Behind those searches lies a question that none of the domestic guides answer, because it only arises the day a British household leaves the country: what happens to a Pension Credit claim when its holder moves to France? The short answer is brutal. Pension Credit cannot be claimed from abroad and cannot survive a permanent move, so the means-tested top-up that keeps hundreds of thousands of British pensioners above the breadline simply stops at the border. France, however, runs its own old-age minimum for residents with small pensions, the allocation de solidarité aux personnes âgées (the old-age solidarity allowance, known as ASPA), which is open to British residents who meet precise conditions of age, residence and resources. The trap is that ASPA is not a gift. Every euro paid can be recovered from the recipient’s estate after death, above a threshold that a modest French house alone can exceed, and the fund secures its claim with a legal mortgage registered against the property. This article explains the three steps every British pensioner household must take in order: close the British claim cleanly so that no recoverable overpayment builds up, open the French claim correctly with the nine-month residence rule and the full resources picture, and organise the estate early so that the recovery does not fall on the children by surprise. Readers mapping the whole benefits landscape should start with our guide to which UK benefits survive the move to France and which stop, and those planning the move itself should read our guide to long-stay visas and residence permits for British newcomers. Every decisive rule below is cited to its official source and linked, so that each statement can be checked, and the final section explains how to challenge a refusal or a recovery bill on either side of the Channel.

I. Why your Pension Credit stops when you move to France, and what France pays instead

A. What the British rules say: four weeks away is tolerated, a permanent move ends the claim

Pension Credit is a means-tested benefit paid by the Department for Work and Pensions (DWP) to people over State Pension age with low income, and it carries a strict presence condition: the claimant must live in England, Scotland or Wales. The official guidance states the position in plain terms: short absences of up to four weeks, for example for a holiday, do not interrupt payment. A death in the family extends that tolerance by up to four more weeks, and medically approved treatment or convalescence abroad extends it to twenty-six weeks. None of those exceptions covers a move to France, as confirmed by the Pension Credit eligibility pages. The same page adds the two rules that decide every expatriation case: no new claim can be made once the claimant is already outside Great Britain, and a permanent move away from Great Britain ends entitlement altogether. There is no discretion in those words and no transitional payment. The day the move becomes permanent, entitlement ends, and any payment received after that date for a period of non-entitlement becomes an overpayment the DWP can pursue.

The practical consequence is a notification duty that should be treated as the first administrative act of the move. Before leaving, the claimant must contact the Pension Service helpline to report the change of circumstances, giving the date of departure and the new address, because the DWP continues to pay until it is told otherwise and every week of silence converts into debt. Households that keep a British bank account open and spend the money in France sometimes imagine that nothing has changed, but the overpayment machinery does not depend on where the money is spent. It depends on residence, and residence is established from travel records, French tax returns, health registrations and the claimant’s own declarations. Pensioners who also receive Housing Benefit or Council Tax Reduction should expect those passported additions to fall at the same time, since both depend on the Pension Credit award or on residence in Britain. The only British pension income that genuinely follows the retiree across the Channel is the State Pension itself: The State Pension can be claimed from abroad by anyone with sufficient UK National Insurance contributions, and payment can be made to a French bank account through the International Pension Centre, which must be contacted within four months of State Pension age to start the claim, as explained in the government’s State Pension abroad guide. That pension, plus any private or occupational pensions, then counts as resources in the French assessment described below, so the British file and the French file are linked from the first month.

B. What France pays instead: the ASPA top-up, who qualifies, and how much it pays in 2026

France guarantees every stable resident a minimum income in old age through the ASPA, a differential allowance that tops total household resources up to a statutory ceiling. The founding article, Article L815-1 of the Social Security Code, provides: “Toute personne justifiant d’une résidence stable et régulière sur le territoire métropolitain ou dans une collectivité mentionnée à l’article L. 111-2 et ayant atteint un âge minimum bénéficie d’une allocation de solidarité aux personnes âgées dans les conditions prévues par le présent chapitre.” For British readers, three words in that sentence carry the whole weight of the claim: stable residence, regular residence, and minimum age. Regular residence means holding a valid residence right, which for a British national arriving after Brexit means the appropriate long-stay visa followed by the matching residence permit, or a Withdrawal Agreement card for those already settled before the end of 2020. Stable residence is now measured against a statutory floor: “Un décret en Conseil d’Etat précise la condition de résidence mentionnée au présent article, sa durée ne pouvant être inférieure à neuf mois par année civile.” Since the summer of 2026, in other words, the statute itself requires at least nine months of presence per calendar year, a deliberate tightening from the six-month test that the courts applied for years. A British pensioner who winters in France and summers in Kent cannot satisfy that test, and should not apply. The minimum age follows the statutory retirement age, currently sixty-two to sixty-four depending on year of birth, and the same article adds: “Cet âge minimum est abaissé en cas d’inaptitude au travail”, so claimants certified unfit for work can qualify earlier.

