Your English friends tell you that France abolished wealth tax years ago. Your French neighbour tells you the opposite: with a London house and a Paris flat, you are exactly the person the impôt sur la fortune immobilière (IFI) — the annual French tax on property wealth — is designed to catch. After Brexit, this question has become one of the most expensive traps for British newcomers, because the answer depends on a date, a threshold and a five-year shield that most arrival guides never mention. This guide explains, for a British reader settling in France, when a newly arrived resident becomes liable to IFI, whether a house kept in England counts, how the five-year partial exemption for newcomers works in practice, and how to value, declare and challenge the bill with the exact legal texts and court decisions behind each step.

I. Do you pay French IFI in your first years as a French resident?

A. When does a British newcomer become liable: the 1 January test and the 1.3 million euro threshold?

IFI is an annual tax on net property wealth. Article 964 of the Code général des impôts (the French general tax code) states that the tax applies where the relevant assets exceed a single threshold: “Sont soumises à cet impôt, lorsque la valeur de leurs actifs mentionnés à l’article 965 est supérieure à 1 300 000 €” (article 964, Code général des impôts, on Légifrance). Below that figure, nothing is due. Above it, the whole machinery of valuation, declaration and progressive rates starts to move. The same article fixes the assessment date once and for all: “Les conditions d’assujettissement sont appréciées au 1er janvier de chaque année.” Your position on 1 January of the tax year decides everything; a purchase completed on 15 January counts only the following year, while a sale completed on 20 December still leaves you liable for the year just ending.

For a British person who has become a French tax resident — broadly, someone whose home, main professional activity or centre of economic interests is in France — the default rule is worldwide liability. French residents are taxed on French and foreign property alike, whereas non-residents are taxed only on French property and on shares representing French property. The tax administration summarises the position in plain terms: you are liable when your net taxable property wealth exceeds 1,300,000 euros on 1 January (see Je déclare mon impôt sur la fortune immobilière, impots.gouv.fr and Impôt sur la fortune immobilière: personnes et biens concernés, service-public.fr). For couples, note that married couples, civil partners under a pacte civil de solidarité (PACS, the French registered civil partnership) and recognised cohabitants are taxed jointly, so the threshold applies to the household, not to each person separately.

What counts toward the threshold is defined by article 965: “L’assiette de l’impôt sur la fortune immobilière est constituée par la valeur nette au 1er janvier de l’année” (article 965, Code général des impôts, on Légifrance). Net means after deducting qualifying debts, which matters enormously for newcomers carrying a mortgage on either side of the Channel, as explained in Part II. It covers built and unbuilt property, property rights such as usufruit (a life interest or right to use another person’s property and take its income), and shares in companies — including a British family holding or a French société civile immobilière (SCI, a non-trading French property company) — in proportion to the underlying French or foreign bricks they represent. Children’s property under legal administration is added to the parents’ base. Take a concrete Paris example: a British couple jointly holding a Paris flat valued at 950,000 euros, a house in Kent valued at 600,000 euros and a small buy-to-let in Lyon valued at 250,000 euros holds 1,800,000 euros of gross property. If they are fully within the worldwide rule, they cross the threshold and must compute the tax, subject to deductible loans. If the five-year newcomer shield described below still protects them, only the French assets count, and the analysis changes completely.

Practical point for the first year: newcomers often discover IFI through the income-tax return, not through any separate demand. If you arrived during 2025 and filed your first French income-tax return in spring 2026, the return is also the vehicle for the IFI declaration, and the administration expects you to have measured your 1 January 2026 position yourself. Readers dealing with that first filing cycle should also read our companion guide on how a British newcomer files a first French tax return and challenges a wrong bill, and those still sorting out their residence papers should start with our guide on which long-stay visa and residence card a British newcomer needs and how to challenge a refusal.

B. How does the five-year shield for newcomers actually work, and does your English house escape the tax?

The most valuable sentence in the IFI code for a British arrival sits inside article 964 itself. After laying down the worldwide rule for French residents, the article carves out newcomers: “les personnes physiques mentionnées au premier alinéa du présent 1° qui n’ont pas été fiscalement domiciliées en France au cours des cinq années civiles précédant celle au cours de laquelle elles ont leur domicile fiscal en France ne sont imposables qu’à raison des actifs mentionnés au 2°.” In ordinary English, a person who was not fiscally domiciled in France during the five calendar years before the year they settled in France is taxed, for IFI purposes, only on the same base as a non-resident — French property and shares representing French property. Your house in Kent, your flat in Manchester and your shares in a purely British investment company holding no French bricks drop out of the IFI base entirely while the shield lasts. The shield then runs for a fixed period: it applies “jusqu’au 31 décembre de la cinquième année qui suit celle au cours de laquelle le domicile fiscal a été établi en France” (article 964, Code général des impôts, on Légifrance).

