Since Brexit, the answer for British State Pension holders rests on two pillars that many newcomers confuse. The first is the S1 healthcare certificate, a paper form issued by the United Kingdom which, once registered with your local health fund in France, moves the bill for your French treatment to London while you are treated like a French patient. The second is the French universal residence-based system, known as PUMA (Protection universelle maladie, the French universal health cover), which protects people who live in France in a stable and lawful way even when no S1 covers them. In both cases the competent state logic is identical: the country that pays your pension carries the cost of your healthcare, while the country where you live delivers the treatment. For a British State Pension holder with no French pension, the competent state for healthcare costs remains the United Kingdom, and France treats you through your registered S1. If you also draw a French pension, even a small one earned during a few years of salaried work in France, competence normally passes to France and you join French cover in your own right rather than through a British S1. Sorting out that single question first saves most of the disputes described below.<\/p>\n<h3>A. The same guidance explains that registered holders and their dependants then access healthcare on the same basis as French citizens. Those two sentences describe the whole mechanism: registration first, equal treatment second, British funding behind the scenes. In ordinary language, a British pensioner whose healthcare costs belong to the United Kingdom under a European regulation or an international agreement is not pushed into the French residence-based system as well; the S1 is the document that proves that allocation of cost. That is why CPAM staff ask S1 holders for a different set of papers from PUMA applicants, and why registering under the wrong route is one of the most common sources of refusal letters. If you hold a British S1, do not file a standard PUMA application as an inactive resident; file the S1 registration, and keep a copy of everything you hand over.<\/p>\n<p>Eligibility for the S1 follows a predictable pattern. Recipients of the UK State Pension who live in France are the core group. Certain posted workers, frontier workers and their dependants can also carry an S1 during their posting, and each dependant family member residing with you in France is covered once the form is registered. The form itself is issued in the United Kingdom by the Overseas Healthcare Services, which sits within the NHS Business Services Authority; applications are made from the United Kingdom before the move or shortly after arrival, and processing commonly takes several weeks, so experienced advisers apply as soon as the pension award letter arrives rather than waiting for the French lease to start. The S1 usually arrives as a paper original with several copies: one stays with you, the others go to the CPAM. Never post your only original without keeping a certified copy and a photograph of each page, because a lost S1 is the slowest file to reconstruct.<\/p>\n<p>Registration at the CPAM follows a fixed ritual. You attend, in person or increasingly through the online ameli account once opened, with the S1 original, your passport, your British birth certificate with a sworn translation where the clerk requires one, your residence permit or Withdrawal Agreement card for those who hold one, proof of address in France less than six months old, your pension award letter, and your bank details (relev\u00e9 d&#8217;identit\u00e9 bancaire, the French bank identity slip used for reimbursements). The clerk records you as a pensioner whose competent state is the United Kingdom, opens your rights, and in time orders your carte Vitale. Between registration and the arrival of the card, which still takes several months in many d\u00e9partements, you work with paper attestations of rights (attestation de droits) and the old-style treatment forms (feuilles de soins) that the surgery stamps when you cannot present the chip card. Declare a m\u00e9decin traitant, your nominated regular GP, as soon as you can: without that declaration, reimbursement rates for specialist consultations fall, and the shortfall is the part patients notice first. Once registered, day-to-day treatment works exactly as for French neighbours: you pay the surgery, the fund reimburses its share within days to your French bank account, and your top-up insurance, if you hold one, settles the balance.