Those who pick the wrong door, file late, or arrive with the wrong card face the same shock: a refusal letter from the CPAM (caisse primaire d&#8217;assurance maladie, the local fund that manages health cover), a hospital bill to pay out of pocket, and months without a carte Vitale (the green smart card that triggers reimbursement). Third, students fall under their own headings of the guidance and should check the studying section rather than assume either adult route applies automatically. The assessment rules sit in <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000031686322\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000031686322\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">article L. 111-2-3<\/a>, which sends the detail to regulation, and the regulations draw three sharp lines.<\/p>\n<p>Stability first. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000049451865\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000049451865\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article R. 111-2<\/a> treats as stable residents persons whose home or principal place of stay is in metropolitan France or certain overseas territories \u2014 a factual test of where life is actually centred, proved by tax notices, utility bills, rent receipts and school certificates. Lawfulness second. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000038701568\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000038701568\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article R. 111-3<\/a> reserves the benefits to French nationals and to foreigners in a lawful position under stay legislation, who moreover do not already belong to another state&#8217;s scheme under European rules or international agreements. For a British citizen after Brexit, that sentence is decisive: without a valid Withdrawal Agreement card, long-stay visa, residence permit or lawful visa-free presence, the PUMA door stays shut, however long the person has rented a house in the Dordogne. Once affiliated, the cover itself is broad: <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000054711241\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000054711241\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">article L. 160-8<\/a> lists general and specialist medicine, dental care and prostheses, pharmacy, laboratory tests, hospitalisation, rehabilitation and related treatment. The standard French mechanics then apply \u2014 a declared m\u00e9decin traitant (usual GP who coordinates the care pathway), roughly 70 per cent reimbursement of the regulated tariff for most care with the patient funding the balance directly or through a mutuelle (supplementary private insurer), and exposure to d\u00e9passements d&#8217;honoraires (fees charged above the regulated tariff) where the practitioner is authorised to set them.<\/p>\n<p>Money matters overlay this picture twice. Finally, protection does not vanish overnight when work ends: <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000044628954\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000044628954\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">article L. 161-8<\/a> maintains cash benefits for those who stop meeting the activity condition while still meeting residence and stay conditions. Registration itself follows the British government&#8217;s pointer \u2014 <a href=\"https:\/\/www.gov.uk\/guidance\/healthcare-in-france-including-martinique-and-guadaloupe\">applications for PUMA go through the local CPAM office<\/a> \u2014 with the same page warning that <a href=\"https:\/\/www.gov.uk\/guidance\/healthcare-in-france-including-martinique-and-guadaloupe\">a provisional social security number normally arrives by post one to three months after registration<\/a> The carte Vitale itself takes longer still, and until it arrives every consultation is paid upfront and reclaimed on paper \u2014 which is why the start date of rights, examined next, is worth real money.<\/p>\n<h2>II. When the CPAM says no: refusals, hospital bills and how to challenge from France or the United Kingdom<\/h2>\n<h3>A. The refusals British residents actually receive: start dates, visiteur private insurance, and the Paris and Ile-de-France practicalities<\/h3>\n<p>The most expensive refusal is not a flat no but a late yes. Funds regularly open rights only from the date the file is deemed complete \u2014 often the date they receive the r\u00e9c\u00e9piss\u00e9 de demande de carte de s\u00e9jour (the receipt issued when a residence-permit application is lodged) \u2014 leaving months of treatment, sometimes a hospital stay, outside cover. The Court of Appeal of Amiens confirmed the mechanism on 18 April 2025 in a PUMA start-date dispute (RG 24\/00112, judgment available on the official judicial