If you live in Manchester, Edinburgh or Belfast and plan to settle in Paris, Lyon, Bordeaux or a farmhouse in the Dordogne, you are now a third-country national, a non-EU citizen, and any stay longer than ninety days requires a French long-stay visa obtained before you travel, followed by residence formalities once you arrive. Every year, British families get this wrong: they buy the ferry tickets, sign a twelve-month lease and only then discover that the consulate cannot regularise them in France, or they arrive on a visitor visa and accept a French job offer, which their status forbids. This guide explains the whole chain in the order you will actually meet it: which long-stay visa to apply for while you are still in Britain, how the online validation and the OFII formalities work after arrival, how the first carte de séjour, the French residence permit, and the multi-year card are obtained, and what to do when the administration says no. Each French term is explained the first time it appears, each decisive rule is quoted from the statute or the case law, and each remedy is given with its deadline, because in immigration law a missed time limit usually ends the case.

I. Which Long-Stay Visa Should You Apply for Before Leaving Britain?

The rule that governs your departure is simple and strict. In plain English, any foreigner who wishes to enter France for more than three months must apply to the French diplomatic and consular authorities for a long-stay visa, valid for no more than one year (see Article L312-2 of the Code de l’entrée et du séjour des étrangers et du droit d’asile, the Code governing entry and residence of foreigners, usually shortened to CESEDA). The same Code adds that, with limited exceptions, “Sous réserve des engagements internationaux de la France ou du livre II, tout étranger âgé de plus de dix-huit ans qui souhaite séjourner en France pour une durée supérieure à trois mois doit être titulaire de l’un des documents de séjour suivants : 1° Un visa de long séjour ;” (see Article L411-1 of the CESEDA). For a British citizen, this means the application is lodged while you are still in the United Kingdom, through the France-Visas online wizard and then at the TLScontact centre in London, Manchester or Edinburgh, which collects the file on behalf of the consulate. You cannot arrive visa-free for a viewing trip and convert a ninety-day Schengen stay into residence at the préfecture, the local state authority that issues residence permits: the first issue of a temporary or multi-year residence card is conditional on producing the long-stay visa (see Article L412-1 of the CESEDA, which states that “la première délivrance d’une carte de séjour temporaire ou d’une carte de séjour pluriannuelle est subordonnée à la production par l’étranger du visa de long séjour mentionné aux 1° ou 2° de l’article L. 411-1”). Choose the wrong category and the whole project stalls, so the two families of visas must be understood before you book anything.

A. Visitor, Employee or Student: How Do You Prove Sufficient Resources, Health Cover and Accommodation?

Three classic routes cover most British movers who are not launching a business. The carte de séjour temporaire portant la mention “visiteur”, the temporary residence card marked “visitor”, suits retirees and anyone living on independent means: the statute grants it to “L’étranger qui apporte la preuve qu’il peut vivre de ses seules ressources, dont le montant doit être au moins égal au salaire minimum de croissance net annuel”, the foreigner who proves he can live on his own resources of at least the net annual SMIC, the French statutory minimum wage (see Article L426-20 of the CESEDA). In practice the consulate wants durable, documented income, state and private pensions, rental income, regular investment drawdowns, at a level at least equal to the full yearly net minimum wage, plus comprehensive private health insurance covering the first year and proof of accommodation in France. Savings alone rarely persuade: the courts have upheld refusals where the money existed but its regularity, durability and origin were unproven. In one leading case on visitor visas, the administrative court of appeal held that “la commission de recours peut légalement fonder sa décision de refus sur la circonstance que le demandeur ne justifie pas des moyens d’existence suffisants pour faire face aux dépenses de son séjour en France”, and rejected the appeal because “les ressources précitées, dont, pour certaines d’entre elles, la régularité, la pérennité et l’origine ne sont pas établies, ne pouvaient être regardées comme étant suffisantes pour financer le séjour en France d’un an” (see CAA Nantes, 26 November 2018, No 17NT03268). Owning your French house outright helps with the accommodation limb but does not replace income, and a visitor must sign a written undertaking, the engagement de n’exercer aucune activité professionnelle, not to take any paid work in France. The second route is employment. The Code states: “L’étranger qui exerce une activité salariée sous contrat de travail à durée indéterminée se voit délivrer une carte de séjour temporaire portant la mention ” salarié ” d’une durée maximale d’un an.” (see Article L421-1 of the CESEDA). Here the sequence is reversed: your French employer must first obtain an autorisation de travail, a work permit, from the labour administration, and only then do you apply for the salarié visa, producing the permit, your permanent contract, qualifications and, where relevant, evidence that the post could not be filled locally, unless the occupation sits on the shortage list. British applicants recruited from London for Paris-based roles should allow two to four months for this chain and should never resign or ship furniture before the visa is in the passport. The third route is study: an unconditional university offer, proof of funds for tuition and living costs, health cover and accommodation produce a student visa, with limited part-time work rights attached. In every case the consulate issues an attestation de demande, a receipt stating the lodging date, because “La demande d’un visa pour un séjour d’une durée supérieure à trois mois donne lieu à la délivrance par les autorités diplomatiques et consulaires d’une attestation de demande indiquant la date du dépôt de la demande.” (see Article R312-2 of the CESEDA). Keep that receipt: it fixes the starting point of the administration’s reply period and later proves when your remedies began to run. Practical advice for this first family: apply about three months before travel, present twelve months of bank statements rather than a single flattering balance, show the origin of every large transfer, take out health insurance expressly valid in France with repatriation cover, and bring a French address with a lease, title deeds or a signed attestation d’hébergement, the formal hosting declaration, plus the host’s identity document and proof of address.

