That single change reshaped everything about healthcare: the European Health Insurance Card issued in the UK stopped working for residents, residence itself became a condition for joining the French system, and every British household had to answer a concrete question — through which door do I enter French healthcare, and what do I do if the door stays shut? This article gives the full answer. It explains the three lawful routes — the S1 certificate paid for by the United Kingdom, affiliation through work, and the residence-based universal cover known as PUMA — and it sets out the remedies when the local health fund, the caisse primaire d’assurance maladie (CPAM, the local branch of the French health insurance fund that registers residents and pays reimbursements), refuses registration, closes your rights, or sends a bill you dispute. The rules below reflect the law as it stood on 4 October 2026, with the exact statutory wording quoted and linked so you can check every step.

I. How do British residents get French healthcare after Brexit: S1, PUMA or work?

French law starts from a broad promise. In plain terms: anyone who works in France, or who lives here in a stable and lawful way without working, is entitled to have health costs covered. The rest of the system organises how that promise is delivered. For a British reader, three routes matter, and choosing the wrong one is the most common cause of delay. Workers join through their employment. Pensioners and certain posted workers enter with a British S1 certificate under the coordination rules preserved by the Withdrawal Agreement and the Trade and Cooperation Agreement. Everyone else who lives here lawfully but does not work — early retirees, people living on savings or rental income, accompanying family members — joins through residence under the scheme called PUMA (protection universelle maladie, the residence-based universal health cover that replaced the old CMU for adults). Each route has its own paperwork, its own payer, and its own traps.

A. How does the S1 route work for British pensioners, frontier workers and posted workers?

The S1 is a certificate issued by the United Kingdom that shifts the cost of your French healthcare to the British budget while France delivers the treatment. The mechanism comes from the European coordination regulations — Regulation (EC) No 883/2004 on the coordination of social security systems and its implementing Regulation (EC) No 987/2009 — which continue to apply to people covered by the Withdrawal Agreement, and from the social security protocol of the EU-UK Trade and Cooperation Agreement for situations that arose afterwards. The British government summarises the position in its official guidance on healthcare for UK nationals living in France: if you receive a UK State Pension or certain other exportable benefits, if you are a frontier worker, or if you are posted by a UK employer, you may be entitled to an S1, which you then register with the CPAM of your place of residence. Registration matters because it is the CPAM, not the NHS, that issues your French carte Vitale (the green chip card you present to doctors and pharmacies so the system reimburses you automatically) once the S1 is recorded.

French domestic law expressly carves out S1 pensioners from the residence-based scheme, which confirms that the S1 is a route in its own right rather than a supplement. A British retiree who draws only a UK State Pension and holds a registered S1 therefore sits outside PUMA by design: the United Kingdom pays, France provides. The practical consequence is favourable — there is no French means test and no cotisation subsidiaire maladie (the annual contribution some PUMA members with capital income but no employment pay) — but it also means the S1 must genuinely be in place. A pension forecast letter is not an S1. The document you register is the original S1 form sent by the NHS Business Services Authority or, for posted workers, the A1 certificate showing that UK social security legislation continues to apply during the posting. Keep copies of everything, because the CPAM will ask for the S1 number, the date of effect, and proof of identity and address before it opens your rights.

The registration sequence is the same in every département (administrative county), though Paris and the inner suburbs process higher volumes and therefore take longer. First, request the S1 from the UK authority before or just after arrival — pensioners through the NHS Business Services Authority overseas healthcare team, posted workers through HMRC for the A1 alongside the S1 where applicable. Second, file the S1 with the CPAM with your passport, your residence permit or Withdrawal Agreement card, proof of address under three months old, birth certificate with certified translation if the caisse (fund office) asks, and bank details (relevé d’identité bancaire). Third, wait for the attestation de droits (the paper or online statement proving your cover is open) and then the carte Vitale. British S1 holders sometimes report that their first attestation carries a short expiry date. That is usually an administrative renewal marker rather than a loss of rights, but check the online compte ameli (your personal account on the health fund website) and ask the CPAM in writing if the date passes without renewal. For day-to-day treatment you are then treated almost like a French insured person: you consult a médecin traitant (the nominated GP who coordinates your care pathway and whose designation conditions full reimbursement rates), you pay the statutory share where one applies, and the fund recovers the cost from the United Kingdom behind the scenes. The S1 does not cover everything — dental prostheses, optical extras and the daily hospital flat fee (forfait journalier) follow the same rules as for French patients — so most S1 households take a mutuelle (voluntary top-up health insurance) exactly as French families do.

