The free movement you once enjoyed is gone: to live in France and take up a salaried job, you now need an entry visa, a work authorisation obtained before you start, and the residence card that matches your contract. Each step belongs to a different authority, each has its own deadlines, and a refusal at any stage can be paired with an order to leave France. This guide explains, in plain English, which visa and which card fit a British hire, how the work authorisation (autorisation de travail) is granted or refused, what your employer must check, and exactly how to challenge a refusal or an removal order. Every key rule is quoted from the statute or the court decision that states it, so you can rely on it in front of a prefecture, an employer or a judge.<\/p>\n<p>Two points of vocabulary before we start. The autorisation de travail is the prior permission to work, applied for online by your employer and granted by the prefecture (pr\u00e9fecture, the local arm of the State). The carte de s\u00e9jour is the residence permit itself: the salari\u00e9 card for permanent contracts, the travailleur temporaire card for fixed-term contracts and postings, and the talent-salari\u00e9 qualifi\u00e9 card for highly qualified hires. The Conseil d&#8217;\u00c9tat is France&#8217;s highest administrative court; the tribunal administratif is the first-level administrative court that hears challenges against prefectural decisions. The obligation de quitter le territoire fran\u00e7ais, usually shortened to OQTF, is the formal order to leave France that frequently accompanies a refusal.<\/p>\n<h2>I. Which visa and which residence card a British hire needs after Brexit<\/h2>\n<h3>A. From the London job offer to the right French residence card<\/h3>\n<p>Everything starts before you travel. A British citizen who wants to work in France must first obtain a long-stay visa (visa de long s\u00e9jour) from the French consulate in the United Kingdom, stating employment as the purpose of stay. The British government&#8217;s own guidance for nationals settling across the Channel, <a href=\"https:\/\/www.gov.uk\/guidance\/living-in-france\">Living in France on gov.uk<\/a>, is the natural starting point on the UK side: it confirms that from 2021 British newcomers need a visa and cannot simply arrive and look for work. Once in France, the visa is validated online and you apply for the residence card through the ANEF platform (Administration Num\u00e9rique des \u00c9trangers en France, the Interior Ministry&#8217;s online foreigners&#8217; portal). If you are hired on a permanent contract (contrat de travail \u00e0 dur\u00e9e ind\u00e9termin\u00e9e, universally shortened to CDI), the statute provides: &#8220;L&#8217;\u00e9tranger qui exerce une activit\u00e9 salari\u00e9e sous contrat de travail \u00e0 dur\u00e9e ind\u00e9termin\u00e9e se voit d\u00e9livrer une carte de s\u00e9jour temporaire portant la mention &#8221; salari\u00e9 &#8221; d&#8217;une dur\u00e9e maximale d&#8217;un an.&#8221; That is <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776797\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776797\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">article L. 421-1 of the Code de l&#8217;entr\u00e9e et du s\u00e9jour des \u00e9trangers et du droit d&#8217;asile<\/a> (the immigration code, known by its initials CESEDA). In plain terms: a CDI means a one-year salari\u00e9 card, renewable, and the same article adds a safety net if you later lose the job involuntarily, which we return to in Part II.<\/p>\n<p>If you are hired on a fixed-term contract (contrat \u00e0 dur\u00e9e d\u00e9termin\u00e9e, or CDD) or posted to France by your group (d\u00e9tachement, the formal secondment of an employee to a French entity), a different card applies: &#8220;L&#8217;\u00e9tranger qui exerce une activit\u00e9 salari\u00e9e sous contrat de travail \u00e0 dur\u00e9e d\u00e9termin\u00e9e ou qui fait l&#8217;objet d&#8217;un d\u00e9tachement conform\u00e9ment aux articles L. 1262-1 , L. 1262-2 et L. 1262-2-1 du code du travail se voit d\u00e9livrer une carte de s\u00e9jour temporaire portant la mention &#8221; travailleur temporaire &#8221; d&#8217;une dur\u00e9e maximale d&#8217;un an.&#8221; That is <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776791\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776791\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">article L. 421-3 of the CESEDA<\/a>. The card lasts as long as the contract or posting, capped at one year, and is renewed for the same period. British readers should note the distinction carefully: a two-year CDD does not give a two-year card in one go; it gives a one-year card tied to the contract, renewed once.