If you were already living in France before 2021, the Withdrawal Agreement, the treaty of 17 October 2019 organising the British exit, protects residence rights you built up under EU law, though you still had to apply for a special permit and late applications are judged strictly. If you are arriving now, everything starts at the French consulate in the United Kingdom with a long-stay visa, continues at the pr\u00e9fecture, the local office of the French state that issues residence permits, with your first carte de s\u00e9jour, meaning your residence permit card, and can end, when things go wrong, with a refusal or an obligation to leave French territory, known by its initials OQTF. This guide explains which visa and which first permit match your project, what the protected route looks like for Britons who were already settled before 2021, and how refusals and removal orders are challenged step by step, with the exact legal texts and three recent court decisions, two of them concerning British nationals.<\/p>\n<h2>I. Which Visa and Which First Residence Permit Match Your Move to France<\/h2>\n<h3>A. How Do You Choose the Right Long-Stay Visa in London and Validate It After Arrival<\/h3>\n<p>The first rule surprises many buyers: you cannot move first and sort out the paperwork later. The CESEDA is the statute you will meet at every stage, so keep its numbering in mind. The consulate rule is even more direct: &#8220;Tout \u00e9tranger souhaitant entrer en France en vue d&#8217;y s\u00e9journer pour une dur\u00e9e sup\u00e9rieure \u00e0 trois mois doit solliciter aupr\u00e8s des autorit\u00e9s diplomatiques et consulaires fran\u00e7aises un visa de long s\u00e9jour dont la dur\u00e9e de validit\u00e9 ne peut \u00eatre sup\u00e9rieure \u00e0 un an&#8221; (<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000051562134\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000051562134\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">article L312-2 of the CESEDA<\/a>). In practice this means the application is lodged in the United Kingdom before travel, through the official France-Visas portal whose <a href=\"https:\/\/www.france-visas.gouv.fr\/en\/visa-de-long-sejour\">long-stay visa pages<\/a> list the categories, and the British government&#8217;s own <a href=\"https:\/\/www.gov.uk\/guidance\/living-in-france\">Living in France guide<\/a> confirms the same starting point from the UK side. Arriving on a short stay without a visa and then applying for a first residence permit from inside France fails at the first hurdle, because &#8220;la premi\u00e8re d\u00e9livrance d&#8217;une carte de s\u00e9jour temporaire ou d&#8217;une carte de s\u00e9jour pluriannuelle est subordonn\u00e9e \u00e0 la production par l&#8217;\u00e9tranger du visa de long s\u00e9jour mentionn\u00e9 aux 1\u00b0 ou 2\u00b0 de l&#8217;article L. 411-1&#8221; (<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776891\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776891\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">article L412-1 of the CESEDA<\/a>). The consulate you leave is therefore the gatekeeper of the pr\u00e9fecture you will meet.<\/p>\n<p>Choosing the wrong category is the costliest mistake in the file, because each visa locks in what you may do for the year that follows. Retired people and anyone living on their own means \u2014 pensions, savings, rental income \u2014 normally apply for the visiteur route. The statute grants &#8220;une carte de s\u00e9jour temporaire portant la mention &#8221; visiteur &#8221; d&#8217;une dur\u00e9e d&#8217;un an&#8221; to the foreigner who proves self-sufficiency, and it sets the bar in plain figures: &#8220;L&#8217;\u00e9tranger qui apporte la preuve qu&#8217;il peut vivre de ses seules ressources, dont le montant doit \u00eatre au moins \u00e9gal au salaire minimum de croissance net annuel&#8221;, the SMIC, the French statutory minimum wage, taken net and annualised (<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776442\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776442\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">article L426-20 of the CESEDA<\/a>). Two further conditions come with it, and both catch British applicants out: you must hold health insurance covering the stay, and you must &#8220;prendre l&#8217;engagement de n&#8217;exercer en France aucune activit\u00e9 professionnelle&#8221;, a formal undertaking not to work. A visiteur permit that forbids work cannot later be converted into a work permit because you found a job; the file must be rebuilt from the consulate stage. If you intend to work as an employee, the salari\u00e9 route applies instead, and its condition is equally strict: &#8220;La d\u00e9livrance de cette carte de s\u00e9jour est subordonn\u00e9e \u00e0 la d\u00e9tention pr\u00e9alable d&#8217;une autorisation de travail, dans les conditions pr\u00e9vues par les articles L. 5221-2 et suivants du code du