A British resident may receive a French invoice, a threat of recovery, or a message saying that the supply will be stopped. The answer depends first on the home concerned. French law gives particularly strong protection to the <em>r\u00e9sidence principale<\/em>, meaning the person\u2019s main home, against a water disconnection for non-payment. That protection is separate from the question of whether the invoice is correct and separate again from the supplier\u2019s ability to recover a genuine debt.<\/p>\n<p>Brexit does not remove that protection. A British national living lawfully in France remains subject to the French rules governing the local public drinking-water service. The UK Government\u2019s guidance on <a href=\"https:\/\/www.gov.uk\/guidance\/living-in-france\" target=\"_blank\" rel=\"noopener\">living in France<\/a> distinguishes Withdrawal Agreement residence rights from later immigration routes, but neither route changes the basic consumer protection attached to a French main residence. This guide explains what the supplier may and may not do, how the leak and meter rules differ from the no-disconnection rule, and what a British resident should put in writing when a bill is disputed.<\/p>\n<h2>I. Can a French water supplier cut off water for an unpaid bill after Brexit?<\/h2>\n<h3>A. What protection applies to a British resident\u2019s main home?<\/h3>\n<p>The starting point is <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000046194366\" target=\"_blank\" rel=\"noopener\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000046194366\" data-kohen-legifrance-title=\"Texte officiel Legifrance\">Article L. 115-3 of the French Social Action and Families Code<\/a> (<em>Code de l\u2019action sociale et des familles<\/em>). Its wording places water within the year-round protection against a supply being interrupted for non-payment at a main residence. The important point is not the nationality written on the account. The important facts are the nature of the supply, the reason given for the proposed interruption, and whether the address is the household\u2019s main home.<\/p>\n<p>The Constitutional Council confirmed the strength of this rule in <a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000030649964\" target=\"_blank\" rel=\"noopener\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000030649964\" data-kohen-legifrance-title=\"Texte officiel Legifrance\">Decision no. 2015-470 QPC of 29 May 2015<\/a>. It held that the legislature could guarantee access to water throughout the year in every main residence, even when bills had not been paid, and that the rule was not disproportionate because the distributor retains debt-recovery remedies. In practical terms, a water company may demand payment, send formal notices and bring recovery proceedings; it may not use the physical supply to punish non-payment at the protected main home.<\/p>\n<p>This protection should be stated carefully. It is a protection against a cut-off based on unpaid bills. It is not a promise that every water connection will remain open in every situation. A supplier may need to stop a service temporarily for reasons such as a serious public-health risk, contamination, urgent works, an unsafe installation, a fraudulent connection or a technical emergency. Those reasons should be identified separately from an ordinary debt. A letter saying \u201cnon-paiement\u201d or \u201cimpay\u00e9\u201d is not transformed into a lawful safety intervention merely because the supplier uses threatening language.<\/p>\n<p>The address also matters. A permanent home occupied by the British resident is not the same legal situation as a holiday property used only for visits. The statute\u2019s protection is tied to the main residence. A second home, an empty investment property, business premises, a communal supply, or a landlord\u2019s account may require a different analysis. A tenant should also identify who contracts with the water service. In some buildings the individual pays the service directly; in others the charge passes through a landlord, a property manager or a building association. The no-disconnection argument must be matched to the actual account and the actual supply.<\/p>\n<p>If the supplier has merely threatened a cut, do not wait for the threatened date. Send a written notice immediately identifying the property as your <em>r\u00e9sidence principale<\/em> (main residence), attach proof of occupation, and refer to Article L. 115-3 and Decision no. 2015-470 QPC. Ask the supplier to confirm in writing that no interruption will be carried out for the disputed debt. Keep the threat, envelope, email headers, account reference and any automated payment message. These items can later show that the dispute concerned non-payment rather than a technical emergency.