If you are coming from the United Kingdom with a skilled job, a group posting, a research contract or a serious business project, the card you are looking for is no longer called only a <em>passeport talent<\/em> (talent passport). The <em>Code de l&#8217;entr\u00e9e et du s\u00e9jour des \u00e9trangers et du droit d&#8217;asile<\/em> (CESEDA, the French code on the entry and stay of foreigners) now issues a multi-year <em>carte de s\u00e9jour pluriannuelle<\/em> (residence card) with a \u201ctalent\u201d mention: most often <em>talent-salari\u00e9 qualifi\u00e9<\/em> (qualified-employee talent). Consulates, older court judgments and some ANEF screens still say \u201cpasseport talent\u201d. The substance is the same family of cards: up to four years, a right to work in the activity that justified the card, and a simplified <em>talent-famille<\/em> (talent-family) route for your spouse and children, without going through <em>regroupement familial<\/em> (family reunification).<\/p>\n<p>This note is for the British reader who has a French job offer, a UK intra-group mission, a research host agreement or a project, and who needs to know whether the talent card actually fits, what salary line the <em>pr\u00e9fecture<\/em> (the local State authority) or the consulate will apply in 2026, and what to do if the file is refused or wrapped in an <em>obligation de quitter le territoire fran\u00e7ais<\/em> (OQTF, an obligation to leave French territory). It is not for Withdrawal Agreement residents who already hold an Article 50 TEU card, and it is not a substitute for the ordinary <em>salari\u00e9<\/em> (employee) work-authorisation route described in our note on a <a href=\"https:\/\/kohenavocats.fr\/en\/2026\/09\/10\/british-job-offer-france-salarie-work-authorisation-refusal-challenge-brexit\/\">British job offer and a salari\u00e9 work authorisation<\/a>. The talent card is attractive precisely because the employer does not apply for a separate work permit. That advantage disappears if the diploma, the contract or the annual gross pay is short of the legal tests.<\/p>\n<p>Service-public, the official French government portal, updated its \u201ccarte talent\u201d fiche on 1 June 2026. The salary line it now publishes for the qualified-employee routes is \u20ac39,582 gross a year. Article R. 421-16 A of the CESEDA, in force since 16 June 2025, says that the L. 421-9 floor is annual gross pay at least equal to the reference average annual gross salary fixed by the immigration minister. Below that line, or without a nationally recognised master\u2019s-level diploma on the main route, the file fails even if the employer is real. The courts have said so. The rest of this article sets out which mention to tick, how to file from the UK or from France, and how a refusal is challenged in Paris and \u00cele-de-France.<\/p>\n<h2>I. Which French talent card can a British citizen get after Brexit?<\/h2>\n<h3>A. Does the talent-salari\u00e9 qualifi\u00e9 card fit your UK job offer and the \u20ac39,582 salary line?<\/h3>\n<p>Article <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000049052463\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000049052463\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">L. 421-9 of the CESEDA<\/a> is the core text. In the version in force it states: \u00ab Sous r\u00e9serve de justifier du respect d&#8217;un seuil de r\u00e9mun\u00e9ration fix\u00e9 par d\u00e9cret en Conseil d&#8217;Etat, se voit d\u00e9livrer une carte de s\u00e9jour pluriannuelle portant la mention \u201c talent-salari\u00e9 qualifi\u00e9 \u201d d&#8217;une dur\u00e9e maximale de quatre ans, l&#8217;\u00e9tranger qui se trouve dans l&#8217;une des situations suivantes : 1\u00b0 Il exerce une activit\u00e9 professionnelle salari\u00e9e et a obtenu, dans un \u00e9tablissement d&#8217;enseignement sup\u00e9rieur habilit\u00e9 au plan national, un dipl\u00f4me au moins \u00e9quivalent au grade de master ou figurant sur une liste fix\u00e9e par d\u00e9cret ; 2\u00b0 Il est recrut\u00e9 dans une jeune entreprise