She owns a flat in Paris, banks with a French high-street bank, and signed an English <em>lasting power of attorney<\/em> \u2014 the English-law instrument appointing someone to manage her property or welfare if she loses mental capacity \u2014 well before the first signs of dementia. Now the bank has frozen online transfers, and the <em>notaire<\/em> (the French public officer who alone can complete a property sale) refuses to sell the Dordogne cottage on the strength of that English document. This article explains what an English lasting power of attorney, universally known as an LPA, is worth in France after Brexit, how to give it its best chance, and which French protection measure to open when the bank or the <em>notaire<\/em> says no. Every French term is explained the first time it appears.<\/p>\n<p>The short answer is that an LPA works smoothly within England and Wales but arrives in France as a foreign paper which no statute obliges a French bank or <em>notaire<\/em> to honour automatically. Your strongest file therefore combines the registered LPA with an <em>apostille<\/em> (the standardised certificate authenticating a document for use abroad), a translation by a <em>traducteur asserment\u00e9<\/em> (a sworn translator registered with a French court of appeal), and proof the document was valid where signed. Where that file is still refused, French law offers three domestic routes: the <em>mandat de protection future<\/em> (the French future protection mandate, signed in advance for incapacity), the <em>habilitation familiale<\/em> (a family authorisation granted by the guardianship judge), and full judicial protection as <em>tutelle<\/em> (guardianship) or <em>curatelle<\/em> (a lighter supervision regime). The Court of Cassation (<em>Cour de cassation<\/em>, France&#8217;s highest civil court) has already drawn the boundaries of what an <em>apostille<\/em> proves and when a judge may replace a mandate with a court measure. This guide sets out each step, the papers to gather, Paris practice, and the remedies \u2014 the application to the <em>juge des tutelles<\/em> (the guardianship judge) and the appeal \u2014 that unblock a frozen file.<\/p>\n<h2>I. Will a French bank or notaire accept your English lasting power of attorney?<\/h2>\n<h3>A. What an English LPA is and how France reads it: a foreign private mandate<\/h3>\n<p>Start with the English side, because everything you present in France must first be regular in England. The official guidance on <a href=\"https:\/\/www.gov.uk\/power-of-attorney\">making and registering a lasting power of attorney<\/a> explains that the donor must be at least 18 and still have mental capacity \u2014 the ability to make their own decisions \u2014 when the LPA is made It adds a point that matters for Britons settled abroad: neither living in the United Kingdom nor holding British citizenship is required to make one An LPA therefore remains available to a British retiree already living in the Dordogne, provided she still had capacity when she signed. There are two kinds \u2014 property and financial affairs on the one hand, health and welfare on the other \u2014 and neither has any effect until a distinct second step is complete: registration with the Office of the Public Guardian, currently advertised at eight to ten weeks where the application contains no mistakes Registration is what turns a signed form into an operative instrument, and the published fee position is \u00a392 per instrument applied for, subject to a reduction or exemption in some cases Keep the registration confirmation from the Office of the Public Guardian with the original document: it is the first paper a French bank will ask to see, because an unregistered LPA is, in English law itself, simply not yet usable.<\/p>\n<p>Cross the Channel and the analysis changes completely. French law knows the <em>mandat<\/em> (the mandate, the contract by which one person gives another the power to act in their name), and <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006445236\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006445236\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 1984 of the <em>Code civil<\/em> (the French civil code)<\/a> defines it word for word: &#8220;Le mandat ou procuration est un acte par lequel une personne donne \u00e0 une autre le pouvoir de faire quelque chose pour le mandant et en son nom.&#8221; An English LPA looks, to French eyes, like a foreign <em>mandat<\/em>: a private writing, signed before English witnesses, often with no French <em>notaire<\/em> anywhere in the chain. That characterisation decides which probative rule applies. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000043895621\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000043895621\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 47 of the civil code<\/a> governs foreign civil-status instruments and provides, word for word: &#8220;Tout acte de l&#8217;\u00e9tat civil des Fran\u00e7ais et des \u00e9trangers fait en pays \u00e9tranger et r\u00e9dig\u00e9 dans les formes usit\u00e9es dans ce pays fait foi, sauf si d&#8217;autres actes ou pi\u00e8ces d\u00e9tenus, des donn\u00e9es ext\u00e9rieures ou des \u00e9l\u00e9ments tir\u00e9s de l&#8217;acte lui-m\u00eame \u00e9tablissent, le cas \u00e9ch\u00e9ant apr\u00e8s toutes v\u00e9rifications utiles, que cet acte est irr\u00e9gulier, falsifi\u00e9 ou que les faits qui y sont d\u00e9clar\u00e9s ne correspondent pas \u00e0 la r\u00e9alit\u00e9.&#8221; A regularly signed and registered LPA therefore starts with a presumption of regularity \u2014 <em>fait foi<\/em>, it is taken as proving what it states \u2014 but that presumption is rebuttable, and the bank or <em>notaire<\/em> is entitled to carry out <em>toutes v\u00e9rifications utiles<\/em> (all useful checks) before releasing funds or authenticating a sale. Refusal is not, as such, unlawful: for a <em>notaire<\/em>, who engages personal liability on every <em>acte authentique<\/em> (the formal notarised deed that alone transfers French land), accepting a doubtful foreign power is a professional risk, and caution is built into the office.<\/p>\n<p>Three practical objections recur, and you should test your file against each before presenting it. First, scope: a property-and-affairs LPA does not appoint you as owner, it authorises defined acts, and many LPAs contain restrictions \u2014 no gifts above a threshold, no sale of a specified property, joint appointment requiring two signatures \u2014 which the French reader will apply literally. Second, timing: an LPA signed after capacity was already lost is void in English law, and a French judge asked to enforce it will want evidence of capacity at signature, ideally a contemporaneous attendance note from the English solicitor. Third, form for land: selling French land requires an <em>acte authentique<\/em> received by a French <em>notaire<\/em>, and most <em>notaires<\/em> will only act on a foreign power that is apostilled, sworn-translated, and, for high-value sales, confirmed by a French legal opinion (<em>consultation juridique<\/em>, the written advice of a lawyer on the applicable law). None of this means the LPA is worthless \u2014 it means it is the opening of the file, not the whole file. Families who grasp this early avoid the classic trap: presenting a bare photocopy of the LPA at the bank counter, being refused, and concluding that nothing can be done, when the refusal letter simply lists the missing authentications.<\/p>\n<h3>B. How to give your LPA its best chance: apostille, sworn translation and proof pack<\/h3>\n<p>The single most useful authentication is the <em>apostille<\/em> issued under the Hague Convention of 5 October 1961 abolishing legalisation for foreign public documents. For an English LPA this means the Foreign, Commonwealth and Development Office apostille, applied to the registered instrument or to a certified copy, confirming the signature and seal of the certifying officer. What exactly that certificate proves was settled by the First Civil Chamber of the Court of Cassation on 13 May 2020 (appeal no. 19-11.374, reported in the Bulletin, <a href=\"https:\/\/www.courdecassation.fr\/decision\/5fca585306daec22cf0296de\">Court of Cassation, First Civil Chamber, 13 May 2020, no. 19-11.374<\/a>). The court recalled, word for word: &#8220;Aux termes de l&#8217;article 5, alin\u00e9a 2, de la Convention de La Haye du 5 octobre 1961 supprimant l&#8217;exigence de la l\u00e9galisation des actes publics \u00e9trangers, l&#8217;apostille d\u00fbment remplie atteste la v\u00e9racit\u00e9 de la signature, la qualit\u00e9 en laquelle le signataire de l&#8217;acte a agi et, le cas \u00e9ch\u00e9ant, l&#8217;identit\u00e9 du sceau ou timbre dont cet acte est rev\u00eatu.