You have never heard of it, you rent only a small office or even work from a domiciliation address, and the amount runs into several hundred euros. This article explains what this first cotisation foncière des entreprises (CFE, the French local business tax assessed on the premises you use) bill means for a foreign founder, why you owe it even when you live outside France, how it is calculated, why the first year is special, and how to pay it by the 15 December deadline, claim relief or challenge it from abroad without travelling to France.

French founders receive the same bill, but foreign founders face three extra difficulties: the assessment notice (avis d’imposition) is only published online in the espace professionnel (the secure business account on the tax authority website), nobody sends a paper letter abroad; the explanatory pages are mostly in French; and the payment, the declaration and any claim must be handled through French online procedures with French deadlines. Missing the bill does not cancel it: interest and a surcharge apply automatically, and the local tax office (service des impôts des entreprises, SIE, the tax office in charge of companies) will pursue collection. The good news is that the rules are written in the statute, the calendar is predictable, and a founder living in London, New York, Berlin or Dubai can deal with the whole file remotely. This guide walks through the legal basis first, then the practical steps when the bill lands. For the full incorporation sequence — bank, Kbis, VAT and first hire — see our pillar guide to setting up a company in France as a foreign founder.

I. Why Your French Company Owes CFE Even Though You Live Abroad

CFE surprises foreign founders because it has no equivalent in many common-law systems: it is not a tax on profit, turnover or salary, but a local tax on the fact of carrying on a business from premises located in France. Understanding who pays and on what base removes most of the anxiety around the first bill.

A. Who Pays CFE and From Which Year After Creation Abroad

The CFE is one half of the contribution économique territoriale (CET, the territorial economic contribution that replaced the old taxe professionnelle in 2010). The statute states that “Il est institué une contribution économique territoriale composée d’une cotisation foncière des entreprises et d’une cotisation sur la valeur ajoutée des entreprises.” The second half, the cotisation sur la valeur ajoutée des entreprises (CVAE, the value-added contribution), only concerns companies above a turnover threshold and is being phased out; for a newly created société par actions simplifiée (SAS, the flexible joint-stock company most foreign founders choose) or société à responsabilité limitée (SARL, the limited liability company with stricter statutory rules), the bill you actually receive in year one or two is the CFE.

Liability is very broad. The law provides that “La cotisation foncière des entreprises est due chaque année par les personnes physiques ou morales, les entités non dotées de la personnalité morale ou les fiduciaires pour leur activité exercée en vertu d’un contrat de fiducie qui exercent à titre habituel une activité professionnelle non salariée.” Any company registered in France that carries on an habitual self-employed professional activity falls inside, whatever the nationality or residence of its shareholder or its président (the legal representative of a SAS). A French SAS wholly owned by an American, British or Emirati resident, managed remotely, is liable in exactly the same way as a company run from Paris. Residence abroad is not an exemption, and having no French employee changes nothing. Only activities that fall outside French corporate or income tax under territoriality rules escape, which is not the case of a company registered at a French address and recorded at the Registre national des entreprises (the national business register) with a French Kbis.

Two timing rules then decide which year you pay. First, “La cotisation foncière des entreprises est due pour l’année entière par le redevable qui exerce l’activité le 1er janvier.” The photograph is taken on 1 January: if your company exists and operates on that date, it owes the full year, even if it closes in February; if it is created on 2 January, that year is not taxed at that establishment. Second, the year of creation itself is exempt: “En cas de création d’un établissement autre que ceux mentionnés au III, la cotisation foncière des entreprises n’est pas due pour l’année de la création.” A company created in March 2026 therefore pays nothing for 2026 and receives its first CFE bill in autumn 2027 for the year 2027. A company created in December 2025 pays nothing for 2025 and is billed in autumn 2026 for 2026. Foreign founders often misread this as a two-year holiday; in reality only the creation year is fully exempt, and the following year benefits from a halved base, as explained below. The official English page of service-public.fr confirms the mechanism and the December payment deadline, and the Ministry of the Economy page details the 50% advance due by 15 June once a prior-year assessment exists and the balance due by 15 December: see the official CFE page on entreprendre.service-public.gouv.fr and the Ministry of the Economy CFE guide.

Domiciliation does not remove liability either. A company domiciled with an approved domiciliation firm, hosted in a co-working space, or renting a 10-square-metre office is liable wherever the commune (the municipality) can attach premises to it. The tax is “établie dans chaque commune où le redevable dispose de locaux ou de terrains, en raison de la valeur locative des biens qui y sont situés”, meaning each municipality where you have rooms or land assesses its own CFE. A Paris registered office plus a Lyon warehouse means two bills. Conversely, a company with no premises at all in France — a pure holding with a letterbox — will still generally be assessed on a minimum base (base minimum) fixed by the commune, because the law authorises municipalities to set a minimum taxable amount depending on turnover. That is why founders who expected zero tax with zero office still receive a bill of 200 to 700 euros. Turnover below 5,000 euros is the only small-amount escape: companies whose turnover or receipts do not exceed 5,000 euros are exempt from that minimum contribution, as the Ministry guide recalls. Above that line, the minimum applies even to a services company working entirely online.

