A neighbour then said that a French <em>auto-entrepreneur<\/em> registration (the micro-business scheme run through URSSAF, the social-security collection body) would let you invoice a few clients, or your UK employer left you on payroll to work from France. Since 1 January 2021 a British passport no longer carries a right to work in France. The visitor card is the opposite of a work permit: it is issued only if you can live on your own resources and if you undertake not to exercise any professional activity in France.<\/p>\n<p>This note is for the British reader already in France after Brexit on a visitor card, or about to sign the honour declaration, who has started invoicing, registered with URSSAF, accepted a UK remote role, or received a refusal of change of status. It is not for Withdrawal Agreement residents living in France at the end of the transition period, who hold a different card with a right to work. It explains what the visitor card forbids, why an auto-entrepreneur number does not cure the prohibition, how to change status toward a <em>salari\u00e9<\/em> (employee) or <em>entrepreneur \/ profession lib\u00e9rale<\/em> (self-employed \/ liberal-profession) card, and how to challenge a refusal or a withdrawal. French terms are translated at first use. Company formation and the property purchase process sit outside this note. Can you work on a British visitor residence card after Brexit?<\/h2>\n<h3>A. What the carte de s\u00e9jour visiteur actually authorises \u2014 and what you signed<\/h3>\n<p>French residence law starts from a simple rule. Article <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000051562113\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000051562113\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">L. 411-1 of the CESEDA<\/a> (the <em>code de l&#8217;entr\u00e9e et du s\u00e9jour des \u00e9trangers et du droit d&#8217;asile<\/em>, the code on the entry and residence of foreigners) provides that, subject to France&#8217;s international commitments or Book II of the same code, &#8220;tout \u00e9tranger \u00e2g\u00e9 de plus de dix-huit ans qui souhaite s\u00e9journer en France pour une dur\u00e9e sup\u00e9rieure \u00e0 trois mois doit \u00eatre titulaire de l&#8217;un des documents de s\u00e9jour suivants&#8221;. After Brexit, a British national who is not a Withdrawal Agreement beneficiary is a third-country national. The visitor card is one of those documents, and it is a narrow one.<\/p>\n<p>Article <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776442\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776442\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">L. 426-20 of the CESEDA<\/a> is the whole of the visitor status in one paragraph. It states: &#8220;L&#8217;\u00e9tranger qui apporte la preuve qu&#8217;il peut vivre de ses seules ressources, dont le montant doit \u00eatre au moins \u00e9gal au salaire minimum de croissance net annuel, ind\u00e9pendamment de l&#8217;allocation aux adultes handicap\u00e9s mentionn\u00e9e \u00e0 l&#8217;article L. 821-1 du code de la s\u00e9curit\u00e9 sociale et de l&#8217;allocation suppl\u00e9mentaire mentionn\u00e9e \u00e0 l&#8217;article L. 815-24 du m\u00eame code, se voit d\u00e9livrer une carte de s\u00e9jour temporaire portant la mention &#8221; visiteur &#8221; d&#8217;une dur\u00e9e d&#8217;un an. Il doit en outre justifier de la possession d&#8217;une assurance maladie couvrant la dur\u00e9e de son s\u00e9jour et prendre l&#8217;engagement de n&#8217;exercer en France aucune activit\u00e9 professionnelle. Par d\u00e9rogation \u00e0 l&#8217;article L. 414-10, cette carte n&#8217;autorise pas l&#8217;exercice d&#8217;une activit\u00e9 professionnelle.&#8221; Three conditions sit together: resources at least equal to the annual net SMIC (the French minimum wage), sickness insurance covering the stay, and a personal undertaking not to exercise any professional activity in France. The last sentence is not commentary. It is a statutory derogation.<\/p>\n<p>The ordinary rule, in article <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776819\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776819\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">L. 414-10 of the CESEDA<\/a>, is that possession of a temporary card, a multi-year card or a resident card &#8220;lui conf\u00e8re, sous r\u00e9serve des exceptions pr\u00e9vues \u00e0 l&#8217;article L. 414-11, le droit d&#8217;exercer une activit\u00e9 professionnelle, sur ce m\u00eame territoire, dans le cadre de la l\u00e9gislation en vigueur&#8221;. The visitor card is listed as one of those exceptions. Article <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776817\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776817\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">L. 414-11 of the CESEDA<\/a> provides that article L. 414-10 does not apply where the foreigner holds, among other titles, &#8220;4\u00b0 La carte de s\u00e9jour temporaire portant la mention &#8221; visiteur &#8221; pr\u00e9vue \u00e0 l&#8217;article L. 426-20&#8243;. The retired person&#8217;s card and certain trainee cards sit in the same list. A visitor card therefore does not confer a right to work, even though it is a residence card.