Your shoulder, your back or your ankle gave way, and within minutes two systems you never chose started running at once: the British habit of carrying on and hoping the GP sorts it, and the French machinery of the <em>accident du travail<\/em> (work accident), which rewards speed and paperwork and punishes silence. This guide is written for British employees working in France after Brexit. It explains, entirely in English, how to get your accident recognised by the French health insurance fund, how your pay is protected while you are off, what happens when your employer disputes the accident or knew the workplace was dangerous, and exactly how to challenge a refusal before the deadlines kill your case.<\/p>\n<p>The French starting point is generous but formal. Article L. 411-1 of the Social Security Code (<em>code de la s\u00e9curit\u00e9 sociale<\/em>) provides: <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000047452603\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000047452603\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">&#8220;Est consid\u00e9r\u00e9 comme accident du travail, quelle qu&#8217;en soit la cause, l&#8217;accident survenu par le fait ou \u00e0 l&#8217;occasion du travail \u00e0 toute personne mentionn\u00e9e \u00e0 l&#8217;article L. 311-2.&#8221;<\/a> In plain terms, any sudden event that injures you by reason of, or on the occasion of, your work counts as a work accident, whatever its cause. That single sentence opens the door to daily allowances from the first day after the accident, free medical care with no upfront payment, stronger dismissal protection than ordinary sick leave, and, where the employer is at fault, extra compensation on top. But none of it is automatic. The fund that decides, the <em>caisse primaire d&#8217;assurance maladie<\/em> (CPAM, the local health insurance fund), works from declarations, medical certificates and deadlines, and an employer who files late, files with hostile reservations, or never trained you on the equipment can tilt the file against you before you even know there is a file. The British comparison sets the scale: in the UK an employee in this position leans on Statutory Sick Pay, currently <a href=\"https:\/\/www.gov.uk\/statutory-sick-pay\">\u00a3123.25 per week if you are too ill to work<\/a>, plus any contractual sick pay. In France the recognised victim of a work accident keeps a large share of salary from day one, pays nothing for the related treatment, and cannot be dismissed while suspended except for serious misconduct or a reason wholly unrelated to the accident. The gap between those two worlds is why getting recognition right matters so much, and why this article walks you through recognition first and money second, each with its own challenge route if the answer is no.<\/p>\n<h2>I. Getting your work accident recognised in France: the first-day reflex, the employer&#8217;s declaration and the fund&#8217;s investigation<\/h2>\n<h3>A. Tell the employer at once, see a doctor the same day and force the paperwork into existence: the victim&#8217;s declaration, the medical certificate and the 48-hour employer duty<\/h3>\n<p>French work-accident law runs on a chain of written acts, and you are the first link. Article L. 441-1 of the Social Security Code states: <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006743183\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006743183\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">&#8220;La victime d&#8217;un accident du travail doit, dans un d\u00e9lai d\u00e9termin\u00e9, sauf le cas de force majeure, d&#8217;impossibilit\u00e9 absolue ou de motifs l\u00e9gitimes, en informer ou en faire informer l&#8217;employeur ou l&#8217;un de ses pr\u00e9pos\u00e9s.&#8221;<\/a> Every French adviser translates that fixed period into the same practical order: tell your employer, or your line manager, within twenty-four hours, in writing, with the date, the time, the place, what you were doing and the names of any witnesses. A text message followed by an email is enough to start with; a letter sent by registered post with acknowledgement of receipt (<em>lettre recommand\u00e9e avec accus\u00e9 de r\u00e9ception<\/em>) follows for the file. The statute excuses only force majeure, absolute impossibility or a legitimate reason, so being taken to hospital in an ambulance counts, while hoping the pain fades over the weekend does not. The most common British mistake in France is cultural: saying nothing on Friday, working through it, and mentioning the accident the following Thursday. By then the employer can truthfully say he learned of nothing, the fund sees a late, lonely declaration, and the presumption that protects you starts life with a limp.