Every British citizen who wants to live in France year-round without working now needs a French residence document, and for retired people with their own income the standard route is the visiteur route: first a long-stay visiteur visa obtained in the United Kingdom, then, after arrival, a carte de séjour temporaire portant la mention visiteur, which is the temporary residence permit marked visitor. This article explains, for a British reader, how that route works in practice, what the préfecture, the local state authority that issues residence permits, actually checks, and how to challenge a refusal or an obligation to leave France, known as an OQTF, when the file is blocked. The law is strict on three points that cause most refusals: money, health cover and the promise not to work. Recent court decisions show exactly where files succeed and where they fail, including a Lyon case where a monthly income of 2,105 euros with free accommodation was enough, and a Toulouse case where a bank balance just below the minimum wage level, combined with the wrong visa and the wrong health cover, justified a refusal.

Two points of vocabulary before starting. The VLS-TS, or visa de long séjour valant titre de séjour, is a long-stay visa that acts as a residence permit for its first year once validated online after arrival. The OFII, the Office français de l’immigration et de l’intégration, is the public body that carries out the medical examination and the administrative welcome for many newcomers. The SMIC, the salaire minimum de croissance, is the French statutory minimum wage, and the net annual SMIC is the yardstick for visiteur resources. PUMA, the protection universelle maladie, is the French universal health system that residents can join once legally settled, while the aide médicale d’État is a separate state medical aid scheme that does not count as health insurance for a visiteur application. The tribunal administratif is the administrative court that hears challenges against residence refusals, and the référé-suspension is the urgent procedure that can suspend a removal order while the main case is examined.

I. How a British retiree gets the French visiteur visa and residence card after Brexit: money, health cover and the no-work promise

A. What British retirees must prove in the United Kingdom: income at SMIC level, private health insurance and a real address

Since 1 January 2021 British citizens are third-country nationals for European Union immigration purposes. The British government guidance on living in France confirms that a move to France now means visas, residence formalities, healthcare registration and, where relevant, pension arrangements have to be organised in advance rather than sorted out after arrival. For a retired person who does not intend to work, the route that matches the project is the visiteur route, not a work permit and not a family permit. The French public service page that describes the carte de séjour temporaire visiteur sets the tone: the applicant must show that he or she can live on his or her own resources for a full year, must hold health insurance for the stay and must undertake not to work in France. Applications for the entry visa are lodged in the United Kingdom through the French consular channel and the TLScontact visa centres, with an online form, supporting documents, biometric enrolment and a fee, and the decision is then made by the consulate. The broader choice of long-stay visas and residence permits for British newcomers is mapped in the firm’s overview of which long-stay visa and which carte de séjour a British newcomer needs after Brexit, and the present article is the narrower retiree companion that follows that overview into the proof bundle, the amounts and the refusal traps.

The central statutory provision is Article L426-20 of the Code de l’entrée et du séjour des étrangers et du droit d’asile, the Code on the Entry and Residence of Foreigners and the Right of Asylum, universally called the CESEDA. In plain English, the foreigner who proves that he or she can live on his or her own resources, at least equal to the net annual minimum wage, is granted a one-year temporary card marked visitor. The same article adds the two companions: “Il doit en outre justifier de la possession d’une assurance maladie couvrant la durée de son séjour et prendre l’engagement de n’exercer en France aucune activité professionnelle.” The applicant must therefore also prove possession of health insurance covering the stay and must give an undertaking not to carry on any professional activity in France.

In figures, the administration currently expresses the annual test as a monthly equivalent of about 1,477.93 euros net per month for a single person over one year, which tracks the net SMIC. For a British retiree the resources are typically a mix of United Kingdom State Pension, private or occupational pensions, rental income and savings drawdown. Three practical lessons follow from daily files. First, the word used by the statute matters: resources must be the applicant’s own and personal. A spouse’s foreign bank balance presented without proof that the money is genuinely available to the applicant has been treated as insufficient, as the Toulouse case discussed below shows with a Moroccan account in the husband’s name. Joint accounts, regular transfers into the applicant’s sole or joint account over several months, pension award letters, annuity statements, twelve months of bank statements and, where relevant, a certified translation and a pounds-to-euros conversion with the source and date of the rate, carry far more weight than a single recent balance. Second, savings alone can work but must be framed as available annual living money, not as a locked asset: statements showing accessible balances, instant-access accounts and a simple one-page budget dividing accessible funds by twelve help the caseworker see the monthly equivalent. Third, free accommodation helps but does not replace money. Lodging free of charge with a partner, a child or an association lowers the outgoings the officer weighs in the round, and in the Lyon case free accommodation provided by a religious association supported the grant, yet the income test itself remained the anchor.