<\/p>\n<p>Highly qualified hires have a third route. The talent-salari\u00e9 qualifi\u00e9 card is a multi-year card of up to four years: &#8220;Sous r\u00e9serve de justifier du respect d&#8217;un seuil de r\u00e9mun\u00e9ration fix\u00e9 par d\u00e9cret en Conseil d&#8217;Etat, se voit d\u00e9livrer une carte de s\u00e9jour pluriannuelle portant la mention &#8221; talent-salari\u00e9 qualifi\u00e9 &#8221; d&#8217;une dur\u00e9e maximale de quatre ans, l&#8217;\u00e9tranger qui se trouve dans l&#8217;une des situations suivantes : 1\u00b0 Il exerce une activit\u00e9 professionnelle salari\u00e9e et a obtenu, dans un \u00e9tablissement d&#8217;enseignement sup\u00e9rieur habilit\u00e9 au plan national, un dipl\u00f4me au moins \u00e9quivalent au grade de master ou figurant sur une liste fix\u00e9e par d\u00e9cret ; 2\u00b0 Il est recrut\u00e9 dans une jeune entreprise innovante r\u00e9alisant des projets de recherche et de d\u00e9veloppement, d\u00e9finie \u00e0 l&#8217;article 44 sexies-0 A du code g\u00e9n\u00e9ral des imp\u00f4ts, ou dans une entreprise innovante reconnue par un organisme public pour exercer des fonctions en lien avec le projet de recherche et de d\u00e9veloppement de cette entreprise ou avec son d\u00e9veloppement \u00e9conomique, social, international et environnemental ; 3\u00b0 Il vient en France dans le cadre d&#8217;une mission entre \u00e9tablissements d&#8217;une m\u00eame entreprise ou entre entreprises d&#8217;un m\u00eame groupe et qui justifie, outre une anciennet\u00e9 professionnelle d&#8217;au moins trois mois dans le groupe ou l&#8217;entreprise \u00e9tabli hors de France, d&#8217;un contrat de travail conclu avec l&#8217;entreprise \u00e9tablie en France.&#8221; That is <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000049052463\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000049052463\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">article L. 421-9 of the CESEDA<\/a>. For a British manager transferred from London to Paris by the same group, the third limb is usually the one that matters: three months&#8217; seniority in the group outside France plus a French contract. For a British graduate of a master&#8217;s-level programme hired by a Paris start-up, the first limb applies, provided the pay meets the threshold set by decree (d\u00e9cret en Conseil d&#8217;\u00c9tat, the government&#8217;s highest-level regulation). Check the current figure on the day you apply; thresholds move and prefectures apply the number in force, not the number quoted in last year&#8217;s blog posts.<\/p>\n<p>A common confusion must be cleared up at this stage. If you continue to work remotely from France for your London employer, without a French contract, you are not on any of the three routes above: you remain employed under a foreign contract and your residence and tax position follow different rules. The work authorisation your employer must obtain before you start<\/h3>\n<p>The residence card is the second half of the story. The first half is the autorisation de travail, and it conditions everything. The Labour Code states the entry rule bluntly: &#8220;Pour entrer en France en vue d&#8217;y exercer une profession salari\u00e9e, l&#8217;\u00e9tranger pr\u00e9sente : 1\u00b0 Les documents et visas exig\u00e9s par les conventions internationales et les r\u00e8glements en vigueur ; 2\u00b0 Un contrat de travail vis\u00e9 par l&#8217;autorit\u00e9 administrative ou une autorisation de travail.&#8221; That is <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006903732\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006903732\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">article L. 5221-2 of the Code du travail<\/a>. And the mirror rule once you are already resident is just as strict: &#8220;Un \u00e9tranger autoris\u00e9 \u00e0 s\u00e9journer en France ne peut exercer une activit\u00e9 professionnelle salari\u00e9e en France sans avoir obtenu au pr\u00e9alable l&#8217;autorisation de travail mentionn\u00e9e au 2\u00b0 de l&#8217; article L. 5221-2 .&#8221; That is <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000050773226\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000050773226\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">article L. 5221-5 of the Code du travail<\/a>. The salari\u00e9 article itself states the order of operations: &#8220;La d\u00e9livrance de cette carte de s\u00e9jour est subordonn\u00e9e \u00e0 la d\u00e9tention pr\u00e9alable d&#8217;une autorisation de travail, dans les conditions pr\u00e9vues par les articles L. 5221-2 et suivants du code du travail .&#8221; That is the second sentence of <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776797\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776797\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">article L. 421-1 of the CESEDA<\/a>, and the sequence is rigid: no work authorisation, no card; no card, no lawful salaried work. Starting the job while the application is pending exposes both you and the employer.