Since Brexit, that project starts with paperwork that did not exist for British students before 2021: a long-stay student visa applied for in the United Kingdom, proof of monthly resources, enrolment through the Études en France (Studies in France) online route, and then a French residence card, a part-time job within strict limits, and, after graduation, a one-year job-seeker card that many prefectures still mishandle. Each step has a refusal hiding behind it, and each refusal has a remedy, as three recent French appeal decisions show: a renewal wrongly refused in Reims, a visa refused over a forged bank certificate, and a graduate card refused on a one-year deadline that no longer exists in any statute. This guide explains, for a British reader and in plain English, how the student visa works from the United Kingdom, what money and study proofs the consulate and the prefecture (the local arm of the French state that issues residence documents) really check, how much you may work, how the graduate job-seeker card operates, and how to challenge a refusal before the commission and the courts.

I. Getting to France: the visa, the money and the enrolment behind the student card

A. The long-stay student visa from the United Kingdom: Études en France, the VLS-TS and the first entry

Since 1 January 2021, British nationals are third-country nationals for French immigration purposes, and study follows the ordinary third-country route. The starting rule is blunt: “Tout étranger souhaitant entrer en France en vue d’y séjourner pour une durée supérieure à trois mois doit solliciter auprès des autorités diplomatiques et consulaires françaises un visa de long séjour dont la durée de validité ne peut être supérieure à un an” (CESEDA, art. L. 312-2). A British school-leaver cannot therefore arrive on a passport, enrol, and sort out the paperwork later. The long-stay visa (visa de long séjour) must be obtained from the French consular authorities in the United Kingdom before travel, and for courses above three months it takes the student form, most often a visa that also acts as a residence permit for its first year, known by its initials VLS-TS (visa de long séjour valant titre de séjour). The official France-Visas portal runs a student section that lists the procedure and the documents for each case (France-Visas, Student), and it is the reference to check before booking any appointment, because the document list moves and consulates apply it strictly.

One piece of the route surprises many British families: service-public.fr, the official French administration site, places the United Kingdom in the group of countries whose nationals go through the Études en France online pre-enrolment procedure for higher education, alongside countries such as the United States, Canada, Russia and India (Service-public.fr, Foreign student in France: long-stay visa or residence permit). In practice this means the application has two tracks running in parallel: the academic track, with the French institution and the Études en France file, and the consular track, with the visa form, the supporting documents and the appointment. Treat them as one dossier. The certificate or letter of admission from a higher-education institution (a university, a grande école, the French elite higher-education institution, or a vocational higher-training body) is the keystone: without proof of registration or pre-registration, the consulate has nothing to stamp, and the residence card later has nothing to rest on. Keep the admission letter, the proof of payment of any deposit or tuition, and the academic records that show the course follows sensibly from what the student did before, because coherence of the study plan is examined at the visa stage and again at every renewal.

The visa, once issued, conditions everything that follows. French law provides that, subject to international commitments and narrow exceptions, “la première délivrance d’une carte de séjour temporaire ou d’une carte de séjour pluriannuelle est subordonnée à la production par l’étranger du visa de long séjour mentionné aux 1° ou 2° de l’article L. 411-1” (CESEDA, art. L. 412-1). In ordinary language: no proper long-stay visa, no first student card (carte de séjour temporaire portant la mention « étudiant », the temporary residence card marked “student”). A student who entered visa-free for a short stay and then tries to convert that stay into a student card at the prefecture will be refused for want of the visa, with only narrow statutory exceptions such as passing an entrance examination after regular entry or having attended school in France since the age of sixteen. British applicants should therefore never treat the visa as a formality to be fixed on arrival. The related long-stay route for newcomers, with its own refusal traps and remedies, is described in our guide to the first long-stay visa and carte de séjour after Brexit.

B. The money test, the genuine-studies test and the health cover to organise before departure

Two tests decide most student-visa files: money and seriousness. On money, the administration applies a monthly resources benchmark that it updates from time to time, so the figure to use is the one published on service-public.fr on the day the file is lodged, and that page should be the last one checked before filing, not the first (Service-public.fr, Foreign student in France: long-stay visa or residence permit).

