Then the post arrives at your British address: a quarterly demand for several hundred euros from a syndic you have never met, to pay for a lift you never use, a roof you have never seen, and a general meeting you never attended. Somewhere in the envelope, or in an email you never opened, the owners of the block voted through a five-figure programme of works, and your share is now due. This is the ordinary shock of French copropriété, the system of joint ownership that governs nearly every block of flats in France, and it binds British owners exactly as it binds French ones. Since Brexit changed nothing in this corner of French private law, the rules that decide what you pay, how the vote was taken and how you fight it are the same Act No. 65-557 of 10 July 1965 on the status of jointly owned buildings (statut de la copropriété des immeubles bâtis) that has governed French blocks for sixty years.

This guide explains, for a British reader, what a French service-charge bill is made of, how the meeting that fixed it works when you live across the Channel, and how you challenge a decision you consider unlawful. It covers the two-month guillotine for contesting a meeting, the April 2026 ruling of the Cour de cassation that punishes owners who leave registered letters uncollected, the legal mortgage the block holds over your flat when you do not pay, and what happens to unpaid charges when you sell. French terms appear in italics with a plain-English explanation each time they first occur.

I. Your Money and Their Votes: How French Copropriété Charges and Meetings Bind a British Owner

A French copropriété is the legal regime of a building divided into private flats (lots) plus shared areas (parties communes) such as the entrance hall, stairs, lift, roof and courtyard. Every owner belongs automatically to the syndicat des copropriétaires, the owners’ association, which is run day to day by its managing agent, the syndic — usually a professional firm, sometimes a fellow owner. The association votes a budget, the agent spends it, and each owner pays a share. If you own a studio in Nice and live in Manchester, you are a full member of that association with full obligations, whether or not you ever open the letters.

A. How the British Owner Pays for the French Block: Charges, Works Funds and Recovery

The starting rule is that every owner must contribute, and the statute says so in these exact words: “Les copropriétaires sont tenus de participer aux charges entraînées par les services collectifs et les éléments d’équipement commun en fonction de l’utilité objective que ces services et éléments présentent à l’égard de chaque lot, dès lors que ces charges ne sont pas individualisées.” In plain English, you pay for shared services and equipment according to the objective usefulness of each service to your flat: a ground-floor owner can lawfully refuse to pay for the lift, because the lift is of no use to a flat on the ground floor, while every owner pays for the roof. A second paragraph of the same article deals with conservation, maintenance and administration of the shared areas, shared in proportion to the relative values of the private parts, and it adds the contribution to the works fund created for major future works. Your exact shares, expressed in thousandths called tantièmes, are fixed by the building’s bylaws, the règlement de copropriété, which must also state the calculation method used.

In practice the syndic sends quarterly demands, called appels de fonds, based on the provisional budget voted by the meeting, followed by an annual balancing statement. Read the breakdown before you pay: French blocks distinguish general charges shared by all, special charges for equipment such as lifts or heating, and exceptional demands for voted works. A British owner who lets the flat should also remember that these charges are the owner’s debt to the association, even if the tenancy agreement passes the recoverable part on to the tenant. If the tenant reimburses you late, the association still pursues you, not the tenant. For the wider yearly cost of owning, including the local taxes that sit on top of these private-law charges, see our guide to what a British owner pays each year on a French home, from taxe foncière to wealth tax.

Falling behind, even by accident because the demand went to an old address, is expensive by design. The Meeting You Missed While Living in Britain: Summons, Proxies and Majorities

The assemblée générale, the yearly general meeting of owners, is where your money is voted: the budget, the works, the choice of managing agent, the level of each demand. The meeting can only decide what is on its agenda, and you must be summoned properly. The implementing decree provides: “Sauf urgence, cette convocation est notifiée au moins vingt et un jours avant la date de la réunion, à moins que le règlement de copropriété n’ait prévu un délai plus long.” Unless there is genuine urgency, the summons must reach you at least twenty-one days before the meeting, longer if the building’s bylaws say so. The same article requires the summons to state the place, date and hour, to set out each question put to the vote, and to tell you where the supporting documents for the charges can be inspected. For a British owner this is the first practical checkpoint: if the syndic still sends everything to a former French address, or to an email address you never check, you will learn about the meeting only from the minutes, when the time to act is already running.

