Within weeks, a British widow or widower living in France faces a stack of French forms with unfamiliar names: the pension de réversion (survivor’s pension), the allocation de veuvage (widow’s allowance), the notaire settling the estate, the health fund asking about your cover, and sometimes a préfecture questioning your residence. This guide explains, entirely under French law as it stands on 18 October 2026, what money a British surviving spouse can claim, how long you can stay in the family home, how the pensions are taxed, and how to challenge a refusal. Brexit changed your residence paperwork; it did not remove these survivor’s rights, which depend on marriage, residence and contributions — not on European Union citizenship. Two particular British traps run through the whole guide: a previous divorce, which forces you to share the pension with a former spouse, and a new relationship, which can cut some benefits overnight.

I. What French survivor’s money can a British widow claim after a death in France?

A. The pension de réversion: 54 per cent of the basic pension, 60 per cent of the complementary pension, and sharing with a divorced former spouse

The pension de réversion is the French survivor’s pension: a slice of the retirement pension the deceased had earned, paid to the surviving spouse for life. It only exists between married people. A PACS (the French civil partnership, pacte civil de solidarité) and unmarried cohabitation (concubinage) give no right to it, as the public service site service-public.fr confirms on its réversion page. If you were married to the deceased — in England, in France or anywhere else — the door is open. The statute states the principle in plain terms: “En cas de décès de l’assuré, son conjoint survivant a droit à une pension de réversion à partir d’un âge et dans des conditions déterminés par décret si ses ressources personnelles ou celles du ménage n’excèdent pas des plafonds fixés par décret” (article L. 353-1 of the Social Security Code). Three conditions therefore decide everything: marriage, age and means.

The age condition is fixed by decree: “La pension de réversion est attribuée sous réserve que le conjoint de l’assuré décédé ou disparu ait atteint l’âge de cinquante-cinq ans à la date d’effet de la pension” (article D. 353-3 of the Social Security Code). If you are younger than 55 when your spouse dies, the basic réversion waits — but the widow’s allowance described in the next section may bridge the gap, which is exactly its purpose. The means condition works as a ceiling on your own resources: your annual gross resources must sit below the current scale, which service-public.fr gives as 25,001.60 euros if you live alone and 40,002.56 euros if you live as a couple, married, PACSed or cohabiting (see Pension de réversion de l’Assurance retraite). How those resources are counted is itself set by regulation: the fund looks at the three calendar months before the pension takes effect, and if they exceed a quarter of the yearly ceiling it substitutes the twelve months before that date (article R. 353-1 of the Social Security Code). The same article excludes several items from the count — the deceased’s own earnings and replacement income, top-up scheme reversions, and income from property acquired through the deceased — and it gives working survivors aged 55 or over a 30 per cent disregard on their earnings: “Les revenus d’activité du conjoint survivant font l’objet d’un abattement de 30 % s’il est âgé de 55 ans ou plus”. For a British widow still working part-time in France, that disregard is often what keeps her under the ceiling.

The amount of the basic réversion is set by decree at “54 % de la pension principale ou rente dont bénéficiait ou eût bénéficié l’assuré” (article D. 353-1 of the Social Security Code). A minimum applies where the deceased built up at least fifteen years of insurance, revalued every year; service-public.fr currently quotes 4,019.13 euros a year for a full record, reduced proportionally below that (see Pension de réversion de l’Assurance retraite). Two increases can top it up: 10 per cent of the pension where the general children’s increase applies — “La majoration prévue aux articles L. 353-1 et L. 353-3 est égale à 10 % de la pension” (article R. 353-2 of the Social Security Code) — and an 11.1 per cent age-and-resources top-up from 67 for small pensions, equal to “11, 1 % de la pension de réversion” under the article it implements (article D. 353-4 of the Social Security Code). If pension plus resources overshoots the ceiling, the réversion is trimmed back to fit: the statute provides that “la pension de réversion est réduite à due concurrence du dépassement” (article L. 353-1 of the Social Security Code).

On top of the basic scheme sit the complementary pensions — Agirc-Arrco for private-sector employees and equivalent top-up funds for other occupations. The single online réversion request covers these complementary schemes too, but each fund then applies its own rulebook, and a separate claim to the fund where the deceased contributed is required (see Pension de réversion de l’Assurance retraite). The asymmetry that traps many widows is assuming every reversion behaves like the basic one: the basic réversion tolerates a new union, while complementary funds set their own conditions on age, means and remarriage — so before forming a new union, ask each complementary fund in writing what remarriage would change for your file, and keep its written answer with your papers.