Health insurance is the second pillar and the most common source of misunderstanding for British retirees. At the visa stage the consulate wants a private travel and health policy covering the full stay, usually with medical expenses, hospitalisation and repatriation of at least 30,000 euros, valid across the Schengen area and France, with a certificate in French or English stating the insured persons, the dates and the ceilings. Many retirees assume that an S1 healthcare certificate, the document by which the United Kingdom pays for the healthcare of certain British State Pensioners resident abroad, or later registration with the French CPAM, the caisse primaire d’assurance maladie or local health fund, will do. The S1 is valuable after settlement for joining PUMA, but it is not a substitute for the private policy at the application stage unless the file expressly shows continuous cover from day one. The Toulouse court put the point bluntly for a different form of public cover: “une telle aide ne peut tenir lieu d’assurance maladie destinée à couvrir ses dépenses médicales pour la durée de son séjour au sens des dispositions précitées de l’article L. 426-20 du code de l’entrée et du séjour des étrangers et du droit d’asile.” (CAA de Toulouse, 3rd chamber, 18/03/2025, 24TL00156). State medical aid could not stand in for the health insurance required by Article L426-20. The same reasoning applies to reliance on a future CPAM registration or on an EHIC or GHIC card designed for temporary stays. The practical answer is to buy a twelve-month private policy before the appointment, keep the certificate and the full policy wording, and only afterwards organise the S1 and PUMA steps once resident.

The third pillar is accommodation and the written undertaking not to work. The file should contain a title deed, a twelve-month lease, or a dated attestation d’hébergement with the host’s identity document, proof of address and, where the host is a tenant, the landlord’s agreement where required. Hotel bookings for a fortnight do not show a real home. The undertaking not to work is a signed statement, and it has teeth: Article L426-20 ends with the warning that, by way of derogation from the general permission in Article L414-10, this card does not authorise any professional activity. Remote work for a British employer while living in France on a visiteur card therefore creates a real risk at renewal, because the file then shows activity inconsistent with the status. Retirees who occasionally advise, consult or manage a property portfolio for gain should take advice before describing any activity in writing. Voluntary and unpaid family help is a different matter, but any contract, payslip or promise of employment points towards a work-based status that was never applied for.

B. What happens after arrival in France: validating the VLS-TS, seeing the OFII and obtaining the first visiteur card

Most British retirees arrive on a long-stay visa marked visiteur that is also a VLS-TS. The visa itself states whether it is a VLS-TS and the maximum stay, and the holder must validate it online within the first months, pay the tax and receive the validation confirmation that regularises the first year. Validation is not optional paperwork: without it the stay is not properly documented, later renewal becomes harder, and travel in and out of France can cause checks at the border. Keep the validation attestation with the passport at all times, alongside proof of address and insurance.

The legal architecture behind the visa-then-card sequence is set by two short provisions that officers cite in almost every refusal. Article L312-2 of the CESEDA requires any foreigner who wishes to enter France for more than three months to apply to the French diplomatic and consular authorities for a long-stay visa, which may authorise a stay as a visitor, student, trainee or worker and more generally any stay of more than three months conferring the rights attached to a temporary card. Article L412-1 of the CESEDA then provides that, subject to international commitments and narrow exceptions, first issue of a temporary or multi-year card is conditional on production of that long-stay visa. The Toulouse court restated the consequence in general terms: “la première délivrance d’une carte de séjour temporaire est en principe, sous réserve des engagements internationaux de la France et des exceptions prévues par la loi, subordonnée à la production par l’étranger d’un visa d’une durée supérieure à trois mois.” (CAA de Toulouse, 3rd chamber, 18/03/2025, 24TL00156, paragraph 3). A short-stay Schengen visa, a visa-free 90-day entry or an exceptional provisional authorisation does not satisfy the condition. For British retirees this means the file must be built in London before departure. Arriving visa-free and hoping to convert a tourist stay into a visiteur card at the préfecture is the single most common planning error, and it fails even when money and insurance are otherwise adequate.

