Since 21 February 2026, an individual who buys a flat to let it unfurnished can write off part of the purchase price against rental income for up to 12,000 euros a year under the so-called Relance logement scheme, also known as the Jeanbrun scheme. The opportunity is real, but so are the strings attached: a nine-year letting commitment, capped rents, and a body of landlord duties that French courts have been sharpening throughout 2025 and 2026. This guide explains the scheme as it stands in official publications, then sets out four recent rulings of the Cour de cassation (Supreme Court for civil matters) that redraw the daily risk map for any foreign owner who lets a French home.

I. The 2026 Route In: How the Relance Logement Scheme Works for a Foreign Buyer

A. Eligibility, Timetable and the Tax Mechanics

The scheme was created by Article 47 of Finance Act No. 2026-103 of 19 February 2026, and the Ministry of the Economy describes its practical conditions on its official investissement locatif information page written on 12 May 2026. It is open to all individual taxpayers with no means test, which includes a non-resident individual who is taxable in France on French-source rental income. The acquisition window runs from 21 February 2026 to 31 December 2028, and only immeubles collectifs (residential blocks of flats) qualify: either new dwellings, or older dwellings provided the buyer invests at least 30 percent of the acquisition price in renovation works, with an emphasis on energy improvement.

The tax mechanism is an amortisation of the purchase price against rental income, combined with the ordinary deduction of rental expenses such as works, loan interest and taxe foncière (local property tax). According to the Ministry, the investor may deduct up to 12,000 euros of amortisation per year, and a deficit of up to 10,700 euros may be set against other income such as salary or pension. These ceilings matter for sizing a project: on a 300,000-euro flat, the amortisable base is spread over the commitment period, so the investor should model the yearly deduction against realistic Paris or regional rents before signing anything.

Three practical checks follow from the official conditions. First, the 30-percent renovation test for older flats is measured on qualifying improvement expenditure, so the buyer should have the contractor quotes itemised and dated before the acte authentique (notarial deed of sale), and keep every invoice for the full commitment period in case the tax administration asks for proof. Second, the scheme sits alongside, and does not replace, the ordinary furnished-letting regimes; an investor who hesitates between unfurnished and furnished letting must choose at the outset, because switching mid-commitment can break the nine-year undertaking. Third, non-resident buyers keep their parallel obligations: registration of the letting where required, French income-tax returns on the rents, and, at resale, the capital-gains and représentant fiscal (tax representative) mechanics for sellers outside the European Union. The tax saving on rents never exempts the owner from the landlord duties described below, and a foreign owner who manages from abroad should appoint a responsive local contact, because several of the court deadlines examined in Part II run in weeks, not months.

For a buyer still comparing structures, the purchase itself follows the standard French path: a compromis de vente (preliminary sale agreement) with conditions precedent, then the notarial deed. A foreign buyer who purchases through a société civile immobilière (non-trading property company, SCI) should confirm with a tax adviser that the company route remains compatible with the individual amortisation benefit before committing, since the scheme is framed for individual investors. Whatever the vehicle, the legal centre of gravity then shifts from the purchase to the letting, and that is where recent case law has moved the lines.

Non-resident investors should add one more layer to the timetable. The acquisition window is fixed by statute, but a cross-border purchase rarely closes as fast as a domestic one: funds must be transferred, a French bank account opened for direct debits of charges and tax, powers of attorney arranged if the buyer cannot attend completion, and foreign-currency exposure managed between the preliminary agreement and the deed. Starting the financing and administrative chain at the same time as the property search, rather than after the offer is accepted, is the difference between completing inside the window and watching it close. Currency movements between exchange of the compromis de vente and completion can shift the effective price by several percent, so the buyer should fix the rate or budget a margin, and should confirm that the lender’s offer covers the renovation works where an older flat is concerned, since the 30-percent test counts expenditure actually committed to the property.