Practical consequence for a founder abroad: tick three boxes as soon as the Kbis arrives. First, file the initial CFE declaration (form 1447-C-SD) with the SIE of the registered office before 31 December of the creation year — for a 2026 creation, before 31 December 2026 for the 2027 tax — describing the premises, even if it is only a domiciliation contract. The tax office needs this return to compute the base; without it, it assesses on estimated data and you lose time correcting. Second, activate the espace professionnel on impots.gouv.fr and subscribe to electronic notices, because as the tax authority recalls, your CFE notice is not sent by post and must be downloaded from the account. Third, diary 1 January: any establishment open on that date triggers the full year. If you plan to close a secondary office in December, complete the deregistration before year-end rather than in January.

B. How the First Bill Is Calculated: Rental Value, Rates and the Halved Base

The calculation looks opaque because three layers stack: a national base definition, a locally voted rate, and a minimum amount. Each layer is fixed by a published rule, so the bill can always be checked line by line.

The base is the valeur locative (the deemed rental value used for French property taxes). The statute defines it as follows: “La cotisation foncière des entreprises a pour base la valeur locative des biens passibles d’une taxe foncière situés en France, à l’exclusion des biens exonérés de taxe foncière sur les propriétés bâties en vertu des 11°, 12°, 13° et 15° de l’article 1382 , dont le redevable a disposé pour les besoins de son activité professionnelle pendant la période de référence définie aux articles 1467 A et 1478 , à l’exception de ceux qui ont été détruits ou cédés au cours de la même période.”. In plain terms, the tax office takes the cadastral rental value of the offices, shops, workshops or land your company had at its disposal during the reference period — generally the penultimate year (year N-2) for the tax of year N, with the 31 December rule for young companies — and applies the local rate. The rental value follows property-tax rules, with a 30% reduction for industrial premises. For offices in Paris, Lyon or Bordeaux, the cadastral value often exceeds the actual rent because it was last revised long ago; that is a frequent source of disputes, and the administrative courts regularly have to fix the value premises by premises. In a widely cited ruling on CFE rental values, the Conseil d’État reviewed the Paris court’s assessment of business premises and fixed the building value used for the base — see Conseil d’État, 11 March 2021, No. 436628, Cofival — which shows that the value is a question of evidence, not an untouchable figure from the administration.

Where the company has little or no valuable premises, the base minimum takes over. Each commune and intercommunal body votes a minimum base within a statutory scale linked to turnover brackets (for example a few hundred euros of base for turnover under 10,000 euros, rising to several thousand euros of base for turnover above 500,000 euros). The CFE rate voted locally — commonly 20% to 30% in large cities — is then applied to that minimum base. The result is the familiar bill: a Paris SAS with 80,000 euros of turnover and a domiciliation address may pay around 400 to 600 euros; the same company with a 50-square-metre office in the 8th arrondissement may pay 1,500 to 3,000 euros because the real rental value replaces the minimum. The additional tax for the chambers of commerce (taxe pour frais de chambres de commerce et d’industrie) and small management fees are added at the bottom of the notice. None of this depends on profit: a loss-making startup pays the same CFE as a profitable one with identical premises.

The first taxed year carries a specific relief that foreign founders should verify on the notice. The law provides that “la base du nouvel exploitant est réduite de moitié pour la première année d’imposition.” Combined with the creation-year exemption, the sequence for a company created in 2026 is therefore: no CFE in 2026, CFE in 2027 on half the base, full CFE from 2028. If the 2027 notice shows a full base, that is a first ground for a claim. Other exemptions may stack: young innovative companies (jeunes entreprises innovantes), new establishments in urban priority zones or rural revitalisation zones, and certain artisanal or artistic activities can be exempt temporarily by law or by local vote, sometimes automatically, sometimes only on express request filed with the 1447-C-SD return. A foreign founder who set up a software SAS in a Paris incubator inside a qualifying zone but never ticked the exemption box will be billed in full and must claim afterwards — a recoverable but avoidable dispute.

To read the bill concretely, open the PDF in the espace professionnel and locate four lines: the commune and rate, the taxable base (real rental value or minimum base with the turnover bracket), the halving if it is the first taxable year, and the breakdown of additional taxes. Compare the base with the 1447-C-SD return you filed and with the cadastral figures on the property owner’s taxe foncière notice if you rent. If you only have a domiciliation contract, the base should normally be the minimum, not a full office value carried over from a previous occupant — a classic error when the tax office keeps the former tenant’s data. Note the BODACC (Bulletin officiel des annonces civiles et commerciales, the official gazette where company creations, transfers and closures are published) and Kbis dates if you took over an existing business: “En cas de changement d’exploitant, la base d’imposition est calculée pour les deux années suivant celle du changement” on the predecessor’s activity, so buying a French business in January means inheriting its CFE base for two years. Price that into the acquisition.