&#8221; An apostille therefore proves the origin of the paper \u2014 whose signature, in what capacity, which seal \u2014 and nothing more. It does not certify that the donor had capacity, that the attorneys remain appointed, or that the LPA covers the act you propose. The same ruling adds the second half of the lesson, word for word: &#8220;Si l&#8217;article 7 de ce texte impose la tenue obligatoire d&#8217;un registre destin\u00e9 \u00e0 permettre un contr\u00f4le a posteriori des apostilles d\u00e9livr\u00e9es dans chaque Etat partie par l&#8217;autorit\u00e9 habilit\u00e9e, la v\u00e9rification qu&#8217;il autorise rev\u00eat un caract\u00e8re facultatif et vise exclusivement \u00e0 permettre \u00e0 l&#8217;autorit\u00e9 de l&#8217;Etat destinataire de s&#8217;assurer, le cas \u00e9ch\u00e9ant, de l&#8217;origine de l&#8217;apostille en prenant contact avec l&#8217;autorit\u00e9 de l&#8217;Etat qui est cens\u00e9e l&#8217;avoir \u00e9mise.&#8221; The receiving authority <em>may<\/em> check the issuing register, but it does not have to, and a court that finds the apostille authenticates the wrong signature \u2014 in that case a third party&#8217;s rather than the registrar&#8217;s \u2014 is entitled to hold, without further enquiry, that the document cannot take effect in France. Draw the operational conclusion: apostille the right document, in the right chain \u2014 the registered LPA as issued or a copy certified by the proper officer \u2014 because an apostille on an odd copy invites the exact rejection the Court of Cassation approved.<\/p>\n<p>Translation comes next, and here French practice is strict. Banks and <em>notaires<\/em> expect a full translation by a <em>traducteur asserment\u00e9<\/em>, attached to the apostilled original, with the translator&#8217;s stamp, signature and court-of-appeal registration number on every page. A home-made translation, or even an excellent translation by an unlisted professional, is routinely returned. Assemble what experienced files call the proof pack (<em>dossier de preuve<\/em>, the bundle of documents establishing your authority): the registered LPA with its Office of the Public Guardian validation page; the apostille; the sworn translation; photographic identification for donor and attorneys; recent proof of the donor&#8217;s address in France (utility bill, <em>taxe fonci\u00e8re<\/em> bill); the English solicitor&#8217;s file note on capacity at signature where one exists; and, where attorneys have changed or one has died or disclaimed, the supporting deeds. Present this pack in one indexed bundle, keep a copy, and ask the bank for a written decision: a refusal letter naming the missing item is the document on which everything else turns, because it tells you whether you face a curable authentication gap or a policy refusal that only a French court measure will cure. Where the bank invokes anti-fraud or anti-money-laundering checks, comply in writing, set a reasonable deadline, and keep every exchange: the paper trail later proves to the guardianship judge that the family route was tried first and that funds are genuinely blocked, which is precisely what makes an urgent application credible.<\/p>\n<p>One related English instrument deserves a warning. The older <em>enduring power of attorney<\/em> (the EPA, the pre-October-2007 English form) and informal letters of authority carry far less weight: EPAs were never designed for registration in the modern sense, and French readers treat them with visible suspicion. Likewise, a health-and-welfare LPA has almost no direct purchase in France, where medical and personal decisions for an incapacitated adult follow French health and guardianship law rather than an English deed. Spend your authentication budget on the property-and-affairs LPA \u2014 apostille, sworn translation, proof of registration \u2014 and do not be surprised if the bank accepts that instrument for day-to-day management while the <em>notaire<\/em> still refuses it for a sale. That split outcome is normal: moving money within an account is reversible, transferring land by <em>acte authentique<\/em> is not, and the <em>notaire<\/em>&#8216;s liability explains the higher bar. When the sale cannot wait, the answer is not to argue longer with the <em>notaire<\/em> but to open the French measure described in Part II, with the LPA annexed as evidence of the donor&#8217;s wishes \u2014 a use to which the guardianship judge is far more receptive than the conveyancing office.<\/p>\n<h2>II. If the LPA is refused: which French protection measure to open and how to challenge a refusal?