It may refer to a missing medical certificate, a request for a medical examination, an adverse medical opinion, a prefectural decision, or a technical closure of an otherwise valid application. Each situation has a different response. The first question is therefore not \u201cHow do I argue with ANTS?\u201d but \u201cWhich document has actually refused what, and on what date?\u201d<\/p>\n<p>The Brexit timetable also matters. A UK licence issued before 1 January 2021 may be recognised under the exchange arrangements applicable to holders of an EU-era licence. Why can a British licence exchange be refused on medical grounds in France?<\/h2>\n<h3>A. Which Brexit rule and deadline apply to your UK licence?<\/h3>\n<p>Start with the status of the licence, not with the wording of an automated portal message. A British driving licence is a <em>permis de conduire<\/em>, the French term for a driving licence. Its issue date, the date on which you became normally resident in France and the category shown on the licence determine the legal route. Keep a colour scan of both sides of the licence, the issue and expiry dates, the categories, any restriction codes and the document showing your right to stay in France.<\/p>\n<p>French law uses the concept of <em>r\u00e9sidence normale<\/em>, meaning normal residence. In practical terms, it is the place where a person lives for at least 185 days in a calendar year because of personal or professional ties, subject to the specific rules for a person whose personal and professional ties are in different countries. The definition is set out in <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000032289687\/2026-05-08\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000032289687\/2026-05-08\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article R. 221-1 of the French Highway Code<\/a>. A British applicant who merely owns a French property, visits for several weeks or receives post there has not automatically proved normal residence. Conversely, a person who works, lives with family and maintains ordinary daily life in France will normally need evidence showing that reality rather than a single utility bill.<\/p>\n<p>The evidence should be coherent over time. Examples include a residence permit or application receipt, a lease, a home insurance certificate, electricity or internet bills, tax correspondence, employment documents, school records, medical registration, bank statements showing ordinary French expenditure and evidence of the date of installation. The file should explain any gap: a temporary stay in the United Kingdom, a move between French addresses, accommodation with a partner or a period spent in hospital can otherwise look like a failure to meet the residence condition. Do not send a random bundle. Label each document with the period it covers and state the proposition it proves.<\/p>\n<p>For licences issued before the end of the transition period, the French public guidance confirms that a UK licence can continue to be recognised while it remains valid, with exchange becoming necessary in the situations described by the guidance, including expiry, loss, theft, damage, a serious traffic offence or a change of personal information. The relevant Service-Public page is <a href=\"https:\/\/www.service-public.gouv.fr\/particuliers\/vosdroits\/F1758\">Driving in France with a European licence<\/a>. The page specifically covers the United Kingdom and distinguishes a licence issued before 2021 from one issued after that date. A pre-2021 licence is therefore not automatically invalid merely because the United Kingdom left the European Union.<\/p>\n<p>A licence issued from 1 January 2021 must be examined under the post-Brexit exchange route. The practical government guidance on <a href=\"https:\/\/www.gov.uk\/guidance\/living-in-france\">living in France<\/a> states that a post-2021 UK licence should be exchanged within the applicable period after arrival and that the application is made through ANTS. The UK guidance also refers applicants to the DVLA or DVA check code, depending on the issuing authority. The parallel <a href=\"https:\/\/www.gov.uk\/guidance\/driving-in-the-eu-uk-licence-holders-living-in-the-eu\">GOV.UK guidance for UK licence holders living in the EU<\/a> explains the one-year recognition period for a licence issued after 1 January 2021. These pages are useful, but the notification and dates in the individual French file remain decisive.<\/p>\n<p>The French Highway Code states that a foreign licence from outside the European Economic Area is recognised for a limited period following the acquisition of normal residence. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000035977232\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000035977232\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article R. 222-3<\/a> states, in the relevant rule, <span lang=\"fr\">\u00ab Au terme de ce d\u00e9lai, ce permis n&#8217;est plus reconnu \u00bb<\/span>. In English, once the period ends, the foreign licence is no longer recognised for driving in France. That sentence is why an applicant should never wait for an informal answer after the deadline has passed. If the application was filed in time, keep the submission receipt, every request for an additional document and every response showing that the file remained active.