database at <a href=\"https:\/\/www.courdecassation.fr\/decision\/680331a5168408c19df97e2d\">courdecassation.fr<\/a>): a woman who had arrived in France in June 2022 and requested cover in July obtained rights only from 13 September 2022, when the fund received her permit-application receipt, and the fund then rejected her request for backdating. The court rehearsed the founding text \u2014 &#8220;Aux termes de l&#8217;article L. 160-1 du code de la s\u00e9curit\u00e9 sociale, toute personne travaillant ou, lorsqu&#8217;elle n&#8217;exerce pas d&#8217;activit\u00e9 professionnelle, r\u00e9sidant en France de mani\u00e8re stable et r\u00e9guli\u00e8re b\u00e9n\u00e9ficie, en cas de maladie ou de maternit\u00e9, de la prise en charge de ses frais de sant\u00e9 dans les conditions fix\u00e9es au pr\u00e9sent livre&#8221; \u2014 tied the regularity condition to the documented permit step, and ended with a dry outcome: <a href=\"https:\/\/www.courdecassation.fr\/decision\/680331a5168408c19df97e2d\">&#8220;D\u00e9boute Mme [T] [J] de sa demande tendant \u00e0 l&#8217;ouverture r\u00e9troactive de ses droits \u00e0 l&#8217;assurance maladie au 19 juillet 2022&#8221;.<\/a> British readers should draw three lessons. File the PUMA request the week of arrival even if the file is incomplete, because the paper trail of early filing is the only weapon later. Chase the r\u00e9c\u00e9piss\u00e9 from the pr\u00e9fecture (the local state authority handling permits) as the single most valuable document in the health file. And frame any later appeal as a precise demand about the start date with dated proof for every week, not as a general complaint about hospital invoices \u2014 in that same judgment the court stressed that <a href=\"https:\/\/www.courdecassation.fr\/decision\/680331a5168408c19df97e2d\">&#8220;L&#8217;objet du litige porte donc exclusivement sur le point de d\u00e9part d&#8217;ouverture des droits&#8221;<\/a> and set aside the first-instance ruling precisely because the lower court had ordered an invoice paid instead of deciding the start-date question put to it.<\/p>\n<p>The second classic refusal hits British holders of a visiteur residence card \u2014 typically retirees who proved self-sufficiency to obtain their visa. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776442\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776442\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article L. 426-20 of the foreigners code<\/a> states that the self-supporting foreigner receives a one-year visiteur card and that <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776442\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776442\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">&#8220;Il doit en outre justifier de la possession d&#8217;une assurance maladie couvrant la dur\u00e9e de son s\u00e9jour et prendre l&#8217;engagement de n&#8217;exercer en France aucune activit\u00e9 professionnelle.&#8221;<\/a> Relying on that undertaking, funds routinely refuse PUMA membership to visiteur holders and tell them to claim on their private insurance instead. The trap is real: the private policy that satisfied the consulate often caps payouts, excludes pre-existing conditions, or refuses direct settlement with French hospitals, leaving the retiree to advance thousands of euros. Anyone choosing the visiteur path should therefore buy insurance that genuinely covers French hospital tariffs for the full year, keep the certificate, and budget for the possibility of litigating the articulation between the insurance undertaking and the residence-based right \u2014 an argument that turns on individual facts and requires advice before the fund&#8217;s deadline expires.<\/p>\n<p>Paris and Ile-de-France add their own layer of practical difficulty. The CPAM de Paris handles an enormous foreign caseload, appointments and document requests move slowly, and English-language support remains patchy despite the <a href=\"https:\/\/www.ameli.fr\/assure\/english-pages\">ameli English pages<\/a> that explain registration steps. Postal delays in the capital mean the one-to-three-month wait for a provisional number frequently stretches further, and hospitals in the AP-HP network bill aggressively while cover is pending. On the litigation side, venue is straightforward: disputes belong to the p\u00f4le social (social chamber) of the judicial court of the insured&#8217;s home \u2014 the Tribunal judiciaire de Paris for the capital \u2014 with appeal to the Paris Court of Appeal, as illustrated by the Lille-to-Douai\/Amiens path in the 2025 case. The decisive factor is always the same \u2014 acting within the time limit with a complete dated file \u2014 which is the subject of the final section.