Then a letter from the French tax office — or your accountant — mentions three letters you never had to think about as a Briton: IFI. The impôt sur la fortune immobilière, France’s annual tax on property wealth, catches British owners on both sides of the Channel: French residents on their worldwide bricks and mortar, and non-residents on the French house alone, once the household’s net property passes €1.3 million. Brexit did not create this tax, but it stripped away the European cushions around it, and the 2008 Franco-British tax treaty — which covers income tax and capital gains only — offers no shelter against it. This guide explains who pays, what counts, how to value the property honestly, which reliefs genuinely cut the bill, what happens if you file late or under-declare, and how to challenge an assessment step by step, with the exact legal texts and recent court decisions to back every move.

I. Do I Have to Pay IFI Wealth Tax on My French Home as a British Owner?

A. Who pays IFI after Brexit: French residents, newcomers and non-residents

IFI is an annual tax, assessed on what you own on 1 January each year. The entry ticket is a single figure: you are liable only “lorsque la valeur de leurs actifs mentionnés à l’article 965 est supérieure à 1 300 000 €” — when the value of your assets described in Article 965 of the General Tax Code (Code général des impôts, the CGI) exceeds €1,300,000. Below that line, there is nothing to declare and nothing to pay; the calculation itself even starts at €800,000 once you are in. That threshold looks at the household, not at each person, and “household” (foyer fiscal) is wider than many British couples expect: “les couples mariés font l’objet d’une imposition commune. Les partenaires liés par un pacte civil de solidarité défini à l’article 515-1 du code civil et les personnes vivant en concubinage notoire font l’objet d’une imposition commune.” In plain terms, married couples are taxed jointly, and so are civil partners under a PACS (pacte civil de solidarité, the French registered partnership) and couples in an established, publicly known cohabitation (concubinage notoire). Two unmarried partners who each own half of a €2.6 million Provençal villa cannot split the threshold in two; the villa is aggregated. Add the property of minor children where the parents hold legal administration of the child’s assets, and the picture is complete.

Three personal situations cover almost every British reader. First, you live in France and are tax-resident here (domicile fiscal in France): you are taxable on your property assets situated in France or abroad — the Paris flat, the Dordogne farmhouse, but also the buy-to-let in Manchester and the shares in a property company holding overseas buildings. Second, you have just moved over: the Code gives newcomers a five-year landing strip. Individuals who were not tax-resident in France during the five calendar years before the year they settle here “ne sont imposables qu’à raison des actifs mentionnés au 2°” — are taxable only on the French-situs base — and that shelter runs “jusqu’au 31 décembre de la cinquième année qui suit celle au cours de laquelle le domicile fiscal a été établi en France”, until 31 December of the fifth year after settling. This is the modern form of a relief once negotiated specifically for Britons: Article 29(3) of the 2008 treaty provided that, for wealth-tax purposes, property outside France owned by a French resident holding British nationality without French nationality stayed out of the base for each of the five calendar years after becoming French-resident. Today’s Article 964 extends the same five-year logic to every newcomer, whatever their passport. Third, you live in Britain and keep the French holiday home: “Les personnes physiques n’ayant pas leur domicile fiscal en France” are taxable on the French buildings and land they own directly and on shares in companies, French or foreign, reflecting the value of French property those companies hold. A UK-resident couple with a €1.5 million house near Sarlat and nothing else in France is inside IFI.

Two Brexit consequences deserve emphasis because expatriate guides often gloss over them. The 2008 Convention between France and the United Kingdom, published by the decree of 7 January 2010, is by its own title a treaty for the avoidance of double taxation with respect to taxes on income and on capital gains — in French, impôts sur le revenu et sur les gains en capital. Article 2 lists the taxes it covers, and on the British side there are exactly three: income tax, corporation tax and capital gains tax. Wealth is simply not in the treaty. There is no treaty article capping French IFI on your French house and no treaty credit for it; the companion article on this site about British pensions and the France-UK treaty shows the same treaty working normally for pensions — IFI sits outside it. The Code does allow one cross-border credit: “Le montant des impôts dont les caractéristiques sont similaires à celles de l’impôt sur la fortune immobilière acquitté, le cas échéant, hors de France est imputable sur l’impôt exigible en France” — a foreign tax with characteristics similar to IFI can be credited, limited to the French tax on the overseas property. Whether anything you pay in the UK qualifies is a question to put to a UK-qualified adviser with evidence in hand; do not assume the credit, and never let anyone tell you the treaty “covers everything”.

