How British Drivers Can Pay or Challenge the Fine After Brexit"},"content":{"rendered":"<p>You were driving down to the Dordogne, or cutting along the A26 back to the Tunnel, when a white flash went off beside a grey box on the hard shoulder. Nobody stopped you, nobody asked for your licence, and you thought no more about it until a brown envelope from France landed on your doormat in Kent, or an email from your hire company told you that a French fine had been matched to your rental, sometimes with an administration fee added under your rental agreement. The letter is therefore not a scam to be binned, and it is not the end of the story either. It is the opening of a strict timetable in which paying within fifteen days can reduce the bill to 45 euros instead of 68, or 90 instead of 135, designating the real driver can move the liability, and doing nothing for forty-five days increases the penalty automatically. This guide explains, for British licence holders in particular, who French law holds liable when a camera flashes, what a speeding case really costs and when it turns criminal, how to pay or to name another driver when the notice reaches a United Kingdom address, and how to challenge the penalty without falling into the traps that defeat most appeals. Every French term is explained as it appears, and every decisive rule is tied to the exact statute or court decision that creates it.<\/p>\n<h2>I. I was flashed by a speed camera in France \u2014 what happens next and what do I risk?<\/h2>\n<h3>A. Who pays when the camera never stops the driver?<\/h3>\n<p>A speed camera does not identify a driver; it photographs a number plate. French law draws a sharp line from that fact. The starting rule, in <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006840868\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006840868\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">article L121-1 of the Highway Code (<i>Code de la route<\/i>)<\/a>, is personal: \u201cLe conducteur d&#8217;un v\u00e9hicule est responsable p\u00e9nalement des infractions commises par lui dans la conduite dudit v\u00e9hicule.\u201d In plain English, the person behind the wheel is criminally responsible for the driving offences they commit. But cameras cannot stop the wheel, so a second rule takes over for automated offences. By way of exception, <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000039785641\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000039785641\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">article L121-3 of the Highway Code<\/a> provides that \u201cle titulaire du certificat d&#8217;immatriculation du v\u00e9hicule est redevable p\u00e9cuniairement de l&#8217;amende encourue pour des infractions dont la liste est fix\u00e9e par d\u00e9cret en Conseil d&#8217;Etat, \u00e0 moins qu&#8217;il n&#8217;\u00e9tablisse l&#8217;existence d&#8217;un vol ou de tout autre \u00e9v\u00e9nement de force majeure ou qu&#8217;il n&#8217;apporte tous \u00e9l\u00e9ments permettant d&#8217;\u00e9tablir qu&#8217;il n&#8217;est pas l&#8217;auteur v\u00e9ritable de l&#8217;infraction.\u201d The <i>titulaire du certificat d&#8217;immatriculation<\/i> is the registered keeper of the vehicle, the person named on the French registration document still commonly called the <i>carte grise<\/i>; <i>redevable p\u00e9cuniairement<\/i> means financially liable for the fine, as opposed to criminally guilty; and <i>force majeure<\/i> means an unforeseeable event beyond anyone&#8217;s control. Speeding recorded by automatic device is on the list, so the keeper pays unless they prove theft, force majeure, or produce material showing they were not the driver.<\/p>\n<p>The Cour de cassation, the supreme court for criminal matters, polices that boundary strictly. On 9 September 2025, in decision <a href=\"https:\/\/www.courdecassation.fr\/decision\/68bfcd4e15e20075ff0b3f8c\">no. 24-87.195 (ECLI:FR:CCASS:2025:CR00981)<\/a>, the criminal chamber restated that \u201cSelon le premier de ces textes, le titulaire du certificat d&#8217;immatriculation du v\u00e9hicule est redevable p\u00e9cuniairement de l&#8217;amende encourue pour la contravention d&#8217;exc\u00e8s de vitesse, \u00e0 moins qu&#8217;il n&#8217;\u00e9tablisse l&#8217;existence d&#8217;un vol ou de tout autre \u00e9v\u00e9nement de force majeure, ou qu&#8217;il n&#8217;apporte tous \u00e9l\u00e9ments permettant d&#8217;\u00e9tablir qu&#8217;il n&#8217;est pas l&#8217;auteur v\u00e9ritable de l&#8217;infraction.\u201d The lower court had acquitted a keeper who said his plates might have been stolen while he was on holiday in Morocco, reasoning that it was \u201cperfectly plausible\u201d the flashed car was not his. The supreme court quashed that reasoning outright: \u201cEn se d\u00e9terminant ainsi, par des motifs hypoth\u00e9tiques insuffisants \u00e0 \u00e9carter la responsabilit\u00e9 p\u00e9cuniaire au titre de laquelle le pr\u00e9venu \u00e9tait uniquement recherch\u00e9, le tribunal n&#8217;a pas justifi\u00e9 sa d\u00e9cision.