<\/p>\n<p>Service-Public, updated on 1 June 2026, translates that prohibition into the file you actually lodge: sufficient resources for the whole stay, sickness insurance, and no work in France as an employee, a trader, an auto-entrepreneur, an artisan or a liberal professional. The same page requires a handwritten <em>attestation sur l&#8217;honneur<\/em> (a declaration on honour) not to work in France, and it gives a practical minimum of \u20ac1,477.93 net per month for a single person, assessed over a year. That figure is the administration&#8217;s reading of the annual net SMIC test in article L. 426-20; it is not a separate tax. Family benefits are left out of the calculation. Pensions, annuities, rental income and a solvent relative&#8217;s guarantee can go in.<\/p>\n<p>The card lasts one year and is renewable only if the same conditions still hold. Article <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000049059471\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000049059471\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">L. 433-1 of the CESEDA<\/a> subordinates renewal to proof that the holder &#8220;continue de remplir les conditions requises pour la d\u00e9livrance de cette carte&#8221;.<\/p>\n<p>The Administrative Court of Appeal of Lyon has read article L. 426-20 as a package, not as a resources test that can be swapped for a French wage. In <a href=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000050375054\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000050375054\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">CAA Lyon, 7th chamber, 17 October 2024, no. 24LY00008<\/a>, the court quoted the article and held: &#8220;Il r\u00e9sulte de ces dispositions que le droit d&#8217;un ressortissant \u00e9tranger de s\u00e9journer en France sur ce fondement est subordonn\u00e9 notamment aux conditions qu&#8217;il dispose de ressources suffisantes pour subvenir \u00e0 ses besoins sans exercer d&#8217;activit\u00e9 professionnelle et d&#8217;une assurance maladie couvrant la dur\u00e9e de son s\u00e9jour.&#8221; In that case a Turkish imam still paid by the Turkish State, housed free of charge and covered for medical costs, kept the visitor route because he had not asked to become a French employee. The opposite facts produce the opposite result. In <a href=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000050277943\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000050277943\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">CAA Douai, 3rd chamber, 18 September 2024, no. 24DA00270<\/a>, a prefect who refused renewal of a visitor card relied &#8220;d&#8217;une part, sur le motif tir\u00e9 de ce qu&#8217;en m\u00e9connaissance des dispositions susmentionn\u00e9es de l&#8217;article L. 426-20 du code de l&#8217;entr\u00e9e et du s\u00e9jour des \u00e9trangers et du droit d&#8217;asile, l&#8217;int\u00e9ress\u00e9 ne justifie pas de ressources suffisantes, et, d&#8217;autre part, sur la circonstance que le titre de s\u00e9jour dont il sollicite le renouvellement ne lui permet pas de travailler.&#8221; The file contained a French open-ended employment contract. A visitor card cannot be used as a back-door work permit, including where the work has a religious or community label.<\/p>\n<p>The card also assumes that you actually live in France as a visitor, not that you hold a plastic title while working full-time somewhere else. Under the former numbering, article L. 313-6 CESEDA was the ancestor of article L. 426-20. In <a href=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000038546055\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000038546055\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">CAA Paris, 3rd chamber, 21 May 2019, no. 17PA00822<\/a>, the court recalled that former text: &#8220;La carte de s\u00e9jour temporaire d\u00e9livr\u00e9e \u00e0 l&#8217;\u00e9tranger qui apporte la preuve qu&#8217;il peut vivre de ses seules ressources et qui prend l&#8217;engagement de n&#8217;exercer en France aucune activit\u00e9 professionnelle porte la mention &#8220;visiteur&#8221;.