You hold a pink photocard issued by the DVLA (the Driver and Vehicle Licensing Agency, the British authority that issues driving licences in Great Britain). A gendarme at a roadside check asks for your licence, glances at the Union flag on the front, and asks the question every British resident in France dreads: is this still valid here? Since the United Kingdom left the European Union, the answer depends on one date that many British drivers have never been told about: the date your licence was issued. A licence issued before 2021 lives under a recognition regime close to the old European rules. A licence issued in 2021 or later is treated as a third-country licence, recognised for only one year after you establish your normal residence in France, and it must be exchanged within that year. Miss the deadline and you do not simply face paperwork: your licence is no longer recognised, you lose the right to drive, and every mile you drive exposes you to a criminal prosecution for driving without a licence, with one year of imprisonment and a 15,000 euro fine on the statute book. This article explains, in plain English and with the exact French texts, which regime applies to you, how to file your exchange application on the ANTS platform (the Agence nationale des titres s\u00e9curis\u00e9s, the French agency that produces driving licences, run online as France Titres), what document keeps you legally driving while the file is examined, and how to challenge a refusal or defend yourself if you are prosecuted.<\/p>\n<h2>I. Can you still drive in France on your UK licence after Brexit?<\/h2>\n<p>The short answer is that it depends when your licence was issued and when you settled in France. French law now draws a bright line at 1 January 2021. Before that date the United Kingdom was still covered by the European recognition system during the transition period. From that date onward, a newly issued British licence is the licence of a third country, a State that is neither a member of the European Union nor a party to the European Economic Area agreement. Your UK licence issued before 2021: recognised in France while it remains valid<\/h3>\n<p>If your British licence was issued before 2021, service-public.fr, the official French public service website, states the position plainly: you have no need to ask for the exchange of your British licence against a French licence, and your British licence is recognised in France as long as it is valid. That reflects the wording of <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000043927934\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000043927934\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">article R. 222-1 of the Code de la route<\/a>, the French Highway Code, which provides: &#8220;Tout permis de conduire national r\u00e9guli\u00e8rement d\u00e9livr\u00e9 par un Etat membre de l&#8217;Union europ\u00e9enne ou partie \u00e0 l&#8217;accord sur l&#8217;Espace \u00e9conomique europ\u00e9en ou par un Etat qui \u00e9tait membre de l&#8217;Union europ\u00e9enne ou partie \u00e0 l&#8217;accord sur l&#8217;Espace \u00e9conomique europ\u00e9en \u00e0 la date de sa d\u00e9livrance, est reconnu en France sous r\u00e9serve d&#8217;\u00eatre en cours de validit\u00e9.&#8221; In other words, a licence delivered by a State that was a member of the Union on the date of issue, which covers the United Kingdom for licences issued before the end of the transition period, is recognised in France provided it is still in date.<\/p>\n<p>Recognition is not the same as exemption from exchange forever. The same official page lists six situations in which exchange of a pre-2021 British licence becomes compulsory: your licence is no longer valid, you apply for a new licence category such as a lorry or bus entitlement, you commit a traffic offence in France that costs you points or brings a restriction, suspension or cancellation, or your licence is stolen, lost or damaged. The points case is the one that catches most British residents by surprise. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000035977228\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000035977228\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article R. 222-2 of the Code de la route<\/a> states: &#8220;Toute personne ayant sa r\u00e9sidence normale en France, titulaire d&#8217;un permis de conduire national d\u00e9livr\u00e9 par un Etat membre de l&#8217;Union europ\u00e9enne ou d&#8217;un autre Etat partie \u00e0 l&#8217;accord sur l&#8217;Espace \u00e9conomique europ\u00e9en, en cours de validit\u00e9 dans cet Etat, peut, sans qu&#8217;elle soit tenue de subir les examens pr\u00e9vus au premier alin\u00e9a de l&#8217;article D. 221-3 , l&#8217;\u00e9changer contre le permis de conduire fran\u00e7ais selon les modalit\u00e9s d\u00e9finies par arr\u00eat\u00e9 du ministre charg\u00e9 de la s\u00e9curit\u00e9 routi\u00e8re, apr\u00e8s avis du ministre de la justice et du ministre charg\u00e9 des affaires \u00e9trang\u00e8res.