\u201d Hypotheses do not defeat keeper liability. A British owner of a French-registered second-home car who simply says \u201cit could have been anyone\u201d will lose; a theft report (<i>d\u00e9p\u00f4t de plainte<\/i>, the formal criminal complaint filed with the police), a destruction certificate, a sale declaration, or the full identity and licence details of the real driver is what the text demands.<\/p>\n<p>A second decision shows the other side of the same line, and it matters particularly to anyone hiring a car. On 18 November 2025, in <a href=\"https:\/\/www.courdecassation.fr\/decision\/691c4c1e8b6588a4f898c8a7\">no. 25-83.480 (ECLI:FR:CCASS:2025:CR01484)<\/a>, the criminal chamber dealt with the hirer of a vehicle convicted of driving the wrong way down a street (<i>circulation en sens interdit<\/i>) recorded by an automatic device. The court recalled that \u201cSelon le premier de ces textes, le conducteur d&#8217;un v\u00e9hicule est responsable p\u00e9nalement des infractions commises par lui dans la conduite dudit v\u00e9hicule,\u201d then held that where the offender was not stopped at the time, \u201cla valeur probante du proc\u00e8s-verbal constatant l&#8217;infraction est limit\u00e9e, en l&#8217;absence de verbalisation imm\u00e9diate du contrevenant, \u00e0 la caract\u00e9risation du comportement incrimin\u00e9 et \u00e0 l&#8217;identification du v\u00e9hicule en cause, l&#8217;identit\u00e9 du conducteur de ce dernier au moment des faits demeurant d\u00e8s lors incertaine.\u201d The <i>proc\u00e8s-verbal<\/i> is the official written record of the offence, and <i>verbalisation imm\u00e9diate<\/i> means being stopped and reported on the spot. The hirer had denied being the driver both in his exemption request and before the court, yet had been convicted as the driver on the strength of the report alone. The supreme court quashed the conviction: without an on-the-spot stop, the report proves the manoeuvre and the vehicle, not who was driving, and the court should have considered financial liability as keeper rather than personal guilt as driver. For a British hirer the lesson is symmetrical with keeper liability. If you were genuinely not driving, deny it consistently from the first form and supply the real driver&#8217;s details, because silence leaves only the financial-liability route. And the authorities cannot turn a plate photograph into a named driver without more.<\/p>\n<p>Hire cars follow the same logic with one extra link in the chain. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000041599404\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000041599404\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article L121-2 of the Highway Code<\/a>, for parking and similar cases, and <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000039785641\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000039785641\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">article L121-3<\/a>, for radar speeding, both move the financial liability onto the hirer (<i>locataire<\/i>) where the vehicle was hired out, under the same defences. That is why the hire company writes to you weeks later: the enforcement system asks it who held the car at the flash time, it names you, and the <i>avis de contravention<\/i>, the formal notice of the offence setting out the fixed penalty to pay, is reissued in your name to your home address. The hire company may also debit an administration fee under your rental agreement for handling the paperwork. If the hire company debits such a fee, that dispute lies between you and the company under the rental agreement; the fine itself follows the forty-five-day procedure. Company cars are harsher still, as Part II explains: <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000051877187\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000051877187\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">article L121-6 of the Highway Code<\/a> makes failure to designate the employee driver a separate offence, punished far more heavily than the speeding itself.<\/p>\n<p>One question worries British readers most: the points. A decision holding the keeper merely financially liable \u201cne donne pas lieu \u00e0 inscription au casier judiciaire, ne peut \u00eatre prise en compte pour la r\u00e9cidive et n&#8217;entra\u00eene pas retrait des points affect\u00e9s au permis de conduire\u201d, in the words of <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000039785641\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000039785641\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">article L121-3<\/a>: no entry on the criminal record (<i>casier judiciaire<\/i>), no counting as a previous offence (<i>r\u00e9cidive<\/i>), no withdrawal of licence points. The same protection covers the deposit lodged with a challenge: <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000043375922\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000043375922\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">article 529-10 of the Code of Criminal Procedure (<i>Code de proc\u00e9dure p\u00e9nale<\/i>)<\/a> provides that \u201ccette consignation n&#8217;est pas assimilable au paiement de l&#8217;amende forfaitaire et ne donne pas lieu au retrait des points du permis de conduire pr\u00e9vu par le quatri\u00e8me alin\u00e9a de l&#8217;article L. 223-1 du code de la route.