II. What to Do When the Notice Lands in Your Online Account

The notice typically appears online in November, with payment due in mid-December. From abroad, everything — paying, requesting time, claiming — goes through the impots.gouv.fr business account, by direct debit, bank transfer from a SEPA account, or card, plus a formal online claim if needed. The sequence below follows the order in which a founder should act.

A. Pay by 15 December From Abroad and Stop Penalties Running

The deadline is national and strict: the balance of the CFE is payable no later than 15 December of the tax year, after deduction of any June advance. The Ministry page states it plainly: the balance must be settled by 15 December included, and where the prior-year CFE justified it, a 50% advance was already due by 15 June — see the official payment calendar. For a first bill there is usually no June advance, so the full amount is due in December. Payment is dematerialised and compulsory above a threshold: log into the espace professionnel, open the CFE account, and pay by direct debit (prélèvement), online card or SEPA transfer to the SIE’s account. A foreign bank account inside SEPA works; outside SEPA, use the company’s French account or a SEPA-capable fintech account in the company’s name and keep the debit proof. Do not send a foreign cheque or an international wire without the statutory references — it may not be allocated before the deadline.

Missing the date triggers two automatic layers. Interest for late payment runs at “0,20 % par mois” on the tax due, counted from the first day of the month following the deadline, plus any penalties. On top of interest, “Donne lieu à l’application d’une majoration de 5 % tout retard dans le paiement des sommes qui doivent être versées aux comptables de l’administration fiscale”. A 800-euro bill paid two months late therefore costs roughly 40 euros of surcharge plus a few euros of interest — small in absolute terms but recorded on the company’s tax account, which matters when you later need a tax compliance certificate (attestation de régularité fiscale) for a public contract, a visa file or a bank loan. Persistent non-payment leads to a formal notice (mise en demeure), then enforced recovery against the company’s French bank balance, even while the director lives abroad. The company, not the foreign shareholder personally, is the debtor, but a blocked French account quickly paralyses payroll, URSSAF (Unions de recouvrement des cotisations de sécurité sociale et d’allocations familiales, the social-security collection agencies) payments and supplier transfers.

If cash is tight in December — common for a first year — do not simply wait. Two remote routes exist before enforcement. First, request a payment plan (délai de paiement) from the SIE through the secure messaging of the business account, attaching a cash-flow forecast and proposing dated instalments; local accountants obtain these routinely for young companies. Second, where the company genuinely cannot pay because of hardship, the administration may grant grace: “L’administration peut accorder sur la demande du contribuable ; 1° Des remises totales ou partielles d’impôts directs régulièrement établis lorsque le contribuable est dans l’impossibilité de payer par suite de gêne ou d’indigence”. This remise gracieuse (discretionary relief) is separate from a legal challenge: it asks for mercy on a correctly assessed tax, must be reasoned with bank statements and management accounts, and can be filed online from abroad. It does not suspend the deadline by itself, so file early in December and pay what you can in the meantime. Keep every receipt: the first meeting with a French bank, a landlord or the URSSAF auditor starts with the question whether taxes are current.

Paris and Île-de-France specifics deserve a paragraph because most foreign founders register there. Paris votes one of the highest CFE rates in France, and the minimum base for higher turnover brackets is set at the top of the scale, so a domiciled SAS billing 200,000 euros pays noticeably more in Paris than the same company domiciled in a small town in Yvelines or Seine-Saint-Denis. The competent office is the SIE of the registered office’s arrondissement — Paris has several SIEs divided by arrondissement — and the notice shows which one. Deadlines and online procedures are national, but processing times in December are longer in Paris; file claims and payment-plan requests in late November rather than on 14 December. If the company also uses premises in La Défense, Boulogne or Saint-Denis, expect one CFE notice per commune, each with its own SIE contact. Domiciliation alone in Paris without any physical presence still triggers the Paris minimum; moving the registered office to a cheaper commune only affects future years and only if the transfer is published at the greffe and effective before 1 January.

B. Claim the Exemptions and Contest Errors Without Coming to France

Paying on time and challenging are not mutually exclusive: French tax procedure lets you pay the 15 December amount and then claim a reduction, with refund if you win. The order matters because a claim filed from abroad takes months, while penalties for non-payment accrue immediately. Pay first, claim in parallel.

