That single fact changes everything. Before Brexit, a Briton could arrive with a laptop, register as an auto-entrepreneur and start invoicing. Today the same person needs a long-stay visa before arrival, a residence permit (carte de séjour) that expressly authorises self-employed work, a registered French business, affiliation to the French social security system for the self-employed, and a French tax position that matches the reality of the activity. Miss one of those steps and the consequences follow quickly: refusal of the visa or the residence permit, an order to leave France (OQTF, obligation de quitter le territoire français), removal from the social security system, backdated social charges, or reclassification of freelance contracts as disguised employment. This guide explains the complete legal path in plain English, with every French term translated at first use. Part I covers the residence permit that authorises self-employed work and the registration of the business itself. Part II covers what a British micro-entrepreneur really pays in social charges and tax, and what to do when the préfecture (the French authority in each département that issues residence permits) says no, when URSSAF (the body that collects social charges) comes knocking, or when a client relationship looks like employment. Throughout, the law is quoted word for word from the official texts, and each decisive point is tied to a court decision you can check yourself.

I. Which Residence Permit Lets a British Freelancer Work Legally in France

A. The entrepreneur/profession libérale visa and residence permit: viability, means and proof

Any British adult who wants to live in France for more than three months needs a residence document, and since Brexit a British passport alone is no longer enough. The rule is set by Article L411-1 of the Code de l’entree et du séjour des etrangers et du droit d’asile (CESEDA, the French immigration code): with limited exceptions, every foreigner over eighteen who wishes to stay in France for more than three months must hold a long-stay visa, a temporary or multi-year residence permit, a resident card or a similar document. A British newcomer therefore starts at the French consulate in the United Kingdom with an application for a long-stay visa that matches the planned activity, and only afterwards applies in France for the residence permit itself. The British government’s own guidance for Britons moving to France, published on gov.uk Living in France, confirms that since Brexit British citizens must follow French immigration rules like any other non-EU national, including visas for work and residence permits applied for at the préfecture. The practical fiche used by the French administration for this route is service-public.fr on the entrepreneur/profession libérale residence permit, which lists the documents the préfecture expects.

The permit that matters for a self-employed Briton is the temporary residence permit marked entrepreneur/profession libérale (literally entrepreneur/self-employed professional). In ordinary English: a foreigner who carries on a non-salaried activity that is economically viable, from which they draw sufficient means of existence, in compliance with current legislation, is issued a temporary residence permit marked entrepreneur/profession libérale for a maximum of one year. Three cumulative conditions therefore decide every application: a genuine self-employed activity, economic viability, and sufficient income drawn from that activity, all within the law. A salaried job offer with a French employer is a different route altogether, governed by Article L421-1 CESEDA for the salarie permit and Article L5221-2 of the Labour Code, which requires a work authorisation for salaried work; a British freelancer must not apply under the salaried route and must not work as an employee while holding a self-employed permit.

For a British reader, the most dangerous misunderstanding is to treat the application as a formality once invoices exist. The administrative courts apply Article L421-5 strictly, and two recent appeal decisions show exactly how préfectures and judges reason. In CAA Toulouse, 16 October 2025, No 24TL00710, a foreign self-employed applicant produced annual salary summaries, monthly VAT returns for two businesses and evidence of a one-off dividend payment of 16,380 euros. The court held that those documents “ne suffisent pas à démontrer la viabilité économique de ses activités, ni qu’il en tirerait des moyens d’existence suffisants”, meaning they were not enough to show the economic viability of the businesses or that he drew sufficient means of existence from them. The dividend, paid after the prefect’s decision, could not prove resources at the date of that decision, and salaries from a company could not count because they came from salaried work rather than the self-employed activity. The refusal and the order to leave France were upheld. The lesson for a British freelancer is direct: turnover shown on VAT returns is not the same as viable self-employed income, one-off payments do not prove durable means, and salaried earnings cannot top up a self-employed file.