\u201d <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000036749888\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000036749888\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article L223-1 of the Highway Code<\/a> runs the French points system (<i>permis \u00e0 points<\/i>), under which \u201cLorsque le nombre de points est nul, le permis perd sa validit\u00e9\u201d: when the points reach zero, the licence loses validity. If you hold a French licence and are convicted as the driver, points go under article L223-1. Paying as keeper, in any event, leaves no French criminal record. But do not confuse that with impunity, which is the subject of the next section: the money penalties are real, they grow fast, and at high speeds the case stops being a mere ticket.<\/p>\n<h3>B. What does a speeding ticket really cost, and when does it become a criminal case?<\/h3>\n<p>Ordinary speeding recorded by camera is a <i>contravention<\/i>, a minor offence dealt with by fixed penalty without a court hearing. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000048533039\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000048533039\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article R413-14 of the Highway Code<\/a> states that \u201cle fait, pour tout conducteur d&#8217;un v\u00e9hicule \u00e0 moteur, de d\u00e9passer de moins de 50 km\/h la vitesse maximale autoris\u00e9e fix\u00e9e par le pr\u00e9sent code ou \u00e9dict\u00e9e par l&#8217;autorit\u00e9 investie du pouvoir de police est puni de l&#8217;amende pr\u00e9vue pour les contraventions de la quatri\u00e8me classe.\u201d The one exception helps small excesses on fast roads: below 20 kilometres per hour over a limit above 50, the case drops to a third-class petty offence. The standard scale is set by regulation: <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000041765693\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000041765693\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">article R49 of the Code of Criminal Procedure<\/a> fixes \u201c4\u00b0 68 euros pour les contraventions de la 3e classe ; 5\u00b0 135 euros pour les contraventions de la 4e classe.\u201d Speed, in other words, is priced in two bands for camera cases: a modest excess on a motorway or dual carriageway sits at 68 euros, while anything from 20 over, or any excess in a 30 or 50 zone, sits at 135 euros. Exceeding the limit by 30 or more also exposes the driver to complementary penalties (<i>peines compl\u00e9mentaires<\/i>, additional sanctions a court may add): suspension of the French driving entitlement for up to three years, a ban on driving certain motor vehicles for up to three years, and a compulsory road-safety awareness course at the offender&#8217;s expense.<\/p>\n<p>Speed then changes the arithmetic twice, once downwards and once upwards. Pay at once and the penalty shrinks. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000033459168\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000033459168\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 529-7 of the Code of Criminal Procedure<\/a> provides that for listed second-to-fifth-class road contraventions except parking, \u201cl&#8217;amende forfaitaire est minor\u00e9e si le contrevenant en r\u00e8gle le montant dans les conditions pr\u00e9vues par l&#8217;article 529-8\u201d, and <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000030254337\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000030254337\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">article 529-8<\/a> gives \u201cun d\u00e9lai de quinze jours \u00e0 compter de la constatation de l&#8217;infraction ou, si l&#8217;avis de contravention est ult\u00e9rieurement envoy\u00e9 \u00e0 l&#8217;int\u00e9ress\u00e9, dans le d\u00e9lai de quinze jours \u00e0 compter de cet envoi\u201d, adding that \u201cEn cas de non-paiement de l&#8217;amende forfaitaire minor\u00e9e dans les conditions pr\u00e9vues ci-dessus, le contrevenant est redevable de l&#8217;amende forfaitaire.\u201d The reduced (<i>minor\u00e9e<\/i>) scale in <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000049692195\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000049692195\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">article R49-9<\/a> runs \u201c2\u00b0 45 euros pour les contraventions de la troisi\u00e8me classe ; 3\u00b0 90 euros pour les contraventions de la quatri\u00e8me classe.