Before Brexit, a student arriving from Manchester, Edinburgh or Bristol enrolled at a French university almost as simply as a student arriving from Lyon or Lille: no visa, no residence permit, no prefecture queue. That world ended with the United Kingdom&#8217;s withdrawal from the European Union. Today a British national who wants to study in France for more than three months is a third-country national like any other, subject to the visa and residence rules of the Code de l&#8217;entr\u00e9e et du s\u00e9jour des \u00e9trangers et du droit d&#8217;asile (the CESEDA, the French code governing entry, residence and asylum). The route is well signposted but unforgiving: a long-stay student visa (visa de long s\u00e9jour valant titre de s\u00e9jour, usually shortened to VLS-TS \u00e9tudiant) before departure, online validation within three months of arrival, proof of roughly 877.50 euros a month in resources, then a temporary residence card marked &#8220;\u00e9tudiant&#8221; (student) that must be renewed each year on evidence of genuine academic progress. Each step carries its own refusal risk, and each refusal can be paired with an obligation to leave French territory (obligation de quitter le territoire fran\u00e7ais, known as an OQTF), the removal order that turns an academic setback into a legal emergency. The good news is that French administrative courts review these decisions closely, and the case law of the cours administratives d&#8217;appel (administrative courts of appeal) shows exactly where prefectures and consulates go wrong: resources miscalculated, academic progress assessed too harshly, or the student&#8217;s file never genuinely examined. This guide walks British students and their parents through the whole chain \u2014 visa, validation, renewal, the right to work up to 964 hours a year, the one-year job-search residence permit after a master&#8217;s degree \u2014 and explains, with the exact legal texts and judgments, how to challenge a refusal or an OQTF before the tribunal administratif (administrative court).<\/p>\n<h2>I. Getting in and staying in: the British student&#8217;s visa, its validation and the carte de s\u00e9jour \u00e9tudiant<\/h2>\n<h3>A. Which long-stay student visa must a British national obtain, and what must happen in the first three months in France?<\/h3>\n<p>Anyone who plans to stay in France for more than three months must apply to the French diplomatic and consular authorities for a long-stay visa before travelling. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000051562134\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000051562134\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article L312-2<\/a> of the CESEDA states the rule without ambiguity: &#8220;Tout \u00e9tranger souhaitant entrer en France en vue d&#8217;y s\u00e9journer pour une dur\u00e9e sup\u00e9rieure \u00e0 trois mois doit solliciter aupr\u00e8s des autorit\u00e9s diplomatiques et consulaires fran\u00e7aises un visa de long s\u00e9jour dont la dur\u00e9e de validit\u00e9 ne peut \u00eatre sup\u00e9rieure \u00e0 un an.&#8221; In plain terms, no British student can fly to France on a passport stamp and then sort out a student residence permit at the local prefecture (pr\u00e9fecture, the state authority in each d\u00e9partement that issues residence permits). The visa must be obtained from the French consulate covering the applicant&#8217;s place of residence in the United Kingdom, and the application passes through the France-Visas online portal, with supporting documents covering admission to a recognised higher-education institution (\u00e9tablissement d&#8217;enseignement sup\u00e9rieur), accommodation, health cover and, above all, financial resources. The official France-Visas student page (<a href=\"https:\/\/france-visas.gouv.fr\/en\/etudiant\">france-visas.gouv.fr \u2014 Student<\/a>) and the English-language service-public.fr fact sheet (<a href=\"https:\/\/www.service-public.gouv.fr\/particuliers\/vosdroits\/F2231?lang=en\">service-public.fr \u2014 Foreign student in France: long-stay visa or residence permit<\/a>) describe the supporting documents the consulate expects, and families should read both before booking any appointment, because a file refused at the consulate is far harder to rescue than a file prepared properly at the start.