Years ago in England you signed a property and financial affairs lasting power of attorney, appointing your daughter as your attorney. Now you are losing capacity, or you simply need her to operate your French bank account and sign papers for your house in the Dordogne, and the French bank refuses to recognise the English document. The notaire handling a sale asks for a French mandate instead. Staff tell you, politely but firmly, that an English power of attorney &#8220;does not work in France&#8221;. After Brexit, that answer is more common than ever, and it leaves British families stuck at the worst possible moment: the money is there, the authority was validly given, but nobody in France will act on it.<\/p>\n<p>This article explains, for a British reader, why French banks and notaires react this way, which law actually governs your English financial LPA on French soil, and the practical route to getting it accepted. The key points are these. First, England and France are not connected by the usual international treaty for this problem, because the United Kingdom ratified the relevant Hague Convention for Scotland only. Second, the French Cour de cassation has nevertheless shown, in a 2021 decision about a Swiss protective mandate, exactly how a foreign mandate can take effect in France through the court clerk&#8217;s visa procedure, without being forced to satisfy every French substantive requirement. Third, acceptance turns on paperwork done in the right order: registration in England, apostille, sworn translation, medical certificate and presentation at the French court greffe. And fourth, a refusal is not the end of the story: any interested person can ask the protection judge to rule, and a parallel French mandate can secure the position while you fight.<\/p>\n<p>Every French term is explained as we go. All decisive legal statements are tied to the official text or decision quoted word for word.<\/p>\n<h2>I. Why Your English Financial LPA Meets Resistance in France, and Which Law Actually Governs It<\/h2>\n<h3>A. What your English property and financial affairs LPA is, and why France does not treat it as automatically valid<\/h3>\n<p>Under the law of England and Wales there are two kinds of lasting power of attorney. The GOV.UK guidance distinguishes two forms of English lasting power of attorney, one for health and welfare and one for property and financial affairs (<a href=\"https:\/\/www.gov.uk\/power-of-attorney\">official guidance<\/a>). The second one is the document this article is about: it gives your chosen attorney power over money and property, such as operating bank accounts, paying bills, collecting rent and selling a house. An LPA is a forward-looking tool. The official guidance presents it as a way to keep control over what happens to you if an accident or illness leaves you unable to make your own decisions (<a href=\"https:\/\/www.gov.uk\/power-of-attorney\">official guidance<\/a>). A distinctive feature of the financial LPA is its flexibility: A financial LPA may be used as soon as it is registered, where the donor permits it (<a href=\"https:\/\/www.gov.uk\/power-of-attorney\">official guidance<\/a>). In other words, unlike the health LPA, it does not have to wait until you lose capacity, provided you allow it.<\/p>\n<p>Two practical facts from the same official source matter for everything that follows. First, the LPA must be registered before anyone can rely on it: Registration runs through the Office of the Public Guardian and typically takes eight to ten weeks where the application is error-free (<a href=\"https:\/\/www.gov.uk\/power-of-attorney\/register\">registration guidance<\/a>). The Office of the Public Guardian is the English supervisory body that registers LPAs. Second, The registration fee is \u00a392, subject to reductions or exemptions (<a href=\"https:\/\/www.gov.uk\/power-of-attorney\">official guidance<\/a>). Keep the registration certificate safe: it is the first document any French bank will ask to see, because an unregistered LPA is simply not usable, even in England.<\/p>\n<p>So why does a perfectly valid English document meet a refusal in Lyon, Paris or Bordeaux? The French professional reasons in French categories. In France, a power of attorney is a mandate, and the Civil Code defines it in these terms: &#8220;Le mandat ou procuration est un acte par lequel une personne donne \u00e0 une autre le pouvoir de faire quelque chose pour le mandant et en son nom. Le contrat ne se forme que par l&#8217;acceptation du mandataire.&#8221; (<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006445236\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006445236\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 1984 of the Civil Code<\/a>). A bank clerk or notaire who sees an English-language deed, signed before an English certificate provider and registered by a foreign body, cannot verify by sight that it satisfies French conditions. Since Brexit, there is no European Union instrument smoothing this over, and many professionals default to the safe answer: no.