Before Brexit, a British student simply arrived with a passport, enrolled, and enjoyed the same treatment as a French classmate. That world is gone. Since 1 January 2021, a British national is a third-country national in the eyes of French immigration law, which means a visa before departure, a residence permit after arrival, proof of money every year, and prefectures that refuse renewal when results or attendance slip. The good news is that the route is well signposted, the courts have clarified the two great refusal grounds, and a graduate gets a full year to find a first job or launch a business. This guide walks you through each stage in plain English, with the exact legal texts and the court decisions that show how judges really decide these cases.

I. How a British Student Enters France and Secures the Carte de Séjour Étudiant After Brexit

Entry and first residence form one continuous chain: the long-stay visa obtained in the United Kingdom, the validation completed after arrival, and then the yearly student residence card. Break one link and the rest falls, so this part follows the chain in order.

A. How Do You Get the French Long-Stay Student Visa and Validate It on Arrival?

Every British student who intends to study in France for more than three months must obtain a long-stay visa before leaving the United Kingdom. This is not a matter of discretion at the border; it is the general rule of French immigration law. In plain terms, without that visa in the passport, no first student residence card can be issued later, subject only to narrow statutory exceptions that almost never help a British school-leaver. The official service-public.fr page on the long-stay visa and residence permit for foreign students (service-public.fr, F2231) describes the same sequence, and the France-Visas portal (France-Visas, Student) sets out the supporting documents for applicants over eighteen enrolling for a course longer than three months.

In practice, a British applicant starts on the France-Visas website, completes the application, and books an appointment at the visa centre serving the United Kingdom, where TLScontact currently collects files on behalf of the French consulate. The file typically contains the passport, the letter of acceptance or proof of enrolment from the French higher-education institution (an établissement d’enseignement supérieur, meaning a university, grande école or accredited business school), proof of accommodation for at least the first months, proof of financial resources at least equal to the monthly level the administration applies to foreign students, and travel medical insurance covering the journey. Most British undergraduates also pass through Campus France, the agency that interviews applicants and issues the attestation many consulates expect; even where the procedure is technically optional for a given institution, consular officers treat a complete Campus France file as evidence that the study plan is serious. Families should apply as soon as the acceptance letter arrives, because late summer appointment slots in London fill quickly and a delayed visa means a missed start of term with no right to enter France meanwhile and begin studying.

The visa issued is usually a long-stay visa equivalent to a residence permit, known by its French initials VLS-TS (visa de long séjour valant titre de séjour, literally a long-stay visa that counts as a residence permit). Within three months of arrival, the student must validate it online, pay the tax, and attend any medical or civic appointments the Office français de l’immigration et de l’intégration (the OFII, the French immigration and integration office) schedules. Only after validation does the stay become fully regular for the first year. Students admitted through a competitive entrance examination sit a slightly different track, the étudiant-concours visa, which allows them to sit the examination in France and then apply at the prefecture (the préfecture, the local office of the State representing the government in each département) without returning to the United Kingdom. Whatever the sub-category, the discipline is the same: keep copies of every document, keep the validation certificate with the passport, and never let the visa expire without either leaving or holding a receipt for a renewal application, called a récépissé, which preserves the right to remain while the prefecture examines the file.

Once installed, the student applies for the residence card itself. The card is therefore annual, and its two pillars are genuine study and sufficient means. The same article adds that the card gives the right to work on a secondary basis within a capped fraction of annual working time, a point developed in part II below. Students who entered France before their sixteenth birthday and completed uninterrupted schooling there can obtain the card even without the long-stay visa, but that exception concerns British children raised in France rather than the school-leaver arriving from Kent or Yorkshire with A-levels in hand. For the standard British student, the message is simple: visa first, validation immediately, student card before the visa year ends, and a paper trail from day one.

B. How Do You Renew the Student Card and Defeat the Two Classic Refusal Grounds?

Renewal is where British families discover that French student residence is conditional, not automatic. The prefecture examines two questions each year: is the student genuinely and seriously studying, and does the student have enough money? A negative answer to either can produce a refusal of renewal accompanied by an obligation to leave France, known as an OQTF (obligation de quitter le territoire français, an administrative order to leave French territory). Understanding how judges review those two grounds is the surest way to build a file that survives.