<\/p>\n<p>The complementary rule for a licence obtained while the issuing state was subject to the European arrangements appears in <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000043927934\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000043927934\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article R. 222-1 of the French Highway Code<\/a>. The provision deals with the recognition of a licence issued by a state which was a member of the European Union or European Economic Area at the relevant time. The legal analysis cannot be reduced to the nationality printed on the passport. The authority may examine where the licence was obtained, where the holder had normal residence when it was obtained and whether the licence is valid, genuine and not subject to a suspension, withdrawal or cancellation.<\/p>\n<p>The current exchange mechanism is described by the French online service <a href=\"https:\/\/www.service-public.gouv.fr\/particuliers\/vosdroits\/R55669\">Exchange of a foreign driving licence<\/a>. It is an online process and the page offers an English version. The service also records the current administrative charge, which is stated by Service-Public in its <a href=\"https:\/\/www.service-public.gouv.fr\/particuliers\/actualites\/A18887?lang=fr\">current information on the foreign-licence exchange fee<\/a>. Fees and technical instructions can change, so use the official page displayed at the time of filing and retain the payment confirmation if one is required.<\/p>\n<p>The implementing order makes the residence condition explicit. Article 5 of the <a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000045807199\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000045807199\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">12 January 2012 order on the exchange of driving licences issued by non-European states<\/a> includes the condition <span lang=\"fr\">\u00ab Avoir acquis sa r\u00e9sidence normale en France \u00bb<\/span>. The same provision requires a valid licence regularly issued by the state in which the holder had normal residence and excludes a licence that is suspended, withdrawn or cancelled. It also refers to a medical fitness examination where French rules require one. The date and nature of the French residence are consequently not background details; they are part of the legal conditions for exchange.<\/p>\n<p>For a British person, the result is a four-date test:<\/p>\n<ol>\n<li>When was the UK licence issued or obtained?<\/li>\n<li>When did normal residence in France begin?<\/li>\n<li>When does the French recognition or exchange deadline expire?<\/li>\n<li>When was the ANTS request, document request, medical opinion or refusal notified?<\/li>\n<\/ol>\n<p>Write those dates on one page before replying. If the dates are uncertain, identify the uncertainty and attach the best available evidence. A refusal often becomes harder to challenge when the applicant answers a legal deadline with a general explanation about having lived in France \u201cfor some time\u201d. The authority needs a chronology capable of being checked.<\/p>\n<p>Do not assume that an application was filed merely because an ANTS account was created. Save the final submission confirmation, the dossier number, the timestamp, the uploaded file list and any email generated by the service. A draft application, a payment without final submission or a document uploaded to the wrong category may not have the same legal effect as a complete application. If the portal does not display the status, take a dated screenshot and request written confirmation through the official contact channel.<\/p>\n<h3>B. Is the issue a medical examination, a missing document or a true refusal?<\/h3>\n<p>The expression \u201cmedical refusal\u201d covers several legally different events. First, ANTS may say that the file is incomplete because a medical form or opinion is absent, illegible, out of date or issued by the wrong doctor. Secondly, the administration may require a medical examination because the applicant\u2019s circumstances or the licence category triggers a control. Thirdly, an approved doctor or medical commission may issue an opinion of temporary fitness, fitness with restrictions or unfitness. Finally, the prefect, the local state authority responsible for the administrative decision, may adopt a decision refusing or restricting the exchange on the basis of that opinion. Only the final event is normally a refusal decision in the legal sense.<\/p>\n<p>This distinction matters because an ANTS status line is not necessarily the operative decision. Ask the administration to identify the act on which it relies: the date, author, legal basis, category affected, medical document considered, and available remedies. A portal message that says \u201cmedical fitness required\u201d calls for a compliant examination. A letter from the prefect saying that the exchange is refused calls for an analysis of the medical opinion, the reasons and the appeal route. A return of documents for \u201cincomplete file\u201d calls for rapid completion, not an argument that the medical conclusion is wrong.