&#8221; It then upheld a refusal because the holder worked full-time in Kuwait and, &#8220;contrairement \u00e0 l&#8217;engagement qu&#8217;elle avait pris lors de sa demande de visa, elle n&#8217;a de fait jamais r\u00e9sid\u00e9 en France plus de trois mois par an sous l&#8217;empire de la carte de s\u00e9jour portant la mention &#8221; visiteur &#8221; qui lui avait \u00e9t\u00e9 accord\u00e9e.&#8221; A British second-home owner who treats the visitor card as a 90-day tourist stamp with better stationery is in the same trap. The honour declaration is evidence against you if the facts diverge.<\/p>\n<h3>B. Why an auto-entrepreneur registration, a UK remote job or a cash-in-hand gig does not create a French work right<\/h3>\n<p>The prohibition in article L. 426-20 is on exercising a professional activity <em>in France<\/em>. It is not limited to a French employment contract. Service-Public lists employee, trader, auto-entrepreneur, artisan and liberal profession. A UK employment contract performed from a French kitchen is still activity exercised in France. So is freelance design work invoiced to a London client, a seasonal cash job in a village restaurant, and a micro-business that URSSAF has registered because the online form does not ask for your residence-card mention. URSSAF affiliation is a social-security step. It is not a pr\u00e9fecture decision and it is not an <em>autorisation de travail<\/em> (work authorisation).<\/p>\n<p>For salaried work the Labour Code is explicit. Article <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000050773226\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000050773226\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">L. 5221-5 of the code du travail<\/a> provides: &#8220;Un \u00e9tranger autoris\u00e9 \u00e0 s\u00e9journer en France ne peut exercer une activit\u00e9 professionnelle salari\u00e9e en France sans avoir obtenu au pr\u00e9alable l&#8217;autorisation de travail&#8221;. Being lawfully present is not enough. A visitor is lawfully present and still barred.<\/p>\n<p>Article <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000024197709\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000024197709\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">L. 8251-1 of the code du travail<\/a> then addresses the other side of the desk: &#8220;Nul ne peut, directement ou indirectement, embaucher, conserver \u00e0 son service ou employer pour quelque dur\u00e9e que ce soit un \u00e9tranger non muni du titre l&#8217;autorisant \u00e0 exercer une activit\u00e9 salari\u00e9e en France.&#8221; A UK company that keeps you on while you live in France, or a French neighbour who pays you in cash, can fall within that prohibition. The <a href=\"https:\/\/kohenavocats.fr\/en\/2026\/09\/10\/british-job-offer-france-salarie-work-authorisation-refusal-challenge-brexit\/\">British job-offer, work-authorisation and salari\u00e9-card route<\/a> is the lawful path for an open-ended French contract; it is not optional window-dressing around a visitor card.<\/p>\n<p>Self-employment is not a loophole. The card that authorises it is not the visitor card. Article <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776783\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776783\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">L. 421-5 of the CESEDA<\/a> provides: &#8220;L&#8217;\u00e9tranger qui exerce une activit\u00e9 non salari\u00e9e, \u00e9conomiquement viable et dont il tire des moyens d&#8217;existence suffisants, dans le respect de la l\u00e9gislation en vigueur, se voit d\u00e9livrer une carte de s\u00e9jour temporaire portant la mention &#8221; entrepreneur\/ profession lib\u00e9rale &#8221; d&#8217;une dur\u00e9e maximale d&#8217;un an.&#8221; Article <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000046074305\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000046074305\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">R. 421-7 of the CESEDA<\/a> applies that article to the foreigner whose non-salaried activity requires registration &#8220;soit au Registre national des entreprises en tant qu&#8217;entreprise du secteur des m\u00e9tiers et de l&#8217;artisanat ou au Registre du commerce et des soci\u00e9t\u00e9s, soit \u00e0 l&#8217;Union de recouvrement des cotisations de s\u00e9curit\u00e9 sociale et d&#8217;allocations familiales (URSSAF)&#8221;. The auto-entrepreneur who exists only because URSSAF issued a SIRET number is precisely in that field \u2014 and still needs the entrepreneur card, not the visitor card.