You retired early to France at fifty-five, you do not work, you draw no pension yet, and you live on the rent from a house back in Britain plus dividends from an investment account. Your residence permit is in order, your PUMA healthcare file was accepted months ago, and nobody at the counter mentioned that accepting cover could come with an annual bill. Yet the cotisation subsidiaire maladie, the CSM, is exactly that: a yearly health contribution aimed at residents who are covered by French healthcare while drawing little or no professional income in France. For British early retirees after Brexit, it is the most commonly misunderstood cost in the whole settlement, and the most unnecessarily overpaid, because households declare on the wrong base, miss the household aggregation rules, confuse it with the separate social levies on their tax return, or pay an assessment they could have challenged. This article explains who pays the levy and on what base, how to declare it without error, how lawful changes in your situation switch it off, and how to challenge an assessment you consider wrong, from the evidence file through the mandatory prior appeal to the court.

I. Who pays the yearly health levy and on what base

A. The two entry conditions: low French professional income and no pension or benefit in payment

The levy does not apply to everyone covered by French healthcare, and the statute draws its circle with two cumulative conditions. Article L. 380-2 of the Social Security Code states that “Les personnes mentionnées à l’article L. 160-1 sont redevables d’une cotisation annuelle lorsqu’elles remplissent les conditions suivantes : 1° Leurs revenus tirés, au cours de l’année considérée, d’activités professionnelles exercées en France sont inférieurs à un seuil fixé par décret.” The first condition therefore looks only at professional income earned in France during the year considered, and asks whether it sits below a threshold set by regulation. A British early retiree who does no work in France meets this condition by definition, with zero French professional income. A semi-retired consultant with a small French self-employed top-up may still meet it if that top-up stays under the threshold, which is why the exact regulated figure for the year concerned must always be checked rather than assumed. The article then extends the test across the household: “En outre, lorsqu’elles sont mariées ou liées à un partenaire par un pacte civil de solidarité, les revenus tirés d’activités professionnelles exercées en France de l’autre membre du couple sont également inférieurs à ce seuil”. Where you are married or in a civil partnership, the pacte civil de solidarité known as PACS, your partner’s French professional income must also sit below the threshold. A couple where one spouse has taken a full-time French job while the other lives on dividends will therefore normally fail the first condition at household level even though the dividend-receiving spouse earns nothing professional, and neither of them will owe the levy for that year.

The second condition looks at what the household receives instead of work. Article L. 380-2 of the Social Security Code continues: “2° Elles n’ont perçu ni pension de retraite ou d’invalidité, ni rente, ni aucun montant d’allocation de chômage au cours de l’année considérée. The archetypal British early retiree, aged fifty-three, living on United Kingdom rental income and portfolio dividends, drawing no State Pension and no private pension yet, satisfies this condition cleanly. The boundary cases are where planning matters. A retiree who starts drawing even a modest private pension during the year moves outside the levy from that year, because the condition is assessed year by year. A household where one partner reaches United Kingdom State Pension age and starts drawing it while the other remains inactive also moves outside, since the condition applies to the other member of the couple as well. Conversely, income that is not a pension, an annuity, or unemployment benefit does not switch the levy off: rental profits, dividends, interest, and capital gains keep you inside the circle, because they feed the base of the levy rather than removing you from it, which is the subject of the next section. One further exit deserves attention because it concerns many British pensioners directly: a person whose healthcare is funded by the United Kingdom through a registered S1 form is not carried as a PUMA member for the period the S1 covers, and the affiliation rule itself is stated subject to international coordination, since article L. 111-2-2 of the Social Security Code affiliates workers only “Sous réserve des traités et accords internationaux régulièrement ratifiés ou approuvés et des règlements européens”. A pensioner couple where one partner holds a registered S1 should therefore verify, line by line, which partner is assessed for which year, because mixed files are where double-counting errors breed.

Two household truths follow from these conditions. First, the levy is assessed per person but tested per household: each adult liable pays on their own base, yet the entry conditions aggregate the couple. Second, everything is annual: the year considered for the conditions is the same year whose capital income forms the base, and the contribution is then recovered the following year, since article L. 380-2 of the Social Security Code provides that “La cotisation est recouvrée l’année qui suit l’année considérée, mentionnée aux 1° et 2° du présent article”. A British household that moves to France in June, earns nothing professional, and draws no pension will therefore typically see the first assessment arrive the next year, computed on that first part-year’s capital income, and the shock of that first envelope is the reason this article exists.

B. The base: French and foreign capital income, lifestyle top-ups, and the regulated rate, allowance, and cap

Once inside the circle, what you pay turns on the base, and the base is deliberately wide. In everyday terms: land and rental income, investment and savings income, capital gains on disposals of property or rights of any kind, and non-professional business profits, measured using the methods of the tax code’s article 1417. For a British early retiree this base routinely captures the rent from a let house in Manchester or Bristol, dividends and interest from British and international accounts, and the gain on any shares or property sold during the year. The territorial reach is worldwide, not French-only, which surprises newcomers who assume that income taxed in Britain stays invisible in France. It does not: residence-based healthcare looks at worldwide means, and the declaration this levy requires sits beside, not inside, the income tax return.