<\/p>\n<h3>B. What can the water service still demand, notify and recover?<\/h3>\n<p>No-disconnection protection is not debt cancellation. A British resident who has received a correct bill remains expected to pay it, or to agree a payment plan, even if the water cannot lawfully be cut off at the main home. Article L. 115-3 itself preserves the distributor\u2019s ability to recover the debt. The document is therefore not decorative. It can determine whether a reading was valid, when a notice was due, and which internal complaint address must be used.<\/p>\n<p>The public service\u2019s charges also have a legal basis. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000027319802\" target=\"_blank\" rel=\"noopener\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000027319802\" data-kohen-legifrance-title=\"Texte officiel Legifrance\">Article L. 2224-12-1<\/a> governs the financing of drinking-water and sanitation services. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000022495934\" target=\"_blank\" rel=\"noopener\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000022495934\" data-kohen-legifrance-title=\"Texte officiel Legifrance\">Article L. 2224-12-2<\/a> addresses the charges that may be imposed and the limits on how they are calculated. The customer should therefore separate three questions: was water actually supplied, was the invoice calculated under the service rules, and is the sum now being pursued legally due?<\/p>\n<p>French contract law also matters where the service relationship is contractual. Under <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000032040777\" target=\"_blank\" rel=\"noopener\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000032040777\" data-kohen-legifrance-title=\"Texte officiel Legifrance\">Article 1103 of the Civil Code<\/a>, \u201cLes contrats l\u00e9galement form\u00e9s tiennent lieu de loi \u00e0 ceux qui les ont faits.\u201d In English, a lawfully formed contract binds the parties as law. That does not allow a supplier to contract out of the statutory no-disconnection protection. It does mean that the service regulations, the agreed tariff and the account history can be used to establish what was supplied and what was owed.<\/p>\n<p>A formal demand to pay is called a <em>mise en demeure<\/em>. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000032042162\" target=\"_blank\" rel=\"noopener\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000032042162\" data-kohen-legifrance-title=\"Texte officiel Legifrance\">Article 1344 of the Civil Code<\/a> explains when the debtor is put formally in default. Do not treat every reminder as a judgment, but do not ignore a formal demand either. Check the sender, the account number, the dates and the stated deadline. If the letter threatens a water cut at the main home solely because of the debt, dispute that specific measure while continuing to challenge or pay the underlying sum according to the evidence.<\/p>\n<p>Where the amount is not disputed, paying it or proposing a realistic instalment plan is usually safer than allowing the dispute to be reduced to a collection file. Where only part is disputed, identify the undisputed amount and pay that amount if possible. Write that the payment is made without accepting the disputed balance. A payment does not automatically cure an unlawful cut or prove that a meter was accurate, but refusing every payment can make the later recovery argument harder.<\/p>\n<p>Households in financial difficulty should ask the local authority or social services about the <em>Fonds de solidarit\u00e9 pour le logement<\/em> (FSL), the housing solidarity fund, and the local <em>centre communal d\u2019action sociale<\/em> (CCAS), the municipal social action centre. The application should be made promptly, with bills, income evidence and proof of the main residence. The rules on maintaining the supply while assistance is considered are not a substitute for a billing dispute, but they can be relevant where the unpaid sum reflects hardship rather than a technical disagreement.<\/p>\n<p>The supplier may also pursue the debt through the courts. That is why the correct response is not \u201cthe water cannot be cut, so I can ignore the account\u201d. The correct response is \u201cthe water cannot be cut for this reason at this main residence, while the bill and any recovery claim must be examined separately\u201d. That distinction is the foundation of a credible written challenge.