The seriousness of studies is assessed through progression, attendance and results. The leading illustration is the judgment of the Administrative Court of Appeal (cour administrative d’appel, the court that hears appeals against administrative court judgments) of Marseille of 29 March 2019, case number 18MA03697 (CAA Marseille, 29/03/2019, 18MA03697). The student had enrolled in 2014-2015 in a university technology institute in electrical engineering and computing, failed, then enrolled twice in the first year of a general science degree and failed again, then re-enrolled a third consecutive time in that same first year. The court held: “Il en résulte que l’intéressé ne justifiait, à la date de cet arrêté, d’aucune progression ou résultat obtenus dans le cadre des études suivies en France.” Results obtained after the prefect’s decision could not cure the defect, and the outcome followed mechanically: “La requête de M. B… est rejetée.” A more recent confirmation came from the Administrative Court of Appeal of Nancy on 17 December 2024, case number 24NC00504 (CAA Nancy, 17/12/2024, 24NC00504), where the court found that the student, “du fait de son absence de progression dans son cursus, ne justifie pas, eu égard à son parcours universitaire, du caractère sérieux des études poursuivies.” Repeated enrolment at the same level without validation, unexplained changes of subject, and wholesale absence from examinations are therefore the three patterns most likely to sink a renewal.

Yet failure in one year is not fatal where the student explains it and shows a coherent plan. The counter-model is the judgment of the Administrative Court of Appeal of Bordeaux of 1 October 2019, case number 19BX01247 (CAA Bordeaux, 01/10/2019, 19BX01247), which annulled a refusal. The prefect had relied on lack of attendance in a first-year computing degree and on allegedly insufficient resources. The court recalled the governing principle: “sauf lorsque les textes l’interdisent expressément, le préfet n’est pas tenu de refuser un titre de séjour à un étranger qui ne remplit pas l’ensemble des conditions auxquelles est subordonnée sa délivrance.” The prefect holds a discretionary power and must weigh the whole personal situation. Here the student had switched orientation mid-year on his teachers’ advice into a rebound stream, with a detailed attestation from his mathematics lecturer confirming attendance at lectures and tutorials, several teachers describing him as particularly serious, motivated and assiduous, and subsequent validation of his year with an average of 13.68 out of 20 among the best students. The court therefore annulled the refusal and the removal order built on it, ordering: “Il y a lieu d’enjoindre au préfet de la Haute-Garonne, en application de l’article L. 911-1 du code de justice administrative, de délivrer à M. D… un titre de séjour portant la mention ” étudiant ” dans le délai de trois mois à compter de la notification du présent arrêt.” The lesson for a British student who stumbles is practical: obtain written attestations from lecturers, document any reorientation, sit the examinations even when success looks unlikely, and re-enrol promptly in a coherent programme so that the file shows perseverance rather than drift.

The second ground, resources, is more arithmetic but equally strict. The administration applies the regulatory threshold derived from the ministerial grant scale, and the Bordeaux court restated it plainly: “pour justifier de la possession de moyens d’existence suffisants, l’étudiant doit disposer de ressources équivalentes à 615 euros par mois.” Bank statements, family transfers spread across the academic year, a scholarship letter, and a certificate of accommodation with board that reduces outgoings can together satisfy the test, as they did in Bordeaux where family transfers averaging above the monthly threshold plus lodging with meals established sufficiency (CAA Bordeaux, 01/10/2019, 19BX01247). British parents should therefore organise regular monthly transfers from the United Kingdom rather than one opaque lump sum, keep every slip, and add a signed accommodation certificate where the student lodges with relatives. Where resources genuinely fall short, a part-time job within the legal ceiling or a declared scholarship closes the gap far more safely than undeclared cash work, which exposes both student and employer to sanctions and cannot be shown to the prefecture.

II. How a British Student Lives, Works and Stays On in France After the First Year

Residence secured, daily life begins: working within the legal ceiling, registering for healthcare, claiming housing help, and, after graduation, converting student years into a first professional foothold. Each of these steps has its own office, its own timetable and its own appeal route, and this part takes them one by one.

