Or a Saturday night in Paris ends with a punch outside a bar and a broken tooth. In Britain you would ring 999, get a crime number and leave the rest to the police and the Crown Prosecution Service. In France the logic is different, and more demanding: the victim is expected to act. You file a plainte (a formal criminal complaint), you keep the récépissé (the written receipt), you may join the prosecution yourself as partie civile (a civil party claiming damages inside the criminal case), and if nobody can pay, a state-backed guarantee fund can step in. Each of these steps has its own office, its own form and its own deadline, and a missed step can cost you the compensation. This guide explains, for a British resident or second-home owner, how to report an offence in France, how to become partie civile, who pays for your loss, and how to challenge a decision to drop the case, with the exact texts and court decisions that govern each point.

I. Reporting the offence and joining the prosecution as a civil party

A. How to report the crime: the plainte, the receipt and the interpreter

The first step is the plainte, the formal complaint that triggers the criminal process. You can file it at any commissariat de police (police station) or brigade de gendarmerie (the military-status police force covering smaller towns and rural areas) of your choice, and the official guidance is unambiguous: officers must take your complaint when you report an offence against you (service-public.fr, File a complaint). An officer who tells a British victim to come back later, or to complain in the town where the offence happened, is not applying the rule: the same page confirms that officers must receive your complaint even if the facts fall outside their geographical area. In Paris, where many British residents live, you can walk into the commissariat of your arrondissement; in an emergency, dial 17 for the police or 112, the European emergency number, before anything else. At the end of your interview, always ask for two documents: the récépissé, which proves you complained, and a copy of the complaint report itself, which is provided on request. Photograph or scan both the same day and keep the originals with your passport and insurance papers.

Language is a right, not a favour. The Code of Criminal Procedure provides that “Pour les victimes qui ne comprennent pas la langue française, de bénéficier d’un interprète et d’une traduction des informations indispensables à l’exercice de leurs droits” (article 10-2 of the Code of Criminal Procedure), in other words, victims who do not understand French are entitled to an interpreter and a translation of the information essential to exercising their rights. Ask for the interpreter at the start of the interview, and check before signing that the written statement matches what you said; a statement you cannot read is a statement you cannot control. The same article lists everything the police must explain to you: your right to compensation, your right to become partie civile, your right to a lawyer of your choice, your right to be helped by an approved victims’ association, and your right to apply to the victims’ compensation commission. If the desk officer skips this information, ask for it expressly and note the request. Practical support exists alongside the legal process: the national victim helpline 116 006 operates every day and answers in several languages (service-public.fr), and the British government’s France help page describes consular support for nationals in difficulty, covering crime victims, arrests and crises abroad (gov.uk, UK help and services in France). The consulate cannot investigate or pay your claim, but it can explain the local procedure, provide lists of English-speaking avocats, and contact your family.

Some complaints can be filed without leaving home, but only in narrow cases. Where the offender is unknown and the loss concerns property, such as a burglary, a fraud or criminal damage, an online complaint service exists and a police officer later decides whether the declaration qualifies as a formal complaint report (service-public.fr). If you know who attacked you or robbed you, online filing is not available and you must complain in person or by post. A complaint by post means a letter to the procureur de la République (the public prosecutor) at the local court, sent by recorded delivery, describing the facts, the date and place, your loss and the identity of the suspect if known. Whatever the channel, do not wait. The official time limits for complaining run from the date of the offence: one year for minor offences, six years for mid-level offences such as theft, assault or fraud, and twenty years for the most serious crimes (service-public.fr). These limits mirror the criminal limitation periods, since “L’action publique des délits se prescrit par six années révolues à compter du jour où l’infraction a été commise” (article 8 of the Code of Criminal Procedure). A burglary discovered months later, common for second homes left empty over winter, still counts from the day it was committed, so file as soon as you discover it and say when you discovered it. Medical evidence matters just as much as speed: after an assault, have your injuries recorded the same day at hospital or by your GP, keep the medical certificate stating any period of total incapacity for work, photograph visible injuries, and keep every receipt, from the locksmith to the dentist.

