Or a gendarme steps into the road, waves you down and keeps your licence. For a British motorist in France after Brexit, the next few weeks matter more than the flash itself. A French speeding case is a chain: a fixed fine with a short payment deadline, an automatic withdrawal of points, and, at higher speeds, the roadside retention of your licence followed by a prefectural suspension. Each link has its own time limit and its own remedy, and missing one deadline can close the next door. This guide explains the whole chain in English, with every French term translated at first use, so that a British holder of a UK licence or a French licence obtained by exchange knows what to pay, what to contest, how points leave and come back, and how a suspension or a loss of all points is challenged. The law is stated as in force on 6 October 2026.

Two ideas organise everything that follows. First, paying the fixed fine quickly ends the criminal prosecution but validates the facts, including the points withdrawal. Second, contesting is a right, but it runs on strict procedural rails: a written request within forty-five days, a reasoned complaint within thirty days of the increased fine, and evidence in writing or by witnesses where an official report is involved. Part I follows the flash: the fine and the points. Part II deals with the harder cases: retention, suspension and the loss of the licence itself.

I. I Was Flashed in France on a UK Licence: Where Do the Fine and the Points Go?

The camera does not know your nationality. Whether you drive on a UK photocard, on an attestation de dépôt (the receipt given when an exchange application is being processed) or on a French licence obtained by exchange, the speeding scale and the fine procedure are the same. What differs is where the points land and whether you still hold a valid right to drive, questions examined in Part II. Here, the two practical questions are the money and the points.

A. The Fixed Fine, the Increased Fine and the Two Routes for Contesting Within the Deadline

Most speeding cases begin with an avis de contravention (the penalty notice sent to the registered keeper) proposing an amende forfaitaire (fixed fine). The mechanism is simple and deliberate: for the listed minor offences, and I quote, “l’action publique est éteinte par le paiement d’une amende forfaitaire qui est exclusive de l’application des règles de la récidive”, as Article 529 of the Code of Criminal Procedure provides. Payment extinguishes the public prosecution, which is why paying feels like closing the file. It does close the prosecution, but it also records the facts, and the recorded facts drive the points withdrawal described below. Never treat payment as neutral where points or a later dispute matter.

The notice gives you forty-five days. Within that period you must either pay or challenge. The text is explicit, and I quote: “Dans le délai prévu par l’article précédent, le contrevenant doit s’acquitter du montant de l’amende forfaitaire, à moins qu’il ne formule dans le même délai une requête tendant à son exonération auprès du service indiqué dans l’avis de contravention”, under Article 529-2 of the Code of Criminal Procedure. That requête en exonération (request for exoneration) goes to the department named on the notice and is forwarded to the public prosecutor. In the cases where another person was driving, the request must be accompanied by one of the documents the notice requires, such as the identity of the actual driver or proof of hire, theft or transfer. Rental companies and employers receive the notice as keeper and designate the driver through the same channel, which is why a British visitor who hired a car should expect the hire firm to pass the papers on and should keep the rental agreement.

If nothing is paid and no request is made within forty-five days, the fixed fine is increased by operation of law and recovered for the Treasury under an enforcement order signed by the prosecutor. That amende forfaitaire majorée (increased fixed fine) is not the end of the road. The law opens a second window, and I quote: “Dans les trente jours de l’envoi de l’avis invitant le contrevenant à payer l’amende forfaitaire majorée, l’intéressé peut former auprès du ministère public une réclamation motivée qui a pour effet d’annuler le titre exécutoire en ce qui concerne l’amende contestée”, under Article 530 of the Code of Criminal Procedure. The réclamation (reasoned complaint) must be reasoned, sent to the prosecutor, and accompanied by the increased-fine notice itself, failing which it is inadmissible. Where the notice was sent by recorded delivery to the address on the vehicle registration certificate, the complaint for a road-traffic offence is in practice no longer admissible after three months from dispatch, unless the keeper had declared a change of address to the registration service before that deadline. British residents who move house within France and forget to update the certificat d’immatriculation (vehicle registration certificate) through the ANTS agency therefore lose real rights over a pure administrative omission, so updating the address is the cheapest protection available.