The statute then adds a backstop for households whose visible income understates their means. All means of subsistence and lifestyle elements, including benefits in kind and income produced by movable and immovable property enjoyed anywhere in the world and on any basis, can be brought into the base where the tax-code measure misses them, with valuation methods set by regulation: “Ces éléments de train de vie font l’objet d’une évaluation dont les modalités sont fixées par décret en Conseil d’Etat.” A retiree living in a villa owned by a family company without paying rent, or enjoying a yacht and staff through an offshore structure while declaring minimal income, is the target of this paragraph, not the ordinary household living on declared rents and dividends. Ordinary households should nevertheless read it as a warning against engineering the base down artificially: the fund is entitled to look at how you actually live, and a declared base wildly inconsistent with visible means invites the deeper audit nobody wants.

The arithmetic that turns the base into a bill is entirely regulated, which is both a discipline and a protection. Three features matter for planning. The rate falls linearly as professional income rises toward the threshold and reaches zero there, so a small amount of French professional income reduces the levy before eliminating it, a taper that rewards even modest declared activity. An allowance is deducted from the base before the rate applies, so small capital incomes can produce no bill at all. And the pre-allowance base is capped, so very large capital incomes do not produce an unbounded levy. Because each of these figures lives in regulation and can move between years, no household should compute from a remembered percentage found online: the only correct inputs are the decree values for the year considered, applied to the income categories the statute lists, and any assessment should be re-performed on those inputs before it is accepted or challenged. Official service-public.fr guidance on the PUMA adds a forward-looking caution worth diarising: the Social Security Financing Act for 2026 provides for a financial contribution from PUMA beneficiaries who combine stable and lawful residence, absence of professional activity, and non-liability to the main French social levies, with a decree still expected on the amount. That future contribution sits beside the CSM rather than replacing it, and until its decree appears it should be carried as a budget reserve, not a costed line.

II. Declaring the levy, switching it off lawfully, and challenging the bill

A. Declaring correctly, timing life events, and the low-income top-up that softens the system

Declaration is where most overpayments are born, because the levy return is not the income tax return and the two documents obey different logics. The statute places declaration duties on the person liable, and collection follows the recovery rules of the Code with regulatory adaptations, so the assessment notice is the end of a chain that starts with what the household declared or failed to declare. Four declaration reflexes prevent most errors. First, declare worldwide capital income in the levy’s own categories even where the same income is treaty-taxable only in Britain: the levy’s base is a healthcare measure of means, not an income-tax charge, and omitting British rental income because it is taxed in Britain is the single most common cause of reassessment with penalties. Second, keep the year logic strict: the conditions and the base both belong to the year considered, while recovery happens the year after, so a pension started in March of year two removes liability for year two but changes nothing for year one. Third, aggregate the couple correctly: where married or in a PACS, each partner’s French professional income counts toward the entry test, while each liable person is assessed on their own capital-income base, so the file must show both partners’ professional income and each partner’s capital income separately rather than blending everything into one figure. Fourth, keep the proof of any pension, annuity, or benefit that switches the levy off: the award letter with its start date is the document that ends liability, and producing it at declaration stage avoids paying first and arguing later.

Life events change the levy picture more often than households expect, and timing them deliberately is lawful planning, not avoidance. Starting even modest French professional activity moves the household along the linear taper and, past the threshold, out of the levy entirely, which can make a small consultancy assignment or a part-time contract worth more than its salary where the levy saving is counted. Drawing a private pension earlier than planned has the same exit effect through the second condition, though the pension-versus-levy arithmetic must be done honestly, since drawing income early to save a levy is rarely sensible on its own. Reaching United Kingdom State Pension age and drawing the pension ends the levy and, for many, opens the S1 route described in the British residence guides, shifting the household from residence-funded to United Kingdom-funded cover. Marriage, PACS, divorce, or the end of a PACS re-draws the household aggregation from the year concerned, so the file for the year of the event must reflect the new household exactly. And departure from France ends the story going forward: the levy follows residence-based cover, so a household that leaves France and closes its PUMA position should keep the dated proof of departure, because a zombie assessment for a year after departure is challenged with that proof, not with arguments about fairness. Throughout these events, the low-income household has a shield worth claiming. Article L. 861-1 of the Social Security Code provides that “Les personnes mentionnées à l’article L. 160-1 ont droit à une protection complémentaire en matière de santé dans les conditions suivantes”, with cover “Sans acquitter de participation financière lorsque leurs ressources ainsi que celles des autres personnes membres du même foyer sont inférieures à un plafond déterminé par décret”. Below the regulated ceiling, the complémentaire santé solidaire tops up state reimbursements without any financial contribution from the household, which matters precisely to the early retiree whose capital income is real but small: the levy may be reduced to little or nothing by the allowance, while the top-up absorbs the patient share of each medical bill. Claiming it is a separate application with its own resource test, and it should be filed alongside the levy declaration, not discovered years later.