&#8221; The relief is real: exchange spares you the French driving tests, the theory examination and the practical test described in <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000032621820\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000032621820\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">article D. 221-3 of the Code de la route<\/a>, which provides: &#8220;Les examens du permis de conduire susvis\u00e9s comportent une \u00e9preuve th\u00e9orique et une \u00e9preuve pratique qui se d\u00e9roulent dans les conditions et selon les modalit\u00e9s fix\u00e9es par arr\u00eat\u00e9 du ministre charg\u00e9 de la s\u00e9curit\u00e9 routi\u00e8re.&#8221; But the same article continues: &#8220;L&#8217;\u00e9change d&#8217;un tel permis de conduire contre le permis fran\u00e7ais est obligatoire lorsque son titulaire a commis, sur le territoire fran\u00e7ais, une infraction au pr\u00e9sent code ayant entra\u00een\u00e9 une mesure de restriction, de suspension, de retrait du droit de conduire ou de retrait de points.&#8221; A single speeding ticket recorded on an ANTS file can therefore convert a comfortably recognised pre-2021 licence into a licence you are legally obliged to exchange, so that the French points system can be applied to you.<\/p>\n<p>A decision of the criminal chamber of the Cour de cassation, the French supreme court for criminal matters, shows how strictly the courts police this boundary and also how carefully they protect drivers who follow the procedure. On 9 March 2022, in case number 21-84.021, the Court dealt with a driver holding a British licence obtained on 11 February 2016 and valid until 10 February 2025, who had applied for exchange on 8 January 2019 and received an attestation, a written certificate, valid until 8 September 2019 stating that she held the right to drive. The Court of Appeal at Riom had convicted her of driving without a licence. The Cour de cassation set that conviction aside in part. Its reasoning restated the core rule: <a href=\"https:\/\/www.courdecassation.fr\/decision\/62285238590661fa1d597c99\">&#8220;Selon les deux suivants, tout permis de conduire r\u00e9guli\u00e8rement d\u00e9livr\u00e9 dans un Etat membre de l&#8217;Union europ\u00e9enne est reconnu en France sous r\u00e9serve d&#8217;\u00eatre en cours de validit\u00e9. L&#8217;\u00e9change d&#8217;un tel permis est obligatoire lorsque son titulaire a commis, sur le territoire fran\u00e7ais, une infraction au code de la route entra\u00eenant une mesure de restriction, de suspension, de retrait du droit de conduire ou de retrait de points.&#8221;<\/a> The appeal judges had held that the English licence could not be recognised because the driver had previously lost all her points under the French system. The supreme court answered that the British licence had been obtained after the ban on applying for a licence had expired, the earlier licence having been returned on 31 March 2008: <a href=\"https:\/\/www.courdecassation.fr\/decision\/62285238590661fa1d597c99\">&#8220;En se d\u00e9terminant ainsi, alors que ledit permis de conduire avait \u00e9t\u00e9 obtenu apr\u00e8s que la p\u00e9riode d&#8217;interdiction de solliciter ou d&#8217;obtenir un permis de conduire avait expir\u00e9, le pr\u00e9c\u00e9dent permis ayant \u00e9t\u00e9 restitu\u00e9, selon les \u00e9nonciations de l&#8217;arr\u00eat attaqu\u00e9, le 31 mars 2008, la cour d&#8217;appel a m\u00e9connu les textes susvis\u00e9s.&#8221;<\/a> The lesson for British residents is practical. Keep your pre-2021 photocard, check its expiry date, and the moment you commit a points-bearing offence in France, file for exchange rather than hoping the British licence shields you. The same decision confirms that the implementing order then in force added one more condition, restated by the Court: <a href=\"https:\/\/www.courdecassation.fr\/decision\/62285238590661fa1d597c99\">&#8220;Le dernier pr\u00e9cise notamment que le titulaire d&#8217;un tel permis ne doit pas avoir obtenu le permis de conduire dans un autre Etat membre pendant une p\u00e9riode d&#8217;interdiction de solliciter ou d&#8217;obtenir un permis de conduire, accompagnant une peine d&#8217;annulation du permis ou r\u00e9sultant d&#8217;une d\u00e9cision d&#8217;invalidation prise en application des dispositions de l&#8217;article L. 223-5 du code de la route.&#8221;<\/a> Never apply for or obtain a British licence while you are still under a French driving ban. A licence obtained during the ban cannot be recognised, and it will not save you.