The tenancy runs smoothly for a year or two, and then the friction starts: the landlord keeps half the deposit for repainting, the agency sends an invoice with no supporting paperwork, or you give notice and the landlord insists on three months&#8217; rent when you were certain one month was enough. For British tenants these disputes carry an extra layer of stress, because the vocabulary is unfamiliar \u2014 d\u00e9p\u00f4t de garantie, \u00e9tat des lieux, cong\u00e9, pr\u00e9avis \u2014 and because the rules that protect you are strict, technical, and very different from the deposit-protection schemes you knew in England.<\/p>\n<p>French residential lettings are governed mostly by one statute, Law No 89-462 of 6 July 1989, which applies to unfurnished and furnished homes alike and overrides almost anything the lease says to the contrary. Its provisions are a matter of public policy, so a clause that contradicts them is simply treated as unwritten. Around that statute sits the Civil Code, which allocates the burden of proof and presumes, where no inventory was drawn up, that you received the flat in good repair. Recent decisions of the Court of Cassation \u2014 including three rulings from 2024, 2025 and 2026 examined below \u2014 show exactly how judges apply these texts to deposit refunds, photographic inventories and notice periods. Brexit changed nothing in this framework: once you rent a home in France, you are a tenant like any other, with the same rights and the same deadlines.<\/p>\n<p>This guide explains, in the order a British tenant actually encounters them, the two questions that generate nearly all litigation: first, how your deposit works, when it must come back, and how to challenge every euro withheld; second, how to live in the flat and leave it properly, from the one-month notice to the repairs you do and do not owe. Each section gives you the exact statutory wording, what the courts have made of it, and the practical steps to protect your position, including where to go in Paris and the \u00cele-de-France.<\/p>\n<h2>I. Getting your deposit back: how much, how fast, and what the landlord may keep<\/h2>\n<p>The deposit \u2014 the d\u00e9p\u00f4t de garantie \u2014 is the single largest source of conflict between landlords and tenants in France, and British tenants are particularly exposed because the English system of ring-fenced deposit schemes does not exist here. The money sits with your landlord, and only the statute forces it back to you. Understanding the ceiling, the timetable and the penalty for lateness puts you in control from the day you sign.<\/p>\n<h3>A. How the deposit is capped, timed and penalised when it comes back late<\/h3>\n<p>Article 22 of the Law of 6 July 1989 fixes the framework in terms that leave no room for negotiation: <a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000028806696\/\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000028806696\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">&#8220;il ne peut \u00eatre sup\u00e9rieur \u00e0 un mois de loyer en principal&#8221;<\/a> \u2014 the deposit cannot exceed one month&#8217;s rent excluding charges. If your landlord demands two months, or increases the deposit during the tenancy, the demand is unlawful. The same article adds that <a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000028806696\/\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000028806696\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">&#8220;Le montant de ce d\u00e9p\u00f4t de garantie ne porte pas int\u00e9r\u00eat au b\u00e9n\u00e9fice du locataire&#8221;<\/a>, so unlike some English arrangements, the sum does not earn you interest while it is held. Note the lease itself must state the amount: article 3 requires the contract to mention <a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000039369598\/\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000039369598\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">&#8220;Le montant du d\u00e9p\u00f4t de garantie, si celui-ci est pr\u00e9vu&#8221;<\/a>, and the lease must be in writing following a standard-form contract, since <a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000039369598\/\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000039369598\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">&#8220;Le contrat de location est \u00e9tabli par \u00e9crit et respecte un contrat type d\u00e9fini par d\u00e9cret en Conseil d&#8217;Etat&#8221;<\/a>.<\/p>\n<p>The refund timetable is the heart of the system and it rewards tenants who leave the flat in the same condition they found it. The statute provides that <a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000028806696\/\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000028806696\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">&#8220;Il est restitu\u00e9 dans un d\u00e9lai maximal d&#8217;un mois \u00e0 compter de la remise des cl\u00e9s par le locataire lorsque l&#8217;\u00e9tat des lieux de sortie est conforme \u00e0 l&#8217;\u00e9tat des lieux d&#8217;entr\u00e9e&#8221;<\/a>. In plain terms, if the exit inventory matches the entry inventory, you must have your money back within one month of handing back the keys. Where the two inventories differ, the landlord has two months. In both cases the refund is made <a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000028806696\/\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000028806696\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">&#8220;d\u00e9duction faite, le cas \u00e9ch\u00e9ant, des sommes restant dues au bailleur et des sommes dont celui-ci pourrait \u00eatre tenu, en lieu et place du locataire, sous r\u00e9serve qu&#8217;elles soient d\u00fbment justifi\u00e9es&#8221;<\/a> \u2014 deductions are allowed only for sums still owed and only where they are properly evidenced. One practical detail matters enormously and is often missed by newcomers: <a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000028806696\/\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000028806696\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">&#8220;A cette fin, le locataire indique au bailleur ou \u00e0 son mandataire, lors de la remise des cl\u00e9s, l&#8217;adresse de son nouveau domicile.&#8221;<\/a> Give your forwarding address in writing when you return the keys, because the penalty for late refund is not due where the delay comes from your failure to do so: <a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000028806696\/\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000028806696\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">&#8220;Cette majoration n&#8217;est pas due lorsque l&#8217;origine du d\u00e9faut de restitution dans les d\u00e9lais r\u00e9sulte de l&#8217;absence de transmission par le locataire de l&#8217;adresse de son nouveau domicile.&#8221;<\/a> British tenants who move back to the United Kingdom should therefore send the new address by recorded-delivery letter and keep the proof.<\/p>\n<p>Where the building is a block of flats, the landlord may keep a capped provision while the annual service-charge accounts are finalised: <a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000028806696\/\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000028806696\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">&#8220;conserver une provision ne pouvant exc\u00e9der 20 % du montant du d\u00e9p\u00f4t de garantie jusqu&#8217;\u00e0 l&#8217;arr\u00eat\u00e9 annuel des comptes de l&#8217;immeuble&#8221;<\/a>. That is a maximum of one fifth, and the final settlement must follow within the month after the accounts are approved. Anything beyond that ceiling is simply retained unlawfully.<\/p>\n<p>The penalty for missing the deadline is automatic and generous to the tenant. The statute states that <a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000028806696\/\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000028806696\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">&#8220;A d\u00e9faut de restitution dans les d\u00e9lais pr\u00e9vus, le d\u00e9p\u00f4t de garantie restant d\u00fb au locataire est major\u00e9 d&#8217;une somme \u00e9gale \u00e0 10 % du loyer mensuel en principal, pour chaque p\u00e9riode mensuelle commenc\u00e9e en retard.&#8221;<\/a> Each month of delay started adds ten per cent of the monthly rent, with no need to prove loss and no formal demand required. The Court of Cassation confirmed how strictly this applies in a ruling of 12 February 2026 (Third Civil Chamber, appeal No 24-21.258): <a href=\"https:\/\/www.courdecassation.fr\/decision\/698d7affcdc6046d47fec70b\">&#8220;Il r\u00e9sulte du second qu&#8217;\u00e0 d\u00e9faut de restitution dans le d\u00e9lai de deux mois \u00e0 compter de la remise des cl\u00e9s, le d\u00e9p\u00f4t de garantie restant d\u00fb au locataire est major\u00e9 d&#8217;une somme \u00e9gale \u00e0 10 % du loyer mensuel principal, pour chaque p\u00e9riode mensuelle commenc\u00e9e en retard&#8221;<\/a>. In that case the landlord claimed to have posted a refund cheque and produced the cheque stub, but the tenant said it never arrived and it was never cashed. The lower court accepted the stub as proof; the Court of Cassation quashed that reasoning, holding that <a href=\"https:\/\/www.courdecassation.fr\/decision\/698d7affcdc6046d47fec70b\">&#8220;En statuant ainsi, sans constater que le bailleur justifiait de la r\u00e9ception du ch\u00e8que par le locataire, qui la contestait, le juge a viol\u00e9 les textes susvis\u00e9s.&#8221;<\/a> The lesson for British tenants is direct: a landlord who says the money was sent must prove you received it, and a cheque stub or an uncashed cheque proves nothing. Always insist on a bank transfer and keep your statements.<\/p>\n<p>The same decision restated the general burden of proof in article 1353 of the Civil Code: <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000032042341\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000032042341\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">&#8220;Celui qui r\u00e9clame l&#8217;ex\u00e9cution d&#8217;une obligation doit la prouver. R\u00e9ciproquement, celui qui se pr\u00e9tend lib\u00e9r\u00e9 doit justifier le paiement ou le fait qui a produit l&#8217;extinction de son obligation.&#8221;<\/a> A landlord who claims to be discharged by payment must prove payment reached you. Finally, remember the long-stop deadline: <a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000028777184\/\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000028777184\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">&#8220;Toutes actions d\u00e9rivant d&#8217;un contrat de bail sont prescrites par trois ans \u00e0 compter du jour o\u00f9 le titulaire d&#8217;un droit a connu ou aurait d\u00fb conna\u00eetre les faits lui permettant d&#8217;exercer ce droit.