<\/p>\n<h2>II. How can a British resident challenge the bill and get urgent relief?<\/h2>\n<h3>A. Is the problem a protected non-payment dispute, a leak, or a meter error?<\/h3>\n<p>Many water disputes become confused because a customer raises a no-disconnection argument when the real financial issue is an abnormal consumption reading. French law has a separate mechanism for that situation. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000041410387\" target=\"_blank\" rel=\"noopener\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000041410387\" data-kohen-legifrance-title=\"Texte officiel Legifrance\">Article L. 2224-12-4, III bis of the General Local Authorities Code<\/a> deals with an \u201cabnormal\u201d increase when consumption is more than twice the average consumption over the previous three years. The rule can limit the amount charged when the increase results from a leak in the private part of the installation after the meter, subject to statutory conditions.<\/p>\n<p>The supplier must notify the customer of the abnormal increase, generally with or before the bill. The customer then has a short response period, normally one month from the notification, to send a plumber\u2019s certificate locating the leak and stating the date of repair, or to ask for the meter to be checked. If the required information was not provided, or if the supplier did not give the information required by the statute, the excess above the statutory threshold may not be payable. The rules are not a general discount for every large bill. They depend on the type of leak, the notice, the timing and the proof.<\/p>\n<p><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000026418286\" target=\"_blank\" rel=\"noopener\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000026418286\" data-kohen-legifrance-title=\"Texte officiel Legifrance\">Article R. 2224-20-1 of the General Local Authorities Code<\/a> gives the implementing detail. The relevant leak is generally after the meter and outside appliances, sanitary equipment and heating equipment. A leaking toilet mechanism, boiler, water softener or household appliance may therefore produce a large bill without falling within the same statutory cap. Ask the plumber to identify precisely where the water escaped. \u201cThere was a leak somewhere\u201d is weaker evidence than a dated certificate stating the location, the repair and the meter readings.<\/p>\n<p>The Cour de cassation has repeatedly required the notice and evidence to be taken seriously. In <a href=\"https:\/\/www.courdecassation.fr\/decision\/5fca96e9bd86368ba272d427\" target=\"_blank\" rel=\"noopener\">First Civil Chamber, 21 March 2018, no. 17-13.031<\/a>, the Court examined the requirement that the service inform the customer of the abnormal consumption and explain the steps needed to obtain the statutory reduction. The decision links the notice to the bill based on the actual meter reading. In <a href=\"https:\/\/www.courdecassation.fr\/decision\/6423d70c78684f04f5813fbf\" target=\"_blank\" rel=\"noopener\">First Civil Chamber, 29 March 2023, no. 22-14.487<\/a>, the Court stated: \u201cA d\u00e9faut d&#8217;information, l&#8217;abonn\u00e9 n&#8217;est pas tenu au paiement de la part de la consommation exc\u00e9dant le double de la consommation moyenne.\u201d The English meaning is that, without the required information, the customer is not liable for the part exceeding twice the average consumption.<\/p>\n<p>A meter challenge is different from a leak challenge. In <a href=\"https:\/\/www.courdecassation.fr\/decision\/60dc08b7f6c5197026403e6c\" target=\"_blank\" rel=\"noopener\">First Civil Chamber, 30 June 2021, no. 19-23.463<\/a>, the Court stated: \u201cil appartient \u00e0 l&apos;usager d&apos;un service de distribution d&apos;eau, qui invoque l&apos;inexactitude de la facturation \u00e9tablie \u00e0 partir du relev\u00e9 de son compteur, d&apos;apporter la preuve d&apos;une erreur de relev\u00e9, d&apos;un dysfonctionnement du compteur ou de toute autre anomalie.\u201d In English, the customer who says that billing based on the meter reading is wrong must prove a reading error, a meter malfunction or another anomaly. Take photographs, request a verification and preserve the readings rather than simply asserting that the amount looks impossible.