<\/p>\n<h3>B. Your UK licence issued in 2021 or later: one year from residence, then exchange or stop driving<\/h3>\n<p>If your British licence was issued in 2021 or afterwards, the regime is harsher and the clock runs fast. Service-public.fr states that you must request exchange of your British licence against a French licence, and more generally that a licence issued by a non-European country is valid for only one year from the acquisition of the r\u00e9sidence normale, the normal residence, in France. The statute behind that warning is <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000035977232\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000035977232\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">article R. 222-3 of the Code de la route<\/a>: &#8220;Tout permis de conduire national, en cours de validit\u00e9, d\u00e9livr\u00e9 par un Etat ni membre de l&#8217;Union europ\u00e9enne, ni partie \u00e0 l&#8217;accord sur l&#8217;Espace \u00e9conomique europ\u00e9en, peut \u00eatre reconnu en France jusqu&#8217;\u00e0 l&#8217;expiration d&#8217;un d\u00e9lai d&#8217;un an apr\u00e8s l&#8217;acquisition de la r\u00e9sidence normale de son titulaire.&#8221; During that year you may exchange it without sitting the French tests. The same article fixes the conditions: &#8220;Pendant ce d\u00e9lai, il peut \u00eatre \u00e9chang\u00e9 contre le permis fran\u00e7ais, sans que son titulaire soit tenu de subir les examens pr\u00e9vus au premier alin\u00e9a de l&#8217;article D. 221-3 Les conditions de cette reconnaissance et de cet \u00e9change sont d\u00e9finies par arr\u00eat\u00e9 du ministre charg\u00e9 de la s\u00e9curit\u00e9 routi\u00e8re, apr\u00e8s avis du ministre de la justice et du ministre charg\u00e9 des affaires \u00e9trang\u00e8res.&#8221; Then comes the guillotine: &#8220;Au terme de ce d\u00e9lai, ce permis n&#8217;est plus reconnu et son titulaire perd tout droit de conduire un v\u00e9hicule pour la conduite duquel le permis de conduire est exig\u00e9.&#8221; After the year, the licence is simply no longer recognised, and the holder loses every right to drive a vehicle that requires a licence. There is no grace period in the text and no second year.<\/p>\n<p>Everything therefore turns on the starting point of that year: the date you acquired your r\u00e9sidence normale in France. For a British citizen that is, in practice, the date your French life genuinely began, and the courts pin it to your first residence permit. On 11 March 2020, in case number 19-80.465, the criminal chamber quashed a conviction where the appeal court had started the clock from an asylum-seeker receipt rather than from the first residence title. The Court restated the rule applicable at the time, drawn from the Code and from articles 2 and 4 of the order of 12 January 2012 that sets the recognition and exchange conditions for licences from States outside the Union and the Economic Area: <a href=\"https:\/\/www.courdecassation.fr\/decision\/5fca5a7c0766a131b76c00b2\">&#8220;La date d&#8217;acquisition de la r\u00e9sidence normale est celle du d\u00e9but de validit\u00e9 du premier titre de s\u00e9jour.&#8221;<\/a> The date of normal residence is the start date of the first titre de s\u00e9jour, the residence permit itself. The Court added that the one-year period available to the holder of a foreign licence to apply for exchange runs from the date of real establishment shown by that first permit, not from a provisional six-monthly asylum receipt. For a British resident, the equivalent landmarks are the start date of your first Withdrawal Agreement residence permit, the carte de s\u00e9jour bearing the mention accord de retrait du Royaume-Uni de l&#8217;Union europ\u00e9enne, or for later arrivals your first long-stay visa validated online, your first carte de s\u00e9jour visiteur, salari\u00e9, passeport talent or vie priv\u00e9e et familiale. Renewals do not restart the clock: service-public.fr warns that the one-year period does not run again from the renewal of a permit or a change of residence status, so a second card following a first permit gives you no fresh year. Calculate your deadline from the very first title and file months ahead, because ANTS examination routinely takes several months and the year is counted to the date of your application, not to the date the French licence is finally printed.<\/p>\n<p>Two British profiles need particular care. The first is the second-home owner who gradually becomes resident: the year starts when France becomes your normal residence, shown by 185 days of presence, your tax residence, your children&#8217;s schooling or your registration with the health system, not when you feel settled. If you split time between Kent and the Charente, seek advice before the facts decide for you. The second is the driver who passed the British test after moving to France. A licence obtained in the United Kingdom while you already lived in France may be refused exchange, because exchange requires that you resided in the issuing State when the licence was granted or that the licence genuinely reflects a test passed there. If ANTS doubts the chronology, it will ask for proof of residence in Britain at the date of issue. Keep tenancy agreements, utility bills and HMRC correspondence from that period. Students are the one clear exception: a British student holding a student residence permit may drive on the British licence for the whole course without exchanging, under the dedicated student page of service-public.fr. Everyone else who settles must treat the year as mandatory.