\u201d Wait too long and it swells: \u201cA d\u00e9faut de paiement ou d&#8217;une requ\u00eate pr\u00e9sent\u00e9e dans le d\u00e9lai de quarante-cinq jours, l&#8217;amende forfaitaire est major\u00e9e de plein droit et recouvr\u00e9e au profit du Tr\u00e9sor public en vertu d&#8217;un titre rendu ex\u00e9cutoire par le minist\u00e8re public,\u201d in the words of <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000048844668\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000048844668\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">article 529-2 of the Code of Criminal Procedure<\/a>. The <i>Tr\u00e9sor public<\/i> is the state revenue service that recovers public debts, and the <i>minist\u00e8re public<\/i> is the prosecuting authority whose enforceable order (<i>titre ex\u00e9cutoire<\/i>) turns the increased sum into a recoverable debt automatically (<i>de plein droit<\/i>). The increased (<i>major\u00e9e<\/i>) scale in <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000041765684\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000041765684\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">article R49-7<\/a> runs \u201c4\u00b0 180 euros pour les contraventions de la troisi\u00e8me classe ; 5\u00b0 375 euros pour les contraventions de la quatri\u00e8me classe.\u201d <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000029007354\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000029007354\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article R49-6<\/a> adds that the increased notice states that \u201cen cas de paiement volontaire de l&#8217;amende forfaitaire major\u00e9e dans le d\u00e9lai d&#8217;un mois \u00e0 compter de sa date d&#8217;envoi, le montant des sommes dues sera diminu\u00e9 de 20 %.\u201d None of this needs a judge; it is arithmetic driven by dates, which is why Part II dwells on deadlines.<\/p>\n<p>At 50 kilometres per hour or more over the limit, the file leaves the world of tickets entirely. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000051877176\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000051877176\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article L413-1 of the Highway Code<\/a> provides that \u201cle fait, pour tout conducteur d&#8217;un v\u00e9hicule \u00e0 moteur, de d\u00e9passer de 50 kilom\u00e8tres \u00e0 l&#8217;heure ou plus la vitesse maximale autoris\u00e9e est puni de trois mois d&#8217;emprisonnement et de 3 750 euros d&#8217;amende.\u201d That is a <i>d\u00e9lit<\/i>, a criminal offence tried in the criminal court, carrying up to three months&#8217; imprisonment and a 3,750 euro fine. Paragraph IV nonetheless preserves a settlement route: \u201cDans les conditions pr\u00e9vues aux articles 495-17 \u00e0 495-25 du code de proc\u00e9dure p\u00e9nale, l&#8217;action publique peut \u00eatre \u00e9teinte, y compris en cas de r\u00e9cidive, par le versement d&#8217;une amende forfaitaire d&#8217;un montant de 300 euros.\u201d The same article adds vehicle confiscation, which is compulsory on a repeat offence although \u201cla juridiction peut toutefois ne pas prononcer cette peine, par une d\u00e9cision sp\u00e9cialement motiv\u00e9e\u201d, licence suspension of up to three years without any restriction to non-professional driving, a driving ban of up to five years, a paid awareness course, and even cancellation of the licence with up to three years before a new one may be sought. The provision also wipes out half the points of a French licence by operation of law. In short: no French address, job, or approved guarantee, and no on-the-spot payment, means the car is held until the deposit is paid, the prosecutor decides within a day, and the pound with its storage costs follows otherwise. The same statute therefore governs the British tourist stopped at the roadside and the French driver alike: residence, not nationality, decides the procedure. A British resident with a French home or job follows the postal route instead, exactly like a French driver. Either way, the flash is only the beginning of the paper chain, and the next part follows that chain to a United Kingdom letterbox.<\/p>\n<h2>II. Name the real driver completely and accurately, because an incomplete designation fails and leaves you liable as keeper. The hirer is the person pursued, as explained above. The hire company may also debit an administration fee under the rental agreement for handling the enforcement paperwork. If the hire company debits such a fee, that dispute lies between you and the company under the rental agreement; the fine itself follows the forty-five-day procedure. Then treat the reissued notice exactly like any other: forty-five days, designation if someone else drove the hired car, challenge if the facts are wrong. Keep the rental agreement, the handover inspection sheet, and any additional-driver slip, because they prove who held the car at the flash time if the company named the wrong lead driver. The notice was paid on 1 February 2023 without the driver being named, so on 17 May 2023 the company received a second notice, this time for failing to disclose the driver&#8217;s identity and address. An <i>ordonnance p\u00e9nale<\/i>, a criminal order made without a hearing, held it liable to 135 euros for that non-disclosure, the company opposed the order, and the police court confirmed a 135 euro fine. Note the narrow exception in the second paragraph of article L121-6: where a natural person registered the vehicle as a legal entity, \u201cl&#8217;obligation pr\u00e9vue au m\u00eame premier alin\u00e9a est alors r\u00e9put\u00e9e satisfaite si le titulaire du certificat d&#8217;immatriculation ou le d\u00e9tenteur du v\u00e9hicule justifie, dans le m\u00eame d\u00e9lai et selon les m\u00eames modalit\u00e9s, que le v\u00e9hicule est immatricul\u00e9 \u00e0 son nom.