Three practical points decide most cases at this stage. First, designate the true driver honestly and early. Claiming that an unidentified person drove, without one of the permitted supporting documents, makes the request inadmissible. Second, use the channel stated on the notice, increasingly the online contestation service, and keep proof of sending and of every enclosure. Third, diarise both deadlines from the date of dispatch, not from the date you open the letter, because post between France and a UK address, or a letter sitting in a holiday home, eats into the forty-five days. A reasoned request filed on day forty-six is a request refused, however strong the underlying argument.

Contesting has a cost-benefit dimension. A successful challenge cancels the fine and, with it, the points withdrawal that would have followed automatically. An unsuccessful challenge sends the case toward the tribunal de police (the police court that tries minor offences), where the judge hears the evidence under the rules examined below. Because payment validates the facts for points purposes, a driver who cares mainly about keeping a clean licence record should think twice before paying simply to obtain peace, and a driver who cares mainly about money and has no defence should think twice before contesting simply on principle. The choice is tactical and personal, but it must be made inside the forty-five days.

B. How Many Points Each Speeding Band Takes and How the Law Returns Them

France runs a permis à points (points-based licence): every licence carries a capital of points, and specified offences deduct from it by operation of law. The principle is stated briefly, and I quote: “Le permis de conduire est affecté d’un nombre de points”, under Article L223-1 of the Highway Code. The same article adds the decisive link with the fine procedure, and I quote: “La réalité d’une infraction entraînant retrait de points est établie par le paiement d’une amende forfaitaire ou l’émission du titre exécutoire de l’amende forfaitaire majorée, l’exécution d’une composition pénale ou par une condamnation définitive.” In plain terms, the day you pay the fixed fine, or the day the increased fine becomes enforceable, or the day a conviction becomes final, the offence counts as established and the points go. There is no separate administrative hearing first. That is why the forty-five-day choice in section A is also a choice about points.

The speeding scale itself is set by regulation. The base rule provides, and I quote: “Le fait, pour tout conducteur d’un véhicule à moteur, de dépasser de moins de 50 km/h la vitesse maximale autorisée fixée par le présent code ou édictée par l’autorité investie du pouvoir de police est puni de l’amende prévue pour les contraventions de la quatrième classe”, under Article R413-14 of the Highway Code. Points then follow the size of the excess automatically, and I quote the scale: “1° En cas de dépassement de la vitesse maximale autorisée compris entre 40 km/h et moins de 50 km/h, réduction de quatre points ; 2° En cas de dépassement de la vitesse maximale autorisée compris entre 30 km/h et moins de 40 km/h, réduction de trois points ; 3° En cas de dépassement de la vitesse maximale autorisée compris entre 20 km/h et moins de 30 km/h, réduction de deux points ; 4° En cas de dépassement de la vitesse maximale autorisée compris entre 5 km/h et moins de 20 km/h, réduction d’un point.” Small excesses below 20 km/h outside built-up areas cost one point; an excess between 30 and 40 km/h costs three points and can also bring a licence suspension of up to three years as an additional penalty, possibly limited to driving outside professional activity, plus an order to attend an awareness course at your own expense. At 50 km/h or more over the limit, the case leaves this scale entirely and becomes a délit (a more serious criminal offence), with far heavier consequences.