<\/p>\n<p>For ordinary car and motorcycle categories, French law does not impose a medical visit in every case. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000051682550\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000051682550\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article R. 221-10 of the French Highway Code<\/a> lists the categories for which a prior medical visit is generally not required, while preserving the exception <span lang=\"fr\">\u00ab sauf lorsqu&#8217;elle est exig\u00e9e en application de l&#8217;article R. 226-1 \u00bb<\/span>. That exception is important. A health condition, a restriction, a previous medical decision, a particular category, a renewal situation or another circumstance may bring the applicant within the medical-control rules even where a routine B-category applicant would not need a visit.<\/p>\n<p><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000026203156\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000026203156\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article R. 226-1 of the French Highway Code<\/a> explains that the control concerns <span lang=\"fr\">\u00ab l&#8217;aptitude physique, cognitive et sensorielle \u00e0 la conduite \u00bb<\/span>. The assessment is therefore not limited to eyesight. Depending on the reason for the referral, it can concern alertness, mobility, neurological function, medication, cardiovascular risk, hearing, vision, substance use, or another condition relevant to safe driving. The legal question is not whether the applicant feels generally well; it is whether the condition meets the French driving standards for the requested category and any stated limitations.<\/p>\n<p>The examination is not simply a letter from the applicant\u2019s ordinary treating doctor. Under <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000037411528\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000037411528\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article R. 226-2 of the French Highway Code<\/a>, the control is carried out by a doctor approved by the prefect or, where the rules require it, by a medical commission. The Code refers to <span lang=\"fr\">\u00ab un m\u00e9decin agr\u00e9\u00e9 par le pr\u00e9fet \u00bb<\/span>. The approved doctor has a public-law function in this procedure and is not merely providing a private medical opinion for the convenience of the file. A specialist report can be useful evidence, but it does not automatically replace the prescribed examination or bind the authority.<\/p>\n<p>Prepare for the appointment as if it were an evidence hearing. Bring the UK licence, identity document, French residence evidence, the ANTS correspondence, the exact category requested, glasses or corrective devices used for driving, current prescriptions and relevant reports. Bring a concise chronology of the condition and treatment. Explain functional consequences honestly: fatigue, episodes of loss of consciousness, visual field problems, hypoglycaemia, sleep-related impairment, mobility limits and medication side effects can matter. Do not conceal a condition because the aim is to obtain an exchange. An inconsistent answer can damage both credibility and safety.<\/p>\n<p>Ask the doctor or commission what document will be transmitted and when. Read the opinion before leaving if it is handed to you. If the document records the wrong category, a wrong identity, an incorrect medical history or a restriction that does not correspond to the examination, ask promptly for a correction in writing. Keep the original and provide copies unless the procedure expressly requires the original. If the opinion is temporary, note the expiry date. A temporary fitness opinion is not the same as a permanent refusal and should generate a renewal plan.<\/p>\n<p>The categories of outcome must be separated. Fitness without a restriction may allow the administrative exchange to continue if every other condition is met. Fitness with restrictions may require a French licence showing codes or a limited validity period. Temporary fitness may require a further examination before renewal. Unfitness may support a refusal or restriction and triggers a different appeal strategy. A portal operator cannot convert one category into another by telephone. Obtain the underlying written opinion and the prefectural decision so that the remedy addresses the actual outcome.