Then comes the divorce trap, central for British families where both spouses often married before. A divorced former spouse counts as a survivor: “Le conjoint divorcé est assimilé à un conjoint survivant pour l’application de l’article L. 353-1” (article L. 353-3 of the Social Security Code). Where the deceased remarried, the statute orders that the pension “est partagée entre son conjoint survivant et le ou les précédents conjoints divorcés au prorata de la durée respective de chaque mariage”. Each marriage is measured date to date and rounded down to whole months, and when one beneficiary dies, “sa part accroîtra la part de l’autre ou, s’il y a lieu, des autres, à compter du premier jour du mois suivant le décès” (article R. 353-4 of the Social Security Code). The Court of Cassation enforces strict proportionality here. In a case where a second marriage was annulled for bigamy yet recognised as putative towards the second wife, the Second Civil Chamber held that each woman qualified as a surviving spouse and quashed an appeal ruling that had split the overlapping years equally:

la pension de réversion à laquelle l’assuré est susceptible d’ouvrir droit à son décès est partagée entre les conjoints survivants au prorata temporis de la durée respective de chaque mariage

(Cass. 2nd Civil Chamber, 21 October 2021, appeal no. 20-17.462, ECLI:FR:CCASS:2021:C200971). So if your late husband was previously married for twenty years and married to you for ten, expect roughly a two-thirds/one-third split — and note that the divorced spouse keeps her share even if she has formed a new couple, since service-public.fr confirms the divorced spouse may draw the réversion while living again as a couple. Where the marriage history spans England and France, gather every marriage certificate and divorce decree early: our guide to British divorce in France explains how foreign decrees are recognised.

B. The allocation de veuvage for widows under 55, and what remarriage or a new partnership changes

If you are widowed young, French law provides a dedicated bridge benefit: the allocation de veuvage, or widow’s allowance, paid for a limited time until you can claim the réversion or rebuild your income. The statute guarantees it to “au conjoint survivant de l’assuré qui a été affilié, à titre obligatoire ou volontaire, à l’assurance vieillesse du régime général, au cours d’une période de référence et pendant une durée fixées par décret” where the survivor lives in France and meets an age set by decree (article L. 356-1 of the Social Security Code). The deceased must therefore have been in the general old-age scheme shortly before death: the decree requires affiliation for “trois mois au cours des douze mois précédant celui de leur décès” (article D. 356-1 of the Social Security Code). A British widow whose late husband worked in France as an employee will normally satisfy this; be ready to prove the contribution record with pay slips and the employer’s certificate.

Three cumulative conditions then apply to you, and each carries a Brexit warning. You must live in France, be under 55, keep your own resources under a quarterly ceiling, and — decisive for many — “Ne pas être remarié, ne pas avoir conclu de pacte civil de solidarité et ne pas vivre en concubinage” (article D. 356-2 of the Social Security Code). Unlike the basic réversion, which tolerates a new union, the widow’s allowance stops if you remarry, sign a PACS or simply live with a new partner. The same article adds a filing rule with teeth: to be admissible, “la demande doit être déposée dans un délai n’excédant pas la période maximum de versement définie au premier alinéa de l’article D. 356-5”. That maximum payment period is “une période maximum de deux ans à compter du premier jour du mois au cours duquel s’est produit le décès”, extended to age 55 where the survivor was already 50 at the death (article D. 356-5 of the Social Security Code). File late and the claim is inadmissible, not merely reduced — so treat the months after the death as a countdown. And if the fund sits on your file, the regulation is blunt: “Le silence gardé pendant plus de quatre mois sur la demande de liquidation ou de révision d’une allocation de veuvage vaut décision de rejet” (article R. 356-1 of the Social Security Code). A four-month silence is a refusal you can challenge, as explained in section II.B below.

The Brexit warning sits in the statute itself: “Le conjoint survivant de nationalité étrangère résidant en France doit justifier de la régularité de son séjour par la production d’un titre ou document figurant sur une liste fixée par décret” (article L. 356-1 of the Social Security Code). Since 1 January 2021, British citizens are third-country nationals: a widow without a valid residence permit — a Withdrawal Agreement card, a vie privée et familiale (private and family life) card as the spouse of a French national, or another current title — can be refused the allowance even where every other condition is met. If your permit was derived from your marriage, take advice promptly after the death rather than waiting for renewal time; our guides to the French spouse visa and residence permit and to marrying a French national map the available titles. The English-language page for the vie privée et familiale card on service-public.fr (see Carte de séjour vie privée et familiale) is the official starting point for checking which permit fits a widowed spouse.