<\/p>\n<p>The international picture contains a trap that even lawyers sometimes miss. There is a Hague Convention of 13 January 2000 on the International Protection of Adults, and France is a full party to it: the official HCCH status table records France as having signed on 13-VII-2001 and ratified on 18-IX-2008, with entry into force on 1-I-2009. The United Kingdom also appears on that table, with signature on 1-IV-2003, ratification on 5-XI-2003 and the same 1-I-2009 entry into force. But the British ratification carries a decisive limitation, stated in the official notification, which limits the British ratification to Scotland (<a href=\"https:\/\/www.hcch.net\/en\/instruments\/conventions\/status-table\/?cid=71\">HCCH status table<\/a>). An LPA made under the law of England and Wales therefore cannot directly invoke Articles 15 and 16 of that Convention as treaty law against a French administration. Scotland-only ratification means the treaty route that works for a Swiss or Scottish mandate is not open, as of right, to an English one. Any adviser who tells you &#8220;the Hague Convention sorts it out&#8221; without mentioning this limit has missed the central difficulty of your case.<\/p>\n<p>That does not mean the Convention is useless to you. The French Cour de cassation applied it in a leading 2021 decision, and that decision remains the closest binding guidance on how French courts receive a foreign protective mandate. The case concerned a Swiss mandate of incapacity, not an English LPA, but the court&#8217;s reasoning lays down the method. The judges recalled Article 15 of the Convention in these terms: &#8220;L&#8217;existence, l&#8217;\u00e9tendue, la modification et l&#8217;extinction des pouvoirs de repr\u00e9sentation conf\u00e9r\u00e9s par un adulte, soit par un accord soit par un acte unilat\u00e9ral, pour \u00eatre exerc\u00e9s lorsque cet adulte sera hors d&#8217;\u00e9tat de pourvoir \u00e0 ses int\u00e9r\u00eats, sont r\u00e9gies par la loi de l&#8217;Etat de la r\u00e9sidence habituelle de l&#8217;adulte au moment de l&#8217;accord ou de l&#8217;acte unilat\u00e9ral, \u00e0 moins qu&#8217;une des lois mentionn\u00e9es au paragraphe 2 ait \u00e9t\u00e9 d\u00e9sign\u00e9e express\u00e9ment par \u00e9crit.&#8221; And they added the second half of the mechanism: &#8220;Les modalit\u00e9s d&#8217;exercice de ces pouvoirs de repr\u00e9sentation sont r\u00e9gies par la loi de l&#8217;Etat o\u00f9 ils sont exerc\u00e9s.&#8221; (<a href=\"https:\/\/www.courdecassation.fr\/decision\/601427b4d881275fcb354460\">Cour de cassation, First Civil Chamber, 27 January 2021, No. 19-15.059<\/a>). Validity is governed by the law of your habitual residence when you signed; only the modalities of exercise are governed by French law. For an English LPA signed while you lived in England, that points to English law deciding whether the document is validly created, with France controlling only how it is put into action.<\/p>\n<h3>B. The French instruments your bank expects instead: the mandat de protection future and the habilitation familiale<\/h3>\n<p>To understand what the bank wants, you need to meet the two French protective tools, because every French professional compares your LPA to them. The first is the mandat de protection future, literally a &#8220;mandate for future protection&#8221;: your own advance appointment of someone to represent you if you lose capacity. The Civil Code opens it widely: &#8220;Toute personne majeure ou mineure \u00e9mancip\u00e9e ne faisant pas l&#8217;objet d&#8217;une mesure de tutelle ou d&#8217;une habilitation familiale peut charger une ou plusieurs personnes, par un m\u00eame mandat, de la repr\u00e9senter pour le cas o\u00f9, pour l&#8217;une des causes pr\u00e9vues \u00e0 l&#8217;article 425 , elle ne pourrait plus pourvoir seule \u00e0 ses int\u00e9r\u00eats.&#8221; (<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000031345528\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000031345528\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 477 of the Civil Code<\/a>). Note the final sentence of that article&#8217;s first passages as implemented in practice: &#8220;Le mandat est conclu par acte notari\u00e9 ou par acte sous seing priv\u00e9.&#8221; A mandat can be made either as a notarial deed (acte notari\u00e9, drawn up by a notaire) or as a private signed deed (acte sous seing priv\u00e9). And the general law of mandate applies behind it: &#8220;Le mandat de protection future est soumis aux dispositions des articles 1984 \u00e0 2010 qui ne sont pas incompatibles avec celles de la pr\u00e9sente section.&#8221; (<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006427848\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006427848\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 478 of the Civil Code<\/a>).