B. Becoming partie civile: the low threshold and the two roads into the trial

Filing a plainte asks the state to prosecute. Becoming partie civile makes you a party to the case so that the criminal court can also order compensation for your personal loss. The foundation is deliberately broad: “L’action civile en réparation du dommage causé par un crime, un délit ou une contravention appartient à tous ceux qui ont personnellement souffert du dommage directement causé par l’infraction.” (article 2 of the Code of Criminal Procedure). Anyone who has personally suffered damage directly caused by the offence may claim. For a British burglary victim, that covers the stolen goods, the smashed door and the hotel nights while the house is unsecured; for an assault victim, the medical bills, lost earnings and pain and suffering. The damage must be direct and personal, which excludes, for example, claiming for a neighbour’s loss, but the courts apply a generous test at the entry stage. In a 2019 decision concerning an armed hotel robbery in Paris, the Criminal Chamber of the Court of Cassation held that “pour qu’une constitution de partie civile soit recevable devant la juridiction d’instruction, il suffit que les circonstances sur lesquelles elle s’appuie permettent au juge d’admettre comme possibles l’existence du préjudice allégué et la relation directe de celui-ci avec une infraction à la loi pénale” (Court of Cassation, Criminal Chamber, 25 June 2019, No. 18-84.653). In plain terms, the judge only needs to regard your alleged loss and its link to the offence as possible. That ruling quashed a decision that had thrown out a hotel company’s civil-party claim after a guest was robbed at gunpoint, and it protects ordinary victims too: a refusal to admit you as partie civile must be reasoned, and weak reasoning can be overturned.

There are two roads into the trial, and the choice depends on whether the prosecutor acts. (article 418 of the Code of Criminal Procedure). You can declare yourself partie civile at the hearing itself, without a lawyer, and claim the damages matching your loss. Bring your file: complaint receipt, medical certificates, invoices, photographs and a written calculation of each head of loss, ideally translated where the originals are in English. The second road is for cases where the prosecutor stays silent. A victim can force the appointment of an investigating judge through a plainte avec constitution de partie civile, but only after giving the prosecutor a chance: “la plainte avec constitution de partie civile n’est recevable qu’à condition que la personne justifie soit que le procureur de la République lui a fait connaître, à la suite d’une plainte déposée devant lui ou un service de police judiciaire, qu’il n’engagera pas lui-même des poursuites, soit qu’un délai de trois mois s’est écoulé depuis qu’elle a déposé plainte devant ce magistrat, contre récépissé ou par lettre recommandée avec demande d’avis de réception, ou depuis qu’elle a adressé, selon les mêmes modalités, copie à ce magistrat de sa plainte déposée devant un service de police judiciaire” (article 85 of the Code of Criminal Procedure). Count three months from the recorded-delivery complaint to the prosecutor before using this route, unless the offence is a crime, where the waiting condition does not apply. Expect one practical hurdle: the investigating judge sets a deposit, the consignation, scaled to your means, to be lodged with the court registry within a fixed time, failing which the complaint is inadmissible, unless you have legal aid or are exempted: “En fonction des ressources de la partie civile, il fixe le montant de la consignation que celle-ci doit, si elle n’a obtenu l’aide juridictionnelle, déposer au greffe et le délai dans lequel elle devra être faite sous peine de non-recevabilité de la plainte.” (article 88 of the Code of Criminal Procedure). Ask an avocat to check whether you qualify for aide juridictionnelle (state legal aid), which the police information notice itself mentions as covering your costs if you meet the conditions (article 10-2 of the Code of Criminal Procedure). Being partie civile changes what you can do: you can request investigative steps, access the file through your lawyer, speak at the hearing and, above all, leave court with an enforceable damages order instead of starting a separate civil lawsuit from scratch.