innovante r\u00e9alisant des projets de recherche et de d\u00e9veloppement, d\u00e9finie \u00e0 l&#8217;article 44 sexies-0 A du code g\u00e9n\u00e9ral des imp\u00f4ts, ou dans une entreprise innovante reconnue par un organisme public pour exercer des fonctions en lien avec le projet de recherche et de d\u00e9veloppement de cette entreprise ou avec son d\u00e9veloppement \u00e9conomique, social, international et environnemental ; 3\u00b0 Il vient en France dans le cadre d&#8217;une mission entre \u00e9tablissements d&#8217;une m\u00eame entreprise ou entre entreprises d&#8217;un m\u00eame groupe et qui justifie, outre une anciennet\u00e9 professionnelle d&#8217;au moins trois mois dans le groupe ou l&#8217;entreprise \u00e9tabli hors de France, d&#8217;un contrat de travail conclu avec l&#8217;entreprise \u00e9tablie en France. \u00bb Three routes therefore sit under one mention. The first is the classic \u201cqualified employee\u201d: a French nationally accredited master\u2019s-level diploma (or a diploma on the decree list) plus a salaried contract. The second is recruitment into a young innovative company (<em>jeune entreprise innovante<\/em>, JEI) or a company recognised as innovative, in a role tied to its research or development. The third is an intra-group mission: at least three months\u2019 seniority in the group outside France and a contract with the French entity.<\/p>\n<p>The salary test is no longer a multiple of the SMIC (the French statutory minimum wage) for this mention. Article L. 421-8 sends the detail to a Conseil d&#8217;\u00c9tat decree: \u00ab Les conditions d&#8217;application des articles L. 421-9, L. 421-11 et L. 421-14 \u00e0 L. 421-21 sont fix\u00e9es par d\u00e9cret en Conseil d&#8217;Etat. \u00bb <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000049052400\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000049052400\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article L. 421-8 of the CESEDA<\/a>. Article <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000051738360\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000051738360\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">R. 421-16 A of the CESEDA<\/a>, in force since 16 June 2025, then states: \u00ab le seuil de r\u00e9mun\u00e9ration dont le respect doit \u00eatre justifi\u00e9 correspond \u00e0 une r\u00e9mun\u00e9ration annuelle brute au moins \u00e9gale au montant du salaire brut moyen annuel de r\u00e9f\u00e9rence fix\u00e9 par arr\u00eat\u00e9 du ministre en charge de l&#8217;immigration. \u00bb Service-public, verified on 1 June 2026, publishes that reference for each of the three L. 421-9 routes as a gross annual salary of \u20ac39,582, and adds that the employment contract must be for more than three months. That is the number a British applicant should put next to the gross annual pay in the French contract, not a UK P60, not a daily rate, and not a \u201cpackage\u201d of bonus and housing unless the contract itself treats those sums as salary.<\/p>\n<p>The Court of Appeal of Toulouse has shown how a short salary kills the file, even where the pr\u00e9fecture also misstates the rule. In <a href=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000053446863\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000053446863\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">CAA Toulouse, 4th chamber, 5 February 2026, no. 23TL02838<\/a>, a change-of-status request for a \u201cpasseport talent\u201d card was refused because the employer certificate showed \u20ac1,679 gross a month. The court, applying the version of article L. 421-9 then in force, held: \u00ab La r\u00e9mun\u00e9ration ainsi pr\u00e9vue \u00e9tait inf\u00e9rieure au seuil de r\u00e9mun\u00e9ration applicable fix\u00e9 par l&#8217;article D. 5221-21-1 du code du travail \u00e0 une fois et demie le montant de la r\u00e9mun\u00e9ration minimale mensuelle. Si Mme B&#8230; a pr\u00e9cis\u00e9 que son salaire correspondait \u00e0 un travail \u00e0 mi-temps, elle n&#8217;a cependant pas justifi\u00e9 de l&#8217;exercice