<\/p>\n<p>The mandat does nothing until it is activated, and activation is a formal procedure at the court office. Article 481 provides: &#8220;Le mandat prend effet lorsqu&#8217;il est \u00e9tabli que le mandant ne peut plus pourvoir seul \u00e0 ses int\u00e9r\u00eats.&#8221; The attorney must then produce evidence at the greffe, the clerk&#8217;s office of the court: the text continues, &#8220;le mandataire produit au greffe du tribunal judiciaire le mandat et un certificat m\u00e9dical \u00e9manant d&#8217;un m\u00e9decin choisi sur la liste mentionn\u00e9e \u00e0 l&#8217;article 431 \u00e9tablissant que le mandant se trouve dans l&#8217;une des situations pr\u00e9vues \u00e0 l&#8217;article 425 .&#8221; The tribunal judiciaire is the main local civil court, and the medical certificate must come from a doctor on the official court list, not from any GP. &#8220;Le greffier vise le mandat et date sa prise d&#8217;effet, puis le restitue au mandataire.&#8221; (<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000039367163\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000039367163\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 481 of the Civil Code<\/a>). The greffier, the court clerk, checks the papers, endorses the mandate with a visa, dates its taking effect and hands it back. That visa is the physical proof French banks recognise.<\/p>\n<p>The official service-public.fr guidance describes the same appointment in practical terms. both the mandator and the attorney attend the appointment in person at the protected-adults department of the court greffe for the district where the mandant lives (<a href=\"https:\/\/www.service-public.fr\/particuliers\/vosdroits\/F16670\">service-public.fr<\/a>). If the protected person&#8217;s state of health makes attendance impossible, the medical certificate covers that absence and notice is given by registered letter. At the end of a successful appointment, the clerk records that the mandate takes effect that day and stamps the visa on it (<a href=\"https:\/\/www.service-public.fr\/particuliers\/vosdroits\/F16670\">service-public.fr<\/a>). And crucially for refusal cases: where the activation conditions are not met, the clerk may refuse the visa (<a href=\"https:\/\/www.service-public.fr\/particuliers\/vosdroits\/F16670\">service-public.fr<\/a>). The clerk can refuse the visa. The notaires&#8217; own national site structures its guidance the same way, with sections on the notarial versus private-deed forms and on the mandate as an alternative to curatorship or tutorship, which confirms where French professionals look first: a French-form mandate with a clerk&#8217;s visa.<\/p>\n<p>The second tool is the habilitation familiale, the &#8220;family authorisation&#8221;: a lighter court measure letting close relatives represent the vulnerable person. Article 494-1 states that &#8220;le juge des tutelles peut habiliter une ou plusieurs personnes choisies parmi ses ascendants ou descendants, fr\u00e8res et s\u0153urs ou, \u00e0 moins que la communaut\u00e9 de vie ait cess\u00e9 entre eux, le conjoint, le partenaire auquel elle est li\u00e9e par un pacte civil de solidarit\u00e9 ou le concubin \u00e0 la repr\u00e9senter, \u00e0 l&#8217;assister dans les conditions pr\u00e9vues \u00e0 l&#8217;article 467 ou \u00e0 passer un ou des actes en son nom&#8221;. (<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000038311073\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000038311073\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 494-1 of the Civil Code<\/a>). The juge des tutelles is the specialised protection judge attached to the local court. Both tools respond to the same trigger, defined by Article 425: &#8220;Toute personne dans l&#8217;impossibilit\u00e9 de pourvoir seule \u00e0 ses int\u00e9r\u00eats en raison d&#8217;une alt\u00e9ration, m\u00e9dicalement constat\u00e9e, soit de ses facult\u00e9s mentales, soit de ses facult\u00e9s corporelles de nature \u00e0 emp\u00eacher l&#8217;expression de sa volont\u00e9 peut b\u00e9n\u00e9ficier d&#8217;une mesure de protection juridique pr\u00e9vue au pr\u00e9sent chapitre.&#8221; (<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006427435\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006427435\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 425 of the Civil Code<\/a>).<\/p>\n<p>Control and challenge are built into the French system, and this is where your leverage lies if a mandate is misused or wrongly blocked. An implemented mandate ends, among other cases, by &#8220;Sa r\u00e9vocation prononc\u00e9e par le juge des tutelles \u00e0 la demande de tout int\u00e9ress\u00e9&#8221;, and more generally, &#8220;Tout int\u00e9ress\u00e9 peut saisir le juge des tutelles aux fins de contester la mise en oeuvre du mandat ou de voir statuer sur les conditions et modalit\u00e9s de son ex\u00e9cution.