During the VLS-TS year the OFII summons many newcomers for a medical examination and a welcome visit, and the medical certificate issued by the OFII is later requested when the first card is issued. The examination is straightforward: chest X-ray or tuberculosis screening where applicable, general health check and vaccination record review. Retirees with chronic conditions should bring a translated summary, a list of medication and the name of a médecin traitant, the nominated general practitioner, once registered. Missing the OFII summons without reason can delay the file, so every letter, email and text message from the OFII should be kept and every change of address notified promptly.

Two to four months before the VLS-TS expires, the retiree applies at the préfecture of the place of residence for the first carte de séjour temporaire visiteur. In Paris applications go through the préfecture de police with an online booking and a personal appearance; in the departments they go through the local préfecture or sous-préfecture, increasingly by online filing on the ANEF system with an in-person appointment for fingerprints and document checks. The list mirrors the visa file but updated: passport and visa with validation, proof of address under three months old, twelve months of bank statements and pension evidence, health insurance certificate covering the coming year, the OFII medical certificate where issued, passport photographs to the French standard, the fee in timbres fiscaux, and a fresh signed undertaking not to work. The administration may keep the passport during examination and issue a récépissé, a receipt that extends the right to stay and, depending on its wording, may or may not authorise travel. Read the récépissé carefully: some receipts allow re-entry, others require a return visa, the visa de retour, for travel. Never leave France on a receipt without checking the travel box with the counter.

Once resident, healthcare organisation runs on a separate track from immigration but interacts with it at renewal. British State Pensioners who hold an S1 register it with the CPAM to join PUMA without paying the subsidised cotisation in many cases, while early retirees without an S1 join PUMA after three months of stable residence and pay the cotisation subsidiaire maladie, a means-tested contribution, where due. Keep every CPAM attestation de droits, every S1, and every private policy. At renewal the préfecture wants to see continuous cover across the whole past year and the coming year, not a gap between the travel policy expiring and PUMA starting. A one-month gap has been enough to trigger a request for further evidence. The clean file shows private cover from arrival to PUMA admission, then PUMA attestations plus a top-up mutuelle, the voluntary supplementary insurance, plus a forward policy where PUMA alone is questioned.

II. How to keep the visiteur card, renew it and challenge a refusal or an OQTF in France

A. What renewal really tests each year: still enough money, still insured, still not working, and how Paris handles the file

Renewal is not a formality. Article L433-1 of the CESEDA provides that renewal of a temporary or multi-year card is conditional on proof by the foreigner that he or she still meets the conditions for issue, and the administration may carry out checks and summon the applicant for interviews. For a visiteur card that means proving again, every year, the SMIC-level personal resources, the full-year health insurance and the absence of professional activity, plus habitual residence in France. The préfecture looks at the whole year, not at the balance on the day of the appointment. Pension increases, exchange-rate movements between the pound and the euro, and one-off transfers can all move the monthly average. Retirees paid in pounds should therefore keep a simple schedule: gross pension in pounds, net received in euros after bank charges, twelve-month total, monthly average, and the European Central Bank or bank rate used. Where the pound has fallen, topping up accessible savings before the application and showing the combined monthly equivalent avoids a refusal that is technically correct on the numbers but avoidable with presentation.

The Lyon decision of 17 October 2024, CAA de Lyon, 7th chamber, 17/10/2024, 24LY00008, is the best recent illustration of a file that survived because each pillar was documented. The holder, admitted as a religious secondee on a visiteur card, sought renewal after his posting changed. The prefect argued that the original posting had ended and that a new social-assistant activity required a work permit under a different status. The court disagreed on the facts: the renewal request had been lodged while the posting was still running, no employment contract and no hiring promise had been presented, and the file showed that the applicant “a continué de percevoir, depuis janvier 2022, un salaire mensuel versé par l’État turc d’un montant de 2 105 euros nets, alors qu’il bénéficiait d’un hébergement à titre gracieux par une association cultuelle et qu’il a produit une attestation de prise en charge par l’Etat turc des frais médicaux pour lui et sa famille.” A monthly payment of 2,105 euros net, free accommodation and a state certificate covering medical costs for the family meant that, at the date of the order, the court held that “M. B… remplissait toutes les conditions pour la délivrance d’une carte de séjour portant la mention ” visiteur “.” The prefect’s appeal was rejected in full. For British retirees the transposition is direct: regular pension credits at or above the SMIC level, free or low-cost housing properly evidenced, and a clear medical-cover certificate together satisfy Article L426-20 even when the administration tries to recharacterise the situation. Conversely, scattered cash deposits without source, a balance that dips below the threshold for months, or payslips from French or remote work without the matching status invite refusal.

