You are too young for the UK State Pension, you do not work in France, and nobody in the household receives a French salary. The removal firm has left, the mairie has registered you, and now comes the question every early retiree asks: who pays if one of you needs an operation in month four? Because the United Kingdom has left the European Union, you cannot simply rely on an EHIC in your pocket, and because you are not yet of UK State Pension age, the British authorities will not issue you the S1 certificate that shifts the bill to London. Your route into the French health system is the Protection universelle maladie, universally shortened to PUMA, and your local branch is the Caisse primaire d’assurance maladie, the CPAM, the local health insurance fund that registers residents and pays their health costs. This guide explains how that registration works, what it costs through the yearly Cotisation subsidiaire maladie, the additional sickness contribution known as the CSM, and what to do when a fund says no. The position of readers who already draw the UK State Pension is different and is covered in our companion pieces on the S1 and on pension taxation, linked below.

I. Registering for French healthcare without an S1: the PUMA route at your CPAM

The S1 is a portable document issued by the state that pays your pension or, for posted workers, by the state of employment. It tells the French fund to register you and to send the bill across the Channel. Before pension age you have no issuing state, so France covers you on a residence criterion instead. That is the whole logic of PUMA: once you live in France in a stable and lawful way, the French system takes charge of your health costs even though you have never paid French social contributions.

A. Who PUMA covers: stable and regular residence and the three-month rule

The foundation sits in the Social Security Code. (Article L. 160-1 of the Social Security Code). Two adjectives carry the entire early-retiree population: residence must be stable and it must be regular. Stability is a question of fact, and regularity is a question of immigration status. For a British citizen after Brexit, regularity normally means holding the right long-stay visa and then the matching titre de séjour, the residence permit, or a Withdrawal Agreement card for those who were already settled before the end of the transition period. The British government’s own living-in-France guidance describes this permit track in practical terms (UK guidance on healthcare in France for British residents), and your CPAM will ask to see the permit before anything else.

The second pillar is Article L. 160-5, which organises registration for people outside employment: anyone who tells a CPAM that Article L. 160-1 does not cover them “bénéficie de cette prise en charge auprès de cette caisse dès qu’elle justifie de son identité et de sa résidence stable et régulière.” (Article L. 160-5 of the Social Security Code). Identity plus stable and regular residence: that is the complete file in legal terms, and everything the fund asks you to produce must serve one of those two proofs.

Stability is measured by a bright-line rule. The same decree lists the documents that can prove it, from benefit statements to housing and tax paperwork. The framework for assessing both stability and regularity is set by decree under Article L. 111-2-3 (Article L. 111-2-3 of the Social Security Code), while Article L. 111-2-2 opens the whole compulsory system, and I quote the opening words: “Sous réserve des traités et accords internationaux régulièrement ratifiés ou approuvés et des règlements européens, sont affiliées à un régime obligatoire de sécurité sociale dans le cadre du présent code, quel que soit leur lieu de résidence” (Article L. 111-2-2 of the Social Security Code).

The courts apply the three-month requirement strictly. In a published judgment of 3 June 2021, appeal No. 20-10.687, the Second Civil Chamber of the Court of Cassation dealt with a woman who had arrived in France on 10 March 2016 and applied for registration on 23 March 2016, only to be refused a week later for want of three months of continuous presence (Court of Cassation, Second Civil Chamber, 3 June 2021, No. 20-10.687). The Paris appeal court had upheld the refusal, and the Court of Cassation rejected the appeal, holding that “la cour d’appel a exactement déduit, sans encourir les griefs du moyen, ni statuer par des motifs susceptibles de constituer, à l’encontre de Mme [P], une discrimination du fait de la nationalité de son conjoint, que l’intéressée ne pouvait, à la date de la demande, prétendre à son affiliation au régime général de l’assurance maladie-maternité.” The lesson for a British household arriving in September is blunt: the clock starts on arrival, the fund counts three full months of uninterrupted presence, and an application filed in month two will fail even if every other paper is perfect. Plan private medical insurance for that gap, because neither PUMA nor the British GHIC for visitors is designed to carry a new French resident through it. The statute does soften one edge: people who already live in France and stop meeting one of the residence conditions keep their health cover for a further period, since the law says they “bénéficient, dans la limite d’un an, d’une prolongation du droit à la prise en charge des frais de santé”, still under Article L. 160-1 (Article L. 160-1 of the Social Security Code). That one-year tail helps, for example, a spouse whose permit renewal runs late, but it does not remove the initial three-month wait for a newcomer.

