening of the site, insurance guaranteeing, without any search for liability, payment of the full cost of repairing damage of the kind for which builders are liable. A foreign buyer should therefore demand, before signing anything, the builder’s ten-year insurance certificate and the DO policy for the works — and verify that the insurer named still exists, because an unreachable insurer turns even a perfect legal claim into a collection problem.

II. Enforcing the warranty from abroad: the clock, the insurer, and the court

A. The ten-year clock starts at acceptance, and the fast lane runs through the DO insurer

Every deadline in this system runs from a single event: acceptance. Article 1792-4-1 of the Civil Code provides that any person whose liability may be engaged under the ten-year regime is discharged from it ten years after acceptance of the works. The Third Civil Chamber treats that period as a trial period in the strictest sense: in the 12 November 2020 decision cited above, appeal no. 19-22.376, published on the Court’s official website, it held that no action founded on the warranty, not even a recourse claim between builders, can be brought more than ten years after acceptance. The court stated: « le délai de la garantie décennale étant un délai d’épreuve, toute action, même récursoire, fondée sur cette garantie ne peut être exercée plus de dix ans après la réception », which means that a writ issued on the tenth anniversary plus one day is too late, including for a builder suing another builder. A non-resident owner who discovers cracks in year nine must therefore instruct counsel and, if needed, file immediately: distance is no excuse the courts will hear.

Acceptance itself is broader than many foreigners assume. It can be express, judicial, or tacit — and tacit acceptance is presumed from conduct. On 20 March 2025, appeal no. 23-20.475, published on the Court’s official website, the Third Civil Chamber restated that full payment of the works plus taking possession creates a presumption of tacit acceptance, which does not require the works to be finished and may carry reservations. The court stated: « le paiement de l’intégralité des travaux et la prise de possession par le maître de l’ouvrage valent présomption de réception tacite, laquelle n’est pas subordonnée à l’achèvement de l’ouvrage, mais peut être assortie de réserves », which means that moving into an unfinished house after paying the contractor in full almost certainly starts your ten-year clock, while allowing you to list visible defects as reservations. For a buyer, the consequence is that the clock usually started years before you purchased: always ask the seller for the acceptance report (procès-verbal de réception), because without its date you cannot know how much warranty remains.

Alongside the ten-year liability action runs the fast lane: the DO insurer must fund repairs without waiting for fault to be allocated. Article L.242-1 of the Insurance Code provides that the insurer has a maximum of sixty days from receipt of the claim declaration to notify its decision on whether the policy is triggered, and must then present an compensation offer within a maximum of ninety days. The sanction for missing those deadlines was sharpened on 30 September 2021, appeal no. 20-18.883, published on the Court’s official website: the insurer must answer every claim declaration within sixty days, even one repeating previously reported disorders, and a failure to do so deprived it of the right to oppose the time-bar it invoked. The court stated: « l’assureur dommages-ouvrage est tenu de répondre dans le délai de soixante jours à toute déclaration de sinistre, y compris lorsqu’il estime que les désordres sont identiques à ceux précédemment dénoncés », which means that a silent or late DO insurer loses its favourite defence and the insured owner, after notifying the insurer, may commission the necessary repairs while the indemnity is increased by operation of law. For an owner living abroad, this procedure is the practical priority: declare the loss to the DO insurer in writing without delay, calendar the sixty-day deadline, and do not let an agent’s reassurances substitute for a recorded declaration.

B. The practical path: evidence first, expertise second, and the Paris forum

Order matters more than speed alone. Before anything else, freeze the evidence: dated photographs, the acceptance report with its reservations, the builder’s insurance certificate, the DO policy, and every exchange with the seller or contractor. Then have the disorders formally recorded by a commissaire de justice (judicial officer, formerly huissier), whose report fixes what the cracks, leaks or failures looked like on a certain date — the 2025 villa decision shows how decisively outcome turns on dated expert findings about gravity. Notify the seller and the builders in writing, declare the loss to the DO insurer, and only then debate liability. Owners who start by arguing fault while the ten-year clock runs down commit the classic error this field punishes: the warranty rewards the claimant who documents early, not the one who negotiates longest. General guidance on structuring a French property dispute from England or elsewhere is available through our English-language real estate practice in Paris, which assists non-resident owners with exactly this sequence.

The procedural engine is the court-ordered technical investigation, the expertise judiciaire (judicial expert assessment). In urgent cases it is obtained from the interim-relief judge (juge des référés) of the court where the property sits, quickly and even in summer; the expert then visits, sometimes over several seasons to observe whether cracks evolve, hears the parties, and files a report on origin, gravity and cost of repair. That report is not a judgment, but in construction cases it settles most files: insurers make offers on it, and judges follow it unless seriously challenged. Two warnings from the decisions above should shape your instructions to counsel. First, ask the expert to opine expressly on whether solidity is compromised or the building unfit for its purpose — or certainly will be — within ten years of acceptance, because the September 2025 ruling rejects vague findings of evolving structural cracking without that dated conclusion. Second, if the disorders look too slight for the strict warranty, plead in the alternative the renovating seller’s proven-fault liability for intermediate damage, which the January 2025 ruling preserves for the full ten years.

For Paris and Île-de-France property, three local points sharpen the general method. First, jurisdiction follows the building: a Paris flat’s construction or renovation dispute goes to the tribunal judiciaire de Paris (Paris judicial court), whose interim-relief judges handle a heavy flow of expertise applications and expect a complete file — acceptance report, insurance certificates, the judicial officer’s record, the DO declaration with proof of receipt — rather than bare allegations. Second, co-ownership overlays liability: in a Paris apartment block, façade or roof disorders concern the syndicat des copropriétaires (co-ownership association) through its syndic (managing agent), while interior renovation disorders concern your own contractor, and the two actions must not be confused, because suing the wrong defendant wastes the months the ten-year clock does not refund. Third, Paris repair economics change litigation value: relogement costs, storage and contractor rates in the capital make the consequential losses recognised by the April 2025 decision — rehousing, storage, removal — a substantial head of claim, which should be documented with invoices from the start rather than reconstructed later. None of this alters the substantive law; it determines where and how expensively the law is applied.

Conclusion

The ten-year builder warranty is the strongest buyer-protection instrument in French construction law, but it is a precision tool, not a general guarantee of quality. It covers only disorders that certainly compromise solidity or fitness for purpose within ten years of acceptance, it binds a defined circle of builders, deemed-builder sellers and their compulsory insurers, and it expires by a strict trial-period deadline that bars even recourse claims brought one day late. Around it sit the two-year equipment warranty, the one-year completion warranty, the renovating seller’s proven-fault liability for lesser disorders, and the DO insurer’s duty to fund repairs within sixty and ninety days. A foreign owner who records the acceptance date, documents disorders early through a judicial officer and a court expert, declares the loss to the DO insurer without delay, and frames each claim inside the correct warranty gives the system what it needs to work.