A. How Can You Work 964 Hours, Get Healthcare and Claim Housing Help as a British Student?

The right to work is the provision British students use most and misunderstand most. The student card authorises secondary salaried work up to sixty per cent of annual working time, and the Labour Code fixes the figure. Nine hundred and sixty-four hours is roughly half-time across the year, and the employer files a simplified declaration rather than seeking a separate work permit. The work must remain secondary to study: a student who works full-time night shifts and stops attending lectures will pay for it at renewal time under the seriousness test described above. Self-employment is a different matter and generally requires a change of status, so a British student who wants to invoice clients as a freelancer should seek advice before registering a micro-business rather than assuming the student card covers it. Undeclared work helps no file and harms every file, because it cannot be evidenced and it breaches the employer’s obligations.

Healthcare follows residence, not nationality. Since the 2016 reform, France covers health costs through the Protection universelle maladie, universally called PUMA (the universal health protection that covers residents after three months of stable presence). A British student who resides stably and lawfully therefore joins the local health insurance fund, the CPAM (caisse primaire d’assurance maladie, the local health insurance fund), obtains a social security number, and in due course receives the green Carte Vitale (the electronic health insurance card presented at doctors’ surgeries and pharmacies). Registration runs through the dedicated student portal rather than the general counter, and the student should complete it in the first term, because reimbursements are not backdated indefinitely and a winter illness without registration means advancing the full fee. The European Health Insurance Card issued in the United Kingdom and its successor, the Global Health Insurance Card, cover only temporary stays and medically necessary care during visits; they do not replace PUMA affiliation for a resident student year. Private top-up insurance, called a mutuelle, remains advisable for the portion of fees the State does not reimburse, particularly dental and optical care.

Housing help is the third pillar of student budgets and the one British families least expect. France pays personal housing aid to qualifying tenants regardless of nationality, provided residence is lawful and the dwelling meets decency standards. Article L821-1 of the Code de la construction et de l’habitation (the Construction and Housing Code) provides: “Les aides personnelles au logement comprennent : 1° L’aide personnalisée au logement ; 2° Les allocations de logement”, the personalised housing aid and the housing allowances administered by the family benefits fund, the CAF (caisse d’allocations familiales, the fund that pays family and housing benefits). A British student renting a studio or a room in Lyon applies to the CAF with the lease, proof of identity and lawful residence, and bank details; the aid is then usually paid directly to the landlord and deducted from the rent. Shared flats, university residences managed by the CROUS (centre régional des œuvres universitaires et scolaires, the regional student services body), and private studios all qualify under different sub-schemes, but the dwelling must be the student’s main home and the lease must be in order. Applications should be filed the month of arrival, declarations of resources updated yearly, and any departure notified, because overpayments are recovered with interest and an undeclared flat-share can generate a demand for repayment years later. For parents budgeting from London, the combination of 964 lawful working hours, PUMA coverage and monthly CAF aid transforms the cost of a French degree, but each benefit depends on maintaining the lawful residence that underpins it.

B. What Happens After Graduation and How Do You Challenge a Refusal or Removal Order?

Graduation opens a bridge year that many British families overlook. A former student who has earned at least a master’s-level degree from a nationally accredited French institution and holds health insurance can obtain a one-year temporary card marked recherche d’emploi ou création d’entreprise (job search or business creation). Article L422-10 of the CESEDA provides: “L’étranger titulaire d’une assurance maladie qui justifie soit avoir été titulaire d’une carte de séjour temporaire ou pluriannuelle portant la mention ” étudiant ” délivrée sur le fondement des articles L. 422-1, L. 422-2 ou L. 422-6 et avoir obtenu dans un établissement d’enseignement supérieur habilité au plan national un diplôme au moins équivalent au grade de master” is granted that card where the graduate intends to complete training with a first professional experience or to pursue a business project connected with the field of study. During that year the holder may seek and take any employment related to the training, or prepare the business, without the employer’s prior labour-market authorisation. At the year’s end, salaried employment meeting the pay threshold leads to an employee card, while a viable business leads to an entrepreneur card. The application must be filed before the student card expires, with the diploma or proof of imminent graduation, health insurance and, for founders, a credible business outline; graduates should request the receipt for the application on the day of filing, because the bridge only protects those who apply in time.