You do not need to fly to Nice or Paris to vote. Every summons must now enclose a postal voting form, because the decree states: “Le formulaire de vote par correspondance mentionné au deuxième alinéa de l’article 17-1 A est joint à la convocation.” Return the form in time and your vote counts as if you were in the room. Alternatively you can give a proxy (pouvoir) to someone you trust: a neighbour, a friend, a fellow British owner in the same block, or your letting agent. But proxies are capped by statute, which provides: “Chaque mandataire ne peut, à quelque titre que ce soit, recevoir plus de trois délégations de vote.” Nobody can collect more than three proxies, however they are labelled, subject only to a narrow exception where the proxy-holder’s own votes plus the proxies stay within ten per cent of the block’s total. So the common British arrangement of asking one bilingual neighbour to carry the votes of six absent compatriots is unlawful, and the extra votes can be struck down with the resolutions they carried. The same article shuts the managing agent out of the game entirely: “Lorsque le syndic a reçu des mandats sans indication de mandataire, il ne peut ni les conserver pour voter en son nom, ni les distribuer lui-même aux mandataires qu’il choisit.” Blank proxies sent back to the syndic cannot be used by the agent to vote in its own name or handed out to friendly hands. Each owner votes in proportion to their thousandths, with one correction: an owner holding more than half of the block’s votes is reduced to the total of all the others, so a single investor cannot simply outvote every resident.

Majorities are where British owners lose the most money, because French law grades them and the expensive decisions sit high on the ladder. Ordinary business — approving the accounts, voting the budget, ordering conservation works, appointing the managing agent’s rivals to the supervisory council (conseil syndical) — passes by a simple majority of the votes actually cast: “Les décisions de l’assemblée générale sont prises à la majorité des voix exprimées des copropriétaires présents, représentés ou ayant voté par correspondance, s’il n’en est autrement ordonné par la loi.” Abstentions do not count, which means a meeting attended by few owners can commit the whole block on ordinary spending. The next rung, the absolute majority of the votes of all owners whether present or not, governs the decisions that change the building: “Ne sont adoptées qu’à la majorité des voix de tous les copropriétaires les décisions concernant :” followed by a long list that includes, at item (n), “L’ensemble des travaux comportant transformation, addition ou amélioration ;” Facade insulation, a new entryphone system, energy-saving works, electric-vehicle charging points in the car park — the works that generate the bills British owners complain about most — all require that absolute majority. Above that sit matters demanding a two-thirds double majority and, at the very top, unanimity for the gravest acts such as selling off part of the shared areas. Before assuming a works vote was invalid, count carefully which ladder rung it stood on: challenging a budget adopted by simple majority because you believe works needed an absolute majority is a different argument from challenging the absolute-majority vote itself, and French courts examine the classification first.

Two recent reforms make distance management easier but punish inattention. First, paper is no longer the only channel: “Les notifications et les mises en demeure sont valablement faites par voie électronique.” Summonses, minutes and formal demands can lawfully arrive by email, and a decree No. 2025-1292 of 22 December 2025, published in the Journal officiel of 24 December 2025, has just modernised the notification machinery of the 1967 decree. A British owner can ask at any time to go back to post, and the agent must explain how, but silence means deemed receipt at an inbox. Give the syndic a monitored email address and a reliable British postal address, confirm both in writing every year, and keep the proofs. Second, for owners in Paris and the inner suburbs, remember that the competent court is the tribunal judiciaire of the building’s location — the Paris court for a Paris flat — that Paris meetings follow the same national statute with no local shortcut, and that Parisian managing agents routinely conduct the whole cycle, summons to recovery, by email and bailiff’s act within weeks. Distance from the building has never excused an owner, and Parisian practice makes that principle concrete.