<\/h2>\n<h3>A. The three French routes: future protection mandate, family authorisation, guardianship<\/h3>\n<p>French law starts from a threshold question that many British families have never had to articulate: is the person medically unable to look after their own interests? <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006427435\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006427435\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 425 of the civil code<\/a> answers it word for word: &#8220;Toute personne dans l&#8217;impossibilit\u00e9 de pourvoir seule \u00e0 ses int\u00e9r\u00eats en raison d&#8217;une alt\u00e9ration, m\u00e9dicalement constat\u00e9e, soit de ses facult\u00e9s mentales, soit de ses facult\u00e9s corporelles de nature \u00e0 emp\u00eacher l&#8217;expression de sa volont\u00e9 peut b\u00e9n\u00e9ficier d&#8217;une mesure de protection juridique pr\u00e9vue au pr\u00e9sent chapitre.&#8221; Note the two cumulative demands: an <em>alt\u00e9ration m\u00e9dicalement constat\u00e9e<\/em> (a medically certified impairment) of mind or body, and resulting inability to provide for one&#8217;s own interests. Old age alone, eccentricity, or a bad financial decision do not satisfy this test; a detailed medical certificate (<em>certificat m\u00e9dical circonstanci\u00e9<\/em>, the reasoned certificate describing the impairment) does. Everything that follows \u2014 mandate, family authorisation, guardianship \u2014 hangs on that certificate, and files fail more often on weak medical evidence than on any point of law.<\/p>\n<p>The first route is the one closest in spirit to the English LPA: the <em>mandat de protection future<\/em>, available to anyone who plans ahead. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000031345528\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000031345528\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 477 of the civil code<\/a> opens it word for word: &#8220;Toute personne majeure ou mineure \u00e9mancip\u00e9e ne faisant pas l&#8217;objet d&#8217;une mesure de tutelle ou d&#8217;une habilitation familiale peut charger une ou plusieurs personnes, par un m\u00eame mandat, de la repr\u00e9senter pour le cas o\u00f9, pour l&#8217;une des causes pr\u00e9vues \u00e0 l&#8217;article 425 , elle ne pourrait plus pourvoir seule \u00e0 ses int\u00e9r\u00eats.&#8221; The same article fixes the form, word for word: &#8220;Le mandat est conclu par acte notari\u00e9 ou par acte sous seing priv\u00e9.&#8221; The choice of form matters enormously. A mandate signed as an <em>acte sous seing priv\u00e9<\/em> (a private deed, signed without a <em>notaire<\/em>) is valid for everyday management but cannot authorise disposals of property; only the <em>acte notari\u00e9<\/em> (the notarised form, received by a <em>notaire<\/em>) empowers the agent to sell land. The official English-language guidance on the <a href=\"https:\/\/www.service-public.gouv.fr\/particuliers\/vosdroits\/F16670?lang=en\">future protection mandate<\/a> confirms the divide: the private-signature mandate is written and signed between the parties without going before a notary, while the mandate drawn up by a notary is an authentic act carrying full powers. British readers should also note <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006427848\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006427848\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 478 of the civil code<\/a>, word for word: &#8220;Le mandat de protection future est soumis aux dispositions des articles 1984 \u00e0 2010 qui ne sont pas incompatibles avec celles de la pr\u00e9sente section.&#8221; The French mandate is therefore an ordinary mandate plus a protective shell \u2014 which is exactly why a French <em>notaire<\/em> understands it at once while an English LPA requires explanation. Where the donor&#8217;s wishes extend to the person as well as the property, <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006427855\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006427855\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 479 of the civil code<\/a> channels them through French safeguards, word for word: &#8220;Lorsque le mandat s&#8217;\u00e9tend \u00e0 la protection de la personne, les droits et obligations du mandataire sont d\u00e9finis par les articles 457-1 \u00e0 459-2 .&#8221; Activation is administrative rather than judicial: <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000039367163\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000039367163\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 481 of the civil code<\/a> provides, word for word: &#8220;Le mandat prend effet lorsqu&#8217;il est \u00e9tabli que le mandant ne peut plus pourvoir seul \u00e0 ses int\u00e9r\u00eats.