The hire feels like a simple signature, but French employment law treats the first recruitment as a sequence of mandatory steps with strict deadlines. Miss the pre-hiring declaration, leave the trial period out of the written contract, choose a fixed-term contract for a permanent need, or pay the first salary without a compliant pay slip, and the contract is reclassified, the trial period is void, or the company faces back pay, damages and even criminal exposure for concealed work. Distance changes nothing: a foreign founder who employs in France carries exactly the same duties as a Paris-based employer.

This guide explains, in plain business English, how to sign your first French employment contract from abroad and how to pay and manage that employee afterwards. Part I covers the signature stage: the DPAE (déclaration préalable à l’embauche, the pre-hiring declaration filed with the social bodies), the written contract and its clauses, the lawful trial period and the narrow cases where a fixed-term contract is allowed. Part II covers life after signature: the pay slip, working time and overtime, the monthly DSN (déclaration sociale nominative, the online payroll return), the real cost of the hire, and how to end the trial period cleanly. Every decisive rule below is quoted from the statute or ruling that states it, so your file rests on verifiable law. Readers who are still at the incorporation stage will find the wider setup sequence, from capital deposit to VAT registration, in our foreign founder setup guide: bank account, Kbis, VAT and first hire.

I. How do I lawfully sign my first French employment contract from abroad?

French law does not let employment start with a handshake and a bank transfer. Before the employee’s first morning, the employer must declare the hire to the social system, and the contract itself must carry the clauses that make probation, working time and pay enforceable. The two most expensive mistakes foreign founders make at this stage are starting work before the declaration is filed and treating the trial period as automatic. Both are avoidable with a short checklist applied before day one.

A. Do I need a DPAE declaration and a written contract before my first hire starts?

Yes. No employee may start work until the employer has filed a nominative declaration with the designated social protection bodies. Article L. 1221-10 of the Labour Code states that “L’embauche d’un salarié ne peut intervenir qu’après déclaration nominative accomplie par l’employeur auprès des organismes de protection sociale désignés à cet effet” (Article L. 1221-10, Code du travail). In practice this DPAE is filed online with URSSAF (the French network of bodies that collect social contributions) before the employee’s first day, and it identifies the company, the employee and the hiring date. The declaration triggers affiliation, the employer’s account and the coming contribution calls. A founder living abroad files it exactly like a local employer, through the URSSAF online service, and keeps the acknowledgement of receipt in the hiring file: it is the first document an inspector asks for.

Skipping the DPAE is not a paperwork delay; the statute treats it as concealed work. Article L. 8221-5 of the Labour Code provides that “Est réputé travail dissimulé par dissimulation d’emploi salarié le fait pour tout employeur : 1° Soit de se soustraire intentionnellement à l’accomplissement de la formalité prévue à l’article L. 1221-10 , relatif à la déclaration préalable à l’embauche” (Article L. 8221-5, Code du travail). The same article extends the presumption to an employer who deliberately avoids issuing a pay slip or understates the hours shown on it. Concealed work exposes the company to back payment of contributions with penalties, a flat-rate indemnity to the employee equal to six months’ salary on termination, and criminal fines and imprisonment for the directing mind. The lesson is blunt: never let anyone work “a few days to try out” before the DPAE is filed. A genuine recruitment test before hiring belongs to a formal trial within a declared contract, not to undeclared days.

The written contract is the second shield. For a full-time permanent contract (CDI, contrat à durée indéterminée), French statute does not impose writing as a condition of validity in every case, but hiring without a written document is a litigation trap: hours, pay, duties, workplace and the applicable collective agreement (convention collective, the branch-level rulebook that often sets minimum pay, trial durations and notice) become one person’s word against another’s, and the trial period, which must be written to exist, simply does not exist. A CDD signed late, sent after the start date, or carrying a vague motive such as “business needs” is reclassified as a permanent contract from day one.

A first contract signed from abroad should therefore contain, at a minimum: the identity of the French employing company with its SIRET number (the establishment identification number issued at registration), the employee’s identity, the job title and qualification, the precise duties, the workplace and any mobility clause, the starting date, the weekly working time and its distribution, the gross salary and its pay date, the applicable collective agreement, the trial period with its exact duration and any renewal possibility, paid-leave rules, the notice periods after probation, and, for a CDD, the precise legal motive with the name and qualification of any replaced employee plus the end date or minimum duration. Both parties can sign electronically from different countries; what matters is that a complete signed copy exists before work starts and that the employee receives the information in a language understood. Many disputes from foreign-owned companies begin with an English offer letter promising one thing and a French contract stating another: align the two texts before signature, and state in the contract which version prevails in case of difference.