d&#8217;un travail \u00e0 temps partiel en l&#8217;absence de production de son contrat de travail. En tout \u00e9tat de cause, les dispositions pr\u00e9cit\u00e9es du code du travail ne pr\u00e9voient pas une modulation du seuil de r\u00e9mun\u00e9ration applicable en fonction de la quotit\u00e9 de travail de l&#8217;\u00e9tranger salari\u00e9. \u00bb Two lessons survive the change of multiplier. First, the threshold is an annual (or, in the old text, monthly equivalent) floor; a part-time job that never reaches the annual figure does not pass by \u201cprorata temporis\u201d. Second, a pr\u00e9fecture error on the multiplier does not save a file that is still below the real floor. The same judgment added that a work authorisation was not required: \u00ab alors m\u00eame que, contrairement \u00e0 ce qu&#8217;elle a indiqu\u00e9 \u00e0 tort dans l&#8217;acte attaqu\u00e9, la production d&#8217;une autorisation de travail n&#8217;\u00e9tait pas requise pour la d\u00e9livrance du titre de s\u00e9jour sollicit\u00e9 \u00bb. That is the practical difference with the ordinary salari\u00e9 card: the talent-salari\u00e9 qualifi\u00e9 card is itself the authorisation to work in the job that justified it, and the employer is not sent through the labour-market test.<\/p>\n<p>Service-public is aligned with that last point: the \u201ctalent-salari\u00e9 qualifi\u00e9\u201d card \u201cvous autorise \u00e0 exercer une activit\u00e9 professionnelle salari\u00e9e\u201d and \u201cVotre employeur n&#8217;a pas \u00e0 demander d&#8217;autorisation de travail\u201d. The card\u2019s duration follows the contract, capped at four years. Article <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000051747392\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000051747392\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">R. 421-12 of the CESEDA<\/a> provides: \u00ab La carte de s\u00e9jour pluriannuelle portant la mention &#8221; talent-salari\u00e9 qualifi\u00e9 &#8221; pr\u00e9vue \u00e0 l&#8217;article L. 421-9 , la carte de s\u00e9jour pluriannuelle portant la mention &#8221; passeport talent-carte bleue europ\u00e9enne &#8221; pr\u00e9vue \u00e0 l&#8217;article L. 421-11 , la carte de s\u00e9jour pluriannuelle portant la mention &#8221; talent-profession m\u00e9dicale et de la pharmacie &#8221; pr\u00e9vue \u00e0 l&#8217;article L. 421-13-1 et la carte de s\u00e9jour pluriannuelle portant la mention &#8221; passeport talent-chercheur &#8221; ou &#8221; passeport talent-chercheur-programme de mobilit\u00e9 &#8221; pr\u00e9vue \u00e0 l&#8217;article L. 421-14 ont une dur\u00e9e de validit\u00e9 identique \u00e0 celle du contrat de travail ou de la convention d&#8217;accueil pr\u00e9sent\u00e9s \u00e0 l&#8217;appui de la demande de titre de s\u00e9jour, dans la limite d&#8217;une dur\u00e9e de quatre ans. \u00bb A twelve-month contract therefore yields a twelve-month card, not a four-year card. Applicants who assume \u201ctalent means four years\u201d are reading the ceiling, not the grant.<\/p>\n<p>Article L. 421-9 also protects the holder who is involuntarily unemployed at renewal, but only on the first two routes (qualified employee and innovative company), not on the intra-group mission. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000049052463\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000049052463\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article L. 421-9<\/a> continues: \u00ab Par d\u00e9rogation \u00e0 l&#8217;article L. 433-1, lorsque l&#8217;\u00e9tranger b\u00e9n\u00e9ficiaire de cette carte dans les conditions pr\u00e9vues aux 1\u00b0 et 2\u00b0 du pr\u00e9sent article se trouve involontairement priv\u00e9 d&#8217;emploi \u00e0 la date du renouvellement de sa carte, celle-ci est renouvel\u00e9e pour une dur\u00e9e \u00e9quivalente \u00e0 celle des droits qu&#8217;il a acquis \u00e0 l&#8217;allocation d&#8217;assurance mentionn\u00e9e \u00e0 l&#8217;article L. 5422-1 du code du travail. \u00bb Article <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000051747371\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000051747371\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">R. 421-15 of the CESEDA<\/a> adds that those cards \u201cne peuvent \u00eatre retir\u00e9es au motif que l&#8217;\u00e9tranger s&#8217;est trouv\u00e9, autrement que de son fait, priv\u00e9 d&#8217;emploi\u201d. Losing the French job is therefore not an automatic withdrawal if the loss is not your doing; it is still a renewal file, with unemployment-insurance rights to prove. A British employee who resigns to go back to a UK remote role, or who never had a genuine French contract, is in a different position.<\/p>\n<p>The diploma limb is as unforgiving as the salary limb. Article L. 421-9, 1\u00b0, requires a diploma \u201cau moins \u00e9quivalent au grade de master\u201d obtained \u201cdans un \u00e9tablissement d&#8217;enseignement sup\u00e9rieur habilit\u00e9 au plan national\u201d, or a diploma on a list fixed by decree. A UK master\u2019s from a British university is not, without more, a diploma obtained in a French nationally accredited institution. Equivalence is a separate, documented question. Service-public\u2019s list of French examples (DEA, DESS, dipl\u00f4me d&#8217;ing\u00e9nieur, certain Conf\u00e9rence des grandes \u00e9coles labels) is a French list. If your only degree is a UK MSc, you either need a recognised equivalence on the decree list or you should be looking at another mention: the EU Blue Card route in article L. 421-11, which accepts three years of higher education or five years\u2019 comparable experience, or the project-holder route in article L. 421-16. Do not force a UK degree into L. 421-9, 1\u00b0, because the form looks similar.<\/p>\n<p>The intra-group mission (L. 421-9, 3\u00b0) is the route many British intra-company transferees reach for. It still needs the \u20ac39,582 line, a French contract, and three months\u2019 seniority in the group outside France. It is not the ICT \u201csalari\u00e9 d\u00e9tach\u00e9\u201d card of articles L. 421-26 and following, which is a different, posted-worker scheme. Mixing the two in one ANEF file is a common reason for a silence or a refusal. If the UK entity is merely paying you while you live in France without a French contract, you are not on L. 421-9, 3\u00b0. You may be on a visitor card that forbids work, which is the problem described in our note on the <a href=\"https:\/\/kohenavocats.fr\/en\/2026\/09\/11\/british-visitor-card-france-work-auto-entrepreneur-change-status-challenge-brexit\/\">British visitor card, remote work and change of status<\/a>.<\/p>\n<h3>B. Which other talent mention should you actually tick \u2014 carte bleue, project holder, company officer or talent-famille?<\/h3>\n<p>The \u201ctalent\u201d family is a cluster of mentions, not one card. Ticking the wrong one is not a clerical slip: the pr\u00e9fet or the consul decides on the legal basis you invoked, and is not required to recast your file onto another article. <a href=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000053446863\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000053446863\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">CAA Toulouse no. 23TL02838<\/a> said so: \u00ab Lorsqu&#8217;il est saisi d&#8217;une demande de d\u00e9livrance d&#8217;un titre de s\u00e9jour sur le fondement de l&#8217;une des dispositions du code de l&#8217;entr\u00e9e et du s\u00e9jour des \u00e9trangers et du droit d&#8217;asile, le pr\u00e9fet n&#8217;est pas tenu, en l&#8217;absence de dispositions expresses en ce sens, d&#8217;examiner d&#8217;office si l&#8217;int\u00e9ress\u00e9 peut pr\u00e9tendre \u00e0 une autorisation de s\u00e9jour sur le fondement d&#8217;une autre disposition de ce code. \u00bb If you asked for talent-salari\u00e9 qualifi\u00e9, a better Blue Card or project-holder case is not examined of the administration\u2019s own motion.