Two misunderstandings cause most S1 failures. The first is confusing the S1 with the GHIC (Global Health Insurance Card, the post-Brexit replacement for the UK EHIC for temporary stays). The GHIC covers medically necessary treatment during a short visit; guidance on applying for a GHIC makes clear it is not a residence document and does not open French permanent cover. A British resident who presents only a GHIC at the CPAM will be turned away, and a British visitor who relies on an S1 abroad will find it is not designed for that purpose either. The second is assuming a posted worker can choose freely between the two systems. A genuinely posted worker covered by a valid A1 stays in the UK system and uses the S1 for care in France. A worker whose posting has ended, whose A1 has expired, or who was hired locally in France belongs in the French system through employment or PUMA instead. If the employer misclassifies the situation, contributions may be claimed in the wrong country, so ask for the A1 in writing and check its dates before registering anywhere. Readers dealing with the employment side of that boundary — contracts, payslips and employer registration — can usefully read the cabinet’s analysis of British hires in France alongside this article, linked through the guide to the salarié card and work authorisation, because residence permits and payroll affiliation often determine which health route is open.

B. How do you join the French system directly through work or PUMA residence?

If you work in France — as an employee, an artisan, a shopkeeper or a company director paying French contributions — affiliation is automatic in principle. Your employer declares you, contributions flow to the URSSAF (the contribution collection agency), and the CPAM opens your health rights from the start of the activity. Self-employed Britons register the business first and are then directed to the general scheme. There is no nationality bar and no separate health application: the payslip or the registration certificate is the evidence. Difficulties arise mainly for frontier situations, such as a Briton living in France but employed remotely by a UK company with no French payroll presence, or for short contracts where the employer delays the declaration. In those cases keep every payslip, the employment contract, and the employer’s declaration receipt, because the CPAM decides on documents, not on explanations. Once affiliation through work is recognised, your minor children are covered as dependants (ayants droit) under the rule examined in Part II, and your spouse is covered either through their own activity or through residence.

The residence route, PUMA, exists precisely for people who do not work but live in France lawfully. It covers early retirees under State Pension age, people living on investment or rental income, students beyond the student scheme in some cases, and inactive family members who hold no S1. Two cumulative conditions govern entry, and both must be documented. Stability first: Article R111-2 of the Social Security Code treats as stably resident persons whose home or principal place of stay is in metropolitan France or the listed overseas collectivities, and provides that, for the benefits concerned, those persons are deemed to have their principal stay in France where they are personally and effectively present “Pendant plus de six mois au cours de l’année civile de versement pour les autres prestations mentionnées au premier alinéa.” The same article adds a sentence applicants should quote back whenever a file stalls on proof: “La résidence en France peut être prouvée par tout moyen.” Tax notices, electricity bills, rent receipts, school certificates and bank statements showing daily life in France all count, and no single document can lawfully be demanded to the exclusion of the rest. Lawfulness second: Article R111-3 of the Social Security Code requires that beneficiaries, apart from those covered by another State’s scheme under European rules or international conventions, be persons “qui sont de nationalité française ou sont en situation régulière au regard de la législation sur le séjour des étrangers en France.” For a Briton that means a valid Withdrawal Agreement residence card, a long-stay visa followed by a residence permit, or any other current permit — the implementing ministerial order lists the accepted documents. The condition is assessed on the day of the application, including where the file is examined after the document’s expiry date, as paragraph II of the same article confirms. An expired card with a renewal receipt (récépissé) therefore does not automatically defeat the application, though some CPAM desks wrongly treat it as fatal, which is exactly the kind of refusal developed in Part II.