\u201d Name the driver within the forty-five days, subject to the sole-trader exception below, and never assume that challenging will reduce the bill: once a challenge is lodged and fails, article 530-1 sets a floor at the fixed or increased penalty according to the route taken, and \u201cEn cas de condamnation, l&#8217;amende prononc\u00e9e ne peut \u00eatre inf\u00e9rieure au montant pr\u00e9vu \u00e0 l&#8217;alin\u00e9a pr\u00e9c\u00e9dent augment\u00e9 d&#8217;une somme de 10 %\u201d in consignation cases.<\/p>\n<h3>B. How do I challenge the fine, and which deadlines kill most appeals?<\/h3>\n<p>A challenge (<i>requ\u00eate en exon\u00e9ration<\/i>, the reasoned request for exemption sent within the forty-five days) must be reasoned, on the enclosed form, by registered post with proof of delivery, to the department shown on the notice, using one of the two admissibility routes article 529-10 provides: the listed documents or the matching deposit. The department forwards it to the prosecuting authority. Two outcomes follow: the prosecutor drops the case, or the case goes to the police court (<i>tribunal de police<\/i>, the court that tries minor offences), seized under <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000024970669\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000024970669\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">article 531 of the Code of Criminal Procedure<\/a> by direct summons among other routes. The well-founded challenges are narrow: mistaken plate or vehicle, theft or cloned plates proved by a prompt complaint, sale proved by the registered sale declaration, or designation of the true driver with full details. The unusable ones are familiar: \u201cI did not see the sign\u201d, \u201ceveryone was speeding\u201d, \u201cmy speedometer reads low\u201d, or a bare \u201cit was not me\u201d with nothing attached, which the 9 September 2025 decision above shows a court will reject. Where the offence is serious enough to reach court and you live in Britain, consider instructing a French lawyer to handle the hearing.<\/p>\n<p>The twin danger of any challenge is the floor rule already quoted twice: contest and lose, and the court cannot go below what the fixed penalty would have been. File the wrong admissibility route, a bare letter where the documents or the deposit were required, and the challenge is declared inadmissible without ever being examined, which is how careful drivers lose winnable cases. The notice and its enclosed form show which of the two routes your case requires, so follow them exactly.<\/p>\n<p>Unpaid notices follow their own escalator. For a British keeper this bites in two familiar ways. Move house in the United Kingdom between the holiday and the letter, and the registered notice goes to the old address while time runs. Sell the French-registered car without registering the sale, and the next keeper&#8217;s flashes land on you until the sale declaration proves otherwise. So act in this order on any increased notice: check the posting date against the three months, declare or evidence the address position at once, and pay the standard sum inside the forty-five days rather than arguing the increase by phone, which suspends nothing.<\/p>\n<h2>Conclusion<\/h2>\n<p>A French speed camera sets a paper machine in motion, not a negotiation. The keeper pays unless theft, force majeure, or the true driver&#8217;s full details are proved with documents; the report alone, without an on-the-spot stop, proves the car&#8217;s behaviour but not who drove; the standard bill is 68 or 135 euros, cut to 45 or 90 for payment within fifteen days and raised to 180 or 375 for delay; and 50 kilometres per hour over turns the ticket into a criminal prosecution. For the British addressee the discipline is the same: calendar the forty-five days from posting, use the enclosed form by registered post with the documents or the deposit, designate consistently, and use the three-month route the moment an increased penalty appears. Done promptly, most camera cases end with a modest payment or a clean transfer to the real driver. Done late, the same case ends at the police court with the failed-challenge floor under it. Keep the notice, the rental agreement or sale papers, the postal receipts, and the payment proof together; they are the file on which everything turns.