II. Getting paid and challenging a refusal to prosecute

A. Who pays for your loss: the offender, your insurer and the state guarantee fund

A criminal conviction in France routinely includes a civil award: once you are partie civile, the trial court that convicts the offender also rules on your damages, assessing each documented head of loss. That order is enforceable against the offender’s assets in France, through a bailiff, exactly like a county court judgment at home. The difficulty every victim knows is the insolvent or missing offender, and French law answers with two safety nets that British victims often overlook. The first is your own insurance. A French assurance habitation (home insurance, compulsory for tenants and standard for owners) commonly covers theft, break-in damage and sometimes legal protection costs, so notify your insurer promptly after the complaint, send the complaint receipt, and check the policy wording and deadlines rather than assuming burglary is automatically covered. Keep every document the insurer asks for, because the second safety net, the state fund, will want proof that no other payer has already compensated you.

That second safety net is the commission d’indemnisation des victimes d’infractions, the CIVI, a specialised panel sitting at each major court that orders compensation from the Guarantee Fund even when the offender is unknown, insolvent or never prosecuted. For personal injury, the eligibility rule is generous: “Toute personne, y compris tout agent public ou tout militaire, ayant subi un préjudice résultant de faits volontaires ou non qui présentent le caractère matériel d’une infraction peut obtenir la réparation intégrale des dommages qui résultent des atteintes à la personne” (article 706-3 of the Code of Criminal Procedure). Full compensation for personal injury requires one of three conditions, typically death, permanent disability, or total incapacity for work of at least one month, with sexual offences, trafficking and violence against minors or by a partner covered regardless of duration. Two features matter enormously for British readers. First, nationality is no obstacle where the facts happened in France: “La personne lésée est de nationalité française ou les faits ont été commis sur le territoire national.” A British holidaymaker assaulted in Nice or a resident attacked in Lyon qualifies exactly like a French victim. Second, the fund cannot send you away to fight the offender’s insurer first. The Second Civil Chamber of the Court of Cassation quashed a decision that had deducted from a victim’s award the sums she might hypothetically have recovered from the liable person’s insurer, ruling that “les dispositions de l’article 706-9 du code de procédure pénale n’imposaient à la victime ni de maintenir son action civile contre l’auteur de l’infraction ni de tenter d’obtenir préalablement à la saisine de la CIVI la réparation de ses préjudices par l’assureur du responsable” (Court of Cassation, Second Civil Chamber, 5 March 2020, No. 18-22.904). In that case a woman bitten by dogs had withdrawn her civil claim against the person responsible and gone straight to the CIVI; the fund still had to deal with her application on its merits. For property crime, a parallel route exists for victims of theft, fraud, breach of trust, extortion, blackmail or criminal damage who cannot obtain effective compensation elsewhere and are left in serious material or psychological difficulty: the same commission can award an allowance, subject to a means test and capped at three times the legal-aid ceiling (article 706-14 of the Code of Criminal Procedure). A British pensioner whose life savings vanish in a boiler-room fraud and who is left genuinely unable to cope is the textbook example; a well-insured second-home owner whose insurer has paid in full is not.

Both routes run on strict clocks that you must diarise from day one. For the CIVI, “A peine de forclusion, la demande d’indemnité doit être présentée dans le délai de trois ans à compter de la date de l’infraction.” (article 706-5 of the Code of Criminal Procedure), which means the application is barred if filed more than three years after the offence. Where a prosecution is running, the same text extends the deadline so that it expires only one year after the final decision on the public prosecution or on the civil claim brought before the criminal court. The commission can lift the time bar where the victim was never informed of the right to apply, could not act in time, suffered a worsening of the injury, or shows any other legitimate reason, but never rely on forgiveness clauses: apply early and in writing. Where you already hold a final damages order that the offender simply will not pay, a different mechanism takes over: if the convicted person has not paid voluntarily within two months of the damages decision becoming final, you can ask the Guarantee Fund for recovery assistance, and that request itself is subject to a one-year deadline from finality, again liftable for legitimate reason (article 706-15-2 of the Code of Criminal Procedure). In practice, this means a burglary victim with a convicted but penniless thief, or an assault victim whose attacker has disappeared, still has a funded path to enforcement. File the CIVI application even while the criminal case is pending, keep copies of everything sent to the fund, and never sign a waiver of your rights against the offender without advice, since the fund will want to recover from the offender what it pays to you.