<\/p>\n<p>The EU Blue Card, now labelled <em>talent-carte bleue europ\u00e9enne<\/em>, sits in <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000051562061\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000051562061\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">article L. 421-11 of the CESEDA<\/a>: \u00ab L&#8217;\u00e9tranger qui occupe un emploi hautement qualifi\u00e9 pendant une dur\u00e9e \u00e9gale ou sup\u00e9rieure \u00e0 six mois et justifie d&#8217;un dipl\u00f4me sanctionnant au moins trois ann\u00e9es d&#8217;\u00e9tudes sup\u00e9rieures ou d&#8217;une exp\u00e9rience professionnelle d&#8217;au moins cinq ans d&#8217;un niveau comparable ou qui a acquis, dans des conditions, tenant notamment \u00e0 la profession concern\u00e9e, d\u00e9termin\u00e9es par d\u00e9cret en Conseil d&#8217;Etat, au moins trois ans d&#8217;exp\u00e9rience professionnelle pertinente au cours des sept ann\u00e9es pr\u00e9c\u00e9dant la demande se voit d\u00e9livrer une carte de s\u00e9jour pluriannuelle portant la mention \u201c talent-carte bleue europ\u00e9enne \u201d d&#8217;une dur\u00e9e \u00e9gale \u00e0 celle figurant sur le contrat de travail, dans la limite de quatre ans lorsque le contrat est conclu pour une dur\u00e9e d&#8217;au moins deux ans, sous r\u00e9serve de justifier du respect d&#8217;un seuil de r\u00e9mun\u00e9ration fix\u00e9 par d\u00e9cret en Conseil d&#8217;Etat et dont le montant ne peut \u00eatre inf\u00e9rieur \u00e0 1,5 fois le salaire annuel brut moyen. \u00bb Three differences with L. 421-9 matter for a British hire. The job must be \u201chautement qualifi\u00e9\u201d for at least six months. The diploma can be three years of higher education, not a French master\u2019s obtained in a nationally accredited institution. The pay floor cannot be lower than 1.5 times average annual gross salary, which is a different legal minimum from the \u20ac39,582 L. 421-9 reference published by Service-public. Self-employed invoices and a self-signed employment certificate do not prove a highly qualified employment. CAA Nantes made that point on a long-stay visa for a \u201cpasseport talent-carte bleue europ\u00e9enne\u201d in <a href=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000054148407\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000054148407\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">CAA Nantes, 5th chamber, 26 May 2026, no. 25NT02178<\/a>: \u00ab Cependant, les pi\u00e8ces pr\u00e9sent\u00e9es ne permettent pas d&#8217;\u00e9tablir qu&#8217;il occuperait un emploi hautement qualifi\u00e9 au sens de la disposition pr\u00e9cit\u00e9e. Les quelques factures \u00e9tablies \u00e0 compter de 2020 au nom de sa soci\u00e9t\u00e9, et non acquitt\u00e9es, ainsi que le certificat de travail de 2023 qu&#8217;il a sign\u00e9 le d\u00e9signant comme salari\u00e9 de sa soci\u00e9t\u00e9 n&#8217;\u00e9tablissent pas qu&#8217;il occupe un emploi hautement qualifi\u00e9 dans son pays au sens de la disposition pr\u00e9cit\u00e9e. \u00bb A British contractor who incorporates a one-person company and then \u201cemploys\u201d himself will meet the same wall.<\/p>\n<p>The project-holder card is <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000049052499\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000049052499\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">article L. 421-16 of the CESEDA<\/a>: \u00ab Se voit d\u00e9livrer une carte de s\u00e9jour pluriannuelle portant la mention \u201c talent-porteur de projet \u201d d&#8217;une dur\u00e9e maximale de quatre ans, l&#8217;\u00e9tranger qui se trouve dans l&#8217;une des situations suivantes : 1\u00b0 Ayant obtenu un dipl\u00f4me \u00e9quivalent au grade de master ou pouvant attester d&#8217;une exp\u00e9rience professionnelle d&#8217;au moins cinq ans d&#8217;un niveau comparable, il justifie d&#8217;un projet \u00e9conomique r\u00e9el et s\u00e9rieux et cr\u00e9e une entreprise en France ; 2\u00b0 Il justifie d&#8217;un projet \u00e9conomique innovant, reconnu par un organisme public ; 3\u00b0 Il proc\u00e8de \u00e0 un investissement \u00e9conomique direct en France. \u00bb This is not an auto-entrepreneur registration and it is not a visitor card with a side hustle. The 1\u00b0 limb needs a real and serious economic project and the creation of a company in France. The 2\u00b0 limb needs public recognition of an innovative project. None of it is the visitor card. None of it is a Withdrawal Agreement renewal. Choose the mention that matches the facts you can prove, not the mention that sounds the most flattering on a UK LinkedIn page.