<\/p>\n<p>The second act belongs to the doctor, and it should happen the same day. Ask the doctor explicitly for a <em>certificat m\u00e9dical initial<\/em> (initial medical certificate) describing the injuries and, where needed, prescribing time off work (<em>arr\u00eat de travail<\/em>). This certificate is the medical anchor of the whole file: it fixes the date of the injuries, and everything the fund later accepts as flowing from the accident must connect back to it. Keep a copy of every certificate, every prescription and every scan referral. If the doctor gives you a <em>feuille d&#8217;accident<\/em> (accident form, the tripartite slip that lets chemists, physiotherapists and clinics bill the fund directly under the work-accident scheme), guard it like a passport: treatment for the recognised accident is free at the point of use, but only once recognition exists, and the form is what makes third-party payment (<em>tiers payant<\/em>) possible. Note carefully what the form is not: it is an administrative slip, not a decision, and presenting it does not mean the fund has accepted your case.<\/p>\n<p>The third act belongs to your employer, and the law puts him on a short leash. Article L. 441-2 provides: <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006743085\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006743085\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">&#8220;L&#8217;employeur ou l&#8217;un de ses pr\u00e9pos\u00e9s doit d\u00e9clarer tout accident dont il a eu connaissance \u00e0 la caisse primaire d&#8217;assurance maladie dont rel\u00e8ve la victime selon des modalit\u00e9s et dans un d\u00e9lai d\u00e9termin\u00e9s. La d\u00e9claration \u00e0 la caisse peut \u00eatre faite par la victime ou ses repr\u00e9sentants jusqu&#8217;\u00e0 l&#8217;expiration de la deuxi\u00e8me ann\u00e9e qui suit l&#8217;accident.&#8221;<\/a> The implementing rule sharpens the employer&#8217;s deadline to a point: <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000038423383\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000038423383\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">&#8220;La d\u00e9claration de l&#8217;employeur ou l&#8217;un de ses pr\u00e9pos\u00e9s pr\u00e9vue \u00e0 l&#8217;article L. 441-2 doit \u00eatre faite, par tout moyen conf\u00e9rant date certaine \u00e0 sa r\u00e9ception, dans les quarante-huit heures non compris les dimanches et jours f\u00e9ri\u00e9s.&#8221;<\/a> Forty-eight hours, Sundays and public holidays excluded, by a means that proves receipt. If your employer shrugs, sits on the declaration or tells you verbally that it was only a minor knock and not worth declaring, do not wait for him. The same Article L. 441-2 lets you declare the accident yourself directly to the CPAM any time within two years, and a late employer declaration never bars your own. Send your declaration by registered post, attach the initial medical certificate and your written account of the facts, and keep the acknowledgement slip. Where the relationship is already tense, copy your union representative or staff delegate. And where the injury happened on the way to or from work rather than on the premises, say so plainly: Article L. 411-2 extends the work-accident umbrella to commuting accidents, providing: <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006743008\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006743008\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">&#8220;Est \u00e9galement consid\u00e9r\u00e9 comme accident du travail, lorsque la victime ou ses ayants droit apportent la preuve que l&#8217;ensemble des conditions ci-apr\u00e8s sont remplies ou lorsque l&#8217;enqu\u00eate permet \u00e0 la caisse de disposer sur ce point de pr\u00e9somptions suffisantes, l&#8217;accident survenu \u00e0 un travailleur mentionn\u00e9 par le pr\u00e9sent livre, pendant le trajet d&#8217;aller et de retour, entre : 1\u00b0) la r\u00e9sidence principale, une r\u00e9sidence secondaire pr\u00e9sentant un caract\u00e8re de stabilit\u00e9 ou tout autre lieu o\u00f9 le travailleur se rend de fa\u00e7on habituelle pour des motifs d&#8217;ordre familial et le lieu du travail.&#8221;<\/a> The detour for the school run or the sandwich stop can complicate that proof, which is another reason to write down the exact route while it is fresh.