The statute organises the content of cover once affiliation is granted. Article L160-8 of the Social Security Code lists what the sickness risk cover includes — general and specialist medicine, dental care and prostheses, pharmacy, laboratory examinations, hospitalisation and rehabilitation, transport in defined cases, preventive acts, and related items — and subsequent articles organise daily allowances and maternity. Low-income households may also qualify for the means-tested top-up called complémentaire santé solidaire (the no-charge or low-cost supplementary cover that pays the part the basic scheme leaves behind). Article L861-1 of the Social Security Code opens that top-up to “Les personnes mentionnées à l’article L. 160-1” on income conditions: at no charge where household resources fall below a decree ceiling, and against a financial contribution where resources sit between that ceiling and the same ceiling increased by 35 per cent. British early retirees on modest private pensions and young families starting out should test eligibility rather than assume the top-up is reserved for French nationals; the criterion is affiliation plus resources, not nationality. Conversely, households with significant capital income but no employment may be asked for the cotisation subsidiaire maladie, an annual contribution assessed on such income above a threshold. It is a contribution, not a fine, and disputing it follows the contribution litigation path rather than the care-refusal path — a distinction worth keeping because the two procedures have different forms and time limits. The official English-language pages of the health insurance system, hosted on ameli.fr in English, describe the practical steps for registration and reimbursement and are a useful parallel reference alongside the statutes, though they do not replace the legal texts when a file is disputed.

II. What happens when the CPAM says no, sends a bill, or care goes wrong?

Refusals follow patterns, and recognising the pattern tells you which remedy to use. The CPAM may refuse initial affiliation for alleged lack of stability or lawfulness of residence; it may close existing rights after a stay abroad or an administrative review; it may refuse a specific reimbursement, particularly for care received in the United Kingdom or in another country; or it may claim contributions such as the cotisation subsidiaire maladie. Each of these is a decision that must be reasoned, notified, and challenged in the right order. French social security disputes are not brought straight to court. The standard ladder is: prior appeal to the fund’s internal appeal board (commission de recours amiable, usually shortened to CRA, the body that re-examines the file before any judge can be seized), then the specialist social division of the judicial court (tribunal judiciaire, pôle social), then the Court of Appeal, with strictly enforced time limits at every rung. Missing the CRA stage or filing out of time loses cases that would otherwise have been won, so the procedural discipline below matters as much as the substantive right.

A. How do you challenge a CPAM refusal, a closure of rights, or a reimbursement bill?

Start with the paper trail. Every refusal should state its legal basis, the facts relied on, and the avenues and time limits for appeal. If the letter merely says cover is refused without citing a text, ask in writing for the full reasoning and keep proof of posting. Then file the CRA appeal promptly — the standard period printed on CPAM decisions is two months — setting out the facts chronologically, enclosing numbered exhibits, and citing the exact articles. A residence-based file should quote Article L160-1 for the principle, Article R111-2 for stability including the sentence “La résidence en France peut être prouvée par tout moyen.”, and Article R111-3 for lawfulness assessed on the application date. An S1 file should enclose the S1 itself, the proof of registration request, and the UK issuing authority’s details, and should remind the fund that pensioners covered by a European regulation or international agreement sit under the exclusion in Article L160-6 rather than under PUMA. Send the CRA letter by registered post with acknowledgement of receipt (lettre recommandée avec accusé de réception) or through the compte ameli messaging function with a saved copy, and diarise the reply date: silence for two months counts as an implied rejection (décision implicite de rejet) that can itself be taken to court.

The courts apply these texts literally, which is why documentation beats argument. In a judgment of 17 March 2026 concerning a PUMA application, the social division of the Lille judicial court recorded that the fund had “a notifié à Mme [J] [L] [W] épouse [B] un refus d’affiliation au motif qu’elle ne remplissait pas les conditions de régularité attachée au droit de séjour de plus de trois mois des ressortissants européens inactifs”, then tested that refusal against the statutes, recalling that under Article L160-1 “Toute personne travaillant ou, lorsqu’elle n’exerce pas d’activité professionnelle, résidant en France de manière stable et régulière bénéficie, en cas de maladie ou de maternité, de la prise en charge de ses frais de santé dans les conditions fixées au présent livre.” (Tribunal judiciaire de Lille, Pôle social, 17 March 2026, RG 25/01909, official judgment record 69c5969ecdc6046d47150e55.) The reasoning is instructive beyond its facts: the tribunal did not treat European inactivity rules as a trump card but examined stability and lawfulness concretely, on the evidence, at the relevant date. British applicants refused on similar generic grounds — “insufficient resources”, “no comprehensive sickness insurance”, “permit under review” — should build the file the same way: marriage certificate or civil partnership evidence where relevant, lease or title deed, utility bills across the seasons, tax assessment, child’s school certificate, employment or registration evidence for the working spouse, and the residence document with any renewal receipt. Where the fund demands a document that does not exist for Britons under the Withdrawal Agreement, say so expressly and produce the closest equivalent; adjudicators understand equivalence arguments when they are documented, but they cannot guess them.