Three conditions deserve close attention because each generates real disputes. First, the five-year absence test looks at fiscal domicile, not nationality or passports. A British citizen who lived in Lyon until 2021, spent three years in London and returned in 2025 fails the test and gets no shield, while a lifelong Londoner arriving for the first time in 2025 passes it. Second, the shield covers only non-French assets; French assets remain fully taxable from day one, and the 1.3 million euro threshold is then measured against French assets alone. A newcomer whose Paris flat is worth 1,450,000 euros owes IFI from the first year despite the shield, because the shield does not exempt French property — it merely excludes foreign property from the count. Third, the timetable is counted in calendar years from establishment, ending on 31 December of the fifth following year, so someone establishing French fiscal domicile in 2025 keeps the shield for 2025 through 2030 and enters the full worldwide regime on 1 January 2031. Mark that date now: the year the shield expires is the year most British families face their first worldwide assessment, and it is also the year to commission a proper valuation of the retained English property in good time.

Consider two worked examples. The Harrisons move from Surrey to Bordeaux in June 2025. They keep a Surrey house worth 700,000 euros and buy a Bordeaux house worth 900,000 euros with a 300,000 euro mortgage. For IFI 2026, the shield applies: only the Bordeaux house counts, at 900,000 euros gross, minus the qualifying loan, leaving 600,000 euros — below the threshold, so no IFI. The Patels, by contrast, move to Paris in 2025, keep a London flat worth 1,100,000 euros and buy a Paris apartment worth 1,500,000 euros mortgage-free. The shield excludes the London flat, but the Paris apartment alone at 1,500,000 euros crosses the threshold, so IFI is due on the French base from the first year. When the shield expires, both families must add their English property back into the base, and the Harrisons in particular should expect to cross the threshold at that point. Readers holding French property through a family company rather than directly should compare this with our analysis of how British family trusts are declared and taxed to IFI in France, because shares representing French property are pulled into the base even where the legal owner is a foreign structure.

A final boundary for this section: the shield concerns IFI only. It does not exempt your English rental income from French income tax, it does not remove the annual taxe foncière (the French local property tax paid by owners) on your French home, and it does not change what happens when you sell. Capital gains on a later sale are taxed under a different article, 150 U of the same code (article 150 U, Code général des impôts, on Légifrance), where the shield has no equivalent. Plan the two taxes separately: IFI asks what you hold each 1 January, capital gains tax asks what you sell and when.

II. How do you value, declare and challenge the bill?

A. What goes into the base and what can you deduct: valuation, mortgage debt and the rate scale?

Valuation starts from a simple principle with demanding consequences. Article 973 provides that “La valeur des actifs mentionnés à l’article 965 est déterminée suivant les règles en vigueur en matière de droits de mutation par décès.” (article 973, Code général des impôts, on Légifrance). In practice this means open-market value — the price a willing buyer would pay — assessed property by property on 1 January, not purchase price, not insured value, and not a national index. The same article grants one major relief: a 30 per cent reduction on the market value of a property occupied as the owner’s main residence. For a British newcomer whose Paris apartment is genuinely the main home, that reduction cuts 450,000 euros off a 1,500,000 euro valuation before any other computation, and it is frequently the difference between liability and no liability. Only one property per jointly taxed household can benefit. English homes kept as second properties never qualify for this reduction within IFI, and British concepts such as council-tax bands or Land Registry price-paid data do not determine French market value, though comparable sales help evidence it.

How the administration proves an undervaluation was examined by the Cour de cassation (France’s supreme court for civil and criminal matters) in a leading wealth-tax valuation case. The Court upheld an assessment where “la proposition de rectification décrivait le bien à évaluer en présentant sa localisation, son année de construction, sa structure et la distribution des pièces” — the correction notice described the property with its location, year of construction, structure and room layout — and where each comparable sale was documented with address, year, construction material, number of floors, terrace or garden and weighted floor area (Cass. com., 27 March 2019, appeal no. 18-10.933, full decision on courdecassation.fr). The lesson for a British owner in Paris or the inner suburbs is direct: the administration wins when it produces three genuinely comparable local sales with documented characteristics, and it loses when it relies on bare averages. Mirror that method when you self-assess. Keep three genuinely comparable sales from the same arrondissement or commune, adjust openly for condition, floor, lift, garden and outlook, and file the working with your return. A valuation file built this way is also your first exhibit if you later challenge an uplift.

