Since Brexit, you cannot simply arrive with a laptop and start invoicing. Self-employment in France sits at the crossing of three systems that do not talk to each other: immigration law decides whether you may work for yourself, the business register decides whether your activity legally exists, and the tax and social security systems decide what you owe once money comes in. A failure in any one of them can undo the other two. The most common pattern this firm sees is painfully predictable: the business is registered, clients pay, and then a letter arrives — a refusal from the prefecture (the local office of the French state that issues residence permits), an order to leave France within thirty days, or a social security bill that bears no resemblance to what you thought the flat-rate scheme would cost.

This guide explains, in order, how a British citizen lawfully becomes a freelancer in France after Brexit, how the simplified tax and contribution regimes actually work, and how to challenge the four decisions that most often go wrong: refusal of the residence permit, the accompanying order to leave, the URSSAF bill (URSSAF being the network of agencies that collects social security contributions), and reclassification of your freelance contracts as disguised employment. Each section gives you the exact legal test the administration applies, so you can build your file the way a court will read it.

I. How a Briton Gets the Right to Freelance in France After Brexit

A. Which French residence permit allows self-employment, and what the prefecture really checks

Since Brexit ended freedom of movement, a British citizen who wants to live and work for themselves in France needs a residence permit that expressly authorises self-employed activity. The permit that matters is the carte de séjour temporaire portant la mention “entrepreneur/profession libérale” — the temporary residence card marked “entrepreneur/self-employed professional”. The general residence route for newcomers, including which long-stay visa to apply for before you travel and how refusals and removal orders are challenged, is described in our guide for British newcomers on French visas, residence cards, refusals and removal orders; what follows is the self-employment layer that sits on top of that route.

The legal test is set by Article L. 421-5 of the Code de l’entrée et du séjour des étrangers et du droit d’asile (the Code on the entry and residence of foreign nationals, known as the CESEDA): “L’étranger qui exerce une activité non salariée, économiquement viable et dont il tire des moyens d’existence suffisants, dans le respect de la législation en vigueur, se voit délivrer une carte de séjour temporaire portant la mention ” entrepreneur/ profession libérale ” d’une durée maximale d’un an.” Three conditions, and the prefecture checks all three: a genuine non-salaried activity, economic viability, and sufficient means of subsistence earned from it, in compliance with the legislation in force. A stack of client promises is not viability. What persuades is a business plan with priced services, signed letters of intent or first contracts, evidence of qualifications or professional experience, and projected accounts showing that the activity can support you within the first year.

Once the temporary card has been held, the Code organises the move to a multi-year card. Anyone switching from another status — a visitor card, for example — passes through the one-year card before reaching the multi-year one.

The refusal cases show exactly where files fail. In a judgment that is now a textbook illustration, the cour administrative d’appel (the administrative court of appeal) of Lyon ruled on 27 November 2024, case no. 23LY03296, on a challenge to an order of 17 March 2023 by which the préfet de la Loire (the prefect of the Loire département) had refused an entrepreneur/self-employed card, ordered its holder to leave France within thirty days, and fixed the country of removal. The tribunal administratif (the first-instance administrative court) of Lyon had rejected the challenge by judgment no. 2303288 of 26 September 2023; the appeal, lodged on 23 October 2023, asked the court to annul both the judgment and the prefectural order and to order the prefect to issue the card, principally a multi-year card, in the alternative a temporary card, within one month under a penalty of 100 euros per day of delay — and the court dismissed the whole application: “Article 1er : La requête de M. A… est rejetée.” The lesson for a British freelancer is direct. The court begins, as courts always do in this field, by reciting the statute — “Aux termes de l’article L. 421-5 du code de l’entrée et du séjour des étrangers et du droit d’asile” — and then measures the file against each word of it. Viability and sufficient means are assessed on evidence, not on assertions, and a refusal routinely arrives stapled to an obligation to leave France. Because the two travel together, a refusal must be challenged immediately before the tribunal administratif, asking both for annulment of the refusal and, where needed, for an injunction ordering re-examination or issue of the card, with emergency interim relief to suspend the removal order while the case is heard.