<\/p>\n<p>In practice the application is filed online by the employer, not by you, on the Interior Ministry&#8217;s foreign-labour platform, and the official procedure page <a href=\"https:\/\/www.service-public.gouv.fr\/particuliers\/vosdroits\/F2728\">Autorisation de travail d&#8217;un salari\u00e9 \u00e9tranger en France on service-public.fr<\/a> describes each step, the supporting documents and the addresses to use. The prefecture examines four things: the state of the labour market for the post (situation de l&#8217;emploi, meaning whether candidates already available in France could fill it), the level of pay offered compared with the minimums and the market, the employer&#8217;s record (compliance with tax, social security and labour law), and your qualifications for the role. Shortage occupations (m\u00e9tiers en tension, listed by regulation) and higher pay bands soften or remove the labour-market test; ordinary hires at ordinary pay face it in full. Your employer&#8217;s file should therefore read like a recruitment case, not a formality: advert history, reasons other candidates were unsuitable, pay benchmarking, diplomas and references. Thin files are refused.<\/p>\n<p>Paris and the \u00cele-de-France add their own practical layer. Files for Parisian employers are instructed regionally, with the DRIEETS (Direction r\u00e9gionale interd\u00e9partementale de l&#8217;\u00e9conomie, de l&#8217;emploi, du travail et des solidarit\u00e9s, the regional labour authority) involved in the employment-side examination, and volumes are heavy: allow the full published processing time and keep dated proof of every upload and every acknowledgement. A recent ruling of the Conseil d&#8217;\u00c9tat shows why that paper trail matters. Asked by the Grenoble administrative court about automatically generated closure messages sent in the name of a regional foreign-labour platform, the court framed the question as: &#8220;une d\u00e9cision g\u00e9n\u00e9r\u00e9e automatiquement adress\u00e9e au nom du service instructeur d&#8217;une plateforme interr\u00e9gionale de la main-d&#8217;\u0153uvre \u00e9trang\u00e8re et cl\u00f4turant comme \u00e9tant sans objet une demande d&#8217;autorisation de travail entre-t-elle dans le champ de l&#8217;article L. 212-2 du code des relations entre le public et l&#8217;administration&#8221;. That is the <a href=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000049241286\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000049241286\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">opinion of the Conseil d&#8217;\u00c9tat of 5 March 2024, no. 489189<\/a>, given on the claim of an employee for whom the company Italia Carrelage had sought an authorisation from the Is\u00e8re prefecture. The lesson for British hires is concrete: an automatic &#8220;closed as without object&#8221; message is not necessarily the end of the story, but only a complete file with proof of each step lets your lawyer argue about who decided what and whether the decision counts as a proper administrative decision. Screenshot every submission, save every reference number, and keep the employer&#8217;s confirmation of filing.<\/p>\n<p>Employers have their own parallel duty, and it is enforced. &#8220;L&#8217;employeur s&#8217;assure aupr\u00e8s des administrations territorialement comp\u00e9tentes de l&#8217;existence du titre autorisant l&#8217;\u00e9tranger \u00e0 exercer une activit\u00e9 salari\u00e9e en France, sauf si cet \u00e9tranger est inscrit sur la liste des demandeurs d&#8217;emploi tenue par l&#8217;institution mentionn\u00e9e \u00e0 l&#8217;article L. 5312-1 .&#8221; That is <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000018766932\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000018766932\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">article L. 5221-8 of the Code du travail<\/a>: before the first day of work, the employer must verify with the competent authority that you hold a document authorising salaried work. Failure is a criminal offence, not a paperwork slip: &#8220;Le fait pour toute personne, directement ou par personne interpos\u00e9e, d&#8217;embaucher, de conserver \u00e0 son service ou d&#8217;employer pour quelque dur\u00e9e que ce soit un \u00e9tranger non muni du titre l&#8217;autorisant \u00e0 exercer une activit\u00e9 salari\u00e9e en France, en m\u00e9connaissance de l&#8217;article L. 8251-1 , est puni d&#8217;un emprisonnement de cinq ans et d&#8217;une amende de 30 000 euros.