The second consequence is administrative. The tax office can invite a non-resident owner to appoint a French tax representative (représentant fiscal), and the statutory exemption from that chore is reserved for residents of EU or EEA states linked to France by the relevant mutual-assistance conventions. Since Brexit, British residents are outside that automatic shelter, and the English-language guidance of the French tax administration confirms that where you live outside the European Economic Area and own property in France, the authorities may ask you to appoint a representative in France for assessment, collection and disputes. If that letter arrives, answer it; ignoring correspondence is how small files become big penalties. Practical detail matters here: keep a French correspondence address on file with the service des impôts des particuliers non-résidents (the non-residents’ tax office) and read every avis d’imposition (tax notice) the moment it lands.

B. What counts towards the €1.3 million line — and the rate you pay above it

The base (assiette) is the net value on 1 January of the year of: first, all the buildings, land and property rights belonging to the liable persons, including minor children’s property under legal administration; second, shares in companies and entities, French or foreign, reflecting the value of the property those structures hold directly or indirectly. The full statutory sentence is worth reading once, because every planning idea hangs off it: the base is made up of the net value on 1 January of the property of the persons concerned and of the shares of companies “à hauteur de la fraction de leur valeur représentative de biens ou droits immobiliers détenus directement ou indirectement par la société ou l’organisme” — up to the fraction of their value representing property held directly or indirectly by the company. If your société civile immobilière (SCI, the non-trading French property company so many British families use) owns a €2 million house and holds €200,000 of cash alongside it, only the property fraction of your shares counts, calculated by applying the ratio of taxable property to total assets. One boundary in the same article helps owners of genuine businesses: shares in a company carrying on an industrial, commercial, craft, farming or professional activity are left out where the taxpayer holds, directly or indirectly, alone or with the household, less than 10% of the capital and voting rights. And a management company cannot dress itself up as an operating business to escape: “n’est pas considérée comme une activité industrielle, commerciale, artisanale, agricole ou libérale l’exercice par une société ou un organisme d’une activité de gestion de son propre patrimoine immobilier” — managing its own property portfolio is not an industrial or commercial activity. A pure asset-holding SCI therefore stays inside IFI while a diversified small shareholding in a trading company stays outside.

Split ownership (démembrement de propriété) follows its own logic, and British families meet it constantly: the surviving spouse who keeps a lifetime right over the French house while the children hold the bare title, or the parent who gifts the bare ownership (nue-propriété) and keeps the use. The starting point is blunt: property burdened with a lifetime interest (usufruit, the right to use the property and take its income) or a personal right of habitation or use “sont compris dans le patrimoine de l’usufruitier ou du titulaire du droit pour leur valeur en pleine propriété” — is counted in the holder’s estate at full-ownership value. Apportionment between the interest-holder and the bare owner on the statutory scale exists only in closed cases, notably where the split comes from the surviving spouse’s legal rights under Article 757 of the Civil Code. If you hold the house as a surviving spouse with a legal usufruit, take advice on which side of that line you fall; the companion guide on this site about British wills, English-law choice and the French forced share explains how that interest usually arises. Either way, the démembrement must be declared exactly as it is — the tax office loves these files because the paperwork so often contradicts itself.

Once inside, the rate scale is progressive and public, so anyone can do the arithmetic before the notice arrives. Article 977 sets the tariff: nothing up to €800,000; 0.50% from €800,000 to €1,300,000; 0.70% to €2,570,000; 1% to €5,000,000; 1.25% to €10,000,000; 1.50% above. A household with €1.6 million of net taxable property therefore pays 0.50% on the €500,000 slice plus 0.70% on the €300,000 slice — €4,600 before reliefs. And there is a smoothing mechanism (décote) at the doorway: for net taxable wealth from €1,300,000 up to €1,400,000, “le montant de l’impôt calculé selon le tarif prévu au tableau du 1 est réduit d’une somme égale à 17 500 €-1,25 % P, où P est la valeur nette taxable du patrimoine“. At €1,350,000 the formula wipes out €625 of the €4,200 scale charge. These are net figures, after the debts the Code lets you deduct — which is where Part II begins, because most British overpayments come from valuing too high and deducting too little, not from the rate itself.

II. How Do I Declare, Value and Reduce My IFI — and Challenge the Tax Office?

A. Value the property at 1 January, claim the 30% home relief and deduct the right debts

Valuation is where IFI is won or lost, and the rule is simpler than the estate-agent brochures suggest. Property is assessed at its valeur vénale réelle — the genuine market value, what a willing buyer would actually pay — on 1 January of the tax year, under the same valuation rules as for inheritance tax. That date is fixed: the January sale next door sets the tone, the September dip does not exist yet, and the price you paid in 2019 is history. Work like a valuer, not like an optimist. Pull the sold prices (prix de cession) for genuinely comparable homes nearby from the notaires’ databases and the land registry, adjust openly for condition, aspect, energy rating and planning constraints, photograph every defect, and keep the file. The Paris administrative court of appeal gave owners a warning that every British seller should memorise: in a dispute over what fraction of a building was the main home and what the works had cost, the court held that “les mentions figurant dans l’acte du notaire reprennent les déclarations du vendeur, et ne sont dès lors pas revêtues de la présomption de vérité d’un acte authentique et peuvent être remises en cause” — statements in the notarial deed (acte authentique drawn up by the notaire) merely repeat the seller’s declarations, carry no presumption of truth, and can be challenged. If the tax office can go behind your notaire’s figures to increase a gain, it can go behind them to increase a value: a round number copied from a purchase deed or an insurance rebuild cost is not a valuation. Build your own, or commission one, every year the market moves.