A refusal is frequently accompanied by an obligation de quitter le territoire français, universally shortened to OQTF — the formal order to leave France. Article L. 611-1 of the CESEDA opens with the empowering words: “L’autorité administrative peut obliger un étranger à quitter le territoire français lorsqu’il se trouve dans les cas suivants”, followed by the listed cases, which include remaining in France without a valid residence permit. The Lyon case is typical: refusal plus a thirty-day order to leave plus designation of the country of removal. Never treat the OQTF as background noise to the refusal. It carries its own deadline and its own remedy, and missing it can make even a winning challenge to the refusal practically useless.

B. Registering the micro-entreprise on the single portal and joining the French social security system

The residence permit is only half the permission. The activity itself must be registered, and since 2023 that happens through the guichet unique — literally the “single counter”, the online portal for business formalities that replaced the old network of separate centres. The official Service Public guidance structures the creation of a micro-entreprise (the simplified sole-trader regime, still widely called auto-entrepreneur after the name of its original scheme) as a sequence: prepare the project, arrange finance, complete the preliminary steps, choose the business name, fix the business address (domiciliation), protect personal assets, and then register the micro-entreprise, with the Guichet des formalités des entreprises as the gateway. Registration produces your SIREN and SIRET numbers — the national business identifiers, the first for the business itself and the second for each business premises — and only from that point does the activity legally exist for the tax office and the social security bodies.

Registration automatically brings affiliation to the social security system for the self-employed. The statute that organises this is Article L. 613-1 of the Code de la sécurité sociale (the Social Security Code), and the base on which ordinary self-employed contributions are calculated is set by Article L. 131-6 of the same Code, which makes professional income the assessment base. A micro-entrepreneur, however, normally opts for the micro-social scheme, whose mechanism is worth understanding precisely because it is so often misunderstood. Contributions are therefore calculated each month or quarter by applying a single overall rate, fixed by government decree for each category of activity, to the turnover or receipts actually collected in the previous month or quarter. No turnover means no contributions for the period, but the mirror rule catches many newcomers: the rate applies to gross receipts, with no deduction for expenses, so a consultant with heavy subcontracting costs can pay contributions on money that was never really theirs.

Turnover is declared online on the autoentrepreneur.urssaf.fr portal, monthly or quarterly according to the option chosen at registration. URSSAF itself needs a word of explanation: the name covers the unions de recouvrement des cotisations de sécurité sociale et d’allocations familiales — the collection agencies for social security and family allowance contributions — operating under the national body. Every declaration generates a payment call, and every payment call missed generates reminders, surcharges, and eventually a contrainte — the enforceable recovery order that opens the road to seizure. Keep every declaration receipt and every bank proof, because in a dispute the burden of showing what was declared and paid falls squarely on you.

Registration also opens healthcare cover. Article L. 160-1 of the Social Security Code, the foundation of the Protection Universelle Maladie (universally shortened to PUMA — the universal public healthcare system), provides: “Toute personne travaillant ou, lorsqu’elle n’exerce pas d’activité professionnelle, résidant en France de manière stable et régulière bénéficie, en cas de maladie ou de maternité, de la prise en charge de ses frais de santé dans les conditions fixées au présent livre.” Anyone working in France is therefore covered for health and maternity costs once affiliated and contributing. A working British freelancer does not depend on an S1 healthcare certificate from the United Kingdom; affiliation flows from the registered professional activity itself. That distinction matters because the S1 route belongs to pensioners and posted workers, while yours runs through URSSAF.

Two day-to-day duties complete the picture. First, the tax rules for the simplified regime require proper records: as will be seen below, the micro-BNC regime obliges you to keep a daily statement of professional receipts showing, for every fee, the client identity as declared, the amount, the date and the method of payment, and to produce it on request. Second, many freelance activities are regulated — estate agents, architects, financial advisers, health-related coaches — and exercising a regulated activity without the required qualification or registration is both a criminal matter and, for residence purposes, a failure of the “in compliance with the legislation in force” condition of Article L. 421-5. Check regulation before you register, not after the prefecture asks.