B. Talent, Founder or Freelancer: Which Visa Fits British Professionals, the Self-Employed and Company Creators?

Qualified Britons, founders and freelancers usually belong in the second family, organised around the passeport talent, the multi-year “talent passport” residence permit, and the independent-activity visas. Behind the quotation lie two distinct doors: the genuine and serious business-creation project backed by a master’s-level qualification or five years of comparable experience, and the innovative project recognised by a designated public body, with investment thresholds set by regulation, currently of the order of thirty thousand euros of committed funds. Highly qualified employees have their own door, the talent-qualified-employee and EU Blue Card tracks, requiring a degree of at least three years of higher education or five years of comparable experience and a contract above a salary threshold, while researchers use the talent-chercheur card built on a convention d’accueil, the hosting agreement signed with an approved research body (see Article L421-14 of the CESEDA). British consultants, tradespeople and liberal professionals who simply want to invoice French and British clients from France generally apply instead for the entrepreneur and profession libérale long-stay visa, evidencing a viable business plan, professional qualifications, registration prospects and funds, or, for regulated professions, the relevant French authorisation. The France-Visas portal lists these as separate categories, “Self employed person or liberal activity”, “Salaried employment” and “International talents”, and explains that some long-stay visas are marked residence card to be applied for within 2 months of arrival, whose holders must attend the préfecture within two months to obtain the permit (see France-Visas, Long-stay visa). The strategic point for Britons is that these categories are watertight: a visitor cannot lawfully freelance for French clients, an employee tied to one sponsor cannot simply change employer without a new permit, and a founder admitted on a non-innovative project cannot invoke the innovative track without meeting its recognition condition. Choose the category that matches what you will actually do in year one, evidence it with contracts, letters of intent, qualifications with sworn translations where needed, and a cash-flow forecast your bank statements support, because consuls refuse Reach-style optimism unsupported by funds, and the refusal stamp then shadows the next application. Readers who were already resident before 31 December 2020 fall under a different regime, the Withdrawal Agreement residence permit, examined in our companion guide on renewal and refusal of the Withdrawal Agreement card; this article concerns new arrivals, who must go through the consular visa route described above.