Care received outside France generates a second family of disputes, and here a different judgment helps. The social division of the Poitiers judicial court, ruling on 3 February 2025, “CONDAMNE la Caisse Primaire d’Assurance Maladie de la Vienne à prendre en charge l’intégralité des soins prodigués à Madame [N] en Suisse le 24 mars 2022” after the fund had refused reimbursement of CHF 1,346.50 for unexpected treatment (Tribunal judiciaire de Poitiers, CTX Protection sociale, 3 February 2025, No 23/00210, official judgment record 67a14243072c53c9d62b97f2). The framework the tribunal applied is the one in Article R160-4 of the Social Security Code, which organises flat-rate reimbursement of unexpected care received outside the EU/EEA/Switzerland area and exceptional reimbursement after medical advice where appropriate care was unavailable in France. For Britons the practical map is: unexpected necessary care during a stay in the United Kingdom is handled through the GHIC or the relevant coordination document, not through French reimbursement; planned care in the United Kingdom generally needs prior authorisation; and unexpected care in a third country while resident in France is claimed from the CPAM with medical evidence of the sudden nature of the illness and itemised paid invoices. File quickly, in French or with translations, because limitation and document-decay problems grow with every month.

Where the dispute is urgent — imminent surgery, a closed file blocking all reimbursements, a demand enforced while the CRA appeal is pending — interim relief before the administrative or judicial judge may be available alongside the main appeal. Against administrative decisions, Article L521-1 of the Administrative Justice Code allows the interim judge, seised with a request for suspension, to order that “peut ordonner la suspension de l’exécution de cette décision, ou de certains de ses effets, lorsque l’urgence le justifie et qu’il est fait état d’un moyen propre à créer, en l’état de l’instruction, un doute sérieux quant à la légalité de la décision.” Social security fund decisions go to the judicial courts rather than the administrative courts, but the same discipline — act fast, show urgency, plead one serious ground clearly — governs applications for interim measures and for enforcement stays there. In all cases the general litigation deadline in administrative matters is worth memorising as a benchmark: Article R421-1 of the Administrative Justice Code states that “La juridiction ne peut être saisie que par voie de recours formé contre une décision, et ce, dans les deux mois à partir de la notification ou de la publication de la décision attaquée.” Social division time limits are equally strict and are printed on each notification, so read the footer of every letter first and the reasoning second. For Paris and Île-de-France readers, two local points deserve emphasis. First, the Paris CPAM handles very large post-Brexit caseloads, and files are sometimes closed automatically after long inactivity or returned addresses; if your compte ameli suddenly shows no rights, check the address on file and the registered S1 dates before assuming a substantive refusal. Second, jurisdiction follows the fund that decided: refusals from the Paris CPAM go through its CRA and then the Paris judicial court, while residents of Hauts-de-Seine, Seine-Saint-Denis and Val-de-Marne answer to their own funds and courts, with the Paris Court of Appeal above several of them. Filing in the wrong court wastes the deadline, so copy the fund’s exact name and address from the decision letter onto every appeal.

B. How are your children, hospital bills and planned or emergency care abroad handled?

Children are covered generously but through precise rules that differ before and after sixteen. Article L160-2 of the Social Security Code provides that, by derogation from Article L160-1, minor children who do not work benefit from cover for their health costs as dependants of an insured parent “les enfants mineurs n’exerçant pas d’activité professionnelle qui sont à sa charge, à condition que la filiation, y compris adoptive, soit légalement établie ou qu’ils soient pupilles de la Nation ou enfants recueillis.” Dependant status ends in the year of majority on a date fixed by decree, and “L’enfant qui a atteint l’âge de seize ans peut demander, selon des modalités fixées par décret, à bénéficier, à titre personnel, de la prise en charge de ses frais de santé en cas de maladie ou de maternité.” For a British family this means: register each child on a parent’s file at affiliation with birth certificates and certified translations; at sixteen, consider the personal-cover option so the teenager’s reimbursements and médecin traitant designation run in their own name; and at eighteen, ensure the young adult holds personal cover rather than drifting uninsured between a parent’s file and a student or work scheme. Blended families and shared-custody arrangements should attach the custody order and proof of the child’s actual residence, because the fund allocates the child to the file of the household where the child principally lives. Where parents separate across the Channel, coordination rules decide which State is primarily competent for family benefits and derived health rights, so keep both countries’ decisions and tell each fund about the other file.