II. Paying Tax and Contributions Correctly, and Challenging URSSAF Bills and Refusals

A. Where a British freelancer is taxed and what the simplified regimes really cost

The first tax question is not how much, but where. A British freelancer who settles their home in France, or who carries on a non-ancillary professional activity there, is fiscally domiciled in France and taxable there on worldwide income, subject to the France–United Kingdom double tax convention and to United Kingdom rules on the British side for any United Kingdom-source income. The folk rule about spending fewer than 183 days in France is only one indicator among others; the home and the professional activity are independent tests, and either one can be enough. Before structuring anything around days of presence, read the treaty position and the official guidance of both countries — including the United Kingdom government’s Living in France guidance — rather than relying on summaries.

For income tax, most British freelancers — consultants, designers, developers, translators, coaches — fall under the micro-BNC regime, BNC standing for bénéfices non commerciaux (non-commercial profits, the category for liberal and service professions). Taxable profit is therefore gross annual receipts minus a flat 34 per cent allowance, with a floor of 305 euros, provided turnover excluding tax did not exceed 83,600 euros in the previous or penultimate year. Three practical points follow. First, the allowance is fixed: if your real expenses exceed 34 per cent of receipts — common for contractors who subcontract, rent studios or travel heavily — the simplified regime over-taxes you, and the Code allows an opt-out: “Les contribuables qui souhaitent renoncer au bénéfice du présent article peuvent opter pour le régime visé à l’article 97”, an option exercisable yearly with the return deadlines. Second, capital gains on business assets are dealt with separately and do not benefit from the allowance. Third, bookkeeping is lighter but not absent: “Les contribuables visés au 1 portent directement sur la déclaration prévue à l’article 170 le montant des recettes annuelles”, and they must keep, and produce on demand, “un document donnant le détail journalier de leurs recettes professionnelles” showing “l’identité déclarée par le client ainsi que le montant, la date et la forme du versement des honoraires”. Declare gross receipts on the annual return, keep the daily log, and you remove the two most frequent triggers for reassessment.

On the social security side, the cost logic differs from tax logic and the two should never be confused. Income tax under micro-BNC applies a 34 per cent allowance to receipts; social contributions under the micro-social scheme apply the decree-fixed overall rate to gross receipts with no allowance at all. A freelancer whose real margin is thin can therefore owe very little income tax and still face a painful URSSAF call for the same quarter. Model both before setting your day rate, and remember that the overall rate varies by category of activity — services, sales, regulated liberal professions — because the decree fixes one rate per category. The official thresholds, rates and category tables change regularly; always verify the current figures on the official portals at the time you invoice, and keep dated screenshots of the pages you relied on.

Finally, keep the two countries’ claims analytically separate. France taxes on the domicile and activity tests quoted above; the United Kingdom taxes on its own residence and source rules; the double tax convention allocates and relieves. British-source income that France also taxes — United Kingdom rental income is the classic example — is relieved in France by the treaty mechanism, not by omitting it from the French return. Declare everything in France, claim relief where the treaty gives it, and keep the United Kingdom paperwork that proves the tax already paid. Undeclared foreign income, once detected through automatic exchange of information, produces not only the tax but penalties that dwarf the original bill.

B. How to challenge a refusal, a removal order, a URSSAF bill or a reclassification as an employee

When the prefecture refuses the entrepreneur card, speed matters more than eloquence. The refusal and the accompanying OQTF each carry short challenge deadlines stated on the documents themselves, and the removal order can in principle be enforced while you argue about the refusal. File an annulment application (recours en annulation) before the tribunal administratif against both the refusal and the removal order, setting out condition by condition — real activity, viability, sufficient means, legal compliance — with fresh evidence attached for each, and ask the court to order the prefect to issue the card or at least to re-examine the file. Where removal is imminent, add an emergency interim application asking the judge to suspend enforcement pending judgment. The Lyon precedent described above shows the anatomy courts expect: first-instance judgment, appeal to the cour administrative d’appel, a reasoned measurement of the file against Articles L. 421-5 and L. 421-6, and, for the applicant who wants more than annulment, a request for an injunction with a daily penalty for delay. Mirror that anatomy in your own application, and never let the OQTF deadline pass while you gather documents for the refusal challenge — lodge first, complete afterwards.