<\/p>\n<p>The resource requirement is the single greatest cause of student visa refusals, and the courts have spelled out how it must be assessed. European Union law frames the exercise: Directive (EU) 2016\/801 on the conditions of entry and residence of third-country nationals for study purposes requires sufficient resources to cover subsistence and return costs plus admission to a higher-education institution, and allows Member States to reject applications where those conditions are unmet. In France, the standing ministerial instruction of 4 July 2019 on long-stay student visas, issued to transpose that directive, provides at its point 2.2 that applicants must prove sufficient means for the whole validity period of the study visa, set at least at the level of the basic monthly maintenance allowance paid to French government bursary holders in the previous academic year, namely 615 euros a month in 2019. That 615-euro monthly benchmark from 2019 has since moved with the times: current service-public.fr guidance requires the student to show resources of at least 877.50 euros per month, assessed in light of the individual situation. Parents wiring a lump sum from London should understand that a bare bank statement is not always enough \u2014 the consulate looks for stable, available funding across the whole academic year, and, as the case law below shows, a father&#8217;s payslips only help if that father has genuinely committed to supporting the student and earns enough to do so.<\/p>\n<p>Once the visa is granted and the student lands in France, the clock starts immediately. Within three months of arrival, the VLS-TS must be validated online (validation du VLS-TS) and a fee paid on top of the visa fee; for the student category that validation fee is currently 150 euros. Validation gives the visa the legal value of a residence permit for its duration and registers the holder with the French administration. Students who miss the three-month window find themselves unlawfully present despite holding a perfectly valid visa, so this formality should be completed in the first week, not the twelfth. The visa is normally valid for up to one year, and before it expires the student applies for a carte de s\u00e9jour temporaire portant la mention &#8220;\u00e9tudiant&#8221; (temporary residence card marked &#8220;student&#8221;), the renewable permit examined in the next section. One narrow exception deserves mention: a British student who entered France through an entrance examination (concours d&#8217;entr\u00e9e) to a higher-education institution that has signed an agreement with the State can be issued the student card on first admission without proving resources and without the long-stay visa otherwise required, under <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776687\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776687\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article L422-2<\/a> of the CESEDA: &#8220;La carte de s\u00e9jour pr\u00e9vue \u00e0 l&#8217;article L. 422-1 est \u00e9galement d\u00e9livr\u00e9e lors de sa premi\u00e8re admission au s\u00e9jour, sans avoir \u00e0 justifier de ses conditions d&#8217;existence et sans que soit exig\u00e9e la condition pr\u00e9vue \u00e0 l&#8217;article L. 412-1, \u00e0 l&#8217;\u00e9tranger ayant satisfait aux \u00e9preuves du concours d&#8217;entr\u00e9e dans un \u00e9tablissement d&#8217;enseignement sup\u00e9rieur ayant sign\u00e9 une convention avec l&#8217;Etat.&#8221; That route concerns a minority, but families whose child sat a competitive entrance examination in France should know it exists.<\/p>\n<p>The first-visa rule that underpins everything is <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776891\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776891\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article L412-1<\/a> of the CESEDA: &#8220;Sous r\u00e9serve des engagements internationaux de la France et des exceptions pr\u00e9vues aux articles L. 412-2 et L. 412-3, la premi\u00e8re d\u00e9livrance d&#8217;une carte de s\u00e9jour temporaire ou d&#8217;une carte de s\u00e9jour pluriannuelle est subordonn\u00e9e \u00e0 la production par l&#8217;\u00e9tranger du visa de long s\u00e9jour mentionn\u00e9 aux 1\u00b0 ou 2\u00b0 de l&#8217;article L. 411-1.&#8221; Because the Brexit Withdrawal Agreement gives no privileged student track to newly arriving Britons \u2014 only those already resident before 31 December 2020 hold Withdrawal Agreement permits \u2014 British applicants fall squarely under this provision. In practice this means the consulate&#8217;s decision is the gateway to the entire stay: challenge it early if it is wrong, because everything downstream, from validation to renewal to the graduate job-search permit, depends on lawful first admission.