The second decision sharpens the accounting point and concerns an auto-entrepreneur, the exact status most British freelancers use. In CAA Lyon, 17 October 2024, No 23LY02014, the applicant ran a handyman business under the auto-entrepreneur regime with gross turnover of 20,918 euros in 2022. The court accepted that the income to be assessed is not simply turnover minus the flat-rate tax allowances of 71, 50 or 34 per cent used for income tax, but added that “doivent notamment être soustraites du chiffre d’affaires les charges et cotisations versées, ainsi que les dépenses professionnelles engagées”, meaning charges, contributions paid and professional expenses incurred must be deducted from turnover. Because the applicant produced no evidence of his business expenses, and half the turnover came from the last quarter including an invoice issued after the contested decision, nothing proved he drew sufficient means of existence at the decision date. The refusal to renew the entrepreneur/profession libérale permit was therefore lawful. For British applicants this is the single most useful paragraph in recent case law: the préfecture looks at net available income after real costs, not headline turnover, and evidence must exist at the date of the decision, not be created afterwards.

In practice, a British file should therefore contain a business plan with priced services and identified clients, registration proof, a separate business bank account, quarterly turnover declarations, evidence of contributions paid, a schedule of real professional expenses, and personal bank statements showing that the net income actually supports life in France. The préfecture can check that the conditions are still met and can interview the applicant, because Article L433-1 CESEDA makes renewal conditional on proof that the foreigner still meets the conditions for issue of the card. A business that exists only on paper, or that survives only through a single client who dictates everything, will struggle at renewal, as Part II explains. Readers who are still choosing between routes should also read the companion hub for newcomers, which long-stay visa and which carte de séjour a British newcomer needs after Brexit, before committing to the self-employed path.

B. Registering the business in France: guichet unique, micro-entrepreneur or company, and regulated activities

Once the visa route is identified, the business itself must exist under French law before the préfecture will take the application seriously. Since 1 January 2023, all business creation formalities in France go through the guichet unique (single online portal) run by the INPI, the French intellectual property and business institute. A British founder declares the start of activity there, and the portal routes the file to the tax office, URSSAF and the relevant register. Registration is not optional decoration: without it there is no SIRET number (the business identifier), no quarterly turnover declarations, no contribution record, and therefore no proof of viable activity for the préfecture. Keep the registration certificate, because it is the first document the préfecture and URSSAF both ask for.

Most British freelancers choose the micro-entrepreneur regime, formerly called auto-entrepreneur. It is not a separate legal form but a simplified tax and social regime grafted onto the entreprise individuelle (sole tradership). Its attraction is simplicity: social charges are calculated as a flat percentage of actual turnover declared each month or quarter, income tax can be calculated on turnover minus a flat-rate allowance, and accounting duties are light. Its limits matter just as much. Annual turnover ceilings apply, certain activities are excluded, and the regime suits services with low costs far better than businesses with heavy expenses, because costs cannot be deducted from the social-charge base and only the flat-rate allowance softens the income-tax base. In plain terms, taxable profit equals turnover minus 71 per cent for most sales of goods, 50 per cent for most services in the industrial and commercial category, and 30 per cent for certain furnished tourist rentals, with a minimum allowance of 305 euros. A British consultant with 40,000 euros of service turnover is therefore taxed on roughly half, while a trader in goods with the same turnover is taxed on under a third. The same article sets the current ceilings, including 203,100 euros for most sales of goods and housing supply and 83,600 euros for other businesses, and requires the business to record turnover day by day in a journal with invoices and supporting documents. Those books are exactly what the préfecture wants to see at renewal.

The alternatives should be chosen deliberately, not drifted into. A classic entreprise individuelle outside the micro regime allows deduction of real costs and suits higher-expense activities. A single-person company such as the SASU (simplified joint-stock company with one shareholder) or the SARL de famille can ring-fence liability and organise the payment of the founder, but it brings corporate accounting, separate taxation choices and higher running costs. Company creation as such belongs to a different desk in this firm’s publications and is not covered here; the point for a freelancer is that the préfecture assesses viability whatever the vehicle, and a company with no clients is no stronger than a sole tradership with no clients. Regulated professions add a further lock: lawyers, architects, doctors, accountants, estate agents and many building trades need a French qualification, registration with the relevant order or licence before they may lawfully practise. A British architect or financial adviser who simply continues a UK regulated activity from a French home without French authorisation is not exercising an activity “in compliance with current legislation” within the meaning of Article L421-5, and the residence file collapses on that ground alone. Check the regulated status before signing a lease or taking client money.

