Your Paris apartment is managed by a local administrateur de biens (licensed rental manager). One month the rent stops arriving. Then two. The quarterly statement never comes, your emails go unanswered, and when you finally get someone on the phone you hear that the tenant “is sorting things out”. Months later you discover the tenant was never properly vetted, the rent guarantee you paid for covers nothing, and the manager claims you owe him fees for work done after you told him to stop. This is one of the most expensive disputes a foreign landlord can face in France, and it is also one of the most winnable, because French law wraps the rental management mandate in strict written-form rules, an annual duty to account for every euro, and a financial guarantee designed exactly for managers who keep other people’s money. This guide walks through both halves of the fight in the order a Paris litigator handles them: getting your money and your file back, then ending the mandate and making the manager answer for a bad tenant.

I. How Do You Get Your Money and Your File Back From a Paris Rental Manager?

A. What Does the Written Management Mandate Have to Contain, and What Does Its Absence Cost the Agent?

Everything starts with the piece of paper most foreign owners sign without reading: the mandat de gestion locative (rental management mandate). In French law a mandate is simply the contract by which one person gives another the power to act in their name. Article 1984 of the Civil Code provides: “Le mandat ou procuration est un acte par lequel une personne donne à une autre le pouvoir de faire quelque chose pour le mandant et en son nom.” That sounds consensual and informal, but for property professionals a special statute adds a hard formal requirement. The Paris Court of Appeal recalled it on 6 March 2025: beyond the general freedom of form for mandates, the statute of 2 January 1970 governing property intermediaries, known as the loi Hoguet (the Hoguet Act), requires a written management mandate, failing which the contract is subject to relative nullity, a defect that can only be cured if the owner later ratifies the acts performed without a mandate (Paris Court of Appeal, 6 March 2025, No. 22/17421). In plain English: no signed written mandate, no valid contract, unless you afterwards approved what the manager did.

The consequences of that nullity fall entirely on the professional. In a 10 July 2025 decision, the same court held that where the intermediary’s mandate was void, the intermediary could not claim damages for unpaid fees, because the alleged loss flowed from a nullity attributable to the intermediary itself (Paris Court of Appeal, 10 July 2025, No. 22/02824). A manager who worked for months without a compliant written mandate cannot send you a bill for it. That same decision quotes the financial safeguard every licensed manager must hold: the court recalls that the professional must “Justifier d’une garantie financière permettant le remboursement des fonds, effets ou valeurs déposés”, meaning proof of a financial guarantee covering the refund of deposited funds, effects and valuables. This garantie financière (financial guarantee) is the deep pocket behind most recovery actions: it is issued by a mutual guarantee fund and it is designed to repay owners when the manager cannot or will not return their money.

A recent judgment shows the guarantee working exactly as intended. On 15 December 2025, the Pontoise court ordered the insurer Allianz to step in for a defaulting agency and pay back an 8,000-euro deposit the agency had received as séquestre (stakeholder funds), expressly under the financial guarantee covering the refund of the balance of the deposit received by its insured (Tribunal judiciaire de Pontoise, 15 December 2025, No. 22/06541). The context there was a sale deposit rather than rent, but the mechanism is identical: client money held by the agent is covered, and the guarantor pays when the agent disappears into insolvency proceedings. For a foreign landlord whose rents sit in the manager’s account, the practical lesson is to identify the guarantee fund named in your mandate on day one, because that is where recovery happens if the agency goes under. Owners who need counsel at this stage often turn to a Paris real estate litigation practice that traces client funds through agency accounts and guarantee funds.

Ask specifically for three documents in that first letter, because each one unlocks a different recovery route. First, the mandate itself, with the number of the carte professionnelle (the professional licence card) and the name of the guaranteeing fund: the July 2025 Paris decision reproduced above shows that the guarantee is the legal precondition of the whole activity, so an agent who cannot name his guarantor is already signalling danger. Second, the bank details of the compte séquestre (the ring-fenced client account): client rents must transit separately from the agency’s own money, and the Pontoise judgment demonstrates that funds identified as stakeholder money are the ones the guarantee repays first. Third, the complete ledger of your property since the mandate began: under the 2019 Cassation ruling, summaries showing only gross and net income prove nothing, and the manager who cannot produce the underlying invoices and receipts owes restitution of the unexplained balance. Owners who receive partial files should reply within days listing precisely what is missing; courts read that paper trail as diligence on your side and obstruction on theirs.

Before any of that, put the manager on notice in writing. Send a registered letter demanding the full file, the keys and codes, a complete statement of account, and payment of every euro collected and not remitted. This is not just good practice: interest starts running from that formal demand, as explained below, and every court cited in this guide treated the owner’s written demands as the starting point of the dispute.