&#8221;<\/a> You have three years to sue for the deposit and the penalty, but there is no reason to wait: interest does not run in your favour, while the ten per cent monthly uplift rewards prompt action.<\/p>\n<h3>B. Deposit withheld after the inventory: how to challenge each deduction line by line<\/h3>\n<p>Most disputes are not about whether the deposit comes back but about what is taken off it: repainting, cleaning, a scratched worktop, alleged arrears of charges. French law answers with a single method \u2014 comparison of the two inventories \u2014 and the landlord who cannot evidence each deduction through that comparison loses. Your first line of defence is therefore built on the day you move in, not the day you move out.<\/p>\n<p>The entry inventory (\u00e9tat des lieux d&#8217;entr\u00e9e) and the exit inventory (\u00e9tat des lieux de sortie) must be drawn up in the same formal conditions: article 3-2 of the 1989 Law provides that <a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000047900049\/\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000047900049\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">&#8220;Il est \u00e9tabli contradictoirement et amiablement par les parties ou par un tiers mandat\u00e9 par elles et joint au contrat de location.&#8221;<\/a> Contradictoirement means both sides present, or duly convened, and both signing. If no joint inventory can be arranged, either party may call in a commissaire de justice (the enforcement officer formerly called huissier), with the cost shared. British tenants should never accept an inventory conducted in their absence or sign a pre-filled form without checking every room: photographs help, but they supplement rather than replace your written comments. The statute gives you a second chance many newcomers miss: after moving in, you may ask the landlord to complete the entry inventory, and the implementing rules allow a short period \u2014 commonly ten days, longer for heating matters \u2014 to report defects you discover once living there. Use it, in writing, with dated photographs.<\/p>\n<p>Where no inventory exists at all, the Civil Code presumes against whoever blocked it. Article 1731 provides that <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006442883\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006442883\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">&#8220;S&#8217;il n&#8217;a pas \u00e9t\u00e9 fait d&#8217;\u00e9tat des lieux, le preneur est pr\u00e9sum\u00e9 les avoir re\u00e7us en bon \u00e9tat de r\u00e9parations locatives, et doit les rendre tels, sauf la preuve contraire.&#8221;<\/a> Read carefully, this is a double-edged rule: a tenant who moves in without an inventory is presumed to have received the flat in good repair and must return it in that state. Conversely, article 3-2 adds that <a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000047900049\/\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000047900049\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">&#8220;A d\u00e9faut d&#8217;\u00e9tat des lieux ou de la remise d&#8217;un exemplaire de l&#8217;\u00e9tat des lieux \u00e0 l&#8217;une des parties, la pr\u00e9somption \u00e9tablie par l&#8217;article 1731 du code civil ne peut \u00eatre invoqu\u00e9e par celle des parties qui a fait obstacle \u00e0 l&#8217;\u00e9tablissement de l&#8217;acte ou \u00e0 sa remise \u00e0 l&#8217;une des parties.&#8221;<\/a> A landlord or agency that refuses the inventory, or refuses to give you a copy, cannot then rely on the presumption against you. If that happens, write immediately demanding the document, by recorded-delivery letter, and keep the receipt: that letter is the evidence that the obstacle came from the other side.<\/p>\n<p>At exit, every deduction must pass two tests: comparison and paperwork. Comparison means the landlord must show, entry inventory against exit inventory, a deterioration beyond fair wear and tear. Estimates made unilaterally by the landlord are worthless, because article 4 of the 1989 Law deems unwritten any clause <a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000050623572\/\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000050623572\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">&#8220;Par laquelle le locataire s&#8217;engage par avance \u00e0 des remboursements sur la base d&#8217;une estimation faite unilat\u00e9ralement par le bailleur au titre des r\u00e9parations locatives&#8221;<\/a>, and the principle extends to the refund stage: article 22 allows deductions only where <a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000028806696\/\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000028806696\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">&#8220;d\u00fbment justifi\u00e9es&#8221;<\/a>. In practice the courts expect invoices or tradesmen&#8217;s quotes describing the work, with the landlord proving the damage is attributable to you rather than to age. A lick of paint after five years of occupation, a carpet worn in the doorway, sealant yellowed by time \u2014 these point to v\u00e9tust\u00e9 (age-related wear), for which the tenant never pays. Ask for the building&#8217;s wear-and-tear scale (grille de v\u00e9tust\u00e9) where one exists, and challenge any deduction unsupported by an invoice.