travail&#8221; (<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776797\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776797\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">article L421-1 of the CESEDA<\/a>). The work authorisation is obtained by the French employer before you travel, not by you after arrival, and the consulate will refuse a salari\u00e9 visa without it. Where the project is family life with a French husband or wife, the position is stronger than any other category, because &#8220;Le visa de long s\u00e9jour est d\u00e9livr\u00e9 de plein droit au conjoint de ressortissant fran\u00e7ais&#8221;, subject only to fraud, annulment of the marriage or a threat to public order (<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042777209\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042777209\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">article L312-3 of the CESEDA<\/a>). Once in France on that basis, the spouse receives a one-year card marked vie priv\u00e9e et familiale, meaning private and family life, provided the couple still live together and the French spouse has kept French nationality (<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000043982327\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000043982327\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">article L423-1 of the CESEDA<\/a>).<\/p>\n<p>After landing, one administrative step decides whether the first year runs smoothly: most long-stay visas are issued as a VLS-TS, a visa de long s\u00e9jour valant titre de s\u00e9jour, meaning a long-stay visa that doubles as your residence permit for its first year, and it must be validated online shortly after arrival with payment of the immigration tax, through the procedure described on the official <a href=\"https:\/\/www.service-public.gouv.fr\/particuliers\/vosdroits\/R52684?lang=en\">service-public validation page<\/a>. Skip the validation and you hold a visa that the pr\u00e9fecture treats as never activated, which poisons the first renewal. A parallel trap awaits second-home owners who assume that owning a house softens the calendar: it does not. Short stays without a visa remain governed by the 90-days-in-any-180 rule for the whole Schengen area, so a British owner who counts only French nights and forgets Spanish or Italian weekends can drift into overstay, and overstay feeds directly into the removal cases examined below. Keep the consulate file, the validation receipt, the health cover and the proof of resources together from day one; every remedy in the second part of this guide is easier with a complete paper trail.<\/p>\n<h3>B. Were You Already Living in France Before 2021? The Withdrawal Agreement Route, Late Applications and the Family-Life Safety Net<\/h3>\n<p>Britons who were exercising EU residence rights in France before 1 January 2021 live under a different, more protective regime, but it is not automatic and its deadlines have teeth. The Withdrawal Agreement provides that long-settled people &#8220;acqui\u00e8rent le droit de s\u00e9journer de mani\u00e8re permanente dans l&#8217;\u00c9tat d&#8217;accueil dans les conditions \u00e9nonc\u00e9es aux Articles 16, 17 et 18 de la directive 2004\/38\/CE&#8221;, permanent residence after five continuous lawful years, counting periods before and after the transition, while its residence chapter lets &#8220;L&#8217;\u00c9tat d&#8217;accueil&#8221; require protected persons to apply for &#8220;un nouveau statut de r\u00e9sident qui leur conf\u00e8re les droits pr\u00e9vus au pr\u00e9sent titre et un document attestant ce statut, qui peut \u00eatre sous forme num\u00e9rique&#8221; (paragraph 1 of article 15 and paragraph 1 of article 18 of the Agreement of 17 October 2019, as set out by the Bordeaux appeal court in the decision linked below). France used that option: it required British residents to apply for Withdrawal Agreement cards, and the French implementing decree, d\u00e9cret n\u00b0 2020-1417 of 19 November 2020, fixed the main deadline at 1 July 2021 while leaving a narrow door open afterwards: &#8220;Lorsque le d\u00e9lai de pr\u00e9sentation de la demande de titre de s\u00e9jour fix\u00e9 aux alin\u00e9as pr\u00e9c\u00e9dents n&#8217;est pas respect\u00e9, le ressortissant \u00e9tranger peut \u00eatre autoris\u00e9 \u00e0 pr\u00e9senter sa demande dans un d\u00e9lai suppl\u00e9mentaire raisonnable, s&#8217;il existe des motifs l\u00e9gitimes justifiant le non-respect du d\u00e9lai initial&#8221;, in the court&#8217;s quotation of article 8 of that decree. Hold five qualifying years and the ten-year card marked S\u00e9jour permanent under article 18(1) is issued as of right: &#8220;un titre de s\u00e9jour d&#8217;une dur\u00e9e de validit\u00e9 de dix ans portant la mention &#8221; S\u00e9jour permanent &#8211; Article 50 TUE\/Article 18(1) Accord de retrait du Royaume-Uni de l&#8217;UE &#8221; est d\u00e9livr\u00e9 de plein droit au ressortissant \u00e9tranger&#8221; who meets the conditions, in the court&#8217;s quotation of article 21 of the same decree (<a href=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000053623513\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000053623513\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">CAA Bordeaux, 26 February 2026, no 25BX01572<\/a>).