Since Brexit you travel on a British passport with no EU mobility rights, which means the French border officer who waves you through for a two-week holiday has no power to let you stay for a year. A British citizen who settles in France today must enter with the right long-stay visa, which is the <em>visa de long s\u00e9jour<\/em>, the consular sticker placed in your passport before you travel that authorises a stay of more than three months, and then convert that entry into a residence permit, which is the <em>carte de s\u00e9jour<\/em>, the plastic card issued by the local state authority that proves your right to live and where relevant work in France. Get either step wrong and the consequences run on rails: no permit without the right visa, no renewal where the file is thin, and after a refusal an order to leave French territory, which is the <em>obligation de quitter le territoire fran\u00e7ais<\/em>, universally shortened to OQTF, with a short deadline to challenge it before the administrative court, which is the <em>tribunal administratif<\/em>, the first-level court that hears cases against the administration.<\/p>\n<p>This guide is for British newcomers, meaning people who arrived after the end of the Brexit transition, not for those covered by the Withdrawal Agreement. Everyone else must read what follows in order: which visa to ask for, what the consulate really examines, which residence permit matches that visa once you are here, and how to challenge each type of refusal within its own deadline. The official sources are quoted throughout, the court decisions are real and linked, and the deadlines are the ones that actually get cases thrown out when they are missed.<\/p>\n<h2>I. Which French long-stay visa should a British newcomer apply for after Brexit?<\/h2>\n<h3>A. Do I need a visitor, worker or family visa to move to France from the UK?<\/h3>\n<p>Start from the basic rule, which now applies to British citizens exactly as it applies to Americans, Australians or Indians. Article L. 411-1 of the Code on the Entry and Residence of Foreigners and the Right of Asylum, known by its French initials CESEDA, provides that &#8220;tout \u00e9tranger \u00e2g\u00e9 de plus de dix-huit ans qui souhaite s\u00e9journer en France pour une dur\u00e9e sup\u00e9rieure \u00e0 trois mois doit \u00eatre titulaire de l&#8217;un des documents de s\u00e9jour suivants : 1\u00b0 Un visa de long s\u00e9jour ;&#8221; (<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000051562113\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000051562113\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">CESEDA, art. L. 411-1<\/a>). In plain English: any foreigner over eighteen who wants to stay in France for more than three months must hold one of a closed list of residence documents, and the first item on that list is the long-stay visa. A holiday of under ninety days inside the Schengen area is a different matter and needs no visa for British visitors; a move to France is not a long holiday and the three-month line is where the obligation bites.<\/p>\n<p>The visa must be obtained before you travel, from the French diplomatic or consular authorities in the country where you live. Article L. 312-2 states that &#8220;Tout \u00e9tranger souhaitant entrer en France en vue d&#8217;y s\u00e9journer pour une dur\u00e9e sup\u00e9rieure \u00e0 trois mois doit solliciter aupr\u00e8s des autorit\u00e9s diplomatiques et consulaires fran\u00e7aises un visa de long s\u00e9jour dont la dur\u00e9e de validit\u00e9 ne peut \u00eatre sup\u00e9rieure \u00e0 un an.&#8221; (<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000051562134\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000051562134\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">CESEDA, art. L. 312-2<\/a>). You cannot fly in without a visa and regularise after arrival by applying for a permit at the local office: the first issue of a temporary or multi-year residence card is conditional on producing the long-stay visa, because &#8220;la premi\u00e8re d\u00e9livrance d&#8217;une carte de s\u00e9jour temporaire ou d&#8217;une carte de s\u00e9jour pluriannuelle est subordonn\u00e9e \u00e0 la production par l&#8217;\u00e9tranger du visa de long s\u00e9jour mentionn\u00e9 aux 1\u00b0 ou 2\u00b0 de l&#8217;article L. 411-1.&#8221; (<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776891\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776891\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">CESEDA, art. L. 412-1<\/a>). The <em>pr\u00e9fecture<\/em>, which is the local office of the French state in each <em>d\u00e9partement<\/em> that issues residence permits, will simply refuse a first application built on entry without a visa, and that refusal can then carry an OQTF, as Part II explains.