B. The Nine-Year Letting Commitment: What It Really Obliges You to Do

The heart of the scheme is a letting undertaking: the flat must be let unfurnished as the tenant’s résidence principale (principal residence) for nine years, at a rent within the applicable cap (intermédiaire, social or very social depending on the option chosen), and it may not be let to a close family member. These are not marketing slogans; they mirror the enforceable core of every French residential lease, and the courts police them strictly. The lease is a contract by which, in the words of Article 1709 of the Civil Code, “one of the parties undertakes to allow the other the enjoyment of a thing for a certain time, in exchange for a price which the latter undertakes to pay: « Le louage des choses est un contrat par lequel l’une des parties s’oblige à faire jouir l’autre d’une chose pendant un certain temps, et moyennant un certain prix que celle-ci s’oblige de lui payer. » The price is capped by the scheme, but the enjoyment the owner must deliver is defined by statute and cannot be reduced by clever drafting.

That enjoyment has a name: logement décent (decent housing). Article 6 of Act No. 89-462 of 6 July 1989, in its version in force since 1 January 2025, provides that the landlord must deliver a dwelling showing no manifest risks to physical safety or health, free of pest infestation, meeting a minimum energy-performance level and equipped for residential use: « Le bailleur est tenu de remettre au locataire un logement décent ne laissant pas apparaître de risques manifestes pouvant porter atteinte à la sécurité physique ou à la santé, exempt de toute infestation d’espèces nuisibles et parasites » The same article then lists the three continuing duties: to ensure the tenant’s peaceful enjoyment, to maintain the premises fit for the contractual use, and to carry out all non-routine repairs needed to keep them in good order. These duties run for the whole nine years, and they apply flat by flat: each dwelling in a foreign investor’s portfolio must individually satisfy them.

The commitment also constrains exits. Selling during the nine years, converting to furnished or seasonal letting, leaving the flat vacant between tenancies for an extended period, or letting to a relative can trigger a clawback of the tax benefit. A foreign owner should therefore stress-test the project against realistic vacancy in the chosen town, the cost of bringing an older flat to the decency and energy thresholds, and the management burden from abroad. The Paris region adds its own layer: rent caps, the encadrement des loyers (rent control framework) and the complément de loyer (rent supplement) litigation examined below are daily realities in the capital, and an investor counting on a high Paris rent to fund renovation works must verify the lawful ceiling before, not after, the purchase. Where a full legal and tax review of a specific project is needed, the firm’s English-language real estate practice in Paris handles precisely this type of cross-border file.

A Paris and Île-de-France acquisition deserves its own checklist, because the capital concentrates every constraint at once. The competent court for tenancy disputes is the tribunal judiciaire (ordinary civil court) of Paris, whose proximity judges handle rent-supplement and decency claims in large volumes, so procedural delays are shorter and case law is applied swiftly. Practical lead times run in weeks: a tenant’s formal notice (mise en demeure) typically demands works within one to two months, and a landlord who manages from London, New York or Tel Aviv needs a local caretaker, agent or lawyer able to commission a bailiff’s report (constat d’huissier) and instruct contractors immediately. The documents to assemble from day one are the energy performance diagnostic (diagnostic de performance énergétique), the check-in inventory with dated photographs, the co-ownership meeting minutes flagging planned building works, and the rent-reference notices for the sector. The local pitfall is assuming that a premium arrondissement exempts the flat from caps: the supplement must still be justified dwelling by dwelling, as the December 2025 ruling shows, and over-optimistic rent assumptions are the most common reason a Paris buy-to-let model fails its first-year review.

II. What French Courts Now Demand From Landlords: Four Rulings Every Foreign Investor Must Know

A. Decent Housing Cannot Be Contracted Away, and Tenants Can Force You to Do the Works

Two 2025–2026 rulings of the Third Civil Chamber close, one after another, the two escape routes landlords used to invoke most often: the lease clause and the passage of time. In Cass. 3rd civ., 16 October 2025, No. 24-16.682, tenants of a flat let in February 2018 sued their social-housing landlord over indecent conditions, and the court of appeal dismissed everything because the lease stated that the tenant took the premises as seen, could raise no further reservations after check-in, and could claim nothing for urgent works the landlord carried out. The Cour de cassation quashed that reasoning outright. It recalled the governing principle in these terms: « le bailleur est obligé de délivrer au locataire un logement décent, de lui en assurer la jouissance paisible pendant la durée du bail » In plain terms, the landlord must deliver a decent dwelling, keep it fit for use and perform all non-routine repairs — and no standard lease wording can waive that duty; only force majeure (an unforeseeable, irresistible external event) can excuse it.