The single biggest lawful reduction is the main-home allowance. Where the property is occupied as the owner’s principal residence (résidence principale), “un abattement de 30 % est effectué sur la valeur vénale réelle de l’immeuble lorsque celui-ci est occupé à titre de résidence principale par son propriétaire” — a 30% reduction applies to the genuine market value. On a Paris flat worth €2 million that you actually live in, €600,000 disappears from the base before any other relief. Two limits police it. Only one property per jointly taxed household can benefit — “En cas d’imposition commune, un seul immeuble est susceptible de bénéficier de l’abattement précité” — so the couple with the Paris flat and the Normandy manor must choose, with evidence of genuine, stable, everyday occupation to defend the choice: electoral roll, tax notices, utility consumption, children’s schooling, GP registration. And a holiday home, however beloved and however many weeks you spend in it, is not a résidence principale; claiming the 30% on the Dordogne second home while the family lives in Kent is exactly the kind of file that ends with a 40% penalty, as Part II.B shows. Furnished lettings declared as professional activity can qualify for a different shelter — property assigned to the taxpayer’s main industrial, commercial, craft, farming or professional activity is exempt — but the conditions are strict and the activity must be genuinely yours and genuinely principal, not a label on a gîte.

Debts are the second lever, and the Code draws the line with unusual precision. Deductible from the value of taxable property and shares are debts existing on 1 January, contracted by a member of the household and actually borne by that person, relating to taxable assets and proportionate to the taxable fraction: “Sont déductibles de la valeur des biens ou droits immobiliers et des parts ou actions taxables les dettes, existantes au 1er janvier de l’année d’imposition, contractées par l’une des personnes mentionnées au 1° de l’article 965 et effectivement supportées par celle-ci, afférentes à des actifs imposables“. In practice that means the outstanding capital of the mortgage used to buy the house, loans for repair, maintenance, improvement, construction or enlargement works, and property taxes owed on the buildings — but not debts linked to the income the property produces, and not notional or family arrangements without substance. Three traps catch British owners here. First, only the capital outstanding on 1 January counts, not the year’s repayments and not future interest. Second, loans taken out against the French house to buy something else — the London flat, a yacht, a portfolio — are not attached to a taxable asset and do not deduct. Third, debts routed through a company you control, especially loans from yourself or your family to your own SCI to buy its property, sit under dedicated anti-avoidance provisions that neutralise them; if your structure involves shareholder loans, get the paperwork reviewed before you deduct a euro. Keep every loan offer, amortisation table and 1-January statement: in a valuation dispute the administration must prove its higher figure, but on debts the burden of proof is yours.

Two final reducers complete the toolkit. The cap (plafonnement) protects the cash-poor, property-rich: broadly, IFI plus the previous year’s French and foreign taxes on income and revenue is reduced down to 75% of the previous year’s worldwide net professional income, after defined adjustments — the mechanism lives in Article 979 and routinely halves bills for retired owners whose pensions are modest beside a valuable house. And generosity counts: a taxpayer may credit 75% of cash gifts (and gifts of listed shares in full ownership) to qualifying research, higher-education, public-interest and insertion bodies, within a €50,000 ceiling — the kind of year-end gift to a fondation reconnue d’utilité publique (recognised public-interest foundation) that also funds the donor’s wider French philanthropy. Neither mechanism applies itself: the cap must be computed and claimed, the gifts documented with receipts, and both survive only if the underlying valuation is defensible.

B. File form 2042-IFI on time, pay, and fight back: penalties, claims and the courts

Filing is part of the ordinary spring ritual. Liable owners must state the gross and net taxable value of the Article 965 assets on the annual return provided for by Article 170 — in practice the online income-tax return — with supporting schedules in the administration’s model: “Les redevables mentionnent la valeur brute et la valeur nette taxable des actifs mentionnés à l’article 965” on the annual return provided for by Article 170. The English-language public-service guidance confirms the rhythm: the IFI return is made in the spring, to the same deadlines as the income-tax return, on form 2042-IFI together with the identification schedule 2042-IFI-COV. Spouses, and PACS partners, must sign the return jointly. The French tax administration’s own international guidance adds the two points non-residents most often miss: only owners of net taxable property above €1.3 million on 1 January of year N file an IFI return in year N+1, and the €1.3 million is a net figure after the deductible debts described above. Diary discipline is everything — the deadlines move slightly each year by area and by online versus paper filing, so check the current year’s dates on the official timetable rather than relying on last year’s. A British owner who “didn’t know” is still liable; there is no newcomer grace period for the obligation to file, only the five-year base restriction in Part I.