&#8221; That is <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000049049561\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000049049561\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">article L. 8256-2 of the Code du travail<\/a>, with the fine multiplied by the number of workers concerned. A serious Paris employer will therefore ask for your papers twice rather than once; do not read that as hostility. It is the law working as intended, and a cooperative attitude at this stage builds the file you may need later.<\/p>\n<h2>II. When the prefecture says no: refusal, removal order and how to challenge them<\/h2>\n<h3>A. Refusal of the card and the OQTF that usually comes with it<\/h3>\n<p>A refusal (d\u00e9cision de refus de titre de s\u00e9jour) rarely arrives alone. The statute authorises the prefecture to order you to leave France in the same movement: &#8220;L&#8217;autorit\u00e9 administrative peut obliger un \u00e9tranger \u00e0 quitter le territoire fran\u00e7ais lorsqu&#8217;il se trouve dans les cas suivants : 1\u00b0 L&#8217;\u00e9tranger, ne pouvant justifier \u00eatre entr\u00e9 r\u00e9guli\u00e8rement sur le territoire fran\u00e7ais, s&#8217;y est maintenu sans \u00eatre titulaire d&#8217;un titre de s\u00e9jour en cours de validit\u00e9 ; 2\u00b0 L&#8217;\u00e9tranger, entr\u00e9 sur le territoire fran\u00e7ais sous couvert d&#8217;un visa d\u00e9sormais expir\u00e9 ou, n&#8217;\u00e9tant pas soumis \u00e0 l&#8217;obligation du visa, entr\u00e9 en France plus de trois mois auparavant, s&#8217;est maintenu sur le territoire fran\u00e7ais sans \u00eatre titulaire d&#8217;un titre de s\u00e9jour ou, le cas \u00e9ch\u00e9ant, sans demander le renouvellement du titre de s\u00e9jour temporaire ou pluriannuel qui lui a \u00e9t\u00e9 d\u00e9livr\u00e9 ; 3\u00b0 L&#8217;\u00e9tranger s&#8217;est vu refuser la d\u00e9livrance d&#8217;un titre de s\u00e9jour, le renouvellement du titre de s\u00e9jour, du document provisoire d\u00e9livr\u00e9 \u00e0 l&#8217;occasion d&#8217;une demande de titre de s\u00e9jour ou de l&#8217;autorisation provisoire de s\u00e9jour qui lui avait \u00e9t\u00e9 d\u00e9livr\u00e9 ou s&#8217;est vu retirer un de ces documents&#8221;. That is <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042775578\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042775578\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">article L. 611-1 of the CESEDA<\/a>. The third case is yours: a refused salari\u00e9 card opens the door to an OQTF, usually with a voluntary departure period (d\u00e9lai de d\u00e9part volontaire, most often thirty days) and sometimes with a re-entry ban (interdiction de retour, which forbids coming back for a fixed period).<\/p>\n<p>Courts see these combined decisions constantly, and they examine each challenged ground separately. A typical example reaching the Conseil d&#8217;\u00c9tat began exactly this way: &#8220;M. A&#8230; C&#8230; B&#8230; a demand\u00e9 au tribunal administratif de Lille, d&#8217;une part, d&#8217;annuler, pour exc\u00e8s de pouvoir, l&#8217;arr\u00eat\u00e9 du 26 septembre 2017 par lequel le pr\u00e9fet du Nord a refus\u00e9 de lui d\u00e9livrer un titre de s\u00e9jour, lui a fait obligation de quitter le territoire fran\u00e7ais dans un d\u00e9lai de trente jours et a fix\u00e9 le pays \u00e0 destination duquel il pourrait \u00eatre reconduit d&#8217;office, d&#8217;autre part, d&#8217;enjoindre, sous astreinte, au pr\u00e9fet du Nord de lui d\u00e9livrer un titre de s\u00e9jour.&#8221; That is the <a href=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000044234301\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000044234301\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">decision of the Conseil d&#8217;\u00c9tat of 20 October 2021, no. 436564<\/a>, on appeal from the Lille administrative court and the Douai appeal court. The triple structure in that one sentence is the template for your own case: annulment of the refusal (recours en annulation pour exc\u00e8s de pouvoir, the standard challenge asking the judge to quash an unlawful decision), annulment of the removal order and of the return country designation, and an injunction (injonction sous astreinte, an order to the prefecture to issue the document within a set time, backed by a daily penalty) if you win. Plead all three; challenging only the refusal while ignoring the OQTF leaves an enforceable departure order alive.<\/p>\n<p>Deadlines are the trap. The OQTF decision itself, the refusal, the voluntary-departure period and any re-entry ban &#8220;peuvent \u00eatre contest\u00e9es devant le tribunal administratif selon la proc\u00e9dure pr\u00e9vue \u00e0 l&#8217;article L. 911-1.&#8221; That is <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000049056408\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000049056408\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">article L. 614-1 of the CESEDA<\/a>.