<\/p>\n<h3>B. Surviving the fund&#8217;s investigation and beating a refusal: reasoned reservations, the 30-day and 90-day clocks, and the two-step challenge before the tribunal<\/h3>\n<p>Once the CPAM holds your declaration and the initial medical certificate, it must decide whether the accident counts as occupational, and the employer gets a formal voice in that decision. Within ten clear days (<em>jours francs<\/em>, full days counted midnight to midnight) of filing his declaration, or of receiving a copy of yours, the employer may lodge <em>r\u00e9serves motiv\u00e9es<\/em> (reasoned reservations) with the fund: <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000038423322\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000038423322\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">&#8220;Lorsque la d\u00e9claration de l&#8217;accident \u00e9mane de l&#8217;employeur, celui-ci dispose d&#8217;un d\u00e9lai de dix jours francs \u00e0 compter de la date \u00e0 laquelle il l&#8217;a effectu\u00e9e pour \u00e9mettre, par tout moyen conf\u00e9rant date certaine \u00e0 leur r\u00e9ception, des r\u00e9serves motiv\u00e9es aupr\u00e8s de la caisse primaire d&#8217;assurance maladie.&#8221;<\/a> Do not panic when this happens; reservations are routine, and they trigger procedure rather than defeat. The fund then has thirty clear days from receiving the declaration and the certificate either to recognise the occupational character or to open formal investigations: <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000038423337\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000038423337\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">&#8220;La caisse dispose d&#8217;un d\u00e9lai de trente jours francs \u00e0 compter de la date \u00e0 laquelle elle dispose de la d\u00e9claration d&#8217;accident et du certificat m\u00e9dical initial pr\u00e9vu \u00e0 l&#8217;article L. 441-6 pour soit statuer sur le caract\u00e8re professionnel de l&#8217;accident, soit engager des investigations lorsqu&#8217;elle l&#8217;estime n\u00e9cessaire ou lorsqu&#8217;elle a re\u00e7u des r\u00e9serves motiv\u00e9es \u00e9mises par l&#8217;employeur.&#8221;<\/a> Where investigations are opened, the clock stretches to ninety clear days: <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000038423349\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000038423349\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">&#8220;Lorsque la caisse engage des investigations, elle dispose d&#8217;un d\u00e9lai de quatre-vingt-dix jours francs \u00e0 compter de la date \u00e0 laquelle elle dispose de la d\u00e9claration d&#8217;accident et du certificat m\u00e9dical initial pour statuer sur le caract\u00e8re professionnel de l&#8217;accident.&#8221;<\/a> Before deciding, the fund must send both sides a questionnaire on the circumstances or organise an inquiry, and it must let you see the file and submit observations. Use that window. Send the fund your witness statements, photographs of the staircase, the rota proving you were on shift, and the accident-book entry. Files are won in this investigation phase far more often than in court afterwards.<\/p>\n<p>Two judgments of the Court of Cassation (<em>Cour de cassation<\/em>, France&#8217;s supreme court for private and social-security law) set the rules of this game, and both help the careful victim. First, an employer cannot sink your file with vague insinuation. In its ruling of 20 March 2025 (Second Civil Chamber, appeal no. N 22-24.732, <a href=\"https:\/\/www.courdecassation.fr\/decision\/67dbc1e1e044dcf80e82cc60\">read the full decision on courdecassation.fr<\/a>), the Court held: <a href=\"https:\/\/www.courdecassation.fr\/decision\/67dbc1e1e044dcf80e82cc60\">&#8220;Les r\u00e9serves motiv\u00e9es vis\u00e9es par ce texte, s&#8217;entendant de la contestation du caract\u00e8re professionnel de l&#8217;accident par l&#8217;employeur, ne peuvent porter que sur les circonstances de temps et de lieu de celui-ci ou sur l&#8217;existence d&#8217;une cause totalement \u00e9trang\u00e8re au travail.