You are shaken, you may be in hospital, and the paperwork is in French. The first question is simple: who pays for your injuries, and what happens if the insurer offers you far less than your losses? The answer is reassuring. France has one of the most protective road-accident systems in Europe, built around a statute called the loi Badinter (the Road Traffic Victims Act of 5 July 1985). Because the crash happened on French soil, it is French compensation law that decides what you receive, even if you are British, even if you have gone back to the United Kingdom, and even if the vehicle that hit you was registered in Britain or Spain. The liable driver’s insurer must make you a reasoned compensation offer within strict statutory deadlines, and if the offer is late, incomplete or too low, the law gives you concrete weapons: penalty interest at double the legal rate, a second medical assessment, and ultimately the French judge. Brexit changed none of this. You do not need a green card to drive in France, but you do need valid insurance, and the British side of the system still works through French bodies that deal with foreign vehicles every day. This article explains, step by step, which law applies to your crash, who exactly has to pay, how your status as pedestrian, passenger, cyclist or driver changes your rights, the precise timetable the insurer must follow, and how to challenge a refusal or an offer that undervalues your injury.

I. The crash happened in France, so French law decides your compensation and names your payer

A. Where the damage occurred fixes the applicable law, and every motor vehicle on a French road is inside the Badinter system

When a British resident is injured in France by a French driver, a Spanish lorry or another British motorist on holiday, the first legal question is which country’s law governs the claim. The answer comes from an international treaty that France applies to every cross-border road crash, the Hague Convention of 4 May 1971 on the law applicable to traffic accidents. (Cour de cassation, First Civil Chamber, 15 June 2022, appeal No 21-13.306, published in the Bulletin, cassation). In plain terms: injured in France, French compensation law applies, even if you live in Manchester, even if your medical treatment continues in England, and even if your lost earnings are in pounds sterling. The Cour de cassation has also confirmed that French courts must apply this Convention to determine the applicable law, even when ruling urgently: “En statuant ainsi, alors que la Convention de La Haye du 4 mai 1971 sur la loi applicable aux accidents de la circulation routière a été ratifiée par la France, la cour d’appel qui, même statuant en référé, était tenue d’en faire application pour déterminer la loi applicable au litige, a violé le texte susvisé.” (Cour de cassation, First Civil Chamber, 18 November 2020, appeal No 19-17.924, published in the Bulletin, cassation). An English court hearing such a case would apply the same conflict rule and therefore French law to the substance of the claim, although in practice most British victims claim directly in France, where the insurer, the experts and the judge are.

live in France or you are spending a few weeks in your French house, and a car hits you on a pedestrian crossing in Bordeaux, or someone drives into the back of your car on the A10 near Poitiers. Its Article 1 defines the field as follows: “Les dispositions du présent chapitre s’appliquent, même lorsqu’elles sont transportées en vertu d’un contrat, aux victimes d’un accident de la circulation dans lequel est impliqué un véhicule terrestre à moteur ainsi que ses remorques ou semi-remorques, à l’exception des chemins de fer et des tramways circulant sur des voies qui leur sont propres.” Three points matter for a British reader. First, the word impliqué (involved) is deliberately wide: the vehicle does not need to have touched you. A car that forces your bicycle off the road without contact, or a lorry whose sudden braking throws you inside a coach, is involved. Second, passengers carried under a contract, for example on a French coach excursion or in a taxi, are covered too. Third, only railways and trams running on their own reserved tracks are excluded; everything else with a motor, from a car to a delivery van to a tractor, is in.

Once a motor vehicle is involved, the driver who caused the crash has almost no escape. Article 2 of the same law states: “Les victimes, y compris les conducteurs, ne peuvent se voir opposer la force majeure ou le fait d’un tiers par le conducteur ou le gardien d’un véhicule mentionné à l’article 1er.” Neither an unforeseeable event (force majeure) nor the fault of a third party can be raised against you by the driver or the keeper of the vehicle. A French court will not listen to a driver who says a sudden gust of wind, a burst tyre or another motorist’s manoeuvre excuses everything. For the victim, this is the foundation of the whole system: you do not have to prove the driver was at fault in the way English negligence law demands. Involvement of the vehicle plus your bodily injury is enough to open the right to compensation, and the only debates left concern the narrow statutory exceptions examined below.