<\/p>\n<p>The Court of Cassation illustrated the comparison method on 6 February 2025 (Third Civil Chamber, appeal No 23-21.193), in a case where the parties, struggling to describe the flat in words, had agreed to record the exit condition with photographs attached to the same document as the entry inventory. The tenant later argued the procedure was irregular. The Court upheld the landlord, finding that <a href=\"https:\/\/www.courdecassation.fr\/decision\/67a45bf16f209ee13f481a94\">&#8220;ce document avait \u00e9t\u00e9 \u00e9tabli contradictoirement et amiablement, en sorte que le recours \u00e0 un commissaire de justice n&#8217;\u00e9tait pas obligatoire&#8221;<\/a>, and that <a href=\"https:\/\/www.courdecassation.fr\/decision\/67a45bf16f209ee13f481a94\">&#8220;ces photographies permettaient la comparaison de l&#8217;\u00e9tat du logement constat\u00e9 \u00e0 l&#8217;entr\u00e9e et \u00e0 la sortie des lieux et qu&#8217;elles prouvaient l&#8217;existence de d\u00e9gradations imputables au locataire lors de la restitution des lieux.&#8221;<\/a> Two practical consequences follow. First, photographs jointly taken and signed are powerful evidence, so take your own dated set at entry and at exit and have the other side acknowledge them. Second, the comparison must genuinely show damage attributable to you: photographs that merely show the flat lived in do not justify a deduction.<\/p>\n<p>When the landlord will not move, the procedure is graduated and inexpensive. Start with a recorded-delivery demand (mise en demeure) listing each contested deduction, citing article 22, and claiming the ten per cent monthly uplift. Allow a short deadline. If that fails, either side may refer the file to the departmental conciliation commission (commission d\u00e9partementale de conciliation), a free body that issues an opinion and settles a large share of deposit disputes. Failing settlement, the local protection-litigation judge (juge des contentieux de la protection) at the judicial court hears the claim: bring both inventories, both sets of photographs, the lease, the key-handover receipt, your forwarding-address letter, proof of rent payments, and every quote or invoice exchanged. Claim the balance of the deposit, the monthly uplift, and, where the landlord&#8217;s resistance was abusive, damages. Tenants in Paris can seise the Paris commission and court for flats in the capital; tenants in the surrounding departments apply to the commission and court of the department where the flat is situated, so check the address of the property, not your new address, when filing.<\/p>\n<h2>II. Living in the flat and leaving it: notice, paperwork, repairs and your defences<\/h2>\n<p>Deposit disputes get the attention, but the tenancy itself creates traps that cost British tenants just as much: notice given in the wrong form, a month of rent paid unnecessarily, a repair bill that belonged to the landlord, or a lease clause that the statute wipes out. This second part follows the life cycle of the letting \u2014 arriving, living there, and giving notice \u2014 so that each stage is handled once and correctly.<\/p>\n<h3>A. Giving notice properly and paying only the rent you truly owe<\/h3>\n<p>The tenant&#8217;s freedom to leave is one of the most protective features of French law. Article 12 states simply that <a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000028806645\/\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000028806645\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">&#8220;Le locataire peut r\u00e9silier le contrat de location \u00e0 tout moment, dans les conditions de forme et de d\u00e9lai pr\u00e9vues \u00e0 l&#8217;article 15.&#8221;<\/a> You may end the lease at any time, for any reason or none \u2014 no justification is ever required from you, unlike the landlord, who may terminate only for sale, repossession or serious breach. The battle is therefore never about whether you may leave, but about how much notice you owe and whether the notice was validly served.<\/p>\n<p>The default notice period is three months. It falls to one month in the exhaustively listed situations set by article 15, which include homes in a designated high-demand area (zone tendue), professional relocation, a first job, job loss, state of health, or receipt of certain benefits. The Court of Cassation restated the rule on 11 January 2024 (Third Civil Chamber, appeal No 22-19.891): <a href=\"https:\/\/www.courdecassation.fr\/decision\/659f9e633328fa00087a2845\">&#8220;lorsqu&#8217;il \u00e9mane du locataire, le d\u00e9lai de pr\u00e9avis applicable au cong\u00e9 est de trois mois. Toutefois, ce d\u00e9lai est r\u00e9duit \u00e0 un mois dans les cas limitativement \u00e9num\u00e9r\u00e9s au 1\u00b0 \u00e0 5\u00b0 de ce texte.&#8221;<\/a> Paris and virtually the whole of the \u00cele-de-France lie in a zone tendue, so a British tenant renting in the capital or its inner suburbs will normally qualify for the one-month period \u2014 but qualification alone is not enough. You must state and evidence the ground in the notice letter itself.