The courts police the prefecture’s handling of this bridge strictly. In the judgment of the Administrative Court of Appeal of Lyon of 29 June 2021, case number 20LY03554 (CAA Lyon, 29/06/2021, 20LY03554), the prefect had refused the provisional authorisation then in force on the ground that the graduate, who had earned a master’s in international financial analysis in October 2017, had applied only in October 2018, supposedly outside the year. The court quoted the former article L311-11: “Une autorisation provisoire de séjour d’une durée de validité de douze mois, non renouvelable, est délivrée à l’étranger ayant obtenu, dans un établissement d’enseignement supérieur habilité au plan national, un diplôme au moins équivalent au grade de master ou figurant sur une liste fixée par décret et qui :” and then held: “il ne résulte nullement des dispositions de l’article R. 311-35 citées au point 2 que la demande de délivrance de l’autorisation provisoire de séjour doive être présentée dans l’année civile d’obtention du diplôme.” The applicant had applied within twelve months of graduation while still holding a valid multi-year card, so the refusal was vitiated by legal error, both the first-instance judgment and the refusal were annulled, and the court ordered: “Il est enjoint au préfet du Rhône de réexaminer la situation de Mme A… dans un délai de deux mois à compter de la notification du présent arrêt.” British graduates should draw the operational lesson: apply within twelve months of the award date, keep the award certificate and transcripts, and challenge any refusal that invents a calendar-year deadline the text does not contain.

Where the prefecture refuses renewal or the graduate route and adds a removal order, the challenge runs to the administrative court. The refusal, the removal order, any departure deadline and any re-entry ban are contested together, and Article L614-1 of the CESEDA states: “La décision portant obligation de quitter le territoire français ainsi que la décision relative au séjour, la décision relative au délai de départ volontaire et l’interdiction de retour sur le territoire français qui l’accompagnent, le cas échéant, peuvent être contestées devant le tribunal administratif selon la procédure prévue à l’article L. 911-1.” Time limits are short, commonly thirty days and sometimes forty-eight hours where detention accompanies the order, so the student must see a lawyer immediately upon notification and file for interim relief where removal is imminent. The judge examines legality as matters stood on the decision date for most grounds, which is why the evidentiary file must already be complete before the prefect decides: later diplomas and later attestations do not retroactively validate, as the Marseille case showed. Where the court annuls, it can order the prefect to issue the card or to re-examine, underpinned by Article L911-1 of the Code de justice administrative (the Administrative Justice Code): “Lorsque sa décision implique nécessairement qu’une personne morale de droit public ou un organisme de droit privé chargé de la gestion d’un service public prenne une mesure d’exécution dans un sens déterminé, la juridiction, saisie de conclusions en ce sens, prescrit, par la même décision, cette mesure assortie, le cas échéant, d’un délai d’exécution.” That is the mechanism behind the Bordeaux order to issue the student card within three months and the Lyon order to re-examine within two months.

For British readers in Paris and the Île-de-France region, two local notes matter. First, applications and renewals for students living in the capital go through the Paris prefecture of police rather than an ordinary departmental prefecture, with its own online appointment system, longer lead times and strict document checklists; students in the inner suburbs apply to the prefecture of their département of residence, and moving across the Boulevard périphérique mid-file means transferring the file and updating proof of address without missing the renewal window. Second, Paris-area rents make the CAF application and the CROUS housing round decisive for budgets, while the concentration of grandes écoles and universities in the region means CPAM student queues peak each October; early filing is not bureaucratic zeal but financial planning. Whatever the academy, the hierarchy of action after a refusal is identical: read the stated grounds the day they arrive, gather the missing attestation or bank statement within days, file the administrative appeal to the tribunal administratif (the administrative court that hears challenges to State decisions) before the deadline expires, and request a stay of removal where one is available.

Conclusion

A British student can still study in France after Brexit, work part-time, be insured, receive housing help, and remain for a first professional year, but every one of those rights now depends on a document applied for on time and defended with evidence. Get the long-stay visa before departure, validate it on arrival, renew the étudiant card with proof of genuine progression and monthly resources above the threshold, register promptly with the CPAM and the CAF, keep work within 964 hours, and file the graduate bridge application before the student card expires. Where the prefecture says no, the administrative courts distinguish the drifting file from the serious one, annul errors of law such as invented calendar deadlines, and order issue or re-examination within months. Built that way, a British degree in France remains what it always was: demanding, affordable, and entirely achievable.

British students now need a long-stay visa, a yearly carte de sejour etudiant, proof of progression and resources, plus CPAM and CAF registration.