So who physically pays you? In the standard case, the insurer covering the civil liability (responsabilité civile) of the vehicle involved. After an accident you exchange details and complete the joint accident report (constat amiable), the familiar blue-and-yellow form, which is not an admission of liability but a factual record that speeds up the file. If the vehicle that hit you is British, the system still works: the United Kingdom remains in the green-card system, and the British government confirms that no green card is needed for driving in the EU, while valid vehicle insurance remains compulsory. A British insurer answers for crashes in France through its French correspondent, and where the foreign insurer is sued, it is represented in France by the French central motor bureau, the Bureau central français. That is exactly what happened in a case decided by the Cour de cassation on 28 March 2019, where the widow of a pedestrian killed by a Spanish-registered lorry sued in France the Bureau central français as representative of the Spanish insurer Allianz Espagne. If the driver who hit you is unknown, because it was a hit-and-run, or has no insurance, a public body steps in: the guarantee fund for compulsory damage insurance, the Fonds de garantie des assurances obligatoires de dommages. The French administration describes this safety net in English on its official service-public.fr pages, including the page devoted to compensation by the guarantee fund after a road accident. A British victim is therefore never left without a payer: foreign insurer, French correspondent, central bureau or guarantee fund.

B. Pedestrian, passenger or cyclist, your own mistake almost never cancels compensation, while a driver faces a stricter test

French law divides victims into two groups, and the distinction decides everything about which arguments the insurer can raise against you. If you were a pedestrian, a passenger, a cyclist, a scooter rider hit by a car, or simply standing beside your broken-down vehicle, Article 3 of the loi Badinter protects you with unusual strength: “Les victimes, hormis les conducteurs de véhicules terrestres à moteur, sont indemnisées des dommages résultant des atteintes à leur personne qu’elles ont subis, sans que puisse leur être opposée leur propre faute à l’exception de leur faute inexcusable si elle a été la cause exclusive de l’accident.” Read that sentence carefully, because it contains a double lock. The insurer cannot reduce your bodily-injury compensation for an ordinary mistake on your part: crossing slightly outside the zebra stripes, cycling without a helmet, stepping onto the road while looking at your telephone. Only an inexcusable fault (faute inexcusable) can exclude you, and only if that fault was the exclusive cause of the accident, meaning the driver’s behaviour played no role at all. In practice the two conditions together are so hard to meet that non-driving victims are compensated in the great majority of cases, with reductions remaining the exception.

The same article adds a reinforced shield for the most vulnerable. A British child knocked off a bicycle on the way to a French school, a 75-year-old British retiree hit while crossing to the market in Eymet, or a disabled adult with an 80 per cent incapacity rating are compensated in all cases. There is only one reservation, stated in the third paragraph: “Toutefois, dans les cas visés aux deux alinéas précédents, la victime n’est pas indemnisée par l’auteur de l’accident des dommages résultant des atteintes à sa personne lorsqu’elle a volontairement recherché le dommage qu’elle a subi.” Deliberately seeking the injury, typically attempted suicide on a road or motorway, is the single exclusion. Nothing else removes the right.

What counts as an inexcusable fault for an adult victim? The French courts use a stable definition, recalled in the 2019 Cour de cassation case mentioned above: an inexcusable fault is “la faute volontaire d’une exceptionnelle gravité exposant sans raison valable son auteur à un danger dont il aurait dû avoir conscience“, that is, a deliberate fault of exceptional seriousness, exposing its author without valid reason to a danger of which he should have been aware. In that case, a pedestrian had been standing safely beside his properly parked car on a motorway refuge, then suddenly and for no known valid reason walked onto the carriageway of the motorway at the exit of a bend that hid visibility, in front of a lorry travelling in the right-hand lane at the authorised speed, which had insufficient distance to avoid him. The Cour de cassation approved the court of appeal’s conclusion in these terms: “<a href="https://www.courdecassation.fr/decision/5fca740c55439e60eb7cb820"Mais attendu qu’ayant relevé que C… No 18-15.168, published in the Bulletin, rejection). The lesson for a British reader is clear: walking onto a motorway carriageway for no reason is the textbook example. Ordinary carelessness in town, by contrast, is not an inexcusable fault, and the insurer that invokes it must also prove it was the exclusive cause, which fails whenever the driver was speeding, distracted or badly positioned.