The seriousness test runs alongside the money test. The same Nantes decision recalls the European framework: admission for study requires general conditions such as sufficient resources and specific conditions such as admission to a higher-education institution and payment of enrolment fees, and a Member State may refuse where it holds serious and objective evidence that the applicant wants to stay for other purposes than the one declared, in the directive’s words, “s’il possède des preuves ou des motifs sérieux et objectifs pour établir que l’auteur de la demande souhaite séjourner sur son territoire à d’autres fins que celles pour lesquelles il demande son admission” (CAA Nantes, 17 Oct. 2025, No 24NT03433). The French instruction lets the consulate refuse “s’il existe des éléments suffisamment probants et des motifs sérieux permettant d’établir que le demandeur séjournera en France à d’autres fins que celles pour lesquelles il demande un visa pour études”. For a British applicant this is rarely about fraud and usually about coherence: a sudden switch from A-level sciences to an unrelated private course with weak French, unexplained gaps, or an institution with no recognisable status. Judges review this ground only for manifest error, a light-touch review, so the file must make the study plan self-evident: admission letter, prior results, language level, and a short personal statement tying the course to the student’s past and future.

Health cover is the third item to settle before the flight, and the British side of the story matters here. The British government’s guidance states plainly: health insurance cover is compulsory for living in France, and the guidance lists a UK-issued GHIC or EHIC used for temporary stays while studying among the routes UK nationals rely on (GOV.UK, Healthcare for UK nationals living in France). GHIC is the Global Health Insurance Card, the post-Brexit successor to the European card for temporary stays. In practice a British student should therefore travel with a GHIC for immediate needs and register with the French health system on arrival for ongoing cover, keeping every certificate: prefectures ask for proof of health insurance (assurance maladie) at several stages, and the graduate card later expressly requires it. Students who take a part-time job will also pick up payslips that matter at tax time; the mechanics of the first French return, the 2042, the 2047 and the 3916 bank-account form, are set out in our guide to the first French tax return after Brexit. Families who want the full health-system picture, from the S1 to PUMA (Protection universelle maladie, the universal French health cover) and how to fight a CPAM (the local health fund) refusal, will find it in our guide to British healthcare in France after Brexit.

II. Working, staying on after graduation and challenging a refusal without losing the year

A. The part-time job, the renewal and the graduate job-seeker card that prefectures still get wrong

The student card itself sets the framework for everything that follows: “L’étranger qui établit qu’il suit un enseignement en France ou qu’il y fait des études et qui justifie disposer de moyens d’existence suffisants se voit délivrer une carte de séjour temporaire portant la mention ” étudiant ” d’une durée inférieure ou égale à un an” (CESEDA, art. L. 422-1). Two features of that card matter most to British students. First, renewal is never automatic: the foreigner already resident who seeks renewal must file the documents required for first issue and show continued compliance, “justifiant qu’il continue de satisfaire aux conditions requises pour celle-ci” (CESEDA, art. R. 433-2). Second, the card carries a work right that many students underuse: “Cette carte donne droit à l’exercice, à titre accessoire, d’une activité professionnelle salariée dans la limite de 60 % de la durée de travail annuelle” (CESEDA, art. L. 422-1). Sixty per cent of the statutory annual working time is the ceiling for salaried work alongside studies, with no separate work permit needed inside that ceiling. The employment must stay ancillary (à titre accessoire): a student working full-time hours while failing every exam invites the prefecture to doubt the studies at renewal, while a student with steady attendance and a weekend contract is exactly what the provision was written for.

Renewal is where British students most often meet the prefecture’s red pen, and the leading recent decision is reassuring for anyone with one bad year followed by recovery. In Nancy on 5 June 2025 (No 24NC01115), a student had failed his first year of an IT degree twice, then enrolled in a coherent IT bachelor, attended assiduously and averaged 13 out of 20 with an exemplary record, yet the prefecture refused renewal and added a 30-day order to leave France (obligation de quitter le territoire français, the removal order commonly called OQTF) (CAA Nancy, 5 June 2025, No 24NC01115). The court annulled everything and stated the method every prefecture must follow: “il appartient à l’administration, saisie d’une demande de renouvellement d’une carte de séjour présentée en qualité d’étudiante, de rechercher, à partir de l’ensemble du dossier, si l’intéressée peut être raisonnablement regardée comme poursuivant effectivement ses études, en tenant compte de l’assiduité, de la progression et de la cohérence du cursus suivi”. Three words decide renewals, then: attendance, progression, coherence. A failed year explained by illness or a bereavement, followed by a coherent reorientation with attendance slips, marks and a tutor’s letter, is a file to defend, not a lost cause. The same judgment shows what a winning case obtains: the court ordered the prefecture to issue the student card within one month of notification and to grant a temporary permit (autorisation provisoire de séjour) in the meantime. Renewal files should therefore be built like mini-trials from the start: enrolment certificates for each year, transcripts, attendance records, medical certificates for any gap, proof of resources, and a one-page timeline connecting the years into a single coherent course.

