British nationals are now third-country nationals (citizens of a state outside the European Union and the Schengen area) under European and French law: a British passport alone no longer opens the lecture hall, and every step, from the first visa application in the United Kingdom to the renewal of a student residence permit at the pr\u00e9fecture (the local office of the State representative, the pr\u00e9fet), follows rules that did not apply before 2021.<\/p>\n<p>The stakes are concrete. A refused student visa can mean a lost academic year and lost tuition fees. A long-stay visa that is never validated on arrival leaves its holder unlawfully present. A failed renewal at the end of the academic year can lead to a refusal of stay (refus de s\u00e9jour) paired with a removal order (obligation de quitter le territoire fran\u00e7ais, universally shortened to OQTF), and sometimes a ban on returning. This guide explains, in order, how a British student lawfully enters and stays in France after Brexit, how study and part-time work rights fit together, and how to challenge a visa refusal, a non-renewal or a removal order, using the exact statutory provisions and the recent court rulings that decide these cases.<\/p>\n<h2>I. How does a British student enter France and obtain a first student residence permit after Brexit?<\/h2>\n<h3>A. Do British applicants need Campus France clearance, and which visa leads to a student permit?<\/h3>\n<p>Any course lasting more than three months requires a long-stay visa obtained before departure. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000051562134\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000051562134\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article L312-2 of the CESEDA<\/a>, the French Code on the entry and residence of foreign nationals and asylum (Code de l&#8217;entr\u00e9e et du s\u00e9jour des \u00e9trangers et du droit d&#8217;asile), states the rule in plain terms: &#8220;Tout \u00e9tranger souhaitant entrer en France en vue d&#8217;y s\u00e9journer pour une dur\u00e9e sup\u00e9rieure \u00e0 trois mois doit solliciter aupr\u00e8s des autorit\u00e9s diplomatiques et consulaires fran\u00e7aises un visa de long s\u00e9jour dont la dur\u00e9e de validit\u00e9 ne peut \u00eatre sup\u00e9rieure \u00e0 un an. Ce visa peut autoriser un s\u00e9jour de plus de trois mois \u00e0 caract\u00e8re familial, en qualit\u00e9 de visiteur, d&#8217;\u00e9tudiant, de stagiaire ou au titre d&#8217;une activit\u00e9 professionnelle, et plus g\u00e9n\u00e9ralement tout type de s\u00e9jour d&#8217;une dur\u00e9e sup\u00e9rieure \u00e0 trois mois&#8221;. A British student is therefore an \u00e9tudiant (student) long-stay applicant like any other non-European national, and the application is lodged with the French consular network in the United Kingdom, through the visa application centres that collect the file and biometrics.<\/p>\n<p>The <a href=\"https:\/\/france-visas.gouv.fr\/en\/etudiant\">official France-Visas student page<\/a> draws the first practical distinction. For a training course not exceeding three months, a short-stay Schengen visa is enough. For anything longer, France issues a long-stay visa that either acts itself as a residence permit or leads to one after arrival. One corridor deserves attention from British applicants planning to sit a competitive entrance examination (concours) in France: the short-stay &#8220;\u00e9tudiant-concours&#8221; visa, which authorises a stay of up to 90 days and, if the candidate passes, allows the pr\u00e9fecture of the place of residence to issue a residence permit directly, without a return to the United Kingdom for a fresh long-stay application. France-Visas is explicit that this visa must be requested even by travellers who would otherwise not need a short-stay visa, and that failure at the examination means leaving the Schengen area when the short stay expires.<\/p>\n<p>Before the consulate even sees the file, most British applicants must pass through Campus France UK, the London arm of the French agency for student mobility. Its EEF-Pastel certificate page (Campus France UK, the London office of the French student-mobility agency), updated in February 2026, presents the EEF-Pastel certificate as a required supporting document for a long-stay student visa application. In practice, the applicant creates an account on the \u00c9tudes en France platform (also called Pastel\/EEF), uploads a passport valid for the mobility plus three months, proof of academic background and the admission letter (lettre d&#8217;admission) from the French institution, and pays a processing fee of 180 pounds. Campus France reviewers then examine the coherence of the study plan (projet d&#8217;\u00e9tudes) against both education systems. The same page warns that the agency is the final authority in this pre-consular screening: acceptance by a French institution does not guarantee approval of the mobility, and applicants are expected to demonstrate full transparency. A vague study plan, a sharp and unexplained change of field, or documents whose authenticity looks doubtful can therefore sink the application before the consulate rules on it.