II. The home, the tax bill and how to challenge a refusal

A. Can a British widow stay in the French family home? One free year, then a lifetime right — if claimed in time

French law protects the roof over the survivor’s head in two stages, and both apply to a British widow on the same terms as a French one. First comes a one-year breathing space that operates automatically. Where the surviving spouse who can inherit was living in the home as the main residence at the death, and the property belonged to the couple or entirely to the estate, “il a de plein droit, pendant une année, la jouissance gratuite de ce logement, ainsi que du mobilier, compris dans la succession, qui le garnit” (article 763 of the Civil Code). De plein droit means by operation of law: no claim to file, no heir’s consent needed. Where the couple rented, or the deceased owned only an undivided share, the estate refunds a year of rent or occupation indemnity instead. These rights “sont réputés effets directs du mariage et non droits successoraux” and the article “est d’ordre public” — they flow from the marriage itself, not from the inheritance, and no will or family arrangement can remove them.

Then comes the lifetime right, which is generous but strictly conditional. Unless the deceased removed it in an acte authentique (a will in notarial form meeting article 971), the surviving spouse who lived in the home keeps “sur ce logement, jusqu’à son décès, un droit d’habitation et un droit d’usage sur le mobilier, compris dans la succession, le garnissant” (article 764 of the Civil Code). The droit d’habitation is a lifelong right to live there; the droit d’usage covers the furniture. Where the home no longer suits the survivor’s needs, the statute even lets the spouse let it for non-commercial, non-agricultural use to fund new accommodation. But the right must be claimed within a hard time limit: “Le conjoint dispose d’un an à partir du décès pour manifester sa volonté de bénéficier de ces droits d’habitation et d’usage” (article 765-1 of the Civil Code). Miss that year and the lifelong right is lost, leaving only occupation that the co-heirs can charge for.

The Court of Cassation has softened one edge of that deadline: the expression of intent may be tacit. Quashing a ruling that had demanded a formal written claim and charged the widow an occupation indemnity, the First Civil Chamber stated:

le conjoint survivant dispose d’un an à partir du décès pour manifester sa volonté de bénéficier de son droit viager au logement ; que cette manifestation de volonté peut être tacite

(Cass. 1st Civil Chamber, 13 February 2019, appeal no. 18-10.171, ECLI:FR:CCASS:2019:C100152). In that case the widow had stayed on in the flat after the free year without immediate objection from her stepson, and the Court treated remaining in the home as the tacit expression — while confirming that a co-heir who promptly objects can still defeat it. The practical lesson for a British widow facing stepchildren from a first marriage is therefore twofold: within the year, put your intent in writing to the notaire and the co-heirs in plain words, stating that you intend to exercise your lifelong habitation right under article 764, and do not rely on silence alone where relations are tense. An inventory of the furniture and a statement of the property’s condition, which any party can demand, prevents later disputes about what the droit d’usage covers.

Two further points complete the housing picture. First, the lifelong habitation right is distinct from the surviving spouse’s inheritance share and from usufruit (the broader lifelong right to use and take income from property): removing the habitation right by will leaves any legal or gifted usufruct untouched, and vice versa. Our guide to the surviving spouse’s usufruct and housing rights works through those combinations with examples. Second, if the deceased tried to disinherit you from the home, only a deprivation expressed in the strict notarial form counts — an English will or a letter will not do it, though an English-law choice for the succession as a whole remains possible under the EU Succession Regulation, as explained in our guide to British wills and French houses.