Points also come back, and the calendar matters as much as the offence. If you commit no further points-bearing offence for two years from the payment of the last fixed fine, the issue of the last enforcement order, the execution of the last penal composition or the last final conviction, the licence recovers its full capital. The same provision extends the wait, and I quote the mechanism: “Le délai de deux ans mentionné au premier alinéa est porté à trois ans si l’une des infractions ayant entraîné un retrait de points est un délit ou une contravention de la quatrième ou de la cinquième classe”, under Article L223-6 of the Highway Code. Because most speeding cases are fourth-class petty offences, the realistic horizon is three years, not two. The article softens this for single-point withdrawals, and I quote: “en cas de commission d’une infraction ayant entraîné le retrait d’un point, ce point est réattribué au terme du délai de six mois à compter de la date mentionnée au premier alinéa, si le titulaire du permis de conduire n’a pas commis, dans cet intervalle, une infraction ayant donné lieu à un nouveau retrait de points.” One small flash, six clean months, and the point returns. Finally, a driver who has lost points can take a stage de sensibilisation à la sécurité routière (road-safety awareness course) to recover points, within the limit of one course per year, as the same article provides.

Challenging the measurement itself is possible but disciplined by evidence rules. Minor offences are proved by official reports or witness evidence, and the reports of judicial police officers and agents carry weight until the contrary is proved. The rule states, and I quote: “Sauf dans les cas où la loi en dispose autrement, les procès-verbaux ou rapports établis par les officiers et agents de police judiciaire et les agents de police judiciaire adjoints, ou les fonctionnaires ou agents chargés de certaines fonctions de police judiciaire auxquels la loi a attribué le pouvoir de constater les contraventions, font foi jusqu’à preuve contraire”, under Article 537 of the Code of Criminal Procedure. The contrary evidence, crucially, can only be given in writing or by witnesses. A bare denial from the dock does not overturn the report.

The Court of Cassation, the supreme court for criminal matters, enforces this balance strictly. On 6 May 2025, in a speeding case where the police court had acquitted because the report was signed only by the investigating officer and not by the operator of the speed-measurement device, the criminal chamber quashed the acquittal. It recalled, and I quote: “les procès-verbaux dressés par les officiers ou agents de police judiciaire font foi jusqu’à preuve contraire des contraventions qu’ils constatent, la preuve contraire ne pouvant être rapportée que par écrit ou par témoins”, and held that the lower court had acquitted, and I quote, “sans constater que la preuve contraire de nature à renverser la force probante du procès-verbal de contravention avait été rapportée par écrit ou par témoins”. See Court of Cassation, criminal chamber, 6 May 2025, appeal no. 24-83.832. The same ruling usefully lists what the report must contain, and I quote: “les seuls éléments qui doivent figurer sur ledit procès-verbal sont le nom ou l’identifiant de l’agent verbalisateur, le service auquel il appartient, la nature, le lieu, la date, l’heure de l’infraction et le numéro d’immatriculation du véhicule”. Check those details first. Missing registration number, wrong place, wrong time or an unidentified reporting officer are the concrete defects worth raising, by writing or by witnesses, rather than a general complaint that the camera must have been wrong. Arguments about calibration, signage or the approved nature of the device belong in the same written form, with documents, photographs or expert observations attached.

II. My Licence Is at Risk in France: Suspension, Zero Points and How to Challenge the Decision

Losing a point or two is an annoyance. Losing the right to drive is a different event, and it arrives through three distinct doors: the immediate roadside retention followed by a prefectural suspension, the expiry of the one-year recognition of a British licence, and the invalidation of the licence when the points capital reaches zero. Each door has its own authority, its own clock and its own challenge. British residents are exposed to the second door in a way that French neighbours are not, which is why licence status comes before tactics here.

A. Roadside Retention, Prefectural Suspension and the One-Year Rule for British Licences

At 40 km/h or more over the limit with an approved device, the officers can retain the licence on the spot as a conservatory measure. The statute lists the case expressly, and I quote: “Lorsque le véhicule est intercepté, lorsque le dépassement de 40 km/ h ou plus de la vitesse maximale autorisée est établi au moyen d’un appareil homologué”, under Article L224-1 of the Highway Code. Rétention (roadside retention) is not the punishment; it is the freeze while the file moves to the préfet (the State representative in the department). The préfet can then order a suspension, and I quote the power: “Le représentant de l’Etat dans le département peut, dans les soixante-douze heures de la rétention du permis prévue à l’article L. 224-1, ou dans les cent vingt heures pour les infractions pour lesquelles les vérifications prévues aux articles L. 234-4 à L. 234-6 et L. 235-2 ont été effectuées, prononcer la suspension du permis de conduire lorsque : 3° Le véhicule est intercepté, lorsque le dépassement de 40 km/ h ou plus de la vitesse maximale autorisée est établi au moyen d’un appareil homologué”, under Article L224-2 of the Highway Code. In Paris, that authority is the préfet de police (the Prefect of Police), and the seventy-two-hour clock includes weekends in practice, so a Friday interception can produce a suspension order before any lawyer’s office reopens on Monday. Ask for a copy of the retention report, note the exact time of the interception, and seek advice immediately rather than waiting for the letter.

