Each week you cross the Channel — by Eurotunnel, ferry or plane — to work in London, Dover or Ashford, then return to your home in Calais, Lille or Boulogne. Since Brexit, that back-and-forth has a legal name with concrete consequences: you are a frontier worker (travailleur frontalier), a person who works in one State and lives in another to which they return regularly. The French liaison body for international social security confirms that, even after the British withdrawal, the frontier-worker concept continues to operate between the United Kingdom and the Member States of the European Union (see the Cleiss frontier-worker page). The arrangement reverses the usual logic: your contributions go to Britain while you work, your healthcare at home in France runs through a specific certificate, your unemployment rights if the British job ends belong to France, and your salary — though earned abroad — is normally declared and taxed in France with treaty relief. This article explains, for a British reader, how each of those four files works after Brexit, where the traps sit, and how to challenge a refusal from the health fund, the employment service or the tax office. Every French term is translated when it first appears.

I. Protected on Both Sides of the Channel: British Contributions, French Healthcare and Unemployment

A. Insured in Britain While You Work, Treated in France With the S1 Certificate

The starting point is the place-of-work principle, stated in the widest terms by French statute: “Sont affiliées obligatoirement aux assurances sociales du régime général, quel que soit leur âge et même si elles sont titulaires d’une pension, toutes les personnes quelle que soit leur nationalité, de l’un ou de l’autre sexe, salariées ou travaillant à quelque titre ou en quelque lieu que ce soit, pour un ou plusieurs employeurs et quels que soient le montant et la nature de leur rémunération, la forme, la nature ou la validité de leur contrat ou la nature de leur statut.” (Article L311-2 of the Social Security Code). Applied in mirror image, the same logic places you under the British scheme while your activity is in Britain: you pay British contributions there, and only there, for the same work. The supreme court for civil matters enforces that territorial reading strictly against employers that keep workers on the wrong side of the line: controllers verify affiliation by collecting the employer’s documents, namely “les documents, quels que soient leur forme et leur support, qui permettent d’établir si l’employeur dispose d’une affiliation à la sécurité sociale française.” (Cass. 2nd civil chamber, 16 October 2025, appeal no. K 23-14.039). The operative part cancelled the employer’s victory below: “CASSE ET ANNULE, en toutes ses dispositions, l’arrêt rendu le 9 février 2023, entre les parties, par la cour d’appel de Colmar”. For the frontier worker the lesson runs in reverse: affiliation follows the British workplace, so no French employer registration is due for that British activity — the opposite of the remote worker living and working in France, whose employer must register with the Foreign Firms service.

Healthcare then needs a bridge, because daily life happens in France while insurance sits in Britain. The mechanism is the portable document S1 (document portable S1): the British institution issues it, you register it with the French health fund (caisse primaire d’assurance maladie) of your home area, and from then on your treatment in France is covered as if you were locally insured, including use of the French health card (carte Vitale). The same document covers members of your family living with you in France. Two practical points decide many files. First, request the S1 before you need treatment, because registration takes weeks and backdating is limited. Second, keep proof of the weekly return pattern — travel tickets, employer attestations, border crossings — since frontier status depends on returning to the State of residence every day or at least once a week. If the pattern breaks and presence in France becomes occasional, the administration may reclassify you as a posted worker (salarié détaché) or an ordinary expatriate, each with its own certificate and time limits, described in our guide on British posted workers.

A further document deserves a place in the file even though frontier workers rarely hear about it: the portable document A1 (document portable A1), which certifies which State’s legislation applies to a worker at a given date. Frontier workers do not need an A1 for the routine itself — the British payroll already proves British cover — but the certificate becomes decisive the day a French controller questions the arrangement, for example when the health fund asks why no French contributions appear anywhere. The British authorities issue it on request, and holding a current one closes most affiliation disputes before they start. The same reflex applies to mixed households: a spouse who works in France, even part-time, falls under the French scheme for that activity under the place-of-work rule, while the frontier worker remains British-insured — one household can honestly contain two legislations, and each activity must be declared where it belongs.

For the general healthcare routes into the French system, see also our healthcare guide for Britons in France.

B. If the British Job Ends: French Unemployment Benefits Within Strict Limits

Losing the British job does not strand you between two systems: unemployment benefits (allocations chômage) for a frontier worker are paid by the State of residence, which for you is France. French statute opens the right in general terms: “Ont droit à l’allocation d’assurance les travailleurs aptes au travail et recherchant un emploi qui satisfont à des conditions d’âge et d’activité antérieure” (Article L5422-1 of the Labour Code). Registration runs through the French employment service (France Travail), which has a dedicated frontier-worker track (see the France Travail frontier-worker page). The British periods of work count toward the qualifying record through the coordination machinery, so gather the British employment proofs — contracts, payslips, the British separation certificate — before leaving, because the French file cannot be completed without them.