B. How Does the Annual Duty to Account for Every Euro Work in Practice?

Once a valid mandate exists, the manager’s central duty is accounting. Every agent must account for the management and hand over everything received under the mandate, even sums that were not strictly owed to the owner. For rental management this means detailed statements, not one-line summaries.

The Court of Cassation gave this duty teeth on 21 November 2019 in a case about two rental management mandates given in 1994 and 1998 to a company called Locatim. The owners had terminated both mandates with effect from 15 April 2009 and sued for an accounting. The court of appeal found that the yearly summaries supplied by the manager showed only gross income, net income and advances per building, with no detailed statement of expenses, and that the court-appointed expert had received no books at all. Endorsing that analysis, the Second Civil Division held the failure to render accounts established, ordered restitution of the funds, and fixed the debt at 470,002.80 euros (Court of Cassation, Second Civil Division, 21 November 2019, No. 18-21.483). Two points in that ruling matter enormously for foreign owners. First, the burden of proof lies on the manager: it is the agent who must prove the accounts are complete, and vague annual summaries do not satisfy reddition de comptes (the rendering of accounts). Second, the professional liability insurer escaped: the court approved the finding that the insurance contract excluded non-payment or non-return of funds received by the insured, regardless of the nature of the fault behind it. Sober translation: do not count on the manager’s liability policy to refund missing rents. The claim for restitution runs against the manager and, behind him, the financial guarantee fund, not the liability insurer.

Two further rules complete the money-recovery picture. Article 1996 of the Civil Code provides: “Le mandataire doit l’intérêt des sommes qu’il a employées à son usage à dater de cet emploi ; et de celles dont il est reliquataire à compter du jour qu’il est mis en demeure.” The agent owes interest on sums kept back, running from the formal demand, which is why the registered letter described above has a direct cash value. And time is on the diligent owner’s side but not unlimited: Article 2224 of the Civil Code provides: “Les actions personnelles ou mobilières se prescrivent par cinq ans à compter du jour où le titulaire d’un droit a connu ou aurait dû connaître les faits lui permettant de l’exercer.” Personal claims expire after five years counted from the day the owner knew or should have known the facts, so an owner who discovers in 2026 that statements were falsified since 2022 is still in time, but sleeping files die.

Paris courts apply these principles without indulgence for big networks. On 20 July 2026, the Paris court ordered the company Citya Immobilier Pecorari to pay its owners 5,000 euros for failures in performing the management mandate, plus 368.76 euros refunded for a rent-guarantee product and 608.34 euros in fee refunds, with another 300 euros for moral harm (Tribunal judiciaire de Paris, 20 July 2026, No. 25/03931). Note what was refunded there: the garantie des loyers impayés (unpaid-rent guarantee) premiums. If you paid for such cover and it never validly protected you, the premiums themselves are recoverable on top of the missing rents.

II. How Do You End the Mandate and Hold the Manager Liable for a Bad Tenant?

A. How Does Revocation Work When the Agent Refuses to Let Go?

The most disorienting moment for a foreign owner is the manager who simply refuses to leave: ignoring the termination letter, continuing to contact the tenant, withholding the file and the keys. French mandate law answers with unusual force. The owner may revoke at will and compel the agent to hand back the written mandate itself. Revocation is unilateral: it does not require the manager’s agreement, a court order, or proof of fault.

But an owner living 5,000 miles away needs that right enforced, and Paris judges enforce it. On 4 July 2024, the Paris Court of Appeal dealt with an owner who had revoked through counsel in November 2021, received no answer, asked for written confirmation in January 2022, again received nothing, and then found the manager still running the property with management reports issued as late as May 2023. The court granted judicial termination of the mandate and condemned the manager’s abusive refusal to accept the revocation and return the documents the owner needed to manage the property directly (Paris Court of Appeal, 4 July 2024, No. 21/11709). Refusing to hand back the file after revocation is not a negotiating tactic; courts treat it as a standalone fault that costs the manager money.

Fault, once established, is judged strictly because the manager is paid. Article 1991 of the Civil Code obliges the agent to perform the mandate and answer for damages from non-performance, and Article 1992 adds: “Le mandataire répond non seulement du dol, mais encore des fautes qu’il commet dans sa gestion.” The agent answers not only for fraud but for faults in management, with faults judged less rigorously only where the mandate was gratuitous, which a fee-charging agency’s never is. Concretely: invented letting fees the mandate said were free, premiums charged for cover never provided, statements that hide expenses, and management continued after revocation are all faults, and courts price them. The 5,000-euro award in the July 2026 Citya judgment above is the current Paris measure of routine management failure.