<\/p>\n<h2>II. How do you apply and how do you challenge a refusal?<\/h2>\n<h3>A. Do you apply from the UK for a long-stay visa or from France on ANEF?<\/h3>\n<p>If you are still in the United Kingdom, you do not start at the French pr\u00e9fecture. Service-public describes an immediate digital filing attestation, then a pr\u00e9fecture message when the card is available, then payment of fiscal stamps. Article <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000053547093\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000053547093\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">L. 436-1 of the CESEDA<\/a> sets the tax: \u00ab I. &#8211; La premi\u00e8re d\u00e9livrance d&#8217;un titre de s\u00e9jour donne lieu \u00e0 la perception d&#8217;une taxe dont le montant est fix\u00e9 \u00e0 300 euros. \u00bb Renewal is \u00ab 200 euros \u00bb under II of the same article. Service-public\u2019s \u20ac350 figure for a first talent card is that \u20ac300 tax plus a \u20ac50 <em>droit de timbre<\/em> (stamp duty). Article L. 436-1, IV, also charges the corresponding tax when a long-stay visa itself stands in for the card. Keep the payment receipt; it is asked for when the card is collected.<\/p>\n<p>Documents follow the mention. For talent-salari\u00e9 qualifi\u00e9, Service-public\u2019s 1 June 2026 fiche requires proof of the master\u2019s-level diploma (or the innovative-company or intra-group facts), the employment contract of more than three months at or above \u20ac39,582, identity, address, and a compliant e-photo. A UK degree should travel with an apostille and, where you rely on equivalence, the equivalence decision, not a self-made translation. A UK contract governed by English law should be accompanied by a French contract or a clear French-language statement of the gross annual salary and the place of work in France. CAA Toulouse treated an employer certificate of \u20ac1,679 a month as the salary \u201cpr\u00e9vue\u201d; the court did not rewrite it into a full-time equivalent. Put the real annual gross in the document the pr\u00e9fecture will read.<\/p>\n<p>If you are already in France on another card, this is a <em>changement de statut<\/em> (change of status), not a first admission. A visitor card is a particularly poor launching pad, because it is issued against an undertaking not to work. A student card can lead to talent-salari\u00e9 qualifi\u00e9 if the French master\u2019s and the salary are there, or to the \u201crecherche d&#8217;emploi ou cr\u00e9ation d&#8217;entreprise\u201d card under article L. 422-8, which Toulouse recalled the pr\u00e9fet need not examine of his own motion. A British employee already on a salari\u00e9 card may switch to talent if the new contract and diploma fit, and the point of doing so is the multi-year duration and the family card. Do not let the old card expire while ANEF is pending without a filing attestation in your pocket.<\/p>\n<p>A consular visa can be refused even when the paper file looks complete. In the March case the <em>Commission de recours contre les d\u00e9cisions de refus de visa d&#8217;entr\u00e9e en France<\/em> (CRRV, the visa-refusal review commission) had relied on a risk of diversion of the visa\u2019s purpose; the applicant\u2019s Moroccan company and a thin French mandate did not establish a genuine officer posting. In the May case the commission had adopted the consulate\u2019s view that the professional criteria were not met in the absence of the expected diploma, and the court held that unpaid invoices and a self-signed employment certificate did not prove highly qualified employment. A British applicant should treat the France-Visas file as evidence of a real French activity, not as a travel document.