Two practical duties are often missed by newcomers. First, professional insurance: decennial liability insurance is compulsory for builders, and professional indemnity insurance is compulsory or strongly expected for advisers, health practitioners and agents. Second, the registered address and the place of actual work must be consistent with the lease and with planning rules; running client-facing premises from a purely residential lease in Paris can breach the lease and the change-of-use rules that apply to furnished rentals and offices. None of this is academic. When the préfecture doubts viability, it asks URSSAF whether contributions are actually being paid, asks the tax office whether turnover is actually declared, and checks whether the activity is lawful. A file where the three answers align is a file that gets renewed. The companion analysis of working from France for a UK employer, which employment law governs and which permit authorises the work, is essential reading for any Briton tempted to mix a UK employment contract with French freelance invoicing, because that mixture is where reclassification disputes begin.

II. What a British Micro-Entrepreneur Really Pays, and What to Do When the Administration Says No

A. URSSAF social charges and French income tax: the real cost of independence

Affiliation to the French social system is automatic and compulsory the moment genuine self-employed activity starts. The scope is set by Article L611-1 of the Social Security Code, which brings non-salaried workers outside the agricultural scheme within the independent workers’ social protection. In practice the body a micro-entrepreneur deals with is URSSAF, which collects the charges and forwards health, family, disability and basic pension coverage. The micro-social regime is set by Article L613-7 of the Social Security Code: charges and social contributions “sont calculées mensuellement ou trimestriellement, en appliquant au montant de leur chiffre d’affaires ou de leurs recettes effectivement réalisés le mois ou le trimestre précédent un taux global fixé par décret pour chaque catégorie d’activité”, meaning they are calculated each month or quarter by applying to the turnover or receipts actually collected in the previous month or quarter an overall rate fixed by decréé for each activity category. No turnover means no charges for that period, which is the attraction, but the reverse discipline is strict: turnover must be declared even when it is zero, late declarations draw penalties, and persistent non-declaration triggers enforcement. The general base for independent workers’ contributions outside the micro regime is defined by Article L131-6 of the Social Security Code, which anchors contributions to the income base used for social purposes. A British freelancer who keeps invoicing UK clients while living in France is within this system from day one of French residence; continuing to pay only UK National Insurance while resident and working in France is not a valid alternative once the European coordination rules for posted workers no longer cover the situation, and an A1 certificate cannot be used as a permanent shield for a settled French business.

The inactivity trap deserves emphasis because it ends businesses silently. In English: with no turnover or receipts, or no declarations, for at least two consecutive calendar years, an independent worker is presumed to have stopped the professional activity that justified social security affiliation, and the body can close the affiliation after warning unless the worker objects. For a British permit holder that administrative closure is doubly dangerous: it destroys the contribution record the préfecture examines at renewal, and the guichet unique deregistration that can follow removes the registration proof as well. Declare every period, keep every receipt, and never let a quiet year become two silent years.

On the tax side, the micro-entrepreneur declares turnover on the annual income tax return and benefits from the flat-rate allowances described in Part I, or may in some cases opt for the flat-rate final payment (versement liberatoire) of income tax as a percentage of turnover where the household tax conditions are met. Real-regime taxation allows deduction of actual expenses instead, which suits cost-heavy activities. In all cases the books required by Article 50-0, the day-by-day receipts journal with invoices and supporting documents, plus the purchases register for traders, must be available on demand. A British newcomer with UK-source income alongside French freelance profits must also file correctly across borders; the firm’s guide to the first French tax return after moving from the UK, forms 2042, 2047 and 3916, the treaty tie-breaker and challenging double tax, explains how worldwide income is declared and how the France-UK double tax treaty allocates taxing rights. Keep the UK and French positions consistent: turnover hidden from URSSAF but visible to HM Revenue and Customs, or the reverse, is the fastest route to a reassessment on both sides of the Channel.

B. Refusals, renewals, false self-employment and how to challenge: including Paris and Ile-de-France specifics

Refusals follow a pattern, and each type has its own remedy. A visa refusal at the consulate is challenged by an appeal to the Nantes administrative court after a preliminary appeal to the visa appeals board in Nantes, within two months. A prefectural refusal of issue or renewal of the entrepreneur/profession libérale permit, usually paired with an order to leave France within thirty days, is challenged before the territorially competent administrative court, also within the stated deadline, with a possible application for interim suspension where removal is imminent. The file must attack the real ground: viability and means under Article L421-5, proved by contemporaneous accounts, contribution records and expense schedules of the kind the Toulouse and Lyon courts found missing. Article L431-1 CESEDA sends filing conditions to the regulations, so check the current prefectural list before alleging a missing-document unfairness; courts reject complaints about documents the applicant never supplied. Where the préfecture refuses renewal because the business has stalled, rebuilding turnover after the decision does not cure the defect, as both appeal decisions above demonstrate. Rebuild first, reapply with a complete year, and use the waiting period to fix registration, declarations and insurance rather than submitting the same thin file twice.