<\/p>\n<p>Consular refusals are not the end of the road. A refused applicant can file an informal appeal (recours gracieux) to the consulate, then a mandatory appeal to the commission de recours contre les d\u00e9cisions de refus de visa d&#8217;entr\u00e9e en France (the appeal commission against entry-visa refusals, usually called the CRRV) within two months, and finally an action for annulment before the tribunal administratif de Nantes, the court with national jurisdiction over visa litigation. Each stage must be reasoned, documented and filed on time, and the file should attack the exact ground stated in the refusal \u2014 most often resources, sometimes the credibility of the study plan or a suspected misuse of the student route for migration purposes. The judgment examined below shows how the court tests each of those grounds against the evidence, and why a refusal based on a genuine misreading of the family&#8217;s finances can be overturned.<\/p>\n<h3>B. Renewing your carte de s\u00e9jour \u00e9tudiant: enrolment, resources and proof of genuine studies<\/h3>\n<p>The student residence card itself is governed by <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776689\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776689\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article L422-1<\/a> of the CESEDA, which provides in full: &#8220;L&#8217;\u00e9tranger qui \u00e9tablit qu&#8217;il suit un enseignement en France ou qu&#8217;il y fait des \u00e9tudes et qui justifie disposer de moyens d&#8217;existence suffisants se voit d\u00e9livrer une carte de s\u00e9jour temporaire portant la mention &#8221; \u00e9tudiant &#8221; d&#8217;une dur\u00e9e inf\u00e9rieure ou \u00e9gale \u00e0 un an. En cas de n\u00e9cessit\u00e9 li\u00e9e au d\u00e9roulement des \u00e9tudes ou lorsque l&#8217;\u00e9tranger a suivi sans interruption une scolarit\u00e9 en France depuis l&#8217;\u00e2ge de seize ans et y poursuit des \u00e9tudes sup\u00e9rieures, l&#8217;autorit\u00e9 administrative peut accorder cette carte de s\u00e9jour sous r\u00e9serve d&#8217;une entr\u00e9e r\u00e9guli\u00e8re en France et sans que soit opposable la condition pr\u00e9vue \u00e0 l&#8217;article L. 412-1. Cette carte donne droit \u00e0 l&#8217;exercice, \u00e0 titre accessoire, d&#8217;une activit\u00e9 professionnelle salari\u00e9e dans la limite de 60 % de la dur\u00e9e de travail annuelle.&#8221; Three elements therefore condition every first issue and every renewal: genuine enrolment in a course of study, sufficient means of subsistence, and \u2014 decisive in practice \u2014 the reality and seriousness of the studies pursued. The card lasts one year at most, so a three-year licence (bachelor&#8217;s degree) means at least two renewals, each a fresh examination of the file, and each capable of producing a refusal served together with an OQTF.<\/p>\n<p>Renewal applications are now filed online through the ANEF platform (Administration num\u00e9rique pour les \u00e9trangers en France, the digital portal for foreign nationals), ideally two to four months before the current card expires. The file typically contains the passport, the expiring permit, proof of address, evidence of resources at the 877.50-euro monthly level, enrolment certificates and, critically, academic results: transcripts (relev\u00e9s de notes), attendance records and any explanatory evidence where results disappointed. British families sometimes assume that re-enrolment alone guarantees renewal. It does not. The prefecture examines whether the student can reasonably be regarded as genuinely pursuing studies, looking at the whole file \u2014 examination passes and failures, changes of course, gaps and explanations. A change of subject can be accepted where it reflects a coherent academic path, but repeated first-year failures with no credible explanation point toward refusal. Medical evidence, proof of part-time work compatible with study, or documentation of a university-approved repeat year should be included rather than left for the judge, because the prefecture can only assess what it receives.