<\/p>\n<h3>B. How do you challenge a consulate, CRRV or pr\u00e9fecture refusal, including an OQTF, in Paris and \u00cele-de-France?<\/h3>\n<p>A refusal of the card is a motivated decision. Involuntary unemployment is carved out for the L. 421-9, 1\u00b0 and 2\u00b0 cards by article R. 421-15, as already quoted.<\/p>\n<p>Service-public, on both the talent fiche (1 June 2026) and the talent-famille fiche (1 May 2026), draws a sharp line between a notified refusal and silence. A notified refusal is usually accompanied by an OQTF fixing the country of return. Silence for four months is an implicit refusal; from that date you have two months to bring an administrative appeal (<em>recours gracieux<\/em> to the pr\u00e9fet and\/or <em>recours hi\u00e9rarchique<\/em> to the interior minister) and\/or a court challenge. Article L. 612-2 allows the administration to refuse any voluntary departure where, among other cases, the stay application was manifestly unfounded or fraudulent, or there is a risk of absconding. Do not file a pr\u00e9fecture ANEF as a substitute for a CRRV challenge, and do not wait for an OQTF that will never come because you are still in the United Kingdom. The Nantes court will look at whether the professional criteria of the mention you ticked were met, and it will apply the wide power of appreciation on diversion of purpose. Rebuild the evidence: group seniority, real French contract, salary on the correct floor, diploma, and a mandate that is not a travel convenience.<\/p>\n<p>In Paris the competent authority on an in-country file is the Police Prefect, not the pr\u00e9fet of a suburban d\u00e9partement, if your residence is in Paris. The court that follows is the tribunal administratif of Paris, Montreuil, Melun, Cergy-Pontoise or Versailles, depending on the authority that signed. A British family living in the 8th arrondissement with a Neuilly employer still files according to the place of residence, not the office address. Bring the filing attestation, the contract, the payslips if any, the diploma, and the refusal letter to the first meeting. If the only defect is a salary just under \u20ac39,582, a new contract at the legal line and a fresh filing will often be cleaner than litigating a file that the court can only annul or reject. If the pr\u00e9fecture demanded a work authorisation that article L. 421-9 does not require, Toulouse 23TL02838 is the case to put in the submissions: the court still dismissed the appeal because the salary itself was short, but it recorded the work-authorisation demand as wrong. An error that did not affect the outcome does not win the case. An error that was the sole ground does.<\/p>\n<p>A long-stay visa refused in London or Edinburgh is not cured by entering Schengen as a visitor and filing ANEF from a holiday let. That path collides with the 90\/180 rule and with the requirement of a long-stay visa in article L. 312-2. The lawful paths are a proper talent visa from the UK, or a change of status if you already hold a valid French residence card. A UK master\u2019s is not automatically the French nationally accredited master\u2019s of L. 421-9, 1\u00b0. The Blue Card, the project-holder card, the company-officer card (three times annual SMIC under R. 421-37) and the talent-famille card of article L. 421-22 are different legal bases. CAA Toulouse no. 23TL02838 shows that a salary below the floor ends the case and that the pr\u00e9fet need not recast your file onto another article. CAA Nantes nos. 24NT02851 and 25NT02178 show that a consulate and the CRRV may refuse a talent visa for diversion of purpose or for failure to prove highly qualified employment. From the UK, article L. 312-2 and article R. 421-11 put the grant in the consul\u2019s hands. From France, ANEF and the pr\u00e9fet of residence, or the Police Prefect in Paris, decide. A notified refusal often carries an OQTF under articles L. 611-1 and L. 614-1; the court deadline is the special L. 911-1 deadline stated on the letter, not a guessed two months.