A second illustration comes from the Court of Appeal of Nîmes in an IFI valuation dispute over rural land: the owners had declared the land by reference to a lapsed promise of sale, but the facts recorded by the court show the scale of what was at stake — “Cette promesse, consentie au prix de 7 600 000 euros”, and “un avis d’imposition d’un montant de 53 531 euros a été émis à leur égard le 20 juillet 2019” (CA Nîmes, 13 February 2025, case no. 23/03035, full decision on courdecassation.fr). The point for newcomers is that a price once discussed with a buyer — an old promise, an estate-agent appraisal prepared for a sale, a figure mentioned to a bank — can resurface as evidence of market value. Declare by reference to 1 January market value supported by comparables, not by reference to a historic transaction figure, and never leave an optimistic asking price in writing unaccounted for in your valuation file.

Debts are then deducted, but only within strict limits. Article 974 allows the deduction of debts existing on 1 January, contracted and genuinely borne by the taxpayer, relating to taxable assets and in proportion to their taxable fraction: “Sont déductibles de la valeur des biens ou droits immobiliers et des parts ou actions taxables les dettes, existantes au 1er janvier de l’année d’imposition, contractées par l’une des personnes mentionnées au 1° de l’article 965 et effectivement supportées par celle-ci, afférentes à des actifs imposables” (article 974, Code général des impôts, on Légifrance). Acquisition loans, genuine improvement and reconstruction costs, and purchase costs for taxable shares qualify; loans from yourself, your spouse or your minor children do not, and loans from parents, siblings or a controlled company survive only with proof of normal terms and real repayments. Interest-only and bullet loans are spread by statutory formulae rather than deducted at face value, and above 5 million euros of gross taxable property, debts exceeding 60 per cent of that value are half-disallowed unless shown to serve a non-tax purpose. Two traps catch British borrowers in particular. A remortgage of the Kent house to fund the Paris deposit is deductible only against the Kent asset it encumbers in economic terms, and an intra-family loan from parents in England to buy in France must be documented with arm’s-length terms, a fixed schedule and traceable repayments, or the administration will strike it out.

Whether a disputed debt can be deducted while litigation is pending was settled against taxpayers by the supreme court: “pour être déductible de l’assiette de l’ISF, une dette doit être certaine au jour du fait générateur de l’impôt, soit au 1er janvier de l’année d’imposition” — a debt must be certain on the taxing date, 1 January, and a contested debt becomes deductible retroactively only for the amount finally fixed by the decision ending the dispute (Cass. com., 13 March 2019, appeal no. 17-13.305, full decision on courdecassation.fr). Although decided under the former impôt de solidarité sur la fortune (ISF, the pre-2018 French wealth tax on all assets that IFI replaced), the certainty principle carries directly into IFI debt disputes. Do not deduct a claimed reimbursement, an unresolved divorce equalisation payment or a contested business liability and hope the litigation resolves in your favour; declare the position, quantify the contingent amount in an annex, and claim the deduction for the year the court fixes it.

Once the net base is fixed, the rate scale in article 977 applies (article 977, Code général des impôts, on Légifrance): nothing up to 800,000 euros, 0.50 per cent between 800,000 and 1,300,000 euros, 0.70 per cent between 1,300,000 and 2,570,000 euros, 1 per cent up to 5,000,000 euros, 1.25 per cent up to 10,000,000 euros and 1.50 per cent above. Because the first 800,000 euros are always taxed at nil, a net base of 1,600,000 euros produces roughly 4,600 euros of tax before reliefs: 2,500 euros on the 800,000–1,300,000 band plus 2,100 euros on the 1,300,000–1,600,000 band. Donations to qualifying research, higher-education, public-interest and integration bodies can then reduce the bill by 75 per cent of the gift within a 50,000 euro cap (article 978, Code général des impôts, on Légifrance). The detailed computation rules are set out for the public on Calcul de l’impôt sur la fortune immobilière, service-public.fr. Work the bands by hand at least once: most British newcomers who overpay do so because they applied a single headline rate to the whole base instead of slicing it band by band.