<\/p>\n<p>Other decisions help define the evidence problem. In <a href=\"https:\/\/www.courdecassation.fr\/decision\/607dde46bdd797b53ae6e07c\" target=\"_blank\" rel=\"noopener\">First Civil Chamber, 24 March 2021, no. 19-13.871<\/a>, the Court considered arguments about abnormal consumption and the service\u2019s information obligations. In <a href=\"https:\/\/www.courdecassation.fr\/decision\/68b92decd5d722cabac541de\" target=\"_blank\" rel=\"noopener\">Third Civil Chamber, 4 September 2025, no. 24-17.470<\/a>, it described the service regulations as defining the user\u2019s obligations and held that \u201cl&#8217;action en r\u00e9paration de ce fait dommageable est fond\u00e9e sur les r\u00e8gles de la responsabilit\u00e9 contractuelle\u201d. That is a useful warning: if the dispute concerns damage caused by a failure of the water service, the claim may be contractual, and the service regulations will matter.<\/p>\n<p>These authorities create two separate tracks:<\/p>\n<ul>\n<li><strong>Supply track:<\/strong> is the supplier threatening or carrying out a water interruption for non-payment at the main residence? If yes, invoke Article L. 115-3 and the 2015 Constitutional Council decision.<\/li>\n<li><strong>Billing track:<\/strong> is the bill inflated by a post-meter leak, a missing notice, a wrong reading or a defective meter? If yes, use Articles L. 2224-12-4 and R. 2224-20-1, the service regulations and the relevant evidence.<\/li>\n<\/ul>\n<p>Both tracks can exist at once. A customer may be protected from a cut while still needing to send a plumber\u2019s certificate within one month. Conversely, a disputed leak cap does not give the supplier permission to cut the main home because the customer asked for verification. Put both points in the same letter, but do not let one obscure the other.<\/p>\n<h3>B. What evidence and urgent steps should be taken?<\/h3>\n<p>Begin with a dated evidence file. Save the bill as a PDF and keep the envelope if it arrived by post. Photograph the meter face, the meter number, the current index and the surrounding installation. Photograph any visible moisture, damaged pipe or repair. Write down when the property was occupied, whether it was empty, whether a tenant or contractor had access, and whether the meter was read physically or estimated. Gather the previous three years of bills if available. For a recent move, ask the former owner, landlord or property manager for the handover meter reading and the date on which responsibility changed.<\/p>\n<p>If a leak is suspected, close internal stop valves where safe and contact a qualified plumber. Ask for a written report, not just an invoice. The report should identify the location, state whether the leak was after the meter, record the date of discovery and repair, and give the meter reading before and after the work. If the plumber says that the problem came from a sanitary appliance or household equipment, ask that this be stated clearly; the classification can affect the statutory cap.<\/p>\n<p>If the meter itself is suspected, do not remove it or interfere with the seals. Request the verification procedure stated in the <em>r\u00e8glement de service<\/em>. Ask who performs the test, what technical standard is used, whether the customer can attend, how the meter is replaced or preserved, and who pays if it is accurate. A controlled verification is more persuasive than a private experiment with a bucket. Keep the supplier\u2019s appointment confirmation and the result.<\/p>\n<p>Send a written complaint to the supplier through every reliable channel identified in the service regulations: the online account, email and a <em>lettre recommand\u00e9e avec accus\u00e9 de r\u00e9ception<\/em> (LRAR), meaning registered post with acknowledgement of receipt. The subject line should be precise: \u201cDisputed water bill \u2014 main residence \u2014 no disconnection \u2014 request for leak or meter review\u201d. Include the account number, address, bill date, amount, meter index and the date of any threat. Attach the evidence in a numbered list.<\/p>\n<p>The letter should make four requests. First, ask the supplier to confirm that no interruption will be carried out for non-payment while the main residence is protected by Article L. 115-3. Secondly, ask for the calculation history, previous readings, estimated-reading explanation and the applicable service regulations. Thirdly, if the bill is more than twice the usual consumption, request the statutory information and state that you are asking for the Article L. 2224-12-4 review. Fourthly, ask the supplier to suspend collection of the disputed excess and to give a written answer within a defined period.