<\/p>\n<p>The file also needs a document audit unrelated to medicine. The implementing order\u2019s Article 6 sets out the online process and the supporting evidence in <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000045807210\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000045807210\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">its official L\u00e9gifrance text<\/a>. It refers to the licence, an official French translation where required, proof concerning the licence rights, identity, residence, stay and, where applicable, the medical opinion. For a UK licence, the authority may need a recent driving-rights or entitlement certificate from the UK issuing authority. The ANTS checklist may request a document with a recent issue date. Uploading an old certificate simply because the information is factually true can still leave the application incomplete.<\/p>\n<p>A \u201crefusal\u201d caused by a missing translation or missing rights certificate should not be pleaded as a medical case. Conversely, sending a new translation will not correct an adverse medical opinion. Divide the response into two files if necessary: a procedural file proving eligibility and a medical file addressing aptitude. This simple separation helps prevent the administration from overlooking an eligibility document because the medical discussion is lengthy.<\/p>\n<p>Check the vehicle category with particular care. The standards and the period of validity can differ between a car, motorcycle, lorry, bus or vehicle with a trailer. The French Service-Public <a href=\"https:\/\/www.service-public.gouv.fr\/particuliers\/vosdroits\/R64185\">driving-licence exchange simulator<\/a> can help identify the ordinary route, but it cannot decide a disputed medical question. If the applicant requests an exchange for several categories, an issue affecting one category may not necessarily justify refusing every category. Ask the administration to state precisely whether the medical reason concerns all requested categories or only one.<\/p>\n<p>Finally, distinguish a refusal to exchange from a separate decision affecting the right to drive. A refusal may mean that France will not issue a French licence, while an existing foreign licence may still be recognised for a remaining lawful period. A medical decision may, by contrast, affect the ability to drive immediately or impose restrictions. Do not infer the answer from the word \u201crefused\u201d alone. The practical right to drive must be checked against the exact document, the recognition period and any restriction or suspension already recorded.<\/p>\n<h2>II. How should a British applicant challenge the refusal without losing the right to drive?<\/h2>\n<h3>A. Which medical appeal and administrative remedy should you use?<\/h3>\n<p>There are normally two tracks to consider, and they should not be confused. The first is the medical appeal against an opinion or prefectural decision based on medical fitness. The second is an administrative challenge alleging an error about residence, the issue date of the UK licence, authenticity, missing evidence, the scope of a restriction, the reasoning or the procedure. A person may need to use both tracks, in parallel or successively, depending on the wording of the notification. The notification should state the available route; if it does not, request clarification immediately while preserving the shortest plausible deadline.<\/p>\n<p>For the medical track, <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000026203162\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000026203162\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article R. 226-4 of the French Highway Code<\/a> provides for an appeal to the medical commission against the prefect\u2019s decision based on the medical control. The provision states that <span lang=\"fr\">\u00ab L&#8217;appel form\u00e9 contre la d\u00e9cision du pr\u00e9fet n&#8217;est pas suspensif \u00bb<\/span>. That means an appeal does not, by itself, restore the right to drive or postpone the effect of the decision. The Service-Public explanation of <a href=\"https:\/\/www.service-public.gouv.fr\/particuliers\/vosdroits\/F1255\">medical control for a driving licence<\/a> also explains that the prefect\u2019s letter identifies the remedies and that the medical appeal must be followed while the decision remains effective.<\/p>\n<p>Read the appeal instructions literally. A medical commission appeal can require a form, copies of the opinion, the prefectural decision and supporting medical documents. It is not the same as asking the ANTS helpdesk to reopen an upload. An appeal should explain the disputed finding in functional terms, identify the new or overlooked evidence and request the outcome sought: fitness, fitness with a specified restriction, a further examination, or a correction of an administrative error. A long medical history without a clear request makes the reviewing body\u2019s task harder.<\/p>\n<p>The medical appeal route may not correct a non-medical legal error. If the refusal says that the applicant was not normally resident in France when the licence was obtained, that the licence was suspended in the United Kingdom, that the exchange deadline had expired or that a required certificate was absent, those issues require a written administrative response with evidence. State which factual finding is wrong and attach the document that disproves it. If both medical and residence issues exist, title the sections separately so that the medical commission does not appear to be asked to decide a residence question outside its remit.