Since Brexit changed nothing about this tax itself, many British owners discover it late: France charges an annual tax on real-estate wealth, the IFI (impôt sur la fortune immobilière, the French tax on real-estate wealth), and it applies to British owners on exactly the same terms as to French nationals. There is no British exemption, no Brexit opt-out and no minimum stay that switches it off. What matters is where you live for tax purposes (your domicile fiscal, the country where you are tax-resident) and what your property is worth on 1 January each year.

This article explains who pays, how the bill is worked out, and how to challenge it. It covers residents and non-residents, the five-year relief for newcomers, valuation and deductible loans, the 30 per cent reduction for your main home (résidence principale, the dwelling where you actually live), the rate scale, gifts that reduce the bill, and the full challenge route from correcting your return to going before the tribunal judiciaire (the French first-instance civil court that hears tax disputes). Every key rule below is tied to the exact article of the Code général des impôts (the French general tax code) and to court decisions quoted word for word.

I. Do British owners pay French wealth tax (IFI) after Brexit?

Yes, wherever you live. The tax is charged when qualifying property passes a threshold, and Brexit did not create any British exclusion. The only questions are which of your assets count and where they sit. French tax residents are taxed on worldwide qualifying property; people living outside France are taxed only on French property. That split runs through everything that follows, so identify your side of the line first.

A. You live in France: worldwide property counts, with a five-year soft landing for newcomers

If France is your domicile fiscal, you fall within the first paragraph of the charging provision: “Sont soumises à cet impôt, lorsque la valeur de leurs actifs mentionnés à l’article 965 est supérieure à 1 300 000 € : 1° Les personnes physiques ayant leur domicile fiscal en France, à raison de leurs actifs mentionnés au même article 965 situés en France ou hors de France.” (Article 964 of the Code général des impôts). In plain terms, once the net value of your qualifying assets passes 1,300,000 euros, French residents pay IFI on all of them, including property outside France, such as a house you kept in Kent or a flat in Edinburgh. The threshold is assessed on the household, not per property, and the position is reviewed every 1 January.

That worldwide scope alarms many new arrivals, so the same article builds in a soft landing. Newcomers who were not tax-resident in France during the five calendar years before settling here are taxed, for five years, as if they were non-residents: “les personnes physiques mentionnées au premier alinéa du présent 1° qui n’ont pas été fiscalement domiciliées en France au cours des cinq années civiles précédant celle au cours de laquelle elles ont leur domicile fiscal en France ne sont imposables qu’à raison des actifs mentionnés au 2°.” (Article 964 of the Code général des impôts). During that window only your French property counts; your British home and any other non-French property stay outside IFI until 31 December of the fifth year after you arrived. After that date the full worldwide basis applies, so diary the expiry and revalue the whole portfolio in time.

Three household points follow from the same article. First, married couples are taxed jointly, and so are partners in a PACS (pacte civil de solidarité, the French registered civil partnership) and couples in a stable unmarried relationship (concubinage notoire): the law states that “les couples mariés font l’objet d’une imposition commune” and extends joint taxation to PACS partners and recognised cohabitants (Article 964 of the Code général des impôts). You cannot halve the threshold by splitting ownership on paper between spouses. Second, the base expressly includes property belonging to your minor children where you hold legal administration of their assets: “L’assiette de l’impôt sur la fortune immobilière est constituée par la valeur nette au 1er janvier de l’année : 1° De l’ensemble des biens et droits immobiliers appartenant aux personnes mentionnées à l’article 964 ainsi qu’à leurs enfants mineurs, lorsqu’elles ont l’administration légale des biens de ceux-ci” (Article 965 of the Code général des impôts). A house put in a child’s name does not leave the household base while you administer it. Third, the same base catches indirect holdings: shares in companies or bodies, French or foreign, count “à hauteur de la fraction de leur valeur représentative de biens ou droits immobiliers détenus directement ou indirectement par la société ou l’organisme” (Article 965 of the Code général des impôts). If you hold your Dordogne house through an SCI (société civile immobilière, the French non-trading property company many British families use), the shares enter the base for the fraction that represents the underlying property. Readers who hold French property inside a British family trust face a separate declaration regime, described in this firm’s analysis of British family trusts, IFI and succession in France, and should read the two together.

Practical consequence for residents: list every property worldwide, deduct only qualifying debts (see II.A below), and check the 1.3 million euro line on net value. If you moved recently, confirm in writing that the five-year relief covers you and when it ends, because the tax office will not apply it on a mere assumption.