<\/p>\n<p>Choosing the right visa category is the single most important decision in the whole process, because the residence permit you receive later mirrors the visa you entered with. A retiree who enters on a visitor visa cannot take a salaried job afterwards; a worker who enters on a visitor visa cannot convert it into an employee card without leaving. Applications run through the official France-Visas portal, which describes the long-stay visa as the permit for stays of more than three months and directs each applicant to the category matching the purpose of stay (<a href=\"https:\/\/www.france-visas.gouv.fr\/en\/visa-de-long-sejour\">France-Visas, long-stay visa<\/a>). The British government&#8217;s own guidance for citizens in France confirms the same starting point: after Brexit, British nationals who want to live in France must meet French immigration requirements, with residence rights under the Withdrawal Agreement reserved to those already settled before 2021 (<a href=\"https:\/\/www.gov.uk\/guidance\/living-in-france\">GOV.UK, Living in France<\/a>). Measure your own plan against the four categories below before you book the consular appointment.<\/p>\n<p>First, the visitor route, which suits retirees and anyone living on savings, pensions or remote foreign income who will not work in France. The official Service-Public page, verified on 1 June 2026, states the position bluntly: applicants must satisfy three cumulative conditions, covering sufficient resources for the whole stay, health insurance covering the whole stay, and a bar on any work in France whether employed or self-employed (<a href=\"https:\/\/www.service-public.gouv.fr\/particuliers\/vosdroits\/F302\">Service-Public, carte de s\u00e9jour temporaire visiteur<\/a>). The resources test is quantified: the same official page sets the minimum for a single person at 1 477,93 euros net per month assessed over one year, roughly the full net minimum wage level, and the funds must cover the whole planned stay, not merely the first month. Private health insurance covering the full stay is compulsory because a visitor has no French employment record and no automatic health cover. And the promise not to work is absolute: any salaried post, any self-employed registration, any contractor invoice to a French client breaches the status and destroys the renewal. British retirees with a state or private pension comfortably above the threshold and comprehensive insurance are the natural holders of this card, which is valid for one year maximum and renewable; younger applicants with thin savings who privately intend to pick up bar or harvest work are the natural refusal statistics.<\/p>\n<p>Second, the worker route, which belongs to the employer as much as to you. French law requires the job to be authorised before the visa exists. Article L. 5221-2 of the Labour Code provides that &#8220;Pour entrer en France en vue d&#8217;y exercer une profession salari\u00e9e, l&#8217;\u00e9tranger pr\u00e9sente : 1\u00b0 Les documents et visas exig\u00e9s par les conventions internationales et les r\u00e8glements en vigueur ; 2\u00b0 Un contrat de travail vis\u00e9 par l&#8217;autorit\u00e9 administrative ou une autorisation de travail.&#8221; (<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006903732\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006903732\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Labour Code, art. L. 5221-2<\/a>). In practice your French employer applies to the regional labour authority, the DREETS, which is the <em>direction r\u00e9gionale de l&#8217;\u00e9conomie, de l&#8217;emploi, du travail et des solidarit\u00e9s<\/em>, the regional state service that endorses foreign hires, for a work authorisation, and only with that document do you seek the visa. The matching permits then follow the contract: &#8220;L&#8217;\u00e9tranger qui exerce une activit\u00e9 salari\u00e9e sous contrat de travail \u00e0 dur\u00e9e ind\u00e9termin\u00e9e se voit d\u00e9livrer une carte de s\u00e9jour temporaire portant la mention &#8221; salari\u00e9 &#8221; d&#8217;une dur\u00e9e maximale d&#8217;un an.&#8221; (<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776797\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776797\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">CESEDA, art. L. 421-1<\/a>), where the <em>contrat \u00e0 dur\u00e9e ind\u00e9termin\u00e9e<\/em> is the open-ended permanent contract, while fixed-term and seconded staff receive the temporary-worker card, since &#8220;L&#8217;\u00e9tranger qui exerce une activit\u00e9 salari\u00e9e sous contrat de travail \u00e0 dur\u00e9e d\u00e9termin\u00e9e ou qui fait l&#8217;objet d&#8217;un d\u00e9tachement conform\u00e9ment aux articles L. 1262-1 , L. 1262-2 et L. 1262-2-1 du code du travail se voit d\u00e9livrer une carte de s\u00e9jour temporaire portant la mention &#8221; travailleur temporaire &#8221; d&#8217;une dur\u00e9e maximale d&#8217;un an.&#8221; (<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776791\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776791\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">CESEDA, art. Highly qualified hires should look instead at the four-year talent route: the code grants &#8220;une carte de s\u00e9jour pluriannuelle portant la mention &#8221; talent-salari\u00e9 qualifi\u00e9 &#8221; d&#8217;une dur\u00e9e maximale de quatre ans&#8221; to foreigners meeting the degree or innovative-company conditions and the pay threshold set by regulation (<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000049052463\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000049052463\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">CESEDA, art. L. 421-9<\/a>). British professionals recruited to Paris finance, tech or research posts will normally enter through one of these three doors, and the employer&#8217;s immigration timetable, not yours, sets the pace.