B. The CPAM file in practice: proving who you are, waiting for the carte Vitale, and answering a refusal

In practical terms your application is the cerfa form S1106, the request to open health insurance rights, filed with the CPAM of your place of residence. In Paris that is the CPAM de Paris, in the departments it is the local fund, and the official Service Public explainer lists the two pillars of the file exactly as the statute does: stable residence shown by more than three months of uninterrupted presence, plus lawful residence shown by your permit (Service Public guide to the Protection universelle maladie). Build the file the way a cautious fund officer would want to read it. Identity means a passport, and for most British applicants a full birth certificate with a sworn translation, because the fund must create a social security number and any discrepancy in names or dates sends the file back. Stability means overlapping proofs across the three months: the lease or title deed, electricity and water bills in your name, French bank statements showing daily spending, and the first tax documents when you have them. Regularity means the visa in the passport and the titre de séjour or the récépissé, the receipt issued while a first permit is being processed. Add a relevé d’identité bancaire, the RIB bank details slip, so reimbursements have somewhere to go. Keep copies of everything you hand over and note the date of filing, because the date on the receipt may later decide which documents counted.

Once the fund accepts the file, cover starts but plastic patience is required. The carte Vitale, the green chip card you show at the doctor’s surgery and the pharmacy, typically arrives weeks or months after rights are opened, and before it comes you pay upfront and claim reimbursement on paper feuilles de soins, the treatment forms. Choose a médecin traitant, a nominated general practitioner, promptly after registration, since consulting within that coordinated pathway keeps reimbursement at the standard rate while wandering outside it cuts what the fund pays back. Many households add a mutuelle, a private top-up policy, to absorb the ticket modérateur, the share of each medical bill the compulsory scheme leaves to the patient, plus daily hospital charges and the extra fees of sector-two specialists. None of this is compulsory, but a retiree household budgeting French life should price it in from year one.

Two common traps deserve emphasis. First, the GHIC, the UK Global Health Insurance Card issued by the NHS for temporary stays, is not a substitute for PUMA registration once you live in France, and it does not cover the first three months of a permanent move either. Use it for what it is: emergency and necessary care during trips back to Britain or elsewhere, applied for through the NHS route (UK guidance on the GHIC for temporary stays abroad). Second, spouses are assessed individually. If one partner still does consultancy work for a British client while living in France, that partner may fall under employment or self-employment rules rather than residence rules, with different funds and different contribution bills. File one application per person and describe each situation exactly as it is.

When the fund refuses registration, the refusal letter must be answered in the order the system imposes. The first step is the Commission de recours amiable, the CRA, the fund’s own internal appeals board, to which you send a reasoned letter with copies of the proofs the fund says are missing or insufficient. If that internal appeal fails, the dispute moves to the judicial courts, to the social division of the judicial tribunal of your area. Readers who want the full S1-side paperwork for comparison, including GHIC use and the pensioner registration sequence, will find it in our broader guide to British healthcare cover in France (British healthcare in France: S1, GHIC and PUMA paperwork compared). The point to carry into any challenge is the one the Court of Cassation made in the 2021 judgment cited above: the fund is entitled to verify the three months strictly, so a winning file proves presence day by day rather than arguing that the rule is unfair.

II. Paying for PUMA and leaving it behind: the CSM bill, then the S1 takes over

Registration is only half of the story for an early-retiree household living on capital. France does not ask PUMA members for monthly salary-linked contributions when there is no salary, but it does levy a yearly charge on unearned income. Many British newcomers discover this bill a year after arrival, when URSSAF, the body that collects social contributions, writes with an assessment calculated from the previous year’s French tax return. Understanding that letter before it arrives is the difference between a planned cost and a shock.

A. The cotisation subsidiaire maladie: who pays it, what it taxes, and how to challenge the assessment

Article L. 380-2 of the Social Security Code sets two cumulative conditions (Article L. 380-2 of the Social Security Code). First, earned income from work in France, yours and, if you are married or in a civil partnership, your partner’s, must sit below a threshold fixed by decree. Second, neither of you may have received a retirement or invalidity pension, an annuity, or any unemployment benefit during the year. The typical British early-retiree household meets both tests without trying: no French payroll, and no pension yet. The price of that position is the contribution itself, whose base the Court of Cassation recalled in these terms: “Selon l’article L. 380-2, alinéa 4, du code de la sécurité sociale, dans sa rédaction issue de la loi n° 2015-1702 du 21 décembre 2015, la cotisation subsidiaire maladie est fixée en pourcentage du montant des revenus fonciers, de capitaux mobiliers, des plus-values de cession à titre onéreux de biens ou de droits de toute nature, des bénéfices industriels et commerciaux non professionnels et des bénéfices des professions non commerciales non professionnels, définis selon les modalités fixées au IV de l’article 1417 du code général des impôts, qui dépasse un plafond fixé par décret.” (Court of Cassation, Second Civil Chamber, 27 February 2025, No. 22-21.800). In plain English, the charge bites on rental income, dividends and interest, capital gains on sales, and non-professional business profits, but only on the slice above a floor set by regulation, and at a rate likewise set by regulation. Interest on a cash ISA, dividends from a UK investment portfolio, rent from a retained English flat, and the gain on selling that flat can therefore all feed the base once you are French tax resident, even though the assets themselves sit across the Channel.