The companion ruling answers the landlord’s second objection: that after years of letting, the tenant’s claim is stale. In Cass. 3rd civ., 4 June 2026, No. 24-11.437, the tenant of a furnished flat sued in 2015 over conditions dating back to 2013, and the courts had to decide what a tenant may still demand years later. The published summary draws a clear double track: « Il en résulte que le locataire d’un local à usage d’habitation est recevable, d’une part, à poursuivre l’exécution forcée en nature de l’obligation de délivrance d’un logement décent tant que le manquement perdure » As long as the breach continues, the tenant can seek a court order forcing the landlord to perform the works in kind; alongside that, the tenant can claim damages for the consequences suffered during the three years before going to court. For a foreign investor, the message is operational: a tenant’s complaint about damp, cold, pests or safety never becomes harmless with age, and ignoring it converts a repairable defect into a court-ordered works programme plus up to three years of backdated compensation.

The statutory anchor behind both rulings is Article 1719 of the Civil Code, which states the landlord’s core obligation: « Le bailleur est obligé, par la nature du contrat, et sans qu’il soit besoin d’aucune stipulation particulière : 1° De délivrer au preneur la chose louée et, s’il s’agit de son habitation principale, un logement décent. » Because the duty exists by the nature of the contract itself, it needs no lease clause to support it — and, symmetrically, no lease clause can remove it. A foreign owner buying an older flat for the Relance logement scheme should therefore treat the 30-percent renovation budget and the decency duty as a single project: the same works that secure the tax benefit (energy retrofit, safety, sanitation) are the works the tenant can compel through the courts. Commission an independent condition survey before purchase, schedule the heavy works before the first letting rather than between tenancies, and keep the état des lieux (check-in inventory) precise, because it will be exhibit number one if decency is ever disputed. Buyers of new flats are not exempt either: where a builder’s defect makes the home unfit, the ten-year strict liability of Article 1792 of the Civil Code — « Tout constructeur d’un ouvrage est responsable de plein droit, envers le maître ou l’acquéreur de l’ouvrage, des dommages, même résultant d’un vice du sol, qui compromettent la solidité de l’ouvrage ou qui, l’affectant dans l’un de ses éléments constitutifs ou l’un de ses éléments d’équipement, le rendent impropre à sa destination. » — gives the owner-investor a direct route against the builder, but it does not suspend what the owner owes the tenant in the meantime.

B. Paris Rents and End-of-Tenancy Traps: the Supplement That Survived and the Termination That Failed

The third ruling concerns money directly, and it will interest every investor targeting Paris. Under the rent-control rules, a landlord in a regulated zone may add a complément de loyer only for features that are exceptional relative to comparable dwellings in the same area and that are specific to the flat itself. In Cass. 3rd civ., 4 December 2025, No. 24-17.930, a Paris landlord charged a 120-euro monthly supplement on top of a 440-euro base rent for a 16-square-metre studio, relying on outstanding light and quiet plus a lift serving the high floor. The tenant challenged the supplement on three fronts: quiet and light were shared by the whole street, a top floor is the norm for such maid’s-room studios, and the lift was already paid for through service charges. The Court rejected the appeal and upheld the supplement, accepting that the flat’s brightness and quiet were rare and highly sought-after characteristics deriving from its high floor rather than from the neighbourhood, with the lift counting only insofar as it lets the tenant enjoy a high floor without its drawbacks: the equipment was considered, in the Court’s words, only as allowing the tenant to benefit from the advantages of a high floor « sans en souffrir les inconvénients », without suffering its inconveniences.