<\/p>\n<p>That same 2024 decision is reassuring about how little formality is needed to invoke the zone-tendue ground. The tenant had given notice mentioning the address of the flat and claiming the one-month period under the ALUR legislation, and the landlord objected that the letter did not prove the zone. The Court held that <a href=\"https:\/\/www.courdecassation.fr\/decision\/659f9e633328fa00087a2845\">&#8220;le fait pour le locataire de mentionner l&#8217;adresse de ce bien dans son cong\u00e9 et de revendiquer le b\u00e9n\u00e9fice d&#8217;un pr\u00e9avis r\u00e9duit au visa des dispositions de la loi Alur suffit \u00e0 pr\u00e9ciser et \u00e0 justifier le motif invoqu\u00e9 de r\u00e9duction du d\u00e9lai de pr\u00e9avis.&#8221;<\/a> In other words, give the address of the flat and expressly claim the reduced period with its legal basis, and the notice is sufficient. Do not rely on this leniency for the other grounds \u2014 job loss, health, professional move \u2014 where you should attach or offer the supporting proof (dismissal letter, medical certificate, employment contract) with the notice.<\/p>\n<p>Form and timing decide everything else. Serve notice by recorded delivery with proof of receipt, by act of a commissaire de justice, or by hand delivery against a signed receipt; email and ordinary post are unsafe unless the landlord acknowledges them in writing. The period runs from receipt by the landlord, not from posting, so keep the acknowledgement slip. During the notice period you owe rent and charges for the time you actually occupy, and you remain liable to the end of the period even if you move out early \u2014 unless the flat is re-let, with the landlord&#8217;s agreement, to a new tenant before expiry, in which case your liability stops. Insist on a key-handover appointment producing a signed exit inventory, hand over your forwarding address in the same document, and photograph the meters. If the landlord refuses to attend, have the inventory drawn up by a commissaire de justice and send the forwarding address separately by recorded delivery: without that address, as seen above, the late-refund penalty cannot run.<\/p>\n<p>British tenants sometimes discover at this stage that the landlord claims the notice was unclear or came from only one of two joint tenants. Where partners, spouses or friends signed together, check whether the lease created a solidarity clause and whether each tenant must give separate notice; a d\u00e9part by one co-tenant does not automatically end the other&#8217;s liability. And where the landlord, rather than you, seeks to end the letting \u2014 for sale or repossession \u2014 the notice must state its ground on pain of nullity and observe a six-month period, with strict protections for elderly or vulnerable tenants. Those landlord-side notices are fully covered by our companion guides for owners; as a tenant, your response should always be checked by a lawyer before the deadline expires, because an invalid landlord notice can be annulled while a missed tenant deadline cannot be recovered.<\/p>\n<h3>B. During the tenancy: the paperwork you must receive, the repairs you owe, and the clauses that cannot bind you<\/h3>\n<p>French law front-loads tenant protection into documents the landlord must hand over at signature. The lease must follow the standard form and list the parties, the duration, the description and floor area, the rent and its revision rules, and the deposit. Alongside it, article 3-3 requires that <a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000043978254\/\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000043978254\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">&#8220;Un dossier de diagnostic technique, fourni par le bailleur, est annex\u00e9 au contrat de location&#8221;<\/a>, including <a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000043978254\/\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000043978254\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">&#8220;Le diagnostic de performance \u00e9nerg\u00e9tique pr\u00e9vu \u00e0 l&#8217;article L. 126-26 du code de la construction et de l&#8217;habitation&#8221;<\/a>, the lead-exposure report, the asbestos statement where applicable, and the gas and electricity safety reports. The energy-performance report (diagnostic de performance \u00e9nerg\u00e9tique, universally called the DPE) is defined as <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000043976949\/\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000043976949\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">&#8220;un document qui comporte la quantit\u00e9 d&#8217;\u00e9nergie effectivement consomm\u00e9e ou estim\u00e9e&#8221;<\/a> with its greenhouse-gas emissions and a letter rating. Its importance has grown sharply: the least efficient ratings are progressively barred from new lettings, and the rating stated in the lease must match the report. A British tenant offered a flat with a missing or suspicious DPE should demand the full file before signing, because reletting restrictions and renovation duties attach to the rating, and an absent diagnostic is evidence of a landlord who cuts corners elsewhere.