<\/p>\n<h3>B. Challenging the decision: the internal appeal, the social chamber, and the evidence that wins<\/h3>\n<p>Every CPAM refusal must state the remedies, and the first is compulsory: the CRA of the fund that decided. The Amiens judgment recalls the framework in terms every British appellant should memorise \u2014 claims against fund decisions go to an internal appeals board, that board must be seized within two months of notification, and more generally <a href=\"https:\/\/www.courdecassation.fr\/decision\/680331a5168408c19df97e2d\">&#8220;s&#8217;il n&#8217;en est dispos\u00e9 autrement, le d\u00e9lai de recours pr\u00e9alable et le d\u00e9lai de recours contentieux sont de deux mois \u00e0 compter de la notification de la d\u00e9cision contest\u00e9e&#8221;.<\/a> Two months for the internal appeal, then two months for the court appeal if the board rejects or stays silent: missing either deadline ends the case whatever its merits. The CRA letter should therefore be sent by tracked post or deposited against receipt within days, identify the exact decision by date and reference, state precisely what is asked \u2014 opening of rights, a specific start date, reimbursement of a named invoice \u2014 and attach the full dated file rather than promises of documents to come.<\/p>\n<p>The file that wins has the same five blocks in every case. Identity and nationality: passport, birth certificate, and for good measure the British driving licence or national insurance letter showing the move is genuine. Lawful presence: Withdrawal Agreement card or long-stay visa plus passport stamps, the permit-application r\u00e9c\u00e9piss\u00e9 with its date, and any pr\u00e9fecture correspondence proving continuity of status \u2014 the Amiens case shows the r\u00e9c\u00e9piss\u00e9 date can become the rights date, so its absence costs money directly. Stability week by week: lease or title deeds, electricity and telephone bills, French tax notices, children&#8217;s school certificates, bank statements showing daily life in France, arranged as an unbroken chain covering the three months before the application and everything since. Non-membership of another scheme: the S1 position clarified (applied for, refused with reasons, or held and registered), HMRC letters on pension and benefit status, and any A1 certificate for posted workers. And the medical-financial loss: hospital invoices, pharmacy receipts, proof of upfront payment, and the private insurer&#8217;s refusal or cap letter where a visiteur policy is in play. Each block answers one statutory condition, and the covering letter should map each document to the condition it proves, because the board rapporteur decides on papers and rewards clarity.<\/p>\n<p>If the board rejects the claim, the dispute moves to the p\u00f4le social of the judicial court, where procedure is written, representation by counsel is strongly advisable for appellants living abroad, and the court&#8217;s review covers both the facts and the law \u2014 including, where relevant, European coordination and the Withdrawal Agreement. Two strategic warnings from the 2025 case law deserve emphasis. Define the object of the dispute exactly: ask the court for the start date with reasons, or for reimbursement of specified invoices, but do not mix both vaguely, since a court that grants something outside the claim risks reversal on appeal. And never let parallel tracks drift: a pending pr\u00e9fecture permit renewal, a GHIC reimbursement claim in the United Kingdom, and the French court case must tell the same story about residence dates, because inconsistent dates across files destroy credibility. British residents who receive a refusal while already back in the United Kingdom should instruct promptly, diarize both two-month limits from the notification date shown on the letter, and preserve every envelope. Handled this way, a CPAM refusal is the beginning of a structured dispute with real prospects \u2014 not the last word.<\/p>\n<h2>Conclusion<\/h2>\n<p>Healthcare is the first promise a British move to France must keep, and after Brexit it keeps itself through paperwork, not passports. Pensioners and qualifying workers should secure the S1 and register it with the CPAM before relying on any French right; everyone else should build the PUMA file from week one \u2014 lawful status, unbroken three-month proof, dated chain of daily life \u2014 and treat the permit receipt as the most valuable page in it. Where the fund refuses or backdates unfairly, the two-month internal appeal followed by the social chamber offers a genuine remedy, as the 2025 start-date litigation demonstrates, provided the demand is precise and the evidence is complete. The system is demanding but legible: meet each statutory condition with paper, meet each deadline with days to spare, and the cover follows.