<\/p>\n<p>The administrative decision should normally be reasoned. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000031367505\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000031367505\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article L. 211-2 of the Code of Relations between the Public and the Administration<\/a> requires reasons for specified adverse individual administrative decisions. The Code describes the right to be informed of the reasons for adverse decisions as <span lang=\"fr\">\u00ab le droit d&#8217;\u00eatre inform\u00e9es sans d\u00e9lai des motifs des d\u00e9cisions administratives individuelles d\u00e9favorables \u00bb<\/span>. A notification that merely says \u201cmedical grounds\u201d may be inadequate if it does not identify the decisive opinion, the legal basis or the remedy. Do not assume that a poor explanation automatically wins the case, but request the full decision and the documents on which it relies.<\/p>\n<p>There may be a useful distinction between an internal portal status and a formal notification. The two-month judicial deadline is generally calculated from notification or publication of the challenged decision. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000039807005\/2026-04-29\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000039807005\/2026-04-29\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article R. 421-1 of the Code of Administrative Justice<\/a> states: <span lang=\"fr\">\u00ab La juridiction ne peut \u00eatre saisie que par voie de recours form\u00e9 contre une d\u00e9cision, et ce, dans les deux mois \u00e0 partir de la notification ou de la publication de la d\u00e9cision attaqu\u00e9e. \u00bb<\/span> The applicant should record the date on which the decision was placed in the ANTS account, the date of the email and the date of receipt of a registered letter. If the dates differ, keep all three.<\/p>\n<p>A request for reconsideration by the prefect is commonly called a <em>recours gracieux<\/em>, meaning an informal administrative appeal to the authority that made the decision. A hierarchical appeal to a superior authority is a <em>recours hi\u00e9rarchique<\/em>. Either can be useful where the problem is a clear document error, but neither should be used as an excuse to let the judicial deadline expire without advice. Send the appeal through a channel that proves delivery, state the original decision date and attach a complete copy. Ask for an acknowledgement and a written answer. If urgent driving consequences exist, explain them, but do not describe urgency as a legal suspension of the decision.<\/p>\n<p>Recent administrative case law illustrates why the remedy information matters. In <a href=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000051468690\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000051468690\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Conseil d\u2019\u00c9tat, 5th\u20136th chambers sitting together, 14 April 2025, no. 475678<\/a>, the Conseil d\u2019\u00c9tat held, on the facts of that case, that <span lang=\"fr\">\u00ab le d\u00e9lai de deux mois fix\u00e9 par l&#8217;article R. 421-1 du code de justice administrative ne lui \u00e9tait pas opposable \u00bb<\/span> because the required information about remedies was not properly given. This is not a general licence to ignore a deadline. It is a warning to inspect the notification: the remedy information, the address of the competent tribunal administratif, the time limit and the date of notification can all become legally significant.<\/p>\n<p>The date on which the administration decides can also matter. Preserve the version of the official instructions used when filing and identify any change that occurred while the application was pending.<\/p>\n<p>Procedural fairness can also be relevant where the authority relies on a problem that could be corrected. In <a href=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000032721211\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000032721211\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Conseil d\u2019\u00c9tat, 16 June 2016, no. 385123<\/a>, the court examined the consequences of an exchange refusal linked to a document and the opportunity to regularise the file. That decision must be applied to its own facts, not copied mechanically into a driving-licence dispute. It nevertheless supports a practical point: identify whether the administration has treated a correctable document defect as a definitive failure, and show the authority exactly how the defect has been cured.<\/p>\n<p>A judicial challenge is brought before the competent <em>tribunal administratif<\/em>, the administrative court, through the proper procedure. The following order is practical:<\/p>\n<ol>\n<li>A one-page chronology: licence issue date, move to France, residence documents, ANTS submission, additional-document requests, medical appointment, opinion and refusal.