<\/p>\n<p>Before you even file for that entrepreneur card, article <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000051747295\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000051747295\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">R. 421-9 of the CESEDA<\/a>, in the wording in force on 11 September 2026, requires a prior opinion: &#8220;Pr\u00e9alablement au d\u00e9p\u00f4t de sa demande de d\u00e9livrance de la carte de s\u00e9jour pr\u00e9vue \u00e0 l&#8217;article L. 421-5 , l&#8217;\u00e9tranger sollicite un avis sur la viabilit\u00e9 \u00e9conomique de l&#8217;activit\u00e9 non salari\u00e9e aupr\u00e8s du service en charge de la main d&#8217;\u0153uvre \u00e9trang\u00e8re comp\u00e9tent pour le d\u00e9partement dans lequel il souhaite r\u00e9aliser cette activit\u00e9.&#8221; Skipping that opinion, or treating a SIRET as a substitute for it, is how files die. The Administrative Court of Appeal of Marseille has already judged a change of status from visitor to auto-entrepreneur. In <a href=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000049515673\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000049515673\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">CAA Marseille, 6th chamber, 29 April 2024, no. 23MA02548<\/a>, the prefect of the Alpes-Maritimes &#8220;a rejet\u00e9 la demande de changement de statut de visiteur \u00e0 celui d&#8217;auto-entrepreneur&#8221; presented by a Lebanese national, and added an obligation to leave. The court held that &#8220;il appartenait au pr\u00e9fet, sur le fondement de l&#8217;article L. 421-5 du m\u00eame code, d&#8217;appr\u00e9cier si l&#8217;activit\u00e9 lib\u00e9rale que M. B&#8230; se proposait d&#8217;exercer \u00e9tait de nature \u00e0 lui procurer des &#8221; moyens d&#8217;existence suffisants &#8220;&#8221;. A thin business plan, a modest investment and no identified clientele were not enough. URSSAF registration would not have saved that file. Economic viability and sufficient means of existence are pr\u00e9fecture questions, not INPI or URSSAF questions.<\/p>\n<p>Working anyway has two further costs. First, undeclared work is forbidden. Article <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006904815\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006904815\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">L. 8221-1 of the code du travail<\/a> prohibits &#8220;Le travail totalement ou partiellement dissimul\u00e9, d\u00e9fini et exerc\u00e9 dans les conditions pr\u00e9vues aux articles L. 8221-3 et L. 8221-5&#8221;. Article <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000044056622\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000044056622\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">L. 8221-3<\/a> treats as dissimulation of activity the lucrative exercise of a service or commercial activity by a person who intentionally fails to register or to file the social and tax declarations. An auto-entrepreneur who hides the activity, or who continues after a social-security striking-off, can meet that definition. Second, the visitor card itself can be withdrawn. Article <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000051562081\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000051562081\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">L. 432-5 of the CESEDA<\/a> provides: &#8220;Si l&#8217;\u00e9tranger cesse de remplir l&#8217;une des conditions exig\u00e9es pour la d\u00e9livrance de la carte de s\u00e9jour dont il est titulaire, fait obstacle aux contr\u00f4les ou ne d\u00e9f\u00e8re pas aux convocations, la carte de s\u00e9jour peut lui \u00eatre retir\u00e9e par une d\u00e9cision motiv\u00e9e.&#8221; The undertaking not to work is a condition of issue. Starting work is a cessation of that condition. The same article requires a prior chance to submit observations under articles L. 121-1 and L. 121-2 of the code on relations between the public and the administration. Silence after a registered letter is not a strategy.<\/p>\n<p>The labour courts still see people who worked without a work title. In <a href=\"https:\/\/www.courdecassation.fr\/decision\/5fca5990f623992e47e153bd\">Cour de cassation, social chamber, 18 March 2020, no. 18-24.982<\/a> (ECLI:FR:CCASS:2020:SO00360, published in the Bulletin), the Court recorded that &#8220;M. V&#8230;, ressortissant \u00e9tranger sans titre de travail, a saisi la juridiction prud&#8217;homale aux fins de voir constater l&#8217;existence d&#8217;un contrat de travail le liant \u00e0 M. R&#8230;, ainsi que de demandes relatives \u00e0 l&#8217;ex\u00e9cution et \u00e0 la rupture de ce contrat.&#8221; A missing work title does not make the wages disappear, and it does not make the visitor card lawful. It puts you in front of the labour court for pay and in front of the pr\u00e9fecture for removal. Those are different rooms.