II. After Arrival: How Do You Validate Your Visa, Obtain Your Carte de Séjour and Challenge a Refusal?

Landing at Gare du Nord or Toulouse airport with a visa vignette in your passport is the midpoint, not the finish. Most British newcomers hold a VLS-TS, a visa de long séjour valant titre de séjour, a long-stay visa that itself acts as a residence permit once validated, and the validation is compulsory, time-limited and done online. The official service-public guidance, in its English version, is headed Validate a long-stay visa as a residence permit (VLS-TS) and pay the fee and directs holders to the online procedure on the Interior Ministry portal (see Service-public.fr, Validate a VLS-TS). In practice you log on to the ANEF platform, the Administration numérique pour les étrangers en France, the Interior Ministry’s digital system for foreigners, within three months of arrival, enter the visa details, pay the fee of around two hundred euros by fiscal stamps, and receive an attestation de validation, which together with the visa proves your lawful residence and your right to travel in and out of the Schengen area during the visa’s validity. Certain visas instead bear the mention “carte de séjour à solliciter”, residence card to be applied for, and their holders must attend the préfecture within two months, as the France-Visas page confirms. Parallel to this, the OFII, the Office français de l’immigration et de l’intégration, the state office for immigration and integration, summons many newcomers for a half-day reception: a medical examination where one is still required, a language-level assessment, and the signature of the contrat d’intégration républicaine, the Republican integration contract, with its civic training and, where prescribed, language courses. Attendance matters beyond politeness, because the later multi-year card depends on it. The Code provides: “Au terme d’une première année de séjour régulier en France accompli au titre d’un visa de long séjour tel que défini au 2° de l’article L. 411-1 ou, sous réserve des exceptions prévues à l’article L. 433-5, d’une carte de séjour temporaire, l’étranger bénéficie, à sa demande, d’une carte de séjour pluriannuelle” (see Article L433-4 of the CESEDA), with the quoted conditions continuing into diligence in the prescribed state training and compliance with the integration contract, alongside continued fulfilment of the original grounds. Renewals obey the parallel rule that “le renouvellement de la carte de séjour temporaire ou pluriannuelle est subordonné à la preuve par le ressortissant étranger qu’il continue de remplir les conditions requises pour la délivrance de cette carte” (see Article L433-1 of the CESEDA). Concretely, the visitor renewing in year two re-proves SMIC-level durable resources, health cover and accommodation; the employee produces the renewed contract and payslips; the founder files accounts, tax returns and evidence the business genuinely trades. Diaries should therefore be organised backwards from expiry: ANEF renewal applications are lodged in the course of the final months before expiry, supporting documents are gathered while still fresh, and travel is avoided while the récépissé, the temporary receipt, is pending unless it expressly authorises exit and return. The British government’s own guidance for its nationals, which each mover should read alongside the French statutes, summarises residence, healthcare registration and practical formalities from the London side (see GOV.UK, Living in France). Families often ask about order: validate the VLS-TS first, attend every OFII summons, register with the French health system once resident, file the first French tax return the following spring, and keep every attestation, because the year-one paper trail becomes the year-two renewal file.

A. VLS-TS Validation, OFII Formalities and the First Carte de Séjour: What Must Be Done, and When?

A practical timeline keeps British households out of trouble. Before travel, check the visa sticker: if it reads “VLS-TS”, validation is your first duty after arrival; if it reads “carte de séjour à solliciter”, booking the préfecture appointment is. Within the first days, buy the timbres fiscaux, the electronic fiscal stamps used to pay state fees; within three months at the latest, complete ANEF validation and download the confirmation, stapling it, physically or digitally, to the passport page. Watch the letterbox and the ANEF inbox for the OFII convocation, attend with passport, validation proof, address evidence and photographs, and complete the medical and civic sessions on the day. Anyone needing a social security number, a carte Vitale, the green health-insurance card, or school enrolments should start those tracks only after validation, since every French counter asks for the validated visa or the titre de séjour, the residence document, first. Two to four months before the VLS-TS expires, file the first carte de séjour application on ANEF under the same category, visitor, employee, student, talent or entrepreneur, attaching updated resources, insurance, address, and, for workers and founders, the employment and business evidence. The préfecture issues a récépissé while it examines the file; keep it with the expired document at all times. At the one-year mark, diligent residents apply for the carte de séjour pluriannuelle, the multi-year card, whose conditions include the integration training record described above. Common British pitfalls are all avoidable: leaving validation until month four, which leaves a gap in lawful residence; letting private health insurance lapse after six months, which sinks the visitor renewal; working on a visitor status, which can ground a refusal and, in serious cases, trigger the ordre public machinery examined below; moving house without updating ANEF, so convocations go to the old flat; and travelling during renewal on a récépissé that does not authorise return, forcing an awkward consular return visa. Where the préfecture demands a document that does not exist in England and Wales, a French-style extrait d’acte de naissance with marginal notes, for example, supply the closest British equivalent, a full birth certificate with a sworn translation, plus a short covering note explaining the difference, rather than leaving the box empty. And remember the boundary of this guide: buying the house is covered by our property colleagues, creating the French company by our business desk; here you are the person, residence, work permission, health cover and renewal, and every file should tell that story coherently from visa to multi-year card.

