The Withdrawal Agreement cards are the specific documents for protected Britons, and the detailed regime for their entry, residence, professional activity and social rights was laid down by D\u00e9cret n\u00b02020-1417 du 19 novembre 2020 concerning the entry, residence, professional activity and social rights of foreign nationals covered by the Withdrawal Agreement (Journal officiel, 20 November 2020), while the exact list of supporting documents was fixed by the arr\u00eat\u00e9 of 20 November 2020 fixing the list of supporting documents for British nationals applying for cards marked Accord de retrait du Royaume-Uni de l&#8217;UE (Journal officiel, 21 November 2020). In practice this means your file must show identity and nationality, continuous residence in France before 31 December 2020, and, for family members, the family link with the protected British national. Keep everything: tenancy agreements or <i>taxe d&#8217;habitation<\/i> bills, electricity and telephone contracts, French tax notices, pay slips, school certificates for children, and boarding passes or ferry bookings showing presence. Gaps in the paper trail are the single most common reason files run into trouble.<\/p>\n<h3>B. Why the pr\u00e9fecture can say no, and the exact routes for challenging a refusal<\/h3>\n<p>A refusal never arrives unexplained. French law requires the administration to give reasons, and those reasons dictate your response. Criminal convictions, police records and serious fraud in the application are the typical material behind such decisions, but the prefecture must connect the facts to the threat: a bare reference to an old minor conviction, without explanation, is vulnerable on appeal. The second family of refusals concerns eligibility. The administration may consider that you have not shown residence in France before 31 December 2020, that your presence since has not been continuous, that your documents are insufficient or unauthentic, or that, as a family member, you have not proved the qualifying link. Read the refusal letter with a highlighter: every ground stated there is a ground you must answer, and any ground not stated generally cannot be added later to justify the same decision.<\/p>\n<p>Your remedies follow the ordinary French system for challenging administrative decisions, applied to the special Withdrawal Agreement regime. The golden rule is the time limit. Article R421-1 of the Code de justice administrative (the Code of Administrative Justice, the procedural code for cases against the administration) provides that a court action must be brought <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000039807005\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000039807005\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">&#8220;dans les deux mois \u00e0 partir de la notification ou de la publication de la d\u00e9cision attaqu\u00e9e&#8221;<\/a>, within two months of notification of the decision. Miss that two-month window and the refusal becomes final, however unfair it feels. In practice you have three complementary weapons, and you will often use the first two together to preserve the third. First, the <i>recours gracieux<\/i>, a written request asking the prefect who signed the refusal to reconsider, with the missing documents or explanations attached. Second, the <i>recours hi\u00e9rarchique<\/i>, the same request addressed to the Minister of the Interior. Neither suspends the time limit for going to court on its own in a way you should rely upon without advice, so the third weapon, the <i>recours contentieux<\/i> before the <i>tribunal administratif<\/i> (the administrative court), must be filed within the two months. Interim relief of this kind, called <i>r\u00e9f\u00e9r\u00e9-suspension<\/i>, does not replace the main case, but it can freeze the effects of the refusal while the court examines the substance.<\/p>\n<p>Two practical points decide many cases before they ever reach a hearing. First, keep proof of everything you file: send reconsideration requests by registered letter with acknowledgement of receipt (<i>lettre recommand\u00e9e avec accus\u00e9 de r\u00e9ception<\/i>), keep screenshots and receipts from the online portal, and keep the envelope of any notified decision so the start of the two-month period can be proved. Second, if you held a previous card or were issued a receipt (<i>r\u00e9c\u00e9piss\u00e9<\/i>) or registration certificate for your application, keep it on you and keep copies elsewhere: it is the document that shows employers, airlines and border officers that your stay remains regular while the procedure runs. My five-year Withdrawal Agreement card is expiring: how do I renew it or step up to the ten-year permanent card?