<\/p>\n<p>Once installed, your core duties are set by article 7 of the 1989 Law: pay the rent and recoverable charges on time, use the flat peacefully for its contractual purpose, and answer for deterioration during your occupation unless you prove force majeure, the landlord&#8217;s fault or a third party&#8217;s act \u2014 the statute&#8217;s own words being <a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000051748585\/\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000051748585\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">&#8220;De r\u00e9pondre des d\u00e9gradations et pertes qui surviennent pendant la dur\u00e9e du contrat dans les locaux dont il a la jouissance exclusive, \u00e0 moins qu&#8217;il ne prouve qu&#8217;elles ont eu lieu par cas de force majeure, par la faute du bailleur ou par le fait d&#8217;un tiers qu&#8217;il n&#8217;a pas introduit dans le logement&#8221;<\/a>. Day-to-day upkeep and minor repairs defined by regulation fall to you, while structural work, age-related replacement and hidden defects fall to the landlord. Keep every receipt for maintenance you carry out, insure the flat against rental risks as the lease requires, and report serious defects \u2014 damp, faulty boiler, dangerous wiring \u2014 in writing without delay, because a tenant who lets deterioration spread may share the cost.<\/p>\n<p>Where the flat itself is substandard, you are not limited to complaining. Article 20-1 allows you to demand compliance: <a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000043977099\/\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000043977099\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">&#8220;le locataire peut demander au propri\u00e9taire sa mise en conformit\u00e9 sans qu&#8217;il soit port\u00e9 atteinte \u00e0 la validit\u00e9 du contrat en cours.&#8221;<\/a> If the landlord does not respond within two months, the conciliation commission may be seised, and the judge can order the works, fix a timetable, and in the meantime <a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000043977099\/\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000043977099\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">&#8220;r\u00e9duire le montant du loyer ou suspendre, avec ou sans consignation, son paiement&#8221;<\/a>. Never stop paying rent unilaterally, however justified you feel: only the judge may suspend or reduce it, and withholding rent exposes you to termination proceedings. The lawful route is a written demand, then conciliation, then the court \u2014 the same graduated path as for deposits.<\/p>\n<p>Finally, read your lease with scepticism, because many standard clauses are void. Article 4 opens with the general guillotine: <a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000050623572\/\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000050623572\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">&#8220;Est r\u00e9put\u00e9e non \u00e9crite toute clause&#8221;<\/a> falling within its long blacklist, which includes forcing you to take insurance from the landlord&#8217;s chosen company, imposing direct debit as the only payment method, authorising deductions from your wages, or providing for automatic termination for any breach other than non-payment, missing insurance or proven neighbourhood disturbance. Penalty clauses fixing arbitrary deductions, collective-liability clauses for damage to common parts, and advance agreements to reimburse unilateral estimates are all caught. A clause deemed unwritten is treated as if it never existed \u2014 you need not ask a court to cancel it before ignoring it, though citing article 4 in correspondence ends most arguments. Two Brexit-specific warnings close this section. First, assemble your tenant file (dossier de location) carefully: residence permit or visa, passport, employment contract or proof of resources, and previous rent receipts. Landlords may only request documents from a closed statutory list, and demands for your full UK bank statements or medical records exceed it. Second, a British newcomer without a French guarantor is routinely asked for one; the free public guarantee Visale and similar guarantee schemes exist precisely for this situation, and a landlord who refuses any guarantee while demanding an unlawful deposit is signalling a tenancy to avoid.<\/p>\n<h2>Conclusion<\/h2>\n<p>Renting in France as a British tenant after Brexit is entirely manageable once the method is understood: the deposit is capped at one month, refundable within one month where the inventories match and two months otherwise, with an automatic ten per cent monthly uplift for lateness that the courts enforce strictly against landlords who cannot prove payment reached you. Every deduction must be justified by comparing the entry and exit inventories and by invoices, unilateral estimates are void, and photographs taken jointly can decide the case either way \u2014 so document everything, in writing, with dates. Notice is yours to give at any time, with one month in Paris and the other high-demand zones provided the letter states the address and the ground, and served in a form you can prove. During the tenancy, demand the full diagnostic file, maintain the flat, report defects promptly, never suspend rent on your own authority, and strike out abusive clauses by citing the statute. Most disputes settle at the demand-letter or conciliation stage when the file is complete; the cases that reach court are usually those where one side kept nothing in writing.