B. You live in Britain: only your French property counts, valued with no residence discount

If your domicile fiscal is in the United Kingdom, France still taxes you, but only on French assets. The charging article taxes non-residents “à raison des biens et droits immobiliers mentionnés au 1° de l’article 965 situés en France” (Article 964 of the Code général des impôts), with shares in companies or bodies caught for the fraction of their value that represents the same French property. Your British home never enters the French base; your Provençal farmhouse, your Paris studio and the shares of the SCI that holds them always do, for the fraction that represents French bricks and mortar.

Two traps catch British second-home owners here. The first is the main-home reduction. French law grants a 30 per cent reduction on the market value of the owner’s main home, but a holiday home you visit for six weeks a year is not a résidence principale, so no reduction applies to it. If you later retire to France and make the house your real home, the reduction switches on from the 1 January when occupation as a main home is genuine; before that date, value it in full. The second trap is assuming that non-residence means light paperwork. It does not: the declaration duty, the valuation rules and the penalties for omission apply to non-residents in full, and the tax office routinely cross-checks published sale prices in popular British-buyer areas against declared values.

A related question is whether anything paid in Britain reduces the French bill. IFI is computed under French domestic rules first, and any question of relief on the UK side belongs to your British return and to the wording of the applicable treaty, which is outside the calculation described here. The British government’s own living-in-France guidance points readers to the United Kingdom’s double-taxation agreement with France, noting that it exists so the same income is not taxed in both countries (Living in France, GOV.UK), which is an income-tax statement, not an IFI credit. Work out the French bill on French rules, keep the UK question separate, and take advice on each side from the right professional. If you are weighing a sale to fall below the threshold, read first how a disposal is taxed and challenged in this firm’s guide to selling a former French home after leaving France, because exit timing changes both taxes at once.

II. How is the French IFI bill calculated and how do you challenge it?

The calculation has four steps: value each asset, subtract qualifying debts, apply reliefs, then run the rate scale. Each step has its own case law, and errors at any step can be challenged. Keep purchase deeds, loan statements, letting records and any professional valuation together; in every reported dispute below, the paperwork decided the outcome.

A. Valuing the property, deducting the loans and running the rate scale

Start with market value, the valeur vénale (the price the property would fetch on the open market), on 1 January. The code sends you to the inheritance-valuation rules and then grants the main-home reduction: “un abattement de 30 % est effectué sur la valeur vénale réelle de l’immeuble lorsque celui-ci est occupé à titre de résidence principale par son propriétaire.” (Article 973 of the Code général des impôts). One property only per jointly taxed household can take it. For a British family that moved into its Lyon house full-time, that single reduction often decides whether the household crosses the 1.3 million line at all.

Valuation method matters as much as the figure. The Paris tax court rejected a taxpayer who tried to revalue two Paris flats downwards years later using sale comparisons that did not match the property or that post-dated the taxing date, and it threw out his fallback capitalisation method, holding that capitalisation cannot value a building that is not let from an assumed rental value, as the expert had tried to do. The court added that the administration had correctly recalled the comparative method for assessing market value, and it closed by dismissing the taxpayer’s refund claim in full (Tribunal judiciaire de Paris, 9th chamber, 3rd section, 19 January 2024, RG 22/08190). The lesson is direct: comparable sales must resemble your property and sit at the right date, and an unlet home cannot be valued by capitalising an imaginary rent. Commission a proper valuation at or near 1 January, keep the comparables, and never file a figure you cannot evidence twice.

Owners who hold through an SCI face a second valuation fight: discounts on the shares. (Cour de cassation, commercial chamber, 9 July 2025, appeal no. 24-13.540). In that case the taxpayer already enjoyed two 10 per cent discounts, one for illiquidity of the buildings and one for illiquidity of the shares, and wanted a third 10 per cent for deemed joint ownership. The Court approved the appeal judges who had held that “la situation de l’associé d’une société civile immobilière n’est pas celle d’un indivisaire” (an SCI shareholder is not in the same position as a joint owner in indivision, the form of co-ownership where each owner holds an undivided share), refused the extra discount, and ended with “REJETTE le pourvoi” (Cour de cassation, commercial chamber, 9 July 2025, appeal no. 24-13.540). Claim only discounts your valuer can justify term by term; stacking a third discount on top of two illiquidity discounts will now fail.