<\/p>\n<p>The consulate then applies the European Visa Code (Regulation (EC) No 810\/2009, readable on <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=CELEX:32009R0810\">Eur-Lex<\/a>), and British files are refused on exactly the same grounds as any others. When supporting documents are examined, the applicant must provide material that lets the authorities assess the intention to leave the Schengen area before the visa expires. A French appeal court restated those provisions word for word in a 2022 visa refusal judgment: &#8220;une attention particuli\u00e8re est accord\u00e9e \u00e0 l&#8217;\u00e9valuation du risque d&#8217;immigration ill\u00e9gale (&#8230;) que pr\u00e9senterait le demandeur ainsi qu&#8217;\u00e0 sa volont\u00e9 de quitter le territoire des \u00c9tats membres avant la date d&#8217;expiration du visa demand\u00e9.&#8221; The same ruling recalls the refusal ground: &#8220;le visa est refus\u00e9 : (&#8230;) \/ b) s&#8217;il existe des doutes raisonnables sur (&#8230;) la fiabilit\u00e9 des d\u00e9clarations effectu\u00e9es par le demandeur ou sur sa volont\u00e9 de quitter le territoire des \u00c9tats membres avant l&#8217;expiration du visa demand\u00e9.&#8221; In that case, the commission dealing with appeals against visa refusals (commission de recours contre les d\u00e9cisions de refus de visa d&#8217;entr\u00e9e en France, usually shortened to the CRV) had relied on what it called a &#8220;risque de d\u00e9tournement de l&#8217;objet du visa \u00e0 des fins migratoires&#8221;, a risk that the visa would be misused for migration, and the court upheld the refusal (CAA Nantes, 5th chamber, 22 November 2022, No 21NT01919, <a href=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000046605103\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000046605103\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">full judgment on L\u00e9gifrance<\/a>). For a British student, the lesson is direct: bank statements showing stable resources, accommodation for the whole stay, comprehensive health insurance with repatriation cover, a return ticket or the means to buy one, and a study plan that reads as a genuine academic project are not decoration. They answer the precise legal question the consulate must resolve, which is whether this applicant will study and then leave, or use the visa for another purpose.<\/p>\n<h3>B. How do you validate your long-stay visa on arrival and move to a multi-year student card?<\/h3>\n<p>Landing in France with the visa in the passport is only half the journey. Most British students arrive on a VLS-TS, a visa de long s\u00e9jour valant titre de s\u00e9jour, meaning a long-stay visa that itself acts as a residence permit for its first year. The <a href=\"https:\/\/www.service-public.gouv.fr\/particuliers\/vosdroits\/F2231?lang=en\">service-public.fr English page for foreign students in France<\/a> requires holders to validate the VLS-TS online within three months of arrival, with a fee payable on top of the visa fee Validation happens online, through the ANEF portal (Administration num\u00e9rique pour les \u00e9trangers en France, the Home Office digital platform for foreign nationals), and it is what makes the stay lawful and allows travel across the Schengen area during that first year. Students who skip this step discover the problem months later, usually at renewal time, when the file shows a year of presence without a validated permit. Diarise the three-month deadline from the date of arrival, keep the validation certificate (attestation) with the passport, and keep proof of the address declared, because every later application will ask for it.<\/p>\n<p>After that first year, the same official page describes two possible permits: a temporary student card (carte de s\u00e9jour temporaire portant la mention &#8220;\u00e9tudiant&#8221;) valid for one year, or a multi-year student card (carte de s\u00e9jour pluriannuelle portant la mention &#8220;\u00e9tudiant&#8221;) valid for two to four years. The multi-year card is available after one year of presence under a VLS-TS or a temporary student card, and students at the most selective institutions (grandes \u00e9coles) can receive on renewal a permit covering them until the end of their programme, for example until the engineering degree (dipl\u00f4me d&#8217;ing\u00e9nieur) is awarded. The logic is one of earned stability: a first year completed properly opens longer permits, while a chaotic first year closes them. Procedurally, <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042807202\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042807202\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article R422-5 of the CESEDA<\/a> requires the pr\u00e9fet (the State representative in the d\u00e9partement) to notify the decision on the student card application in writing, within set time limits, which matters when a file sits unanswered for months and the student needs written proof of the pending application (r\u00e9c\u00e9piss\u00e9, the receipt issued while a decision is awaited). Service-public warns that a renewal applied for after the expiry date triggers an additional 180-euro regularisation fee (droit de visa de r\u00e9gularisation), except in cases of force majeure or where a valid visa is still held. In Paris and the \u00cele-de-France region, where prefectural appointment slots are notoriously tight, the file should be lodged on ANEF two to four months before expiry, with enrolment for the coming year (certificat de scolarit\u00e9 or attestation d&#8217;inscription), transcripts (relev\u00e9s de notes), proof of resources and proof of address already assembled. A renewal applied for late, or with the coming year&#8217;s enrolment missing, is the single most common route from student to removal order, as the next part shows.