<\/p>\n<p>Two misunderstandings about travel documents cause recurring trouble and deserve a clear answer. First, the S1 is not a travel document; it organises your everyday healthcare where you live. For temporary stays elsewhere, you carry a separate card: the European Health Insurance Card or the Global Health Insurance Card issued by the United Kingdom. Keep the two functions apart in your file and in your head: the S1 for residence in France, the travel card for holidays and family visits. Second, dependants need their own registration step. A spouse or civil partner and minor children residing with you in France are covered through your S1, but each of them must be individually recorded at the CPAM with their own identity papers; a CPAM letter that names only the pension holder does not yet prove the spouse&#8217;s cover. When the whole household appears on the attestation de droits, the family file is complete, and later disputes about a spouse&#8217;s treatment bills become far easier to answer.<\/p>\n<h3>B. Stable means your home or main place of stay is in France; lawful means your residence papers are in order for the period you claim. The companion provision, <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000033714770\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000033714770\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">article L. 160-5 of the Social Security Code<\/a>, gives the procedure: &#8220;Toute personne qui d\u00e9clare aupr\u00e8s d&#8217;une caisse primaire d&#8217;assurance maladie, dans des conditions fix\u00e9es par d\u00e9cret, ne pas b\u00e9n\u00e9ficier de la prise en charge des frais de sant\u00e9 mentionn\u00e9e \u00e0 l&#8217; article L. 160-1 b\u00e9n\u00e9ficie de cette prise en charge aupr\u00e8s de cette caisse d\u00e8s qu&#8217;elle justifie de son identit\u00e9 et de sa r\u00e9sidence stable et r\u00e9guli\u00e8re.&#8221; In practice, you walk into the CPAM and declare that no other system covers you, and cover starts once identity and stable, lawful residence are shown. The setting for the regularity condition is completed by <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000031686322\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000031686322\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">article L. 111-2-3 of the Social Security Code<\/a>, which leaves the detailed assessment of stability and lawfulness of stay to regulation, so the decrees and the CPAM circulars matter as much as the statute in daily files.<\/p>\n<p>The regulation that decides most British PUMA files is <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000049451865\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000049451865\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">article R. 111-2 of the Social Security Code<\/a>. It treats as stably resident anyone whose home or principal place of stay sits in metropolitan France or the listed overseas collectivities, and it organises proof around duration of presence: &#8220;Pendant plus de six mois au cours de l&#8217;ann\u00e9e civile de versement pour les autres prestations mentionn\u00e9es au premier alin\u00e9a.&#8221; Health cover belongs to that six-month group, while family and old-age benefits sit in a stricter nine-month group. Alongside duration, CPAM offices in practice require three months of continuous presence before opening PUMA rights for newcomers, a rule derived from the implementing decree for article L. 160-5; the refusal letters that cite a stay of a few weeks almost always rest on that three-month expectation. The same article closes with the sentence that wins the most appeals: &#8220;La r\u00e9sidence en France peut \u00eatre prouv\u00e9e par tout moyen.&#8221; Rents receipts, utility bills, tax notices, school certificates, bank statements showing daily life in France, travel records showing absence dates: no single paper is compulsory, and a refusal that demands one specific document to the exclusion of all others misreads the text. British applicants should therefore file a bundle, not a single proof: lease or title deed, three consecutive months of electricity, gas or internet bills, home insurance certificate, French bank statements, and the passport pages that fix entry and absence dates.<\/p>\n<p>The courts police exactly this point. In a judgment of 3 June 2021, the Second Civil Chamber of the Court of Cassation examined a CPAM refusal grounded on the three-month continuous presence rule and the family-reunification exception to it; the Court <a href=\"https:\/\/www.courdecassation.fr\/decision\/60b8701b7418a41b2a7fcb51\">rejected the appeal in case 20-10.687<\/a>, its operative words being &#8220;REJETTE le pourvoi.&#8221; The file failed because the applicant could not bring her situation within the pleaded exception, not because the principle of residence-based affiliation was doubted. The lesson for British readers is practical rather than discouraging: where your presence is genuine, prove it with overlapping documents across the full three months, and where you rely on an exception or a special status, name it and evidence it from the first letter. A thin file invites a standard refusal; a thick, dated, consistent file forces the fund to engage with the actual legal test. Applicants who arrived recently under a long-stay visa should add their visa, their entry stamp, their OFII or prefecture registration, and any r\u00e9c\u00e9piss\u00e9, because the regularity branch of the test is examined alongside the stability branch from the first appointment.