<\/p>\n<h2>II. How to change status lawfully and challenge a refusal<\/h2>\n<h3>A. How to move from visiteur to salari\u00e9 or entrepreneur \/ profession lib\u00e9rale<\/h3>\n<p>French law does not trap you on the visitor mention for ever. It requires you to change the mention before you work. On a genuine change of status from an existing visitor card, that visa condition is not opposable, provided the conditions of the new mention are met. The last sentence of article L. 433-6 is the trap for the ambitious: &#8220;Le pr\u00e9sent article ne s&#8217;applique pas aux titres de s\u00e9jour pr\u00e9vus aux articles L. 421-2 et L. 421-6.&#8221; Direct issue of a multi-year salari\u00e9 or entrepreneur card from another mention follows a different, slower path.<\/p>\n<p>If the plan is a French employment contract, the destination mention is salari\u00e9 or, for a fixed-term contract, <em>travailleur temporaire<\/em> (temporary worker). Article <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776797\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776797\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">L. 421-1 of the CESEDA<\/a> provides: &#8220;L&#8217;\u00e9tranger qui exerce une activit\u00e9 salari\u00e9e sous contrat de travail \u00e0 dur\u00e9e ind\u00e9termin\u00e9e se voit d\u00e9livrer une carte de s\u00e9jour temporaire portant la mention &#8221; salari\u00e9 &#8221; d&#8217;une dur\u00e9e maximale d&#8217;un an.&#8221; The same article then subordinates issue of that card to a prior work authorisation under the Labour Code. The employer files the work authorisation first. You do not start work on the visitor card while that file is pending.<\/p>\n<p>Article <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000049052363\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000049052363\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">L. 421-2 of the CESEDA<\/a> then says that a person who already holds another card and who asks for a multi-year salari\u00e9 card first receives a one-year temporary card with that mention if the conditions are met, and only later the multi-year card. The labour-market test, the contract, the salary and the job title must match. That is the subject of the job-offer note already cited. A change of status is not a lighter version of that file. It is the same file, started from inside France rather than from a consulate.<\/p>\n<p>If the plan is self-employment, the destination mention is entrepreneur \/ profession lib\u00e9rale under article L. 421-5. Service-Public page F35795, the official page for that card, distinguishes a commercial, industrial or craft activity from a liberal profession and lists the business plan, the lease, the professional qualification for a regulated activity, and proof of means. Article R. 421-9, as in force on 11 September 2026, requires the foreign-labour opinion on economic viability before the residence-card filing. Article <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000049052360\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000049052360\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">L. 421-6 of the CESEDA<\/a> then mirrors article L. 421-2 for the multi-year entrepreneur card: &#8220;Par d\u00e9rogation \u00e0 l&#8217;article L. 433-6, l&#8217;\u00e9tranger qui sollicite la d\u00e9livrance d&#8217;une carte de s\u00e9jour pluriannuelle portant la mention &#8221; entrepreneur\/ profession lib\u00e9rale &#8221; et qui est titulaire d&#8217;une carte de s\u00e9jour d\u00e9livr\u00e9e pour un autre motif b\u00e9n\u00e9ficie d&#8217;une carte de s\u00e9jour temporaire d&#8217;une dur\u00e9e d&#8217;un an portant la mention demand\u00e9e lorsque les conditions de d\u00e9livrance de cette carte sont remplies.&#8221; You should expect a one-year entrepreneur card first, not a four-year talent card, unless you separately meet a talent route. Marseille no. 23MA02548 is the warning: a change of status from visitor to auto-entrepreneur is judged on viability and sufficient means, not on the sincerity of the project.<\/p>\n<p>The file that works is built before the click on the URSSAF site. For a salari\u00e9 change of status, that means a named employer, a contract or promise of employment, a work-authorisation application, and no start date that precedes the authorisation. For an entrepreneur change of status, that means a real business plan, identified clients or a credible market, a French registered office or domiciliation, the foreign-labour opinion, professional insurance if the activity requires it, and resources that cover the first months without relying on the visitor honour declaration you are about to leave behind. Registering the micro-business first and asking the pr\u00e9fecture afterwards inverts the order that article R. 421-9 now imposes. If the visitor card is close to expiry, file the change of status while it is still valid. An expired visitor card plus a SIRET is not a status. It is an irregular stay with a tax number.