The claim itself is made expressly to the pension fund, not granted automatically. In practice the British retiree applies to the French pension fund that pays any French basic pension, or, where no French basic pension exists because the career was entirely British, to the dedicated ASPA service administered under agricultural social mutual supervision. The application must list every resource in the world, because the allowance is differential under Article L815-9 of the Social Security Code: “L’allocation de solidarité aux personnes âgées n’est due que si le total de cette allocation et des ressources personnelles de l’intéressé et du conjoint, du concubin ou du partenaire lié par un pacte civil de solidarité n’excède pas des plafonds fixés par décret.” British State Pension, occupational pensions, rental income from a let flat in Manchester, investment income, and even notional income from assets all count. Two assessment rules surprise British applicants in particular. A cash gift to the children made three years before the claim is therefore still treated as if it were producing income under Article R815-22 of the Social Security Code. Second, the ceilings are revalued every January: “Les montants de l’allocation définie à l’article L. 815-1 et des plafonds de ressources prévus pour son attribution sont revalorisés au 1er janvier de chaque année par application du coefficient mentionné à l’article L. 161-25 .” For 2026 the official figures give a single person a maximum of 1,043.59 euros per month, or 12,523.14 euros per year, while a couple in which both partners receive the allowance can receive up to 1,620.18 euros per month, or 19,442.21 euros per year, with the monthly payment equal in each case to the difference between the ceiling and the household’s actual resources. Those amounts are gross, they are reassessed whenever resources change under Article L816-2 of the Social Security Code, which revalues amounts and ceilings every 1 January, and they presuppose that health cover is already in place, since cash benefits without medical cover leave the household exposed. British pensioners covered by Britain keep their S1 healthcare certificate on arrival, while the others join French universal health protection under Article L160-1 of the Social Security Code, the protection universelle maladie known as PUMA, under which “Toute personne travaillant ou, lorsqu’elle n’exerce pas d’activité professionnelle, résidant en France de manière stable et régulière bénéficie, en cas de maladie ou de maternité, de la prise en charge de ses frais de santé dans les conditions fixées au présent livre.” For households settling in Paris and the inner suburbs, the practical circuit runs through the Île-de-France pension fund for the claim, its friendly-appeal commission for the first challenge, and the social chamber of the Paris judicial court for litigation, with the same deadlines and the same evidence rules as everywhere else in the country.

II. The two traps that cost British families money, and how to challenge a refusal

A. The estate recovery trap: how ASPA can take a share of your French home after death

The feature of ASPA that no British pensioner expects, because nothing in the British system works this way, is recovery from the estate. Recovery is, however, fenced in on three sides. First, it only bites above a threshold: “Toutefois, la récupération n’est opérée que sur la fraction de l’actif net qui excède un seuil dont le montant est fixé à 100 000 euros au 1er septembre 2023 et revalorisé dans les mêmes conditions que celles prévues au même article L. 816-2.” For deaths occurring in 2026 the service-public.fr ASPA page puts the threshold at 108,586.14 euros of net estate, meaning debts and funeral costs deducted. Below that figure there is no recovery at all, and the worked official examples confirm that a net estate of 100,000 euros in 2026 escapes entirely. Second, the yearly recoverable amount is capped: for 2026 the maximum is 8,463.42 euros per year of payment for a single recipient and 11,322.77 euros per year where both spouses received the allowance, with part-years counted proportionally. Third, the fund must act within five years, since recovery claims prescribe five years from registration of a document recording the death and the details of at least one heir. Two further rules complete the picture. Where both spouses received the allowance, it is deemed to have been received half by each, which matters for apportioning the debt between the two successions. And the sums are secured during the beneficiary’s lifetime: “Les sommes recouvrables sont garanties par une hypothèque légale prenant rang à la date de son inscription”, a legal mortgage the fund can register against French property, which surfaces at the latest when the notaire settles the succession.