One practical point specific to foreign founders: the signatory must have authority to bind the French company. The president of a SAS (société par actions simplifiée, the flexible company form most foreign founders choose), the manager (gérant) of a SARL (société à responsabilité limitée, the limited liability company with stricter statutory rules), or a person holding a written delegation of hiring powers signs the contract. A contract signed by the foreign parent company rather than the French employer creates confusion about who the employer is, which the employee’s counsel will exploit at the labour court (conseil de prud’hommes, the elected court that hears employment disputes). Name the French company as employer, sign in the name of that company, and file the DPAE under that company’s URSSAF account.

B. How long can the trial period last and when is a fixed-term contract lawful?

The trial period (période d’essai) is the employer’s evaluation window and the employee’s symmetrical right to test the job. The statute defines its purpose in plain terms: “La période d’essai permet à l’employeur d’évaluer les compétences du salarié dans son travail, notamment au regard de son expérience, et au salarié d’apprécier si les fonctions occupées lui conviennent” (Article L. 1221-20, Code du travail). It is not a reduced-rights job: the employee is paid, declared, covered and entitled to the same protections, and either side may end the relationship during the trial without the dismissal procedure, subject only to the notice periods examined below.

Duration is capped by employee category. The applicable collective agreement frequently shortens these ceilings or sets its own scale, and it may also impose a minimum duration or specific formalities, so the branch text must be checked before drafting. Writing a five-month trial for a non-managerial employee, or copying a foreign template with a six-month probation, voids the excess: the employee is then deemed confirmed, and ending the relationship requires the full dismissal procedure with a real and serious cause.

The decisive drafting rule is that probation never goes without saying. A contract that says nothing about probation means no probation at all, even if the collective agreement allows one. Without an extended branch agreement authorising renewal, a renewed trial is void. With such an agreement, renewal still requires the employee’s clear agreement during the initial trial, and the total including renewal cannot exceed four months for workers and employees, six months for supervisors and technicians, and eight months for managers. A founder managing from abroad should calendar these dates personally: an assistant’s reminder buried in an inbox in another time zone has already cost many employers a deemed confirmation.

Fixed-term contracts deserve a separate warning because foreign founders use them as extended trials, which French law forbids. A CDD “ne peut être conclu que pour l’exécution d’une tâche précise et temporaire, et seulement dans les cas suivants” (Article L. 1242-2, Code du travail), namely replacing an absent or suspended employee, awaiting the arrival of a permanent recruit, facing a temporary increase in activity, filling seasonal jobs, or replacing the head of certain businesses, plus the special defined-purpose CDD for engineers and managers where a branch or company agreement provides for it. A permanent post with a stable workload can never lawfully be filled with back-to-back CDDs. The sanction is reclassification: “Est réputé à durée indéterminée tout contrat de travail conclu en méconnaissance des dispositions des articles L. 1242-1 à L. 1242-4” (Article L. 1245-1, Code du travail), which converts the relationship into a permanent contract with retroactive seniority, back pay for the gaps between contracts, and a reclassification indemnity in the cases the statute covers.

The Court of Cassation recently refined one corner of this regime. In other words, continuation past the term still converts the contract into a permanent one, but the specific reclassification indemnity is not added when conversion results only from that continuation. Employers should read this as a technical softening of one penalty, not as permission: the reclassified permanent contract, its seniority and the remaining claims stay fully on the table. The safe rule for a first hire with a lasting need remains the permanent contract with a written trial period, not a fixed-term contract used as a test.

II. How do I pay, declare and manage my first French employee from abroad?

Once the contract is signed, the company enters the monthly machinery of French payroll: a compliant pay slip every month, exact counting of hours and overtime, a single online social return, and contributions that make the real cost of employment significantly higher than the gross salary. Foreign founders often discover this cost structure with surprise at the first payroll run. Understanding each piece before the first pay date keeps the company compliant and the budget honest.