<\/p>\n<p>That Bordeaux decision, given only months ago, is the clearest picture available of how French judges treat a late British file, and it cuts both ways. The applicant, &#8220;ressortissant britannique, n\u00e9 le 9 octobre 1955 \u00e0 Montserrat&#8221; (<a href=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000053623513\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000053623513\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">CAA Bordeaux, 26 February 2026, no 25BX01572<\/a>), had lived in France since 1987 yet applied only on 14 February 2022; the court approved the rejection of the permanent card, holding that getting a mere acknowledgment of receipt proves nothing about the excuse, since &#8220;Il ne r\u00e9sulte pas des dispositions pr\u00e9cit\u00e9es que le seul fait d&#8217;obtenir une attestation de d\u00e9p\u00f4t de dossier caract\u00e9rise l&#8217;admission, par les services de l&#8217;\u00c9tat, des circonstances particuli\u00e8res \u00e9voqu\u00e9es par le requ\u00e9rant pour justifier du d\u00e9p\u00f4t tardif de sa demande&#8221;, and it dismissed yearly benefit letters and even full illiteracy as insufficient legitimate reasons. But the same judgment then rescued the man on human-rights grounds: decades of village life, a carpentry living and no remaining ties to his birthplace meant &#8220;la d\u00e9cision en cause porte une atteinte disproportionn\u00e9e \u00e0 son droit au respect de sa vie priv\u00e9e&#8221;, so the refusal, the removal order and the return-country designation were all annulled, the pr\u00e9fet was ordered to issue &#8220;une carte de s\u00e9jour portant la mention &#8221; vie priv\u00e9e et familiale &#8220;, dans un d\u00e9lai de deux mois \u00e0 compter de la notification du pr\u00e9sent arr\u00eat&#8221;, to erase the Schengen non-admission alert within fifteen days, and to pay 2,000 euros in legal costs. The lesson is practical, not theoretical: file late only with documented legitimate reasons, and if the Agreement door closes, the vie priv\u00e9e et familiale card under article 8 of the European Convention on Human Rights, the continent-wide human-rights treaty France applies directly, is the credible fallback, not a second Withdrawal Agreement application.<\/p>\n<p>The mirror case shows the limit of that fallback. In Lyon, a young Briton who said he had entered France at five and sought an Agreement card in June 2021 was refused for public-order reasons: &#8220;M. A&#8230; B&#8230;, ressortissant britannique n\u00e9 le 15 juillet 1997, d\u00e9clare \u00eatre entr\u00e9 sur le territoire fran\u00e7ais \u00e0 l&#8217;\u00e2ge de cinq ans, accompagn\u00e9 de ses parents et de son fr\u00e8re&#8221;, yet the court upheld the refusal because he argued he was not &#8220;une menace r\u00e9elle, actuelle et suffisamment grave \u00e0 l&#8217;encontre d&#8217;un int\u00e9r\u00eat fondamental de la soci\u00e9t\u00e9&#8221; without bringing anything to displace the lower court&#8217;s assessment, cited article 8 without success, and ended with the blunt line &#8220;La requ\u00eate de M. B&#8230; est rejet\u00e9e&#8221; (<a href=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000047947485\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000047947485\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">CAA Lyon, 2 August 2023, no 22LY03344<\/a>). Read together, the two rulings draw the map: long residence plus integration can defeat a removal order even after a missed Agreement deadline, but neither long residence nor British nationality by itself neutralises a reasoned public-order refusal, since &#8220;La d\u00e9livrance d&#8217;une carte de s\u00e9jour temporaire ou pluriannuelle ou d&#8217;une carte de r\u00e9sident peut, par une d\u00e9cision motiv\u00e9e, \u00eatre refus\u00e9e \u00e0 tout \u00e9tranger dont la pr\u00e9sence en France constitue une menace pour l&#8217;ordre public&#8221; (<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776402\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776402\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">article L432-1 of the CESEDA<\/a>). Anyone with even a minor criminal record should therefore assemble rehabilitation evidence before applying, not after the refusal lands.