The foundation beneath all of this is the cover itself, and it must stay valid while the levy is disputed, because challenging the bill never suspends the cover and letting cover lapse while arguing about price is the worst trade available. Residence-based cover rests on the statutory promise that article L. 160-1 of the Social Security Code expresses as “Toute personne travaillant ou, lorsqu’elle n’exerce pas d’activité professionnelle, résidant en France de manière stable et régulière bénéficie, en cas de maladie ou de maternité, de la prise en charge de ses frais de santé dans les conditions fixées au présent livre”, with the stability and lawfulness conditions detailed by regulation under article L. 111-2-3 of the Social Security Code, including the rule that article R. 111-2 of the same Code states as “sont considérées comme résidant en France de manière stable les personnes qui ont leur foyer ou le lieu de leur séjour principal sur le territoire métropolitain”, closing with “La résidence en France peut être prouvée par tout moyen.” A household whose residence file is fragile should therefore repair it in parallel with any levy challenge: lawful stay through the correct visa and permit, presence proved month by month, and each adult’s file complete. Challenging the assessment: recompute first, then the prior appeal, then the court

Every challenge starts at the desk, not at the court, with a recomputation on the correct inputs. Take the assessment notice and re-perform it line by line: the year considered, the French professional income of each member of the couple against the threshold for that year, the presence or absence of any pension, annuity, or unemployment benefit in payment to either member, then each component of the base against the categories the statute lists, with the allowance deducted and the cap applied using the decree values for that year. The errors this exercise catches fall into patterns. Wrong-year errors apply one year’s threshold or rate to another year’s income. Household errors assess a blended couple figure instead of each person’s base, or ignore a spouse’s professional income that should have removed the household from the levy. Category errors pull in income the statute does not list, or double-count income already taxed under a different measure. Status errors assess a year in which a pension had already started, or a year after departure from France. And S1 errors assess PUMA-levy on a partner whose registered S1 covered that year. Each pattern needs its own documentary answer: the decree values for the year, pay slips or nil statements for professional income, the pension award letter with its start date, the dated proof of departure, the S1 and its CPAM registration receipt, and the tax notices that evidence each income component. If you live in Paris, the file goes to the CPAM de Paris, which processes a very large volume of foreign files; keep a complete copy of everything deposited, note the date and reference of each exchange, and never surrender an original where a copy will do. Files of this kind, combining levy recomputation with residence and coordination evidence, are handled on +33 6 46 60 58 22, and an early review of the notice against the recomputation usually shows whether the gap is a missing paper or a genuine legal disagreement.

Where the recomputation shows the notice is wrong and the fund maintains it, the dispute enters a framed procedure whose first frame is mandatory. Article L. 142-4 of the Social Security Code provides that “Les recours contentieux formés dans les matières mentionnées aux articles L. 142-1 , à l’exception du 7°, et L. 142-3 sont précédés d’un recours préalable, dans des conditions prévues par décret en Conseil d’Etat.” A court challenge to the assessment must therefore be preceded by a prior appeal to the fund’s internal appeals commission, lodged within the time limit printed on the notice, which is why the notice should be read in full on arrival day, checking the year, the base, the rate, the deadline, and the appeal address. The prior appeal is a genuine re-examination: it should present the recomputation in a table the reader can verify, attach each proof in numbered order with an inventory, answer the notice’s figures line by line, and state expressly what is sought, whether full discharge of the assessment, reduction to a computed figure, or reclassification of a disputed component. Where the commission rejects expressly or by silence, the file moves to the court that hears social-security disputes, carrying the notice, the prior appeal, the full evidence bundle, and the articles quoted in this article, and the judge reviews both the facts and the law. Two disciplines decide these cases more than rhetoric: separating the questions, so that cover, base, rate, and year are each argued on their own evidence rather than merged into a general complaint, and dating everything, because the levy is an annual machine and the household that proves each year separately wins year by year while the household that argues in generalities loses in specifics.

Conclusion

The yearly health levy on the British early retiree in France is lawful, computable, and, where wrongly assessed, challengeable, and each of those three adjectives points to an action. Lawful means the two entry conditions and the worldwide capital-income base should be tested against the household’s real position every year, not assumed from the previous notice. Computable means the bill should be re-performed on the decree values for the year considered, allowance and cap included, before it is paid or fought, because wrong-year figures, blended couple bases, and miscategorised income are the errors that recur. Challengeable means the recomputation goes first to the fund with numbered proofs, then through the mandatory prior appeal within the printed deadline, and only then before the judge, with cover, base, rate, and year argued separately and dated precisely. Households that run this discipline from the first assessment spend a little time each year and never overpay twice; households that file the notice in a drawer pay whatever figure it contains, including the errors. The envelope, in short, is the start of a procedure, and the procedure rewards the household whose papers are in order.

Retired early to France on rental income and dividends?