B. Visa Refused, Validation Blocked or Renewal Rejected: How Do You Challenge the Decision?

Refusals follow a fixed procedural map, and each stage has its own forum and deadline. A consular visa refusal must be motivated, at least by standard refusal formulae identifying the ground, insufficient resources, lack of health cover, doubtful accommodation, risk to public order, and it can first be contested before the CRRV, the Commission de recours contre les refus de visa, the specialist appeals commission for visa refusals, within two months of notification. The commission’s own decision is then litigated before the tribunal administratif de Nantes, the Nantes administrative court, which has exclusive nationwide jurisdiction over visa-refusal disputes, with appeal to the cour administrative d’appel de Nantes, the Nantes administrative court of appeal. That this is the correct forum is visible in the reported cases: applicants ask the Nantes court to annul the commission’s implicit or express rejection, and proceed on appeal to the Nantes court of appeal (see CAA Nantes, 6 May 2025, No 24NT01430, a decision illustrating CRRV and Nantes-court procedure). On the merits, judges review refusals for erreur manifeste d’appréciation, manifest error of assessment, and annul decisions whose stated ground the file contradicts. The visitor-resources judgment quoted above is the template: the court tested each head of income, found the bank balance and currency withdrawal might double-count the same trading profit, noted the absence of evidence for the other years, and concluded the administration had not manifestly erred. Turn that template around and the winning file writes itself: twelve months of statements, tax assessments proving the origin of savings, pension award letters, lease income with tax returns, and a schedule totalling durable monthly resources above the SMIC line. Refusals grounded on public order obey a different logic. The Code permits refusal only “par une décision motivée” where presence “constitue une menace pour l’ordre public” (see Article L432-1 of the CESEDA), and the courts demand precise, current facts rather than old allegations. In a case concerning a long-stay family visa refused on public-order grounds, the Nantes court annulled the refusal and the minister appealed, showing that such motives are fully justiciable and that generic suspicion does not suffice (see CAA Nantes, 26 December 2018, No 16NT03865). Urgency has its own tool: the référé-suspension, the emergency application asking the judge to freeze the decision within days, combined with a requête en annulation, the full action for annulment, on the merits. Deadlines are everything: “La juridiction ne peut être saisie que par voie de recours formé contre une décision, et ce, dans les deux mois à partir de la notification ou de la publication de la décision attaquée.” (see Article R421-1 of the Code de justice administrative). The same two-month rule governs challenges to préfecture refusals of issue or renewal, refusals to admit exceptional regularisation, and withdrawals, but those go to the locally competent administrative court, Paris for Paris residents, Versailles for Yvelines and Hauts-de-Seine, and so on, not to Nantes. A sensible refusal protocol runs: photograph and calendar the notification date; file the CRRV appeal for visa cases, or a recours gracieux, the informal reconsideration request, and, in parallel, prepare the court action so the two-month guillotine never falls; request the consul’s or préfet’s file, the communication du dossier, to see the exact incriminated documents; cure what can be cured, fresh insurance, stronger resources, corrected accommodation proof, new employer permit; and lodge the emergency suspension where removal or professional collapse looms. Never overstay to “wait it out”: unlawful presence poisons renewals, triggers removal orders, the OQTF, obligation de quitter le territoire français, and can convert a curable refusal into a multi-year entry ban. Where the administration stays silent, treat the silence correctly: after two months many residence applications incur an implicit refusal which is itself challengeable, so diary the two-month mark and act on it rather than queuing hopefully at the counter.

Conclusion

Moving from Britain to France after Brexit is an administrative project before it is a removal-van project. Secure the right long-stay visa while still in the United Kingdom, evidencing durable resources at least equal to the net annual minimum wage for visitors, a work permit and contract for employees, or a genuine, funded project for talent and founders; validate the VLS-TS within three months of arrival and attend every OFII summons; convert the first year into a carte de séjour and then a multi-year card by keeping resources, insurance, address and integration training continuously in order; and challenge refusals through the CRRV and the Nantes court for visas, or the local administrative court for residence permits, always within two months. Families who respect that sequence, and who keep every attestation, statement and tax assessment from day one, give themselves the strongest file at each gate and the strongest remedy at each refusal. Those who improvise, arrive first and apply later, work on visitor status, or let insurance lapse, discover that French immigration law forgives almost nothing and that each shortcut must later be bought back at the price of an appeal. Start early, file coherently, diary every deadline, and the Channel becomes paperwork, not a wall.

Need a quick opinion on your case

If your visa, validation or residence application is stuck, refused or running against a deadline, get advice before the time limit expires.