<\/p>\n<p>Third, the family route, which covers British citizens joining a French spouse or asserting a genuine private and family life in France. The spouse of a French national receives a one-year private-and-family-life card where three conditions coincide: &#8220;L&#8217;\u00e9tranger mari\u00e9 avec un ressortissant fran\u00e7ais, se voit d\u00e9livrer une carte de s\u00e9jour temporaire portant la mention &#8221; vie priv\u00e9e et familiale &#8221; d&#8217;une dur\u00e9e d&#8217;un an lorsque les conditions suivantes sont r\u00e9unies : 1\u00b0 La communaut\u00e9 de vie n&#8217;a pas cess\u00e9 depuis le mariage&#8221; (<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000043982327\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000043982327\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">CESEDA, art. L. 423-1<\/a>), with continued French nationality of the spouse and transcription of any foreign marriage onto French civil-status registers completing the test. Where none of the standard family boxes fits, the safety-net provision still protects real family life: a foreigner whose personal and family ties in France are such that refusing residence would disproportionately harm the right to respect for private and family life receives the same one-year card, since the statute covers the person for whom &#8220;le refus d&#8217;autoriser son s\u00e9jour porterait \u00e0 son droit au respect de sa vie priv\u00e9e et familiale une atteinte disproportionn\u00e9e au regard des motifs du refus&#8221; (<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000043982318\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000043982318\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">CESEDA, art. L. 423-23<\/a>). Unmarried British partners of French residents, parents of French children, and carers embedded in a French household live or die on this proportionality test, proved with leases, school certificates, birth records and evidence of daily life, not with assertions. The code grants the student card to the foreigner who shows enrolment and sufficient means: the holder &#8220;se voit d\u00e9livrer une carte de s\u00e9jour temporaire portant la mention &#8221; \u00e9tudiant &#8221; d&#8217;une dur\u00e9e inf\u00e9rieure ou \u00e9gale \u00e0 un an&#8221; and may work incidentally within sixty per cent of the annual working year (<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776689\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776689\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">CESEDA, art. L. 422-1<\/a>). Whatever the category, most long-stay visas are issued as VLS-TS, the <em>visa de long s\u00e9jour valant titre de s\u00e9jour<\/em>, meaning a long-stay visa that itself counts as a residence permit once validated online with the OFII, which is the <em>Office fran\u00e7ais de l&#8217;immigration et de l&#8217;int\u00e9gration<\/em>, the state office that registers newcomers, collects the validation fee and summons arrivals to medical and civic appointments. Validate within three months of arrival, keep the confirmation, and attend the summons: an unvalidated VLS-TS leaves you undocumented at the first renewal.<\/p>\n<h3>B. What does the consulate actually check before refusing my long-stay visa?<\/h3>\n<p>British applicants often assume the consulate rubber-stamps any complete file, or conversely that a French employer&#8217;s work authorisation guarantees the visa. Both assumptions are wrong, and the administrative courts say so in published decisions. The leading recent statement comes from the Nantes administrative appeal court, the <em>cour administrative d&#8217;appel<\/em>, which is the second-level administrative court that hears appeals from tribunal judgments, in a 1 October 2024 ruling on a long-stay work visa: &#8220;les autorit\u00e9s fran\u00e7aises, saisies d&#8217;une telle demande, disposent, sous le contr\u00f4le du juge de l&#8217;exc\u00e8s de pouvoir, d&#8217;un large pouvoir d&#8217;appr\u00e9ciation et peuvent se fonder non seulement sur des motifs tenant \u00e0 l&#8217;ordre public, tel que le d\u00e9tournement de l&#8217;objet du visa, mais aussi sur toute consid\u00e9ration d&#8217;int\u00e9r\u00eat g\u00e9n\u00e9ral.&#8221; (<a href=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000050301197\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000050301197\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">CAA Nantes, 1 Oct. 2024, No. 23NT00454<\/a>). In ordinary terms the consulate enjoys a wide discretion, reviewed only for manifest error by the judge who hears excess-of-power claims, and it may refuse on public-order grounds such as misuse of the visa&#8217;s purpose as well as on any general-interest consideration. The same judgment draws the employer&#8217;s-document consequence bluntly: &#8220;La circonstance qu&#8217;un travailleur \u00e9tranger dispose d&#8217;un contrat de travail vis\u00e9 par la direction r\u00e9gionale des entreprises, de la concurrence, de la consommation, du travail et de l&#8217;emploi (DIRECCTE) ou d&#8217;une autorisation de travail, ne fait pas obstacle \u00e0 ce que l&#8217;autorit\u00e9 comp\u00e9tente refuse de lui d\u00e9livrer un visa d&#8217;entr\u00e9e en France en se fondant, sous le contr\u00f4le du juge de l&#8217;exc\u00e8s de pouvoir, sur tout motif d&#8217;int\u00e9r\u00eat g\u00e9n\u00e9ral.