A. What must the first pay slip show and how do I count overtime?

Every salary payment must be documented. Article L. 3243-2 of the Labour Code provides that “Lors du paiement du salaire, l’employeur remet aux personnes mentionnées à l’article L. 3243-1 une pièce justificative dite bulletin de paie” (Article L. 3243-2, Code du travail). The pay slip (bulletin de paie) must show the employer’s identity, the employee’s identity and job classification, the pay period, the hours worked distinguishing standard and overtime hours, the gross salary, each social contribution with its base and rate, the net social amount, the income tax withheld at source (prélèvement à la source, the pay-as-you-earn withholding applied by the employer for the tax administration), and the net amount actually paid. Since 2017 the slip follows a simplified statutory model, and it may be issued electronically unless the employee objects, provided integrity, availability and confidentiality are guaranteed. For a founder abroad, the operational consequence is simple: do not pay the first salary by manual transfer with a spreadsheet summary. Use a French payroll provider (prestataire de paie) or compliant payroll software from month one, so the slip, the withholding and the declarations all match.

A pay slip proves what was itemised, not what was paid. The Social Chamber of the Court of Cassation confirmed this allocation of proof in April 2025, holding that “nonobstant la délivrance de la fiche de paie, l’employeur doit prouver le paiement du salaire” (Cass. soc., 29 April 2025, no. 24-13.894: full decision). In that case an employee claimed unpaid wages from the start of the relationship, and the lower court had dismissed her claim; the Court of Cassation quashed that reasoning, recalling that acceptance of a pay slip without protest never amounts to a waiver of salary claims and that the employer bears the burden of proving actual payment. Concretely, keep every bank transfer order matched to every pay slip, especially when paying from a foreign account or through a parent company: a transfer labelled “advance” or “loan” without payroll linkage invites the employee to claim the salary was never paid, and the company will have to prove the link.

Working time is the second pillar of the first payroll. The 25 % rate covers weekly hours 36 to 43, and the 50 % rate covers hour 44 onward, unless the branch agreement provides higher rates or compensatory rest instead. Overtime must appear distinctly on the pay slip, and the employer must be able to prove the hours actually worked: reliable time records (décomptes du temps de travail) are the employer’s best asset and their absence is routinely held against the company when the employee produces even approximate evidence of extra hours. Our analysis of overtime claims, time records and labour court proof, written for founders managing at a distance, complements this section: first employee overtime: 35-hour week, pay rates, time records and labour court risk.

Two further payroll points catch foreign employers by surprise. First, the national minimum wage (SMIC, salaire minimum interprofessionnel de croissance) and the applicable branch minimum both apply; the contract salary must satisfy the higher of the two, and the branch scale usually exceeds the SMIC for qualified posts. Second, salary is only part of the monthly file: bonuses, benefits in kind (avantage en nature, such as a company car or housing assessed on official scales), expense reimbursements and the overtime above must each be treated correctly in the contribution base. A flat monthly “package” wired from abroad with no breakdown cannot be booked as salary, cannot be declared in the DSN, and cannot be defended before URSSAF. Itemise everything, every month, from the very first pay run.

B. How much does the first employee really cost and how do I end the trial period cleanly?

The headline figure founders must absorb is that French employer social contributions add a heavy layer on top of gross salary. Contributions cover health insurance, basic and supplementary pensions, family allowances, unemployment insurance, workplace accidents and occupational illness, the autonomy solidarity contribution and various smaller levies, each with its own base, rate and ceiling, and they are collected by URSSAF on the basis of the employer’s monthly return. As a working assumption for budgeting, total employer charges commonly represent around four to five tenths of gross salary for ordinary pay levels, with targeted reductions for low wages softening the bottom of the scale; the exact burden depends on the salary, the company’s size and sector, the accident rate and the branch rules. Commission a written payroll simulation (simulation du coût employeur) before signing: it converts a candidate’s gross-salary demand into the true monthly and annual employer cost, including the thirteenth month or contractual bonuses, paid-leave accrual, the employer’s share of supplementary health cover (mutuelle, the compulsory top-up health insurance the employer must offer and co-finance) and the year-end adjustments. Hiring on a gross figure that ignores these layers is how a comfortable budget becomes a loss-making post within one quarter.