The courts set a firm boundary that every frontier worker should know before claiming sickness benefits on top of unemployment. In a 2024 decision concerning a worker who had been active in Germany while living in France, then drew French unemployment and asked the French health fund for daily sickness allowances (indemnités journalières), the Cour de cassation recalled the coordination rule first: “Il résulte des deuxième et troisième de ces textes que la personne, qui au cours de sa dernière activité salariée ou non salariée, résidait dans un État membre autre que l’État membre compétent et qui continue à résider dans le même État membre, bénéficie de prestations de chômage en vertu de la législation de l’État membre de résidence et est soumise à la législation de cet État membre.” (Cass. 2nd civil chamber, 17 October 2024, appeal no. H 22-17.390). It then restated the domestic maintenance rule: “Selon le dernier de ces textes, toute personne, qui perçoit l’une des allocations ou l’un des revenus de remplacement qu’il énumère, conserve la qualité d’assuré et bénéficie du maintien de ses droits aux prestations du régime obligatoire d’assurance maladie, maternité, invalidité et décès dont elle relevait antérieurement.” The statute behind that second proposition is still in force today: “Toute personne percevant l’une des allocations mentionnées à l’article L. 5123-2 ou aux articles L. 1233-65 à L. 1233-69 et L. 1235-16 ou au 8° de l’article L. 1233-68 du code du travail ou l’un des revenus de remplacement mentionnés à l’article L. 5421-2 du même code conserve la qualité d’assuré et bénéficie du maintien de ses droits aux prestations en espèces du régime obligatoire d’assurance maladie, maternité, invalidité et décès dont elle relevait antérieurement.” (Article L311-5 of the Social Security Code). But maintenance is not creation: because the worker’s earlier German cover had been taken out as private insurance that never included daily allowances, the appeal court had created rights existing under neither legislation, and the Cour de cassation cancelled the whole judgment: “CASSE ET ANNULE, en toutes ses dispositions, l’arrêt rendu le 7 avril 2022, entre les parties, par la cour d’appel de Metz”. The practical moral for a British frontier worker is sharp: French unemployment protects you, and it preserves the health rights you actually held — it does not invent daily-allowance cover you never had in Britain. Check what the British record really contains before asserting French sickness rights on top of it.

Two further unemployment traps catch frontier workers by surprise. The first is availability: French benefits require genuine job-seeking in France, and the employment service checks it — refusing suitable offers or training without reason can suspend payment just as for any other claimant. The second is overpayment recovery (trop-perçu): where benefits were paid on British periods that are later corrected, or where undeclared activity emerges, the service issues a recovery notice that must be challenged within its own short deadline, separately from any dispute on the underlying right. Treat every letter as a deadline, reply in writing, and keep copies of everything sent.

Every refusal in this area follows the same ladder. Against the health fund, file the prior complaint with its appeals commission (commission de recours amiable), then bring the case before the judicial court (tribunal judiciaire) for social protection disputes, then the court of appeal. Against the employment service on benefit amount or duration, use its own reconsideration stage before the administrative route where applicable, keeping every deadline counted from notification. Attach the status proofs from day one: S1 registration, frontier-pattern evidence, British employment and separation papers, and the coordination documents showing which periods were aggregated. Files fail most often on proof, not on principle.

II. Living in France While Earning in Britain: Residence Papers and French Tax

A. Your Right to Live in France Does Not Depend on a French Employer

Because you work in Britain, no French work authorisation is needed for that activity — but living in France still requires a French residence title. Since Brexit, a British citizen counts as a third-country national, and the entry rule is general: “tout étranger âgé de plus de dix-huit ans qui souhaite séjourner en France pour une durée supérieure à trois mois doit être titulaire de l’un des documents de séjour suivants : 1° Un visa de long séjour ;” (Article L411-1 of the Code on the Entry and Residence of Foreigners and Asylum). In practice the frontier worker enters on a long-stay visa, then holds a temporary card (carte de séjour temporaire) and later a multi-year card (carte de séjour pluriannuelle), with the exact card depending on personal circumstances — family ties in France, length of presence, financial means — as mapped in our hub guide for British newcomers. Those covered by the Withdrawal Agreement, having lived in France before the end of the transition period, follow their own specific card track instead, described in our guide on the Withdrawal Agreement residence card. One confusion to clear at once: the weekly commute does not exempt you from holding a French title. Border guards and préfectures (préfectures, the local State offices issuing permits) see a resident, not a visitor, and the 90-day visa waiver covers short stays, never residence.