&#8221; The endorsed contract or work authorisation does not tie the consulate&#8217;s hands; it is one favourable factor among others, and the visa can still be refused on a general-interest ground that survives light-touch judicial review.<\/p>\n<p>That refusal must nevertheless be reasoned, and the reasoning requirement is your first lever of challenge. The Nantes court recalls that &#8220;Les d\u00e9cisions des autorit\u00e9s consulaires portant refus d&#8217;une demande de visa doivent \u00eatre motiv\u00e9es en vertu des dispositions de l&#8217;article L. 211-2 du code des relations entre le public et l&#8217;administration.&#8221; (<a href=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000050301197\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000050301197\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">CAA Nantes, 1 Oct. 2024, No. 23NT00454<\/a>). In practice consular refusals use standard formula boxes: means of subsistence unproven, documents incomplete or unreliable, or risk that the visa&#8217;s purpose will be diverted towards unlawful residence or unlawful activity after expiry. The 2024 case turned on exactly such formulas, where the consular decision stated that the supporting information was incomplete or unreliable and that a misuse risk existed; the court held those mentions sufficient in that file because the applicant could identify the factual and legal reasons from the documents he had produced, while making clear that genuinely unreasoned decisions are annullable. So read the ticked boxes against your own bundle: which precise document was judged unreliable, which income line was judged insufficient, which fact suggested you would overstay or work unlawfully. A refusal that ticks every box but matches none of your papers is the classic insufficient-reasons case, and it is winnable, as Section II shows.<\/p>\n<p>The same decision shows how files actually fail on the facts, and British readers should take the lesson personally because the fact patterns recur in London-processed applications. The applicant held a fibre-optic technician authorisation yet proved his experience with a single employer certificate covering nine months; his wife lived in France while he applied as a worker rather than through family reunion; and he declared accommodation with a relative in Nice while the hiring company sat in the Yvelines near Paris. The court concluded that &#8220;la commission de recours contre les refus de visa d&#8217;entr\u00e9e en France a pu l\u00e9galement refuser le visa sollicit\u00e9, en raison de l&#8217;absence d&#8217;ad\u00e9quation entre l&#8217;exp\u00e9rience professionnelle de l&#8217;int\u00e9ress\u00e9 et l&#8217;emploi propos\u00e9 et du risque cons\u00e9cutif de d\u00e9tournement de l&#8217;objet du visa \u00e0 d&#8217;autres fins que l&#8217;exercice de l&#8217;emploi autoris\u00e9.&#8221; (<a href=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000050301197\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000050301197\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">CAA Nantes, 1 Oct. 2024, No. 23NT00454<\/a>). Translate that into a British file: the junior analyst sponsored for a senior Paris post with a thin CV, the partner who applies as a skilled worker while the French spouse waits at home, the applicant who declares a cousin&#8217;s flat in Marseille for a Lille job. Coherence is evidence. Before filing, align every line: employment history with the sponsored role, declared address with the workplace, family situation with the chosen route, bank statements with the means threshold, insurance certificate with the full stay. Where a line cannot be aligned, change the route rather than hoping the officer misses it, because officers are trained to spot exactly these gaps.<\/p>\n<h2>II. Once in France, how do I get my residence permit and challenge a refusal or OQTF?<\/h2>\n<h3>A. Which residence permit matches my visa, and how do I renew it in time?<\/h3>\n<p>Arrival is the middle of the process, not the end. Holders of a VLS-TS validate online with the OFII within three months, as noted above; holders of a visa marked <em>carte de s\u00e9jour \u00e0 solliciter<\/em>, meaning a visa that requires the holder to apply for a card, attend the <em>pr\u00e9fecture<\/em> of their home <em>d\u00e9partement<\/em> promptly with passport, visa, birth certificate, proof of address, photographs and the category-specific documents. The governing principle remains Article L. 412-1: the first card is issued against the long-stay visa, so the category you chose at the consulate dictates the card you may claim.