<\/p>\n<h2>II. How do you exchange your British licence and challenge a refusal?<\/h2>\n<p>Knowing the deadline is half the battle. The other half is the file itself: where to apply, what to attach, what paper lets you drive while you wait, and what to do when the administration says no or when a prosecutor says you drove too long. French procedure is entirely online and entirely documentary. Roadside explanations count for little. Paper, dates and receipts count for everything.<\/p>\n<h3>A. The ANTS application, the supporting file and the certificate that keeps you driving<\/h3>\n<p>Exchange applications are filed online on the ANTS portal, the permisdeconduire.ants.gouv.fr service of France Titres, under the heading demande d&#8217;\u00e9change de permis \u00e9tranger. You create an account, select the exchange route, and upload scans of your British photocard front and back, your passport, your current titre de s\u00e9jour or validated long-stay visa, a justificatif de domicile, proof of address less than six months old such as a utility bill or rental lease, and a translation of your licence by a traducteur asserment\u00e9, a sworn translator listed by a French court of appeal, unless ANTS confirms your category of British licence is exempt. A timbre fiscal, an electronic tax stamp bought online or in a tobacconist fitted with the authorised terminal, must be paid at the end of the process; without it the file cannot be submitted. Check each scan before sending: expired proof of address, a cropped photocard, or a missing counterpart detail are the three most common causes of requests for further documents, and each round trip costs weeks.<\/p>\n<p>Once the file is lodged, ANTS issues a r\u00e9c\u00e9piss\u00e9 de d\u00e9p\u00f4t, an acknowledgement of receipt, and in many cases an attestation de droit \u00e0 conduire, a certificate stating that you hold the right to drive while the exchange is examined. The 21-84.021 case described exactly such a document: an attestation valid from the January application until the following September, stating that the holder was entitled to drive. Carry that attestation with your British licence and your passport at all times. If you are stopped, present all three together and keep a copy on your telephone. The attestation is your shield during the months of examination, when the French authorities verify with the DVLA that your licence is authentic, that it was not suspended or cancelled in Britain, and that you were not under a French ban when it was issued. Do not drive abroad on the attestation alone beyond what it states, and never let it expire without chasing ANTS through the portal messaging system and keeping screenshots of every chase. If ANTS asks for extra evidence, reply within the stated time and keep the upload receipts: silence is processed as abandonment.<\/p>\n<p>Expect verification to be slow. The DVLA reply, the sworn translation check and the pr\u00e9fet&#8217;s decision, the order of the pr\u00e9fet, the State representative in your d\u00e9partement who formally grants the exchange, each take their turn. While you wait, respect every French rule as if you already held a French licence: speed limits, alcohol limits, the mobile telephone ban and the obligation to carry a warning triangle and high-visibility vest. Any points-bearing offence during this period triggers the mandatory exchange logic of article R. 222-2 and can complicate a pending file. If your British photocard expires mid-procedure, renew it with the DVLA using a British correspondence address where you are entitled to do so, and upload the new card immediately; an expired foreign licence cannot be exchanged. If ANTS refuses exchange because your licence category has no French equivalent, typically certain restricted motorcycle entitlements, ask in writing which categories are recognised and whether a partial exchange plus a French test for the remainder is possible, rather than abandoning the whole file.