Graduation opens the second chapter: the job-seeker and business-creation card (carte de séjour temporaire portant la mention « recherche d’emploi ou création d’entreprise », often shortened to APS). The statute grants it to the foreigner with health cover who held a student card and obtained, in a nationally accredited higher-education institution, “un diplôme au moins équivalent au grade de master ou figurant sur une liste fixée par décret”, and who either wants a first professional experience, “sans limitation à un seul emploi ou à un seul employeur”, or has a business-creation project in the field of his training, with the card issued for one year: “se voit délivrer une carte de séjour temporaire portant la mention ” recherche d’emploi ou création d’entreprise ” d’une durée d’un an” (CESEDA, art. L. 422-10). During that year the holder may work: the card “autorise l’étranger à exercer une activité professionnelle salariée jusqu’à la conclusion de son contrat ou l’immatriculation de son entreprise” (CESEDA, art. L. 422-8). For a British graduate in Paris, where applications go to the Paris police prefecture (préfecture de police), and everywhere else to the prefecture of the home address, the practical checklist is short: health cover certificate, the student card history, and the diploma at master level or on the listed tracks, from an accredited institution.

The Paris decision of 4 July 2025 (No 24PA02335) kills the most persistent prefectural myth in this field (CAA Paris, 4 July 2025, No 24PA02335). The police prefecture had refused a Vietnamese graduate on the sole ground that she had obtained her diploma more than a year before applying, pointing to a checklist annex that asked for a diploma “obtenu dans l’année”. The court held that since 1 May 2021, “il n’est plus exigé par aucun texte législatif ou réglementaire que l’étranger dépose sa demande dans un délai d’un an à compter de l’obtention de son diplôme”, and that the annex “a pour seul objet de récapituler les pièces justificatives à fournir selon les catégories de titre de séjour et ne saurait ajouter une condition supplémentaire à l’octroi du titre sollicité”. A checklist is not the law. Any British graduate refused an APS on timing alone should quote that holding in the first letter, because many refusals collapse once the prefecture is reminded of it. After the APS year, the standard landing zone is the employee card (carte de séjour « salarié ») for open-ended contracts, whose issue requires a prior work authorisation: “La délivrance de cette carte de séjour est subordonnée à la détention préalable d’une autorisation de travail” (CESEDA, art. L. 421-1). The employer applies for that authorisation, so the graduate’s real task during the APS year is to convert the internship or first job into an employer willing to sponsor the next card before the year runs out.

B. How to challenge a student visa, renewal or graduate-card refusal: the commission, the prefect and the judge

Every refusal in this field must be motivated. French law gives individuals “le droit d’être informées sans délai des motifs des décisions administratives individuelles défavorables qui les concernent”, and expressly requires reasons for decisions that refuse an authorisation or refuse an advantage to someone who meets the legal conditions (CRPA, art. L. 211-2). The first practical step on receiving any refusal is therefore to read the reasons against the file: which document was deemed missing or unconvincing, which condition was held unmet, and whether the reason matches the evidence. A refusal that merely recites a formula without engaging with the bank statements, the admission letter or the transcripts is vulnerable on reasoning alone, and later judges read the file exactly that way. Keep the envelope or the electronic notification with its date, because every time limit that follows runs from notification, and keep a complete copy of everything filed, since the administration sometimes defends refusals on grounds that shift between the letter and the courtroom.