&#8221; The agent then files the mandate with the registry (<em>greffe<\/em>, the court office) of the <em>tribunal judiciaire<\/em> (the ordinary civil and criminal court) together with the listed doctor&#8217;s certificate \u2014 &#8220;A cette fin, le mandataire produit au greffe du tribunal judiciaire le mandat et un certificat m\u00e9dical \u00e9manant d&#8217;un m\u00e9decin choisi sur la liste mentionn\u00e9e \u00e0 l&#8217;article 431 \u00e9tablissant que le mandant se trouve dans l&#8217;une des situations pr\u00e9vues \u00e0 l&#8217;article 425 &#8221; \u2014 and &#8220;Le greffier vise le mandat et date sa prise d&#8217;effet, puis le restitue au mandataire.&#8221; No hearing, no judge, a clerk&#8217;s endorsement: that speed is the great attraction of the French mandate for a British family that planned ahead, and the great reason to sign one now even where an English LPA already exists.<\/p>\n<p>The second route, and often the best fit for a British family facing an immediate block, is the <em>habilitation familiale<\/em>: a close relative authorised by the judge to represent, assist, or conclude specified acts for the vulnerable person. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000038311073\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000038311073\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 494-1 of the civil code<\/a> frames it, word for word, for the case &#8220;Lorsqu&#8217;une personne est dans l&#8217;impossibilit\u00e9 de pourvoir seule \u00e0 ses int\u00e9r\u00eats en raison d&#8217;une alt\u00e9ration, m\u00e9dicalement constat\u00e9e soit de ses facult\u00e9s mentales, soit de ses facult\u00e9s corporelles de nature \u00e0 emp\u00eacher l&#8217;expression de sa volont\u00e9&#8221;, providing that &#8220;le juge des tutelles peut habiliter une ou plusieurs personnes choisies parmi ses ascendants ou descendants, fr\u00e8res et s\u0153urs ou, \u00e0 moins que la communaut\u00e9 de vie ait cess\u00e9 entre eux, le conjoint, le partenaire auquel elle est li\u00e9e par un pacte civil de solidarit\u00e9 ou le concubin \u00e0 la repr\u00e9senter, \u00e0 l&#8217;assister dans les conditions pr\u00e9vues \u00e0 l&#8217;article 467 ou \u00e0 passer un ou des actes en son nom&#8221;. A daughter from London, a brother from Manchester, a French-resident spouse: all sit inside the eligible circle, and the authorised person acts free of charge \u2014 &#8220;Elle exerce sa mission \u00e0 titre gratuit.&#8221; Compared with full guardianship, family authorisation is lighter, faster, and usually requires no annual accounts where the order so provides; it can be general or limited to named acts such as selling the Dordogne cottage or operating specified accounts, which makes it the natural answer to a bank that demands &#8220;a French court paper&#8221; for one blocked transaction. Ask for general authorisation where the impairment is global, and for act-specific authorisation where one sale or one account is the entire problem: judges grant what the medical certificate supports, and a certificate describing total loss of financial understanding supports more than one complaining of occasional forgetfulness.<\/p>\n<p>The third route is full judicial protection \u2014 <em>sauvegarde de justice<\/em> (a short-term court safeguard), <em>curatelle<\/em>, or <em>tutelle<\/em> \u2014 and it is governed by two principles of restraint that British applicants sometimes overlook. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000038311088\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000038311088\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 428 of the civil code<\/a> states the subsidiarity rule word for word: &#8220;La mesure de protection judiciaire ne peut \u00eatre ordonn\u00e9e par le juge qu&#8217;en cas de n\u00e9cessit\u00e9 et lorsqu&#8217;il ne peut \u00eatre suffisamment pourvu aux int\u00e9r\u00eats de la personne par la mise en \u0153uvre du mandat de protection future conclu par l&#8217;int\u00e9ress\u00e9, par l&#8217;application des r\u00e8gles du droit commun de la repr\u00e9sentation, de celles relatives aux droits et devoirs respectifs des \u00e9poux et des r\u00e8gles des r\u00e9gimes matrimoniaux, en particulier celles pr\u00e9vues aux articles 217 , 219 , 1426 et 1429 ou, par une autre mesure de protection moins contraignante.&#8221; A judge must therefore check first whether the family&#8217;s English LPA, the spouses&#8217; mutual powers, or a lighter measure would do \u2014 which is why your refused LPA file, far from being wasted, becomes exhibit one in the guardianship application.