After several years of continuous visiteur residence, some retirees ask for a carte de séjour pluriannuelle, a multi-year card. The general renewal and multi-year machinery sits in Article L432-1 and the multi-year card machinery of the CESEDA and the regulatory detail in Article R432-2 and the surrounding regulatory provisions, with Article R432-2 fixing the implied-rejection period: “La décision implicite de rejet mentionnée à l’article R.* 432-1 naît au terme d’un délai de quatre mois.” Silence for four months on a standard renewal application therefore creates an implied refusal that can be challenged, which matters in Paris where backlogs are longest. In practice, visiteur holders should apply at least two months before expiry, keep the proof of filing, attend every summons, and never work while waiting unless a different status has been granted. Where the préfecture proposes a change of status because the retiree has started a small paid activity, such as holiday letting with services or consultancy, the choice must be made consciously: either stop the activity and defend the visiteur renewal with bank and insurance evidence, or apply for the matching work or self-employed status with contracts and registration. Drifting between the two with payslips in a visiteur file is the fastest route to a refusal.

Paris and Île-de-France practice deserves a paragraph because many British retirees keep a Paris pied-à-terre or live with adult children in the capital. The préfecture de police requires precise proof of Paris address, often with the host’s title deed or lease plus a recent utility bill, and it checks habitual residence closely where the retiree spends months each year in the United Kingdom. Keep boarding passes, Eurostar bookings, French health reimbursements, utility consumption and tax notices to show that France is the main home. Where the household owns a provincial house and a Paris flat, file from the true main residence and keep the secondary address consistent across tax, health and bank documents. Inconsistency between the address on the tax notice, the CPAM attestation and the electricity bill is a classic trigger for an interview. A short covering letter in French that lists the documents, states the monthly average in euros, confirms continuous insurance and confirms the no-work undertaking helps the caseworker and later helps the judge see a coherent file.

B. How to challenge a visiteur refusal or an OQTF: the triple failure to avoid, the deadlines and the proof that wins

The mirror image of Lyon is the Toulouse decision of 18 March 2025, CAA de Toulouse, 3rd chamber, 18/03/2025, 24TL00156, which upheld a refusal on three cumulative grounds and is now the clearest checklist of what not to do. The prefect had relied on the threefold circumstance that the applicant lacked the required resources equivalent to the net annual minimum wage, namely 16,596 euros in 2023, held no long-stay visa and produced no health insurance covering the stay. The court accepted that the prefect could rely on that triple basis. On money, the only account produced was in the husband’s name with a balance equivalent to 14,925 euros, below the threshold and not shown to be the applicant’s own funds. On the visa, the applicant had entered on a short-stay visa and later held only an exceptional provisional authorisation, and the court recalled that such an authorisation does not have effects equivalent to a long-stay visa or a residence permit. On health, state medical aid was held insufficient, in the passage quoted above. The lesson for British retirees is exact: arrive on the wrong visa, show money that is slightly short or not personally available, and rely on public medical aid or future registration instead of a real policy, and the refusal will survive judicial review even where family and schooling arguments are raised.

When a refusal arrives it usually comes as a single arrêté that does three things: it refuses the card, it imposes an obligation to leave France under Article L611-1 of the CESEDA, and it fixes the country of return. Article L611-1 lists the cases including the foreigner who has been refused a residence permit, its renewal or a provisional document, or who has stayed on after an expired visa without a valid permit. The OQTF normally gives thirty days for voluntary departure, or forty-eight hours in cases with public-order or absconding features, and it sets the clock for challenge. The standard remedy is a recours en annulation before the tribunal administratif, with a short deadline that is stated in the notification, often thirty days where an OQTF with a departure period is attached. A recours gracieux to the prefect and a recours hiérarchique to the Ministry of the Interior can be filed in parallel to seek reconsideration, and they can produce a withdrawal where fresh bank or insurance evidence fills the gap, but they do not by themselves suspend the departure obligation. Only the court can suspend.