<\/p>\n<p>Two neighbouring routes are often confused with a visitor who wants to work. A British national who married a French citizen, or who has a durable French family life, may have a <em>vie priv\u00e9e et familiale<\/em> (private and family life) claim under article L. 423-23 CESEDA; that is a different mention, with different evidence, and it is not a freelance permit dressed up as family life. A British national who still holds Withdrawal Agreement residence has a right to work that the visitor card never gave. Mixing those files \u2014 for example, telling the pr\u00e9fecture you will not work and telling URSSAF you will \u2014 is how both files fail. If the long-stay visitor visa was itself refused before you even arrived, the <a href=\"https:\/\/kohenavocats.fr\/en\/2026\/09\/05\/french-long-stay-visa-refused-british-citizen-brexit-appeal\/\">consular refusal and appeal route<\/a> is the prior battle; you cannot change status in France from a visa you never obtained.<\/p>\n<h3>B. How to challenge a pr\u00e9fecture refusal, a card withdrawal or an URSSAF problem in Paris and \u00cele-de-France<\/h3>\n<p>A refusal of change of status is a written, reasoned administrative decision. So is a refusal to renew the visitor card, and so is a withdrawal under article L. 432-5. The first document to keep is the decision itself, with the date of notification, the mention refused, the reasons, and any accompanying <em>obligation de quitter le territoire fran\u00e7ais<\/em> (OQTF, an obligation to leave French territory). The OQTF has its own, shorter litigation timetable. This note does not re-open that specialised appeal; it flags that an OQTF served with a visitor-card refusal is a removal measure, not a polite suggestion, and that the residence challenge and the removal challenge have to be read together.<\/p>\n<p>For the residence decision standing alone, article <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000039807005\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000039807005\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">R. 421-1 of the code de justice administrative<\/a> (the code of administrative justice) provides: &#8220;La juridiction ne peut \u00eatre saisie que par voie de recours form\u00e9 contre une d\u00e9cision, et ce, dans les deux mois \u00e0 partir de la notification ou de la publication de la d\u00e9cision attaqu\u00e9e.&#8221; Two months from notification, not from the day you opened the envelope in a drawer. A <em>recours gracieux<\/em> (an informal request that the prefect reconsider) does not magically extend that time unless it is a proper administrative appeal that the code treats as interrupting the period; do not assume that an email to the foreigner desk has frozen the clock. If the decision is already executing \u2014 for example a withdrawal that leaves you without a card, or a refusal that coincides with an employer start date \u2014 article <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006449326\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006449326\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">L. 521-1 of the code de justice administrative<\/a> allows the urgent-applications judge to suspend the decision where &#8220;l&#8217;urgence le justifie et qu&#8217;il est fait \u00e9tat d&#8217;un moyen propre \u00e0 cr\u00e9er, en l&#8217;\u00e9tat de l&#8217;instruction, un doute s\u00e9rieux quant \u00e0 la l\u00e9galit\u00e9 de la d\u00e9cision&#8221;. Urgency and a serious doubt as to legality are cumulative. A start date next Monday can be urgency. A thin legality challenge is not a serious doubt.<\/p>\n<p>What the court actually looks at depends on the mention you asked for. On a visitor renewal, Lyon no. 24LY00008 and Douai no. 24DA00270 show the grid: resources without French work, insurance, and no professional activity in France. A file that contains a French employment contract, URSSAF returns, invoices, or a LinkedIn profile advertising services from France, argues against you. On a change of status to entrepreneur, Marseille no. 23MA02548 shows the grid: article L. 421-5 viability and sufficient means, the R. 421-7 registration setting, and, where it applies, the foreign-labour opinion. A business plan without clients, without a French registration where registration is mandatory, and without numbers that survive a pr\u00e9fecture reading, will not be cured by enthusiasm. On a change of status to salari\u00e9, the court looks at the work authorisation, the contract and article L. 421-1. You cannot ask the administrative court to ignore the Labour Code because the visitor card is about to expire.