&#8221;<\/a> Reasoned reservations, the Court says, mean contesting the occupational character of the accident, and they can only attack the time and place or assert a cause wholly unconnected with work. A possible pre-existing condition that never caused any incapacity, the Court added in that same case, is not a cause wholly unconnected with work. So where your employer writes that your back was already fragile, or that nobody saw anything, that is doubt, not a reservation, and the fund owes you a proper investigation before refusing. Second, where reservations genuinely are reasoned, the fund has no shortcut. In its ruling of 26 November 2020 (Second Civil Chamber, appeal no. V 19-20.058, <a href=\"https:\/\/www.courdecassation.fr\/decision\/5fca262d4504b03b8a33c161\">read the full decision on courdecassation.fr<\/a>), the Court recalled: <a href=\"https:\/\/www.courdecassation.fr\/decision\/5fca262d4504b03b8a33c161\">&#8220;Selon ce texte, en cas de r\u00e9serves motiv\u00e9es de l&#8217;employeur ou si elle l&#8217;estime n\u00e9cessaire, la caisse envoie, avant d\u00e9cision \u00e0 l&#8217;employeur et \u00e0 la victime d&#8217;un accident du travail ou d&#8217;une maladie professionnelle, un questionnaire portant sur les circonstances ou la cause de l&#8217;accident ou de la maladie, ou proc\u00e8de \u00e0 une enqu\u00eate aupr\u00e8s des int\u00e9ress\u00e9s.&#8221;<\/a> And crucially, at the stage of deciding whether reservations are admissible, the employer does not have to prove they are well founded: it is enough that they were lodged in time and genuinely address the time, place and materiality of the accident. In that case the temporary-work agency had noted there was no witness though the victim worked in a workshop, and that she had finished her day normally without telling anyone; the Court of Appeal had waved that away, crediting the same-day medical certificate for acute lumbago instead. The Court of Cassation quashed that approach and declared the fund&#8217;s recognition unenforceable against the employer, because the fund had decided without the prior investigation its own reservations required. The lesson for you as victim is symmetrical and practical: keep your own evidence strong enough to survive a real inquiry, because a serious employer objection guarantees one, and attack a refusal precisely where the fund skipped a step, because courts annul decisions taken without the mandatory investigation.<\/p>\n<p>Your strongest substantive shield, meanwhile, is the presumption of imputability (<em>pr\u00e9somption d&#8217;imputabilit\u00e9<\/em>), the rule that an accident at the time and place of work is presumed occupational. In its ruling of 24 June 2021 (Second Civil Chamber, appeal no. H 19-24.945, <a href=\"https:\/\/www.courdecassation.fr\/decision\/60d41fb3f185911b57e04dba\">read the full decision on courdecassation.fr<\/a>), the Court stated: <a href=\"https:\/\/www.courdecassation.fr\/decision\/60d41fb3f185911b57e04dba\">&#8220;Il r\u00e9sulte de ce texte que l&#8217;accident survenu au temps et au lieu du travail est pr\u00e9sum\u00e9 \u00eatre un accident du travail, sauf \u00e0 \u00e9tablir que la l\u00e9sion a une cause totalement \u00e9trang\u00e8re au travail. La pr\u00e9somption d&#8217;imputabilit\u00e9 s&#8217;\u00e9tend aux l\u00e9sions constat\u00e9es jusqu&#8217;\u00e0 la date de consolidation.&#8221;<\/a> An injury at work time and place is presumed a work accident unless a cause wholly unconnected with work is proved, and the presumption covers every injury recorded up to consolidation (<em>consolidation<\/em>, the medical stabilisation of your condition). In that case a worker felt shoulder pain handling equipment, the pain was logged in the company accident register the next day, and a torn tendon was diagnosed eleven days later; the Court of Appeal had thrown out the presumption because of the eleven-day gap, and the Court of Cassation quashed it for failing to pin down when consolidation occurred and whether symptoms and treatment had continued. For you the message is concrete: report the pain immediately even if it seems small, get every ache recorded by a doctor without gaps, and never let weeks pass between appointments without a certificate bridging them. Continuity of symptoms and treatment is the thread the presumption hangs from; break it, and the employer needs only to cut it.<\/p>\n<p>If the fund still refuses recognition, you challenge in two steps, and both are deadline-driven. First comes the compulsory prior appeal (<em>recours pr\u00e9alable<\/em>) to the fund&#8217;s friendly-appeals board (<em>commission de recours amiable<\/em>, CRA). Article L. 142-4 of the Social Security Code makes that step mandatory: <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000048700753\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000048700753\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">&#8220;Les recours contentieux form\u00e9s dans les mati\u00e8res mentionn\u00e9es aux articles L. 142-1 , \u00e0 l&#8217;exception du 7\u00b0, et L. 142-3 sont pr\u00e9c\u00e9d\u00e9s d&#8217;un recours pr\u00e9alable, dans des conditions pr\u00e9vues par d\u00e9cret en Conseil d&#8217;Etat.