The second great risk is reclassification. A British designer or developer with one UK client who sets the hours, controls the methods and can cut off the work is not self-employed in substance, whatever the invoices say. French law prohibits disguised work: Article L8221-1 of the Labour Code provides that “Sont interdits : 1° Le travail totalement ou partiellement dissimulé, défini et exercé dans les conditions prévues aux articles L. 8221-3 et L. 8221-5”, meaning totally or partly concealed work is prohibited, alongside advertising for it and knowingly using its services. The courts apply a single test, repeated word for word across the leading cases: Cass. soc., 28 November 2018, No 17-20.079 (Take Eat Easy) holds that “l’existence d’une relation de travail ne dépend ni de la volonté exprimée par les parties ni de la dénomination qu’elles ont donnée à leur convention mais des conditions de fait dans lesquelles est exercée l’activité des travailleurs ; que le lien de subordination est caractérisé par l’exécution d’un travail sous l’autorité d’un employeur qui a le pouvoir de donner des ordres et des directives, d’en contrôler l’exécution et de sanctionner les manquements de son subordonné”, meaning subordination exists where work is performed under an authority that can give orders and instructions, supervise performance and punish failings, with geolocation tracking and sanction powers treated as evidence. The same formula governs platform work in Cass. soc., 4 March 2020, No 19-13.316 (Uber). Reclassification brings backdated wages, paid leave, severance exposure for the client, and URSSAF reassessment of employer contributions with penalties. A freelancer who depends on one principal should therefore keep several clients, set their own tariffs and schedule in writing, use their own equipment, refuse exclusivity and penalty clauses that mimic disciplinary power, and insure the risk. An URSSAF reassessment itself is challenged first by an adversarial exchange and a formal notice, then before the social-affairs bench of the judicial court within the deadlines on the notice, with the full contribution history and contracts as exhibits.

In Paris and Ile-de-France, procedure has local colour that changes outcomes. Applications pass through the Paris préfecture of police or the relevant departmental préfecture for the inner and outer suburbs, each with its own online appointment system, document lists and waiting times; filings from a Paris address are examined against Paris costs of living when means are assessed, so a turnover figure that might satisfy a rural préfecture can look thin beside a Paris lease. Renewal interviews in the region are common for first-year entrepreneur permits, and judges of the Paris administrative court see these files weekly, which means thin or contradictory accounts are spotted fast. Practical preparation for a Paris file therefore means a lease or solid proof of address in the name of the applicant, a Paris-consistent budget showing rent, health cover and charges covered by net freelance income, registration with a Paris-area business address, and, where clients are elsewhere, evidence that the work is genuinely directed from France. Keep copies of every prefectural receipt (récépissé), because lawful stay between expiry and the renewal decision depends on it, and diary every deadline from the decision letter rather than from memory.

Conclusion

A British freelancer can build a durable working life in France after Brexit, but only by treating residence, business, social charges and tax as one connected file. The entrepreneur/profession libérale permit rewards applicants who prove, with contemporaneous books and contribution records, a lawful activity that is economically viable and yields sufficient net means; the Toulouse and Lyon appeal courts show that turnover alone, late invoices and salaried top-ups do not pass that test. The micro-entrepreneur regime keeps charges proportional to real receipts, yet demands declarations every period, real insurance and, for regulated trades, real authorisation. Single-client dependence invites reclassification under the subordination test restated in the Take Eat Easy and Uber rulings, with backdated liabilities for the client and the end of the permit for the freelancer. Prepared in that order, with Paris-level means where the applicant lives in Ile-de-France, the file that wins the visa is the same file that survives renewal, an URSSAF audit and a change of client. Start the paper trail before arrival, and never let a decision date catch the evidence half-built.

British and self-employed in France after Brexit: the entrepreneur/profession liberale permit, micro-entrepreneur registration, URSSAF and tax, and how to challenge a refusal.

[80312,80314

post-2134356","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-british-desk","category-decryptage
<!-- This site is optimized with the Yoast SEO Premium plugin v28.2 (Yoast SEO v28.2) -