<\/p>\n<h3>B. Refusal, expired year and roadside prosecution: the criminal risk and how to fight back<\/h3>\n<p>A refusal from ANTS usually arrives as a short online message: licence not exchangeable, unrecognised category, doubt about residence at issue, or application out of time. Do not let it rest. First, download and save the decision and every page of your file the day it appears, because portal messages can become unreadable after a new application overwrites them. Second, send a recours gracieux, a free-form request for reconsideration, to the decision-making authority within two months, attaching the missing or corrected evidence with a dated cover letter: proof that you lived in Britain when the licence was issued, the full translation, the start date of your first titre de s\u00e9jour proving you applied within the year, or the DVLA letter confirming your licence is clean. If the reconsideration fails or goes unanswered for two months, you may bring a recours contentieux, a court challenge, before the tribunal administratif, the administrative court, of your place of residence. Ask a lawyer whether a r\u00e9f\u00e9r\u00e9 suspension, an urgent application to freeze the decision, is justified where you need to drive for work, and always keep driving within whatever right you can still prove while the challenge runs. Never manufacture a solution by obtaining a fresh British licence during a French ban or by using an international driving permit as a substitute residence title: the Cour de cassation held on 17 May 2022, in case number 21-85.611, that once a French licence is invalidated the holder is barred from driving on national territory even if he holds a licence issued by another State or an international licence: <a href=\"https:\/\/www.courdecassation.fr\/decision\/62833bc65a52a8057d9917a2\">&#8220;D\u00e8s lors que l&#8217;invalidation du permis de conduire fran\u00e7ais entra\u00eene n\u00e9cessairement l&#8217;interdiction du droit de conduire sur le territoire national fran\u00e7ais, quand bien m\u00eame le pr\u00e9venu serait titulaire d&#8217;un permis d\u00e9livr\u00e9 par un autre Etat ou d&#8217;un permis international, le moyen soutenant que les permis de conduire libanais et international pr\u00e9sent\u00e9s par le pr\u00e9venu auraient \u00e9t\u00e9 obtenus r\u00e9guli\u00e8rement est inop\u00e9rant.&#8221;<\/a> Substitute licences do not cure an invalidated right.<\/p>\n<p>The criminal risk after the year expires is severe and it is enforced at the roadside. Driving with an unexchanged, unrecognised licence is prosecuted as driving without a licence. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000039099784\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000039099784\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article L. 221-2 of the Code de la route<\/a> provides: &#8220;Le fait de conduire un v\u00e9hicule sans \u00eatre titulaire du permis de conduire correspondant \u00e0 la cat\u00e9gorie du v\u00e9hicule consid\u00e9r\u00e9 est puni d&#8217;un an d&#8217;emprisonnement et de 15 000 euros d&#8217;amende.&#8221; The same article allows the prosecution to be extinguished by a fixed fine of 800 euros, reduced to 640 euros if paid promptly and increased to 1,600 euros otherwise, and it adds complementary penalties including confiscation of the vehicle where the driver owns it, a ban on driving certain motor vehicles for up to five years, community service, day-fines and a compulsory road-safety course at the driver&#8217;s expense. The total-loss-of-points variant is punished separately: <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000039099768\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000039099768\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">article L. 223-5 of the Code de la route<\/a> states: &#8220;En cas de retrait de la totalit\u00e9 des points, l&#8217;int\u00e9ress\u00e9 re\u00e7oit de l&#8217;autorit\u00e9 administrative l&#8217;injonction de remettre son permis de conduire au pr\u00e9fet de son d\u00e9partement de r\u00e9sidence et perd le droit de conduire un v\u00e9hicule.&#8221; Refusing to hand the licence over is itself punished by two years of imprisonment and a 4,500 euro fine. Alongside the criminal file runs the insurance danger. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000048523650\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000048523650\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article L. 211-1 of the Code des assurances<\/a>, the Insurance Code, provides: &#8220;Toute personne physique ou toute personne morale autre que l&#8217;Etat, dont la responsabilit\u00e9 civile peut \u00eatre engag\u00e9e en raison de dommages subis par des tiers r\u00e9sultant d&#8217;atteintes aux personnes ou aux biens dans la r\u00e9alisation desquels un v\u00e9hicule est impliqu\u00e9, doit, pour faire circuler celui-ci, \u00eatre couverte par une assurance garantissant cette responsabilit\u00e9, dans les conditions fix\u00e9es par d\u00e9cret en Conseil d&#8217;Etat.&#8221; Victims remain compensated by the insurer, but your own insurer may turn against you for driving without a valid licence and reclaim what it paid, then cancel the policy.