&#8221;<\/a> The implementing rule gives you two months from notification of the refusal to seize the board: <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000037595656\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000037595656\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">&#8220;Cette commission doit \u00eatre saisie dans le d\u00e9lai de deux mois \u00e0 compter de la notification de la d\u00e9cision contre laquelle les int\u00e9ress\u00e9s entendent former une r\u00e9clamation.&#8221;<\/a> Skip the board and go straight to court, and your claim is inadmissible. Then, if the board confirms the refusal expressly or by silence, you take the case to the judicial court (<em>tribunal judiciaire<\/em>, social division), again within the strict time limit printed on the board&#8217;s letter, usually two months. Plead in this order: the accident at work time and place with the register entry and witness statements to trigger the presumption; the continuity of certificates up to consolidation; and the procedural defects, missing questionnaire, missing file disclosure, or decision taken on vague reservations that were never reasoned within the meaning of the 2025 ruling. Ask the court to declare the refusal annulled and the accident recognised as occupational, with the fund ordered to pay the benefits from the correct date. Recognition backdated means the daily allowances, the free care and the dismissal protection all snap back into place retroactively.<\/p>\n<h2>II. Getting paid and holding the employer to account: daily allowances, the employer&#8217;s top-up, dismissal protection and inexcusable fault<\/h2>\n<h3>A. What lands in your bank account while you are off: the fund&#8217;s daily allowance, the employer&#8217;s top-up and the ban on sacking the injured worker<\/h3>\n<p>Recognition converts immediately into money, and the French package is far more protective than anything a British worker expects from home. The statute starts with the day itself: <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000053283560\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000053283560\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">&#8220;La journ\u00e9e de travail au cours de laquelle l&#8217;accident s&#8217;est produit, quel que soit le mode de paiement du salaire, est int\u00e9gralement \u00e0 la charge de l&#8217;employeur. Une indemnit\u00e9 journali\u00e8re est pay\u00e9e \u00e0 la victime par la caisse primaire, \u00e0 partir du premier jour qui suit l&#8217;arr\u00eat du travail cons\u00e9cutif \u00e0 l&#8217;accident sans distinction entre les jours ouvrables et les dimanches et jours f\u00e9ri\u00e9s.&#8221;<\/a> Your employer pays the full day of the accident however you are paid, and from the very next day the fund pays a daily allowance (<em>indemnit\u00e9 journali\u00e8re<\/em>) for every calendar day, weekends and holidays included, with no waiting period. Ordinary sick leave in France carries waiting days; work accidents do not. That is the first thing to check on your bank statement: if payroll shows a three-day gap at the start of the absence, the absence has been coded as ordinary illness and the recognition has not been applied. The official service-public guidance confirms the computation method the funds actually use: the daily reference wage is your gross pay for the month before the stoppage divided by 30.42, capped, and the allowance equals 60 per cent of that reference for the first 28 days, rising to 80 per cent from the 29th day, within a net daily earnings ceiling and after deduction of the social charges (CSG at 6.2 per cent and CRDS at 0.5 per cent). Worked example from the official page: a reference wage producing 59.17 euros gives 35.50 euros a day at 60 per cent. The allowance runs until full recovery, consolidation, death or the regulatory maximum, and it revives on relapse or aggravation. When the employer knew the workplace was dangerous: inexcusable fault, the uplifted award for permanent injury and taking the case to court<\/h3>\n<p>Some accidents are nobody&#8217;s fault. That extra compensation has two parts: an uplift (<em>majoration<\/em>) of the annuity or lump sum paid for your permanent incapacity, and full damages for personal losses the standard scheme never covers, such as pain and suffering, disfigurement, loss of enjoyment of life and the need for a adapted home or third-party help. The Court of Cassation turned that duty into the definition of inexcusable fault in its ruling of 29 January 2026 (Second Civil Chamber, appeals nos. J 24-12.938 and A 24-13.183, <a href=\"https:\/\/www.courdecassation.fr\/decision\/697b0329cdc6046d47111bd0\">read the full decision on courdecassation.fr<\/a>): <a href=\"https:\/\/www.courdecassation.fr\/decision\/697b0329cdc6046d47111bd0\">&#8220;Le manquement \u00e0 l&#8217;obligation l\u00e9gale de s\u00e9curit\u00e9 et de protection de la sant\u00e9 \u00e0 laquelle l&#8217;employeur est tenu envers le travailleur a le caract\u00e8re d&#8217;une faute inexcusable lorsque l&#8217;employeur avait ou aurait d\u00fb avoir conscience du danger auquel \u00e9tait soumis le travailleur et qu&#8217;il n&#8217;a pas pris les mesures n\u00e9cessaires pour l&#8217;en pr\u00e9server.