Drivers are treated differently, and British motorists driving their own car or a hire car in France must understand this asymmetry. Any fault by the driver, even a light one, can reduce the compensation for his or her own bodily injury, and a serious fault can remove it entirely. A British driver who drifts across the white line, drives after drinking, or joins a motorway without looking may therefore recover only part of the losses, or nothing, for personal injury, while the passengers in the same car remain fully protected under Article 3. Note that this concerns the driver’s own injuries; the driver’s liability towards others is unaffected. Two further provisions complete the picture. For damage to property, such as your crushed bicycle, your broken spectacles or your dented car, Article 5 states: “La faute, commise par la victime a pour effet de limiter ou d’exclure l’indemnisation des dommages aux biens qu’elle a subis. Toutefois, les fournitures et appareils délivrés sur prescription médicale donnent lieu à indemnisation selon les règles applicables à la réparation des atteintes à la personne.” Property follows an ordinary fault logic, but wheelchairs, prostheses and medical devices prescribed by a doctor are compensated under the generous bodily-injury rules. And where the victim dies or is gravely injured, the suffering of close relatives, called indirect victims (victimes par ricochet), follows the direct victim’s fate, because Article 6 provides: “Le préjudice subi par un tiers du fait des dommages causés à la victime directe d’un accident de la circulation est réparé en tenant compte des limitations ou exclusions applicables à l’indemnisation de ces dommages.” A spouse’s bereavement claim cannot exceed what the direct victim could have obtained.

II. The insurer works to a fixed timetable, and every refusal or low offer can be challenged before the judge

A. From the accident report to the reasoned offer, the deadlines run in your favour and your consent is never final on the spot

Once liability in principle is established, which as shown above is nearly automatic for non-driving victims, the system moves to money, and here again the statute protects the victim with deadlines that bind the insurer, not you. After completing the joint accident report at the scene and notifying the insurer under your policy, the injured person sends a claim for compensation (demande d’indemnisation) with medical certificates, sick-leave notes and proof of expenses. The insurer will usually order a medical examination (expertise médicale) by a doctor it appoints. The official service-public.fr page on compensation for bodily injury after a road accident, which describes each step, states that the victim is summoned at least 15 calendar days before the examination date, may be accompanied by a doctor of his or her choice, and that the expert’s report must be sent by the insurer within 20 days following the examination (Accident de la route: indemnisation des victimes de dommages corporels). Bring every document to that examination: hospital discharge summaries (comptes rendus d’hospitalisation), prescriptions, physiotherapy invoices, proof of home help paid privately, and evidence of lost earnings, because the expert’s report will structure the entire offer. A British victim treated partly in England should have the English records translated and sent to the expert; an incomplete file produces an incomplete offer.

The central obligation is the reasoned offer (offre d’indemnité motivée). Article L211-9 of the Insurance Code provides that “Une offre d’indemnité doit être faite à la victime qui a subi une atteinte à sa personne dans le délai maximum de huit mois à compter de l’accident.” The same article organises the details: an offer must be presented within three months of the claim where liability is not disputed and the loss is fully quantified, and where liability is rejected or unclear, or the loss is not yet quantified, the insurer must give a reasoned reply within the same period. Consolidation is the medical moment when your condition stabilises and any remaining after-effects (séquelles) are considered permanent; only after consolidation can permanent disability, future care needs and lasting effects on work and private life be priced. The final sentence is the key: wherever two deadlines could apply, the one most favourable to the victim applies.

Two further protections surround your acceptance. First, the offer must cover every compensable head of loss, including property damage not already settled, and for a deceased victim it is addressed to the heirs and where relevant the spouse. Second, even after you accept, you keep a cooling-off right: the service-public.fr page confirms that a 15-calendar-day right of retraction runs from the date of acceptance, and that the victim who refuses the offer may either enter further discussion or bring the matter before the judge to obtain fairer compensation (Accident de la route: indemnisation des victimes de dommages corporels). Never treat the first cheque as the end of the story if your condition is still evolving. And time, for once, is generous: Article 2226 of the Civil Code provides that “L’action en responsabilité née à raison d’un événement ayant entraîné un dommage corporel, engagée par la victime directe ou indirecte des préjudices qui en résultent, se prescrit par dix ans à compter de la date de la consolidation du dommage initial ou aggravé.” You have ten years from consolidation of the initial injury, or of its aggravation, to bring the liability action, which matters greatly for injuries that worsen years later. As for where to sue, Article 46 of the Code of Civil Procedure lets the claimant choose, in non-contractual matters, “en matière délictuelle, la juridiction du lieu du fait dommageable ou celle dans le ressort de laquelle le dommage a été subi“, so a British victim can seise the tribunal judiciaire (the ordinary civil court) of the place where the crash happened, practical when the evidence, the experts and the witnesses are in France, even after returning to Britain.