Urgency plus a serious doubt about legality is therefore the test. In visiteur cases urgency is usually shown by the imminent end of the departure period, the loss of the home, the interruption of medical treatment and, for retirees, the impossibility of boarding a flight or managing a move at short notice. Serious doubt is shown by targeting the weakest link in the triple test: a fresh twelve-month insurance certificate where cover was the gap, twelve months of pension credits pushing the average above the SMIC where money was the gap, or proof of a valid long-stay visa and timely renewal where entry regularity was the gap. Lyon-style arguments work where the file now proves each condition with dated documents; Toulouse-style files fail where the challenge repeats assertions without new proof.

The winning proof bundle at both the reconsideration and the court stage has a stable shape. First, identity and entry: passport, VLS-TS with validation or current card, entry stamps and travel history showing compliance with the 90-day Schengen logic before residence and continuous residence since. Second, money: twelve months of statements for every account relied on, pension award letters for the current year, annuity and rental statements, a pounds-to-euros schedule with the rate source, and, where accommodation is free, the host attestation with title deed or lease and utility bill. Third, health: the private policy certificate and full wording for the coming year, past PUMA attestations, S1 and CPAM attestations, and receipts showing no gap. Fourth, home: lease or title deed, utility bills across the year, home insurance, tax notices and, in Paris, the consistent address chain described above. Fifth, no work: the signed undertaking, absence of contracts and payslips, and, where past activity is questioned, a short explanation with supporting documents distinguishing unpaid family help from professional activity. File everything in French or with a certified translation, number the pages, and keep the originals for the hearing. Judges decide on the file as it stands at the hearing date, so updating the bundle with the latest statements and a fresh insurance certificate between filing and hearing regularly turns a borderline case.

Two frequent British-retiree errors need a final warning. The first is buying a French house before the visa and treating the purchase as a right to reside. Ownership of a house in France has never conferred a right to live in it year-round since Brexit; the purchase process belongs to a different legal field and the person who lives in the house needs his or her own residence status. The purchase file and the residence file should be kept separate, and rental income from letting the house while resident in the United Kingdom must be declared and taxed in the right place rather than mixed into the visiteur resources without explanation. The second error is working remotely on a visiteur card and leaving a paper trail of payslips and contracts. Where remote work is the reality, the answer is a different status with a work authorisation, not a visiteur renewal that asks the prefect to ignore the evidence. A short, honest reorientation of the application before refusal costs far less than an OQTF with a court timetable.

Conclusion

For a British retiree, the visiteur route after Brexit is demanding but legible. The statute asks for three things and the courts enforce them exactly as written: personal resources at least equal to the net annual SMIC, health insurance covering the whole stay, and a genuine undertaking not to work, all built on a long-stay visa obtained before departure. The Lyon grant and the Toulouse refusal, decided only months apart on the same article, draw the boundary with unusual clarity: documented monthly income above the threshold with free accommodation and certified medical cover succeeds, while a balance slightly below the threshold in another person’s name, a short-stay entry and reliance on state medical aid fails on all three grounds together. Retirees who build the file in pounds and present it in euros, who buy the full-year private policy before the appointment and organise the S1 and PUMA sequence only afterwards, and who keep the address chain consistent from London to the Paris or provincial préfecture, give themselves the best chance of a first grant and a smooth renewal. Where a refusal with an OQTF nevertheless arrives, the response is procedural and evidential rather than rhetorical: check the visa ground first, close the money or insurance gap with dated documents, file the tribunal challenge and the urgent suspension within the stated deadlines, and present the judge with a complete, translated and updated bundle. That is how a British retirement in France survives the paper test that Brexit created.

British retiree route to France after Brexit: SMIC-level income proof, full-year health insurance, VLS-TS validation and OFII, yearly renewal, and how to challenge a visiteur refusal or OQTF with recent court decisions.

[80312,80314

post-2136570","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-british-desk","category-decryptage
<!-- This site is optimized with the Yoast SEO Premium plugin v28.2 (Yoast SEO v28.2) -