Next subtract qualifying debts. The code allows deduction of “les dettes, existantes au 1er janvier de l’année d’imposition, contractées par l’une des personnes mentionnées au 1° de l’article 965 et effectivement supportées par celle-ci, afférentes à des actifs imposables” (Article 974 of the Code général des impôts), which in practice means the outstanding capital of the acquisition mortgage, loans for repairs the owner genuinely bore, improvement and building works, and property taxes that are not normally the occupier’s. Only debts existing on 1 January and actually borne by you count, and only in proportion to the taxable fraction of the asset. Keep the 1 January loan statement every year; a debt repaid in February still counts for that year’s IFI, while a loan taken out in March does not.

Two reliefs then reduce many bills. A British artisan whose workshop is also the taxable building should test this exemption before paying. A 10,000 euro cash gift to a qualifying foundation therefore wipes 7,500 euros off the IFI, within the 50,000 euro cap.

Split ownership (démembrement, dividing ownership between a life interest and the underlying capital) follows its own rule: assets burdened with a usufruct (usufruit, the lifetime right to use the property and take its income), a right of habitation or a personal right of use are counted “dans le patrimoine de l’usufruitier ou du titulaire du droit pour leur valeur en pleine propriété” (Article 968 of the Code général des impôts), meaning the life tenant, not the bare owner (nu-propriétaire, the owner of the capital without the use), bears the full value, except for legal family usufructs which are split on the statutory age scale. Never ignore it and never accept figures “to move things along”; an acceptance closes doors that a reasoned refusal keeps open.

If the reply fails, file a formal claim (réclamation, the written claim to the tax office seeking discharge or reduction). Such claims belong to the contentious courts “lorsqu’elles tendent à obtenir soit la réparation d’erreurs commises dans l’assiette ou le calcul des impositions, soit le bénéfice d’un droit résultant d’une disposition législative ou réglementaire.” (Article L. 190 of the Livre des procédures fiscales). In practice that covers every IFI argument in this article: wrong market value, wrongly refused 30 per cent reduction, wrongly refused debt deduction, wrongly taxed person, computation error, or a discount the office would not allow. Attach everything, number your exhibits, and keep proof of sending; the claim must reach the office with reasons and figures, not complaints.

When the office rejects the claim, or lets it die unanswered, the forum is the tribunal judiciaire, which hears IFI cases at first instance. The two judgments quoted in this article show both outcomes, so study what separated them. In Paris, the taxpayer attacked years later with mismatched comparables and an imaginary-rent capitalisation, and the court dismissed the whole refund claim. In Compiègne, a farming couple had sold property into two SCIs partly funded by shareholder current-account advances (comptes courants d’associés, loans made by shareholders to their company), then divided the shares among their children by a formal partage (donation-partage, the notarised deed dividing assets among heirs in advance). The office cried abuse of law over the deductible debts. The court compared the IFI saved against every gain and advantage, Weighing the IFI saving against the cost of the steps taken and the advantages sought, the court held the couple had shown the scheme was not mainly tax-driven. It weighed the wider succession plan, the liquidity needs of retired farmers and the health circumstances staggering the steps, It then granted further discharge of 5,965 euros plus 251 euros of late-payment interest for 2020 and 5,918 euros plus 107 euros for 2021, 12,241 euros in total (Tribunal judiciaire de Compiègne, 1st chamber, 1st section, 2 September 2025, RG 24/00911). The contrast is the whole strategy in miniature: documented economics and a genuine family purpose win; bare assertions about value lose.

Three final cautions shape every challenge. First, mind who proves what: you prove the value, the loan and the occupation you assert, while the office proves the increase it adds. Second, never manufacture evidence after the fact; backdated valuations and comparables from another market destroy credibility faster than any legal argument. Third, watch the clock at every stage, from the reply to the reassessment proposal to the claim and the court summons, because tax procedure forgives almost nothing late. A British owner who values carefully on 1 January, deducts only real debts, claims only defensible reliefs and answers every letter with exhibits will rarely need a judge; and if a judge is needed, that same file is the case.

Conclusion

France’s wealth tax reaches British owners as surely as French ones: residents pay on worldwide property once the household passes 1,300,000 euros net, newcomers enjoy five years on the French-only basis, and non-residents pay on French property alone. Value at 1 January by genuine comparison, deduct only debts that exist and that you bear, take the 30 per cent reduction only on a true main home, run each slice at its own rate, and declare gross and net with schedules. If the office disagrees, answer the reasoned proposal, claim in writing, and take a documented file to the tribunal judiciaire. Done in that order, IFI is a computation to get right, not a dispute to fear.

British owner with French property over 1.3m euros?