B. Refusing a low offer, forcing penalty interest, and asking the judge for a full reassessment

Insurer offers are frequently too low, not necessarily from bad faith but because the file is incomplete or a head of loss is missing: future care costs underestimated, loss of promotion prospects ignored, the spouse’s own moral suffering omitted, English medical bills left out because they were never translated. Your first response should be methodical rather than angry. Ask for the detailed breakdown behind the offer and compare it, line by line, with the medical consolidation report and your receipts. French bodily-injury practice itemises losses under standard headings, medical expenses, assistance by a third person (tierce personne), lost earnings, permanent functional deficit, suffering endured (souffrances endurées), aesthetic damage, loss of enjoyment of life (préjudice d’agrément), and the moral and economic losses of close relatives. Any heading that is absent or priced at zero without reasons is a ground for challenge. You may obtain your own medical opinion from a doctor who advises victims (médecin-conseil de victimes), distinct from the insurer’s expert, and send the insurer a reasoned counter-valuation with supporting documents. Many files settle at this stage for a significantly higher figure once the missing evidence arrives.

If the insurer misses the statutory deadlines or serves an offer that is manifestly derisory, the statute punishes the delay automatically. Interest at twice the legal rate runs automatically from expiry of the deadline until the offer or the final judgment, and only circumstances beyond the insurer’s control allow the judge to reduce it. This is a powerful lever in negotiation, but a second Cour de cassation decision shows it must be used explicitly. On 24 May 2018 the Second Civil Chamber rejected a victim’s claim for double interest with this reasoning: “Mais attendu que M. X… n’ayant soutenu dans ses conclusions d’appel ni qu’aucune offre provisionnelle n’avait été faite dans les huit mois de l’accident, ni que l’offre définitive du 17 novembre 2011 était manifestement insuffisante et incomplète, la cour d’appel, qui n’avait pas à procéder à une recherche qui ne lui était pas demandée, a légalement justifié sa décision ;” (Cour de cassation, Second Civil Chamber, 24 May 2018, appeal No 17-12.470, published in the Bulletin, rejection). The court will not investigate of its own motion; your written submissions must state precisely that no provisional offer was made within eight months of the accident, or that the final offer was manifestly insufficient and incomplete. Plead the penalty in clear terms, with dates, or lose it.

When negotiation fails, the judge takes over the valuation entirely. Before the tribunal judiciaire of the place of the accident, you can request a court-ordered medical assessment (expertise judiciaire) by an independent expert, interim payments (provisions) while the case continues, and a full reassessment of every head of loss, where the judge is not bound by the insurer’s figures. If your condition worsens after a settlement or a judgment, Article 2226 quoted above gives you a fresh starting point: the ten-year period for aggravated damage runs from consolidation of the aggravation, so a knee that deteriorates five years after the crash can reopen the file. Where the crash also led to a prosecution, for example for drink-driving or dangerous driving causing injury, you may join the criminal proceedings as a civil party (partie civile) and have the criminal court rule on your compensation at the same time as guilt; the mechanism is explained step by step in our guide for British victims of crime in France who file a complaint, join the trial and claim compensation, and the same logic applies when a road accident becomes a criminal case. Finally, if the liable driver was uninsured or fled, address the guarantee fund directly with the police report, the medical evidence and proof that no insurer can pay; the official English-language page on compensation by the guarantee fund lists the path, and the fund then pursues the wrongdoer itself.

Conclusion

A road crash in France does not leave a British victim at the mercy of an insurer’s first figure. French law applies because the damage occurred in France; the loi Badinter compensates pedestrians, passengers and cyclists for bodily injury unless an inexcusable fault was the exclusive cause of the accident, and it measures drivers by their own faults; the insurer must present a reasoned offer within three months of the claim and in any event within eight months of the accident, with a definitive offer five months after consolidation; late or derisory offers attract interest at double the legal rate when expressly pleaded; and you keep ten years from consolidation to bring your action before the court of the place of the accident. Keep the accident report, photograph everything, have every English medical document translated, never accept an incomplete offer during the cooling-off period without advice, and plead each deadline breach in writing. The statute was written so that the victim, including the British visitor who has long since driven home, is paid fully and quickly, and the judge remains available whenever the insurer forgets that purpose.

Injured on a French road after Brexit?