II. Challenging the Bill: How a British Owner Contests a French Block Vote

French law gives every unhappy owner a remedy, but it is fenced with deadlines that forgive nobody. The system distinguishes two kinds of attack: striking down an unlawful meeting decision within a short guillotine period, and relying on rules that no meeting can override at any time. A British owner needs both, because the first protects against a rigged vote last spring while the second protects against bylaws that were unlawful from the start.

A. Challenge the Vote Within Two Months or Lose the Right for Ever

Only owners who voted against a resolution or who were absent — the opposants ou défaillants — can challenge it, and the statute attaches a guillotine: “Les actions en contestation des décisions des assemblées générales doivent, à peine de déchéance, être introduites par les copropriétaires opposants ou défaillants dans un délai de deux mois à compter de la notification du procès-verbal d’assemblée, sans ses annexes.” Miss the two months and the action is barred (déchéance), however unlawful the vote was. On 16 April 2026 the Third Civil Chamber of the Cour de cassation, ruling in a case about exactly this point and published for the profession, gave an answer every absent owner should memorise. Whether or not you collected the registered letter, the two months run from the day after its first presentation at your home. For a British owner this ruling (Cass. 3e civ., 16 April 2026, No. 24-18.842, section formation, published in the Bulletin) is a blunt warning: an avis de passage sitting in a French letter box while you are in Kent, or a registered letter returned unclaimed to the syndic, does not pause anything. Arrange mail forwarding or a local contact, collect every registered letter immediately, and diary the two months from first presentation, not from the day you finally read the minutes.

Acting in time has a useful side effect for works you oppose. The statute suspends the works while the guillotine runs: “Sauf urgence, l’exécution par le syndic des travaux décidés par l’assemblée générale en application des articles 25 et 26 de la présente loi est suspendue jusqu’à l’expiration du délai de deux mois mentionné au deuxième alinéa du présent article.” Except in emergencies, works voted under the heavy majorities cannot start until the two months expire, which gives a swift challenger real leverage to negotiate. The grounds for challenge are wide: defective summons, missing agenda item, wrong majority, miscounted proxies beyond the three-proxy cap, a vote taken on a question never put to the meeting, or a decision that contradicts the bylaws or the statute. You do not need to show personal financial loss beyond the unlawful decision itself. If the court annuls the resolution, the decision is treated as never having existed, against every owner, and sums already collected under it must be unwound.

Alongside the two-month action sits a timeless weapon. The statute declares: “Toutes clauses contraires aux dispositions des articles 1er, 1-1, 4, 6 à 37, 41-1 à 42-1 et 46 et celles du décret prises pour leur application sont réputées non écrites.” Any bylaw clause contrary to the listed protections is deemed unwritten — treated by the judge as if it never existed — and where the clause concerns the sharing of charges, “Lorsque le juge, en application de l’alinéa premier du présent article, répute non écrite une clause relative à la répartition des charges, il procède à leur nouvelle répartition.” A 1970s schedule that dumps lift costs on a ground-floor flat, or that exempts the developer’s retained lots from charges, can be struck down and reallocated by the court years later, with the new sharing taking effect from the first day of the accounting year after the judgment becomes final. This action has no two-month guillotine, but it requires proving the clause truly contradicts the statute rather than merely displeasing you, and it runs before the same local civil court with a lawyer.