<\/p>\n<p>Do not write that you \u201caccept the debt\u201d if your position is that the bill is wrong. Use a reservation such as \u201cI contest the disputed amount and reserve all rights\u201d. If part of the account is plainly due, say what that part is and pay it if you can. Ask for an instalment arrangement for the undisputed balance. A good letter is calm, factual and narrow: it gives the supplier a route to correct the account without forcing the entire matter into litigation.<\/p>\n<p>If the supply has actually been stopped, or if a disconnection is scheduled despite the written challenge, obtain urgent legal advice. The relevant urgent procedure is commonly called <em>r\u00e9f\u00e9r\u00e9<\/em>, an interim application seeking a rapid order before the court decides the whole dispute. The competent court and legal route depend on the contract, the identity of the supplier, whether the service is publicly operated or delegated, the status of the occupier and the exact measure taken. The application may seek restoration, an order preventing the cut, preservation of the meter evidence, or a direction that the supplier respond to the complaint. Do not assume that a threat from a debt collector is itself a court order, but do not ignore a court document or a bailiff\u2019s notice.<\/p>\n<p>A damages claim requires proof. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000032042341\" target=\"_blank\" rel=\"noopener\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000032042341\" data-kohen-legifrance-title=\"Texte officiel Legifrance\">Article 1353 of the Civil Code<\/a> sets out the basic burden-of-proof principle: the person asserting performance or a fact must prove it, while the person claiming release must justify the event that released the obligation. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000032010123\" target=\"_blank\" rel=\"noopener\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000032010123\" data-kohen-legifrance-title=\"Texte officiel Legifrance\">Article 1231-1 of the Civil Code<\/a> concerns damages for non-performance or delay in a contractual obligation. Those provisions do not automatically produce compensation. They explain why photographs, readings, receipts, accommodation costs, medical evidence and the chronology of the supplier\u2019s conduct should be preserved.<\/p>\n<p>Before approaching a mediator, use the supplier\u2019s formal complaint route and keep proof of it. A mediator can help with a billing and service dispute, but mediation does not make an unlawful cut lawful and does not replace an urgent court application where water has already been interrupted.<\/p>\n<p>For a British household, prepare a short French summary even if the main correspondence is in English. Use the French account terms exactly as they appear on the bill: <em>abonn\u00e9<\/em> (subscriber), <em>facture<\/em> (bill), <em>relev\u00e9<\/em> (meter reading), <em>fuite apr\u00e8s compteur<\/em> (post-meter leak), <em>\u00e9cr\u00eatement<\/em> (the statutory reduction or cap), <em>mise en demeure<\/em> (formal demand), and <em>r\u00e9sidence principale<\/em> (main residence). Translating the legal theory into the supplier\u2019s own vocabulary reduces the risk that a general customer-service reply misses the actual request.<\/p>\n<p>Finally, do not confuse a water dispute with an immigration dispute. A British person may need a Withdrawal Agreement card, a long-stay visa or another residence document, but the supplier\u2019s duty not to cut the main home for an unpaid bill does not depend on having a French passport. Conversely, residence status does not by itself cancel a bill. Keep the immigration documents as proof of occupation when useful, while making the water argument under the French water and civil-law rules.<\/p>\n<h2>Conclusion<\/h2>\n<p>A French water supplier cannot use a debt-based disconnection to deprive a protected main residence of water throughout the year. That rule applies to a British resident after Brexit and is supported by Article L. 115-3 of the Social Action and Families Code and Constitutional Council Decision no. 2015-470 QPC. It does not erase the debt, prevent a lawful recovery claim or resolve a disputed meter reading.<\/p>\n<p>The practical response is therefore two-track. Challenge any threatened cut immediately and identify the property as the <em>r\u00e9sidence principale<\/em>. At the same time, preserve the meter and billing evidence, obtain a precise plumber\u2019s report where there is a leak, request a meter check where appropriate, and use the one-month statutory timetable when an abnormal-consumption notice is involved.