B. The case is dropped or goes wrong: recours, direct summons and appeal

Not every complaint ends in a trial. The prosecutor may close the file with a classement sans suite, a decision to take no further action, for reasons ranging from an unidentified offender to insufficient evidence. That letter is not the end of the road. The Code provides a direct hierarchical remedy: “Toute personne ayant dénoncé des faits au procureur de la République peut former un recours auprès du procureur général contre la décision de classement sans suite prise à la suite de cette dénonciation.” (article 40-3 of the Code of Criminal Procedure). Anyone who reported facts to the prosecutor can appeal the discontinuance to the procureur général (the senior prosecutor at the court of appeal), who may order the local prosecutor to bring charges or must explain why the appeal is unfounded. Write that appeal quickly, attach the discontinuance letter, the complaint receipt and any new evidence such as CCTV you have since recovered or a witness who has come forward, and send it by recorded delivery. If the hierarchy confirms the closure, two judicial routes remain. The first is the complaint to the investigating judge described above, available once three months have passed since your recorded-delivery complaint to the prosecutor or once the prosecutor has told you he will not prosecute (article 85 of the Code of Criminal Procedure). The second is the citation directe, a direct summons of the identified offender before the criminal court, which the victim information notice expressly lists alongside the complaint to the investigating judge as a way of setting the prosecution in motion (article 10-2 of the Code of Criminal Procedure). The direct summons suits simple, well-documented cases against a known person, such as a clearly identified fraudster, but it requires precise drafting of the facts and their legal classification, so take advice before serving one.

Where the case does reach court and the outcome disappoints, the appeal clock runs fast. In criminal matters, “l’appel est interjeté dans le délai de dix jours à compter du prononcé du jugement contradictoire” (article 498 of the Code of Criminal Procedure), meaning ten days from delivery of a judgment given in the parties’ presence, with the period running only from formal service for parties who were absent or unrepresented. Ten days leaves no room for a leisurely return to the United Kingdom to think it over: instruct your avocat at the hearing itself on whether to appeal, and confirm the instruction in writing the same week. The same urgency applies to preserving evidence for any forum. Photograph the scene before repairs, keep the broken lock and the damaged phone, save threatening messages with their metadata, and ask witnesses for dated written accounts while memories are fresh. One boundary is worth understanding early, because it confuses many British readers: a noisy neighbour or a boundary row is a civil dispute, not a crime, unless threats, violence or criminal damage are involved. Our guide on neighbour disputes in France explains where that line falls. Conversely, where the person who harmed you was himself breaking the criminal law, for instance by driving drunk, he faces a separate prosecution in which you can again join as partie civile; the penalties and defences in that parallel case are explained in our guide to drink-driving prosecutions in France. Parallel cases move at different speeds, which is exactly why the CIVI extension rule matters: your compensation clock waits for the final criminal decision, but only if you respect the one-year tail described above.

Conclusion

A British victim in France is not a spectator of the criminal process but one of its drivers. Report the offence in person wherever you can, demand the receipt, and use your right to an interpreter rather than muddling through in school French. Join the case as partie civile, at the hearing where a trial is coming or before the investigating judge where the prosecutor sleeps on the file, and budget for the means-tested deposit unless legal aid covers you. Pursue the offender’s assets, your insurer and the CIVI in parallel rather than in sequence, remembering that no court can make you exhaust the offender’s insurer before turning to the fund. And if the prosecutor closes the file, answer with the hierarchical appeal, then with the investigating judge or the direct summons, all within deadlines counted in months and days, not years. The French system rewards the victim who writes everything down, keeps every receipt and acts early; it quietly punishes the one who waits for the state to call back.

Burgled, assaulted or defrauded while living in France?