British citizens already covered by the Withdrawal Agreement keep an additional layer of protection: residence rights acquired before the end of the transition period, including the specific card, cannot be questioned merely because the holder works across the Channel — frontier work is an expressly contemplated pattern, and absence rules for maintaining the card look at overall ties, not at the workplace address. New arrivals since 2021 build their file under ordinary immigration law instead, where the strength of the French home and the regularity of returns carry the application. In both cases, travel discipline matters beyond social security: keep passports stamped or boarding records showing the weekly returns, because the same documents prove residence continuity if the préfecture ever doubts it.

The proof that matters most at the counter is the reality of the French home: lease or title deeds, utility bills, school registrations, and the weekly-return evidence already gathered for social security. Where family members are also British, each adult needs their own title; where a spouse holds European Union nationality, the European track may simplify the file. If the administration refuses the card or issues a removal order alongside it, the challenge runs from an informal appeal (recours gracieux) to the administrative court (tribunal administratif), which reviews the legal basis, the whole file and proportionality. Never let the appeal deadline pass while waiting for an informal answer: the two tracks run in parallel, and only the court filing stops the clock.

B. France Normally Taxes the British Salary, With Treaty Relief for British Deductions

Tax residence follows the home, not the workplace. (Article 4 A of the General Tax Code). (Article 4 B of the General Tax Code, third test). A frontier worker whose family home, daily life and centre of interests sit in France meets the first test on arrival, even though the professional activity is exercised across the Channel. The consequence is worldwide taxation in France: the British salary is declared on the French return — main form 2042 with the foreign-income schedule 2047 — following the method in our walk-through of the first French tax return. Because British payroll tax is deducted at source, the bilateral double-tax convention then eliminates the overlap: France taxes and grants a credit for the British tax on the same income. Keep every British payslip and P60, because the French tax office asks for them when checking the credit. Pension questions that arise alongside — the British State pension, its declaration, and when French social charges do not apply — are covered in our guide on the British State pension in France.

A worked example shows why the counting matters. Take a frontier worker present in Britain from Monday to Friday for forty-six weeks a year: roughly 230 British working days against some 135 days of French presence. The residence test under Article 4 B is met through the permanent French home regardless of that arithmetic, while the treaty employment rule keeps primary taxation in France with credit for the British payroll deductions — the exact opposite of what intuition suggests to someone who spends most working hours abroad. Where the pattern is lighter — two British days a week with the rest worked from the French home — the file changes character entirely and the remote-worker analysis takes over, with French social security for the French working days. Get the classification right before filing, because tax and contributions follow it.

Unlike some of France’s continental borders, there is no special frontier-worker tax regime with Britain that derogates from the ordinary treaty sharing: the salary follows the standard employment rule, with the State of residence taxing and relief given for source deductions, and short-assignment exceptions that a weekly commuter structurally fails by spending the working year abroad. The counting that matters is therefore simple and unforgiving: days worked in Britain documented by the employer, days of French presence shown by the travel pattern, and the permanent French home tying the residence test.

Finally, assume both administrations see everything. Britain and France exchange employment and financial information automatically, so a salary visible on a British payroll record will sooner or later face the question of its French declaration. File in both States wherever a filing duty exists — the British self-assessment or payroll return on one side, the French 2042 and 2047 on the other — claim the treaty credit where the treaty gives it, and never treat payment in one State as an exemption from declaring in the other. Returns that mirror each other invite no questions; gaps between them invite audits.

Against a tax assessment, file the claim (réclamation) with the tax office first, attaching the treaty-credit computation and the British tax proofs, then appeal to the administrative court within two months of rejection. Against a residence-permit refusal, the administrative ladder described above applies. In all lanes, diary every deadline from notification and keep proof of sending: frontier files are won on dated paper.

Conclusion

The British frontier worker lives in the exact mirror of the remote worker: insured where the work is done, treated at home through the S1, protected by French unemployment if the British job ends within the limits the courts enforce, resident in France on a French title, and taxed in France on the worldwide salary with treaty credit for British deductions. Hold the four proofs together — the weekly-return pattern, the S1 registration, the British employment and tax papers, and the French home file — and each administration finds the case it expects. The order of operations is therefore simple: secure the S1 and register it before treatment is needed, keep the commute documented week by week, hold a valid French residence title independent of any French employer, declare the British salary in France with the treaty credit, and challenge any refusal through its proper lane before its deadline expires.