Visa refusals follow their own track. As the Nantes case shows, the route runs from the consulate’s refusal to the specialised commission (commission de recours contre les décisions de refus de visa d’entrée en France, the appeals board for visa refusals), and only then to the administrative court in Nantes, which hears visa litigation for the whole country, with appeal to the Nantes court of appeal (CAA Nantes, 17 Oct. 2025, No 24NT03433). The lesson for British families is procedural and evidential together: go through the commission first, because the chain consulate, commission, court is how the file is built and how judges expect to receive it, and use the commission stage to repair the file rather than merely protest. If the refusal attacked resources, add what was missing: fresh statements covering every month, the sponsor’s employment proofs, the blocked-account mechanics the bank will confirm in writing, and the tuition receipts. If it attacked coherence, add the missing narrative: prior qualifications, language certificates, and the letter tying the French course to the student’s trajectory. Do not submit a document the bank or the school would disown if checked, because the Nantes judgment shows consulates do check, and a forgery finding poisons not only the application but any later one. Where the tribunal grants the visa, it can set the administration a deadline, as the Nantes first-instance judges did with a two-month order, but that case also warns that the minister appeals: the court of appeal reversed the tribunal and upheld the refusal, so a first-instance victory should be executed quickly and never treated as the end of the story.

Renewal and graduate-card refusals are fought at the prefecture and then before the local administrative court (tribunal administratif). The useful sequence is a prompt written challenge to the prefecture pointing at the exact legal error, with the judgment or article attached, followed by court action if the prefecture maintains the refusal, especially where an OQTF with a 30-day departure period is attached. The Nancy template applies to renewals: attendance, progression and coherence across the whole file, with medical or personal evidence for any weak year and a coherent reorientation documented by fresh results (CAA Nancy, 5 June 2025, No 24NC01115). The Paris template applies to APS timing refusals: no statute imposes a one-year filing deadline since 2021, and a checklist cannot add one (CAA Paris, 4 July 2025, No 24PA02335). In both settings, ask the court for what the Nancy court granted as a matter of course: annulment, an injunction to issue the card within one month, and a temporary permit pending issue.

Two court tools frame the litigation, and both carry deadlines stated by the statutes themselves. The ordinary action for annulment goes to the administrative court “dans les deux mois à partir de la notification ou de la publication de la décision attaquée” (CJA, art. R. 421-1): two months from notification, not from when the family feels ready. Where removal is imminent or the start of term cannot wait, the emergency suspension (référé-suspension) lets the duty judge freeze the decision where urgency justifies it and the file shows an argument raising serious doubt about legality, in the statute’s words, “lorsque l’urgence le justifie et qu’il est fait état d’un moyen propre à créer, en l’état de l’instruction, un doute sérieux quant à la légalité de la décision” (CJA, art. L. 521-1). A renewal refusal that ignores fresh 13-out-of-20 marks, or an APS refusal resting on the repealed one-year rule, is precisely the kind of serious-doubt argument that provision was written for. File the annulment and the emergency application together, attach the dated refusal, the complete supporting file, and the evidence the administration ignored, and ask expressly for suspension of the removal order alongside annulment of the refusal. Throughout, never let a refusal sit unanswered while the studies continue: attending classes without a valid card does not regularise the stay, and each new application is judged on the file as filed, so repair the evidence first and file once, completely.

Conclusion

A British study project in France succeeds on three piles of paper: an admission that makes academic sense, money that is regular and checkable month by month, and health cover sorted before departure. The long-stay visa must be obtained in the United Kingdom before travel, because the first card depends on it; the student card allows ancillary work within 60 per cent of annual working time but is renewed only on proof of genuine studies measured by attendance, progression and coherence; and the graduate card offers a one-year bridge to a first job or a business, with no statutory one-year filing deadline since 2021. When the administration says no, the answer is method: read the reasons, repair the file at the commission stage for visas or before the prefecture for renewals and graduate cards, go to the administrative court within two months of notification, and seek emergency suspension where a term or a removal order is at stake. The three appeal decisions of 2025 show judges applying exactly that method, annulling refusals that ignored the file and ordering cards within a month. Build the file as if a judge will read it, because one day a judge may.

British student visa from the UK after Brexit: resources, part-time work, the graduate APS card and how to challenge a refusal.

[80312,80314

post-2149957","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-british-desk","category-decryptage
<!-- This site is optimized with the Yoast SEO Premium plugin v28.2 (Yoast SEO v28.2) -