<\/li>\n<li>The complete ANTS acknowledgement, dossier number, uploaded-document list and screenshots of the current status.<\/li>\n<li>Both sides of the UK licence, the UK driving-rights or entitlement certificate and any document explaining a replacement, renewal or change of address.<\/li>\n<li>Identity and French residence documents covering the relevant period, with an explanation of any periods outside France.<\/li>\n<li>The refusal or restriction decision in full, including the page explaining remedies and deadlines.<\/li>\n<li>The medical opinion, appointment record and reports that address the specific functional issue, rather than a general statement of good health.<\/li>\n<li>A short legal response divided into eligibility, medical fitness, procedure and requested outcome.<\/li>\n<\/ol>\n<p>Translate only what needs to be understood by the French authority, using an official translator when the instructions require it. Keep the original English documents beside the translation. A translation should preserve dates, category codes, restriction codes, signatures and issuing authorities. If a UK document uses a date format that could be misunderstood, write the date in words in the explanatory chronology. Never edit a scan to make it appear French. Submit the original and the translation as separate, clearly named files.<\/p>\n<p>For medical evidence, relevance is more persuasive than volume. A report should identify the diagnosis or event, the treatment, the date of the last episode, the functional impact on driving, the category of vehicle, the expected evolution and the reason the French standard is met. Where medication is involved, ask the clinician to address alertness and any driving warning. Where eyesight is involved, include the measurement with and without correction and the visual-field result if relevant. Where episodes are intermittent, provide the frequency and the period without an episode. A general letter saying \u201cfit to drive\u201d may not answer the legal question if it does not address the applicable French category.<\/p>\n<p>Ask for the medical records on which the adverse opinion relied, subject to the applicable rules on access to personal health information. If a report contains a factual error, mark the precise sentence and supply the correction. If the opinion is unclear, ask the issuing doctor or commission to explain whether the conclusion is unfitness, temporary fitness, fitness with restrictions or an inability to reach a conclusion because documents were missing. The appeal should not guess.<\/p>\n<p>The applicant should also ask ANTS or the prefecture to state whether the file is still under review or has been closed. Use the official contact route associated with the dossier and keep proof of each message. A telephone conversation can be useful for identifying the missing document, but it is not a substitute for a written record. After a call, send a short message: \u201cFollowing today\u2019s call, please confirm whether the file requires an approved medical examination, a missing document, or an appeal against a prefectural decision.\u201d This creates a clear question and reduces the risk of responding to the wrong event.<\/p>\n<p>While an exchange application is pending, driving rights depend on the recognition of the UK licence and on the documents issued during the process. Service-Public explains that an applicant may be able to drive while the exchange is being examined, and that after the original licence has been sent, a secure deposit certificate, commonly called an <em>attestation de d\u00e9p\u00f4t s\u00e9curis\u00e9e<\/em> or ADS, can provide a temporary document for a defined period. The one-year recognition period and the conditions on the certificate matter. Read the dates and categories on the document; do not treat an email confirming receipt as an ADS unless it is identified as such by the administration.<\/p>\n<p>If the decision is based on medical unfitness or a restriction, the non-suspensive nature of the medical appeal becomes central. Do not drive merely because an appeal has been filed. The appeal may ultimately produce a more favourable opinion, but it does not itself create a temporary French licence. The safest evidence is a written document showing the present authorisation, categories and expiry date.<\/p>\n<p>For a refusal based on an incomplete file, the immediate objective is different. Upload the missing document within the stated period, use the exact document category and write a short explanation in French or in the language accepted by the portal. If the portal no longer accepts uploads, ask for reopening or provide the file through the channel stated in the notification. Keep the original refusal and show that the correction was attempted before the deadline. If the administration has already made a final decision, a new upload may not replace an appeal; ask for confirmation.