The vehicle for declaring all of this is the DSN, the single monthly return every employer files online. The DSN carries hires, departures, suspensions, contract changes, pay amounts, contribution bases and working time to URSSAF, the tax administration and the social bodies in one flow, and it must be filed by the statutory deadline each month with payment of the contributions. Late, missing or inconsistent DSNs trigger penalties and interest, and they are the documentary basis of every later URSSAF audit (contrôle URSSAF): the inspector reconciles the DSN lines with the pay slips, the contracts and the bank movements. Foreign founders should give their payroll provider a direct mandate and verify each month that the DSN receipt (compte rendu) shows accepted status, rather than discovering two years later that a mailbox nobody monitored received the warnings. Readers facing an audit will find the procedure, the assessment and the remedies described step by step in our URSSAF audit guide: control, assessment, penalties and how to challenge from abroad.

Ending the trial period is where remote management most often slips. When the employer takes the initiative, the statute imposes a graduated notice (délai de prévenance): “le salarié est prévenu dans un délai qui ne peut être inférieur à : 1° Vingt-quatre heures en deçà de huit jours de présence ; 2° Quarante-huit heures entre huit jours et un mois de présence ; 3° Deux semaines après un mois de présence ; 4° Un mois après trois mois de présence” (Article L. 1221-25, Code du travail). The notice does not extend the trial: “La période d’essai, renouvellement inclus, ne peut être prolongée du fait de la durée du délai de prévenance.” If the notice is not observed, “son inexécution ouvre droit pour le salarié, sauf s’il a commis une faute grave, à une indemnité compensatrice”, equal to the wages and benefits the employee would have received through the end of the notice, including compensatory paid leave. In practice, decide early: calendar the trial end date on signature day, assess at two-thirds of the period, and notify in writing with proof of delivery. Discovering from another continent that the trial expired yesterday turns a simple goodbye into a confirmed employment relationship that can only be ended through the dismissal procedure.

No procedure, no severance and no notice indemnity beyond the days worked, but the departure must still be recorded: final pay slip, final DSN with the departure date, work certificate (certificat de travail), payslip-summary attestation for the unemployment body and closing balance (solde de tout compte) paid and receipted. Deliver these documents even when the separation is amicable; a missing certificate is a standalone damages claim at the labour court.

Once the trial is passed, the relationship enters ordinary dismissal law: ending it requires a real and serious cause (cause réelle et sérieuse), a formal invitation to a preliminary meeting, the meeting itself, a reasoned notification letter observing minimum waiting periods, and the full set of departure documents and indemnities. Our step-by-step guide to dismissing for personal reasons from abroad, including performance files and notice traps, takes over exactly where this article stops: dismissing an employee for personal reasons while living abroad. One boundary must stay clear in every founder’s mind: breaking off a trial for a discriminatory reason, for retaliation, or because of pregnancy or a protected status is unlawful even during probation, and courts award damages beyond the notice indemnity. Assess skills, document facts, notify on time, and never put a non-professional reason in writing.

Conclusion

Hiring a first employee in France from abroad succeeds when the founder treats recruitment as a dated procedure rather than a single signature. Before day one, file the DPAE and sign a complete written contract that names the French employer, states the exact duties, pay, hours and collective agreement, and expressly sets the trial period within the statutory ceilings. Choose the contract type honestly: a permanent contract with a written trial for lasting needs, a fixed-term contract only for a precise and temporary statutory case with its motive spelled out, on pain of reclassification into a permanent contract. After signature, run compliant monthly payroll from the first month: an itemised pay slip for every payment with proof of the transfer behind it, exact recording and enhanced payment of overtime, and a DSN filed and paid on time that matches the contracts and the bank. Calendar the trial period on the day of signature and end it, if needed, with the correct notice on each side. Each of these steps is a short administrative gesture; together they are the difference between a hire that builds the business and a file that feeds the labour court. Keep the DPAE receipt, the signed contract, every pay slip with its transfer proof, every DSN acceptance and every trial notice in one hiring file, and the distance between the founder’s desk and the employee’s workplace stops being a legal risk.

First hire in France from abroad: DPAE before day one, written CDI clauses, lawful trial periods, pay slips, DSN and the true employer cost explained.

[80314,80313

post-2147314","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-decryptage","category-doing-business-in-france
<!-- This site is optimized with the Yoast SEO Premium plugin v28.2 (Yoast SEO v28.2) -