The practical lesson cuts both ways. A supplement can survive, but only if the landlord proves, feature by feature, that the characteristic is both rare in the sector and intrinsic to the dwelling — and never for an amenity the tenant already funds through charges récupérables (recoverable service charges). An investor underwriting a Paris purchase on a rent above the reference ceiling must therefore assemble the justification before the lease is signed: photographs and orientation evidence for light and views, noise measurements or location analysis for quiet, and a check that no element of the supplement duplicates a charged service. The tenant has a parallel remedy when the seller concealed a fundamental nuisance: the courts have annulled sales for erreur sur les qualités substantielles (mistake as to substantial qualities) over undisclosed noise, and the buyer’s protection on that front is the seller’s disclosure duty backed by Article 1641 of the Civil Code on hidden defects: « Le vendeur est tenu de la garantie à raison des défauts cachés de la chose vendue qui la rendent impropre à l’usage auquel on la destine, ou qui diminuent tellement cet usage que l’acheteur ne l’aurait pas acquise, ou n’en aurait donné qu’un moindre prix, s’il les avait connus. » Visit the street at different hours, ask the syndic (managing agent) and neighbours about noise, and make the preliminary agreement record what the seller declared.

The fourth ruling closes a trap at the end of the tenancy. In Cass. 3rd civ., 4 June 2026, No. 24-16.993, a landlord served notice to quit a 8.84-square-metre studio so that works could be carried out, after a final judgment had already declared the room indecent. The Court held that such works cannot supply a legitimate and serious ground for termination: « Dès lors, ne constitue pas un motif légitime et sérieux de congé la réalisation de travaux par le bailleur destinés à remédier à l’indécence du logement dont il avait connaissance lors de la conclusion du bail. » A landlord who knew of the indecency when the lease was signed cannot use the cure as a reason to remove the tenant. The ruling follows a consistent line — a September 2026 decision already held that notice served to fix unfitness the landlord knew about at the outset is invalid — and it matters doubly under the nine-year scheme, where keeping the tenant in place during works, with a temporary rent reduction if enjoyment is impaired, is almost always cheaper than defending an annulled notice. For Paris investors the combined picture is therefore this: capped base rents, supplements that must be proven dwelling by dwelling, tenants who can force works at any time, and no exit through termination when the defect was known from the start. Price those constraints into the acquisition, and the 2026 scheme remains what it was designed to be — a steady, documented yield on a properly maintained flat, supported where needed by the firm’s Paris real estate team for the points where tax, works and tenancy law intersect.

When a tenant reports a problem, the procedure that protects the owner is straightforward and should be followed every time. Acknowledge the complaint in writing within days, arrange access for inspection, and commission an independent assessment where the cause is disputed, such as a leak whose origin may lie in the common parts managed by the syndic. If the common parts are the source, notify the managing agent immediately in writing and claim through the building’s insurance, while keeping the tenant informed of the timeline. Where works inside the flat are needed, agree written access dates with the tenant, record the completed works with photographs and invoices, and confirm closure in writing. Each of these steps creates the paper trail that distinguishes a diligent landlord from a defaulting one if the dispute ever reaches the Paris court, and it also preserves the owner’s parallel claim against a builder or seller whose defect caused the disorder.

Conclusion

The Relance logement scheme gives foreign buyers a defined, time-limited framework — acquisitions from 21 February 2026 to 31 December 2028, nine years of unfurnished letting within rent caps, amortisation of up to 12,000 euros a year — but the tax benefit is only half of the investment. The other half is the landlord’s enforceable duty to deliver and maintain a decent home, a duty no lease clause can waive, actionable by the tenant for as long as it is breached, and enforceable through court-ordered works plus three years of damages. Paris adds the rent-supplement discipline: above-ceiling rents survive only on proven, dwelling-specific features. And when the flat needs heavy works, the landlord cures the defect with the tenant in place rather than through a termination notice. An investor who surveys before buying, budgets the renovation and the capped rent together, documents every invoice and every inventory, and reacts to tenant complaints in weeks rather than years will hold both the tax advantage and a defensible letting.