<\/p>\n<p>Three sub-groups of British readers need to locate themselves correctly before filing. The second is the dual pensioner who draws both a British and a French pension: France is normally competent, the S1 route closes, and PUMA-equivalent affiliation in your own French right opens, with contributions organised around French pension status rather than British funding. The third is the pensioner couple where only one spouse has reached pension age: the pensioner registers the S1 and asks for the younger spouse and children to be recorded as dependants where the coordination rules allow it, while the younger spouse who works in France joins through employment and whose who does not work checks dependant status before filing a separate PUMA claim. Filing the whole household under one label without distinguishing these positions is how families end up half-covered, with one member reimbursed and another billed in full for the same treatment.<\/p>\n<h2>II. What You Pay, What You Keep When You Travel, and How to Put a Wrong Decision Right<\/h2>\n<p>Once cover is open, three financial questions dominate British files: do I owe the yearly CSM levy, do I need top-up insurance, and what happens when treatment takes place outside France. The answers differ sharply between S1 holders and PUMA members, which is why the first part of this article insisted on choosing the right route before discussing money. The paragraphs below take each cost in turn, then give the procedure for challenging the two decisions British pensioners contest most often: the CPAM refusal of registration or reimbursement, and the wrongful demand for the CSM levy.<\/p>\n<h3>A. What an S1 Changes for Contributions, Top-Up Cover and Planned Treatment in Another Country<\/h3>\n<p>Start with the levy that worries inactive residents most. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000037947779\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000037947779\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article L. 380-2 of the Social Security Code<\/a> opens with a cautious sentence: &#8220;Les personnes mentionn\u00e9es \u00e0 l&#8217;article L. 160-1 sont redevables d&#8217;une cotisation annuelle lorsqu&#8217;elles remplissent les conditions suivantes&#8221;. The conditions that follow are cumulative, and the second one protects pensioners directly: &#8220;Elles n&#8217;ont per\u00e7u ni pension de retraite ou d&#8217;invalidit\u00e9, ni rente, ni aucun montant d&#8217;allocation de ch\u00f4mage au cours de l&#8217;ann\u00e9e consid\u00e9r\u00e9e.&#8221; A person who drew a retirement or invalidity pension, an annuity pension payment, or any unemployment benefit during the year concerned is outside the levy for that year, and the same exclusion extends to the other member of the couple where relevant. A British State Pension holder therefore does not owe the CSM for any year in which the British pension was paid, whether cover runs through a registered S1 or through French affiliation as a pensioner. The levy remains a live issue only for the economically inactive resident who genuinely drew no pension, no annuity and no unemployment benefit in the year: typically the early retiree living on capital, rental income or savings, for whom the base is capital income and gains as defined by reference to article 1417, IV of the General Tax Code, after an abatement fixed by decree and within a ceiling fixed by decree, collected the following year by the URSSAF, the network of contribution collection bodies. Where a demand arrives addressed to a pensioner, the first pleading is therefore factual and short: attach the pension award letter and the bank statements showing payment for the year, cite the pension exclusion, and ask for discharge.<\/p>\n<p>The two leading judgments on the CSM confirm that its legal basis must be examined year by year and text by text. On 18 March 2021 the Second Civil Chamber <a href=\"https:\/\/www.courdecassation.fr\/decision\/6054bea170526d97cf3cc686\">quashed the Cr\u00e9teil judgment in case 19-25.792<\/a>, holding &#8220;CASSE ET ANNULE, en toutes ses dispositions, le jugement rendu le 17 octobre 2019, entre les parties, par le tribunal de grande instance de Cr\u00e9teil&#8221;. Six weeks earlier, on 28 January 2021, the same Chamber had <a href=\"https:\/\/www.courdecassation.fr\/decision\/601427b4d881275fcb354465\">quashed the parallel Cr\u00e9teil judgment in case 19-25.853<\/a> in identical terms. Both cases concerned calls issued in December 2017 for the 2016 CSM, in the first year of PUMA, when the statute of 21 December 2015, its completing decree of 19 July 2016 and the collection decree of 3 May 2017 overlapped; the lower courts had annulled the calls on timing and implementing-text grounds, and the Court of Cassation sent the cases back for re-examination under the correct articulation of statute and decree. British readers should not read these old timing disputes as an exemption from the levy in general; their present value is methodological. Every CSM demand must state the year concerned, the statute and decree it rests on, and the base it taxes; a demand that taxes a year in which you drew a pension, or that applies the wrong year&#8217;s machinery, is challengeable on the face of the papers, and the two 2021 rulings are the authority that forces the collection body to answer on the texts rather than on generalities.