&#8221;<\/a> Breach of the employer&#8217;s legal safety duty counts as inexcusable fault where the employer was, or should have been, aware of the danger facing the worker and failed to take the measures needed to protect him. Three points in that sentence decide real cases. First, awareness includes what the employer should have known: a risk assessment (<em>document unique d&#8217;\u00e9valuation des risques<\/em>, the compulsory single risk register every French employer must keep) that lists the hazard, an earlier accident on the same machine, a labour inspector&#8217;s letter, or staff delegates&#8217; warnings all prove it. Mind the time limit: actions on the occupational character and its consequences are subject to a two-year limitation (<em>prescription biennale<\/em>) running, depending on the claim, from the accident, the end of the investigation or the consolidation decision, so diary every notification date and file early rather than late. Build the bundle as a prosecutor would: the risk register or proof of its absence, training attendance sheets, maintenance logs, photographs taken the day of the accident, the labour inspectorate report if one exists, witness statements in the statutory form, and the medical file linking each lasting symptom to the accident. Ask the court to recognise the inexcusable fault, to order the uplifted annuity, and to award full compensation for each head of personal loss with a medical expert appointed where needed. One strategic warning: the fund pays the uplift and then recovers it from the employer through a surcharge on his contributions, which is why funds sometimes defend these cases half-heartedly. Your lawyer acts for you, not for the fund&#8217;s recovery ledger, so frame the claim around your losses, not the fund&#8217;s.<\/p>\n<p>Finally, keep the criminal and administrative tracks in view without confusing them with your compensation. A serious safety breach can also bring a labour-inspector report, a criminal prosecution for involuntary injury, and a separate civil-party claim (<em>constitution de partie civile<\/em>) by you within that prosecution. The criminal route punishes; the social-security route pays. Run them in parallel where the facts justify it, but never let the slower criminal timetable make you miss the two-month CRA deadline or the two-year limitation on the compensation claims. Deadlines in this field forgive nothing, and the employer who hopes you will wait for the criminal case to conclude before claiming is an employer whose insurer understands limitation periods better than you do.<\/p>\n<h2>Conclusion<\/h2>\n<p>A work accident in France rewards the worker who writes everything down and punishes the one who waits to see. Tell the employer in writing within a day, get the initial medical certificate the same day, and declare the accident yourself if the employer will not do it within his forty-eight hours. Feed the fund&#8217;s investigation with rosters, photographs and witnesses inside its thirty-day and ninety-day clocks, and remember that vague employer doubts are not reasoned reservations, that an injury at work time and place is presumed occupational until consolidation, and that every refusal must survive the two-month prior appeal and then the court. While you recover, check that the daily allowance started the day after the accident with no waiting days, claim the employer&#8217;s top-up and the sector agreement&#8217;s maintenance, and treat any dismissal letter received during the suspension as suspect unless it proves serious misconduct or an unrelated impossibility. And where the danger was known and the protection was missing, do not settle for allowances alone: the inexcusable-fault action exists precisely for the guard that was never fitted and the training that never happened, and the courts have just repeated, in January 2026, that judges must verify whether the protection was sufficient and effective.