A suspension is an administrative decision that can be challenged before the administrative court, including by urgent interim proceedings asking the judge to suspend the suspension while the case is examined. The request should attach the retention report, the suspension order, proof of professional need where driving is essential for work, and any evidence on the measurement itself. Judges weigh the seriousness of the excess against the consequences of being unable to drive, and a delivery driver, a carer or a rural resident with no public transport has concrete arguments that a city-centre resident may lack. The criminal case for the speeding itself continues separately before the police court, so two files run in parallel and neither waits for the other.

For British licence holders, a quieter trap sits beside the speeding rules. Since the end of the transition period, a licence issued by the United Kingdom, which is neither an EU member nor in the European Economic Area, is treated as a third-country licence. The rule provides, and I quote: “Tout permis de conduire national, en cours de validité, délivré par un Etat ni membre de l’Union européenne, ni partie à l’accord sur l’Espace économique européen, peut être reconnu en France jusqu’à l’expiration d’un délai d’un an après l’acquisition de la résidence normale de son titulaire”, under Article R222-3 of the Highway Code. The same article adds the sting, and I quote: “Au terme de ce délai, ce permis n’est plus reconnu et son titulaire perd tout droit de conduire un véhicule pour la conduite duquel le permis de conduire est exigé.” One year after becoming normally resident, an unexchanged UK licence ceases to authorise driving in France at all, and during that year it can be exchanged for a French licence without sitting the French tests, under conditions set by ministerial order. Driving after the year on the unexchanged licence is driving without a valid entitlement, whatever the photocard expiry date printed on the plastic.

The position of older licences is more favourable and often misunderstood. A licence regularly issued by an EU member state, or by a state that was a member at the date of issue, remains recognised in France while valid, as Article R222-1 of the Highway Code provides, and I quote: “Tout permis de conduire national régulièrement délivré par un Etat membre de l’Union européenne ou partie à l’accord sur l’Espace économique européen ou par un Etat qui était membre de l’Union européenne ou partie à l’accord sur l’Espace économique européen à la date de sa délivrance, est reconnu en France sous réserve d’être en cours de validité.” In practice, the French administration recognises a British licence issued before 2021 while it remains valid, with exchange compulsory only in defined cases such as an offence carrying a points withdrawal, while a licence issued from 2021 onwards follows the third-country exchange track. The official service-public pages confirm this split between pre-2021 and post-2021 British licences. Readers who have not yet exchanged will find the administrative route described in our guide to exchanging a UK driving licence via ANTS after Brexit, and the exchange should be started well before the one-year anniversary of residence, because processing delays do not extend the right to drive.

The criminal courts have already tested these distinctions on British licences. In a 2022 case, a driver argued that she held a valid British licence obtained in 2016 and an exchange receipt covering the date of the alleged driving without a licence. The Court of Cassation recalled the framework, and I quote: “Selon le premier de ces textes, en cas de retrait de la totalité des points, le titulaire du permis de conduire doit remettre celui-ci et perd le droit de conduire”, and, and I quote: “tout permis de conduire régulièrement délivré dans un Etat membre de l’Union européenne est reconnu en France sous réserve d’être en cours de validité.” It quashed the conviction for driving without a licence because the appeal court had treated the British licence as unrecognisable without examining whether it had been obtained after the prior ban had expired and the earlier licence returned. See Court of Cassation, criminal chamber, 9 March 2022, appeal no. 21-84.021. The lesson is practical: keep the exchange receipt, the proof of filing date and the history of any earlier French licence, because the recognition question turns on documents and dates, not on assertions.