<\/p>\n<p>Next, the part of French medical costs that no registration removes. French state cover reimburses a share of each treatment, not the whole bill: roughly seven tenths for many consultations, with different rates for pharmacy lines, dentistry, optics and hospital stays, plus fixed flat-rate sums that stay with the patient. The balance, known as the ticket mod\u00e9rateur, plus any excess fees charged by practitioners who charge fees above the statutory tariff (d\u00e9passements d&#8217;honoraires), remains yours unless top-up insurance absorbs it. The British guidance makes the same point for S1 holders, noting that they can also take top-up insurance known as a mutuelle. A mutuelle is a non-profit top-up insurer; a commercial compl\u00e9mentaire sant\u00e9 does the same job in company form. For pensioners on modest incomes, a further device exists: <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000037950247\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000037950247\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">article L. 861-1 of the Social Security Code<\/a> provides that &#8220;Les personnes mentionn\u00e9es \u00e0 l&#8217;article L. 160-1 ont droit \u00e0 une protection compl\u00e9mentaire en mati\u00e8re de sant\u00e9 dans les conditions suivantes&#8221;, with no or reduced financial participation below resource ceilings revised each April. The Compl\u00e9mentaire sant\u00e9 solidaire, the means-tested public top-up, is therefore worth checking for single pensioners and widows whose only income is the British pension and a small rental surplus. Hospitalisation needs separate attention: declare your mutuelle at admission, carry the attestation de droits alongside the carte Vitale, and confirm that the establishment bills the fund directly (tiers payant) where offered, because advances for a hospital stay are the sums that hurt most when paperwork lags.<\/p>\n<p>Treatment outside France follows coordination rules rather than French domestic discretion, and a recent Court of Cassation ruling restates the test every British traveller should know. On 24 September 2026 the Second Civil Chamber <a href=\"https:\/\/www.courdecassation.fr\/decision\/6ab4d725c27382d0992e8d32\">quashed the Grenoble appeal judgment in case 23-19.562<\/a>, holding &#8220;CASSE ET ANNULE, en toutes ses dispositions, l&#8217;arr\u00eat rendu le 7 avril 2023, entre les parties, par la cour d&#8217;appel de Grenoble&#8221;. The dispute concerned programmed outpatient treatment in Switzerland, and the Court recalled the European test that also governs British pensioners travelling under the Withdrawal Agreement or the Trade and Cooperation Agreement Protocol: &#8220;une personne assur\u00e9e se rendant dans un autre \u00c9tat membre aux fins de b\u00e9n\u00e9ficier de prestations en nature pendant son s\u00e9jour demande une autorisation \u00e0 l&#8217;institution comp\u00e9tente, qui est accord\u00e9e lorsque les soins dont il s&#8217;agit figurent parmi les prestations pr\u00e9vues par la l\u00e9gislation de l&#8217;\u00c9tat membre sur le territoire duquel r\u00e9side l&#8217;int\u00e9ress\u00e9 et que ces soins ne peuvent lui \u00eatre dispens\u00e9s dans un d\u00e9lai acceptable sur le plan m\u00e9dical, compte tenu de son \u00e9tat actuel de sant\u00e9 et de l&#8217;\u00e9volution probable de la maladie.&#8221; Two cumulative conditions, one administrative step: the treatment must belong to the basket of the state of residence, it must be unavailable there within a medically acceptable time, and prior authorisation must be requested from the competent institution. An S1 holder resident in France who plans non-urgent treatment in the United Kingdom, Spain or any other coordinated state should therefore apply to the CPAM for the S2 route before booking anything, keep the medical evidence that waiting times or missing equipment justify the request, and travel only once the authorisation is granted. Urgent and medically necessary care during a temporary stay works differently and passes through the travel card, but programmed care without prior authorisation is reimbursed, if at all, at the French domestic rate and often after a fight.<\/p>\n<h3>B. How to Challenge a CPAM Refusal, a Wrong Affiliation or a Wrong CSM Bill<\/h3>\n<p>Refusals addressed to British applicants fall into four families, and each has its own remedy. The first is the S1 registration refusal or the silent file: the clerk questions the form, asks for a French pension record you do not have, or files the S1 as a PUMA claim and then rejects it for lack of three months&#8217; presence.