Hospital treatment follows the same affiliation logic but with its own billing vocabulary that surprises British patients. Public hospitals bill the fund directly for the covered share (tier payant or direct settlement depending on the department), while the patient remains liable for the ticket modérateur (the statutory co-payment left to the patient), the daily flat fee, and any excess fees (dépassements d’honoraires) charged by doctors operating in the unregulated-fee sector (secteur 2). Always ask before admission whether the practitioner works in secteur 1 (regulated fees) or secteur 2, and whether the clinic is conventioned (conventionné, bound by the national fee agreement). A mutuelle typically absorbs the co-payment and much of the flat fee; without one, even routine surgery leaves a balance that British newcomers find startling after the NHS. Keep the bulletin de situation or admission statement, the itemised invoice, and the fund’s reimbursement statement (décompte), because any challenge — wrong sector billed, médecin traitant pathway penalty wrongly applied, emergency exemption missed — is argued from those three documents. Maternity, chronic illness (affection de longue durée, the registered long-term condition scheme that lifts the co-payment for the condition concerned), and workplace accidents each carry enhanced cover, but each requires its own declaration: declare the pregnancy early, have the GP file the long-term condition protocol, and ensure any accident at work is declared by the employer within the statutory time so the accident-at-work fund, not the ordinary sickness fund, bears the cost.

Cross-border care deserves a clear decision tree because British families genuinely live between two countries. Emergency necessary care during a temporary stay in the United Kingdom: use the GHIC or the Withdrawal Agreement document that matches your status, and keep the NHS treatment evidence. Emergency care in France for a British visitor: the GHIC or travel insurance pays, and any French top-up is claimed at home, not from the CPAM. Care in France for a British resident: present the carte Vitale or the attestation de droits, follow the médecin traitant pathway, and claim normally. Planned treatment in the United Kingdom for a French-resident Briton: seek prior authorisation through the CPAM before travelling, with the specialist’s referral and cost estimate, because retrospective claims for planned foreign care are the most frequently rejected files in this area. Care in a third country outside the EU/EEA/Switzerland while resident in France: claim under Article R160-4 with proof of the sudden onset and of payment, as the Poitiers case illustrates. In every branch, translate key medical terms, keep boarding passes or booking confirmations proving the temporary nature of the stay where relevant, and never surrender original invoices without retaining certified copies. Readers also managing the tax side of a Franco-British life — residence, treaty tie-breakers and first returns — will find the companion analysis of the British arrival year, first tax return and treaty tie-breaker a natural complement, since tax residence evidence often doubles as the stability proof the CPAM requests.

Conclusion

British healthcare in France after Brexit is neither automatic nor impenetrable: it is documentary. Pensioners and posted workers who hold a valid S1 and register it promptly receive French treatment at British expense without entering PUMA. Workers join through their activity from day one. Everyone else who lives here in a stable and lawful way is entitled to PUMA on proof of six months’ effective presence and a current residence document, with residence provable by any means and lawfulness judged on the application date. When the CPAM refuses, closes rights, or rejects a foreign-care bill, the remedy is procedural before it is rhetorical: a reasoned CRA appeal within the printed time limit, exhibits in logical order, the exact statutory sentences quoted above, and then the social division of the judicial court if the fund maintains its position. Build the file as this article describes — S1 or residence evidence, children’s certificates, hospital statements kept together — and the system that looks opaque from London becomes manageable from your French address. The cover, once opened, works like that of any French insured household, with the same médecin traitant, the same reimbursements, and the same reasons to hold a mutuelle for the balance.

British in France after Brexit: S1 registration, PUMA residence cover, GHIC limits, CPAM refusals and how to challenge them — the complete legal guide.

[80312,80314

post-2138434","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-british-desk","category-decryptage
<!-- This site is optimized with the Yoast SEO Premium plugin v28.2 (Yoast SEO v28.2) -