URSSAF disputes follow a different track but the same discipline: read the document, diary the deadline printed on it, and respond in writing. A mise en demeure (formal demand) invites payment or written observations; a contrainte is an enforceable order that must be opposed before the court stated on it within the stated time, with your declaration receipts and bank statements attached. The most winnable URSSAF cases this firm sees are not about rates at all: turnover declared in the wrong quarter, receipts counted twice after a correction, employed income wrongly affiliated as self-employed income, or contributions claimed for a period before registration or after deregistration. Each of these is proved by documents, not by argument, which is why the declaration receipts and the daily receipts log mentioned earlier are worth more than any letter. Where the debt itself is correct but unpayable at once, ask in writing for a payment schedule before enforcement starts; collectors can discuss timing, but they rarely discuss arithmetic once the contrainte is issued.

The fourth risk is reclassification — redressement through requalification, where URSSAF or a court decides that the “freelancer” was really an employee of a single client. The starting point favours the registered self-employed: Article L. 8221-6 of the Code du travail (the Labour Code) provides that “Sont présumés ne pas être liés avec le donneur d’ordre par un contrat de travail dans l’exécution de l’activité donnant lieu à immatriculation ou inscription : 1° Les personnes physiques immatriculées au registre du commerce et des sociétés, au registre national des entreprises en tant qu’entreprise du secteur des métiers et de l’artisanat, au registre des agents commerciaux ou auprès des unions de recouvrement des cotisations de sécurité sociale et d’allocations familiales pour le recouvrement des cotisations d’allocations familiales”, before adding the decisive reservation: “L’existence d’un contrat de travail peut toutefois être établie lorsque les personnes mentionnées au I fournissent directement ou par une personne interposée des prestations à un donneur d’ordre dans des conditions qui les placent dans un lien de subordination juridique permanente à l’égard de celui-ci.” Registration creates a presumption of self-employment; permanent legal subordination to one client destroys it.

The test for that subordination was restated with unusual clarity by the Cour de cassation (the supreme court for civil and criminal matters), Chambre sociale (the labour division), on 28 November 2018 in case no. 17-20.079, concerning a bicycle courier engaged through the Take Eat Easy platform who sought reclassification of the relationship. Neither the label the parties chose nor their stated wishes decide; only the factual conditions of the work count, and subordination means working under an authority that can give orders and instructions, supervise performance and punish failures. A British freelancer with one United Kingdom or French client dictating hours, processes and availability, monitoring performance through required tools, and penalising unavailability, sits squarely in the danger zone whatever the contract is called. The protections are practical and should be built in from day one: several genuinely independent clients, your own methods and timetable, your own equipment, the right to send a substitute where the work allows, no exclusivity, and no integration into the client’s hierarchy, rotas or disciplinary systems. If more than half your income depends on one client who controls how you work, renegotiate the relationship before URSSAF or a prud’homal claim does it for you.

One closing procedural warning covers all four disputes. French time limits are short, written procedure dominates, and the court reads the file, not the story. Keep every prefectural receipt (récépissé), every URSSAF declaration acknowledgment, every contract and invoice, and every proof of payment, in chronological order, in both paper and digital form. When a deadline is stated in days, count from notification, diary the expiry, and file early: late challenges in residence and social security matters are almost never forgiven.

Conclusion

A British freelancer can thrive in France after Brexit, but only by satisfying three masters in the right order. First, earn the right to work for yourself: meet the viability and means test of Article L. 421-5, move through the one-year card to the multi-year card under Article L. 421-6, and treat any refusal and any accompanying removal order as urgent litigation, on the Lyon model, not as correspondence. Second, give the business a legal existence on the single portal, declare honestly on the URSSAF platform, and understand that the micro-social rate bites into gross receipts while the micro-BNC allowance softens only the tax side. Third, keep the paper that proves each position: the daily receipts log, the declaration acknowledgments, the contracts showing genuine independence from each client. Do that, and the three systems line up behind you; neglect any one of them, and it will eventually summon the other two.

British consultant, designer or contractor moving to France after Brexit: which residence permit allows self-employment, how the auto-entrepreneur and URSSAF system works, where you pay tax, and how to challenge a prefectural refusal, a removal order or a reassessment.

[80312,80314

post-2145345","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-british-desk","category-decryptage
<!-- This site is optimized with the Yoast SEO Premium plugin v28.2 (Yoast SEO v28.2) -