Start with the three most common first-bill errors. First, the creation-year exemption missing: a company created in the same calendar year as the tax must owe nothing, and the first taxed year must show the halved base. Quote the assessment year against the Kbis creation date and the BODACC publication. Second, the wrong base: domiciliation taxed on a full office value, predecessor’s premises still attributed after a move, or cadastral value that does not match the lease. Attach the 1447-C-SD return, the domiciliation contract or lease, the departure inventory (état des lieux) and the new Kbis showing the updated address. Third, an unapplied temporary exemption: jeune entreprise innovante status, establishment in a qualifying zone, artisan exemption — attach the ruling, the zone map and the initial exemption request. Turnover under 5,000 euros with proof from the filed accounts is a fourth, simpler case. Each of these is a réclamation contentieuse (formal tax claim) to be filed in the business account under réclamer, addressed to the SIE shown on the notice, within the statutory claim period — generally 31 December of the second year following assessment for local taxes — setting out the facts, the legal basis and the exact discharge requested, with exhibits.

The legal doorway for the claim is broad. The procedure code states that “Les réclamations relatives aux impôts, contributions, droits, taxes, redevances, soultes et pénalités de toute nature, établis ou recouvrés par les agents de l’administration, relèvent de la juridiction contentieuse lorsqu’elles tendent à obtenir soit la réparation d’erreurs commises dans l’assiette ou le calcul des impositions, soit le bénéfice d’un droit résultant d’une disposition législative ou réglementaire.” In practice the founder writes in English or French — French is processed faster — identifying the tax, year, and SIE reference, stating for example that the base should have been halved under Article 1478 II or that the company had no premises in the commune on 1 January, and requesting full or partial discharge plus refund of the overpaid amount with interest. The administration has six months to answer; silence after six months counts as an implicit rejection that can be taken to the administrative court (tribunal administratif) within two further months. Every step can be done by the legal representative through the online account or by a French tax adviser or lawyer holding a simple power of attorney (mandat); no personal appearance is required at this stage. Keep the claim receipt, the acknowledgment and the proof of payment together: the court will ask for them.

Two French competitor pages cover the mechanics well and confirm this reading: the service-public English CFE sheet lists who pays, the December deadline and the online-only notice, while the Economy Ministry page adds the June advance, the 1447-C-SD initial return and the turnover-based exemptions — both agree that the declaration year drives the first bill and that the notice must be fetched online. Private French guides add useful calculators but sometimes conflate CFE with CVAE or present old rates; prefer the two official pages above and the statute for the deadline and the base. For founders, the actionable difference from those general pages is the cross-border handling: mandate wording in both languages, SEPA proof with the company’s name, and grouping the CFE file with the VAT, corporate tax and DSN (déclaration sociale nominative, the monthly payroll return) calendar so December does not become a missed-deadline cascade.

If the SIE rejects the claim or does not answer, the file moves to the tribunal administratif of the commune, still without travelling: the Télérecours platform accepts claims, exhibits and pleadings electronically, and hearings for small tax cases are often decided on the papers. Cite the exact statutory sentence relied upon, attach the Kbis, the lease or domiciliation contract, the 1447-C-SD return and the cadastral comparison, and quantify the reduction. Case law on rental values, such as Conseil d’État, 11 March 2021, No. 436628, Cofival, is useful only if the dispute truly concerns valuation methodology; most first-bill wins come from simpler facts — wrong year, wrong commune, missing halving — decided on Articles 1478, 1467 and 1473 alone. Do not mix the gracious request (hardship) and the contentious claim (legal error) in one letter: file the claim on legal grounds and, if needed, a separate short grace request for the undisputed remainder. Interest on the overpaid portion is refunded with the principal when the discharge is granted.

Conclusion

Your first CFE bill is not a mistake and not a sign that France taxes foreign founders more heavily: it is the normal local tax on doing business from French premises, assessed where the company sits on 1 January, on the rental value or on a turnover-based minimum, with no bill for the creation year and a halved base for the first taxed year. From abroad, the winning reflex is procedural: activate the professional account early, file the 1447-C-SD return in the creation year, download the November notice instead of waiting for post, pay by 15 December to freeze the 5% surcharge and monthly interest, then claim the halving, the exemption or the base correction online with the Kbis, the lease and the return as exhibits. Group the file with the company’s wider French calendar — corporate tax instalments, VAT returns and payroll filings — so the December deadline never arrives as a surprise. Handled this way, the CFE becomes what it should be for a young international business: a predictable, checkable local charge, not a cross-border dispute.

First CFE bill for your French company while you live abroad: who pays, how the rental-value base and halved first-year base work, paying by 15 December from abroad, and claiming or contesting online.

[80314,80313

post-2147368","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-decryptage","category-doing-business-in-france
<!-- This site is optimized with the Yoast SEO Premium plugin v28.2 (Yoast SEO v28.2) -