B. What Your Flat May Be Used For, and How Unpaid Charges Follow a Sale

British owners sometimes discover that the block, not the town hall, decides what they may do inside their own flat. Every building has a règlement de copropriété that fixes the permitted use (destination) of each part: purely residential (bourgeois), mixed residential and professional, or commercial. Running a year-round holiday let, converting a cellar into a bedroom, knocking through a load-bearing wall, installing air-conditioning units on the facade or parking a trade van in a residential courtyard can each breach the bylaws and expose the owner to a court order to restore the premises, even where no neighbour complains of noise. The Cour de cassation polices these boundaries closely: ruling on a dispute about a storeroom turned first into offices and then into a recording studio, it held that changing a lot to a liberal profession breaches the bylaws distinctly from changing it to commercial use, “alors que l’affectation d’un lot à l’exercice d’une activité libérale est une infraction au règlement de copropriété distincte de son affectation à une activité commerciale” (Cass. 3e civ., 8 June 2017, No. 16-16.565). The lesson for a British owner is to read the use clause before converting, letting or working from the flat: the association can sue to stop the use and to undo the works, and an earlier decision of the same chamber confirms that long toleration of a breach does not rewrite the bylaws (Cass. 3e civ., 26 May 2016, No. 15-14.475, on the visa of article 42 of the 1965 Act). If your plans include regular short letting, check both the bylaws and the meeting minutes for any clause or vote restricting furnished tourist rental, and take advice before the first booking rather than after the first writ.

Selling the flat does not wash away what you owe the block — and, since a 2024 reform, owing the block can stop the sale itself. When the seller cannot show the notary (notaire) a recent clearance certificate from the syndic, the statute orders: “avis de la mutation doit être donné par le notaire au syndic de l’immeuble par lettre recommandée avec avis de réception dans un délai de quinze jours à compter de la date du transfert de propriété.” The notary warns the agent within fifteen days of the transfer, and the agent can then freeze part of the price by a formal objection (opposition) served at its elected address, which “Cette opposition contient élection de domicile dans le ressort du tribunal judiciaire de la situation de l’immeuble et, à peine de nullité, énonce le montant et les causes de la créance.” Any payment of the price in breach of a valid objection cannot be set up against the association, and a valid objection operates as enforcement of the legal mortgage described above. A British seller who assumed the arrears would quietly follow them back to Britain can therefore find the notary retaining the disputed sum and paying it to the association within three months unless someone takes the objection to court.

The sharper edge, in force since April 2024, bites before completion. The notary must now notify the syndic of the buyer’s identity ahead of the deed, the agent has one month to certify whether that buyer — or their spouse, civil partner, company directors or partners — already owns in the building and owes it money unpaid forty-five days after a formal demand, and the statute is brutal about the result: “Si le copropriétaire n’est pas à jour de ses charges au sens du 2° du présent II, le notaire notifie aux parties l’impossibilité de conclure la vente.” If the buyer is already a debtor of the block, the notary notifies both sides that the sale cannot proceed. A British investor buying a second flat in a building where they already own one, or a couple buying jointly where one partner already owes arrears on another lot, must therefore clear every debt to the association before signing anything, and should obtain the agent’s certificate early rather than discovering the blockage at the signing table. Where a preliminary contract was signed first, the buyer has thirty days from the notary’s notification to pay the association, failing which the preliminary contract is deemed void at the buyer’s fault.

Conclusion

Owning a French flat from Britain means belonging to a small private democracy that votes your money in your absence and enforces its decisions against your property. Pay the quarterly demands on time and to the right address, because reminders, bailiffs and mortgages are charged to the defaulter alone. Vote every meeting by post or by a lawful proxy, because ordinary spending passes on the votes of whoever turns up and heavy works pass on an absolute majority you could have joined. Above all, treat every registered letter from the syndic as urgent: since the April 2026 ruling of the Cour de cassation, the two months to challenge a meeting run from the day after first presentation of the minutes, collected or not, and an uncollected letter protects nothing. Check the bylaws before changing the use of the flat, and clear every euro owed to the block before buying or selling another lot in the same building. The block’s rules are technical, but they are all written down, all dated, and all open to challenge by an owner who acts within time.

A French service-charge bill lands at a British address for a flat near Nice.