&#8221; (<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000038311081\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000038311081\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 483<\/a> and <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006427886\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006427886\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 484 of the Civil Code<\/a>). Any interested person, which includes you, your attorney, your children or the bank itself, can go to the protection judge. The 2021 Cour de cassation decision confirms this safety net at the highest level: where a foreign mandate is not exercised in the adult&#8217;s interests, the authorities of the state of habitual residence may suspend or revoke it, and &#8220;cette action, selon les articles 483 et 484 du code civil, \u00e9tant ouverte \u00e0 tout int\u00e9ress\u00e9.&#8221; (<a href=\"https:\/\/www.courdecassation.fr\/decision\/601427b4d881275fcb354460\">Cour de cassation, First Civil Chamber, 27 January 2021, No. 19-15.059<\/a>) No foreign document operates in France without judicial oversight available to the family.<\/p>\n<h2>II. Getting Your English LPA Accepted in Practice, and Challenging a Refusal<\/h2>\n<h3>A. Build the acceptance file: registration, apostille, translation, medical certificate and the court clerk&#8217;s visa<\/h3>\n<p>Acceptance is won by presenting the right file, in the right order, to each French interlocutor. Think of it as five layers, each answering one objection the bank or notaire is entitled to raise.<\/p>\n<p>First, prove the LPA exists and is registered. Produce the LPA itself plus the Office of the Public Guardian registration certificate, and be ready to explain the English timeline: registration takes 8 to 10 weeks and the \u00a392 fee, so a recently signed but unregistered LPA is not yet usable. If capacity is already borderline, this is also the moment to check that the LPA was registered while the donor still had capacity; a bank that doubts this will ask, and you should have the answer ready.<\/p>\n<p>Second, legalise the English documents for use abroad. Both the United Kingdom and France are parties to the Hague Convention of 5 October 1961 abolishing the requirement of legalisation for foreign public documents, which is why the apostille exists. The Cour de cassation states the rule plainly: &#8220;Vu la Convention de La Haye du 5 octobre 1961 supprimant l&#8217;exigence de la l\u00e9galisation des actes publics \u00e9trangers&#8221;, and &#8220;les actes publics qui ont \u00e9t\u00e9 \u00e9tablis sur le territoire d&#8217;un Etat contractant et qui doivent \u00eatre produits sur le territoire d&#8217;un autre Etat contractant, doivent \u00eatre rev\u00eatus de l&#8217;apostille, d\u00e9livr\u00e9e par l&#8217;autorit\u00e9 comp\u00e9tente de l&#8217;Etat d&#8217;o\u00f9 \u00e9mane le document&#8221; (<a href=\"https:\/\/www.courdecassation.fr\/decision\/5fca6d0a7e0ae057f1fa44ef\">Cour de cassation, First Civil Chamber, 13 June 2019, No. 18-50.055<\/a>). In practice, that means the Foreign, Commonwealth and Development Office Legalisation Office in the United Kingdom. Its official guidance explains that the office compares signatures, stamps and seals against its own records before attaching the apostille certificate (<a href=\"https:\/\/www.gov.uk\/get-document-legalised\">official guidance<\/a>). Have any solicitor-certified copy of the LPA apostilled first, then the registration certificate if needed. Order a paper apostille rather than an electronic one: the official guidance itself warns that a paper apostille may be needed where the receiving party asks for paper (<a href=\"https:\/\/www.gov.uk\/get-document-legalised\">official guidance<\/a>), and French banks, notaires and court clerks invariably want paper.<\/p>\n<p>Third, have everything translated by a sworn translator. A traducteur asserment\u00e9 is a translator sworn before a French cour d&#8217;appel, whose stamp French courts and notaires accept. Commission a full translation of the LPA, the registration certificate and the apostille, bound to the English originals. Our firm recommends this even where a bilingual bank officer claims to understand English: the file will travel to the greffe, to the notaire and possibly to the judge, and only a sworn translation travels everywhere without discussion.<\/p>\n<p>Fourth, obtain the French medical certificate. This is the piece British families most often get wrong, because an English GP letter does not satisfy the French rule. Article 481 requires a certificate from a doctor on the Article 431 court list, establishing one of the Article 425 situations. Your French m\u00e9decin traitant, your regular GP, can direct you to a listed specialist, and the protection judge&#8217;s office at the tribunal judiciaire publishes the list. Get this certificate early: without it, no visa procedure can start, and the whole file stalls.