<\/p>\n<p>The leading illustration is a judgment of the cour administrative d&#8217;appel de Marseille of 29 March 2019, case number 18MA03697 (<a href=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000038327735\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000038327735\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">CAA Marseille, 29 March 2019, No. 18MA03697<\/a>), concerning a student whose prefect refused renewal and ordered him to leave France within thirty days. The court recalled the applicable provision, then worded as Article L313-7 of the CESEDA: &#8220;I. &#8211; La carte de s\u00e9jour temporaire accord\u00e9e \u00e0 l&#8217;\u00e9tranger qui \u00e9tablit qu&#8217;il suit en France un enseignement ou qu&#8217;il y fait des \u00e9tudes et qui justifie qu&#8217;il dispose de moyens d&#8217;existence suffisants porte la mention &#8221; \u00e9tudiant &#8221; (&#8230;). Le renouvellement de cette carte est subordonn\u00e9, notamment, \u00e0 la justification par son titulaire de la r\u00e9alit\u00e9 et du s\u00e9rieux des \u00e9tudes qu&#8217;il a d\u00e9clar\u00e9 accomplir.&#8221; Applying that test, the court approved the prefect&#8217;s method: &#8220;il appartient \u00e0 l&#8217;administration saisie d&#8217;une demande de renouvellement d&#8217;une carte de s\u00e9jour pr\u00e9sent\u00e9e en qualit\u00e9 d&#8217;\u00e9tudiant de rechercher, \u00e0 partir de l&#8217;ensemble du dossier, si l&#8217;int\u00e9ress\u00e9 peut \u00eatre raisonnablement regard\u00e9 comme poursuivant effectivement des \u00e9tudes.&#8221; On the facts, the student had failed a technology institute year in 2014\u20132015, failed two successive first years of a general science licence, and re-enrolled a third consecutive time in the same first year, with only five validated course units in 2016\u20132017; the court held that &#8220;l&#8217;int\u00e9ress\u00e9 ne justifiait, \u00e0 la date de cet arr\u00eat\u00e9, d&#8217;aucune progression ou r\u00e9sultat obtenus dans le cadre des \u00e9tudes suivies en France&#8221; and that later success came too late, being &#8220;post\u00e9rieures \u00e0 l&#8217;arr\u00eat\u00e9 en litige et, par suite, sans influence sur sa l\u00e9galit\u00e9.&#8221; The appeal was dismissed: &#8220;La requ\u00eate de M. B&#8230; est rejet\u00e9e.&#8221; Two practical lessons follow for British students. First, the assessment is frozen at the date of the prefect&#8217;s decision, so results obtained after the refusal cannot save the case on appeal for annulment \u2014 everything must be in the renewal file before the decision. Second, the court accepted that a prior warning letter is not a legal prerequisite: &#8220;l&#8217;administration pouvant opposer un tel refus si elle constate l&#8217;absence de progression ou de r\u00e9sultat obtenus dans le cadre des \u00e9tudes suivies en France par un \u00e9tudiant \u00e9tranger.&#8221; No warning is owed; the results must speak for themselves.<\/p>\n<p>Health cover, often overlooked by British families used to the NHS, should be arranged in parallel. Since Brexit the European Health Insurance Card issued in the UK no longer covers a full academic year of residence, and students must register with the French student social security system through their local caisse primaire d&#8217;assurance maladie (CPAM, the local health insurance fund) \u2014 registration that is free and completed online \u2014 plus, where the university or the family&#8217;s prudence suggests it, a top-up policy (mutuelle) for the share of medical costs the state scheme does not reimburse. A student who later applies for the graduate job-search permit will additionally need to show health insurance in their own name, as the statute expressly requires, so keeping continuous, documented cover from the first year avoids a painful gap at the moment of graduation.<\/p>\n<h2>II. Working alongside your studies, staying on after graduation, and challenging a refusal or removal order<\/h2>\n<h3>A. Can a British student work in France, and how does the graduate job-search permit keep you in the country?<\/h3>\n<p>Yes \u2014 the student card carries an accessory right to salaried work, and the ceiling is set by regulation at 964 hours per calendar year. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000043320747\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000043320747\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article R5221-26<\/a> of the Code du travail (the French Labour Code) provides: &#8220;L&#8217;\u00e9tranger titulaire du titre de s\u00e9jour ou du visa pour un s\u00e9jour d&#8217;une dur\u00e9e sup\u00e9rieure \u00e0 trois mois mentionn\u00e9 au 11\u00b0 de l&#8217;article R. 5221-2 portant la mention \u00e9tudiant est autoris\u00e9 \u00e0 exercer une activit\u00e9 salari\u00e9e, \u00e0 titre accessoire, dans la limite d&#8217;une dur\u00e9e annuelle de travail \u00e9gale \u00e0 964 heures.&#8221; That is roughly 60 percent of full-time annual working hours, matching the 60 percent figure stated in Article L422-1 itself. The official service-public.fr page (<a href=\"https:\/\/www.service-public.gouv.fr\/particuliers\/vosdroits\/F2713\">service-public.fr \u2014 Can a non-European student work in France?