<\/p>\n<h2>II. How do study, work and compliance fit together, and how do you challenge a refusal?<\/h2>\n<h3>A. What part-time work is allowed, and why do student renewals fail?<\/h3>\n<p>The student card is a study permit first, with work allowed only on the side. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776689\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776689\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article L422-1 of the CESEDA<\/a> sets both the entry ticket and the work ceiling: &#8220;L&#8217;\u00e9tranger qui \u00e9tablit qu&#8217;il suit un enseignement en France ou qu&#8217;il y fait des \u00e9tudes et qui justifie disposer de moyens d&#8217;existence suffisants se voit d\u00e9livrer une carte de s\u00e9jour temporaire portant la mention &#8221; \u00e9tudiant &#8221; d&#8217;une dur\u00e9e inf\u00e9rieure ou \u00e9gale \u00e0 un an.&#8221; The same article continues: &#8220;Cette carte donne droit \u00e0 l&#8217;exercice, \u00e0 titre accessoire, d&#8217;une activit\u00e9 professionnelle salari\u00e9e dans la limite de 60 % de la dur\u00e9e de travail annuelle.&#8221; Sixty per cent of a standard French working year works out at roughly 964 hours a year, and the word accessoire (secondary, ancillary) does real work here: salaried shifts must remain the side activity, with studies as the main one. A British student working full-time hours across the academic year, or whose attendance collapses while payslips pile up, hands the pr\u00e9fecture the exact evidence used to refuse renewal, namely that studies are no longer the genuine purpose of the stay. Employers in France also check permits through the official employment-authorisation system, so undeclared over-limit work creates immigration and employment problems at once.<\/p>\n<p>Renewal refusals turn on three words applied together: attendance (assiduit\u00e9), progression and coherence of the course of study (coh\u00e9rence du cursus). The administrative appeal court of Toulouse restated the test in January 2026 in terms every British student family should memorise: &#8220;Il appartient au pr\u00e9fet, lorsqu&#8217;il est saisi par un \u00e9tranger d&#8217;une demande de renouvellement d&#8217;un titre de s\u00e9jour d\u00e9livr\u00e9 sur le fondement des \u00e9tudes, de rechercher si l&#8217;int\u00e9ress\u00e9 peut \u00eatre raisonnablement regard\u00e9 comme poursuivant effectivement des \u00e9tudes et d&#8217;appr\u00e9cier, sous le contr\u00f4le du juge, la r\u00e9alit\u00e9 et le s\u00e9rieux des \u00e9tudes poursuivies en tenant compte de l&#8217;assiduit\u00e9, de la progression et de la coh\u00e9rence du cursus suivi.&#8221; (CAA Toulouse, 4th chamber, 22 January 2026, No 23TL02807, <a href=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000053397765\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000053397765\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">full judgment on L\u00e9gifrance<\/a>). The underlying facts are a textbook warning. A foreign student who had entered France on a student visa and held a multi-year student card completed an MBA-level business qualification, including a vocational certificate worth 300 ECTS credits (the European credit system measuring study volume), but produced no university enrolment for the following academic year and was in effect job-seeking. The court held that the pr\u00e9fet had lawfully refused renewal on that single ground, the absence of any proof of continued study, and it upheld the removal order paired with the refusal. Graduation is therefore a cliff edge as much as a celebration: the day the course ends without a new enrolment, a change of status (changement de statut) towards a work or job-seeker permit must already be in motion, because the student card cannot survive as a bridge to employment on its own.<\/p>\n<h3>B. How do you challenge a student visa refusal, a refusal of stay or a removal order?<\/h3>\n<p>Three different refusals call for three different remedies, and confusing them wastes the short deadlines. Start with the consular refusal. When a student visa is refused, the decision letter states the ground, typically doubtful resources, an unconvincing study plan, or doubts about the intention to leave when studies end, the Visa Code test quoted above. The first step is a reasoned informal appeal to the authority that refused (recours gracieux) or to the minister (recours hi\u00e9rarchique), and, for refusals confirmed on appeal, a challenge to the CRV decision before the administrative court (tribunal administratif). Visa litigation is centralised in Nantes, which is why the case law on British-relevant refusal grounds comes from the Nantes courts, including the 2022 ruling cited in the first part of this guide. In parallel, nothing prevents a fresh, strengthened application: new bank statements covering several months, confirmed accommodation, a rewritten study plan tying the French course to the student&#8217;s British qualifications and stated career, and, where the refusal hinted at doubts about documents, certified translations and verifiable originals. Many families do both at once, appealing the refusal while preparing a cleaner second file for the next intake, because university start dates do not wait for litigation.