<\/h2>\n<h3>A. Renewal and permanent residence: conditions, papers and the two-month deadline<\/h3>\n<p>The five-year card was never meant to be the end of the story. Official guidance explains that once you have built up at least five years of residence in France, you may apply for a ten-year residence card recording permanent stay under Article 50 TEU and Article 18(1) of the Withdrawal Agreement. For a Withdrawal Agreement card, that means showing that you have continued to live in France, that you have not been absent for so long or in such circumstances as to break the continuity of residence protected by the treaty, and that none of the grounds for withdrawal, such as fraud or a serious threat to public order, has arisen. The administration may carry out checks, and article L431-1 of CESEDA reminds applicants that <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776418\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776418\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">&#8220;Les conditions dans lesquelles les demandes de titres de s\u00e9jour sont d\u00e9pos\u00e9es aupr\u00e8s de l&#8217;autorit\u00e9 administrative comp\u00e9tente sont fix\u00e9es par voie r\u00e9glementaire.&#8221;<\/a> In everyday language, the formalities for filing, including the online portal, the supporting documents and the photograph and fee requirements, are set by regulation, so follow the prefecture&#8217;s current published list to the letter and keep dated proof of your online submission.<\/p>\n<p>For the ten-year permanent card, think of the file as a five-year story told in documents. You must demonstrate the length and continuity of your stay: yearly tax assessments (<i>avis d&#8217;imposition<\/i>), employment records or business accounts, health insurance statements, tenancy agreements and utility bills spread across the whole period, and evidence explaining any long absence, such as caring for an elderly parent in Britain or a posting abroad. Short trips home for Christmas, holidays and family events are normal life and do not break residence; what damages a file is an unexplained gap of many months with no French footprint at all. Family members apply in their own right where they qualify, with proof of the continuing family link. If the prefecture doubts a period, it will usually ask for more evidence before refusing, so answer such requests within the stated time and send complete bundles rather than dribs and drabs. And remember the parallel track: Britons who arrived after 1 January 2021 cannot use this route at all. If you are in that later-arrival group, your renewal file must instead show that you still meet the conditions of your own category of permit, such as employee, self-employed, student or family member, and the Withdrawal Agreement arguments simply do not apply to you.<\/p>\n<h3>B. Living and working while the administration decides: receipts, travel and repairs<\/h3>\n<p>Filing on time buys you a protected status while the file is examined. In the Withdrawal Agreement system, as in everyday French immigration practice, the applicant who has lodged a complete renewal application before the old card expires is entitled to documentary proof of the pending file, and that proof preserves the attached rights, including residence, employment and social rights, until the administration decides. Government guidance for Britons confirms the principle: people waiting for their card can continue to reside regularly and enjoy the rights attached to their residence status as soon as they can show the registration certificate for their online application or the receipt for the issue of the permit. In concrete terms, show that certificate or receipt to your employer, to the health insurance fund (<i>caisse d&#8217;assurance maladie<\/i>) and at the border, and keep a copy on your telephone as well as the original with your passport. Employers sometimes panic when a card date passes; a calm explanation with the receipt, backed by a short letter from your lawyer citing the pending renewal, resolves most workplace incidents in days.<\/p>\n<p>Travel needs particular care during the renewal window. Within the Schengen area, carry your passport, the expired or expiring card and the proof of renewal; outside it, especially on return from the United Kingdom, allow extra time at the border and carry the same bundle plus recent proof of French domicile. If an officer questions your status, stay courteous, present the documents in order, and ask for the decision and its reasons in writing if you are refused entry or issued with a removal measure. Never surrender originals without a written receipt. A genuine refusal must be reasoned, and the same remedies described in Part I apply, including the two-month court deadline in article R421-1 of the Code de justice administrative and, in urgent cases, the <i>r\u00e9f\u00e9r\u00e9-suspension<\/i> of article L521-1. Renewal refusals most often rest on one of four findings: residence considered interrupted by long unexplained absences, resources or activity considered insufficient where the card category requires them, documents considered unauthentic, or public-order concerns. Each has a different evidential answer. Absences are answered with dated proof of presence and explanations with supporting documents. Resource doubts are answered with bank statements, contracts and tax records. Document doubts are answered by going back to the issuing body for certified copies rather than arguing. Public-order findings require immediate legal advice and a carefully framed challenge to the proportionality of the measure. In every case, continue to meet the ordinary duties of any resident while the dispute runs: file your French tax returns, keep your health cover current, keep your address updated with the administration, and do not let your passport expire.