B. Paying French tax on the pensions, keeping health cover and residence, and challenging a refusal

A British widow living in France is as a rule French tax-resident on her worldwide income, and the French pensions above are therefore declared in France. Pensions and retirement income carry a 10 per cent allowance: “Les pensions et retraites font l’objet d’un abattement de 10 %” within the caps and floor the article sets (article 158, 5, a of the General Tax Code). The réversion itself also bears social charges — the CSG and CRDS contributions and the autonomy solidarity top-up known as CASA — as service-public.fr confirms for the basic réversion (see Pension de réversion de l’Assurance retraite). Declare the first year carefully: the year of the death changes the household, the shares and sometimes the applicable forms, and our walkthrough of the first French tax return for British newcomers covers forms 2042, 2047 and 3916 line by line. Keep every pension statement the funds send you: where the administration later disputes the declared amounts, those slips are your evidence, and the reply discipline for a French tax audit — answer the adjustment proposal within its deadline, contain the penalties, then challenge — is set out in our guide to answering a French tax audit. On the succession itself, service-public.fr lists the surviving spouse among the heirs exempted from inheritance tax by reference to article 796-0 bis of the General Tax Code (see In which cases is an heir exempt from inheritance tax?), which is why the notaire’s main task for the widow is usually the deed of ownership and the children’s shares, not a tax bill in her own name — a point developed in our British wills and French houses guide.

Do not overlook the British side of the money. If you already receive a UK bereavement benefit when you move to France, it follows you: British government guidance states that an existing bereavement benefit continues to be paid after a move abroad, wherever the destination (Claiming benefits if you live, move or travel abroad: bereavement benefits on GOV.UK). New claims from France are possible too, because France sits in the European Economic Area group for these purposes, covering Bereavement Support Payment and Widowed Parent’s Allowance where the eligibility conditions are met. The UK State Pension built on your own contribution record is a separate matter from French réversion and continues under its own rules; our guide to the British State Pension in France explains declaration, CSG and CRDS on it. Where the deceased worked across both countries, each side pays its own benefit and each side taxes its own residents — coordinate the two files rather than assuming one claim covers both.

Health cover and residence need active management in the months after the death. A widow who was covered as an ayant droit (a family member deriving rights from the insured spouse) should contact the local CPAM (the primary health insurance fund, caisse primaire d’assurance maladie) to switch her affiliation to her own right, through work, the réversion-linked status or universal cover; where an S1 form from the United Kingdom was involved, its basis may change with the death. Our guide to healthcare in France for British residents maps the S1, GHIC and PUMA routes and how to challenge a CPAM refusal. On residence, the principle is reassuring but conditional: your own permit does not lapse automatically with your spouse’s death, yet permits derived from marriage and benefits conditioned on regular stay — including the widow’s allowance above — require a current title, so check the expiry date on your card now and seek advice before it expires rather than after.

If a fund refuses the réversion or the allowance, or answers with silence, French procedure gives you a clear ladder. Start with the fund’s own friendly-appeal board, the commission de recours amiable (CRA): “Cette commission doit être saisie dans le délai de deux mois à compter de la notification de la décision contre laquelle les intéressés entendent former une réclamation” (article R. 142-1 of the Social Security Code). Send that appeal by tracked post within the two months, attach the missing document the fund claims not to have — very often the foreign marriage certificate with its certified translation, the divorce decree, or proof of resources — and keep copies of everything. If the board confirms the refusal, the dispute moves to the specially designated judicial court, where the sharing, ceiling and resource calculations above become the battleground; the two Court of Cassation rulings quoted in this guide show how strictly judges apply the prorata sharing and how seriously they take the one-year housing expression. For the widow’s allowance specifically, remember that four months of administrative silence already counts as a rejection (article R. 356-1 of the Social Security Code), so diary the date and escalate rather than waiting hopefully.

Conclusion

A British widow in France holds three distinct bundles of rights after a spouse’s death, and each runs on its own clock. The money bundle — the 54 per cent basic réversion from 55 subject to a resources ceiling, the 60 per cent complementary réversion with no means test but lost on remarriage, and the two-year widow’s allowance under 55 conditioned on residence, modest resources and no new partnership — rewards early, documented claims and punishes delay. The housing bundle — a free year by operation of law, then a lifelong habitation right that must be expressed within a year of the death, tacitly if necessary — protects the survivor even against hostile co-heirs, provided the intent is made clear in time. The status bundle — French taxation of the pensions with their 10 per cent allowance, continuing health cover, a current residence permit, and UK bereavement benefits claimed alongside — keeps the household lawful while the first two bundles pay out. The single most expensive mistake, seen again and again in the case law, is assuming that grief pauses the deadlines: it does not. File the pension claims, write the housing letter, check the permit’s expiry date, and challenge refusals through the friendly-appeal board within its two months — the rights are real, but only the vigilant collect them.

British widow in France?