<\/p>\n<p>The second refusal happens in France: the pr\u00e9fet refuses to issue or renew the student card. Service-public confirms that the applicant then has two months to lodge an informal appeal to the pr\u00e9fet (recours gracieux), an appeal to the Minister of the Interior (recours hi\u00e9rarchique), or proceedings before the administrative court (recours contentieux), with no obligation to instruct a lawyer (avocat) at that stage. The two-month period runs from notification of the written decision, which is why keeping the notification letter and its date matters so much. The court will review exactly the attendance, progression and coherence test described above, so the appeal file must attack the refusal on its own ground: missing transcripts supplied, medical or family circumstances documented with certificates, a new enrolment produced, or, where the course is finished, a change-of-status application filed without delay. An appeal that merely repeats that the student wishes to stay, without fresh proof of genuine study, fails against the Toulouse test.<\/p>\n<p>The third and gravest decision is the removal order. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042775578\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042775578\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article L611-1 of the CESEDA<\/a> lists the cases, and its second paragraph covers the classic student situation: &#8220;L&#8217;\u00e9tranger, entr\u00e9 sur le territoire fran\u00e7ais sous couvert d&#8217;un visa d\u00e9sormais expir\u00e9 ou, n&#8217;\u00e9tant pas soumis \u00e0 l&#8217;obligation du visa, entr\u00e9 en France plus de trois mois auparavant, s&#8217;est maintenu sur le territoire fran\u00e7ais sans \u00eatre titulaire d&#8217;un titre de s\u00e9jour ou, le cas \u00e9ch\u00e9ant, sans demander le renouvellement du titre de s\u00e9jour temporaire ou pluriannuel qui lui a \u00e9t\u00e9 d\u00e9livr\u00e9&#8221;. An expired student card without a timely renewal application therefore exposes the holder to an OQTF as a matter of course, and the Toulouse case shows the pairing in action: refusal of the student renewal plus a thirty-day removal order, both upheld. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042775568\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042775568\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article L612-1<\/a> gives the standard thirty-day voluntary departure period (d\u00e9lai de d\u00e9part volontaire): &#8220;L&#8217;\u00e9tranger faisant l&#8217;objet d&#8217;une d\u00e9cision portant obligation de quitter le territoire fran\u00e7ais dispose d&#8217;un d\u00e9lai de d\u00e9part volontaire de trente jours \u00e0 compter de la notification de cette d\u00e9cision.&#8221; <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042775566\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042775566\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article L612-2<\/a> lists the cases where that delay can be refused, notably where the behaviour is deemed a threat to public order or where a previous application has already been refused, in which case departure can be demanded without delay. Finally, <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000049056408\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000049056408\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article L614-1<\/a> sends the whole package, the removal order, the linked residence decision, the decision on the departure delay and any return ban (interdiction de retour sur le territoire fran\u00e7ais), to the administrative court: &#8220;La d\u00e9cision portant obligation de quitter le territoire fran\u00e7ais ainsi que la d\u00e9cision relative au s\u00e9jour, la d\u00e9cision relative au d\u00e9lai de d\u00e9part volontaire et l&#8217;interdiction de retour sur le territoire fran\u00e7ais qui l&#8217;accompagnent, le cas \u00e9ch\u00e9ant, peuvent \u00eatre contest\u00e9es devant le tribunal administratif selon la proc\u00e9dure pr\u00e9vue \u00e0 l&#8217;article L. 911-1.&#8221; The practical message for a British student served with an OQTF is therefore threefold: check whether a departure delay was granted or refused and on what ground, count the litigation deadline from the notification date rather than from any informal discussion, and put the study evidence, not general hardship, at the centre of the challenge. A removal order also stains later files, because future consulates will assess the risk of misuse of visas with that history in view, which is precisely the &#8220;d\u00e9tournement&#8221; reasoning the Nantes court approved.<\/p>\n<h2>Conclusion<\/h2>\n<p>A British student who treats the French system as a sequence of dated proofs rarely has problems: Campus France clearance and a coherent study plan before departure, a long-stay student visa matched to the course, online validation within three months of arrival, part-time work kept within sixty per cent of a working year, and a renewal file lodged early with the coming year&#8217;s enrolment, transcripts and resources. Each step is a separate legal test, and each test is documented, from the Visa Code intention-to-leave assessment at the consulate to the attendance, progression and coherence review at the pr\u00e9fecture. Where a refusal or a removal order nevertheless arrives, the remedies are mapped in advance: informal and ministerial appeals plus the administrative court within two months for residence refusals, the CRV route and the Nantes court for visa refusals, and the L614-1 challenge for removal orders with their departure delays and return bans.