<\/a>) confirms the mechanism in plain language. In practice, the 964-hour envelope covers casual jobs, vacation work and the student jobs (jobs \u00e9tudiants) advertised by universities, and the employer hires the student directly without a separate work authorisation, declaring the employment in the usual way. Two cautions matter. First, the work must remain accessory to study: a student working full-time hours while failing every examination invites the prefect, at renewal, to doubt the reality of the studies \u2014 the very test examined above. Second, the hours are counted across all employers over the year, so a student holding two part-time jobs must track the cumulative total, because exceeding the ceiling can taint both the renewal and any later application.<\/p>\n<p>Certain work-adjacent situations need separate paperwork. A paid internship (stage) forming part of the curriculum is covered by the internship agreement (convention de stage) signed with the university rather than the 964-hour envelope, provided the placement meets the legal definition of training. An alternance contract (apprenticeship or professionalisation contract) is different again: it generally requires employee status and, for most non-European students, a change of status or specific authorisation, so a British student offered an alternance rhythm should seek advice before signing. Self-employment (auto-entrepreneur registration) is not covered by the accessory work right at all and requires a different residence basis. None of this affects ordinary salaried student jobs, but British students recruited by London-based employers for remote work while living in France should be particularly careful: French social security and tax residence rules may treat them as working in France regardless of where the employer sits, a question that belongs to detailed residence advice but should never be ignored.<\/p>\n<p>Graduation opens the most valuable door in the student track: the one-year temporary card marked &#8220;recherche d&#8217;emploi ou cr\u00e9ation d&#8217;entreprise&#8221; (job search or business creation, often called the APS \u2014 autorisation provisoire de s\u00e9jour \u2014 in everyday speech, though it is now a full temporary card). <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000049052670\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000049052670\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article L422-10<\/a> of the CESEDA grants it to &#8220;L&#8217;\u00e9tranger titulaire d&#8217;une assurance maladie qui justifie soit avoir \u00e9t\u00e9 titulaire d&#8217;une carte de s\u00e9jour temporaire ou pluriannuelle portant la mention &#8221; \u00e9tudiant &#8221; d\u00e9livr\u00e9e sur le fondement des articles L. 422-1, L. 422-2 ou L. 422-6 et avoir obtenu dans un \u00e9tablissement d&#8217;enseignement sup\u00e9rieur habilit\u00e9 au plan national un dipl\u00f4me au moins \u00e9quivalent au grade de master ou figurant sur une liste fix\u00e9e par d\u00e9cret, soit avoir \u00e9t\u00e9 titulaire d&#8217;une carte de s\u00e9jour pluriannuelle portant la mention &#8221; talent-chercheur &#8221; d\u00e9livr\u00e9e sur le fondement de l&#8217;article L. 421-14 et avoir achev\u00e9 ses travaux de recherche, se voit d\u00e9livrer une carte de s\u00e9jour temporaire portant la mention &#8221; recherche d&#8217;emploi ou cr\u00e9ation d&#8217;entreprise &#8221; d&#8217;une dur\u00e9e d&#8217;un an dans les cas suivants : 1\u00b0 Il entend compl\u00e9ter sa formation par une premi\u00e8re exp\u00e9rience professionnelle, sans limitation \u00e0 un seul emploi ou \u00e0 un seul employeur ; 2\u00b0 Il justifie d&#8217;un projet de cr\u00e9ation d&#8217;entreprise dans un domaine correspondant \u00e0 sa formation ou \u00e0 ses recherches.&#8221; The English-language service-public.fr fact sheet (<a href=\"https:\/\/www.service-public.gouv.fr\/particuliers\/vosdroits\/F17319?lang=en\">service-public.fr \u2014 Residence card or VLS-TS \u2014 Job search \/ business creation<\/a>) details the filing practicalities. Three conditions therefore decide eligibility: a master&#8217;s-level (or listed) degree from a nationally accredited French institution, health insurance in the applicant&#8217;s own name, and either a first professional experience or a business project linked to the field of study \u2014 with no restriction to a single employer, which makes this card far more flexible than the student work right it replaces.