<\/p>\n<p>For a refusal based on residence, assemble evidence by month rather than by type. A bank statement in March and a utility bill in November may not prove the whole period. Combine accommodation, work, family, tax and day-to-day evidence. Explain why a UK address appears on a document. A person who has retained a UK home can still be normally resident in France, but the file must explain the centre of ordinary life. The question is factual and can be assessed from the full circumstances.<\/p>\n<p>For a refusal based on the issue date or issuing residence of the UK licence, obtain the historical driving record and evidence of where you were resident when the licence was issued. A UK passport alone does not prove the issuing state\u2019s legal conditions. If the licence was exchanged from another country, disclose that history. The authority may ask whether the original licence was obtained in the country of normal residence or whether an exchange chain is being presented as a UK qualification. Honest disclosure is safer than allowing a later discovery to appear as concealment.<\/p>\n<p>For a refusal based on authenticity or a suspension, contact the UK issuing authority and obtain an official explanation. A DVLA or DVA check code may prove current entitlement, but it may not answer every historical question. Show whether the licence is valid, whether categories were removed, whether a medical restriction exists in the United Kingdom and whether a replacement was issued. If the French authority has relied on an outdated database entry, request correction with the authoritative record.<\/p>\n<p>For a refusal based on an adverse medical opinion, do not simply submit more pages. The appeal should answer the reason for the opinion. If the doctor considered a condition incompatible with driving, provide the current clinical position and the applicable category-specific evidence. If the decision is based on a missing test, complete that test. If the issue is a restriction code, explain why the code is inaccurate or accept it and ask for the exchange to proceed with the correct limitation. The exchange file should still be accurate. Residence documents, the right to stay and driving entitlement are connected facts, and inconsistent statements can create unnecessary difficulty. Use the correct French terms in the cover letter, but write the explanation in clear English if the channel permits it and attach a French summary of the key facts. An English-speaking lawyer can help ensure that the medical and administrative wording does not create an unintended admission.<\/p>\n<p>The same discipline applies to a family member assisting the applicant. A spouse or relative may upload documents, but the applicant should authorise access where required, keep the ANTS credentials secure and sign the appeal. Medical information is sensitive. Send it only through the channel identified by the authority or the approved medical process. Do not put medical reports in an open social-media message or a general email address when a secure upload channel exists.<\/p>\n<p>Where the applicant lives in France but works partly in the United Kingdom, add a short explanation of travel patterns. Frequent travel does not automatically defeat normal residence, but unexplained absences can lead the administration to question the 185-day condition. A calendar, employment contract, French accommodation records and family evidence may resolve the point. Avoid presenting tax residence as the only proof: tax residence and driving-licence normal residence are related factual questions but are not identical legal tests.<\/p>\n<p>Where the applicant has a French residence permit issued under the Withdrawal Agreement, include it and explain its dates. Do not assume that the permit alone proves every condition, and do not omit it because the applicant also holds a UK passport. The administrative record should show why the present request is different.<\/p>\n<p>If the refusal is urgent and the appeal deadlines are close, prioritise preservation of rights. File the shortest defensible appeal with the available documents, request access to missing reasons or records, and supplement promptly. An applicant can explain that additional medical evidence has been requested. Missing a deadline in the hope of producing a perfect file later can be more damaging than filing a complete initial challenge and supplementing it.<\/p>\n<p>The strongest file answers five questions in its first pages: why France is the relevant normal residence, why the UK licence is within the applicable recognition and exchange route, what precise medical or administrative finding is disputed, which evidence proves the correction, and what remedy is requested by what date. If those answers are clear, the authority can address the merits instead of searching through the file for its basic structure.<\/p>\n<h2>Conclusion<\/h2>\n<p>An ANTS refusal on medical grounds is a starting point for classification, not a complete explanation. Establish whether the issue is the Brexit status of the UK licence, the one-year recognition period, normal residence, an absent document, a required medical examination, an adverse medical opinion or a formal prefectural decision. The answer determines the evidence and the remedy.