<\/p>\n<p>Evidence is dull and decisive. Keep the visitor visa, the honour declaration, the insurance certificate, the bank statements that supported resources, the URSSAF acknowledgements, the invoices, the UK employment contract, the Slack or badge records that show work from France, the foreign-labour opinion or the letter saying none was needed, the ANEF filing receipt, and the pr\u00e9fecture decision with its annexes. If the prefect withdrew the card, keep the letter that invited observations and your reply. Article L. 432-5 makes that exchange a condition of a lawful withdrawal. A decision that skipped it is weaker. A decision that followed it, and that quotes your own invoices, is stronger against you.<\/p>\n<p>In Paris and \u00cele-de-France the geography of the file matters. A British resident in Paris deals with the Prefecture of Police, not with a departmental pr\u00e9fecture in the provinces. In Hauts-de-Seine, the foreigner desk has already put first applications and changes of status toward a salari\u00e9 card onto the State online procedure at demarche.numerique.gouv.fr, with a Nanterre contact point. Other departments in the Paris region use the ANEF portal, a mailbox, or a mix. The competent administrative court follows the prefect who signed: Paris, Montreuil, Cergy-Pontoise or Versailles depending on the department, then the Administrative Court of Appeal of Paris or of Versailles. Do not file in the wrong court because you bank in another department. Time spent on the wrong registry is time lost on the two-month clock.<\/p>\n<p>URSSAF is a parallel problem, not a substitute appeal. If you registered as an auto-entrepreneur while holding a visitor card, you may receive social-security contribution calls on an activity the pr\u00e9fecture forbids. Paying those calls does not regularise the residence mention. Ignoring them creates a debt. The regularisation, if it exists, is the change of status under articles L. 433-6 and L. 421-5, or a salari\u00e9 authorisation under articles L. 421-1 and L. 5221-5, followed by a clean URSSAF position. Closing the micro-business without telling the pr\u00e9fecture does not erase the fact that the activity was exercised. The court in Douai looked at the contract in the file, not at the story told afterwards.<\/p>\n<p>A British visitor who has already started work should not wait for a random check. The practical sequence is: stop presenting the visitor card as a work permit; gather the evidence; decide whether the true destination is salari\u00e9, entrepreneur, family life, or a return to a genuine visitor life funded by pensions and savings; file the correct change of status while the current card is valid; and, if a refusal or an OQTF has already been served, count the days from notification and instruct an avocat on the court that actually has jurisdiction. Informal promises from a town-hall clerk, a UK payroll officer or an online auto-entrepreneur platform do not bind the prefect, the labour inspectorate or the administrative court.<\/p>\n<h2>Conclusion<\/h2>\n<p>After Brexit, a British visitor residence card is a permission to live in France without working there. Article L. 426-20 makes the undertaking not to exercise any professional activity a condition of issue; article L. 414-11 takes the visitor card out of the ordinary right to work; article L. 432-5 allows withdrawal if that condition ceases. An auto-entrepreneur SIRET, a UK remote contract performed from France, or a cash job does not reverse those articles. The lawful exits are a change of status toward a salari\u00e9 card with a prior work authorisation, or toward an entrepreneur \/ profession lib\u00e9rale card that meets article L. 421-5, article R. 421-7 and the prior viability opinion in article R. 421-9. Marseille no. 23MA02548 shows that a visitor-to-auto-entrepreneur file is won or lost on viability and means, not on registration. Douai no. 24DA00270 and Lyon no. 24LY00008 show that a visitor renewal is lost where French work appears in the file and is kept where resources exist without French work. Challenge a refusal within two months under article R. 421-1 of the code of administrative justice, and use the urgent-applications judge under article L. 521-1 if the decision is already executing.