Miss the deadline and the scale is mechanical. Late filing draws 10% where no formal demand (mise en demeure) was sent or where the return arrives within thirty days of one: “10 % en l’absence de mise en demeure ou en cas de dépôt de la déclaration ou de l’acte dans les trente jours suivant la réception d’une mise en demeure d’avoir à le produire dans ce délai” — rising to 40% beyond that grace period. Under-declaration is punished separately and harder: inaccuracies or omissions in a return determining the base or the tax draw “40 % en cas de manquement délibéré” — 40% for deliberate failure — and 80% for abuse of law or fraud. Late payment adds interest for late payment (intérêt de retard) on any fiscal debt unpaid by the legal date, on top of any penalties, and simple non-payment of the tax shown on the notice by the stated payment date draws its own 10% increase. These stack: a deliberately understated villa can cost the duty, 40%, interest, and the loss of the taxpayer’s credibility for every later argument.

The Nancy administrative court of appeal showed in November 2020 how the 40% works on property owners who say “it wasn’t me”. A taxpayer had omitted, two years running, the rental income from his shares in four property companies, filing his overall 2042 on time but never the rental schedule; he blamed his accountants for not forwarding documents, his wife’s lack of financial skills, and the fact that the profits stayed in the companies to repay loans. The court restated the test first: “la majoration pour manquement délibéré a pour seul objet de sanctionner la méconnaissance par le contribuable de ses obligations déclaratives” — the deliberate-failure surcharge exists only to punish breach of filing duties — and “l’administration doit apporter la preuve, d’une part, de l’insuffisance, de l’inexactitude ou du caractère incomplet des déclarations et, d’autre part, de l’intention de l’intéressé d’éluder l’impôt” — the administration must prove both the defective return and the intent to dodge tax. It then upheld the 40%: the omitted income was 57% then 47% of the final tax, the omissions spanned four companies and repeated, the taxpayer had filed correctly in earlier years, a previous audit had already flagged the same omission, and as company director and SCI manager he could not credibly claim ignorance of the rents. For a British owner, translate directly: omitting the SCI-held house from the IFI return while declaring everything else, year after year, after an accountant once warned you, is the textbook fact pattern for 40%. “My French isn’t good enough” and “my spouse does the forms” are not defences the judges accept — appoint a competent representative instead.

If the assessment is wrong, challenge it in the right order. Start with a formal claim (réclamation) to the tax office: the Procedure Code opens the courts to claims seeking “soit la réparation d’erreurs commises dans l’assiette ou le calcul des impositions, soit le bénéfice d’un droit résultant d’une disposition législative ou réglementaire” — either correction of errors in the base or computation, or the benefit of a right under statute or regulation. That single sentence is your checklist: every challenge must be either your value is wrong, with comparable evidence attached or you denied the taxpayer a right the statute grants — the 30% relief, the debt deduction, the cap or the five-year newcomer base. File the claim before the deadline printed on the notice, attach the valuation file, the loan statements, the proof of main-home occupation and the computation of the cap, and ask explicitly for discharge (décharge) or reduction (réduction) in rights and penalties. If the administration rejects expressly or stays silent, the dispute moves to the administrative court (tribunal administratif) of the property’s location, where the two court decisions cited above show judges engaging seriously with valuation evidence and penalty tests rather than rubber-stamping. Throughout, never stop paying what is safely due: undisputed amounts paid on time stop interest running, while disputed amounts can be contested without the file rotting.

Conclusion

IFI is not a Brexit punishment, but Brexit made it a lonelier tax for Britons: no treaty ceiling, no treaty credit, and no automatic exemption from appointing a French representative. The discipline that keeps bills lawful is the same for the Dordogne farmhouse and the Paris flat — aggregate the household honestly against €1.3 million, value at 1 January with real comparables, take the 30% only on a genuine main home, deduct only attached debts existing at New Year, claim the cap and the gifts where they fit, and file form 2042-IFI with the spring return. Do that, and the tax is often hundreds rather than thousands; do the opposite, and the Nancy pattern — omission, repetition, 40% — writes itself. Valuations move every year, so reopen the file each January before the spring deadline closes it for you.

British owner caught by French IFI wealth tax above EUR 1.3m?