For owners based in Paris itself or elsewhere in the Île-de-France, the geography of these disputes is an advantage worth using. Every precedent cited in this guide was decided by a Paris-area court: the Court of Appeal of Paris for the mandate, revocation and solvency cases, the Paris court for the July 2026 Citya condemnation, and the Pontoise court for the guarantee-fund payment. Filing where the property sits and where the agency operates keeps the file, the tenant witnesses and the enforcement officers in the same jurisdiction, and it puts your case before judges who apply the July 2024 and July 2025 rulings every week. Practically, that means addressing your registered letters to the agency’s Paris office, keeping proof of posting from abroad, and, once in court, asking expressly for handover of the file and the funds under astreinte (a daily penalty for each day of delay), the pressure tool Paris judges attach routinely to expulsion and handover orders. An owner in London can conduct the entire paper phase by email and registered letter with acknowledgement of receipt, travelling only if a hearing requires personal appearance, which in mandate-accounting cases is rare because the file speaks.

One warning from abroad: read your mandate’s own term and notice clause before acting. The statute lets you revoke at will, but the contract you signed may organise the financial consequences of an early exit, and the cleanest revocations quote the clause, set an unambiguous end date, and demand the file, the funds and the tenant’s contact details in the same letter. From Paris, the standard next step when the letter is ignored is a court action for judicial termination plus handover under penalty, exactly as granted in the July 2024 Citya case.

B. What Does the Manager Owe You When Choosing the Tenant, and When the Tenant Stops Paying?

The second half of the liability question concerns the tenant the manager selected. Here the courts strike a balance foreign owners must understand: the manager must vet, but the duty is one of means, not of result. On 8 July 2025, the Paris Court of Appeal stated the rule plainly: the manager of a rented home must make sure the applicant offers full guarantees of solvency and must see to it that the rent is recovered for the owner, but this obligation is an obligation of means (Paris Court of Appeal, 8 July 2025, No. 23/08535). In that case the owner accused the manager of never checking the tenant’s finances; the court found the agency had verified solvency through a guarantor whose own finances it had checked, with a joint guarantee of 15,600 euros covering the whole lease, and dismissed the fault claim. The lesson cuts both ways: you will not win by showing only that the tenant defaulted, but you will win by showing the file was empty, with no payslips, no tax notices and no verified guarantor collected before the lease was signed. Ask for the complete tenant file in your first letter; its thinness is often the whole case.

The Court of Cassation confirmed the same strict-but-fair approach toward managers in a September 2021 dispute between an owner and Citya over a managed letwhere the court of appeal had examined the agency’s conduct file by file; the supreme court simply dismissed the owner’s appeal, leaving the court of appeal’s assessment of the manager’s duties in place (Court of Cassation, First Civil Division, 22 September 2021, No. 19-17.224). Do not over-read a dismissal: it punishes no manager and creates no new duty. Its value for your file is narrower and practical: appellate courts are the real battlefield for management-fault claims, and Paris appellate judges know these files intimately.

Two products sold alongside management mandates deserve special suspicion. The first is the garantie des loyers impayés itself: as the July 2026 Paris judgment shows, premiums for cover that never validly applied must be refunded, and a manager who sold you a worthless policy while skipping basic solvency checks cumulates two faults, not zero. The second is rent collection after default: the manager’s duty does not end when the tenant stops paying; the July 2025 decision above expressly includes seeing to it that rent is recovered. A manager who watches arrears accumulate for a year and files nothing, neither payment order nor termination proceedings, will struggle to present that passivity as diligent means. Owners managing from abroad should therefore calendar two controls: monthly proof that each rent reached the mandate account, and written evidence of enforcement steps within weeks of the first missed payment. When both are missing, the file for liability is usually complete, and the forum will normally be the Paris courts where the property sits and where the agency operates, before judges who decided every precedent cited in this guide. For the recovery phase, specialist advice from a Paris firm handling real estate agent liability helps quantify arrears, guarantee refunds and management-fault damages in a single claim.

Conclusion

A Paris rental manager who keeps your rents, hides your accounts, refuses your revocation or installs an unvetted tenant is not protected by distance, by fine print or by professional habit. French law requires the mandate to be written, forces the agent to justify every euro with detailed statements under a burden of proof the agent carries, lets you revoke at will and compel return of the file, prices management faults in the thousands of euros, and backs the whole system with a financial guarantee that pays when the agency cannot. The owners who lose are the ones who wait: unanswered emails become unrecoverable years. Send the registered demand now, secure the tenant file and the guarantee fund’s identity, and have the termination and the accounting claim filed where the property is, in Paris, while the five-year clock is still on your side, and every unanswered month strengthens the file against the manager.

Your Paris rental manager stopped forwarding rent or justifies nothing.