B. How do you file, fix a mistake and fight an assessment: annexes, deadlines, claims and the courts?

Filing is done through the annual income-tax return, not through a separate wealth-tax form. Article 982 requires that “Les redevables mentionnent la valeur brute et la valeur nette taxable des actifs mentionnés à l’article 965 sur la déclaration annuelle prévue à l’article 170” — taxpayers enter the gross and net taxable values on the yearly return and attach supporting schedules in the administration’s format (article 982, Code général des impôts, on Légifrance). In practice this means the 2042-IFI annexes alongside your 2042 income return, filed online through your personal account on impots.gouv.fr. The calendar follows the income-tax timetable with departmental brackets — for 2026 the administration set 21 May for departments 1 to 19 and 28 May for departments 20 to 54, with Paris filers in the first bracket — and payment follows later in the year, with the first IFI notices payable by 15 September 2026 (see Je déclare mon impôt sur la fortune immobilière, impots.gouv.fr and IFI: déclaration et paiement, service-public.fr). A British newcomer in Paris therefore works to the May online deadline for the return and keeps September funds available for the notice. Miss the return and the administration taxes by default assessment on the information it holds — land-registry prices, notarial records, your prior income return — which is how inflated bills begin.

Build the file as though it will be audited, because high-value Paris property regularly is. For each property, keep the valuation working: address, floor area with the weighting method shown, condition notes with dated photographs, the three comparables with sale dates and adjusted prices, and the main-residence evidence — taxe d’habitation records where still relevant, utility bills, school enrolment, electoral registration and a copy of the attestation from your mairie (town hall) if needed. For debts, keep the loan offer, the amortisation schedule, the 1 January outstanding balance proved by a bank statement, and proof that each repayment came from your own funds. For the newcomer shield, keep the evidence of your arrival year and of your prior five years’ fiscal domicile abroad: the visa or residence card, the lease or purchase deed, UK HM Revenue and Customs residence confirmations, P60s or self-assessment returns, and exit evidence such as the sale or letting of the former English home. Where the English property stays in your base after the shield expires, add a Royal Institution of Chartered Surveyors red-book valuation or a French expert valuation using French comparable methodology, plus the sterling-to-euro conversion rate applied at 1 January. An organised file does double duty: it disciplines your own declaration and it becomes the evidence bundle for any later claim.

If the notice looks wrong, the route is the standard French tax-claim procedure, and timing is strict. First, file a réclamation contentieuse (a formal claim to the tax office asking it to reduce or discharge the tax) with the local service des impôts des particuliers (the personal-tax office) that issued the notice, setting out each ground — shield wrongly refused, valuation excessive, deductible loan struck out, wrong rate band — with the exhibits attached, and keep proof of sending. The office must answer; silence for six months counts as an implied rejection and opens the court door. Second, if rejected, take the case to the tribunal judiciaire (the ordinary civil court hearing direct-tax disputes) of the tax office’s district — for a Paris home, the Paris court — within two months of an express rejection, or once the six-month silence has run. Before the court, the valuation fight follows the method the supreme court endorsed in the 2019 comparables case: attack any comparable that differs in location, construction quality, condition or amenities, and produce your own documented local sales. Where the dispute is a pure valuation disagreement, either side can ask for expert evidence, and courts routinely cut assessments that rest on unadjusted averages. Interest for late payment runs meanwhile, so consider paying the disputed sum and claiming restitution with interest rather than letting penalties accumulate — a payment made under protest is recovered if you win, while unpaid arrears grow even while you argue.

Three Paris-specific points close this section. Commissions and agency fees included in a Paris purchase price are not part of market value for IFI; strip them from the notarial price when building your base. Co-owned Paris apartments held in indivision (joint ownership without shares being divided) attract a discount for the difficulty of selling a fractional interest, typically evidenced by a notarial or expert opinion rather than asserted. And where the property sits in an SCI whose shareholders include your British family members, value the shares by transparency — the underlying Paris bricks minus the company’s qualifying debts — and attach the company accounts, because the administration systematically asks for them. Readers whose French property arrived through an inheritance or a lifetime gift rather than a purchase should also check our guide on choosing English law for a French house and defending the succession, since the value declared for succession duty and the value declared for IFI must tell a consistent story.

Conclusion

A British newcomer does not escape French IFI by keeping a foot in England, but does not face worldwide taxation from day one either. The 1.3 million euro household threshold measured each 1 January decides whether the tax exists at all; the five-year newcomer shield then decides whether a retained English house counts, excluding it until 31 December of the fifth year after settlement while always leaving French property fully taxable. Value each property at open-market value with documented local comparables, deduct only certain 1 January debts with real proof of arm’s-length terms, slice the progressive bands instead of applying a headline rate, and file the annexes on time through the income-tax return. Where the administration uplifts a valuation, refuses the shield or strikes out a loan, the claim procedure and the Paris court give a structured second chance — provided the valuation file, the loan papers and the arrival evidence were assembled before the dispute, not after it.

Newly resident in France with a house in England and a flat in Paris?