B. Losing Every Point, Taking the Awareness Course and Bringing the Challenge Before the Right Court

When the capital reaches zero, the administration sends an injonction de remettre le permis (an order to hand the licence in). The statute states, and I quote: “En cas de retrait de la totalité des points, l’intéressé reçoit de l’autorité administrative l’injonction de remettre son permis de conduire au préfet de son département de résidence et perd le droit de conduire un véhicule”, under Article L223-5 of the Highway Code. From that notification, driving is prohibited. Refusing to hand the licence in is itself a criminal offence punishable by two years’ imprisonment and a 4,500 euro fine, and driving despite the order draws the same penalties, so the letter must be obeyed even while it is challenged. A new licence cannot be obtained until six months after handing the old one in, extended to one year where a fresh total loss occurs within five years of the previous one, and only after passing a medical, clinical, biological and psychotechnical fitness examination at your own expense.

Before that stage, the awareness course is the safety valve. A driver who has lost points may take a road-safety awareness course to recover up to four points, once a year, and a probationary driver who loses a quarter or more of the maximum capital must take it as a substitute for the fine. The course is organised by approved centres throughout France, including several in Paris and the inner suburbs, and the recovered points are credited once attendance is registered. For a British resident whose livelihood depends on driving, booking the course early in the year, rather than after the next flash, is simple risk management.

Challenges follow the nature of each decision. The fixed fine and the increased fine are contested through the forty-five-day request and the thirty-day reasoned complaint described in Part I, which, if maintained, lead to a hearing before the police court where the report-faith rule and the 2025 case law govern. The prefectural suspension is contested before the administrative court, with interim relief available in urgent cases such as a risk of job loss. The zero-points invalidation is contested by challenging the underlying withdrawals: each withdrawal presupposes a properly notified offence and, for the withdrawal to stand, proper prior information about the points procedure. Requests for the relevé d’information intégral (the full driving-record statement) from the ANTS agency show every withdrawal with its date and legal basis, and the statement is the essential exhibit for any challenge, because only dated, notified withdrawals count. In Paris and Île-de-France, the competent bodies are concentrated and fast: the Prefect of Police for suspensions arising in the capital, the Paris police court for petty offences committed in the city, and the Montreuil administrative court for challenges to decisions taken by Paris authorities. Deadlines do not pause for translation difficulties, so a British defendant who needs an interpreter should ask the court registry early.

A final procedural warning applies to visitors as much as to residents. A British motorist who lives in the United Kingdom and is flashed by a French camera receives the notice at the keeper’s address through cross-border cooperation, and the same forty-five-day and thirty-day clocks apply. Ignoring a French notice from across the Channel does not make it go away; the increased fine becomes enforceable and later border checks or vehicle stops can revive the file. Designating the driver, paying where there is no defence, or contesting in writing where there is one, are the same three options, and the keeper who lends a car to friends should keep a dated record of who drove on each trip.

Conclusion

A French speeding case moves in a fixed order: notice, forty-five days to pay or request exoneration, automatic points withdrawal once the fine is paid or increased, and, at the top of the scale, roadside retention with a seventy-two-hour prefectural suspension. British drivers carry one extra question, the validity of their licence itself, governed by the one-year recognition rule and the pre-2021 distinction. The method that protects you is the same in every case: read the notice on arrival, diarise the forty-five-day and thirty-day limits from dispatch, update your registration address, keep the exchange receipt and the full driving record, and put any challenge in writing with documents or witnesses rather than bare denial. Points return with clean time or an awareness course; suspensions and invalidations are challenged before the administrative judge and the police court respectively, each on its own clock. Treated this way, a flash in the mirror stays a manageable administrative episode instead of becoming the loss of the right to drive.

British driver flashed in France?