<\/p>\n<p>Fifth, present the file at the greffe for a visa, following the same procedural path as a French mandat. The Code of Civil Procedure sets out the clerk&#8217;s checks: the attorney appears in person, files the original or an authenticated copy of the mandate with identity documents, the medical certificate and proof of the mandator&#8217;s habitual residence, and the clerk verifies the papers. (<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000050505856\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000050505856\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Articles 1258<\/a> and <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000050505844\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000050505844\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">1258-2 of the Code of Civil Procedure<\/a>). Then, as <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000050505840\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000050505840\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 1258-3 of the Code of Civil Procedure<\/a> states: &#8220;Si l&#8217;ensemble des conditions requises est rempli, le greffier, apr\u00e8s avoir paraph\u00e9 chaque page du mandat, mentionne, en fin d&#8217;acte, que celui-ci prend effet \u00e0 compter de la date de sa pr\u00e9sentation au greffe, y appose son visa et le restitue au mandataire, accompagn\u00e9 des pi\u00e8ces produites.&#8221; (<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000050505840\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000050505840\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 1258-3 of the Code of Civil Procedure<\/a>). Initial each page, date the taking effect, stamp the visa, hand it back: that visa is the document the bank can file and rely on.<\/p>\n<p>Here the 2021 decision gives you your strongest argument if the clerk hesitates over the English form of your LPA. A short petition exhibiting the visaed LPA, the account statements and the bank&#8217;s written refusal normally concentrates minds; banks answer judges faster than they answer families. Keep a parallel complaint to the bank&#8217;s m\u00e9diateur, the independent ombudsman, running at the same time, since compensation for late execution can follow through that channel while the judge secures access itself.<\/p>\n<p>In parallel, and this is our firm&#8217;s standard advice for British clients with substantial French assets, sign a French mandat de protection future as a belt-and-braces measure. Nothing prevents you from holding both instruments: the English LPA for English assets and as evidence of your wishes, the French mandat for French banks and notaires. Choose the notarial form rather than the private-deed form for cross-border weight, name the same attorney, and expressly state that the French mandate complements rather than revokes the English LPA. If capacity is already lost, this door is closed and the fallback measures take over: the habilitation familiale for a spouse, partner, child or sibling, or a full sauvegarde de justice, curatelle or tutelle ordered by the judge. Remember also the boundary that surprises many families: no mandate survives death. Article 483 ends an implemented mandat on &#8220;Le d\u00e9c\u00e8s de la personne prot\u00e9g\u00e9e&#8221;, and your English LPA likewise stops at death, at which point the succession, the notaire and the inheritance rules take over entirely.<\/p>\n<p>For readers in Paris and the Ile-de-France, three local points matter. Second, sworn translators are listed by the Paris cour d&#8217;appel and the demand from British families is steady, so commission the translation early rather than in the week of completion. Third, Paris banks&#8217; legal departments know the apostille system well but insist on paper apostilles with original ink stamps; an electronic apostille on a PDF will be sent back. Build in the English-side delays too: OPG registration and FCDO legalisation each take weeks, and the French medical certificate and greffe appointment add more. Start the file while the donor can still participate, because every French route is simpler, cheaper and faster before capacity is lost.<\/p>\n<h2>Conclusion<\/h2>\n<p>A French bank that rejects your English financial LPA is not necessarily acting unlawfully, but it is very often acting on an incomplete view of the law. Your LPA, validly made and registered in England, does not evaporate at the French border; it meets a system that receives foreign mandates through its own procedural gates, above all the court clerk&#8217;s visa, and that cannot impose French substantive conditions English law never required. The Scotland-only limit on the Hague Convention makes the argument harder than for a Swiss or Scottish mandate, which is exactly why the paperwork must be flawless: registered LPA, paper apostille, sworn translation, listed-doctor medical certificate, greffe visa. Where refusal persists, the protection judge decides, at any interested person&#8217;s request, and a parallel French mandat de protection future removes the problem at its root for the future.