For a British homeowner in France these rules produce a concrete arithmetic that should be done before applying, not after death. A Dordogne house worth 180,000 euros with no mortgage, plus 20,000 euros of savings, leaves a net estate of 200,000 euros, of which 91,413.86 euros sits above the 2026 threshold and is exposed. Four years of ASPA at the single-person cap represent at most 33,853.68 euros recoverable, so the fund would take the smaller of the exposed fraction, the yearly caps and the total actually paid. The children expecting to inherit the house intact discover instead a registered creditor at the notaire’s table. Three planning points follow, all grounded in decided cases and official guidance rather than optimism. First, gifts made after the claim can be pulled back into the estate if they look like avoidance: official guidance warns that gifts to third parties or life-insurance premiums paid after the ASPA application can be added back to the net assets where they form a scheme to reduce resources or wealth artificially. Second, gifts made before the claim already count as resources for ten years under the assessment rule quoted above, so hurried pre-application generosity neither buys eligibility nor protects the estate. Third, leaving France ends the allowance altogether: “Le service de l’allocation de solidarité aux personnes âgées est supprimé aux personnes qui établissent leur résidence en dehors du territoire métropolitain et des collectivités mentionnées à l’article L. 111-2.” A pensioner who claims ASPA, returns to England for family reasons, and keeps cashing the payments accumulates an overpayment, since Article L815-12 of the Social Security Code ends the allowance on settlement outside France, that the fund will recover under the fraud and undeclared-residence provisions discussed below. British households holding French property should coordinate the ASPA decision with their succession planning from the start, and our guide to choosing English law for a French house while protecting the children explains the will structures into which this recovery risk must be fitted.

B. Controls, overpayments and how to challenge a refusal or a recovery bill

French pension funds do not take declarations on trust. Beneficiaries are under a permanent reporting duty under Article R815-38 of the Social Security Code: “Les bénéficiaires de l’allocation de solidarité aux personnes âgées sont tenus de déclarer à l’organisme ou au service qui leur sert cette allocation tout changement survenu dans leurs ressources, leur situation familiale ou leur résidence.” A British pension that starts paying out, a rental void that ends, a spouse who moves in, a return to England: each must be declared without waiting for the annual questionnaire. The funds, for their part, hold a standing power of investigation under Article R815-39 of the Social Security Code: “Les organismes et services mentionnés à l’article L. 815-7 peuvent procéder, à tout moment, à la vérification des ressources, de la résidence ou de la situation familiale des demandeurs ou au contrôle des ressources, de la résidence ou de la situation familiale des bénéficiaires de l’allocation de solidarité aux personnes âgées.” Bank data cross-checks, residence enquiries and home visits under agreement between funds are all routine, and British newcomers whose footprint spans two countries attract attention precisely because their resources are harder to see from France. In Rennes on 28 May 2025 (Court of Appeal, case 23/02757, full judgment on courdecassation.fr), the judges recalled that claiming ASPA requires both a resources condition and a residence condition, quoted the reporting duty and the funds’ control powers, and held that work-accident pensions and investment holdings the claimant had never declared, neither on the original form nor on control questionnaires returned in 2008, 2010 and 2020, justified recovery. The court confirmed the first judgment in full and added: “CONDAMNE M.[I] [V] à payer à la CARSAT des [Localité 4] la somme de 800 euros sur le fondement de l’article 700 du code de procédure civile”, a reminder that unsuccessful appeals carry their own price. In Mont-de-Marsan on 12 March 2026 (judicial court, case 25/00568, full judgment on courdecassation.fr), the tribunal worked through the recovery article paragraph by paragraph, confirming that post-death recovery, the decree cap, the protection of farm capital, collection through the paying bodies, the legal mortgage and the five-year prescription all flow from the same provision, a useful checklist for any heir challenging the amount rather than the principle. In Nimes on 4 December 2025 (Court of Appeal, case 24/03196, full judgment on courdecassation.fr), the court rebuilt the residence architecture from the texts, quoting Article L.815-1 and then Article R.115-6: “Pour bénéficier du service des prestations en application du troisième alinéa de l’article L. 111-1 et des articles L. 380-1, L. 512-1, L. 815-1, L. 815-24 et L. 861-1, ainsi que du maintien du droit aux prestations prévu par l’article L. 161-8, sont considérées comme résidant en France les personnes qui ont sur le territoire métropolitain ou dans un département d’outre-mer leur foyer ou le lieu de leur séjour principal.” The same article defines the home as the place of habitual residence on condition of permanence: “Le foyer s’entend du lieu où les personnes habitent normalement, c’est-à-dire du lieu de leur résidence habituelle, à condition que cette résidence sur le territoire métropolitain ou dans un département d’outre-mer ait un caractère permanent.” The court confirmed the first judgment in full, “Confirme en toutes ses dispositions le jugement rendu le 11 juillet 2024 par le tribunal judiciaire d’Avignon”, refused any costs award under article 700, “Juge n’y avoir lieu à application des dispositions de l’article 700 du code de procédure civile”, and ordered the claimant to bear the appeal costs, “Condamne M. [R] [L] aux dépens de la procédure d’appel.” For British villagers splitting the year between France and England, that reasoning is the warning: habitual, permanent, principally present in France, or no allowance.