That regulatory freedom worried contributors, and the Constitutional Council was asked whether handing the rate and the base to decree-law breached equality before public charges. The same 2025 judgment drew the procedural consequence: a challenge to the rate decree belongs to the administrative courts, and the civil courts hearing a CSM dispute must send that question to the administrative judge when it raises a serious difficulty. For the reader this draws a clear map. If URSSAF’s arithmetic looks wrong on your figures, the dispute stays with the social courts after the internal appeal. If your argument is that the rate or the calculation method itself is unlawful, expect the file to travel to the administrative court, which alone judges that legality.

Practical discipline keeps most files out of court. File your French tax return carefully even in a year when most income remains British, because URSSAF builds the CSM assessment from the French tax base, and an omitted rental schedule or an undeclared gain resurfaces as a reassessment with surcharges. Keep the assessment notice, the calculation detail, and the underlying return together, since any challenge will need all three. Where one spouse starts French work or draws a first pension, tell the fund promptly: crossing either threshold of Article L. 380-2 ends liability for the following assessment, but only clean paperwork proves the date. Households whose capital income sits near the floor should model the charge before realising gains in a single year, because bunching a property sale and a portfolio disposal into the same twelve months can push the slice above the floor sharply higher than spreading them would have done.

B. Reaching UK State Pension age: the S1 takes over and double cover ends

The PUMA years end when the British state starts paying you. Once you reach UK State Pension age and draw the pension, the competent state for your healthcare becomes the United Kingdom, which issues the S1 certificate through the NHS Overseas Healthcare Services. You register that document with your CPAM, and from that point France provides your treatment but recovers the cost from London under the coordination rules that the post-Brexit agreements kept alive for pensioners. Family cover follows the document: ask the issuing authority in writing which members of the household the S1 you receive actually covers, and register each person the answer names, rather than assuming that one certificate shelters everybody under the roof.

The legal reason two systems never bill you at once is the single-legislation principle. The Court of Cassation restated it in a September 2025 judgment concerning cross-border contributions: “la personne à laquelle les règlements s’appliquent n’est soumise qu’à la législation d’un seul État membre, en sorte que celle-ci, affiliée à un régime de sécurité sociale d’un État membre, ne doit pas contribuer au régime de sécurité sociale d’un autre État membre”, recalling the Court of Justice’s De Ruyter ruling of 26 February 2015, case C-623/13, point 35 (Court of Cassation, Second Civil Chamber, 25 September 2025, No. 22-24.634). The same logic organises the special case of frontier workers with Switzerland, who, when exempted from the Swiss scheme, “sont affiliés obligatoirement au régime général dans les conditions fixées par l’article L. 160-1” (Article L. 380-3-1 of the Social Security Code). For the British pensioner in France the consequence is symmetrical and welcome: one competent state, one registration, one bill routed between the two systems.

The switch also closes the CSM chapter. From the year a pension is first paid, the second condition of Article L. 380-2 fails and the yearly capital-income charge falls away (Article L. 380-2 of the Social Security Code). Time the paperwork rather than assuming it: request the S1 as pension age approaches, register it at the CPAM without delay, and confirm in writing that PUMA-based billing has stopped, because an S1 left in a drawer while the fund still treats you as a PUMA member produces exactly the double paperwork the single-legislation rule is meant to prevent. Pensioners who want the registration sequence step by step will find it in our guide written for readers who already hold the document (British state pensioners: registering an S1 at the CPAM), and the tax side of the same birthday, meaning where the pension itself is taxed and declared, is covered in our analysis of the UK State Pension in France (Where your UK State Pension is taxed and how to declare it in France).

One household, two timetables, is the normal picture. When spouses reach pension age years apart, the elder moves onto an S1 while the younger remains on PUMA and keeps paying the CSM on the household’s capital income until the second pension starts. Coordinate the two files explicitly with the fund so that neither spouse drifts into a gap: the elder’s S1 registration must not accidentally close the younger’s PUMA rights, and the younger’s continued PUMA cover must not generate contribution demands in the elder’s name. A short letter to the CPAM each time one status changes, kept with proof of posting, costs nothing and prevents the most common muddle this desk sees.

Conclusion

An early British retirement in France rests on three dates: three months of presence before PUMA registration, one yearly CSM assessment built from your capital income for as long as no pension is paid, and pension age, when the S1 moves the bill to the United Kingdom under the single-legislation rule. Each stage has its own paperwork, its own fund, and its own remedy when the answer is no, and the files that succeed are the ones that prove presence day by day, declare capital income completely, and register each change of status in writing. Keep every decision the fund or URSSAF sends you, with its envelope or electronic timestamp, because a challenge is won on dated paper long before it is won on legal argument.