<\/p>\n<h2>II. How to Challenge a Refusal or a Removal Order Without Missing the Decisive Deadline<\/h2>\n<h3>A. Your Visa Was Refused in the UK: Why the Visa Appeals Commission Comes Before Any Judge<\/h3>\n<p>A consular refusal usually arrives as a short standard form with boxes ticked \u2014 unreliable documents, unclear means, suspected misuse of the visa \u2014 and the instinct is to write straight to a court. That direct challenge is thrown out without examination, because the statute makes the administrative appeal compulsory: &#8220;La saisine de l&#8217;une ou l&#8217;autre de ces autorit\u00e9s, selon la nature du visa sollicit\u00e9, est un pr\u00e9alable obligatoire \u00e0 l&#8217;exercice d&#8217;un recours contentieux, \u00e0 peine d&#8217;irrecevabilit\u00e9 de ce dernier&#8221; (<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000045998672\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000045998672\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">article D312-3 of the CESEDA<\/a>). The authority in question is the CRRV, the commission de recours contre les d\u00e9cisions de refus de visa, the appeals commission for visa refusals sitting with the foreign and interior ministries, for long-stay refusals, with a two-month silence rule: no answer within two months means an implied rejection carrying the same reasons as the consulate. Send that appeal by tracked post or the designated online channel within two months of the consular refusal, keep the acknowledgment of receipt, and diary the two-month mark, because the court clock runs from the commission&#8217;s express or implied decision, not from the consulate&#8217;s letter. The competent court for visa cases is the tribunal administratif de Nantes, the administrative court in Nantes, which hears consular-visa litigation for the whole country, so a refusal issued in London is challenged in Nantes, not in the city where you plan to live.<\/p>\n<p>The leading recent judgment on this machinery repays close reading, because it settles three points British applicants constantly misunderstand. First, reasons: public bodies must normally give written reasons for unfavourable decisions, since &#8220;Les personnes physiques ou morales ont le droit d&#8217;\u00eatre inform\u00e9es sans d\u00e9lai des motifs des d\u00e9cisions administratives individuelles d\u00e9favorables qui les concernent&#8221;, and consular refusals and rejections of compulsory prior appeals are both covered; but where the rejection is implied, the applicant who never asked for the reasons in time cannot then complain about missing reasons, whereas a consulate decision that is reasoned can be attacked for thin reasoning straight away (<a href=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000050301197\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000050301197\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">CAA Nantes, 1 October 2024, no 23NT00454<\/a>, applying articles L211-2, L211-5 and L232-4 of the CRPA, the code governing relations between the public and the administration). Second, discretion: where no treaty, statute or regulation fixes the grant criteria for a work visa, &#8220;les autorit\u00e9s fran\u00e7aises, saisies d&#8217;une telle demande, disposent, sous le contr\u00f4le du juge de l&#8217;exc\u00e8s de pouvoir, d&#8217;un large pouvoir d&#8217;appr\u00e9ciation&#8221;, and they may rely not only on public-order grounds such as misuse of the visa but on any general-interest consideration, including a mismatch between the applicant&#8217;s experience and the job. Third, outcome: the court quashed the lower judgment that had annulled the refusal for defective reasoning \u2014 &#8220;Le jugement n\u00b0 2206703 du 10 f\u00e9vrier 2023 du tribunal administratif de Nantes est annul\u00e9&#8221; \u2014 and upheld the refusal on the merits, finding the stated risks of misuse and unreliable documents sufficient. For a British reader the message is that visa litigation is won on paperwork, not on indignation: coherent funds, credible accommodation near the workplace, experience matching the contract, and a prior work authorisation where the category requires one. Challenge a refusal that misreads your file, by all means, but reapply with a repaired file at the same time where the calendar allows, because a fresh complete application often delivers the visa faster than a judgment.<\/p>\n<h3>B. Your Permit Was Refused or You Were Ordered to Leave France: OQTF Deadlines, the Administrative Court and the Arguments That Win<\/h3>\n<p>Inside France, a refusal rarely travels alone: it commonly arrives stapled to an OQTF, and the combination has its own deadlines and its own judge. The statute lists the cases, and the refusal case is written for exactly this situation: the administration may order departure where &#8220;L&#8217;\u00e9tranger s&#8217;est vu refuser la d\u00e9livrance d&#8217;un titre de s\u00e9jour, le renouvellement du titre de s\u00e9jour, du document provisoire d\u00e9livr\u00e9 \u00e0 l&#8217;occasion d&#8217;une demande de titre de s\u00e9jour ou de l&#8217;autorisation provisoire de s\u00e9jour qui lui avait \u00e9t\u00e9 d\u00e9livr\u00e9 ou s&#8217;est vu retirer un de ces documents&#8221; (<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042775578\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042775578\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">article L611-1, 3\u00b0 of the CESEDA<\/a>). Two safeguards frame every such order. It must be reasoned and individualised: &#8220;La d\u00e9cision portant obligation de quitter le territoire fran\u00e7ais est motiv\u00e9e.