The appeal route itself is compulsory and sequenced. Contentious appeals in social-security matters must first pass through the fund’s friendly-appeal commission under Article L142-4 of the Social Security Code: “Les recours contentieux formés dans les matières mentionnées aux articles L. 142-1 , à l’exception du 7°, et L. 142-3 sont précédés d’un recours préalable, dans des conditions prévues par décret en Conseil d’Etat.” A direct application to the court without that prior step is inadmissible, and the Rennes line of cases shows that tribunals will not annul or confirm the commission’s decision as such but will re-examine the entitlement on the full file. The second stage goes to the social chamber of the judicial court, which decides on evidence, not on hardship narratives. The winning files in this litigation share the same anatomy: dated proof of nine-month presence such as tax assessments, health-reimbursement statements and utility records; a complete worldwide resources schedule reconciled with British P60s and pension statements; the demand and every questionnaire answered consistently; and, against a recovery bill, a contradictory valuation of the estate, verification of the threshold and caps for the year of death, and a check of the five-year prescription from the death registration. For Paris-region households that means assembling the file with the Île-de-France fund, lodging the prior appeal within the period stated on the refusal letter, and pleading before the Paris court’s social chamber with translations of the British documents. On the British side the mirror discipline applies from day one: report the departure to the Pension Service before leaving, keep the dated proof of notification, and treat any Pension Credit paid after the permanent move as money held for repayment rather than income. Households that run both disciplines together, British notification on exit and French documentation from entry, convert a system designed to catch omissions into one that simply records their compliance.

Conclusion

The British pensioner who settles in France trades one old-age minimum for another, and the exchange is neither automatic nor neutral. Pension Credit, with its Great Britain presence condition, ends with the permanent move, while the State Pension earned through National Insurance contributions continues and is paid abroad through the International Pension Centre. France then offers the ASPA top-up to stable, lawfully resident households whose worldwide resources fall below the annual ceilings, 12,523.14 euros for a single person and 19,442.21 euros for a couple at the 2026 figures, provided presence reaches nine months a year and every resource, including British pensions and decade-old gifts, is declared. The price of that top-up is written into the same chapter of the Social Security Code: recovery from the estate above 108,586.14 euros net, capped per year of payment, secured by legal mortgage and prescribed in five years, alongside controls at any time, revision or suspension the moment a condition fails, and a two-year recovery window for overpayments outside fraud. The Rennes, Mont-de-Marsan and Nimes decisions show courts that enforce each of those provisions exactly as written, adding costs against claimants who litigate on incomplete files. None of this makes the move unwise. It makes timing and paperwork decisive: notify Britain before departure, claim in France with a complete file, declare every change, value the estate before the fund does, and challenge refusals and recovery bills through the prior appeal and the social chamber with evidence rather than protest. Handled in that order, the two systems connect and the household keeps what it is owed on each side. Handled by drift, the household learns the connection from a recovery letter, which is the most expensive possible way to discover how French social law works.

Pension Credit stops when you move to France.
